1. CALL TO ORDER
President Kubiak, presiding, called the meeting to order at 7:00 p.m.
2. PLEDGE OF ALLEGIANCE
Those in attendance recited the Pledge of Allegiance.
3. ROLL CALL
Clerk Ortega, called the roll; answering present were President Amber Kubiak and Trustees: Adam
Hagg, Luke Hall, Kevin Pini, Ed Tarnow, and Robert Wangles. Trustee Andrew McCurdy was absent.
Also present were Andy Ferrini, Village Manager, Laura Ortega, Village Clerk, Michael Smoron, Village
Attorney, Pat Doherty, Public Works Director, Nick Partipilo, Asst to Village Manager and
Development Services Director, Chris Harris, Chief of Police, and Seth Gronewold, Village Engineer.
Deputy Fire Chief, Chris Howell of the Pingree Grove Fire Protection District was in attendance.
4. PUBLIC COMMENTS – none
5. SPECIAL PRESENTATION
President Kubiak read aloud a Proclamation proclaiming April 24, 2026 as Arbor Day in the Village.
6. CONSENT AGENDA
Trustee Hall made a motion, seconded by Trustee Hagg, to approve the Consent Agenda consisting of
Minutes from the April 6, 2026 Board Meeting; and Warrant List for April 20, 2026 in the amount of
$479,519.84; pay application no. 30 for the wastewater treatment plant improvements project in the
amount of $833,329.89; a resolution authorizing an IGA between the Village and City of Elgin
reconfiguring a portion of Damisch Road., and the reappointment of various members to Village
Commissions.
A roll call vote determined Trustees Wangles, Tarnow, Pini, Hagg, and Hall, answered aye. The roll call
vote passed 5-0-1.
7. ITEMS FOR SEPARATE ACTION
a. Consideration and Approval – Authorization of a 3-Year IT Consulting Services Agreement with
MCC Technology in the amount of $173,592.
Staff presented a recommendation to award IT consulting services to MCC Technology. The
prior contract had expired; a Request for Proposals was issued, and six proposals were
received and evaluated based on cost, experience, and responsiveness. The three highestranked firms were invited to interview, and MCC Technology was selected as the top-ranked
firm at a cost of $57,864 per year for three years, which is under 2027 budgeted amount. Staff
noted the agreement includes options for two one year extensions with an annual adjustment
of up to 4%.

During discussion, a Trustee inquired about a discrepancy between the service pricing shown
in the board packet and the vendor’s submitted pricing. Staff clarified that the discrepancy
resulted from an omission identified after the initial bid submittal.
Trustee Wangles made a motion, seconded by Trustee Hall, to authorize a 3-Year IT Consulting
Services Agreement with MCC Technology in the amount of $173,592.
A roll call vote determined Trustees: Tarnow, Hagg, Pini, Wangles, and Hall, answered aye.
The roll call vote passed 5-0-1.
b. Consideration and Approval – Ordinance Amending Village Code Title 10 Building and
Development: Addition of Chapter 11, Rental Housing Inspection Program
Staff presented a proposed Rental Housing Inspection Program and ordinance adding Chapter
11 to Title 10 of the Village Code. The program aligns with the Village’s strategic plan; staff
reviewed comparable programs (including Prospect Heights and Round Lake) and
recommended Lakeside Consultants to administer it, with approximately 260 rental units
identified. Implementation would include rental registration in 2026 and biennial inspections
beginning in 2027 (odd-numbered addresses) and 2028 (even-numbered addresses).
Projected 2027 fees were $275 per single-family inspection and $250 per
condominium/townhome inspection.
Board discussed narrowing the checklist to life-safety items, inspection scheduling/notice
(including whether five days is sufficient), standards (e.g., carbon monoxide detectors), and
compliance/documentation expectations; staff indicated inspections would be coordinated
with owners, off-hours inspections may be available, and corrections would be due within
about 30 days with flexibility.
After further discussion Board consented to table the item for additional research and
potential revisions to the checklist and ordinance language.
Trustee Pini made a motion, seconded by Trustee Hagg, to table item 7.b. for further research
and review of ordinance language.
A roll call vote determined Trustees: Pini, Wangles, Hagg, Tarnow, and Hall, answered aye.
The roll call vote passed 5-0-1.
c. Consideration and Approval – Authorization of the purchase and installation of parking lot
and field lighting at the new Fire Station Park at a cost not to exceed $73,000.
Staff noted that park development is on a fast track, and there was insufficient time to solicit
multiple bids; the selected vendor has successfully completed prior Village projects. Staff
stated the parking-lot lights will have dimming capability for security purposes without
operating at full brightness and will be controlled via an application or the building control
system.
Discussion included motion-sensor lighting, safety considerations raised by Carillon, and the
existing lighting operation at the Pingree Grove Fire Protection District’s lot.
Trustee Hagg made a motion, seconded by Trustee Pini, to approve the purchase and
installation of parking lot and field lighting at the new Fire Station Park at a cost not to exceed
$73,000.
A roll call vote determined Trustees: Tarnow, Hall, Pini, Hagg, and Wangles, answered aye.
The roll call vote passed 5-0-1.
d. Consideration and Approval – Authorization of the Award of a Bid for Biowaste Sludge Hauling
Services to Synagro in the Amount of $63,740.00.
Staff presented the recommendation to award the biowaste sludge hauling services bid to
Synagro, stating the current sludge haul contract expires April 30. Two bids were received
through RFP; staff noted there are limited vendors in the area that provide this service.

Trustee Pini made a motion, seconded by Trustee Hall, to authorize the award of a bid for
Biowaste Sludge Hauling Services to Synagro in the amount of $63,740.00.

8. PRESIDENT’S REPORT
President Kubiak reported that the Reinking/R72 developer submitted their plans to IDOT and still
moving forward with the project and that they have two concept plans ready to go pending IDOT
response. She also reported that the Jewel lease has not been signed yet but that they would like to
break ground June 1; a good sign if they can make that.
STAFF REPORTS AND DISCUSSION
Village Manager Ferrini shared that he and President Kubiak are working with lobbyist for R47
expansion tentative house appropriations hearing regarding state budget to solicit phase II study
project for r47 exp. Tentative house appropriations hearing regarding state budget for solicit phase
ii study and update on phase I study. He also spoke to e-bikes/scooters; nothing passed by both
houses yet there is momentum; continuing to monitor; if state adopts we will consult with legal on
what we should implement locally and report back to the board.
Development Services Director Partipilo– Updated on recent Planning and Zoning Commission
activities
Public Works Director Doherty provided update on wastewater treatment plant service work and
indicated IHC delays due to rain.
Village Engineer Gronewold Seth – reported on the wastewater treatment plant – delay due to – time
extension – no cost change order will be brought for board approval; he also gave an update to the
R72 pathway and that Fehr Graham is assisting IDOT through a clerical error, as they did not get a
permit from IDNR for a culvert extension in 2014. He indicated good news that the WWTP project
may be coming in $600K under the awarded construction budget. Manager Ferrini acknowledged Fehr
Graham and Public Works for the great job navigating a very complex construction project process.
Village Clerk Ortega shared information on upcoming special events and that our business partners
have been very responsive to event sponsorship.

I move to approve an Ordinance Amending Village Code Title 10: Building and
Development, addition of Chapter 11 Rental Housing Inspection Program

Purpose:
Consider the implementation of a Rental Housing registration and inspection program to prevent and abate
nuisances.
Background:
The Village’s Strategic Plan outlines goals for the creation and implementation of a proactive code
enforcement program and the establishment of a rental inspection program. These programs are tools to
promote the health and safety of the community by abating harmful nuisances that occur through potentially
hazardous conditions in rental properties.
Other non-home rule municipalities in Northern Illinois, such as the City of Prospect Heights, the Village of
Lakemoor, and the Village of Round Lake Park, all run successful rental inspection programs. Through
research into these programs and others, staff have identified two ways of administering a rental inspection
program: in-house or through a third-party contractor. For example, the City of Prospect Heights runs its
rental inspection program in-house, while other municipalities, like the Village of Woodridge and
Schaumburg, run their rental inspection program through the consulting firm Lakeside Consulting. As a
reminder for the Board, Pingree Grove utilizes Lakeside Consulting for commercial building consulting
services.
Structure:
The Village of Pingree Grove plans to utilize Lakeside Consulting for our own rental inspection program.
This will require rental property owners to register their rental units once and then schedule inspections on
a biannual basis. Staff have identified approximately 260 rental units in the Village, which were identified
through the utility billing software and by contacting the various HOAs in the Village. Staff have divided the
rental properties into two groups (Even Group and Odd Group) by even and odd address numbers. These
two groups are then divided into a two-year inspection cycle, based on even and odd addresses, with even
addresses being inspected in even years and odd addresses being inspected in odd years. Staff plans for
the rest of the calendar year 2026 to be used for rental unit registration and educating residents on the new
program. Starting in calendar year 2027, rental inspections will begin with rental units with odd-numbered
addresses.

Inspections are conducted to ensure that rental units are up to code. This includes fire safety and making sure that
everything in the unit is in good repair and is not a hazard to the health and safety of the resident or the public.
These inspections will be done with the purpose of preventing and abating nuisances. A nuisance is defined as
everything that endangers life or health, gives offense to the senses, or obstructs reasonable and comfortable use
of property.
This will be run through the local adjudication program, in which a lack of compliance with the ordinance
will be adjudicated. If the property owner fails to reply to communication from Lakeside that states that they
were noncompliant and need to schedule a reinspection, the property owner will receive a citation after 30
days. Failure on the part of the property owner to comply with registering and completing inspections will
result in a code compliance ticket and will be adjudicated through the Village’s local adjudication program.
Updates per April 20, 2026, Meeting
Per the recommendation of the Village Board at the April 20, 2026, Village Board Meeting, staff further researched
the proposed rental housing inspection program and made edits to the corresponding documents. First, the rental
inspection checklist form was edited to remove the requirements that were more cosmetic in nature, as well as
establish a defined timeline for smoke and carbon monoxide detectors. Second, staff identified seven (7) other
municipalities in Kane County that have rental inspection programs; those being Aurora, Elgin, Hoffman Estates,
Carpentersville, Batavia, West Dundee, and East Dundee. Finally, staff discussed the scheduling of inspections
as well as the potential for pictorial evidence for reinspection with Lakeside Consultants. Lakeside confirmed their
ability to utilize virtual re-inspections if requested by the property owner, as well as flexibility in scheduling the
initial inspections. In an effort to increase flexibility, they confirmed that they can do inspections with or without
the landlord present.
Options:
1. Implement the Rental Inspections Program into the Village Code.
2. Do not implement the Rental Inspections Program into the Village Code.
3. Table the ordinance for further staff research and discussion.
Financial Impact:
The costs associated with this program will be placed on the landlord/property owner. The Village will
receive $25 per dwelling unit inspected, and $250 or $225 going to Lakeside, depending on the type of unit
inspected.
Here is the cost breakdown per single-family home and townhouse.

FOR THE VILLAGE OF PINGREE GROVE, KANE COUNTY, ILLINOIS
WHEREAS, the Village of Pingree Grove (the “Village”) is not a home rule municipality
within Article VII, Section 6A of the Illinois Constitution and, pursuant to the powers granted to
it under 65 ICLS 5/1-1-1 et seq.; and
WHEREAS, the Illinois Municipal Code, 65 ILCS 5/1-2-1, provides that the corporate
authorities of each municipality may pass all ordinances and make all rules and regulations
proper or necessary, to carry into effect the powers granted to municipalities; and
WHEREAS, as a non-home rule municipality, the Village of Pingree Grove has the authority
to run a rental inspection program in the case of defining, preventing, and abating nuisances that
impact the public health and welfare, pursuant to the powers granted to it under 65 ILCS 5/1160-2; and
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village
of Pingree Grove, Kane County, Illinois, as follows:
SECTION ONE: VILLAGE CODE AMENDED.
The following chapter is inserted into the village code:
Title 10: Building and Development, Chapter 11, Rental Housing Inspection Program
10-11-1: Rental Dwelling Units
The purpose of this chapter is to provide for the registration and inspection of rental dwelling
units so as to protect the health, safety and welfare of the residents of the Village, including:
(a) To protect the public health and safety by ensuring rental units comply with minimum
housing standards as established by village ordinances;
(b) To protect the character and stability of residential areas;
(c) To correct and prevent housing conditions that adversely affect or are likely to adversely
affect the life, safety, general welfare and health of persons occupying dwellings;
(d) To facilitate the enforcement of minimum standards for the maintenance of existing
rental residential property and thus to prevent slums and blight; and
(e) To preserve the value of land and buildings throughout the Village
10-11-2: Definitions
COMMON AREAS shall be defined as the areas in a RENTAL HOUSING PROPERTY that are
accessible to all occupants of the property, including, but not limited to, lobbies, laundry rooms,
recreation areas, common kitchens, hallways, stairs, courtyards, light wells, garbage areas, boiler
rooms, storage rooms, basements, roof areas, or parking garages or areas
RENTAL DWELLING UNIT shall be defined as any room or group of rooms located within a dwelling
forming a single habitable unit with facilities which are used, designed or intended to be used for
living, sleeping, working, and eating. The term “rental dwelling unit” shall not include hotels,
motels, bed and breakfast establishments, nursing homes, retirement homes, rest homes,

assisted living facilities or dwellings owned or controlled by government agencies and public
housing authorities.
RENTAL HOUSING PROPERTY shall be defined as any property containing one or more RENTAL
DWELLING UNITS and may include COMMON AREAS
10-11-3: Mandatory Rental Housing Inspection Program
(a) Registration required: It shall be unlawful for any person, individual, firm, trust,
partnership, association, corporation or other legal entity to lease or allow occupancy of
any "rental dwelling unit", as defined hereafter, for any consideration within the
corporate limits of the Village without first registering with the Village as provided in this
chapter. The owner shall also be required to submit a copy of the written lease in effect
at the date of registration.
(b) Validity: Registration is valid from January 1st until December 31st of the calendar year
following the calendar year that is identified within the registration form. The Village
Manager or designee may extend a registration for a period of time not to exceed one
year, if the property owner has demonstrated to the Village Manager or designee
continued compliance with this chapter.
(c) Inspection required: Rental dwelling units shall be inspected by an employee or agent of
the Village for compliance with this code. After the initial inspection, following the
effective date hereof, which must not reveal any violations, a rental dwelling unit may
continue to be leased until the next mandatory inspection.
(d) Inspections authorized: The Village is hereby authorized and obligated to conduct
inspections of any and all rental dwelling units within the Village to determine compliance
with the standards and regulations set forth in this code, as amended. All inspections shall
occur at reasonable hours except in emergency situations where the life, health, and/or
safety of any individual occupying the rental dwelling unit is threatened.
(e) Frequency, notice of and entry for inspection:
a. All rental dwelling units shall be registered for inspections by the employees or
agents of the Village at least once every two (2) calendar years.
b. Inspections may occur more frequently, provided there is:
i. Reasonable suspicion to believe that there exists within such rental
dwelling unit conditions or conditions associated with such rental dwelling
unit which present a threat to the health, safety, welfare or general
comfort of the resident(s) of such rental dwelling unit; or
ii. A complaint lodged by the resident(s) of the rental dwelling unit to be
inspected; or
iii. A request made by a prospective resident accompanied by the consent of
the owner (or owner's agent) of a rental dwelling unit to be inspected; or
A request made by the owner or owner's agent.
c. The Village Manager or designee shall serve written notice to the owner or the
owner's agent and the occupant of the rental dwelling unit of the date and time
of any inspection to be conducted under this section, by mailing such notice by
first class mail at least five calendar days prior to the date of inspection, except in
those situations described in subsections (e)(b)(i), (ii) or (iii), of this section. In the
case of multiple owners of the same property, notice to any one of the owners

shall comply with the notice requirement under this section.
d. Entry.
i. The Owner or Owner's Representative shall provide the Village employee
or agent of the Village conducting the inspection, with access to all
common areas and vacant units on the rental housing property.
ii. The Owner or Local Contact Representative is responsible for obtaining the
consent of the tenant of the rental dwelling unit for the Village Manager
or designees’ entry to inspect the unit. If the tenant does not consent to
the entry for inspection, the Village Manager or designee is authorized to
seek an administrative inspection warrant from a court of competent
jurisdiction authorizing the inspection. If a tenant or occupant of a rental
dwelling unit refuses to allow the inspection, the Owner is not in violation
of this section.
(f) Identification of rental dwelling unit and designation of owner’s agent:
a. Any person owning, managing, or supervising any rental dwelling unit or rental
housing property shall, within 30 days of assuming ownership, management or
supervision of any rental dwelling unit, inform the Village on a form approved by
the Village of such residential dwelling.
b. Every owner of any rental dwelling unit who does not reside on the premises of
such rental dwelling unit shall appoint and designate an individual to act as an
agent on their behalf. Every owner shall notify, in writing, the Village and each
occupant of the rental dwelling unit of the name, address, and telephone number
of the agent. Such written notice shall contain the signature of the agent accepting
appointment and designation as agent of the owner.
c. Any individual, who is appointed and designated as agent of the owner, shall
reside within a 75-mile radius of the municipal limits of the village. An owner of a
rental dwelling unit may act as their own agent provided they meet the residency
requirements set forth herein.
(g) Fees
a. A bi-annual fee for inspection of any rental dwelling pursuant to this chapter shall
be $250 per townhome/condominium unit and $275 per single-family dwelling
relative to Section 10-11-3(c).
b. In addition to the inspection contemplated by Section 10-11-3(g)(a) a fee of $75
for the first reinspection pursuant to Section 10-11-3(e) and each subsequent
reinspection until such violation is corrected.
c.

Any reinspection fees remaining unpaid after two weeks shall be a debt due and
owing the village from the owner of the rental dwelling unit and, as such, may be
collected in accordance with applicable law. In addition, the owner shall also be
responsible for the Village’s cost of collection, including court costs and
reasonable attorney fees. If there are two or more owners of a rental dwelling unit
who owe such debt to the Village, such debt shall be a joint and several obligation
to the Village due from such owners.
(h) Inspection Checklist
a. Dwelling Units inspected via this program are subject to the following inspection
checklist.

-All smoke detectors shall be maintained and operable at all times, and shall not be older than
10-years past the manufacturer’s date.
-GFCI-protected outlets are required in Kitchen and Bathrooms
-All carbon monoxide detectors shall be maintained and operable at all times, and shall not be
older than 10-years past the manufacturer’s date.
- Building front/rear doors shall latch and lock, and be weather-tight
-All interior/exterior lights must be operable. Common area lighting is important in crime
prevention
-All interior wall/ceiling surfaces shall be in good repair
-All appliances must be operable and in good repair
-The main boiler and water heater must be operable, properly vented, leak-free, and supplied by
rigid black pipe with shut-off and drip leg for each appliance

-All plumbing must be maintained and intact without leaks. All faucets must be maintained in
good repair
-All interior habitable spaces must be able to be maintained at a minimum of 68◦F at all times in
the winter months
-No combustible storage or closets permitted under stairs
Unit-Dependent Checklist:
-The utility room must have a code-compliant source of combustion air and a locked door,
applicable to the dwelling unit
-Common area fire extinguishers (2A10BC) must be properly mounted with current inspection
tags in multi-family units
-A current boiler certificate from the office of the State Fire Marshal shall be posted in the utility
room, if applicable, in the dwelling unit
-Fire extinguishers are located in the hallway outside and in each bedroom, if applicable to the
dwelling unit
-All balconies shall be structurally sound, safe, and with code-compliant guardrails
-All chimneys must have a screened cap to prevent rodents
-Building address numbers shall be clear post on the front/rear of each building, or visible from
the road and/or parking lot

(i) Penalty
a. Penalty. Any person who violates any provision of this section shall be subject to
a fine of not less than $75, nor more than $750, for each offense, unless specified
otherwise within this chapter. A separate offense shall be deemed committed on
each day that a violation continues. All violations of this section are hereby
determined to be a nuisance which may be abated or enjoined by the village.
Nothing in this section shall exempt the village or any person from seeking civil
remedies against any person who is in violation of this section.
b. Preservation of other rights and penalties. This section shall not be construed so
as to restrict the right of the village to inspect any property, nor to seek penalties
for violations of other provisions of this code. The Village shall be entitled to
enforce this Section 10-11-3 by injunctive relief in addition to any other remedy.
c. In the event any violation is enforced through a court or administrative hearing
proceeding, all such penalties shall be in addition to all court or hearing costs. Any
administrative hearing shall be scheduled no less than 21 days from when a person
is issued a citation for a violation of any section or subsection of this Chapter. If a
person is found liable at an administrative hearing and fails to pay the imposed
fine, along with any applicable court and hearing costs, within ten (10) days of the
hearing date, the fine shall increase by twenty-five dollars ($25.00) on the
eleventh (11th) day following the hearing. If the fine and any applicable court and
hearing costs remain unpaid within twenty (20) days of the hearing date, the fine
shall be increased by an additional twenty-five dollars ($25.00) on the twenty-first
(21st) day following the hearing.
SECTION TWO: GENERAL PROVISIONS.
REPEALER: All Ordinances or portions thereof in conflict with this Ordinance are hereby repealed,
amended to be consistent with this requirement, or superseded by this requirement.
SEVERABILITY: Should any provision of this Ordinance be declared invalid by a court of competent
jurisdiction; the remaining provisions will remain in full force and effect, the same as if the invalid
provision had not been a part of the Ordinance.
EFFECTIVE DATE: This Ordinance shall take effect as provided for under Illinois law.

Accounting Department Advisory Services on a monthly base amount of $6,350.

Purpose:
Consider the approval of an engagement letter with Lauterbach and Amen to secure professional
accounting and financial consulting services to support the Village’s financial operations and ensure
continuity, compliance, and timely completion of required financial functions.
Background:
Staff recommend entering into an agreement with Lauterbach & Amen, LLP (L&A), a firm experienced in
providing municipal accounting and financial consulting services. L&A will provide support for key
financial functions, including but not limited to – review of board reports, annual audit preparation,
reporting compliance for Treasurer's report, TIFs, budget preparation and forecasting, levy preparation,
grant reporting, and compliance. L&A will support critical financial functions, ensure compliance with
statutory requirements, and provide other support and direct training to Village staff. The assigned L&A
staff person will be on-site approximately one (1) day per week and will provide additional remote
support as needed. The engagement anticipates approximately 400 hours annually, not to exceed 425
hours. Additional L&A staff time beyond this amount will be billed at a rate of $190 per hour. The
agreement also includes approximately 20 hours of consulting support from firm leadership.
L&A’s services are intended to supplement Village operations with professional expertise and provide
flexibility in addressing ongoing and emerging financial needs.

1. Approve the agreement with Lauterbach & Amen, LLP.

Financial Impact:
The cost for Lauterbach & Amen services is $6,350 per month for eight (8) months, totaling
approximately $50,800 for the May through December 2026 period. Starting January 1st of 2027, the
contract provides for a 4% annual increase in each subsequent year.
The engagement anticipates approximately 400 hours annually, not to exceed 425 hours, with additional
staff time billed at $190 per hour if needed. Approximately 20 hours of consulting support from firm
leadership is also included within the agreement.
The agreement may be terminated by either party with thirty (30) days' written notice if the arrangement
no longer meets the needs of the Village. Funding is expected to be accommodated within the adopted

We are pleased to confirm our understanding of the services we are to provide for the Village of Pingree
Grove.
It is our understanding that Lauterbach & Amen, LLP will provide an accounting department advisory service
to the Village of Pingree Grove. Such assistance will be arranged between the Village and Lauterbach &
Amen, LLP and will be billed $6,350 per month starting on May 1, 2026 through December 31, 2026. The
fee will then increase 4% in each subsequent year, unless there is a change in the services provided. Our full
scope of services is detailed in the attached Exhibit A. If for any reason this arrangement becomes
unacceptable, it can be terminated by either party with 30 days written notice.
These services cannot be relied upon to detect errors, irregularities, or illegal acts that may exist. However,
we will inform you of any such matters that may come to our attention.
In accordance with our firm policies, work may be suspended if your account becomes 90 days or more
overdue and may not be resumed until your account is paid in full. Please be advised that we will charge
interest on late invoices over sixty days.
The Village agrees that during the term of this agreement and for a period of twelve months thereafter, the
Village shall not solicit, or arrange an employment contract with personnel of Lauterbach & Amen, LLP.
Violation of this provision shall, in addition to other relief, require the Village to compensate Lauterbach &
Amen, LLP with one hundred percent of the solicited person’s annual compensation.

Project: Accounting Department Advisory Services for the Village

These accounting advisory services will include 1 day per week onsite at the Village.

Tasks to include review of board reports, annual audit preparation, reporting compliance for
Treasurer's report, TIFs, audit, etc., budget preparation and forecasting, levy preparation, grant
reporting and compliance, support on higher-level accounting questions, Board meeting
attendance as requested, and additional tasks as assigned by the Village Manager.

All work performed by L&A will be approved by the Village.

Plan:

Schedule is one day per week of onsite support with additional time as needed during peak seasons.

Remote support on questions as needed.

Approximately 20 annual hours of consulting support from Matt Beran-Partner and other firm
leadership as needed.

Annual hours approximately 400 hours. Not to exceed 425 hours.

Additional hours to be agreed-upon by the Village with expected billing at $190 per hour.

Renewal to occur on 12/31 annually with a 4% increase.

Other Benefits:

L&A is in charge of training and HR for each employee.

Bench of staff to cover during extended absences or turnover.

I move to authorize the Chief of Police to place an order for two 2026
Dodge Durango vehicles from James Chrysler Dodge, and purchase
emergency equipment and decaling, in the amount of $158,600.00

Purpose:
To obtain approval for placing the order for two new 2026 Dodge Durango’s and all necessary
equipment to outfit two new patrol vehicles for duty use for FY25/26.
Background:
The Pingree Grove Police Department has budgeted for two new 2026 Dodge Durango police
vehicles for FY26/27. One vehicle is a direct replacement for the fleet, and one vehicle will be
additional due to the increase in staffing.
Orders for new cars are now open, and vehicles are reportedly ready to ship to dealerships upon
order. This also applies to all equipment and decals needed to prepare each vehicle for patrol.
Considering this, ordering the equipment now will put the police department on a list to ensure
we receive the vehicle and all necessary equipment as quickly as possible.
One of the vehicles will be added to the fleet following the recent hiring of three new police
officers at the start of 2026. This vehicle will be crucial to meeting patrol requirements. Our
current fleet is configured for two officers per vehicle, and no car is used for more than 16 hours
a day unless essential. This approach reduces mileage and maintenance needs for the other
vehicles.
The other vehicle will be added to the fleet, replacing the 2015 Ford Explorer, which was
purchased new in 2016. Originally, this vehicle served primarily as a supervisor call unit 10 years
ago and had limited usage. After being replaced by a newer Dodge in 2023, the 2015 Ford was
reassigned to patrol duties, resulting in higher mileage and maintenance costs than typical patrol
vehicles. Currently, it has just over 108,000 miles, not accounting for engine idle time.
In previous years, police vehicles were purchased from Sunnyside Dodge in McHenry, over 25
miles from Pingree Grove. Although this was a convenient option offered by previous
management, it was noted that James Chrysler/Dodge in Hampshire, only 5 miles away, can also
supply police vehicles using State Bid pricing. The police department has obtained a quote from
James Chrysler/Dodge and plans to order the vehicles from them rather than from Sunnyside
Dodge.

If authorized, the Police Department will promptly arrange for the shipment and installation of
both vehicles and all equipment.
Options:
1. Authorize the Purchases- Staff will proceed with ordering the vehicles.
2. Do Not Authorize the Purchases- If the purchase of this vehicle is not approved, the
vehicles will operate continuously without stopping, increasing mileage and maintenance
costs, and ultimately shortening their lifespan. Staff will follow the direction of the Board
on next steps.
Financial Impact:
For the FY26/27 budget, the Police Department allocated $158,600 for two fully outfitted
vehicles. This estimate includes the cost of in-car camera systems, which may vary by vendor.

Purpose:
Consider proposed changes to the Village’s zoning code as it pertains to accessory buildings, structures, and
uses.
Background:
Over the last 1-2 years, it has come to the attention of Village staff that the Village’s Code, as it relates to pools
and accessory structures, is difficult to enforce, and difficult to interpret for residents/contractors. The Code,
as it is currently written, has fairly extensive requirements when it comes to the installation of above-ground
pools in particular.
The Village currently has numerous regulations regarding screening, including requirements for the types of
materials used, such as decorative wood, decorative aluminum, or decorative wrought iron fencing. There are
also extensive requirements regarding the location of screening, including instances where screening must be
doubled . For example, if screening is located at the property line, additional screening is required around the
perimeter of the above-ground pool. The screening at the pool perimeter is landscape screening, with
requirements related to shrub height, spacing, and the number of planting rows. Overall, the current code
provisions are convoluted and more extensive than the requirements imposed by homeowners' associations
within the community. Staff’s goal is to mirror HOA rules in order to make the process as simple and
straightforward for residents as possible.
Currently, the code requires building permits for temporary rubber and plastic pools; Staff believes that it does
not make sense to require permits for them. One of the proposed code updates removes this requirement.
Additionally, the proposed updates include changes to where pools must be located in relation to the property
line. The current code requires pools to be located 20 feet from the property line, while the proposed update
would reduce this requirement to 10 feet of separation. Screening would still be required under the proposed
update, but it would not be as stringent as the current code. The proposed code requires that pools be
screened from the property line and from any area visible from the street or public right-of-way. Screening
must not exceed a height of 6 feet and may consist of wood, aluminum, or wrought iron fencing. The Village’s

building code also requires fencing for any pool within the Village. These updates are intended to ensure that
the Village’s code mirrors HOA rules within the community.
Other proposed changes include requiring accessory structures to be located at least six feet from the nearest
wall of the principal structure, as opposed to the current requirement of 10 feet. In residential districts,
accessory structures must be located in the rear or side yard, must be no less than five feet from any property
line, and may not be located within one foot of any easement or right-of-way. Additionally, a distance
requirement between accessory structures was included.
This proposed Ordinance also requires that properties located within an HOA must obtain HOA approval for
any building permit project as a condition for approval from the Village. This has been a longstanding practice
that we are looking to codify.
Options
1. Approve the code text amendments to the zoning code as is or with revisions.
2. Do not approve the amendments to the zoning code. Staff will await further direction from the Board.
Financial Impact:
No direct impact
Planning and Zoning Recommendation:
The Planning and Zoning Commission voted 5-1 to recommend approval of the Ordinance as written. The
Commissioner, who did not vote to recommend it, wanted to retain the requirement for permits for
temporary pools. The Commissioner wanted to retain the requirement to ensure that International Pool and
Spa Code (ISPSC) requirements applying to temporary pools would be inspected. The ISPSC indicates that any
pool, temporary or permanent, with a greater depth than 24” is subject to the requirements of the code. Items
that would be inspected under the ISPSC for a temporary pool include barrier standards, placement
requirements, and means of entry/exit requirements. The other Commissioners felt that because there is no
history of residents applying for these types of permits, maintaining the requirements, and enforcing them to
a greater extent was not necessary and potentially burdensome for residents. To help ensure residents enjoy
temporary pools in a safe manner, staff recommended adding a temporary pool basic guidelines fact sheet to
the Village website or including relevant safety information in the Village’s next newsletter.
Recommendation:
Staff recommend approval of the ordinance modifying the Village Code.

AN ORDINANCE AMENDING VILLAGE CODE TITLE 11 ZONING REGULATIONS
CHAPTER 5, GENERAL ZONING PROVISIONS, AND CHAPTER 6: RESIDENCE DISTRICTS
IN THE VILLAGE OF PINGREE GROVE, KANE COUNTY, ILLINOIS

WHEREAS, the Village of Pingree Grove (the “Village”) is not a home rule municipality
within Article VII, Section 6A of the Illinois Constitution and, pursuant to the powers granted to
it under 65 ICLS 5/1-1-1 et seq.; and
WHEREAS, after proper notice was given, the Planning and Zoning Commission (the
“PZC”) held a public hearing on the proposed amendments on March 16, 2026; and
WHEREAS, based on the PZC’s recommendation, the Corporate Authorities desire to
approve the proposed Text Amendment.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village
of Pingree Grove, Kane County, Illinois, as follows:
SECTION ONE: VILLAGE CODE AMENDED.
Section 11-5-6 Zoning Regulations, of Chapter 5, General Zoning Provisions, Section 6, Accessory
Buildings and Uses, shall be amended with the addition of new text underlined, and deletion of
text striked as follows:
11-5-6: ACCESSORY BUILDINGS STRUCTURES AND USES
A. Accessory Uses: Accessory uses shall not be established prior to the establishment of
the principal use, and shall not include the keeping, propagation, or culture of poultry,
cattle, goats, sheep, pigs, horses, or other livestock, whether for profit or not for
profit; except, that horses may be kept only as specified in section 11-6F-4 of this title.
(1990 Code §21.1.100; amd. 2011 Code)
B. Accessory BuildingsStructures (including accessory sheds, toolrooms, and other
accessory buildings):
1. For Residential Districts, including the Heritage District, noNo accessory
building structure, unless it is structurally a part of the principal building and
unless it conforms with requirements of accessory buildings structures for
special uses, shall be erected or altered, nor moved to a location within ten
five six feet (6510') of the nearest wall of the principal building, nor within the
required area for front or side yards of the lot as set forth for the district; and
in residence districts, an accessory building structure in a rear yard shall be:
not less than five feet (5') from any property line:
i. erected only in a rear yard or in the rear half of any side yard; and
ii. not less than five feet (5') from any property line nor within one foot
(1') of any easement or right of way.

2. No accessory building structure shall encroach upon that side yard of a corner
lot which is adjacent to the street nor upon that side yard of a reversed corner
lot which is adjacent to the street, nor upon the rear yard of a through lot.
3. No accessory building structure shall have more than one story nor exceed
seventeen feet (17') in height, unless otherwise permitted as an accessory to
business and manufacturing uses, or to authorized special uses. (1990 Code
§21.1.100)
4. No accessory structure shall be erected, altered, constructed, nor moved to a
location within five feet (5’) of the nearest wall or edge of another accessory
structure.
C. Aboveground Swimming Pools and Hot Tubs:
1. Aboveground swimming, soaking or wading pools, hot tubs and other similar
structures, including any pool or tub support structure, fencing or screening,
deck, pump or recreation equipment or other appurtenances thereto
(hereafter "aboveground pool structure"), shall be considered accessory
structures, shall only be allowed in rear yard areas behind the principal building
and shall be generally centered between the lines formed by the extension of
lines parallel with the side walls of the principal building into the rear yard area.
No portion of any aboveground pool structure shall be located within twenty
ten feet (20'10’) of a rear lot line, nor five feet (5’) of a property line or six feet
(6’) from the nearest wall of the principal building, nor within one foot (1') of
any easement or right of way. When the pool’s electrical equipment is between
the principal building and the pool, the required distance between the principal
building and the pool shall be measured from the associated electrical
equipment, not the side of the pool. No aboveground pool structure may cover
more than one-third (1/3) of the total area contained in the rear yard of the lot
in which it is located.
2. Each aboveground pool structure shall be required to have screening in areas
which face the side or rear property lines of the lot in which they are located,
and screening in any area which may be visible from a public road, sidewalk
or pathway, in compliance with the following requirements:
a. Screening may be located either at the perimeter of the property line, if
otherwise permitted under the applicable regulations and ordinances, or
around the perimeter of the aboveground pool structure.
b. Permissible screening materials include decorative wood, decorative
aluminum or decorative wrought iron fencing or screening in a height not
more than four feet (4') above the highest portion of the aboveground pool
structure, nor more than seven and one-half feet (71/2') above grade level,
provided such fencing or screening is otherwise permissible on the premises.
All such screening materials must be of a design and in a configuration
approved by the village building department.
c. Any aboveground swimming, soaking or wading pool, hot tub or other
similar structure which has the vertical surfaces of the exterior finished with a
wood facade shall not be required to screen such portions which are covered
by the wood facade; provided, that the top surface of the aboveground pool
structure must be covered by a locked, tamper resistant cover constructed of

a sturdy material capable of supporting not less than one hundred fifty (150)
pounds at all times when the aboveground pool structure is not presently
actively in use. Further, any vertical portion of the structure which is not
covered by a wood facade, including any support structure, fencing or
screening, deck, pump, or recreation equipment or other appurtenances
thereto, shall be required to be screened in accordance with this subsection
C2.
d. Any aboveground pool structure which has screening located at the
perimeter of the property line shall also be required to utilize landscape
screening at the perimeter of the aboveground pool structure. Such landscape
screening may consist of either: 1) evergreen shrub plantings with a minimum
height at time of planting of three feet (3') above grade level, with a minimum
plant spacing of three feet (3') on center; or 2) deciduous shrub plantings, with
a minimum height at time of planting of three feet (3') above grade level, with
a minimum of two (2) rows of plant screening, with a minimum plant spacing
of one and one-half feet (11/2') on center when measured for the two (2) rows
(i.e., staggered installation in 2 rows, with each row having plants installed at
3 feet on center).
e. The decorative wood, decorative aluminum or decorative wrought
iron fencing required to be constructed either at the perimeter of the pool
structure or at the perimeter of the yard shall be of a nonclimbable design,
and shall completely surround such aboveground pool structure in such a
manner as to minimize the danger of unsupervised children gaining access
thereto. All gates or doors opening through such enclosure shall be equipped
with a self-closing and self-latching device designed to keep and capable of
keeping such doors or gates securely closed at all times when not in actual use.
All such latches shall be made inaccessible to small children from the outside,
and shall be installed prior to the filling of the aboveground pool structure with
water. (Ord. 2006-15, 6-3-2006)
3. Excluding fencing or screening required under subsection C2 of this
section, which is subject to the height restrictions contained therein, no
portion of any aboveground pool structure shall exceed forty eight inches (48")
above the grade level existing prior to installation of the aboveground pool
structure. Where the grade of a given site induces a variation in the height
from grade to the top of the pool structure, the finished level of the pool may
be up to fifty-four inches (54") from the finished grade level, provided that
some portion of the pool is not more than forty-eight inches (48") from the
finished grade level. (Ord. 2008-15, 5-5-2008)
2. Each pool, in-ground or aboveground, must be screened from the side and/or
rear property lines and any area visible from the road, pathway, sidewalk, or
public right-of-way. The screening may be wood, aluminum, or wrought iron
fencing. Screening may be located either at the perimeter of the property line,
if otherwise permitted under the applicable regulations and ordinances, or
around the perimeter of the aboveground pool structure. Screening must have
a height not exceeding six feet (6’) above the finished grade

3. Aboveground swimming pools and hot tubs must not exceed 48 inches in height
from grade level.
3. 4.Temporary aboveground pool structures which: a) do not exceed twentyfour inches (24") in height; b) do not exceed sixteen feet (16') in diameter; ac)
are constructed of plastic or rubber; and d) do not require any permanent
structure, framework, or site preparation and e) are in place for not more than
two (2) weeks at a time with a complete removal thereafter, are exempt from
the requirements of this subsection.
4. 5. Notwithstanding the provisions of this subsection, this subsection shall not
apply to any aboveground pool, or attached structure for which the Village
issued a permit and which pool was structure installed prior to November
3June 19, 202506; provided that such pool structure is maintained in its
configuration as installed.
5. Removable, Above-Ground Swimming Pools: The following provisions shall
apply to removable, above-ground swimming pools that are not maintained in
place for longer than four (4) months per year:
a. Where an above-ground swimming pool is removable, a
resident may apply for a single building permit for the pool. This
permit shall permit initial installation of the pool, as well as
subsequent removal and reinstallation in subsequent years,
without requirement of obtaining a new permit on an annual
basis, provided that:
1. The pool remains substantially the same
size and shape;
2. The pool is reinstalled in substantially the
same location (and not on any public or
private easements or other prohibited
areas);
3. The yard in which the pool is installed
remains configured substantially the
same (i.e. screening and fencing is
maintained, no new permanent
improvements are installed that
interfere with the pool or that create
new setback areas, etc.); and,
4. The pool does not require any new or

b. Removeable, above-ground swimming pools are
required to comply with the applicable fencing
standards, but are not required to comply with the
screening standards outlined in Section 11-5-6(c)(2)(d),
above.
6. Alternative Swimming Pool Locations Authorized: Where possible,
swimming pools shall be installed in accordance with the requirements of
the Village zoning code, in the rear yard of a platted lot, between the lines
created by the parallel extension of the sides of the principal building, while
remaining within and within the rear yard building setback line. Where such
installation is not practical based upon the presence of utility installations,
patios or other permanent improvements, a pool may be relocated so as to
extend beyond the parallel extension of the sides of the building or to move
into the rear yard building setback area, provided that:
a. The pool does not intrude on any public or private easements;
b. The pool is not located in an area that would interfere with the
drainage of the property or any other properties;
c. The pool is located so as to minimize the intrus1ion in areas where
it would not customarily be permitted to the greatest extent
possible;
d. The pool location is acceptable to the Chief Building OfficialVillage
Manager or designee; and,
e. The pool location complies with applicable, mandatory setbacks from
items such as permanent structures and electrical services. These
provisions shall not authorize non-compliance with other Village
regulations on pools. The Chief Building OfficialVillage Manager or
Designee shall be authorized to approve of pool configurations in
compliance with this alternative standard without requirement of
any public hearing or approval of a variance, where required based
upon the configuration of a given lot. If the Chief Building
OfficialVillage Manager or Designee denies a permit requesting such
alternative relief under this subsection (6), the property owner may
appeal such denial by filing a petition for a zoning variation with the
Planning and Zoning Commission. This shall be the sole mechanism
to contest a denial of the Chief Building Official'sVillage Manager or
Designee determination under this subsection (6). The Chief Building
OfficialVillage Manager is further authorized to impose such
additional building permit conditions or requirements as may be
appropriate based upon the configuration of a given lot, including but
not limited to additional fencing, screening, grading, or utility

Section 11-6A-6 Zoning Regulations, of Chapter 6, Residence Districts, Article 6A-6, Site and
Structure Requirements, shall be amended with the addition subsection C. as follows:
11-6A-6: SITE AND STRUCTURE REQUIREMENTS:
C. Homeowner’s Association Permit Requirements:
Any applicant for a permit to construct any building, structure, or other improvement, in
an area of the village which is subject to a homeowners' association or property owners'
association shall be required to provide a clearance letter from the applicable association
prior to receipt of a permit from the building department. If the applicant does not reside
in an area of the Village which is subject to a homeowners’ association or property
owners’ association, they do not need any clearance letter from an association, but they
shall still be required to obtain a building permit. Applicants who seek to obtain a permit
without providing such a clearance letter shall make application to the village board of
trustees for issuance of their permit, which may only be issued after the holding of a
public hearing on the proposed aboveground pool structure.
SECTION TWO: GENERAL PROVISIONS.
REPEALER: All Ordinances or portions thereof in conflict with this Ordinance are hereby repealed,
amended to be consistent with this requirement, or superseded by this requirement.
SEVERABILITY: Should any provision of this Ordinance be declared invalid by a court of competent
jurisdiction; the remaining provisions will remain in full force and effect the same as if the invalid
provision had not been a part of the Ordinance.
EFFECTIVE DATE: This Ordinance shall take effect as provided for under Illinois law.

Purpose:
Inform the Board on the proposed changes to the Village’s zoning code as it pertains to lighting and Vehicle
Impact Protection, and receive direction on how they want to proceed with the proposed updates.
Background (Lighting):
As part of the routine review of the Zoning and Subdivision codes, it has been identified by Village staff that
the zoning code needs to be updated to reflect current practices. This includes lighting provisions. The intensity
of lighting in this context is defined as “footcandles” which is essentially how much light is measured as it hits
a particular surface. Our current zoning language states that “the intensity of such lighting shall not exceed
two (2) foot-candles as measured at the abutting property line.” Two foot candles have been the standard
utilized in previous (commercial and residential) lighting reviews; however, the code currently only covers
residential, and has no stated requirements in commercial. This proposed change would codify past practice
and clarify requirements for developers and staff by establishing a consistent two (2) foot-candle standard at
abutting property lines for all property types. An example of what two foot-candles look like is provided below,
as demonstrated in a parking lot.

Background (Vehicle Impact Protection):
Some communities in our region, including Oswego and Sugar Grove, are considering requiring additional
vehicle impact protection devices—such as bollards or reinforced planters—at commercial properties. Staff
believes that implementing similar requirements is worth considering for our community.
For context, in the Summer of 2025, in Oswego, IL, a car ran through the entrance of a Portillo's, killing a
toddler and injuring 12 others. The Village of Oswego has since updated its zoning code with the passing of
“Finnegan’s Law” (named after the toddler who passed), which establishes stricter vehicle impact protection
requirements at entrances to commercial and industrial buildings. Impact protection would also be required
at storefront windows that are two feet or less off the ground. These protective barriers, typically concrete
bollards or reinforced planters, are designed to withstand impacts from typical vehicles and enhance public
safety.
Examples of what these proposed changes would look like are included in Figures 1 and 2.

depending on the number of bollards installed and the materials of the bollard.

Updates based on the Planning and Zoning Commission Meetings
Based on the discussion at the Planning and Zoning Commission meetings on March 16 and April 20, the
requirement for Vehicle Impact Protection (VIP) barriers at schools has been incorporated. Additionally, the
Ordinance, as written, would apply to all businesses. Staff originally drafted the Ordinance to apply only to
new businesses, but per the recommendation of the Planning and Zoning Commission, it was altered to apply
to all users
Staff have identified December 31, 2028, as the proposed compliance deadline for existing businesses. This
timeline has been selected for several reasons. First, legislation has been introduced in the State Legislature
related to this issue; should such legislation be adopted, staff believe it is prudent to allow time to review and
incorporate any new or revised requirements into the Village’s implementation approach.
Second, staff has begun evaluating the feasibility of a potential cost-sharing program. Under such a program,
installation costs for existing businesses could be shared between the Village and the business owner.
Development and consideration of this program will require additional time for analysis, policy development,
and financial planning, and would need to be considered as part of a future fiscal year budget cycle, as the
Village’s current fiscal year budget, beginning May 1st, has already been established. Staff has been in contact
with other municipalities in Kane County that are attempting to navigate a cost-sharing program for
retroactive VIP requirements.
Options:
Staff is seeking initial feedback from the Board as we continue to analyze options for future Board
consideration.
Financial Impact:
The financial impact of the proposed ordinance will vary based on several factors, including whether the Board
elects to require retroactive installation of VIP devices for all users and whether a cost-sharing program is
implemented to partially or fully offset those costs for existing users. Additionally, staff have identified the
potential use of TIF funds from the Bell-Harris and Heritage District TIFs to support the retroactive installation
of VIP devices for businesses within those districts, but further research is needed.
Recommendation:
Staff recommend that the Village Board adopt the ordinance establishing lighting and VIP standards for new
developments at an upcoming meeting. Additionally, staff will continue to research the feasibility of a costsharing program to help offset the cost of purchasing and installing VIP devices for existing users, as outlined
above.
Staff is also seeking initial feedback and direction from the Board to help guide ongoing research and
evaluation of potential options.

CHAPTER 6 RESIDENCE DISTRICTS AND CHAPTER 5 GENERAL ZONING PROVISIONS
FOR THE VILLAGE OF PINGREE GROVE, KANE COUNTY, ILLINOIS
WHEREAS, the Village of Pingree Grove (the “Village”) is not a home rule municipality
within Article VII, Section 6A of the Illinois Constitution and, pursuant to the powers granted to
it under 65 ICLS 5/1-1-1 et seq.; and
WHEREAS, the Village President (the “President”) and the Board of Trustees of the Village
(the “Village Board” and with the President, the “Corporate Authorities”) desire to regulate light
pollution and resulting nuisances; and
WHEREAS, the Corporate Authorities find that adding Vehicle Impact Protection barriers
to new commercial or industrial construction will promote the health and welfare of the residents
of the Village; and
WHEREAS, after proper notice was given, the Planning and Zoning Commission (PZC) held
a public hearing on the proposed amendments on March, 16, 2026; and
WHEREAS, based on the PZC’s recommendation, the Corporate Authorities desire to
approve the proposed Text Amendment.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village
of Pingree Grove, Kane County, Illinois, as follows:
SECTION ONE: VILLAGE CODE AMENDED.
The Village Code is hereby amended, notwithstanding any provision, ordinance, resolution, or
Village Code section to the contrary, by amending language in Title 11, Chapter 6, Article A, 116A-7, with the addition of new text underlined, and deletion of text striked as follows:
11-6A-7: DISTRICT STANDARDS:
All uses of structures and land in the R-1 residence and agricultural district are subject to the
general standards, ordinances, and regulations of the Village. In addition, all uses located in the
R-1 zoning district shall be subject to the following district standards:
A. Exterior Lighting: All exterior lighting shall be shaded or inwardly directed in such a manner
so that no direct lighting or glare is cast upon adjacent residential or institutional property. The
intensity of such lighting shall not exceed two (2) foot-candles as measured at the abutting
property line.
B. A. Landscaping Aand Screening: All uses shall conform with the applicable requirements for
landscaping and screening.

C. B. Off Street Parking Aand Loading: All uses shall conform to the applicable requirements
for off street parking and loading set forth in this title.
D. C. Performance Standards: All uses shall conform to the performance standards set forth in
this title.
E. D. Signs: All uses shall conform to the applicable requirements for signs set forth in this title.
SECTION ONE: VILLAGE CODE AMENDED.
The Village Code is hereby amended, notwithstanding any provision, ordinance, resolution, or
Village Code section to the contrary, by amending the language of Title 11: Zoning Regulations,
Chapter 5: General Zoning provisions, with the addition of Section 11-5-11: Exterior Lighting and
Section 11-5-12: Vehicle Impact Protection:
11-5-11: EXTERIOR LIGHTING STANDARDS
A. Exterior Lighting: All exterior lighting shall be shaded or inwardly directed in such a
manner so that no direct lighting or glare is cast upon adjacent property. The intensity of
such lighting shall not exceed two (2) foot candles as measured at the abutting property
line.
11-5-12: VEHICLE IMPACT PROTECTION
A. Definition
a. Vehicle Impact Protection Device: A concrete or metal barrier, including but not
limited to a bollard or decorative planter, designed to protect both people and
property from moving vehicles.
B. Applicability. Vehicle impact protection devices are used to safeguard pedestrians,
buildings, and building occupants from motor vehicles. These vehicle impact protection
devices are required for buildings with a commercial or industrial use or as otherwise
required in this section.
C. Location. Vehicle impact protection devices must be utilized in each of the following
instances (refer to Figure 1 Vehicle Impact Protection Required Locations and Figure 2
Vehicle Impact Protection Model):
a. Building Entrances. All public entrances to buildings in the C-1 and I-1 Districts,
schools, and residential care facilities must utilize vehicle impact protection
devices where:
i. Adjacent parking spaces are perpendicular to or angled towards the use
and/or public entrance.
ii. Drive aisles are perpendicular to the use and/or public entrance.
b. Storefronts, Outdoor Dining Areas, and Day Care Center Outdoor Play Areas.
Vehicle impact protection devices must be used for buildings where storefront
windows are within 2 ft off the ground, outdoor dining areas, and day care center
outdoor play areas where:
i. Adjacent parking spaces are perpendicular to or angled towards the use.
ii. Drive aisles are perpendicular to the use.

D. Layout. Vehicle impact protection devices may be located alongside the outside wall of a
building, along the edge of the adjacent sidewalk, at the end of an adjacent parking space,
or in another location as approved by the Village Manager or designee. When vehicle
impact protection devices are located within a parking space, said parking space must be
adequately sized to meet the requirements of this code.
E. Standard. Vehicle impact protection devices must be designed to achieve an impact
resistance level of five thousand pounds traveling at 30 miles per hour (such as ASTM
F3016 S30 or similar, as determined by the Village Engineer.

F. Design. Vehicle impact protection devices must be designed in accordance with the
following requirements:
a. Type. Vehicle impact protection devices may include bollards, planters, or other
design features that meet the specifications of this section.
b. Height. Vehicle impact protection devices must be a minimum of 3 feet in height.
a.c. Vehicle Impact Protection Spacing for Entrances: Vehicle impact protection
devices must measure 48 inches from inside edge to inside edge inside of
applicable entrances.
b.d.
Vehicle Impact Protection Spacing for Parking Spaces: A continuous barrier
(e.g., concrete planter or other design features that meet the specifications of this
section) may be provided in lieu of individual vehicle impact protection devices. In
the absence of a continuous barrier vehicle impact protection devices must
measure 48 inches from inside edge to inside edge at the end of the parking space
in between the parking space and the applicable use.
c.e. Aesthetics. Materials used for vehicle impact protection devices must be finished
metal or have a decorative cover, or anything approved by the Village Manager or
designee
f. Variances. The Village Manager or their designee may grant a variance from one
or more of the design requirements of this subsection F, design standards, where
strict compliance is impractical, unnecessary, or would preclude reasonable site
design, as determined in their sole discretion. In granting such a variance, the
Village Manager or designee may consider alternative locations, layouts,
standards, or designs that provide comparable or adequate vehicle impact
protection and may impose conditions as necessary to further the intent of this
section.
G. Access. Vehicle impact protection devices must not restrict access to the building. The
spacing of protective devices must be designed to meet the Illinois Accessibility Code and
all additional applicable laws.
H. Temporary Devices. Plain concrete barriers, such as jersey barriers, may be temporarily
allowed for no longer than 90 days while awaiting the installation of new or replacement
permanent devices.
E.I. Exemptions. Section 11-5-12 (Vehicle Impact Protection) shall not apply to protection
devices which are voluntarily installed, and which are not required by this ordinance
F.J. Timeline. All property owners subject to this section 11-5-12 shall bring their properties
into compliance with the requirements herein no later than December 31, 2028.
