AGENDA ITEM SUMMARY
Meeting Date: 11/10/2026
Agenda Number: 10C
Action Item
Title: Resolution Authorizing the Mayor to Sign a Ten-Page Interlocal Agreement Pertaining to
the Yakima Valley Local Crime Lab (YVLCL), Whereby Selah Will Receive Regional Forensic
Laboratory Services through the End of 2029
From: Police Chief, Michael Gause
Action Requested: Approval
Staff Recommendation: Approval
Board/Commission Recommendation: Approval
Fiscal Impact: The Yakima Valley Local Crime Lab (YVLCL) operates pursuant to a written
Interlocal Agreement (ILA) entered into between its constituent members. The ILA establishes
a cost-sharing structure based upon the population of each participating member jurisdiction, with
population figures updated annually per figures published by the Washington State Office of
Finance Management. The fiscal impact for Selah to continue being a member of the YVLCL in
2027 is estimated at fourteen thousand three hundred eleven dollars ($14,311.00), which equates
toa one thousand three hundred and one dollar ($1,301.00) increase from 2026. Selah’s fiscal
impact for each future year would be determined later.
Funding Source: 139 Law & Justice Fund (3/10th)
Background/Findings/Facts: The City recently began contracting—along with other area
municipalities—for regional forensic laboratory services, from the recently-established Yakima
Valley Local Crime Lab (YVLCL).
The current Interlocal Agreement (ILA) between the City and the other municipalities is set to
expire at the end of 2026. A proposed new ten-page ILA has been drafted, to cover YVLCL
services for a new three-year term running from January 1, 2027 through December 31, 2029. A
copy of proposed new ILA is submitted with the instant AIS and it has been reviewed by the City
Attorney. The terms of the proposed new ILA are acceptable to the Chief of the City’s Police
Department and the Chief has recommended that it be approved and entered.
Under the new ILA, the City of Union Gap would begin serving as the Fiduciary and
Administrative Manager of the YVLCL and, in that role, would oversee the administrative and
financial functions of the laboratory including financial management, personnel, procurement,
budgeting, facility needs, regulatory compliance, and related administrative responsibilities.
Union Gap will collect/retain an administrative fee of five percent (5.00%) of the total operating
costs of the laboratory, and, further, Union Gap will have final authority to establish the yearly
budget of the laboratory.
Selah’s anticipated cost for 2027 is $14,311.00, and Selah’s estimated cost for each future year
will be determined at a later date.
A proposed Resolution is submitted with the instant AIS that, if approved, will authorize the
Mayor to sign the new 10-page ILA.
Recommended Motion: I move to approve the Resolution in the form presented.

This Agreement/ILA becomes effective on January 1st 2027. This Agreement shall
remain in effect for an initial term of three (3) years and will automatically renew
for additional three-year terms unless terminated under Section 14. The Executive
Board may recommend adjustments during renewal cycles.
6. Funding & Cost-Sharing.
The term "Operating Costs" as used in this section means all costs reasonably incurred
by the City of Union Gap in operating YVLCL, including but not limited to personnel
costs (salaries, benefits, and overtime), equipment purchase, maintenance, and
calibration, laboratory supplies and consumables, facility costs (rent, utilities, janitorial,

The term "Population" as used in this section means the official population of each
Member City as most recently determined by the Washington State Office of Financial
Management ("OFM") pursuant to RCW 43.62.030, as published annually on April 1.
Each party’s proportionate share of Operating Costs for a given fiscal year ("Cost
Share") shall be calculated by dividing that party’s Population by the sum of the
Populations of all parties, and applying that percentage to the total Operating Costs for
the applicable billing period, as follows:
Member party Cost Share = (Member party Population ÷ Total Population of All Member
parties) × Total Operating Costs
Population figures shall be updated annually using the Office of
Financial Management population determination in effect as of April 1 of each year, and
the updated figures shall apply to invoices issued for the fiscal year beginning [January
1 / the following billing cycle].
Jurisdiction cost share will be invoiced immediately after budget approval but no later
than December 31st of each year. Invoices will be due January 31st for the following
year. If a member's cost share is not paid by February 10th, lab services will
be suspended until paid in full.
7. Nondiscrimination.
All parties agree not to discriminate against any person on the grounds of race, creed,
color, religion, national origin, sex, sexual orientation, gender identity, veteran status,
pregnancy, age, marital status, political affiliation or belief, or the presence of any

12101 et seq.) or any other applicable state, federal or local law, rule or regulation.
8. Budgeting.
By September 1st of each year, the City of Union Gap shall prepare and distribute to
each Member City a proposed annual YVLCL budget for the following fiscal year,
including estimated Operating Costs and each Member City's estimated Cost Share.
Member Cities shall have [30] days to review and comment on the proposed budget.
The City of Union Gap shall consider comments in good faith but retains final budget
authority.
Within [90] days after the close of each fiscal year, the City of Union Gap shall provide
each Member City with a reconciliation statement comparing actual Operating Costs to
budgeted Operating Costs. Any surplus or deficit shall be reallocated to the reserve fund
of the YVLCL.
9. Administrative Fee.
In addition to the YVLCL’s annual operating costs, Union Gap shall assess an
administrative fee equal to five percent (5%) of the total operating costs. The fee shall
reimburse Union Gap for administrative services provided in support of YVLCL
operations, including payroll administration, procurement and contracting, policy
administration, fiscal management and accounting, and other general administrative
support.
10. Records & Audits.
Union Gap shall maintain all records in accordance with state law. Records will also be
retained according to the Secretary of State’s Retention schedule.
11. Relationship of Parties.

create employment relationships between YVLCL personnel and any jurisdiction other
than Union Gap. The YVLCL personnel are employees of the City of Union Gap and, as
such, do not report to or take direction from any other member agency.
12. Executive Board.
The Executive Board consists of the Police Chiefs of all participating cities, the Yakima
County Sheriff, and the Yakima County Prosecutor (non-voting). The Board provides
oversight, reviews policy proposals, evaluates operational performance, and makes
strategic recommendations to ensure alignment with regional needs. The Executive
Board has no direct supervisory authority over employees. The Board does not
Yakima Valley Local Crime Lab ILA Page | 3
conduct discipline, evaluation, or personnel actions but may provide
recommendations. Any direction from the Board flows to Union Gap management, not
straight to employees.
The members of the Board shall elect a presiding officer to serve a term of two (2)
years. The Board may also elect a deputy presiding officer from its membership to
act as the presiding officer when the presiding officer is unavailable. The presiding
officer and deputy presiding officer will serve staggered two-year terms, except that the
presiding officer's first term will be three years and the deputy presiding officer's first
term will be two years.
The presiding officer is responsible for facilitating meetings, providing notice
of meetings, and providing any materials in advance so that all participants are fully
advised of the agenda and items being discussed.
The Board shall meet quarterly unless otherwise determined by the Board. The
presiding officer shall provide no less than seventy-two (72) hours’ notice of all meetings
to all members of the Board. However, in an emergency, the presiding officer may
conduct a telephonic or virtual meeting to resolve any issues related to the
emergency.
13. Confidentiality.
All forensic data, reports, and information generated by YVLCL shall be confidential
except as required by law. Parties shall safeguard forensic materials and adhere to
public records and evidence-handling standards. At all times, the entities will comply
with the Public Records Act ( RCW 42.56 et seq and other disclosure laws.
14. Compliance with Laws.
In operating the YVLCL, the City of Union Gap and the other Parties to this agreement
will comply with all laws. This includes any and all applicable laws, rules, and
regulations adopted or promulgated by any governmental agency or regulatory body,
whether federal, state, local, or otherwise, including policies adopted by the County, as
those laws, ordinances, rules, regulations, and policies now exist or may hereafter be
amended or enacted.
15. Property Ownership.
All equipment, software, and supplies purchased using YVLCL funds before January
1, 2027, shall remain titled to Yakima County (equipment purchased with ARPA
funds). Any equipment purchased after January 1, 2027, shall remain titled to Union
Gap. Property reassignment or disposal must comply with state and federal
guidelines.
Yakima Valley Local Crime Lab ILA Page | 4
16. Termination and Withdrawal.
Any Party may withdraw with 180 days’ written notice. Union Gap may, in consultation
with the executive board, terminate a Party for failure to pay assessments, a material
breach, or conduct that impedes lab operations. Remaining Parties may continue
YVLCL operations following withdrawal. Annual assessments are non-refundable. If a
Party withdraws, its payment obligations remain in effect through the end of the current
budget year.
17. Employee Status.
All YVLCL positions are contingent upon the continued existence of YVLCL.
Should YVLCL dissolve or undergo significant structural changes, Union Gap
may modify or eliminate positions. Union Gap shall consider the Executive Board's
feedback and recommendations when making hiring, restructuring, or employment
decisions.
18. Grievances and Complaints.
YVLCL employees shall follow Union Gap’s established personnel policies and
procedures for reporting workplace grievances, complaints, or disciplinary matters. The
Administrative Manager shall notify the Executive Board of issues that may affect lab
operations, interagency relations, or policy compliance. The Executive Board may
provide advisory input but shall not override Union Gap’s role as the employer of
record.
19. Scope of Work.
The YVLCL provides DNA testing, NIBIN operations, digital forensics, firearms analysis,
and trace evidence examinations. Additional services and technologies may be added
with Executive Board approval and available funding.
20. External Government Agency Participation.
Government entities outside Yakima County may utilize YVLCL on a fee-for-service
basis or request full membership. Full membership grants equal rights, responsibilities,
and participation in governance. Agencies seeking membership must submit a written
request to the Executive Board, which will evaluate the request and issue
recommendations. Final approval requires unanimous consent of all Parties via a formal
amendment. Cost allocation formulas may be updated to include new member
agencies.
Yakima Valley Local Crime Lab ILA Page | 5
21. Annual Reports.
Union Gap shall deliver an annual report summarizing service volume, case types,
turnaround times, staffing, budget performance, achievements, challenges, and
strategic recommendations. Reports support transparency and planning.
22. Liability.
Each Party shall indemnify and hold harmless the other Parties, and their officers,
employees, and agents, from all claims, losses, damages, judgments, and costs,
including reasonable attorneys' fees, to the extent caused by the negligent or wrongful
acts or omissions of the indemnifying Party or its own officers, employees, or
agents. The City of Union Gap is responsible for the acts and omissions of Lab
personnel it employs, within the scope of their employment. Each other Party is
responsible for the acts and omissions of its own personnel, including their handling and
submission of evidence to the Lab and their use or disclosure of Lab results. Where
fault is shared, each Party's responsibility is limited to its proportionate share of fault.
Each Party's personnel remain its own employees or agents for all purposes under this
Agreement. Nothing in this Agreement waives any Party's immunities or defenses or
creates rights in third parties. This section survives termination of this Agreement and
any Party's withdrawal.
23. Amendments.
Amendments must be in writing and signed by all Parties in order to be effective.
24. Integration.
This Agreement replaces all prior agreements related to the YVLCL.
25. Execution of Multiple Original Counterparts.
This Agreement may be reproduced in any number of original counterparts. Each party
needs to sign only one counterpart, and when the signature pages are all assembled
with one original counterpart, the compilation constitutes a fully executed and effective
agreement among all the participating jurisdictions. If fewer than all named parties
execute this agreement, the agreement once recorded as specified in Section 26 shall
be effective as between the parties that have executed the agreement to the same
extent as if no other party had been named.
26. Recording.
This interlocal agreement will be recorded in compliance with RCW 39.34.040.
27. Severability.
Yakima Valley Local Crime Lab ILA Page | 6
The parties agree that if any term of this ILA is held invalid by any court of competent
jurisdiction, that the remainder of the ILA terms shall remain valid and in full force and
effect.
28. Law, Venue & Jurisdiction.
This ILA shall be governed by the laws of the State of Washington. Any action, suit, or
judicial proceeding for the enforcement of this Agreement shall be brought in Yakima
County Superior Court.

AGENDA ITEM SUMMARY
Meeting Date: 11/10/2026
Agenda Number: 10D
Action Item
Title: Resolution Authorizing the Mayor to Sign a Local Agency Agreement Supplemental and a
Local Agency State Funds Project Prospectus, Pertaining to the City’s 1st Street Signalized
Intersection Improvements Project
From: Ty Jones, Public Works Director
Action Requested: Approval
Staff Recommendation: Approval
Board/Commission Recommendation: N/A
Fiscal Impact: Receipt and usage of $860,400.00 of state grant funds for ready-to-now-occur
CN Phase of the Project (with the total state grant funding amount, including the previously
completed PE Phase, being $958,000.00)
Funding Source: 111 Street Improvement (following receipt of state grant funds)
Background/Findings/Facts:
The Washington State Department of Transportation

amount of $958,000.00 to be applied toward the phases of the City’s in-progress 1st Street

previously applied toward the Design Phase (PE) of the Project, which PE Phase is now complete.
A remaining portion of the grant funds—specifically $860,400.00—will be applied toward the
now-ready-to-occur Construction Phase (CN) of the Project.
To facilitate the City receiving of CN Phase-specific portion of the grant funds, WSDOT and City
staff have prepared a two-page Local Agency Agreement Supplemental and a three-page Local
Agency State Funds Project Prospectus, copies of which are submitted along with the instant AIS.
The terms of these funding authorization documents are acceptable to City staff. (Similar, original
documents were previously entered into—for the PE Phase of the Project—following the City
Council’s approval of Resolution No. 3266 in late-2025).
The attached proposed Resolution will—if approved—authorize the Mayor to sign the nowproposed documents so that the CN Phase-specific portion of the grant funds can be obtained and
so that work on the CN Phase of this Project can commence forthwith.

AGENDA ITEM SUMMARY
Meeting Date: 11/10/2026
Agenda Number: 10E
Action Item
Title: Resolution Authorizing the Signing and Submission of a Washington State Department of
Health Drinking Water State Revolving Fund Application Related to the City’s Brader Hill Water
Storage Reservoir Project
From: Ty Jones, Public Works Director
Action Requested: Approval
Staff Recommendation: Approval
Board/Commission Recommendation: N/A
Fiscal Impact: None via this action. The City is seeking $3,608,900.00 of loan funds from the
Drinking Water State Revolving Fund (DWSRF) due to its favorable interest rates.
Funding Source: 411, Water Fund, would be utilized to repay any loan and, also, to fund the
difference between any loan funds obtained and the total Project cost.
Background/Findings/Facts: During work on the City’s Water System Plan Amendment to the
February 2021 Water System Plan, City staff (and HLA Engineering and Land Surveying, Inc.,
(HLA), which serves as a consultant to the City) identified the need for an additional reservoir to
be constructed at the existing Brader Hill Reservoir site, due to the need for an increased storage
capacity to ensure adequate water supply will exist for the Fire Department during future
emergency scenarios and, more generally, to enhance overall system performance.
This prospective project will be known as the City’s Brader Hill Water Storage Reservoir Project
(Project). The Project’s estimated total cost is $3,608,900.00 according to HLA.
City staff is seeking the City Council’s approval for a Drinking Water State Revolving Fund
(DWSRF) Application to be signed and submitted to the Washington State Department of Health
(DOH) for the full amount, in hopes that loan funds—of some amount—might be secured to help
fund the Project. A proposed Resolution is submitted with the instant AIS. If approved, it will
authorize this action to occur.
Recommended Motion: I move to approve the Resolution in the form presented.

AGENDA ITEM SUMMARY
Meeting Date: 11/10/2026
Agenda Number: 13A
Informational Item
Title: Resolution Establishing Water Rates and Rules for the Year of 2027
From: Mayor, Roger Bell; City Attorney, Rob Case
Action Requested: Adoption
Staff Recommendation: Adoption
Board/Commission Recommendation: N/A
Fiscal Impact: None occasioned by adopting the proposed Resolution. The City will realize
increased revenues from its water utility customers/consumers in the forthcoming year of 2027
(in comparison to the cumulative amount the City expects to receive for the totality of 2026).
Funding Source: N/A
Background/Findings/Facts: This AIS accompanies a proposed new Resolution, which, if
passed and adopted, would establish the City’s water rates for the forthcoming year of 2027.
This is the same proposed Resolution (with a few typographical errors now corrected)
that was proposed during the meeting on October 20, 2026. The Councilmembers in
attendance on that date voted to table the matter and to have it brought back at a later
date. The matter is now brought forth again.
As part of the prior vote to table the matter, at least one Councilmember expressed a
desire to simultaneously consider—when considering whether to pass the proposed
Resolution on water rates—whether to take a related action to establish water pressure
zones and establish various monetary fees or recovery amounts for the zones. Since
then, City management has determined that the water zone issue is not actually ready
to be proposed and/or implemented. Additional work is necessary by City
management and the City’s consultant, HLA Engineering & Land Surveying, Inc.
(HLA) on that topic.
Rather than try to rush the water zone issue before it is ready, City management hereby
asks the City Council to adopt the proposed Resolution to establish new water rates
for 2027 without any further delay, and for action (an up or down vote) to occur on
the water zone issue near the turn of year 2027 into 2028 (essentially one year from
now).
Section 9.02.190 of the Selah Municipal Code provides that the various monetary rates that the
City charges customers/consumers for water service shall be set via Resolution of the City
Council from time to time. The most recent was Resolution No. 3254 on October 28, 2025, which
set the rates that would apply during 2026. It is now necessary to establish new rates that will
apply during 2027.
The City has long contracted with HLA Engineering & Land Surveying, Inc. (HLA), for
engineering services—rather than the City directly employing one or more engineers. Among
other things, HLA produces “Rate Analysis Review[s]” from time to time for the City, to project
future capital expenditures (such as constructing a new Wastewater Treatment Plant, constructing
an additional reservoir, and acquiring more water rights) that will need to occur for the water
utility to continue adequately functioning and, relatedly, to specify the various monetary rates that
the City must impose to seek and qualify for one or more loan(s) that will prove necessary for the
City to actually undertake and complete such future capital expenditures.
Consistent with HLA’s most-recent Rate Analysis Review, water rates must be increased to
ensure that the water utility is operated in a financially healthy way during 2027. The “regular
service rates” and the “rates for two-family dwellings . . . .” must be increased (versus the rates
that were applicable during 2026). Likewise, the “reduced rates for low-income senior citizens
and/or low-income disabled persons” must also be increased (versus the rates that were applicable
during 2026).
As a partial offset for low-income customers, City management proposes that the “annual
household income” levels whereby low-income senior citizens and low-income disabled persons
respectively can qualify for reduced rates should be adjusted upward for the forthcoming year of

RESOLUTION NO. _____
RESOLUTION ESTABLISHING WATER RATES AND RULES
FOR THE YEAR OF 2027
WHEREAS, section 9.02.190 of the Selah Municipal Code provides that the various monetary
rates that the City charges consumers for water service shall be set via Resolution of the City
Council from time to time; and
WHEREAS, the City utilizes the services of HLA Engineering & Land Surveying, Inc. (HLA)
via a contractual engagement, because the City does not direct employ any engineers; and
WHEREAS, among other things, HLA produces “Rate Analysis Review[s]” from time to time
for the City, to project future capital expenditures (such as constructing a new Wastewater
Treatment Plant, constructing an additional reservoir, and acquiring more water rights) that will
need to occur for the water utility to continue adequately functioning and, relatedly, to specify
the various monetary rates that the City must impose to seek and qualify for one or more loan(s)
that will prove necessary for the City to actually undertake and complete such future capital
expenditures; and
WHEREAS, to ensure that the water utility is operated in a financially-healthy way during 2027,
the City Council has determined that the “regular service rates” and the “rates for two-family
dwellings . . . .” must be increased (versus the rates that were applicable during 2026), to the
amounts specified within this Resolution. Likewise, the “reduced rates for low-income senior
citizens and/or low-income disabled persons” for the year of 2027 must also be increased (versus
the rates that were applicable during 2026), to the amounts specified in this Resolution; and
WHEREAS, the City Council has further determined the “annual household income” levels
whereby low-income senior citizens and low-income disabled persons respectively can qualify
for reduced rates should be adjusted upward for the forthcoming year of 2027 (versus the
amounts that were applicable during 2026), to the amounts specified within this Resolution. This
is intended to enable those individuals to continue qualifying for reduced rates even if their
incomes slightly increase during 2027 (versus 2026); and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SELAH, WASHINGTON, as follows:
The rates specified in this Resolution shall become effective on January 1, 2027, and shall
remain effective unless and until the City Council subsequently takes other action to revise or
change any rate.
