a. 2968-26 An Ordinance Amending Chapter 25, Article I, Section 9.13, of the Revised General
Ordinances of the Township of West Orange Banning “Pop-up” Parties (Semeraro)
The Township of West Orange (the “Township”) has received numerous complaints from residents in
various neighborhoods throughout the Township regarding parties, events, and/or gatherings wherein
the attendees of the events have purchased tickets or wristbands for entry into residential homes within
the Township. The purpose of this Section is to provide recourse for the Township if such “pop-up”
parties occur in the future and to put the public on notice that the same is prohibited as a health and
safety concern for the general welfare of the public.

b. 2973-26 An Ordinance Amending and Supplementing Chapter 5, General Licensing, Article VII
Cannabis Licenses, Subsection § 5-34.8(a) Operating Requirements and Prohibitions (Permitted
Operating Hours for Licensed Cannabis Entities) of the Revised General Ordinances of the Township
of West Orange (Semeraro)
This Ordinance, which amends the Cannabis Licensing Regulations of the Township, amends the
permitted hours of operations for Licensed Cannabis Entities, to permit Licensed Cannabis Entities to
operate only between the hours of Monday through Sundays from 8:00 a.m. through 10:00 p.m. This
action is in response to a request for operating hours to be extended in the evening, which would bring
the Township’s Regulations into alignment with the regulations of other nearby suburban Essex County
municipalities. This action also brings the Township’s Regulations into alignment with the Township’s

regulations concerning hours of operations for licensed alcohol retailers. For the avoidance of any doubt,
this action does not affect Licensed Cannabis Cultivators or Licensed Cannabis Manufacturers, who, in
accordance with Subsection 5-34.8(a), are not subject to these hours of operations, except that incoming
or outgoing deliveries of any kind to Licensed Cannabis Cultivators or Licensed Cannabis
Manufacturers shall only occur between the hours of 8:00 A.M. through 8:00 P.M.

9. Ordinance(s) on First Reading
a.

2978-26 An Ordinance Amending and Supplementing Chapter 7, “Traffic,” Section 32.2,

“Restricted Parking Zones,” of the Municipal Code of the Township of West Orange
(Carballo) This Ordinance amends and supplements Chapter 7 Traffic, Subsection 32.2 Restricted
Parking Zones of the Revised General Ordinances. Restricted Parking Stalls will be established in front
of 30 Kingsley Street and 99 High Street for the exclusive use of the residents who are in possession of a
NJMVC Disability ID and Parking Placard. These Stalls were requested by the residents of each location
and are permissible under NJ Statutes Annotated (N.J.S.A.) 39:4-197.7. Parking is permitted in the
restricted parking zone except when prohibited by other sections of Chapter 7 of the Revised General
Ordinances.

AUTHORIZE TAX COLLECTOR TO PREPARE AND ISSUE ESTIMATED TAX BILLS
FOR THIRD QUARTER 2026 TAXES
WHEREAS, N.J.S.A 54:4-66.3, pursuant to Section 3 of P.L 1994 c. 72 and 54:4:4-66.2, the governing
body has determined that the Tax Collector will be unable to complete the mailing and delivery of the tax
bills due to the absence of a certified tax rate; and
WHEREAS, the Tax Collector in consultation with the Chief Financial Officer has computed an
estimated tax levy in accordance with N.J.S.A. 54:4-66.3, and has signed a certification showing the tax
levies for the previous year, the tax rates and the range of permitted estimated tax levies; and
WHEREAS, in accordance with Chapter 72, P.L. 1994, the Tax Collector requests the Council to
approve the estimated tax levy; which is between the mandated estimated range proposed by the Local
Government Services. Approval will enable the Township to meet its financial obligations, maintain the
tax collection rate, provide uniformity for tax payments and save the unnecessary cost of interest on
borrowing,
NOW, THEREFORE, BE IT RESOLVED, that the Governing Body of the Township of West Orange,
County of Essex, State of New Jersey, hereby authorizes that:
1. The Tax Collector is hereby authorized and directed to prepare and issue estimated tax bills for
the Township for the third installment of 2026 taxes.
2. The entire estimated tax levy for 2026 is hereby set at $272,105,119.03. The estimated tax rate for
2026 is hereby set at 2.736.
3. In accordance with law, the third installment of 2026 taxes shall not be subject to interest until the
later of August 10 or the twenty-fifth day after the date the estimated tax bills were mailed. The
estimated tax bills shall contain a notice specifying the date on which interest may begin to
accrue.
BE IT FURTHER RESOLVED, that a copy of this resolution shall be forwarded to the Tax Collector
and Chief Financial Officer for their records.

RESOLUTION
WHEREAS, accumulated time remaining upon retirement from the Township of West
Orange will be paid to the employee at the rate of pay at the time of retirement; and
WHEREAS, Daniel Carroll, hired on July 24, 2000, has retired from the Township of West
Orange effective February, 1, 2026; and
WHEREAS, a calculation of Daniel Carroll’s accumulated balances and ending pensionable rate
are attached and have been provided to support the total payment; and
WHEREAS, outside legal counsel has reviewed all documentation, including time sheets and
accrual balances, and has verified the accuracy of the figures supporting the total payment
amount, and has provided a written opinion in support thereof; and
WHEREAS, Daniel Carroll has signed a Settlement Agreement and General Release pertaining
to this matter;
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of West
Orange in the County of Essex, State of New Jersey that the following separated employee,
Daniel Carroll, be paid in the payroll cycle immediately preceding approval of the resolution in
the total amount of $13,718.93; and
BE IT FURTHER RESOLVED, that the method of payment shall be determined on a case by
case basis by the Township Chief Financial Officer upon the passage of a resolution approving
payment by the Township Council. Payment may be made in one lump sum if feasible and
requested by the retiree.

SETTLEMENT AGREEMENT AND GENERAL RELEASE
This Settlement Agreement and General Release (hereinafter referred to as the “Agreement”) is
entered into this 24th day of June 2026 between the Township of West Orange (hereinafter
referred to as “Township”) and Daniel Carroll hereinafter referred to as (“Carroll”) (collectively,
the “Parties,” each a “Party”).
WHEREAS, Carroll has been an employee with the Township from the period of July 24, 2000February 1, 2026;
WHEREAS, a calculation of Carroll’s accumulated accrued leave time balances and ending
pensionable rate have been provided to support a total payment of $13,718.93;
WHEREAS, outside legal counsel has reviewed all documentation, including time sheets and
accrual balances, and has verified the figures that support the total payment amount, and has
provided a written opinion in support thereof;
WHEREAS, the Parties wish to resolve all disputes which may have arisen out of or in relation
to the processing of payment of Carroll’s accrued earned and unused paid leave and Carroll’s
employment with the Township to date; and
WHEREAS, the Parties wish to memorialize in the Agreement all the terms and conditions of
Carroll’s employment separation payout and desire to resolve all outstanding issues with respect
to this matter;
NOW, THEREFORE, in consideration for the promises and mutual covenants set forth herein,
the Parties agree as follows:
COVENANTS AND TERMS OF AGREEMENT
1. TOWNSHIP TO PROCESS PAYMENT
a.
The Township agrees to process payment to Carroll for all his accrued earned
and unused paid leave time without further delay in the amount of $ 13,718.93.
b.
Carroll agrees to waive any and all claims to back pay, benefits, and any and all
other monetary claims including, but not limited to, attorneys’ fees with respect to his
employment with the Township to date with the sole exception of the payment pursuant to
paragraph (a) above.
c.
Carroll and the Township acknowledge that this Agreement does not nor will
it establish precedent in any future proceedings, nor is it intended to add to, modify or change
any collective bargaining agreement.

d.
The Parties also understand that Carroll may be applying for retirement benefits
with the State of New Jersey, Division of Pensions and Benefits. Carroll understands and
agrees that the ultimate approval of said pensionable benefits is at the sole risk of Carroll and
any denial thereof shall in no way affect the enforceability of this Agreement or diminish the
consideration given therefore.
2.
COMPLETE RELEASE. In exchange for the above consideration, Carroll
and his heirs, assigns and agents, hereby irrevocably and unconditionally waive, release and
forever discharge any and all claims or rights, whether known or unknown, from the beginning
to time up to the date this Agreement is executed against the Township personally and
officially, individually and collectively, its past and present Council members, all officers and
administrators, its attorneys, agents and employees, personally and officially, as well as their
successors, and assigns (collectively, the “Releasees”), including, but not limited to any and
all claims for damages, reinstatement, attorney’s fees, penalties, potential lost interest
payments and/or costs under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C.
§ 2000e et seq., the Civil Rights Act of 1991, 42 U.S.C. § 1981a et seq., the Age
Discrimination in Employment Act of 1967, as amended, 29 U.S.C. § 621 et seq. (“ADEA”),
the Americans with Disabilities Act, 42 U.S.C. § 12101 et seq. (“ADA”), the Pregnancy
Discrimination Act, the Equal Pay Act, the Family and Medical Leave Act (“FMLA”), as
amended, the Sarbanes-Oxley Act of 2002, the United States Constitution, the Constitution of
the State of New Jersey, the Conscientious Employee Protection Act (“CEPA”), New Jersey
Law Against Discrimination (“NJLAD”), the New Jersey Employer-Employee Relations Act,
or any other federal, state or local laws, regulations or ordinances regulating employment or
the workplace or of similar effect to the foregoing, including, but not limited to any federal,
state or local law regarding retaliation for protected activity or interference with protected
rights, and all amendments to each such law. Carroll understands and acknowledges that Title
VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq., the Civil Rights
Act of 1991, 42 U.S.C. § 1981a et seq., the ADEA, the ADA, the FMLA, the CEPA, the Equal
Pay Act, NJLAD, the state and local civil rights laws, provide Carroll the right to bring actions
against the Township if, among other things, Carroll believes he has been discriminated against
on the basis of race, ancestry, color, religion, sex, pregnancy, national origin, disability, age,
need for protected leave, medical condition, sexual orientation, marital status, veteran status,
benefit eligibility or any other protected basis. This Agreement shall constitute, and may be
raised by the Township and other Releasees as, a bar to recovery by Carroll in any action
initiated by him or on his behalf against the Township and other Releasees or any of them in
any forum, including, but not limited to, administrative charges filed with the EEOC or
National Labor Relations Board under one or more of the statutes listed above. Nothing in this
waiver and release is intended to or shall interfere with Carroll’s right to participate in a
proceeding with any appropriate federal, state or local government agency enforcing
discrimination laws, nor shall this Agreement prohibit Carroll from filing a charge of
discrimination or cooperating with any such agency in its investigation. Provided, however,
Carroll hereby waives the right to receive money or monetary relief in any action he institutes
or is instituted on his behalf by any other person, entity or government agency. It is expressly
understood that the arrangement herein shall not be construed to represent any policy or
procedure of the Township.

3.
FUTURE EMPLOYMENT. Carroll agrees that if he applies for employment
in any position with the Township at any time in the future, the Township has the absolute
discretion to refuse to hire him. Carroll specifically acknowledges that this agreement may
constitute a waiver of any right he may have under the Civil Service Commission to be hired
by the Township for any position. Carroll will not appeal or challenge the Township’s refusal
to hire him in any court of law, administrative agency, in arbitration or before any
governmental body.
4.
NON-ADMISSION. This Agreement is executed and all consideration is given
in final settlement of disputed claims, and shall not be construed as an admission of any
allegation or of liability by the Township, by whom any such obligation or liability is expressly
denied.
5.
NO DISPARAGING STATEMENTS. Carroll agrees that he will not make
any statement(s) that has, have or can be expected to have the effect of disparaging the
Township or any of its representatives, agents and employees.
6.
CONSULTATION WITH ATTORNEY. Carroll has been given the
opportunity to consult with his attorney with respect to this Agreement and to review with his
attorney all the terms and conditions of this Agreement prior to executing this Agreement.

COMPLETE AGREEMENT. This Agreement contains the entire agreement
between Carroll and the Township, and each of them, with respect to the subject matter and
supersedes all prior agreements or understandings dealing with the same subject matter. There
is no agreement on the part of the Township to do anything other than as is expressly stated in
this Agreement. This Agreement shall in all respects be interpreted, enforced and governed
by the Laws of the State of New Jersey.
8.
MODIFICATION. No modification or amendment of this Agreement will be
enforceable unless it is in writing and signed by the party to be charged.
9.
SEVERABILITY. Should any provision of this Agreement be declared or
determined by any court of competent jurisdiction to be illegal, invalid or unenforceable, the
legality, validity, and enforceability of the remaining parts, terms, or provisions shall not be
affected thereby and said illegal, unenforceable or invalid part, term, or provision shall be
deemed not to be a part of this Agreement.
10.
CARROLL ATTESTS. Carroll represents and warrants that he has carefully
read each and every provision of this Agreement and that he fully understands all of the terms
and conditions contained in each provision of this Agreement. Carroll represents and warrants
that he enters into this Agreement voluntarily, of his own free will, without any pressure or
coercion from any person or entity including, but not limited to, the Township or the Releasees.
11.
FULL KNOWLEDGE OF TERMS AND REVIEW PERIOD. The
Township advises Carroll to consult with an attorney of his choice and his expense prior to
executing this Agreement and Carroll hereby represents and warrants that, prior to executing

this Agreement, he has fully discussed its meaning and effect with an attorney of his choosing,
or that he has waived his right to consult with an attorney, and he fully understands its meaning
and effect. Carroll has twenty-one (21) days from the date it is provided to him to consider it
before signing it. In particular, Carroll represents and warrants that his attorney has explained
to him, and/or he fully comprehends the meaning of each of the provisions of this Agreement
and that he has entered into this Agreement voluntarily. Carroll’s signature also acknowledges
that (1) the Township advised him to consult with an attorney before signing this Agreement;
(2) he has up to twenty-one (21) days from the date he receives this Agreement to consider it
before signing it; and (3) if Carroll signs this Agreement less than twenty-one (21) days after
receiving it, he does so knowingly and voluntarily, and waives any right he might have under
the Age Discrimination in Employment Act, as amended, to the full twenty-one (21) days to
consider this Agreement. Carroll has seven (7) days after signing this Agreement in which to
revoke his acceptance by delivering written notice revoking his acceptance.
This revocation must be provided directly to the Township’s Labor Counsel, Ramon
E. Rivera, Esq. of Antonelli Kantor Rivera PC, 354 Eisenhower Pkwy, Suite 1000,
Livingston, New Jersey 07039. Accordingly, this Agreement shall not become effective or
enforceable until the seven (7) day revocation period has expired. If Carroll does not revoke
this Agreement during the seven (7) day revocation period, it shall be deemed accepted. Carroll
agrees that he made an informed and voluntary decision to sign this Agreement on the date he
has done so, because he did not need any additional time to decide whether to sign this
Agreement.

WHEREAS, Chapter 25, Article I, Section 25-18.4 of the Revised Ordinances of the Township
of West Orange (the “Township”) establishes the West Orange Housing Rehabilitation Program; and
WHEREAS, the West Orange Housing Rehabilitation Program offers assistance to low- and
moderate-income Township homeowners for necessary repairs and/or replacements to ensure housing
units are in compliance with N.J.A.C. 5:28; and
WHEREAS, on or about September 6, 2014, Nadia R. Mendez and Gilmar Colonia (the
“Borrowers”) executed a Mortgage in the amount of $33,575 (the “Current Mortgage”) to secure a loan
through the Township of West Orange's Housing Rehabilitation Program on the property located at Block
151.07, Lot 3, on the Tax Map for the Township of West Orange, commonly known as 8 Abington Road,
West Orange, New Jersey 07052 (the “Property”); and
WHEREAS, the Mortgage was recorded on October 27, 2014 as Instrument Number 14077472
in Mortgage Book 12521, Page 7879 with the Essex County Register of Deeds and Mortgages; and
WHEREAS, the loan through the Township of West Orange's Housing Rehabilitation Program
provides for repayment of the loan at the time of the sale of the home or transfer of title; and
WHEREAS, the Borrowers desire to refinance their home to obtain a new mortgage loan from
JPMorgan Chase Bank, N.A. in the amount of One Hundred Forty-Six Thousand Dollars ($146,000.00)
(the “New Mortgage”); and

RESOLUTION
WHEREAS, Township Ordinance 1115-92 grants to this Township Council the discretion to reimburse
the owners of one – family residential dwellings who do not receive garbage collection services from the
Township of West Orange for the costs in an amount equal to the actual cost of private garbage collection
or equal to the estimate of the cost to the Township if they were to provide said services, whichever is
lower; and
WHEREAS, this council desires to reimburse those home owner associations or individuals; who have
complied with the terms of Ordinance 1115-92, for the cost of private garbage collection for the period of
January 1, 2024 through December 31, 2025; and
WHEREAS, there is attached here to and, made part here a report of the Chief Financial Officer detailing
the names of those who have filed for reimbursement and the sum of monies the applicants are entitled to
for the period of January 1, 2024 through December 31, 2025; and

WHEREAS, The Governing Body of the Township of West Orange desires to further the
public interest by obtaining a grant from the State of New Jersey in the amount of approximately
$5,000.00 to fund the following Project: Green Communities Forest management Plan
Development (CFMP);

Susan McCartney or the successor of the office of Mayor is authorized to (a) make application

RESOLUTION
WHEREAS, N.J.S.A. 40A:65-4 of the Uniformed Shared Services and Consolidation
Act (the “Act”) authorizing municipalities to enter into shared services agreement to either
provide or receive any services that each local unit is empowered to provide or receive within its
own jurisdiction; and
WHEREAS, the Township of West Orange (the “Township”) and the Borough of Essex
Fells (the “Borough”) have previously entered into a Shared Services Agreement whereby the
Township provides animal control services to Essex Fells in exchange for quarterly payments
from Essex Fells to the Township; and
WHEREAS, the Township and Essex Fells have negotiated a renewal of the Shared
Services Agreement, in a form substantially similar and subject to Township Attorney approval,
as annexed hereto as Exhibit “A” (the “Shared Service Agreement”) for a three (3)-year term,
whereby the Township shall continue to provide animal control services to Essex Fells from
January 1, 2026 through December 31, 2028; and
WHEREAS, pursuant to the Shared Service Agreement, the Borough will pay to the
Township as follows:
(i)

For the period January 1, 2026 through December 31, 2026,
quarterly payments of $1,572 for a total of $6,287

(ii)

For the period January 1, 2027 through December 31, 2027,
quarterly payments of $1,603 for a total of $6,413

(iii)

For the period January 1, 2028 through December 31, 2028,
quarterly payments of $1,635 for a total of $6,541

for a total amount of $18,861 for the full three (3) year term of the Shared Service Agreement;

WHEREAS, this Resolution authorizes that twenty-five (25%) of the per annum amount
for each contract year be dedicated to and placed in the dog license account 04-2010-00-6690304 to cover the cost of personnel and other expenses authorized under the Shared Services

WHEREAS, the Township’s Health Officer has reviewed the Shared Services
Agreement and recommends execution of the terms contained therein; and
WHEREAS, the Borough has agreed to indemnify the Township for any services
provided to the Borough, as stated in Schedule A attached to the Shared Service Agreement;
NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of
West Orange that the Mayor be and is hereby authorized to execute and counter-sign a
substantially similar Agreement with the Borough of Essex Fells as annexed hereto as Exhibit
“A,” and the Municipal Clerk be and is hereby authorized to attest to the Mayor’s signature
thereon; and be it further
RESOLVED that pursuant to N.J.S.A. 40A:65-4(b) of the Uniformed Shared Services
and Consolidation Act the Municipal Clerk shall forward a copy of the Shared Services
Agreement to the Division of Local Government Services in the Department of Community
Affairs for informational purposes; and be it further
RESOLVED that notice of this award shall be available in the Clerk’s office for
reasonable inspection in accordance with any applicable law.

SHARED SERVICES AGREEMENT
FOR ANIMAL CONTROL SERVICES
THIS SHARED SERVICES AGREEMENT (the “Agreement”), made and entered into
on this 24th day of June, 2026 by and between the TOWNSHIP OF WEST ORANGE, a
municipal corporation of the State of New Jersey, having principal offices at 66 Main Street,
West Orange, NJ 07052, hereinafter referred to as the “Provider,” and the BOROUGH OF
ESSEX FELLS, a municipal corporation of the State of New Jersey, having principal offices at
255 Roseland Avenue, Essex Fells, NJ 07201 hereinafter referred to as the “Recipient”
(collectively referred hereinafter as the “Parties”).
RECITALS
WHEREAS, the Uniformed Shared Services and Consolidation Act, N.J.S.A. 40A:65-1
et seq. allows for any local unit to enter into an agreement with any other local unit(s) to provide
or receive any services that each local unit participating in the Agreement is empowered to
provide or receive within its own jurisdiction, as set forth in N.J.S.A. 40A:65-4; and
WHEREAS, the Recipient seeks to utilize Animal Control Services to be provided by
the Provider for a three (3) year term beginning January 1, 2026, and ending December 31, 2028;
and
WHEREAS, pursuant to N.J.S.A. 40A:65-5, the parties each adopted resolutions
authorizing entry into this Agreement, copies of which are annexed hereto and made part of this
Agreement; and
NOW THEREFORE, in consideration of the mutual terms set forth herein, the parties
agree as follows:
1. The Provider shall make their Animal Control Services available to the Recipient
on a daily basis, as needed, for five (5) days a week. Saturday, Sunday, holidays and night
emergency services will be provided as needed and billed to the Recipient at a minimum of 4
hours per call at $35 per hour in addition to the rates set forth in Paragraph 2 of this Shared
Services Agreement. Emergency service shall be defined as “the care of injured animals, trapped
animals, sick animals, animals whose lives are endangered or animals that are providing a danger
to humans or have entered the living space of a residence (also on an emergency basis, the
Provider will assume control as described in paragraph 9 below of animals that have bitten a
human being).”
2. Recipient agrees to provide payment to Provider a total amount of $19,241.00 with
payment made in the following manner:
(i)

For the period January 1, 2026, through December 31,
2026, quarterly payments of $1,572 for a total of $6,287;

Payment shall be made within thirty (30) days of receipt of invoice from the Provider.
3. The payment set forth above shall include all costs incurred by the Provider or its
Animal Control Officers in the maintenance of its kennels, costs expenses and maintenance of
vehicles to be used the Provider’s Animal Control Officers and all necessary insurance except
the care and treatment of injured animals which will be the responsibility of the Recipient or an
owner, if located.
4. The Animal Control Officers shall patrol and inspect the streets of the Recipient
from Monday through Friday, for one hour per day, anytime between 9am and 5pm, for licensed
and unlicensed dogs running at large for the purpose of impoundment or the issuing of
summonses to the owners thereof where possible and appropriate. It is understood and agreed
between the Parties that the Animal Control Officers shall not be responsible for the removal of
dead animals on the roadways or on public or private properties.
5. Upon request of the Recipient, the Animal Control Officers shall respond to any
emergency that is defined in Paragraph 1 of this Shared Services Agreement. Emergency
treatment will be given to an ill or injured animal as required by State regulations under Title 8.
Sick and injured animals, including wildlife, requiring immediate medical attention will be taken
to an emergency veterinary clinic designated by the Recipient. If there is no known owner at the
time of service, the cost of emergency veterinary care will be the responsibility of the Recipient,
billed directly to the Recipient. If an owner is ascertained, those costs will be borne by the
owner of the animal, billed by the emergency veterinary clinic designated by the recipient,
directly to the animal owner.
6. When specifically notified by the Recipient, the Provider shall attempt to impound any
stray or licensed dog or cat running at large on the streets of the Recipient Municipality. When a
dog or cat cannot be located upon arrival after being requested to respond by the Recipient, the
Provider shall spend no more than one-hour locating the dog or cat. When such impoundment
occurs, the dog or cat shall be held for a period of seven (7) days unless claimed earlier by the
owner; then such dog or cat shall be put up for adoption or humanely disposed of, but in no way
whatsoever, shall they be made available for experimentation.
7. Any person may redeem their dog, cat or other animal from the Provider’s Animal
Control Facility located at 311 Lakeside Avenue, West Orange, NJ 07052. The redemption
hours are set by the Provider or through an appointment time designated by the Provider’s
Animal Control Officers. The redemption of said animals will be completed upon the payment
to the Provider the sum of $30.00 pick up fee, Monday – Friday; 8:30 a.m. – 5:00 p.m. There
will be an $85.00 pick up fee for other hours, weekends and holidays and a boarding fee of
$25.00 for each day that the animal has been impounded up to and including seven (7) days.
After the seven (7) day period the dog, cat or other animal becomes the property of the Provider

unless otherwise arranged. No redemption will be honored unless the owner provides a current
dog license as set forth in State Statues.
8. Any stray dog or cat in the custody of the Provider and charged with biting a human
being, shall be quarantined and isolated from other animals for the regular quarantine period of at
least ten (10) days. The cost of this shall be to the owner or person who is bitten or scratched or,
if the person is a minor, the legal guardian, if established. Any stray or wild animal suspected of
biting, scratching or exposing a human being or domestic pet with rabies will be euthanized by
the Provider. The specimen will be prepared for analysis by the Provider and transported to the
State Department of Health Laboratory.
9. Transportation of the head of an animal suspected of rabies to the State Department of
Health shall be provided by the Provider under the condition that said animal expired on the
premises before the ten (10) day quarantine period referred to in Paragraph 9 above had elapsed.
The fee for removal of the head and delivery for rabies examination will be paid by the owner of
the animal if known; if not known, by the person bitten. An owner may quarantine his own
animal with permission of the Recipient’s Health Officer. All quarantine functions and animal
bite reporting will be the responsibility of the Recipient’s Police Department. The Health
Officer of the Recipient’s Health Department shall be responsible for the collection, reporting
and analysis of birds suspected of carrying the West Nile Virus.
10. The Provider agrees to furnish the necessary vehicles to be used by the Animal
Control Officers solely for the performance of their duties under this agreement. Said vehicles
will be insured by the Provider.
11. It is understood and agreed between the Parties that the Animal Control Officers shall
be employees of the Provider and that the Provider is responsible for any damage caused by said
Animal Control Officer, except as set forth in Schedule A. The Provider, including its Animal
Control Officers, is not responsible for damage caused by any animals within the Recipient
Municipality.
12. The Providers services include the handling of all animals as described. The charges
for owned animals shall be the responsibility of the owner.
13. Removal of an animal, including wildlife, on private property, inside of a home’s
non-living space including cellars, attics, sheds, garages, roofs, etc., is not covered under this
standard contract and constitutes private service. The Provider can respond to private service
calls; however, the owner of the premises will be charged Eighty-five ($85.00) Dollars per hour
during regular business hours and Ninety-Five ($95.00) Dollars per hour during evening hours,
holidays and weekends for this service. The payment for this service shall be made by the
property owner by check payable to the “West Orange Health Department” at the completion of
the rendered services. Such payments shall be collected separately from the property owner in
addition to the fees paid by the Recipient as set forth in Paragraph 2 of this Shared Services
Agreement.

14. Stray domestic animals, including feral cats outside of a residence shall be handled
by the Provider. Traps are available from the Provider with a deposit of Sixty- five ($65.00)
Dollars. Dog traps are also available with a deposit of One Hundred and Twenty-five ($125.00)
Dollars. Traps are not to be set on weekends or nights or with poor weather (rain, snow, extreme
cold or heat above 90 degrees.
15. Recipient will be charged an additional boarding fee of Fifteen ($15.00) Dollars per
day for any animals brought to the Provider who are involved in litigation and cannot be released
to their owners.
16. The Recipient shall hold harmless, indemnify, defend, and release Provider and their
members, directors, officers, employees, agents, contractors, successors and assigns from and
against all suits, liabilities, penalties, costs, losses, damages, expenses, or claims, including
without limitation, reasonable attorneys fees arising from or in any way connected with the
Provider’s performance, attempted performance, or failure to perform in connection with this
Agreement or other activities as described in this Agreement, including, but not limited to, any
injury to or the death of any person or any damage to any property resulting from any act,
omission, condition, or otherwise related to this agreement, regardless of cause.
17. Pursuant to N.J.S.A. 40A:65-4(b), recipient shall file this Agreement, for
informational purposes, with the Division of Local Government Services in the Department of
Community Affairs, together with an estimate of the cost savings anticipated to be achieved by
recipient.
18. Either the Provider or Recipient may terminate this Shared Services Agreement by
providing: (i) sixty (60) days written notice sent via Certified Mail-Return Receipt Requested;
(ii) accompanied by a Resolution adopted by the governing body authorizing termination of this
Shared Services Agreement; and (iii) if termination by the Recipient payment for all outstanding
fees due to Provider up to the termination date set forth in the written notice. Upon the
termination or expiration, all rights and obligations between the Parties under this Shared
Services Agreement shall cease and be deemed null and void.
19. INSURANCE. At all times during the term of this Agreement, Recipient shall
maintain all state mandated insurance and must maintain a general liability policy with respect to
the services to be performed under this Agreement of at least one million dollars per occurrence
and shall name Provider as an additional insured, and will deliver to Provider a certificate of
insurance prior to the commencement of services. Recipient shall further maintain appropriate
insurance as to its own actions relative to this Agreement.
20. TERM. This is a three (3) year Shared Services Agreement, and the Parties agree to
be bound by the provision of Schedule A attached hereto and made a part hereof.

21.
SEVERABILITY. If any provision of this Agreement, or any portion thereof, is
held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remainder of
this Agreement shall not be affected thereby and shall continue in full force and effect as if such
invalid, illegal, or unenforceable provision had never been contained herein. Each provision of
this Agreement shall be valid and enforceable to the fullest extent permitted by law. If any
provision of this Agreement is held to be excessively broad, it shall be reformed and construed
by limiting and reducing it so as to be enforceable to the maximum extent permitted by law. The
parties expressly acknowledge and agree that they would have entered into this Agreement
regardless of the enforceability of any particular provision.
22.
ENTIRE AGREEMENT (MERGER). This Agreement, including all exhibits,
appendices, and attachments hereto, sets forth the entire agreement between the Public Entity
and the other party with respect to the subject matter hereof and supersedes all prior and
contemporaneous discussions, negotiations, understandings, representations, warranties, and
agreements, whether oral or written, between the parties. All previous drafts, proposals, and
communications between the parties relating to the subject matter of this Agreement are hereby
merged into this Agreement. Neither party has relied upon any representation, warranty, or
undertaking that is not expressly set forth in this Agreement. The parties acknowledge that there
are no terms, conditions, representations, warranties, promises, covenants, or understandings
between the parties other than those expressly set forth herein.
23.
MODIFICATIONS (NONWAIVER). No amendment, modification, waiver, or
other change to any provision of this Agreement shall be effective unless specifically set forth in
a writing titled "Amendment to Agreement" that expressly identifies the provision(s) being
amended and is signed by authorized representatives of both parties. No course of dealing, delay,
or failure to enforce any provision of this Agreement shall constitute an amendment,
modification, waiver, or continuing waiver of such provision or any other provision of this
Agreement. Email exchanges, text messages, or other electronic communications, regardless of
content, shall not constitute a signed writing for purposes of modifying this Agreement. The
parties acknowledge that this provision is essential to maintain clarity and certainty in their
contractual relationship and to protect the interests of the Public Entity as required by New
Jersey law.

ADDENDUM TO ANIMAL CONTROL SERVICES CONTRACT BETWEEN THE
TOWNSHIP OF WEST ORANGE, PROVIDER, AND THE BOROUGH OF ESSEX
FELLS, RECIPIENT.
1. The Borough of Essex Fells will indemnify and hold harmless the Township of West Orange
with reference to any cause of action resulting from or arising out of any act or conduct by the
Animal Control Officers when said act or conduct is solely and exclusively for the performance
of his duties and obligations to the Borough of Essex Fells pursuant to the terms and conditions
of this Contract. In the event the Township of West Orange receives notification of any cause of
action or claim which it contends arises out of the employment by the Borough of Essex Fells of
the services of the Animal Control Officers pursuant to the terms of this Contract, said
notification shall be made promptly to the Borough of Essex Fells by directing same to the
Mayor and Business Administrator.
2. The Borough of Essex Fells shall indemnify and hold harmless acts, conduct or services of
the Animal Control Officers when said individuals are acting solely and exclusively for the
Borough of Essex Fells provided that said acts, conduct or services arise out of and are in the
scope and duties of the Animal Control Officer’s employment. It is the intent of this provision
that the Animal Control Officers shall conduct themselves pursuant to general principles,
obligations, duties and responsibilities governing the general nature and standards of Animal
Control services recognized throughout the State of New Jersey.

AN ORDINANCE AMENDING CHAPTER 25, ARTICLE I, SECTION 9.13, OF THE
REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE
BANNING “POP-UP” PARTIES
WHEREAS, The Mayor and Council of the Township of West Orange (the “Township”),
have an interest in the efficient administration of government services; and
WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may
make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not
contrary to the laws of this State or Federal Government, as it may deem necessary and proper
for the good of government, order and protection of person and property, and for the preservation
of the public health, safety and welfare of the municipality and its inhabitants, and as may be
necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by
any law; and
WHEREAS, the Township desires to amend Chapter 25, Article I, Section 9.13, of the
Revised General Ordinances of the Township of West Orange banning “pop-up” parties to define
and clarify the penalties for violations of Section 9.13, and to remove language that was
inadvertently included in Section 9.13, that should have only been incorporated by reference.
NOW THEREFORE, BE IT ORDAINED, by the Township Council of the Township
of West Orange, in the County of Essex, State of New Jersey, as follows:
SECTION 1. RECITALS. The foregoing whereas clauses are incorporated herein by
reference and made a part hereof.
SECTION 2. Section 9.13 “Pop-Up Parties” of the Revised General Ordinances of the
Township of West Orange is hereby supplemented and amended as follows:

Scope and purpose. The Township of West Orange (the "Township") has received

numerous complaints from residents in various neighborhoods throughout the Township regarding
parties, events, and/or gatherings wherein the attendees of the events have purchased tickets or
wristbands for entry into residential homes within the Township. The purpose of this subsection is
to provide recourse for the Township if such "pop-up" parties (defined herein) occur in the future
and to put the public on notice that the same are prohibited as a health and safety concern for the
general welfare of the public.

Definitions.
ADVERTISEMENT
Shall be defined for the purposes of this subsection to include the creation of any flyer,

social media posting, text message, or other form of electronic or other communication soliciting
guests to a residential home for payment of any amount.
POP-UP PARTY(IES)
Shall be defined as a party including any event and/or gathering occurring in a residential
home, apartment or other location (excluding commercial establishments such as licensed
restaurants, bars, or other event halls where such activity is permitted) whereby the owner,
occupant and/or operator of the residence solicits or advertises the use of their residence for an
event, party, or gathering and where the guests are subject to payment for tickets, wristbands, or
other mode of entry into the residence, or for food, alcoholic or non-alcoholic beverages.
c.

Prohibitions.
1. Any person, owner, occupant, or operator of a residence located in the residential zoning
district of the Township of West Orange shall be prohibited from advertising or otherwise
soliciting monies for entry into their home, food, or beverages to attend any pop-up party as
defined herein.
2. Any person who rents or otherwise loans their property in the residential district of the
Township of West Orange to a person for a pop-up party is in violation of this subsection.
3. Any person who creates, submits, publicizes or otherwise posts an advertisement for a popup party shall be considered in violation of this subsection and the same shall be considered
a separate violation under this subsection, subject to the penalties provided for herein.
4. Exemptions: Activities, gatherings, or other events that may constitute a pop-up party
under this subsection shall be exempted where the proceeds for the same shall be used for
any bona fide charitable organization licensed in the State of New Jersey and/or for
political contributions to any bona fide local, state, or federal campaign which has been
properly registered with the appropriate authority.

d.

Enforcement. The Township Police Department, the Township Health Department, the

Township Zoning Official, the Township Fire Department, their agents, employees, officers, or
assigns shall have the power to enforce the provisions of this subsection.
e.

Penalties. Each violation of any provision of this subsection shall carry a penalty of

one or more of the following: a fine not exceeding $2,000.00 or imprisonment for a period not
exceeding 90 days; or a period of community service for a period not exceeding 90 days. All

penalties for violation of any provision of this subsection shall be governed by the provisions of §
1-5.1 et seq. of the Revised General Ordinances of the Township of West Orange.
f.

Severability. Each section, subsection, sentence, clause and phrase of this subsection is

declared to be an independent section, subsection, sentence, clause and phrase, and the finding or
holding of any such portion of this subsection to be unconstitutional, void, or ineffective for any
cause, or reason, shall not affect any other portion of this subsection.
g.

Repealer. All other ordinances or parts of ordinances inconsistent with this subsection are

hereby repealed.
h.

Effective date. This subsection shall be in full force and effect from and after its adoption

and any publication as required by law.
SECTION 2. Severability. Each section, subsection, sentence, clause and phrase of this subsection
is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or
holding of any such portion of this subsection to be unconstitutional, void, or ineffective for any
cause, or reason, shall not affect any other portion of this subsection.
SECTION 3. Repealer. All other ordinances or parts of ordinances inconsistent with this
subsection are hereby repealed.

WHEREAS, the Governing Body of the Township of West Orange recognizes that
residents want the ability to purchase cannabis until 10:00 pm, Monday through Sunday; and
WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may
make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not
contrary to the laws of this State or Federal Government, as it may deem necessary and proper
for the good of government, order and protection of person and property, and for the preservation
of the public health, safety and welfare of the municipality and its inhabitants, and as may be
necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by
any law; and
WHEREAS, it is proper for the good of government and order to have the Township’s
hours of operations for cannabis sales reflect the already existing regulations for hours of
operations for alcohol sales.
BE IT ORDAINED, by the Township Council of the Township of West Orange, in the
County of Essex, State of New Jersey, as follows:
Section 1.
Subsection 5-34.8(a) Operating Requirements and Prohibitions (Cannabis
Licenses) of the Revised General Ordinances of the Township of West Orange is hereby

a. A Licensed Cannabis Entity may only operate during the following hours: Monday

Saturdays from 8:00 A.M. through 9:00 P.M. A Licensed Cannabis Cultivator and a
Licensed Cannabis Manufacturer shall not be subject to these hours of operations, except
that incoming or outgoing deliveries of any kind shall only occur between the hours of
8:00 A.M. through 8:00 P.M.
Section 2.
If any provisions of this Ordinance or application thereof, under any
circumstances, is held invalid, the invalidity shall not affect any of the provisions or applications
of this Ordinance that can be given effect without the valid provision(s) or application and to this
end, the provisions of the Ordinance are severable.

This Ordinance, which amends the Cannabis Licensing Regulations of the Township,
amends the permitted hours of operations for Licensed Cannabis Entities, to permit Licensed
Cannabis Entities to operate only between the hours of Monday through Sundays from 8:00
a.m. through 10:00 p.m. This action is in response to a request for operating hours to be
extended in the evening, which would bring the Township’s Regulations into alignment with the
regulations of other nearby suburban Essex County municipalities. This action also brings the
Township’s Regulations into alignment with the Township’s regulations concerning hours of
operations for licensed alcohol retailers. For the avoidance of any doubt, this action does not
affect Licensed Cannabis Cultivators or Licensed Cannabis Manufacturers, who, in accordance
with Subsection 5-34.8(a), are not subject to these hours of operations, except that incoming or
outgoing deliveries of any kind to Licensed Cannabis Cultivators or Licensed Cannabis

at 34 South Valley Road, West Orange, New Jersey, 07052, is the holder of Plenary Retail
Consumption License No. 0722-33-009-014; and
WHEREAS, an application has been filed by Jo Jo’s Restaurant Services, LLC t/a The
Valley Barbeque Lounge for renewal of its Plenary Retail Consumption License # 0722-33-009014, for the period July 1, 2026 through June 30, 2027, the Application submitted to the

WHEREAS, the Council expressed concern about creation of excess noise due to
amplified music in or about the vicinity of the expansion, the proposed outdoor patio area where
dining and alcoholic beverage service would be available, and to address that concern the Board
would approve the expansion of licensed premises and place to place transfer only if subject to
the Special Condition that there will be no amplified outside music after 10:00 p.m.; and

Orange Township ABC Board, approved of the Extension of Licensed Premise and Place to
Place transfer of License No. 0722-33-009-014, held by Jo Jo’s Restaurant Services,
LLC t/a The Valley Barbeque Lounge located at 34 South Valley Road, West Orange, New
Jersey, 07052, subject to the Special Condition pursuant to N.J.S.A. 33:1-32, that no amplified outside
music shall be permitted after 10:00 p.m., all as evidenced and set forth in Resolution #483-12, adopted
on June 12, 2014; and
WHEREAS, on June 12, 2014, the Township Council of the Township of West Orange,
Sitting as the West Orange Township ABC Board, approved the renewal of the Plenary Retail
Consumption License No. 0722-33-009-014, held by Jo Jo’s Restaurant Services, LLC t/a The Valley
Barbeque Lounge located at 34 South Valley Road, West Orange, New Jersey, 07052, for the License
Term July 1, 2014 to June 30, 2013, subject to the Special Condition pursuant to N.J.S.A. 33:132 that no amplified outside music shall be permitted after 10:00 p.m., there being no objection
on the part of the Licensee to such Special Condition, and the same Special Condition having
been deemed necessary and appropriate by the ABC Board, and having been consented by the
Licensee in the succeeding License terms to date; and

WHEREAS, by letter dated and sent via certified mail, registered return receipt to the
Licensee on May 11, 2026, the Licensee was notified of the Township ABC Board’s intention
to continue the same Special Conditions upon renewal for the 2026-2027 License Term and
offering a formal hearing in the event there was objection to same by the Licensee; and
WHEREAS, the Licensee has offered no objection and therefore by its inaction has
consented to continuation of the same Special Conditions upon renewal; and
WHEREAS, the Licensee has one pending ABC violation charge as follows:
Violation #1: On April 5, 2018, you allowed, permitted or suffered on or about the licensed
premises, a brawl, act or violence and/or disturbance in violation of N.J.A.C. 13:2-23.6(a)(2);
Recommended Penalty: 1st Offense= 30-day suspension; and
WHEREAS, a hearing on that pending charge can be scheduled at the discretion of the
ABC Board and the Municipal ABC Prosecutor.

RESOLUTION
WHEREAS, the Township Council of the Township of West Orange (“Township”)
serves as the Township of West Orange Board of Alcoholic Beverage Control (“ABC Board”);
and
WHEREAS, an application has been filed by Las Palmeras, Inc. t/a La Dolce Vita Bar
Restaurante (“Licensee”), 364 Valley Road, West Orange, NJ, for the renewal of its Plenary
Retail Consumption License, bearing License #0722-33-045-005, for the License Period July 1,
2026 through June 30, 2027; and
WHEREAS, the Licensee’s application for renewal complies with the New Jersey State
Laws regulating the sale, consumption, and distribution of alcoholic beverages; and
WHEREAS, the Licensee, in or about early June 2016, resolved with the State of New
Jersey at least ten (10) charges filed by the Office of the Attorney General, Department of Law
and Public Safety, Division of Alcoholic Beverage Control, alleging that the Licensee had
committed various and serious offenses during 2014, and seeking suspension of the license for
209 days, the resolution of which included payment of $8,600 in lieu of a 72 day suspension,
with 45 days held in abeyance for a period of 2 years, and the mitigating factor that the
Township had imposed Special Conditions on this Licensee, including, but not limited to, the
requirement to install and maintain a video security system, and the Township learning of such
disposition shortly after the Licensee’s License had been renewed for the 2016-2017 License
term; and
WHEREAS, the Special Conditions existing on the Licensee for that License Term were
as follows”

The Licensee shall hire one off-duty WOPD Officer or private security guard at
prevailing rates to provide for exterior security at the Licensed Premises on Friday, Saturday and
Sunday nights from 9:30 p.m., to 1:30 a.m.;
2.
The Licensee shall hire a licensed security company to provide security for the interior of
the Licensed Premises on Friday, Saturday and Sunday nights from 9:30 p.m., to 1:30 a.m.;
3.
The Licensee shall install and maintain a video surveillance system to cover the interior
of the Licensed Premises, including the bar area, the front and back entrances and exits and the
front sidewalk area on Valley Road, which surveillance system shall be maintained in good
working order and operating during all hours when the Licensed Premises is open for business,
and recordings shall be kept and made available to the West Orange Police Department upon
request for at least thirty (30) days following the date of recording, and the Licensee shall

cooperate with the West Orange Police Department in the implementation and maintenance of
this video surveillance system; and that
4.
The Licensee, every day it is open, shall close its doors to new customers at 12:30 a.m.,
shall cease the sale of alcoholic beverages at 1:00 a.m., and all customers shall be off the premise
by 1:30 a.m.; and
WHEREAS, new ABC charges were brought by the Township against this Licensee in
February 2017, as follows: On or about November 27, 2016, at or about 11:20 p.m., in the
Township of West Orange, County of Essex and State of New Jersey, at and about the Licensed
premises of the Licensee located at 364 Valley Road, West Orange, New Jersey, the Licensee did
conduct the premises so as to allow, permit or suffer in, upon and about that premises, an act of
violence and disturbance, specifically a patron shoving and throwing a bottle at another patron,
who was highly intoxicated, and causing a laceration above the victim’s left eye, in violation
N.J.A.C. §13:2-23.6(a)2, and the Licensee has violated N.J.A.C. §13:2-23.6(b) , in that it has
repeatedly and over a period of at least the past three years allowed, permitted, or suffered in or
upon the licensed premises assaults, acts of violence and/or disturbances, including, but not
limited to seventeen incidents requiring police intervention in or about the year 2014, adversely
affecting public safety or the rights of the public, to which a non-vult plea was entered and
disposition made on June 1, 2016, by the State of New Jersey, Department of Law and Public
Safety, Division of Alcoholic Beverage Control, Trans. No. R42991, as well as fifteen incidents
of affrays, two incidents of aggravated assault, an incident of strong arm robbery, urinating in
public, disorderly conduct, and ten noise complaints, all occurring in 2015, as well as twenty-one
incidents of affrays, four incidents of simple assault, an aggravated assault, assault with a
weapon, fighting, strong arm robbery, disorderly conduct, theft and noise complaints in 2016, all
contrary to the public health, safety and welfare, requiring many calls to and interventions by the
West Orange Police Department, such that the operation of this licensed premises has become,
and its operation is, a nuisance, the Licensee unable to maintain control of its patrons and its
licensed and surrounding premises; and
WHEREAS, counsel for the Licensee had advised that the Licensee employed a new CoManager in February 2017, and had voluntarily self-imposed certain time constraints on its
operation since that time, which were greater constraints than those currently existing Special
Conditions, in an effort to eliminate the incidents which have given rise to the pending and
earlier ABC charges and Special Conditions during the past several years; and
WHEREAS, the West Orange Township ABC Board and the Licensee agreed with
respect to said pending charges to proceed as follows:
The Township ABC Board shall adjourn the hearing on the pending ABC charges for a
period of ninety (90) days, from the currently scheduled June 27, 2017, to the second
regular Council Meeting in September, or first such meeting in October 2017, and shall
then determine based upon the Licensee’s operation in the interim whether there is a need
to go forward with prosecution of those charges, or to forego them in view of the
Licensee’s improved and acceptable operation during 2017; and

The Licensee agrees to continue its to date self-imposed modifications to the previously
imposed Special Condition no. 4, closing its doors to new customers at 12:00 a.m., rather
than 12:30 a.m., ceasing the sale of alcoholic beverages at 12:15 a.m., rather than at 1:00
a.m., and having all customers off the premises by 1:00 a.m., instead of at 1:30 a.m., all
of those limitations applicable every day the Licensee is open; and
The Licensee understands and acknowledges that Special Conditions 1 and 2, previously
imposed and to continue for the 2017-2018 License Term, contemplate that any security
company and security guard, or officer, shall be licensed and registered pursuant to the
“Security Officer Registration Act” (“SORA”), N.J.Stat. §45:19A-1, et seq., the terms
“security guard” and “security officer” meaning the same thing, and, if not already in full
compliance with “SORA”, full compliance shall be achieved within sixty (60) days of
enactment of this Resolution; and
WHEREAS, by Resolution No. 757-25, adopted on February 6, 2025, Licensee was
found guilty as follows:
• Failing to produce a complete employee list in violation of N.J.A.C. 13:223.13(a)(3)
• Failing to comply with special condition to make available video surveillance in
violation of N.J.A.C. 13:2-23.1
• Brawl- allowed, permitted or suffered on or about the premises a brawl, act of
violence and/or disturbance in violation of N.J.A.C. 3:2-23.6(a)(2)
• A suspension was imposed on the Licensee for 35 days from February 10, 2025
until March 17, 2025.
WHEREAS, by Resolution No. 761-25, adopted on March 13, 2025, the parties placed a
settlement on the record as follows:
•

Sold, served, delivered, allowed service to person underage in violation of
N.J.A.C. 13:2-23(a)
• Sold, served, delivered, allowed service to person apparently intoxicated in
violation of N.J.A.C. 13:2-23(b)
• A suspension was imposed on Licensee for 45 days, of which 15 was served from
March 17, 2025 to April 1, 2025, and the remaining 30 days, Licensee was given
the option to convert the suspension to a monetary fine.
WHEREAS, by Resolution No. 776-25, adopted on June 24, 2025, the parties agreed to
a settlement as follows:
1. License #0722-33-045-005 shall be suspended for 100 days total, as follows:

a) Thirty (30) days to be served, which shall begin on Tuesday, July 15, 2025 at
10:00A.M. and continue through until Thursday, August 14, 2025 at
10:00A.M.;
b) Twenty (20) days held in abeyance for one (1) year, to be served in the event
the Licensee is found guilty of serving an actually or apparently intoxicated
person, in violation of N.J.A.C. 13:2-23.1(b);
c) Monetary payment to the State, in lieu of fifty (50) day suspension.
2. Security:
a) All security will provide Security Officer Registration Act (“SORA”) cards
within thirty (30) days;
b) All security will participate in training programs, suggested by the State
Police, with a focus on de-escalation.
3. Any violations of the following offenses, between July 1, 2025 and June 30, 2026, will
be charged as a successive violation, consistent with N.J.A.C. 13:2-19.11(f):
a) Ordinance Violation, N.J.S.A. 33:1-31(h);
b) Special Condition Violation, N.J.S.A. 33:1-31(h);
c) Brawl, N.J.A.C. 13:2-23.6(a)(2);
d) Serving an actually or apparently intoxicated person, N.J.A.C. 13:2-23.1(b);
e) Hindering an investigation, N.J.S.A. 33:1-35/N.J.A.C. 13:2-23.30;
f) Sale or consumption beyond the scope of the license, N.J.S.A. 33:1-12/
N.J.A.C. 13:2-23.1(a); and
g) Nuisance, N.J.A.C. 13:2-23.6(b).
4. Should this corrective action not facilitate a change in the Licensee’s violations, future
violations after July 1, 2025 will be considered towards non-renewal of the license for
future years.
5. The Licensee shall enter a non-vult plea to all pending Charges.
6. The Licensee shall withdraw its Appeal regarding the March 13, 2025 Hearing result,
wherein the Licensee was found guilty of violating N.J.A.C. 13:2-23.6(b), and the license
was suspended for thirty (30) days.
WHEREAS, by Consent Order dated October 17,2025, between the State Division of
Alcoholic Beverage Control (“ABC” and Licensee, Licensee’s appeal to convert its 50-day
suspension to a monetary fine was resolved, resulting in the Licensee paying a monetary fine of
$5,000 to the State ABC.

settlement on the record as follows:

Sold, served, delivered, allowed service to person underage in violation of
N.J.A.C. 13:2-23(a)
• Sold, served, delivered, allowed service to person apparently intoxicated in
violation of N.J.A.C. 13:2-23(b)
• A suspension was imposed on Licensee for 45 days, of which 15 was served from
March 17, 2025 to April 1, 2025, and the remaining 30 days, Licensee was given
the option to convert the suspension to a monetary fine.
WHEREAS, by Resolution No. 776-25, adopted on June 24, 2025, the parties agreed to
a settlement as follows:
1. License #0722-33-045-005 shall be suspended for 100 days total, as follows:
a) Thirty (30) days to be served, which shall begin on Tuesday, July 15, 2025 at
10:00A.M. and continue through until Thursday, August 14, 2025 at
10:00A.M.;
b) Twenty (20) days held in abeyance for one (1) year, to be served in the event
the Licensee is found guilty of serving an actually or apparently intoxicated
person, in violation of N.J.A.C. 13:2-23.1(b);
c) Monetary payment to the State, in lieu of fifty (50) day suspension.
2. Security:
a) All security will provide Security Officer Registration Act (“SORA”) cards
within thirty (30) days;
b) All security will participate in training programs, suggested by the State
Police, with a focus on de-escalation.

3. Any violations of the following offenses, between July 1, 2025 and June 30, 2026, will
be charged as a successive violation, consistent with N.J.A.C. 13:2-19.11(f):
a) Ordinance Violation, N.J.S.A. 33:1-31(h);
b) Special Condition Violation, N.J.S.A. 33:1-31(h);
c) Brawl, N.J.A.C. 13:2-23.6(a)(2);
d) Serving an actually or apparently intoxicated person, N.J.A.C. 13:2-23.1(b);
e) Hindering an investigation, N.J.S.A. 33:1-35/N.J.A.C. 13:2-23.30;
f) Sale or consumption beyond the scope of the license, N.J.S.A. 33:1-12/
N.J.A.C. 13:2-23.1(a); and
g) Nuisance, N.J.A.C. 13:2-23.6(b).
4. Should this corrective action not facilitate a change in the Licensee’s violations, future
violations after July 1, 2025 will be considered towards non-renewal of the license for
future years.
5. The Licensee shall enter a non-vult plea to all pending Charges.
6. The Licensee shall withdraw its Appeal regarding the March 13, 2025 Hearing result,
wherein the Licensee was found guilty of violating N.J.A.C. 13:2-23.6(b), and the license
was suspended for thirty (30) days.
WHEREAS, by Consent Order dated October 17,2025, between the State Division of
Alcoholic Beverage Control (“ABC” and Licensee, Licensee’s appeal to convert its 50-day
suspension to a monetary fine was resolved, resulting in the Licensee paying a monetary fine of
$5,000 to the State ABC.
WHEREAS, new incidents have occurred since resolution of those charges and for
which written charges are being prepare, but during the current licensing term, the following
incidents occurred at, or originated from the licensed premises:

WHEREAS, the purpose of the ABC regulatory scheme is to protect the health, safety
and welfare of the people of the State of New Jersey, and the fostering of moderate and

responsible use and consumption of alcoholic beverages, and the proposed special conditions
being logically related to the regulatory scheme and being reasonable efforts to promote the
purposes of that scheme;

WHEREAS, the Licensee has not conformed its behavior for which new charges are
being prepared, which result in multiple second violations for which penalties will be more
substantial, the ABC Board believes that it is obligated to protect the health, safety and welfare
of the people of the State of New Jersey, and even with Special Conditions imposed, the
Licensee is operating a business that is to the determinant of the health, safety and welfare.
NOW, THEREFORE, BE IT RESOLVED THAT THE TOWNSHIP ALCOHOLIC
BEVERAGE CONTROL BOARD OF THE TOWNSHIP OF WEST ORANGE, does
hereby
approve
deny
the renewal of the Plenary Retail Consumption License heretofore issued to the Licensee bearing
License #0722-33-045-005, for the 2026-2027 Licensing term
If said License is renewed said renewal is subject to the following Special Conditions pursuant to
N.J.S.A. §33:1-32, all of which Special Conditions having been found by the Township ABC
Board to be necessary and proper to accomplish the objects of Title 33 and secure compliance
with its provisions, and submitted promptly for approval by the Director of the Division of
Alcoholic Beverage Control in accordance with law:

All security will provide Security Officer Registration Act (“SORA”) cards within
thirty (30) days;
All security will participate in training programs, suggested by the State Police,
with a focus on de-escalation.
The Licensee shall hire one private security guard, pursuant to the “Security
Officer Registration Act” (“SORA”), N.J.Stat. §45:19A-1, et seq., at prevailing
rates to provide for exterior security at the Licensed Premises on Friday, Saturday
and Sunday nights from 9:30 p.m., to 1:30 a.m.;
The Licensee shall hire a licensed security company, pursuant to the “Security
Officer Registration Act” (“SORA”), N.J.Stat. §45:19A-1, et seq., to provide
security for the interior of the Licensed Premises on Friday, Saturday and Sunday
nights from 9:30 p.m., to closing at 1:00 a.m.;
The Licensee shall install and maintain a video surveillance system to cover the
interior of the Licensed Premises, including the bar area, the front and back
entrances and exits and the front sidewalk area on Valley Road, which
surveillance system shall be maintained in good working order and operating
during all hours when the Licensed Premises is open for business, and recordings
shall be kept and made available to the West Orange Police Department upon
request for at least thirty (30) days following the date of recording, and the

Licensee shall cooperate with the West Orange Police Department in the
implementation and maintenance of this video surveillance system; and that
The Licensee shall provide the West Orange Police Department with remote
access to its video surveillance camera system including surveillance camera web
address, username and password log-in information, allowing for periodic review
of video by West Orange Police Department personnel.
The Licensee, every day it is open, shall close its doors to new customers at 11:00
a.m., shall cease the sale of alcoholic beverages at 11:30 a.m., and all customers
shall be off the premises by 12:00 a.m.; and

AND BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided
to the Director of the Division of Alcoholic Beverage Control of the State of New Jersey for the
Director’s approval before implementation and for that Division’s records, and shall be
maintained in the Township’s permanent Alcoholic Beverage Control records.
The above Resolution was passed by the Township Council of the Township of West
Orange serving as the West Orange Board of Alcoholic Beverage Control at the Board’s regular
meeting held on June 24, 2026.
