BOND ORDINANCE TO APPROPRIATE AN ADDITIONAL SUM OF $862,000 FOR THE UNDERTAKING
OF THE HOULIHAN-SID FAY FIELDS PARKING LOT, RESTROOM AND MULTIPURPOSE FACILITY
IMPROVEMENT PROJECT IN, BY AND FOR THE TOWN OF WESTFIELD, IN THE COUNTY OF UNION,
STATE OF NEW JERSEY, TO MAKE A DOWN PAYMENT, TO AUTHORIZE THE ISSUANCE OF BONDS
TO FINANCE SUCH ADDITIONAL APPROPRIATION AND TO PROVIDE FOR THE ISSUANCE OF
BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE OF SUCH BONDS.
WHEREAS, the Town Council of the Town of Westfield has heretofore authorized the undertaking of the
Houlihan-Sid Fay Fields Parking Lot, Restroom and Multipurpose Facility Improvement Project in, by and for
the Town and appropriated the sum of $2,339,000 therefor pursuant to Ordinance No. 2025-06 adopted by the
Town Council of the Town on October 14, 2025; and
WHEREAS, the Town Council now finds and determines that the additional sum of $862,000 is required
for such improvement, NOW, THEREFORE,
BE IT ORDAINED by the Town Council of the Town of Westfield, in the County of Union, State of New
Jersey (the "Town"), as follows:
Section 1. The additional sum of $862,000 is hereby appropriated to the payment of the cost of the
improvement authorized by Ordinance No. 2025-06 adopted by the Town Council of the Town on October 14,
2025 (the "Prior Ordinance"). Said additional appropriation shall be met from the down payment appropriated
and from the proceeds of the sale of the bonds authorized by this ordinance. Said improvement has been and shall
be made as a general improvement and no part of the cost thereof has been nor shall be assessed against property
specially benefitted.
Section 2. It is hereby determined and stated that (1) the making of such improvement (hereinafter referred
to as "purpose") is not a current expense of the Town, and (2) it is necessary to finance said purpose by the
issuance of obligations of the Town pursuant to the Local Bond Law (Chapter 2 of Title 40A of the New Jersey
Statutes Annotated, as amended; the "Local Bond Law"), and (3) the estimated cost of said purpose authorized
by the Prior Ordinance is $3,201,000, including the sum of $2,339,000 appropriated by the Prior Ordinance and
the $862,000 appropriated by this ordinance, and (4) $231,000 of said sum is to be provided by the down payment,
including the $189,000 appropriated by the Prior Ordinance and the $42,000 hereinafter appropriated to finance
said purpose, and (5) the estimated maximum amount of bonds or notes necessary to be issued for said purpose
is $2,970,000, including the $2,150,000 authorized by the Prior Ordinance and the $820,000 hereinafter
authorized, and (6) the cost of such purpose includes the amount of $405,000 stated in the Prior Ordinance, which
is estimated to be necessary to finance the cost of such purpose, including architect's fees, accounting, engineering
and inspection costs, legal expenses and other expenses, including interest on such obligations to the extent
permitted by Section 20 of the Local Bond Law.
Section 3. It is hereby determined and stated that moneys exceeding $42,000, appropriated for down
payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for said
Town, are now available to finance said purpose. The sum of $42,000 is hereby appropriated from such moneys
to the payment of the cost of said purpose.
Section 4. To finance said purpose, bonds of the Town of an aggregate principal amount not exceeding
$820,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear interest at a
rate per annum as may be hereafter determined within the limitations prescribed by law. All matters with respect
to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter adopted.
Section 5. To finance said purpose, bond anticipation notes of the Town of an aggregate principal amount
not exceeding $820,000 are hereby authorized to be issued pursuant to the Local Bond Law in anticipation of the
issuance of said bonds. In the event that bonds are issued pursuant to this ordinance, the aggregate amount of
notes hereby authorized to be issued shall be reduced by an amount equal to the principal amount of the bonds so
issued. If the aggregate amount of outstanding bonds and notes issued pursuant to this ordinance shall at any time
exceed the sum first mentioned in this section, the moneys raised by the issuance of said bonds shall, to not less
than the amount of such excess, be applied to the payment of such notes then outstanding.
Section 6. Each bond anticipation note issued pursuant to this ordinance shall be dated on or about the
date of its issuance, shall be payable not more than one year from its date, shall bear interest at a rate per annum
as may be hereafter determined within the limitations prescribed by law and may be renewed from time to time
pursuant to and within limitations prescribed by the Local Bond Law. Each of said notes shall be signed by the
Mayor and by a financial officer and shall be under the seal of the Town and attested by the Town Clerk or Deputy
Town Clerk. Said officers are hereby authorized to execute said notes in such form as they may adopt in
conformity with law. The power to determine any matters with respect to said notes not determined by this
ordinance, and also the power to sell said notes, is hereby delegated to the Chief Financial Officer who is hereby
authorized to sell said notes either at one time or from time to time in the manner provided by law.
Section 7. It is hereby determined and declared that the period of usefulness of said purpose, according
to its reasonable life, is a period of fifteen years computed from the date of said bonds.
Section 8. It is hereby determined and stated that the Supplemental Debt Statement required by the Local
Bond Law has been duly made and filed in the office of the Town Clerk of the Town, and that such statement so
filed shows that the gross debt of the Town, as defined in Section 43 of the Local Bond Law, is increased by this
ordinance by $820,000 and that the issuance of the bonds and notes authorized by this ordinance will be within
all debt limitations prescribed by the Local Bond Law.
Section 9. Any funds received from private parties, the County of Union, the State of New Jersey or any
of their agencies or any funds received from the United States of America or any of its agencies in aid of such
purpose shall be applied to the payment of the cost of such purpose or, if bond anticipation notes have been issued,
to the payment of the bond anticipation notes, and the amount of bonds authorized for such purpose shall be
reduced accordingly.
Section 10. The Town intends to issue bonds or notes to finance the cost of the improvement authorized
by the Prior Ordinance and described herein. If the Town incurs such costs prior to the issuance of such bonds
or notes, the Town hereby states its reasonable expectation to reimburse itself for such expenditures with the
proceeds of such bonds or notes in the maximum principal amount of bonds or notes authorized by this ordinance.
Section 11. The full faith and credit of the Town are hereby pledged to the punctual payment of the
principal of and interest on the obligations authorized by this ordinance. Said obligations shall be direct, unlimited
and general obligations of the Town, and the Town shall levy ad valorem taxes upon all the taxable real property
within the Town for the payment of the principal of and interest on such bonds and notes, without limitation as to
rate or amount.
Section 12. The capital budget is hereby amended to conform with the provisions of this ordinance to the
extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full
detail of the amended capital budget and capital program as approved by the Director, Division of Local
Government Services, is on file with the Town Clerk and is available for public inspection.
Section 13. This ordinance shall take effect twenty days after the first publication thereof after final
passage.

BE IT ORDAINED by the Town Council of the Town of Westfield, in the County of Union, State
of New Jersey, as follows:
Section 1. The Town of Westfield, in the County of Union, State of New Jersey (the "Town") is
hereby authorized to replace the synthetic turf athletic fields and make other improvements at Houlihan-Sid Fay
Fields in, by and for the Town. Said improvements shall include all work, materials and appurtenances necessary
and suitable therefor.
Section 2. The sum of $880,000 is hereby appropriated to the payment of the cost of making the
improvements described in Section 1 hereof (hereinafter referred to as "purpose"). Said appropriation shall be
met from the proceeds of the sale of the bonds authorized and the down payment appropriated by this ordinance.
Said improvements shall be made as general improvements and no part of the cost thereof shall be assessed against
property specially benefitted.
Section 3. It is hereby determined and stated that (1) said purpose is not a current expense of said
Town, and (2) it is necessary to finance said purpose by the issuance of obligations of said Town pursuant to the
Local Bond Law (Chapter 2 of Title 40A of the New Jersey Statutes Annotated, as amended; the "Local Bond
Law"), and (3) the total estimated cost of said purpose is $880,000, and (4) $44,000 of said sum is to be provided
by the down payment hereinafter appropriated to finance said purpose, and (5) the estimated maximum amount
of bonds or notes necessary to be issued for said purpose is $836,000, and (6) the cost of such purpose, as
hereinbefore stated, includes the aggregate amount of $8,000 which is estimated to be necessary to finance the

cost of such purpose, including architect's fees, accounting, engineering and inspection costs, legal expenses and
other expenses, including interest on such obligations to the extent permitted by Section 20 of the Local Bond
Law.
Section 4. It is hereby determined and stated that moneys exceeding $44,000, appropriated for
down payments on capital improvements or for the capital improvement fund in budgets heretofore adopted for
said Town, are now available to finance said purpose. The sum of $44,000 is hereby appropriated from such
moneys to the payment of the cost of said purpose.
Section 5. To finance said purpose, bonds of said Town of an aggregate principal amount not
exceeding $836,000 are hereby authorized to be issued pursuant to the Local Bond Law. Said bonds shall bear
interest at a rate per annum as may be hereafter determined within the limitations prescribed by law. All matters
with respect to said bonds not determined by this ordinance shall be determined by resolutions to be hereafter
adopted.

WHEREAS, PARKSIDE WESTFIELD LLC owns and rents property located at 2212 ECHO LANE, UNIT
2212, WESTFIELD, NJ 07090 which property is governed by the statutes, ordinances, rules and regulations
restricting use of the property as an Affordable Housing Inclusionary Project; and
WHEREAS, tenants can request Affordability Assistance Program grants from the Affordable Housing Trust
Fund as has been authorized and mandated by the court approved Spending Plan which governs the use of those
funds; and
WHEREAS, the Town is obligated to extend a grant as provided for in the Town’s Affordability Assistance
Policies and Procedures Manual after review and approval by the Town’s Affordable Housing Administrative
Agent, and
WHEREAS, the funding for the grant will be from the Town of Westfield Affordable Housing Trust Fund.
NOW THEREFORE BE IT RESOLVED by the Town of Westfield Town Council, County of Union, State
of New Jersey, that:
1. The appropriate Town officials are hereby authorized to execute an Affordability Assistance
Program grant with the owner/renter of Affordable Housing units located at 2212 Echo Lane, Unit
2212, WESTFIELD, NJ 07090 as approved by the Town’s Affordable Housing Administrative
Agent.

WHEREAS, the County Board of Taxation is unable to certify the tax rate throughout the county in a timely
fashion and the Municipal Tax Collector will be unable to mail the tax bills on a timely basis; and
WHEREAS, the Municipal Tax Collector, in consultation with the Municipal Chief Financial Officer, has
computed an estimated tax levy in accordance with N.J.S.A. 54:4-66.3 and they have signed a certification
showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Westfield in the County of
Union and the State of New Jersey on this 9th day of June, 2026, as follows:
1. The Municipal Tax Collector is hereby authorized and directed to prepare and issue estimated tax
bills for the Town of Westfield for the third installment of 2026 taxes. The Tax Collector shall
proceed and take such actions as permitted and required by P.L. 1994, c.72 (N.J.S.A. 54:4-66.2 and
54:4-66.3).
2. The entire estimated tax levy for 2026 is hereby set at $206,267,493.
3. In accordance with the law, the third installation of 2026 taxes shall not be subject to interest until
the later of the end of the grace period, or the twenty-fifth calendar day after the date the estimated
tax bills were mailed. The estimated tax bills shall contain a notice specifying the date on which
interest may begin to accrue.

WHEREAS, N.J.S.A. 40A: 5-4 requires the governing body of every local unit to have made an annual audit of its
books, accounts and financial transactions, and
WHEREAS, the Annual Report of Audit for the year 2024 has been filed by a Registered Municipal Accountant
with the Municipal Clerk, pursuant to N.J.S.A. 40A: 5-6, and a copy has been received by each member of the
governing body; and
WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports
pertaining to the local fiscal affairs; and
WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:30-6.5, a regulation requiring that the
governing body of each municipality shall, by resolution, certify to the Local Finance Board of the State of New
Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit
entitled “Comments and Recommendations; and
WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of
Audit, and specifically the sections of the Annual Audit entitled “Comments and Recommendations, as evidenced
by the group affidavit form of the governing body attached hereto; and
WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days
after the receipt of the annual audit, pursuant to N.J.A.C. 5:30-6.5; and
WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the
minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have
subscribed to the affidavit, as provided by the Local Finance Board; and
WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may
subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit:
R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date
fixed for compliance, fails or refuses to obey an order of the director (Director of Local
Government Services), under the provisions of this Article, shall be guilty of a
misdemeanor and, upon conviction, may be fined not more than one thousand dollars
($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his
office.
NOW, THEREFORE BE IT RESOLVED, that the Town Council of the Town of Westfield, hereby
states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution
and the required affidavit to said Board to show evidence of said compliance.

WHEREAS, in 2014, pursuant to an act of the state legislature, every municipal police vehicle purchased, leased,
or otherwise acquired which is primarily used for traffic stops shall be equipped with a mobile video recording
(MVR) system; and
WHEREAS, in 2019, the Westfield Police Department purchased a body worn camera (BWC) for use by each
uniformed police officer who engages in patrol activities, this to comply with the everchanging needs and best
practices of law enforcement; and
WHEREAS, in 2021, pursuant to an act of the state legislature, BWCs became mandated for use by every
uniformed police officer who engages in patrol activities; and
WHEREAS, on September 19, 2023, the Westfield Police Department entered into an Agreement with Axon
Enterprise that allowed it to purchase: 1) An upgraded MVR system for each police vehicle primarily used for
traffic stops that included automatic license plate reader (ALPR) capability; 2) An upgraded BWC for each and
every officer, this to include detectives and plainclothes officers; and 3) Other needed MVR and BWC equipment.
WHEREAS, pursuant to the Agreement with Axon Enterprise, the total costs of same shall be extended over a
5-year time period and the 2026 costs for same shall be $126,612.39; and
WHEREAS, Axon Enterprise of P.O. Box 29661, Department 2018, Phoenix, AZ 85038 was awarded State
Contract T0106, under the Department of Purchase and Property’s NJStart eProcurement Solution, Purchase
Order 17-FLEET-00738, Category 14 for Police Body Camera Solution and 14A for Installation, Consulting
Services, Hardware/Software Configuration, Training, and Hourly Repair Service Rates; and
WHEREAS, the upgraded MVRs with ALPR capability, upgraded BWCs, and needed MVR and BWC
equipment purchased pursuant to the Agreement with Axon Enterprise and the servicing of same continue to meet
the operational needs of the Westfield Police Department and statutory requirements of the State of New Jersey,
this as determined by the Chief of Police; and
WHEREAS the Town Council of the Town of Westfield does hereby authorize payment to Axon Enterprise for
the 2026 costs specified herein; and
WHEREAS, the Chief Financial Officer has certified to the availability of adequate funds for the payment of
costs of this Agreement with Axon Enterprise and which are to be charged to Account 130-208 under Purchase
Order No. 26-01831, prepared in accordance with N.J.A.C. 5:30-1.10.
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Westfield does hereby authorize
payment to Axon Enterprise for the 2026 costs specified herein.
BE IT FURTHER RESOLVED that the proper Town Officials be and are hereby authorized to take whatever
actions are appropriate in the execution and discharge of this new Agreement with Axon Enterprise of P.O. Box
29661, Department 2018, Phoenix, AZ85038-9661.

through the installation of an access control and security door system, including card readers and electrified
locking hardware; and
WHEREAS, Everon, LLC, 1501 Yamato Road, Boca Raton, Florida 33431, has submitted a proposal for the
purchase and installation of security door access control equipment and related services in the amount of
$34,990.00; and
WHEREAS, Everon, LLC is an authorized vendor under the OMNIA Partners Cooperative Purchasing
Program Contract No. R220701 – Facility Technology Integration & Security System Services; and
WHEREAS, the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-11(5), authorizes the purchase of
goods and services through a nationally recognized cooperative purchasing agreement, and requires that such
purchases be authorized by resolution of the governing body; and
WHEREAS, the Chief Financial Officer certifies the availability of adequate funds for payment, prepared in
accordance with N.J.A.C. 5:30-5.4, in the amount of $34,990.00, to be charged to Special Ordinance 26-01,
Account No. C-07-26-001-4A1 under Purchase Order No. 26-01905.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Westfield that
the proposal submitted by Everon, LLC for the purchase and installation of an access control and security door

proposal to perform said services at the AddamsFest event with a payment to the Town of Westfield totaling

COUNTY OF UNION TO MODIFY THE COOPERATIVE AGREEMENT DATED JUNE 2014, AS
AMENDED JULY 9, 2019
WHEREAS, certain Federal funds are potentially available to the County of Union under Title I of the Housing
and Community Development Block Grant Act of 1974, as amended, commonly known as the Community
Development Block Grant Program; and
WHEREAS, certain Federal funds are potentially available to the County of Union under Title II of the National
Affordable Housing Act of 1990, commonly known as the HOME Investment Partnership program; and
WHEREAS, substantial Federal funds provided through subtitle B of Title IV of the McKinney-Vento Homeless
Assistance Act commonly known as the Emergency Solutions Grants program (ESG) are allocated to prevent
homelessness and to enable homeless individuals and families to move toward independent living; and
WHEREAS, it is necessary to amend an existing Cooperative Agreement for the County of Union and its people
to benefit from this program; and
WHEREAS, it is in the best interest of the Municipality of Town of Westfield and the County of Union in
cooperation with each other to enter into a modification of the existing Cooperative Agreement pursuant to
N.J.S.A. 40A:65-1 et seq;
NOW THEREFORE, BE IT RESOLVED by the Mayor and Governing Body of the
Municipality
of Town of Westfield that the agreement entitled “COOPERATIVE AGREEMENT BETWEEN THE
COUNTY OF UNION AND CERTAIN MUNICIPALITIES FOR CONDUCTING CERTAIN
COMMUNITY DEVELOPMENT ACTIVITIES,” dated June 2014, as amended July 9, 2019 for the Purpose
of Inserting a Description of Activities for Fiscal Year 2026-2027 of the Union County Community Development
Block Grant program, the HOME Investment Partnership program, and the Emergency Shelter Grant program
(ESG), a copy of which is attached hereto; be executed by the Mayor and Municipal Clerk in accordance with the
