BACKGROUND

Every year, at the June 30t" fiscal year end, there are unspent budgets. While appropriations were
included in the FY 2026 Budget, the actual expenditure for all or part of open items will occur
during FY 2027.
Because the FY 2027 Budget was prepared prior to year-end, and before it was known whether

funds would be expended or not, the fund balances used to develop the budget were projected
as though all non -salary budgets would be expended

by year- end. Therefore, approval of

carryover budgets does not reduce the estimated June 30, 2027, fund balances.

In order to keep from having purchase orders open for multiple years, past practice of the City is
to close prior year purchase orders at the end of September and re -appropriate the funds in the

subsequent year, along with authorizing the City to re -issue the purchase orders in the new fiscal
year. Since Generally Accepted Accounting Principles ( GAAP) do not recognize encumbrances,
closing out old encumbrances where goods and services have not been received will enable
budgetary financial statements to more closely align with audited GAAP statements.

BACKGROUND:

The City of Owasso operates a wastewater treatment system that collects and treats

wastewater from homes and businesses. Wastewater from homes is commonly used as
the baseline for normal domestic sewage. A concentration of approximately 250
milligrams per liter ( mg/ L) for both Biochemical Oxygen Demand ( BOD) and Total
Suspended Solids ( TSS) is widely used in wastewater programs as the benchmark for
normal

domestic

sewage.

BOD and TSS are two standard

measurements

used to describe

wastewater

strength.

BOD represents the amount of organic material in the wastewater that must be treated,

while TSS represents suspended solids that must be removed during treatment.
For industrial

users,

excessive - strength

wastewater

stronger

wastewater.

When

than

normal

user contributes

excessive

strength.

Industrial wastewater surcharges are a cost -recovery method commonly used by
wastewater utilities to account for this additional pollutant loading. Industrial users pay
their normal

sewer charges,

and when

they contribute

BOD

or TSS above normal

domestic strength, they also pay a surcharge for the excess pollutant loading. The
surcharge helps recover the additional treatment costs associated with stronger industrial

wastewater rather than passing those costs on to other wastewater customers.
The City has authorized excessive - strength wastewater surcharges by ordinance
1988 using an EPA calculation methodology that is listed in Section 17- 1 10.

Existing Ordinance Discrepancy: The City's Sewer Use Ordinance defines normal
domestic sewage as 250 mg/ L of BOD and 250 mg/ L of TSS, while the current excessive strength surcharge provision uses a threshold of 300 mg/ L. Staff is proposing to correct
this discrepancy by changing the surcharge threshold from 300 mg/ L to 250 mg/ L,
consistent with the City' s definition of normal domestic sewage. The proposed ordinance
amendment does not establish a new surcharge methodology; it corrects the ordinance
language so that the definition of normal domestic sewage is properly aligned with the
threshold for excessive - strength wastewater.

The City's current surcharge rates were last calculated in the 1990s using historical
wastewater treatment operating costs and influent loading data. To ensure the rates
continue to fairly recover the additional costs associated with treating excessive - strength
wastewater, the City retained Hardgrave Environmental
Management ( HEM) to

recalculate the surcharge rates using the some EPA methodology listed in Section 17- 110
of

the

ordinance

and

current

operating

costs

and

influent

monitoring

data.

recommends updated surcharge rates of $0.44 per excess pound of BOD and $0.23 per
excess pound of TSS.
PROPOSED SEWER USE ORDINANCE AMENDMENTS:
In conjunction

with

the

surcharge

rate

update,

staff

reviewed

the

industrial

wastewater

provisions of the Sewer Use Ordinance and identified several provisions that should be corrected
or clarified. The proposed amendments do not create a new surcharge methodology or

change DEQ' s regulatory authority. Rather, they correct existing inconsistencies, clarify the
respective roles of the City and DEQ, and better reflect how the City' s industrial wastewater
program is currently administered.
Section 17- 110 - Excessive - Strength Wastewater Discrepancy:

Corrects the discrepancy

between the City' s definition of normal domestic sewage at 250 mg/ L of BOD and TSS
and the excessive -strength surcharge provision, which currently references 300 mg/ L. The
proposed amendment changes the surcharge provision to 250 mg/ L so that the normal
domestic sewage benchmark is properly aligned with the threshold for excessive - strength
wastewater.

Section 17- 330 - Fats, Oils & Grease ( FOG) Limit: Changes the oil and grease discharge
limit for Food Service Establishments from 100 mg/ L to 150 mg/ L, providing one consistent
local oil and grease limit throughout the ordinance.

permitting authority for industrial users regulated under a DEQ Industrial User Permit and

that a City of Owasso Industrial Wastewater Discharge Permit applies only to industrial
users that are not permitted by DEQ. This distinction avoids duplicating a DEQ- issued
regulatory permit with a second City permit.

Industrial

Wastewater

Service Agreements:

Establishes

a new section

requiring an Industrial Wastewater Service Agreement for industrial users permitted by
DEQ. DEQ will remain responsible for issuing and administering the regulatory permit,
while the City's Service Agreement will establish the local conditions under which the City
will accept, convey, and treat the industrial wastewater. These conditions may include
monitoring, sampling, reporting, surcharge payment, and other requirements necessary
to protect the City' s sanitary sewer system and Wastewater Treatment Plant. The Service
Agreement does not replace or supersede the DEQ Industrial User Permit.
PROPOSED RESOLUTION AND IMPLEMENTATION:

A resolution is necessary to formally adopt the updated industrial wastewater surcharge
rates. The proposed resolution contains the rates calculated by HEM using the
methodology established in Section 17- 110 of the City of Owasso Code of Ordinances.
The updated per -pound rates are based on current Wastewater Treatment Plant
operating expenses and pollutant loading data.
Although the HEM study supports immediate implementation of the calculated rates,

staff recommends a five-year phased implementation beginning January 1, 2027. This
approach provides existing and future industrial users with a predictable schedule for
rate adjustments while allowing the City to gradually recover the actual costs associated
with treating excessive - strength wastewater.

A.

INTRODUCTION

The City of Owasso owns and operates a Publicly Owned Treatment Works ( POTW)
subject to regulations as outlined in Oklahoma Pollutant Discharge Elimination

System

OPDES) discharge permit number OK0020303 issued to the POTW by the Oklahoma
Department of Environmental Quality ( DEQ) on June 30, 2023.
The OPDES permit establishes effluent limitations and monitoring requirements for the

City of Owasso' s POTW. The City of Owasso' s POTW has the following effluent
limitations for Biological Oxygen Demand ( BOD) and Total Suspended Solids ( TSS or
SS) shown in the table below.

In order to comply with these established effluent limitations and proactively prevent
potential sources of pollution discharging to the receiving waters outlined in the OPDES

permit, the City of Owasso is reevaluating sewer rate surcharges for BOD and TSS. The
City of Owasso contracted with Hardgrave Environmental Management, LLC ( HEM) to
update surcharge rates to reflect the most recent POTW pollutant monitoring data and
contributory flows.

HEM used the procedures established in the City of Owasso Code of Ordinances outlined
in Sections 17- 321, 17- 328, and 17- 110 to calculate a new recommended surcharge rate

for any users discharging excessive strength BOD, TSS, or other pollutants to the POTW.
Surcharges or excess strength charges are applicable to any wastewater discharges above

normal domestic sewage defined as 250 mg/ 1 for both BOD and TSS.
The City of Owasso Code of Ordinances includes an established formula and procedures
to determine surcharge rate( s) and calculate charges for excess strength BOD, TSS, or

other pollutants discharged to the POTW as follows:

B.

DATA REQUIREMENTS
Annual POTW Operation and Maintenance ( O& M) Costs

Total Annual O& M costs were obtained from the Owasso Public Works Authority
Wastewater Treatment portion of the City of Owasso Fiscal Year 2026 Budget. O& M
costs are defined by the Environmental Protection Agency ( EPA) as the necessary,
recurring expenditures required to operate, maintain, manage, and repair assets, facilities,
or treatment systems over their lifespan.

POTW Influent Data and Flow Rates

Monitoring for BOD and TSS is done on a weekly and daily basis respectively at the
Owasso POTW influent and effluent. All sampling was completed in accordance with the
methods prescribed by 40 CFR Part 136. POTW influent flow is monitored continuously.
All monitoring data is documented in monthly operational reports ( MORs). The MORs
for the 2025 Calendar Year have been utilized for the calculation of average POTW

influent BOD, TSS, and flow. The daily MOR data for the 2025 Calendar Year is
included in this document as Appendix I.
C.

SURCHARGE RATE CALCULATION
The excessive strength surcharges utilize, Pc, the calculated O& M cost for treatment of a

unit of pollutant or " surcharge rate". The total annual O& M cost ( See Section B. I) and
the total annual pollutant loadings ( See Section B. II) were utilized in determining the
surcharge rate. The Surcharge Calculation information recommended by HEM is
included in this document as Appendix II.
D.

TECHNICAL

SUMMARY

The City of Owasso POTW' s average influent pollutant concentrations for BOD and TSS
of 313 mg/ L and 207 mg/ L respectively for a combined concentration of 520 mg/ L is
significantly higher than that of cities similar in size ( population of 25- 50K). Combined

influent concentrations from similarly sized cities typically average in the 200- 400 mg/ L
range. For example, the calendar year 2025 average for the City Ardmore, OK was
documented to be 242 mg/ L. Higher influent BOD and TSS pollutant concentrations in
Owasso can be attributed to National Steak and Poultry ( NSP), a food processing
Industrial User. These high influent pollutant

concentrations

and resulting loadings may

skew results downward from what is typically expected for calculated surcharge rates;
however, best professional judgement has been applied in determining equitable
surcharge rates based on the data available.

According to data provided by the City of Owasso, the discharge from NSP for calendar
year 2025 contained pollutant concentrations averaging 2,274 mg/ L BOD and 1, 578
mg/ L TSS at flows of approximately 100, 000 gallons per day. At these levels, the

average daily pollutant loading from NSP totals 3, 213 lbs/ day representing approximately
20% of the total influent BOD &

TSS loading to the Owasso POTW of 16, 283 lbs/ day

see Appendix I).

Based on the City of Owasso Code of Ordinances outlined above, the proposed sewer
surcharge rates ( see Appendix II) and the calendar year average pollutant loading from
NSP ( see above), the resulting annual surcharges to NSP would total $ 359, 087. This

represents a reasonable and proportionate share of the annualized cost to operate and
improve the POTW. These surcharges, of course, may be reduced by NSP through
pollution prevention and/ or pretreatment.
Based on the technical assessment above, HEM recommends full implementation of the

calculated surcharge rates ( see Table- 2 below and Appendix II). The recommended

surcharge rates of $0.44 per excess pound of BOD and $ 0.23 per excess pound of TSS in
accordance with Section 17- 110. 0 of the City of Owasso Code of Ordinances.
