Transportation (TxDOT), and reducing the posted speed limit on East Meyer Avenue

those living in Seabrook and visiting ; and
Whereas, fire remains a serious public safety concern both locally and nationally, and
the presence of lithium-ion batteries in many household devices introduces unique
fire risks; and
Whereas, most of the electronics used in homes daily — including smartphones,
tablets, laptops, power tools, e-bikes, e-scooters, and toys — are powered by lithiumion batteries, which if misused, damaged, or improperly charged, can overheat, start a
fire, or explode; and
Whereas, the National Fire Protection Association® (NFPA®) reports an increase in
battery-related fires, underscoring the need for public education on the safe use of
lithium-ion batteries; and
Whereas, the way lithium-ion battery devices are charged can make a difference in
helping prevent home fires, and safe charging includes using the cord and charger
that came with your device or one approved by the manufacturer, unplugging when
fully charged; and
Whereas, Seabrook first responders are dedicated to reducing the occurrence of fires

Executive Summary / Background:
The City solicited qualifications for engineering services for this project. The firms were
reviewed and ranked based on qualifications, and staff began negotiations with the
highest-ranked firm as required for professional engineering services.
During negotiations, the anticipated engineering cost was determined to be outside the
available budget for the project. Staff does not recommend continuing the RFQ
procurement under those circumstances.
Instead, staff recommends formally ending the current procurement and utilizing the
City's existing contracted engineering firm, provided the work is within the scope of that
existing agreement.
This action is not a determination that the responding firms were unqualified. It is a
decision to discontinue this particular procurement because staff was unable to negotiate
an agreement that fits within the City's expected project budget.

Mayor Jim Sweeney called the Seabrook Council Meeting to order at 6:00 p.m. in the Council
Chambers in Seabrook City Hall. Present were City Councilmembers Jim Sweeney, Jared Sessum,
Angela Cervantes, Summer Sanford, Melanie Deemer, Guy Rodgers, Byron Hanssen. Also in

services and solicit proposals from qualified event logistics and management firms
for the planning and execution of a new annual City event, and to bring the
proposals and associated funding requirements back to City Council for
consideration.
Councilmember Cervantes suggested the proposed Seabrook Seafood Festival,
presented during the Hotel Occupancy Tax funding presentations, be considered as the
City’s annual signature event rather than developing an entirely new event.
Councilmember Rodgers expressed support for a large-scale City event that could
potentially incorporate the seafood festival.
Following discussion, Council reached consensus to solicit proposals from companies
to coordinate and produce a larger City event, with City staff retaining appropriate
oversight. Council further agreed that selection should not be based primarily on the
lowest cost, but should place greater emphasis on the quality, scope, and overall
experience offered to Seabrook residents.

Councilmember Cervantes asked whether the proposed records policies would change
the City’s records retention periods. City Attorney David Olson explained that the City
followed the records retention schedules established by the Texas State Library and
Archives Commission (TSLAC) and that the proposed policies reinforced those existing
state requirements.

Discuss the pre-construction and post-construction ambient sound level studies
conducted near the intersection of Red Bluff Road and State Highway 146,
including the study findings, and provide direction to staff regarding potential next
steps.
Matt Cott with Behrens & Associates presented the findings of the sound study. He
reviewed the measurements taken, monitoring locations, and results, including sound
levels and perceived noise. Mr. Cott reported that sound levels were reduced at three of
the four monitoring locations and that the results did not indicate an overall worsening of
sound conditions or a measurable overall noise problem. He noted that intermittent
noise events were recorded and attributed primarily to passing trains and landscaping
activities.
Councilmember Cervantes expressed concern regarding the level of noise experienced
in her neighborhood and played an audio recording illustrating the sound residents
encounter.
Mayor Sweeney asked about potential noise mitigation measures. Mr. Cott discussed
several sound-control options, including various types of wall construction designed to
reduce decibel levels and the importance of a wall’s location and distance from the
noise source. He explained that a shorter wall would likely not adequately address the
issue due to the distance that train noise can travel.
Following discussion, Council requested additional analysis to identify potential
locations for a sound wall and to conduct noise modeling to evaluate its anticipated
effectiveness. Council also requested a cost estimate for the proposed mitigation
measures to assist in determining how the available $1.6 million could best be utilized.

Mayor Pro Tem Summer Sanford called the Seabrook Council Meeting to order at 5:03 p.m. in the
Council Chambers in Seabrook City Hall. Present were City Councilmembers Angela Cervantes,
Summer Sanford, Melanie Deemer, Byron Hanssen. Also in attendance were: City Manager Gayle

General Information:
Consider and take all appropriate action on the approval of the first reading of Ordinance
2026-21, updating the prima facie speed limits along State Highway 146 frontage roads
based on an engineering and traffic study by the Texas Department of Transportation
(TxDOT), and reducing the posted speed limit on East Meyer Avenue from 35 MPH to
30 MPH based on a City traffic study.
Executive Summary / Background:
SH 146 Feeder Roads:
TxDOT completed a traffic study on both feeder roads of SH 146 with results of 45
MPH as the recommended speed limit.
East Meyer Road:
With the completion of E Meyer road from asphalt to concrete, staff was asked to
analyze the existing 35 MPH speed limit and revise to 30 MPH. Staff collected data on
both eastbound and westbound travel, with the results being 11,594 vehicles traveling
eastbound with an average speed of 29.38 MPH, a 50% speed of 29.51 MPH, and an
85% speed of 35.71 MPH. Westbound results are 4,320 vehicles, with a average speed of
29.38 MPH, a 50% speed of 30.36 MPH, and an 85% speed of 34.81 MPH. The data
shows that a significant amount of traffic is already traveling at or near 30 mph. In
addition, City staff has considered the residential characteristics of East Meyer,
including the presence of residential driveways directly accessing the roadway.The
City's Residential Traffic Management Plan provides a process for reviewing speedcontrol requests, including collection and evaluation of traffic data and consideration of
site-specific conditions. The plan specifically identifies the 85th-percentile speed as an
important factor in evaluating speed-related concerns and allows consideration of other
conditions present at the study location.
Based upon the information collected, City staff is supportive of bringing the
requested reduction from 35 mph to 30 mph forward for consideration by the

ORDINANCE 2026-21
AMENDMENT OF SH 146 FRONTAGE ROAD AND EAST MEYER SPEED LIMITS
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
SEABROOK, TEXAS, CHAPTER 90 "TRAFFIC AND VEHICLES", ARTICLE II
"SPEED RESTRICTIONS", SECTION 90-33 "ENUMERATION OF LIMITS";
ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES
UNDER THE PROVISIONS OF SECTION 545.356, TEXAS TRANSPORTATION
CODE, UPON THE BASIS OF ENGINEERING AND TRAFFIC INVESTIGATIONS,
FOR THE SH 146 FRONTAGE ROADS AND EAST MEYER AVENUE WITHIN THE
CORPORATE LIMITS OF THE CITY OF SEABROOK, AS SET OUT IN THIS
ORDINANCE; PROVIDING FOR A PENALTY OF A FINE NOT TO EXCEED TWO
HUNDRED DOLLARS ($200.00) OR THE MAXIMUM AMOUNT PROVIDED BY
LAW FOR VIOLATION OF ANY PROVISIONS HEREOF BY INCLUSION INTO THE
CODE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES
INCONSISTENT OR IN CONFLICT HEREWITH; AND PROVIDING FOR
SEVERABILITY.
WHEREAS, Section 545.356, Texas Transportation Code, provides that whenever
the governing body of the city shall determine upon the basis of an engineering and traffic
investigation that any prima facie speed therein set forth is greater or less than is reasonable
or safe under the conditions found to exist at any intersection or other place or upon any
part of a street or highway within the city, taking into consideration the width and condition
of the pavement and other circumstances on such portion of said street or highway, as well
as the usual traffic thereon, said governing body may determine and declare a reasonable
and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which
shall be effective when appropriate signs giving notice thereof are erected at such
intersection or other place or part of the street or highway;
WHEREAS, Ordinance No. 2018-30 comprehensively updated Chapter 90,
Article II, of the Seabrook City Code and established the City's enumerated speed limits,
including speed limits along State Highway 146 and its frontage roads; and
WHEREAS, the City Council has received and considered an engineering and
traffic investigation for the State Highway 146 frontage roads from Texas Department of
Transportation (TxDOT), together with City traffic studies for East Meyer Avenue, and
desires to incorporate the resulting prima facie speed limits into the City Code; and
WHEREAS, the City traffic studies for East Meyer Avenue reflect a currently
posted speed limit of 35 MPH, an eastbound 85th-percentile speed of approximately
35.71 MPH, and a westbound 85th-percentile speed of approximately 34.81 MPH, and
the City Council has determined that a 30 MPH prima facie speed limit on East Meyer
Avenue is reasonable and safe; and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SEABROOK, TEXAS:
SECTION 1. FINDINGS OF FACT.
The facts and matters set forth in the preamble of this Ordinance are hereby adopted
and found to be true and correct.
SECTION 2. COMPLIANCE WITH TRANSPORTATION CODE; PRIMA
FACIE SPEED LIMITS.
Upon the basis of an engineering and traffic investigation heretofore made as
authorized by the provisions of Section 545.356, Texas Transportation Code, the following
prima facie speed limits hereafter indicated for vehicles are hereby determined and
declared to be reasonable and safe, and such speed limits are hereby fixed at the rate of
speed indicated for vehicles traveling upon the named streets and highways, or parts
thereof, described as follows:
Along SH 146, west frontage road, from the north City limit of the City of
Seabrook to the intersection of NASA Rd, a distance of approximately 1.858
mile, the speed limit shall be 45 MPH.
Along SH 146, east frontage road, from a point 237 feet south of Seabrook
Circle Rd. to the intersection of NASA Rd, a distance of approximately 1.070
mile, the speed limit shall be 45 MPH.
East Meyer Avenue, for its entire length within the City of Seabrook, the speed
limit shall be 30 MPH, except as otherwise provided for any applicable school
zone established elsewhere in this Article.
SECTION 3. AMENDMENT TO THE CODE.
The Code of Ordinances of the City of Seabrook, Texas, Chapter 90 "Traffic and
Vehicles", Article II "Speed Restrictions", Section 90-33 "Enumeration of Limits", under
the subsection entitled "Major Roads", is hereby amended by (1) replacing the existing
State Highway 146 frontage-road speed-limit provisions and (2) adding East Meyer
Avenue, as follows:
CHAPTER 90
TRAFFIC AND VEHICLES
ARTICLE II. - SPEED RESTRICTIONS
Sec. 90-33. - Enumeration of Limits.
Major Roads
NASA Road 1 (formerly F.M. 528), for its entire length within the city, being from
the western city limits to its intersection with State Highway 146, 45 miles per hour.
Red Bluff Road, from the west city limits to State Highway 146, a distance of
approximately 0.90 mile, 45 miles per hour.

Red Bluff Road, from a point 400 feet west of Park Drive to Todville Road, 35 miles
per hour.
Repsdorph Road, for its entire length, a distance of 1.40 miles, 35 miles per hour.
Todville Road, from a point 600 feet north of East Meyer Avenue to the north city
limits, a distance of 1.60 miles, 35 miles per hour.
El Mar Lane, between Bahama Drive and North Meyer Avenue of 25 miles per
hour.
Along SH 146 Southbound and Northbound Frontage Lanes from the north city limit
to the south city limit line, a distance of approximately 3.10 miles, the speed limit
shall be 45 miles per hour until an 85-percentile speed, and traffic and engineering
investigations made by Texas Department of Transportation is made and is posted
by the state.
Along SH 146, west frontage road, from the north City limit of the City of
Seabrook to the intersection of NASA Rd, a distance of approximately 1.858 mile,
the speed limit shall be 45 MPH.
Along SH 146, east frontage road, from a point 237 feet south of Seabrook Circle
Rd. to the intersection of NASA Rd, a distance of approximately 1.070 mile, the
speed limit shall be 45 MPH.
East Meyer Avenue, for its entire length within the City of Seabrook, the speed
limit shall be 30 MPH, except as otherwise provided for any applicable school
zone established elsewhere in this Article.
All other provisions of Section 90-33 not expressly amended by this Ordinance
shall remain in full force and effect.
SECTION 4. PENALTY CLAUSE; INCLUSION INTO THE CODE.
This Ordinance is hereby incorporated into and made a part of the Seabrook City
Code. Any person who shall violate any provision of this Ordinance shall be deemed guilty
of a misdemeanor and, upon conviction, shall be fined in an amount not more than Two
Hundred Dollars ($200.00) per offense or the maximum amount provided by law. Each
day of violation shall constitute a separate offense.
SECTION 5. REPEAL OF CONFLICTING ORDINANCES.
All ordinances or parts of ordinances inconsistent or in conflict herewith are, to the
extent of such inconsistency or conflict, hereby repealed.
SECTION 6. SEVERABILITY.
In the event any clause, phrase, provision, sentence, or any part of this Ordinance
or the application of the same to any person or circumstances shall for any reason be
adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not
affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other
than the part declared to be invalid or unconstitutional; and the City Council of the City of

Seabrook, Texas, declares that it would have passed each and every part of the same
notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, whether there be one or more parts.
SECTION 7. NOTICE BY PUBLICATION.
The City Secretary shall give notice of the enactment of this Ordinance by promptly
publishing it or its descriptive caption and penalty after final passage in the official
newspaper of the City; the Ordinance to take effect upon publication and posting of signs
in accordance with law.
SECTION 8. NOTICE BY ERECTION OF SIGNS.
This Ordinance shall become effective upon appropriate erection of speed zone
signage giving notice of the speed limits established herein.

Consider and take all appropriate action on first and final reading of Ordinance 2026-22,
Budget Amendment No. 5, Amending the Budget for the fiscal year beginning October
1, 2025 and ending September 30, 2026.
Executive Summary / Background:
Staff is requesting approval of budget amendments for several expenditures that are
expected to exceed the amounts originally included in the adopted budget. These
amendments primarily reflect increased service activity and costs that were not fully
anticipated when the budget was prepared.
Budget Amendments
Contract Prosecutor – Municipal Court
Municipal Court activity, including fines and citations, has increased. The higher case
volume has resulted in greater use of the City's contract prosecutor than originally
budgeted. An amendment is necessary to provide sufficient funding for prosecution
services through the remainder of the fiscal year.
Legal Services
Legal expenses are also projected to exceed the adopted budget. During the year, the
City required additional legal assistance related to projects, agreements, operational
matters and an increased volume of public information/FOIA requests. These needs
resulted in greater legal expenditures than anticipated during preparation of the budget.
SH 146 Corridor Landscaping Maintenance
Maintenance of the SH 146 corridor landscaping began during the fiscal year; however,
funding for the ongoing maintenance was not included in the original budget. The
amendment will establish the necessary funding for the City's landscaping and
maintenance responsibilities along the corridor for the remainder of FY 2026.
Annual Audit Services
During preparation of the budget, the amount allocated for annual audit services was
reduced based on the anticipated cost at that time. Actual audit costs are higher than the

the cost of completing the City's required annual financial audit.

AN ORDINANCE AMENDING THE AMOUNT OF APPROPRIATIONS FOR
THE FISCAL YEAR BEGINNING OCTOBER 1, 2025 AND ENDING
SEPTEMBER 30, 2026 BY AUTHORIZING CERTAIN ADDITIONS IN THE
AMOUNT OF $ 58,000.00 FOR GENERAL FUND; AUTHORIZING THE CITY
MANAGER TO TAKE ALL ACTIONS NECESSARY TO FACILITATE THE
CHANGES IDENTIFIED; AND FINDING AVAILABLE UNENCUMBERED
FUNDS FOR THE SUPPLEMENTAL APPROPRIATION AND/OR RESERVE
REDUCTION.
WHEREAS, the City Council of the City of Seabrook Approved Budget Ordinance
2025-17 on September 25, 2025; and
WHEREAS, the City Council is authorized by law to make changes in the City
budget for supplemental appropriations or reductions, and;
WHEREAS, the City Manager has certified there are unencumbered fund balances
available for appropriation in excess of those appropriated for specific expenditures in the
budget for supplemental appropriation and/or transfer; and
WHEREAS, such expenditures will occur subsequent to the adoption of the
2025/26 budget and will require formal appropriations; and
WHEREAS, said amendments are necessary to appropriate funds to provide
proper fund accounting for changes to a variety of expenditure and revenue lines as a result
of timing circumstances relating to the time of budget adoption; and
WHEREAS, the City Council finds it in the public interest to amend the total Fiscal
Year 2025/26. Operating Budget for the General Fund by adjusting various budget
accounts as outlined in Exhibit “A”
WHEREAS, the City Council of the City of Seabrook finds and determines that
this budget amendment complies with all requirements under its Charter and laws;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SEABROOK, STATE OF TEXAS:
THAT,
the 2025/26 Adopted Budget for the City of Seabrook for the period
beginning on October 1, 2025 and ending on September 30, 2026 is hereby
amended by decreasing and increasing various department line items in the
total amount of $ 58,000.00 as set out in Exhibit “A”, Budget Amendment
# 5 to FY 2026 attached hereto and incorporated herein.
