EXECUTIVE SESSION
A.

City Council shall convene into closed executive session pursuant to Section
511.07 to seek legal advice from the City Attorney regarding proposed
contracts for Municipal Solid Waste Services.

B.

City Council shall convene into closed executive session pursuant to Section
551.074, of the Texas Government Code, Personnel, to deliberate the duties
of the City Manager under the Home Rule Charter and, pursuant to Section
551.071 of the Texas Government Code, to seek legal advice from the City
Attorney on the same topic.

CITIZENS' INPUT
In-person citizen comments will be heard during the Regular Session. In keeping with the City Council’s
Rules of Procedure adopted on June 4, 2024, electronic mail comments will no longer be read aloud. Paper
copies will be provided to the City Council at the dais. The comments will be made a part of the public record
in the minutes. “Pursuant to Section 551.007 of the Texas Gov’t Code, any member of the public has the
opportunity to address the City Council concerning any matter of public business or any posted agenda item;
however, the Act prohibits the City Council from deliberating any issues not on the public agenda and such
non-agenda issues may be referred to City staff for research and any future action; all persons addressing
are subject to council adopted rules and limitations permitted by law” At this time, two-minute comments will
be taken from the audience on any topic. To address the Council, please submit a fully completed request
card to the City Secretary prior to the beginning of the Citizens' Input portion of the Council meeting. In
accordance with the Texas Open Meetings Act, the City Council cannot discuss issues raised or make any
decisions at this time. Issues may be referred to City Staff for research and possible future action.

A.

Consider the minutes for the August 18, 2026, and September 1, 2026, City

Council Meetings.
B.

Consider a Resolution approving the terms and conditions of Amendment No.
4 to the Household Hazardous Waste Interlocal Agreement between Dallas
County and the City of Duncanville, Texas, to provide household hazardous
waste services, including a disposal event and disposal services at the Dallas
County fixed-site Home Chemical Collection Center from October 1, 2026,
through September 30, 2027, as part of the Dallas Area Household Hazardous
Waste Network, for a cost not to exceed $57,700.00.

C.

Consider a Resolution approving an amendment to the Municipal Materials
Management Agreement by and between Republic Services of Texas, LTD.
and the City of Duncanville to increase contract rates by 4.69% for residential
collection and commercial services, effective October 1, 2026.

D.

Consider a Resolution approving an amendment to the Solid Waste Disposal
Agreement by and between Waste Management of Texas, Inc. and the City of
Duncanville to increase contract rates by 4.68% for solid waste disposal,
effective October 1, 2026.

E.

Consider a Resolution Approving a Negotiated Settlement Between the Atmos
Cities Steering Committee (ACSC) and Atmos Energy Corp., Mid-Tex Division
regarding the company's 2026 rate review mechanism filing; declaring existing
rates to be unreasonable; adopting tariffs that reflect rate adjustments
consistent with the negotiated settlement; finding the rates to be set by the
attached settlement tariffs to be just and reasonable and in the public interest;
approving an attachment establishing for pensions and retiree medical
benefits; requiring the company to reimburse ACSC's reasonable rate making
expenses; determining that this resolution was passed in accordance with the
requirements of the Texas Open Meetings Act; adopting a savings clause;
declaring an effective date; and requiring delivery of this resolution to the
company and the ACSC's legal counsel.

F.

Consider a Resolution approving an interlocal agreement between the City of
Duncanville and Texas Municipal League Intergovernmental Risk Pool (TMLIRP) for group critical illness insurance coverage to satisfy compliance with
House Bill 4144.

G.

Consider a Resolution authorizing the donation of six (6) SYMBOL brand
electronic ticket writers and twenty (20) ZEBRA brand mobile printers to the
Duncanville Independent School District Police Department.

H.

Consider a Resolution authorizing annual expenditures for wholesale treated
water and wastewater treatment services provided by Dallas Water Utilities
and wastewater treatment services and the Lakeview Regional Water Supply
Project provided by the Trinity River Authority, for Fiscal Year 2026-2027.

I.

Consider a Resolution approving the revised and amended terms for a
restated economic development incentive agreement between the Duncanville
Community and Economic Development Corporation (DCEDC) and Hajoca
Corporation dba Moore Supply Co., in an amount that shall not exceed
$631,350, categorizing this project as a business expansion and retention

incentive.

Consider a Resolution confirming the Interim City Manager's appointment of
James Leary as the Interim Fire Chief.

Consider the reappointment of Tammi Abney to the Duncanville Community
and Economic Development Corporation (DCEDC) for a two-year term.

Consider a Resolution Authorizing the City Manager or Designee to enter into
Interlocal Agreements for Cooperative Purchasing

M.

Consider a Resolution establishing the Duncanville Teen Council

N.

Consider an ordinance amending the Code of Ordinances by revising Chapter
12G, “Automotive Repair, Restoration and Salvage Facilities,” to modify
provisions relating to vehicle storage timeframes, appeals, and recordproduction timeframes.

O.

Consider a Resolution authorizing an Interlocal Agreement with the South
Central Planning and Development Commission for the Utilization of
MyGovernmentOnline (MGO) software modules for Planning and Permitting
Services.

Consider an Ordinance accepting Fiscal Year 2027 Motor Vehicle Crime
Prevention Authority grant funding, authorizing the required City match and
grant appropriations, authorizing procurement of two Skydio X10 Drone as
First Responder Dock systems from Axon Enterprise, Inc., and deferring
procurement of ten Automated License Plate Recognition systems pending
final State and MVCPA guidance.

C.

Open and hold the continued Public Hearing on the FY 2026-27 Budget

D.

Conduct a Public Hearing on the 2026 tax rate.

E.

Consider an Ordinance approving and adopting a budget for the City for the
Fiscal Year October 1, 2026, through September 30, 2027.

F.

Consider an Ordinance of the City of Duncanville, Texas, levying Ad Valorem
Taxes for the Year 2026 at a rate of $0.611659 per one hundred dollars
($100.00) assessed valuation on all taxable property within the corporate limits
of the City of Duncanville as of January 1, 2026, to provide revenues for
current expenses and interest and sinking fund requirements.

G.

Consider an Ordinance ratifying the Fiscal Year 2026-2027 Budget which
raises more revenue from property tax than in the previous year.

H.

Consider a Resolution adopting the Master Fee Schedule for FY 2026-2027.

I.

Consider an Ordinance regarding the City of Duncanville's Texas Municipal

Retirement System (TMRS) benefits adopting: (1) Retroactive Repeating
COLAs, for retirees and their beneficiaries; and (2) Annually Accruing Updated
Service Credits (USC).

Consider an Ordinance updating - False Alarms - Alarm Permitting

Consider an Ordinance establishing and implementing a program to charge
mitigation rates for the deployment of emergency and non-emergency services
by the Fire Department for services provided/rendered for the City of
Duncanville.

Consider a Resolution authorizing an addendum to the service agreement with
Emergicon, LLC, adding billing and claims management services with
Emergifire for fire response and cost recovery services for a service fee of
15% of revenues collected.

M.

Conduct a public hearing and consider a zoning text amendment and
amendment to the land use chart to allow HUD-code manufactured homes as
a permitted land use in the Estate Single-Family Residential District (SF-43)
zoning district.

N.

Conduct a public hearing and consider a request to amend the Code of
Ordinances, Appendix B Subdivision Regulations and Section 5.02, Planning
and Zoning Commission of the Zoning Ordinance to delegate the Planning and
Zoning Director/Assistant Director or designee the authority to administratively
approve, approve with conditions, or disapprove all simple plats as defined by
the Zoning Ordinance.
