A LOCAL LAW AMENDING CHAPTER 110
OF THE BEDFORD TOWN CODE
CONCERNING TAXATION
A LOCAL LAW to amend
Chapter 110 of the Bedford
Town
Code
concerning
Taxation.
BE IT ENACTED by the Town Board of the Town of Bedford as follows:
Section 1.
Legislative Intent.
This Local Law is intended to amend Chapter 110, Article II, Section 4 of the Bedford Town Code
and to further delete and replace Chapter 110, Article II, Section 5.A to clarify certain provisions
relating to the criteria for granting a Senior Citizens Tax Exemption and to modify the extent of
the exemption, as authorized under New York Real Property Tax Law Section 467.
Section 2.
Authority.
This Local Law is adopted pursuant to the provisions of the New York Municipal Home Rule
Law, Article 16 of the New York Town Law and Section 467 of the New York Real Property Tax
Law.
Section 3.
Amendment.
Chapter 110 of the Bedford Town Code – Taxation, Article II – Senior Citizens Tax Exemption,
Section 4 entitled “Granting of exemption”, is hereby revised, as follows:
§ 110-4 Granting of exemption.
A. Any real property located in the Town of Bedford shall be exempt from taxation by the Town,
to the extent of 50% of the assessed valuation thereof as set forth in § 110-5.A, pursuant to §
467 of the Real Property Tax lawLaw, provided that:
(1) All of the owners of said real property are 65 years of age or over or, where the
owners are husband and wife a married couple, either at least the husband one
spouse or wife must be 65 years of age or over.
(2) The income of the owner or the combined incomes of all the owners of the property
does not exceed the annual income in § 110-5 for the 12 consecutive months income

tax year immediately preceding the date of the application for exemption. “Income
tax year” shall mean the twelve-month period for which the applicant filed a federal
personal income tax return or, if no such return was filed, the calendar year where
title is vested in either member of a married couple. Where title is vested in either
the husband or the wife member of a married couple, their combined income may
not exceed the annual income in § 110-5.A such sum. For purposes of determining
eligibility, “income” shall be computed pursuant to § 467 of the Real Property Tax
Law, Subdivision 3(a)(iv), and consist of the adjusted gross income for federal
income tax purposes as reported on the applicant’s federal or state income tax return
for the income tax year specified above, subject to any subsequent amendments or
revisions, and including tax-exempt interest or dividends that were excluded from
the applicant’s federal adjusted gross income (“FAGI”). Such income shall include
social security (including those benefits not part of FAGI), and retirement benefits,
interest, dividends, total gain from the sale or exchange of a capital asset which
may be offset by a loss from the sale or exchange of a capital asset in the same
income tax year, net rental income, salary or earnings and net income from selfemployment, but losses applied to reduce an applicant’s federal adjusted gross
income shall be subject to the limitations specified in § 467 of the Real Property
Tax Law, Subdivision 3(a)(iv)(5). For purposes of determining income eligibility,
the calculation of total income shall not include a return of capital, gifts, or
inheritances, or a veteran’s disability compensation. In computing net rental income
and net income from self-employment, no depreciation deduction shall be allowed
for the exhaustion, wear and tear of real or personal property held for the production
of income.
(3) Effective as of the June 1, 2027 tentative assessment roll/2028 tax billing cycle and
continuing thereafter, distributions received from an individual retirement account
or individual retirement annuity that were included in the applicant’s FAGI shall
be considered income for purposes of determining exemption eligibility.
(4) The title to the property shall have been vested in the owner or all of the owners of
the property for at least 12 consecutive months prior to the date of making
application for exemption.
(5) The property is used exclusively for residential purposes.
(6) The real property is the legal residence of and is occupied in whole or in part by the
owner or by all of the owners of said property.

Section 4.
Amendment.
Chapter 110 of the Bedford Town Code – Taxation, Article II – Senior Citizens Tax Exemption,
Section 5.A entitled “Graduated maximum income level” is hereby deleted and replaced in its
entirety, as follows:

Section 5.
Ratification, Re-adoption and Confirmation.
Except as specifically modified by the amendments contained herein Chapter 110 of the Town
Code of the Town of Bedford is otherwise to remain in full force and effect and is otherwise
ratified, readopted and confirmed.
Section 6.
State Environmental Quality Review Act.
Pursuant to 6 NYCRR 617.5 (26) and (33) this Local Law is classified as a Type II action which
requires no further review under the New York State Environmental Quality Review Act.

Section 7.
Numbering for Codification.
It is the intention of the Town of Bedford and it is hereby enacted that the provisions of this Local
Law shall be included in the Code of the Town of Bedford; that the sections and subsections of
this Local Law may be re-numbered or re-lettered by the Codifier to accomplish such intention;
that the Codifier shall make no substantive changes to this Local Law; that the word “Local Law”
shall be changed to “Chapter,” “Section” or other appropriate word as required for codification;
and that any such rearranging of the numbering and editing shall not affect the validity of this
Local Law or the provisions of the Code affected thereby.
Section 8.
Severability.
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this
Local Law or their petition to other persons or circumstances. It is hereby declared to be the
legislative intent that this Local law would have been adopted if such illegal, invalid or
unconstitutional provision, clause, sentence, subsection, word or part had not been included
therein, and if such person or circumstance to which the Local Law or part hereof is held
inapplicable had been specifically exempt therefrom.
Section 9.
Effective Date.
This local law shall take effect immediately upon filing with the Office of the Secretary of State.

Changes to New York State RPTL 467 Low Income Aged Exemptions
Several significant modifications have been made to New York State Real Property Tax Law (RPTL) Section 467,
which governs the low-income aged exemptions for senior citizens aged 65 or older on their primary residence.
These changes primarily focus on new income limits and percentages, sliding scale options and adjustments to
income that local municipalities may adopt.
Currently the T. Bedford has adopted the income limit of $50,000 to be eligible for the 50% tax saving for the low
income senior Aged exemption and the sliding scale option that gradually reduces the exemption by 5% intervals
to the state maximum income limit of $58,400.
Local Option 1: Lower Income thresholds and Increased exemption percentages
Beginning with the 2026 Assessment Roll, the town may grant, at local option, up to a 65% property tax
exemption for qualifying low-income seniors, increasing from the previous maximum of 50%.

Tax Implications:
For the 2025 Final Assessment Roll, 81 low income senior exemptions were granted with 55 seniors receiving the
maximum 50% tax exemption. The income ranges for all seniors receiving the max 50% tax exemption are below:
- 50 seniors with income < $47,000
2 seniors with income > $47,000 but less than $48,000
0 seniors with income > $48,000 but less than $49,000
3 seniors with income > $49,000 but less than $50,,000
Assuming ALL current low income senior exemptions @50% were to receive the 65% tax exemption,
the town tax rate would increase app. $0.03 and the typical residential property tax bill, with an assessed value
of $70,000, market value of $915,000, would increase app. $2.20.

Local Option 2: Including taxable IRA distributions in determining exemption eligibility
Summary of Income Definitions and local options for adjustments to income:
Recent legislation stipulates that the Federal Adjusted Gross Income (FAGI) reported on income
tax returns will serve as the basis for determining income eligibility.
The FAGI is then adjusted as follows:
- Inclusion of tax-exempt interest and dividends not included in FAGI
- Inclusion of non-taxable Social Security benefits not included in FAGI
- capping the net loss amount on individual schedules to $3,000 & total losses to $15,000
At local option, additional adjustments to FAGI that may be adopted:
- Inclusion of taxable IRA distributions.
- Deduction of non-taxable Social Security benefits.
- Deduction for unreimbursed medical & drug expenses not covered by insurance.
Note:
Pensions and annuities are included as income in determining exemption eligibility.
Other Westchester municipalities have adopted option to include taxable IRA distributions as income
Signed worksheets are used for non-tax filers.
Tax Implications:
For the 2025 Final Assessment Roll, taxable IRA distributions (line 4b) were excluded as income
in determining exemption eligibility for the low income senior Aged exemption.
If the local option is adopted to include taxable IRA distributions as income in determining
income eligibility for the low income senior Aged exemption, the tax implications would be as
follows:
- 14 seniors would lose their low income senior Aged exemption
8 seniors would retain their exemption but at a lower percentage.

RESOLUTION
BE IT RESOLVED that the Town Board of the Town of Bedford hereby
ratifies and approves the Stipulation of Settlement dated March 25, 2026 resolving
a matter filed against the Town of Bedford including a Settlement Payment in the
amount of $55,000, and hereby authorizes and directs the Town Supervisor to
execute same and take all actions consistent therewith.

A Resolution Determining
Freedom of Information Law Appeal
WHEREAS, by letter dated March 25, 2026, which was received by the
Town Clerk on April 1, 2026, Ronald C. Greenland, filed an appeal pursuant to
the Freedom of Information Law (the “FOIL Appeal”) with respect to a response to
a FOIL request provided by the Town of Bedford Records Officer on January 2,
2026, seeking certain police reports and other documents retained by the Town
of Bedford Police Department; and
WHEREAS , pursuant to Town Code §95-8(C), the Town of Bedford Town
Board is the body designated to hear appeals for denial of access to records
under the FOIL; and
WHEREAS , the Town Board has reviewed and discussed the merits of the
FOIL Appeal with the Town Attorney in executive session and considered the
basis for the denial of the original FOIL request and whether the FOIL appeal
should be granted or denied.
NOW THEREFORE, IT IS HEREBY RESOLVED , that the Town Board
has determined that the appeal was not timely filed within thirty (30) days as
required by Public Officers Law §89(4)(a); however, because Mr. Greenland is
currently incarcerated, the Town Board has determined that the FOIL Appeal
should be addressed on the merits; and
IT IS FURTHER RESOLVED , that the FOIL Appeal is granted based upon
the finding that there is one (1) record that is arguably responsive to the original
FOIL request that was not provided previously; and
IT IS FURTHER RESOLVED , that the Town of Bedford Records Officer is
directed to provide such document to Mr. Greenland with five (5) days of the date
of this Resolution; and
IT IS FURTHER RESOLVED , that the Town Board has been advised that
a diligent search has been conducted and the document being provided is the
only document in the possession of the Town of Bedford Police Department that
is potentially responsive to the FOIL Appeal. To the extent Mr. Greenland is
seeking records that are maintained by another municipality’s police department,
such records must be requested from that police department.

WHEREAS, by letter dated March 19, 2026, Melanie Hammer, filed an
appeal pursuant to the Freedom of Information Law (the “FOIL Appeal”) with
respect to responses to town (2) Freedom of Information Law (“FOIL”) requests
submitted by Melanie Hammer; and
WHEREAS , the first FOIL request was submitted on December 21, 2025,
and sought the following records:

WHEREAS , the second FOIL request was dated January 12, 2026, and
sought the following records:
Pursuant to Article 6 of the New York Public Officers Law, I hereby
request copies of any and all existing maps in the possession,
custody, or control of the Town of Bedford, including but not
limited to the Department of Building, Planning Department,
Zoning Office, and any archived or legacy record systems, that
classify, describe, or depict the structure located at 146 Goldens

WHEREAS , the Town Board has reviewed and discussed the merits of the
FOIL Appeal with the Town Attorney in executive session and considered the basis
for the denial of the original FOIL requests and whether the FOIL appeal should be
granted or denied.
NOW THEREFORE, IT IS HEREBY RESOLVED , that the Town Board has
determined that the appeal was not timely filed within thirty (30) days as required
by Public Officers Law §89(4)(a); and
IT IS HEREBY FURTHER RESOLVED , that the February 25, 2026, email
from the Records Officer was not a supplemental response and the FOIL Appeal
remains untimely; and
IT IS HEREVY FURTHER RESOLVED , that even if the Town Board were
to find that the FOIL Appeal was timely, which it was not, it should also be denied
on the merits for following reasons:

With respect to the first FOIL response provided on January 12, 2026,
the Town Board confirms that there are no documents in the Town’s
possession that classify the space over the garage as “residential”.
While certain surveys in the Building Department’s files identify a “1
STORY FRAME RESIDENCE OVER GARAGE”, those surveys were
prepared by third-parties, these are not “zoning maps, planning maps,
tax maps, or property classification maps”; and
2.
With respect to the second FOIL response provided on February 12,
2026, documents that classify, describe or depict the area over the
garage as non-residential were properly provided.
IT IS FURTHER RESOLVED , that the Town Board has been advised that
a diligent search has been conducted of all records in the Town of Bedford’s
possession, including Building Department and Planning Department files and all
documents response to the referenced FOIL requests have been provided.

STORMWATER CONTROL FACILITY MAINTENANCE AND
ACCESS EASEMENT AGREEMENT FOR PROPERTY LOCATED
AT THE HARVEY SCHOOL AT 240-260 JAY STREET, BEDFORD, NEW YORK
RESOLUTION NO. ___ OF 2025
WHEREAS, the Harvey School is an educational corporation organized and existing
under the laws of the State of New York with offices at 260 Jay Street., Bedford, NY 10536 (the
“Owner”); and
WHEREAS, Owner owns that certain plot, piece and parcel of land, with the buildings
and improvements thereon, situated at (240-260 Jay St.) in the Town of Bedford, comprising
(92.34 ± acres), and shown and designated on the Tax Map for the Town of Bedford as Sheet
50.13, Block 1, Lot 8.1, (same being derived from transactions digested at Westchester County
Clerk Control Number 620604032 (the “Property”); and
WHEREAS, Owner has submitted a Stormwater Pollution Prevention Plan ("SWPPP")
to the Town of Bedford (the “Town”) dated November 1, 2022 and prepared by Bibbo Associates,
LLP which sets forth, inter alia, the proposed improvements to be constructed and\or installed
for the purpose of controlling and mitigating stormwater runoff from the parcel; and
WHEREAS, the SWPPP has been approved by the Town; and
WHEREAS, as required by Section 103-9 of the Bedford Town Code, a maintenance
and access agreement is to be recorded in the Office of the Westchester County Clerk (Division
of Land Records) in order to provide for the long-term maintenance and continuation of the
various stormwater control measures shown on the approved plans submitted in support of the
Site Plan Application and SWPPP (the "Facilities") and
WHEREAS, copies of the approved plans submitted in support of the Site Plan
Application and SWPPP are on file with the Building Department of the Town at Bedford, 425
Cherry Street, Bedford Hills, New York 10507; and
WHEREAS, the Town and the Owner desire that the Facilities, as shown and set forth in
Schedule “B” of the Stormwater Control Facility Maintenance and Access Agreement *the
“Agreement”) submitted herewith, be constructed and installed in accordance with the approved
plans submitted in support of the Site Plan Application and SWPPP and that they thereafter be
inspected, used, maintained, repaired, and replaced in perpetuity in order to insure that they
continue to function in the manner for which they are intended
NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Bedford
hereby approves the Stormwater Control Facility Maintenance and Access Agreement for the
Property, subject to final review and approval by the Town Attorney and Town Engineer, and
authorizes the Town Supervisor of the Town of Bedford, to take all actions and execute all
documents as may be necessary for the purposes of filing and recording the Stormwater Control
Facility Maintenance and Access Agreement.

RESOLUTION
WHEREAS, negotiations have been ongoing between the Bargaining Team for the
Town of Bedford and the Bargaining Team for Local 456, of the International Brotherhood of
Teamsters (White Collar Unit) for a successor to the 2023-2025 Agreement between the parties;
and
WHEREAS, those negotiations have resulted in a tentative agreement contained in a
Memorandum of Agreement which has been ratified by the membership of the Unit; and
WHEREAS, the Town Board of the Town of Bedford has reviewed the terms of the
Memorandum of Agreement, dated March 19, 2026, and finds that a settlement consistent with
the terms contained therein is in the best interest of the Town of Bedford;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Bedford hereby approves and ratifies the terms of the aforesaid Memorandum of Agreement and
hereby authorizes the Town Supervisor to execute a Collective Bargaining Agreement consistent
with the terms thereof.

Axon Contract Renewal
Respectfully requesting approval to renew our departments current contract with Axon for
body worn cameras and conducted energy devices (AKA Taser). This renewal is essential to
maintaining the high standards of transparency, accountability, as well as officer and public
safety. The proposed renewal will ensure uninterrupted service, technical support, secure
data storage and access to updated equipment and software for the next 5 years (20262030). The initial cost of $240,000.00 has been accounted for in the Department 2026 capital
budget and the annual cost for years 2-5 are substantially similar to the current annual
operating cost budget for this service and equipment.

Request to purchase a road grader
The DPW fleet currently includes a 1987 Caterpillar road grader. It is approaching 40 years of age,
and parts availability is becoming difficult. The grader is a critical piece of equipment for
maintaining the Town’s 33 miles of dirt roads.
After researching several models, we have received a proposal from HO Penn for a Caterpillar
120JOY grader for $379,500. Purchase is via a Sourcewell contract. Sourcewell is a national public
service agency which provides competitive bids which municipalities can purchase from. This is
permissible by N.Y. General Municipal Law §103. The proposed purchase would be funded from
highway fund balance, as approved in the capital plan. I recommend that the Board authorize me
to make this purchase. Highway fund balance will remain well above the Town’s 15% goal after this
purchase.

The starting salary will be $60,392 per the White-Collar contract and an appointment date on or about,
April 27, 2026 pending pre-employment clearance.
Ms. Pectol is currently working as a contractor with the Thrive Program in the Town of Bedford. She
has previously worked with the town in various departments seasonally. She has also worked in the
health care industry. She is excited to have the opportunity to work with the Building Department and
looks forward to growing in her role with the Town.

New York State law requires that the governing body of a municipality approve
budget transfers. The attached schedule details the budget transfers necessary as
part of the 2025 year-end process.
The annual audit by PKF O’Connor Davis is scheduled to begin on Monday, March
30, 2026. While we have taken every precaution to address all necessary account
deficits, it is possible that additional budget transfers may be required based on
the audit's findings.
Therefore, it is recommended that the Town Board approve the attached budget
transfers, as well as any further adjustments that may arise during the audit
process. Funds are to be transferred from appropriated fund balances.

As part of the year-end close and preparation for the 2025 audit, the Town
conducted a continued review and analysis of its capital projects to identify
those appropriate for closure. Building on last year’s comprehensive review,
this year’s effort went further to properly classify project expenditures and
ensure that eligible projects were fully reconciled and closed out.
The projects included in the attached schedule have been determined to be fully
expended and now reflect zero balances. These projects have had no recent
financial activity and are considered complete.
Closing out these projects ensures that the Town’s capital records remain
accurate and up to date. It also supports compliance with bond covenants, audit
standards, and generally accepted accounting principles, while promoting clear
financial reporting and the effective management of Town resources.

I am writing to relay the request for co-sponsorship and Police Resource support of the Bedford Village Sidewalk
Sale. The sale runs from 6/5-6/7/2026 and supports the Bedford Village Hamlet there is recommended Police
Support being needed for 6/7/2026 to ensure extra pedestrian safety.
Resource recommendation as follows:

A Resolution Authorizing A Waiver Of Fees For
Certain Applications To The Zoning Board of Appeals
Involving The Correction of De Minimis Errors
WHEREAS, it has come to the attention of the Town Board of the Town of Bedford that
circumstance exist where an application for an area variance for a residential property is filed and
approved based upon a previously obtained survey; and
WHEREAS, upon there being a final as-built survey following the construction of a
structure, it is determined that the prior survey was not accurate and that the structure remains in
non-compliance with the approved variance; and
WHEREAS, in those situations, the applicant is required to re-file for a new area variance
with the Zoning Board of Appeals in order to address the non-compliance in order to ensure that
the structure in question is brought into compliance; and
WHEREAS, the Town Board has determined that where the required variance correcting
the non-compliance is de minimis, that the applicant should not have to pay a new application fee
to correct the non-compliance resulting from the reliance on a prior survey.
NOW THEREFORE BE IT RESOLVED, the Town of Bedford Town Board finds that
the application fee seeking an area variance from the Zoning Board of Appeals for residential
properties to correct a non-compliance resulting from the reliance on an inaccurate historical
survey should be waived where the requested variance is: (i) less than one (1’) foot and is totally
within the applicant’s property with respect to any minimum setback requirement; and (ii) less
than ten (10) square feet with respect to any coverage requirements.
RESOLUTION TO PROVIDE LETTER OF SUPPORT TO NYSDOT TO CREATE A
NO PASSING ZONE ON A PORTION OF ROUTE 22 TO ENHANCE PUBLIC SAFETY
WHEREAS, New York State Route 22 is a major transportation corridor within the Town of
Bedford that is heavily utilized by residents, commuters, students, and visitors; and
WHEREAS, Route 22 provides access to key cultural and educational destinations, including the
John Jay Homestead, the Katonah Museum of Art, The Harvey School, and the Caramoor Center
for Music and the Arts; and
WHEREAS, this corridor experiences significant traffic volumes, including local residents,
students, regional commuters, and visitors attending cultural, educational, and seasonal events;
and
WHEREAS, stakeholders have expressed concerns related to an increase of unsafe passing along
portions of Route 22, particularly in the stretch of road near the John Jay Homestead; and
WHEREAS, the existing double yellow centerline permits vehicles to pass one another and
therefore may contribute to unsafe driving behavior; and
WHEREAS, modification of the pavement markings from a double yellow centerline to a single
yellow line, which will create a no passing zone, may help to regulate traffic flow, reduce unsafe
passing behavior, and improve overall roadway safety;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Bedford hereby
supports the evaluation and potential modification of pavement markings on Route 22, including
the conversion of the existing double yellow centerline to a single yellow line in appropriate
locations, as a measure to enhance public safety; and
BE IT FURTHER RESOLVED that the Town Board respectfully requests that the Supervisor
provide a letter of support to the New York State Department of Transportation to review this
matter, and consider implementation of such modifications.
