Councilwoman Gretchen Bangert – St. Louis County Council
PUBLIC HEARING
City Administrator Jason McConachie read the public hearing notice regarding a
conditional use permit for 1939 Woodson Road for the operations of a construction
contractor office.
Two residents spoke in support of the business and the improvements that have been
made to the building.
Mayor Little opened the floor to comments. Hearing none, the public hearing was
closed.
APPROVAL OF MINUTES
January 26, 2026, City Council Meeting
Councilwoman Requejo made a motion to approve the January 26, 2026, Council
Meeting minutes as presented. Councilwoman Ruckman seconded. The vote was
polled as follows: Ruckman – yes; Wroblewski – yes; Furnace – yes; Steibel – yes;
Requejo – yes; Barnard – yes; and Bennett – yes. Motion carried.

Tobacco Sales at 1939 Woodson Road in the C-1 Neighborhood Commercial Zoning
District as Provided for in Section 400.220 and Appendix A of the Municipal Code
of the City of Overland” as Ordinance 2026-03. Councilman Bennett seconded.
The vote was polled as follows: Ruckman – yes; Wroblewski – yes; Furnace – yes;
Steibel – yes; Requejo – abstain; Barnard – yes; and Bennett – yes. Motion carried.

requesting a site plan review to build an addition to the South side of the current building
for storage. The owner was previously approved by P&Z to place the addition on the rear
of the building, but was denied by Metropolitan Sewer District for encroachment of the
easement. The property is zoned “C-2” General Commercial.
10055 Page Avenue- Lot Consolidation- Brandon Harp, CEDC Civil Engineering on
behalf of Dobbs Auto & Tire, is requesting a lot consolidation to combine 10055 Page
Avenue and 1701 Northfield Drive into one parcel. 1701 Northfield serves as a parking lot

PROBLEM IDENTIFICATION

Per the FY24-26 Triennial Highway Safety Plan, substance-impaired drivers contributed to 22% of Missouri' s traffic crash
fatalities during the past five years. Alcohol remains the primary contributor to substance-impaired driving crashes; however,
the number of persons under the influence of prescription medications and/or illicit drugs has increased significantly over the
past decade. With recreational marijuana now legal in Missouri, there are concerns this trend will continue.
Male drivers were more likely than females to be involved in substance-impaired driving crashes. During the past five years,
males were responsible for 81.7% of substance-impaired driving fatalities. Ten percent of the children less than 15 years of
age, who were killed in motor vehicle crashes over the last five years, were riding with a substance-impaired driver.
Depending on the jurisdiction, impaired driving offenses in Missouri are prosecuted differently . Prosecutors and judges may not
always be aware of the severity of the impaired driving problem or how to best provide treatment for an offender .
During the years of 2022 - 2024, there were ninety (90) alcohol- involved traffic crashes in the City of Overland, Missouri.
Of the ninety (90) crashes, two (2) resulted in a fatality, and eight (8) resulted in a disabling injury.
The City of Overland, Missouri, was ranked seventeenth (17th) in the State of Missouri for alcohol-involved crashes, seventh
(7th) in the state for alcohol-involved crashes resulting in a fatality, and tenth (10th) in the state for alcohol-involved crashes
resulting in a disabling injury.
In 2025, the Overland, Missouri, Police Department made approximately sixty-one (61) Driving While Intoxicated (D.W.I.)
arrests.
The top crash locations in Overland, Missouri, were State Route Highway D ( Page Avenue), followed by Interstate Highway
I-170, and Woodson Road.

As outlined in the FY24-26 Triennial Highway Safety Plan, Core Performance Measure Goal:
Based on a goal of 0 fatalities by 2030, Missouri is setting a five-year average alcohol-involved fatality target of 232.6 by
December 31, 2026.
The overall goal of the City of Overland, Missouri, Police Department is to focus on decreasing the number of intoxicated
subjects, whether in general or operating a motor vehicle, causing a traffic crash.
Goal #1 is to decrease the number of intoxicated subjects. Goal #2 is to decrease the number of fatal alcohol- involved traffic
crashes and goal #3 is to decrease the number of disabling injuries from intoxicated subjects operating a motor vehicle.
The City of Overland, Missouri, Police Department's objectives include, but are not limited to, participating in Driving While
Intoxicated (D.W.I.) enforcement campaigns.

The MHTC will administratively evaluate this project. Evaluation will be based, at a minimum, upon the following:
1. Law enforcement compliance with state MIBRS, Racial Profiling, and MOCARS reporting requirements (law enforcement
contracts only)
2. Timely submission of monthly reimbursement vouchers and appropriate documentation to support reimbursement for
expenditures (i.e., personal services, equipment, materials)
3. Timely submission of periodic reports (i.e., monthly, quarterly) as required
4. Timely submission of the Year End Report of activity (due within 30 days after contract completion date)
5. Attaining the Goals set forth in this contract
6. Accomplishing the Objectives established to meet the project Goals, such as:
· Enforcement activities (planned activities compared with actual activities)
· Programs (number and success of programs held compared to planned programs, evaluations if available)
· Training (actual vs. anticipated enrollment, student evaluations of the class, student test scores on course examinations,
location of classes, class cancellation information)
· Equipment purchases (timely purchase of equipment utilized to support and enhance the traffic safety effort ; documentation of
equipment use and frequency of use)
· Public awareness activities (media releases, promotion events, or education materials produced or purchased)
· Other (any other information or material that supports the Objectives)
7. The project will be evaluated by the Highway Safety and Traffic Division through annual crash analysis
Evaluation results will be used to determine:
· The success of this type of activity in general and this particular project specifically ;
· Whether similar activities should be supported in the future; and
· Whether grantee will receive funding for future projects
The City of Overland, Missouri, Police Department will evaluate this and all projects complying with the State of Missouri's
National Incident Based Reporting System (N.I.B.R.S.) / Missouri Incident Based Reporting System (M.I.B.R.S.), Missouri Crash
Analysis Reporting System (M.O.C.A.R.S.) reporting requirements, and Traffic Analysis data submissions.
The City of Overland, Missouri's Police Department will submit the required reimbursement vouchers and documentation in a
timely manner, in accordance with the contract. The Police Department will compile statistics and reports to evaluate this
project.

U.S. Drug Enforcement Administration (D.E.A.) Task Force Officer agreement The contract date began on October 1, 2022, and concludes on September 30, 2026. The agreement reimburses our department
for overtime expenses incurred by personnel.

contributing circumstance more than twice as often as impaired driving, and feedback and citation data from law enforcement
agencies indicate speeds are up significantly during the last 3 years.
During the years of 2022 - 2024, there were a total of one-thousand seven-hundred nineteen (1,719) motor vehicle crashes in
the City of Overland, Missouri.
Of the one-thousand seven-hundred nineteen (1,719), there were seven (7) fatalities, and fifty-six (56) crashes resulting in
disabling injuries.
The City of Overland, Missouri, was ranked eighteenth (18th) in the State of Missouri for speed-involved crashes, twelfth (12th)

THE DISTRACTED DRIVING ENFORCEMENT PROGRAM
WHEREAS, the Missouri Department of Transportation – Traffic and Highways Safety
Division administers a variety of grant programs, utilizing federal funds, available to local law
enforcement agencies, and
WHEREAS, the City of Overland, through the Missouri Department of Transportation –
Traffic and Highways Safety, participates in a variety of these programs, including the
“Distracted Driving Enforcement” Program, and
WHEREAS, the City’s goals include but are not limited to; decreasing the number of
distracted driving violations that result in a traffic crash, as well as distracted drivers in general;
and
WHEREAS, a copy of the application is attached hereto and is marked as Exhibit “A”.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OVERLAND, MISSOURI, AS FOLLOWS:
Section 1. The Mayor is hereby authorized to sign and execute, on behalf of the City, the

PROBLEM IDENTIFICATION

Per the FY24-26 Triennial Highway Safety Plan, there is a growing body of evidence which suggests distracted driving is
becoming an increasingly large contributor to traffic crashes . While many drivers drive distracted, it is often difficult for law
enforcement to determine a driver was distracted after a crash. As a result, the reported number of distracted driving crashes
are widely considered to be underreported. In addition, national research and telematics data indicate the problem is occurring
much more frequently.
In 2015, the National Safety Council found that cell phones are involved in an estimated 27% of all car crashes. According to a
recent Naturalistic Driving study by Virginia Tech Transportation Institute , a risk for being involved in a critical incident is 23
times greater if the driver texts while driving.
From 2017-2021 in Missouri, 8% of fatal crashes involved a distracted driver. Twenty-two percent of the distracted drivers
involved in fatal crashes in the last five years were between 15 and 24 years of age. The number of reported distracted driving
fatalities has increased two of the last three years. In 2022, preliminary data indicates there were 85 reported distracted driving
fatalities.
Notably, more than half of the individuals killed in Missouri distracted driving crashes were someone other than the distracted
driver. Twenty-two percent of the distracted drivers in fatal crashes were between the ages of 15 and 24. Though Missouri law
currently only prohibits texting and driving for drivers age 21 and younger, more than 70% of drivers involved in distracted
driving crashes are age 22 or older. In a recent survey of Missourians, distracted driving was identified as one of the most
concerning behaviors on Missouri roadways.
During the years of 2022 - 2024, there were a total of one hundred fifty-three (153) distracted driving motor vehicle crashes in
the City of Overland, Missouri.
Of the one hundred fifty-three (153), there was one (1) fatality, and three (3) crashes resulting in disabling injuries.
The City of Overland, Missouri, was ranked forty-sixth (46th) in the State of Missouri for distraction involved traffic crashes ,
sixth (6th) in the state for distraction involved crashes resulting in a fatality, and thirteenth (13th) resulting in a disabling injury.

AUTHORIZING CONTRACT WITH MISSOURI DEPARTMENT OF
TRANSPORATION – TRAFFIC AND HIGHWAYS SAFETY DIVISION RELATED TO
THE YOUTH ALCOHOL ENFORCEMENT PROGRAM
WHEREAS, the Missouri Department of Transportation – Traffic and Highways Safety
Division administers a variety of grant programs, utilizing federal funds, available to local law
enforcement agencies, and
WHEREAS, the City of Overland, through the Missouri Department of Transportation –
Traffic and Highways Safety, participates in a variety of these programs, including the “Youth
Alcohol Enforcement” Program, and
WHEREAS, the City’s goals include but are not limited to; decrease the number of
intoxicated minors, decrease the number of disabling injuries from intoxicated minors operating
a motor vehicle, and decrease the number of minors operating a motor vehicle resulting in a
traffic crash; and
WHEREAS, a copy of the application is attached hereto and is marked as Exhibit “A”.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OVERLAND, MISSOURI, AS FOLLOWS:
Section 1. The Mayor is hereby authorized to sign and execute, on behalf of the City, the
documents necessary, for the submittal of the grant application to the Missouri Department of
Transportation – Highway Safety and Traffic Division, 830 MoDOT Drive, P.O. Box 270,
Jefferson City, MO 65102 for the “Youth Alcohol Enforcement” Program.
Section 2. If the grant is awarded, the Mayor is hereby authorized to sign and execute, on
behalf of the City, the documents necessary for the acceptance of the grant and the City’s
participation in the “Youth Alcohol Enforcement” Program.

PROBLEM IDENTIFICATION

Per the FY24-26 Triennial Highway Safety Plan, substance-impaired drivers contributed to 22% of Missouri' s traffic crash
fatalities during the past five years. Alcohol remains the primary contributor to substance-impaired driving crashes; however,
the number of persons under the influence of prescription medications and/or illicit drugs has increased significantly over the
past decade. With recreational marijuana now legal in Missouri, there are concerns this trend will continue.
Male drivers were more likely than females to be involved in substance-impaired driving crashes. During the past five years,
males were responsible for 81.7% of substance-impaired driving fatalities. Ten percent of the children less than 15 years of
age, who were killed in motor vehicle crashes over the last five years, were riding with a substance-impaired driver.
Depending on the jurisdiction, impaired driving offenses in Missouri are prosecuted differently . Prosecutors and judges may not
always be aware of the severity of the impaired driving problem or how to best provide treatment for an offender .
There are numerous schools in the City of Overland, Missouri, vicinity. One of which is a high school located only a few
blocks from the Overland Police Department. It is not uncommon for the men and women of the Overland Police Department
to encounter minors that have been consuming alcohol and / or drugs.
During the years of 2022 - 2024, there were five (5) traffic crashes involving drivers that were 21 and below under the influence
of alcohol, ranking us sixteenth (16th) in the state. One (1) of those resulted in a fatality, and one (1) resulted in a disabling
injury.

As outlined in the FY24-26 Triennial Highway Safety Plan, Core Performance Measure Goal:
Based on a goal of 0 fatalities by 2030, Missouri is setting a five-year average alcohol-involved fatality target of 232.6 by
December 31, 2026.
The overall goal of the Overland Police Department is to focus on decreasing the number of underage drinkers, whether in
general or operating a motor vehicle causing a traffic crash .
Goal #1 is to decrease the number of intoxicated minors.
Goal #2 is to decrease the number of disabling injuries from intoxicated minors operating a motor vehicle.
Goal #3 is to decrease the number of minors operating a motor vehicle resulting in a traffic crash .
The Overland Police Department's objectives include but are not limited to participating in youth alcohol and D.W.I.
enforcement campaigns.

The MHTC will administratively evaluate this project. Evaluation will be based, at a minimum, upon the following:
1. Law enforcement compliance with state MIBRS, Racial Profiling, and MOCARS reporting requirements (law enforcement
contracts only)
2. Timely submission of monthly reimbursement vouchers and appropriate documentation to support reimbursement for
expenditures (i.e., personal services, equipment, materials)
3. Timely submission of periodic reports (i.e., monthly, quarterly) as required
4. Timely submission of the Year End Report of activity (due within 30 days after contract completion date)
5. Attaining the Goals set forth in this contract
6. Accomplishing the Objectives established to meet the project Goals, such as:
· Enforcement activities (planned activities compared with actual activities)
· Programs (number and success of programs held compared to planned programs, evaluations if available)
· Training (actual vs. anticipated enrollment, student evaluations of the class, student test scores on course examinations,
location of classes, class cancellation information)
· Equipment purchases (timely purchase of equipment utilized to support and enhance the traffic safety effort ; documentation of
equipment use and frequency of use)
· Public awareness activities (media releases, promotion events, or education materials produced or purchased)
· Other (any other information or material that supports the Objectives)
7. The project will be evaluated by the Highway Safety and Traffic Division through annual crash analysis
Evaluation results will be used to determine:
· The success of this type of activity in general and this particular project specifically ;
· Whether similar activities should be supported in the future; and
· Whether grantee will receive funding for future projects
The City of Overland, Missouri, Police Department will evaluate this and all projects complying with the State of Missouri's
National Incident Based Reporting System (N.I.B.R.S.) / Missouri Incident Based Reporting System (M.I.B.R.S.), Missouri Crash
Analysis Reporting System (M.O.C.A.R.S.) reporting requirements, and Traffic Analysis data submissions.
The City of Overland, Missouri's Police Department will submit the required reimbursement vouchers and documentation in a
timely manner, in accordance with the contract. The Police Department will compile statistics and reports to evaluate this
project.

AN ORDINANCE AMENDING CHAPTER 400, ZONING CODE OF THE CITY
OF OVERLAND, MISSOURI, RELATING TO SECTION 400.685. PROCEDURE
TO AMEND APPROVED CONDITIONAL USE PERMIT.
WHEREAS, the City of Overland has control under Chapter 89 RSMo. to establish
reasonable land use requirements to protect the public health, welfare, and morals of its
citizens; and
WHEREAS, after the Planning & Zoning Commission held a duly noticed public
hearing on January 27, 2026, in accordance with legal requirements, wherein comments
from the public were taken, and thereafter the Planning & Zoning Commission
recommended to the City Council that the City Council approve the requested amendments
to the Zoning Code; and
WHEREAS, the City Council, after careful and due deliberation has concluded that
the proposed amendments to the Zoning Code would be in the interests of the health, safety,
and welfare of the citizens of the City of Overland.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF OVERLAND, STATE OF MISSOURI, AS FOLLOWS:
Section 1.
That Chapter 400 Zoning Regulations of the Municipal Code of the
City of Overland is hereby amended by the repeal of Section 400.685. Procedure to
Amend Approved Conditional Use Permit which read as follows, in its entirety;:
Section 400.685. Procedure to Amend Approved Conditional Use Permit.
In order to amend an existing conditional use permit. the applicant must file the
application documents required by Section 400.670(A), and expressly include
information demonstrating: 1) the amendment(s) to the conditional use permit
sought by applicant; and 2) the information to substantiate the need for such
amendment(s). All applications to amend an approved conditional use permit shall
include a signed statement that the applicant agrees to be bound by the terms and
conditions of the issued conditional use permit, as may be amended. The procedure
to amend an approved conditional use permit shall either be under the
administrative amendment process described in Subsection (A) or the nonadministrative amendment process described in Subsection (B), depending on the
amendment requested by the applicant. Any term or condition that is not amended
as part of a conditional use permit amendment shall continue in full force and effect.
A. Administrative Amendment.
1. The Director may administratively amend an approved conditional
use permit if the applicant proposes any of the following amendments:
a. A change in name of, or ownership interest in, a business
operating the conditional use, or a change in ownership of the
property where a conditional use permit has been issued;
b. A change in the hours of operation for all businesses except
those selling intoxicating liquor or marijuana businesses;
provided that such changes in hours shall not be an increase of
more than fifteen percent (15%) in total hours the business
would be in operation, or an increase in days of operation;
2. The Director, in considering whether to administratively amend a
conditional use permit, shall consider if the amendment:
a. Keeps with the intent and spirit of the original conditional use
permit approval;
b. Is an appropriate amendment in light of the operation of the
conditional use since approval; and
c. Not a substantial deviation from the original conditional use
permit approval or conditions placed thereon.
If, in the judgment of the Director, consideration of the proposed conditional
use permit amendment is more appropriate to be considered by the City
Council, the Director shall have the authority to require that such conditional use
permit amendment proceed under the non-administrative amendment process
described in Subsection (B) herein. Additionally, if the request for an
administrative amendment to an approved conditional use permit is denied by
the Director, the applicant shall have the right to appeal to the Planning and
Zoning Commission. The Planning and Zoning Commission shall hear any such
appeal as if it were brought as a non-administrative amendment.
B. Non-Administrative Amendment. All other amendments to any conditional use
permit that do not fall within the limited scope of the administrative amendment
process shall require the application to proceed through the process to initially
secure a conditional use permit described in Section 400.670.
Section 2.
That Chapter 400 Zoning Regulations of the Municipal Code of the
City of Overland is hereby amended by the adoption of the following terms and definitions
from Section 400.060 Definitions which read as follows, in its entirety;:
Section 400.685. Procedure to Amend Approved Conditional Use Permit.
A. General Applicability.
This Section shall apply to all amendments to existing Conditional Use
Permits. In order to amend an existing conditional use permit, the
applicant must file the application documents required by Section
400.670(A) and a Site Plan as required by Chapter 400, Article IX. Such
amendment application shall also expressly include information
demonstrating: 1) the amendment(s) to the conditional use permit sought
by applicant; and 2) the information to substantiate the need for such
amendment(s). All applications to amend an approved conditional use
permit shall include a signed statement that the applicant agrees to be
bound by the terms and conditions of the issued conditional use permit, as
may be amended. The procedure to amend an approved conditional use
permit shall either be under the administrative amendment process
described in Subsection (B) or the non-administrative amendment process
described in Subsection (C), depending on the scope of the amendment
requested by the applicant. Any term or condition that is not amended as
part of a conditional use permit amendment shall continue in full force and
effect.
B. Administrative Amendment.
1. The Director may administratively amend an approved conditional
use permit if the applicant proposes any of the following
amendments:
a. A change in name of, or ownership interest in, a business
operating the conditional use, or a change in ownership of
the property where a conditional use permit has been
issued;
b. A change in the hours of operation for all businesses;
provided that such changes in hours shall not be an
increase of more than fifteen percent (15%) in total hours
the business would be in operation, or an increase in days

c. An increase in square footage of up to one hundred (100%)
percent of the previously City Council-approved square
footage within a multi-tenant building
2. The Director, in considering whether to administratively amend a
conditional use permit, shall consider if the amendment:
a. Keeps with the intent and spirit of the original conditional
use permit approval;
b. Is an appropriate amendment in light of the operation of
the conditional use since approval; and
c. Not a substantial deviation from the original conditional
use permit approval or conditions placed thereon.
d. Results in an increase in the required parking for the
business; provided, however, administrative amendment
shall not be available if the total amount of required
parking for the business is not available on-site absent a
variance from the strict application of the parking
requirements granted by the Board of Adjustment.
3. The Director shall have no authority to consider administrative
amendments relating to any business that sales or transacts in
intoxicating liquor, marijuana, tobacco, or e-cigarette products.
4. The Director shall have no authority to consider administrative
amendment for any business, property, to Conditional Use that has
not been in operation within the past ninety (90) days.
If, in the judgment of the Director, consideration of the proposed
conditional use permit amendment is more appropriate to be considered
by the City Council, the Director shall have the authority to require that
such conditional use permit amendment proceed under the nonadministrative amendment process described in Subsection (B) herein.
Additionally, if the request for an administrative amendment to an
approved conditional use permit is denied by the Director, the applicant
shall have the right to appeal to the Planning and Zoning Commission. The
Planning and Zoning Commission shall hear any such appeal as if it were
brought as a non-administrative amendment.

SUPERMARKET — A self-service grocery store with a gross floor area of more
than thirty-five thousand (35,000) square feet selling groceries, dairy products and
household goods at retail.
Section 2.
That Chapter 400 Zoning Regulations of the Municipal Code of the
City of Overland is hereby amended by the adoption of the following terms and definitions
to Section 400.060 Definitions which read as follows;
400.060 Definitions.
CONVENIENCE STORE – A retail establishment with fuel sales, which
occupies less than five thousand (5,000) square feet of gross floor area that also
sells prepackaged food items, tobacco products, periodicals and tangible
consumer goods, primarily for self-service by the consumer, including hot
beverages, fountain beverages and pastries. Such businesses may also sell siteprepared food items and packaged liquor not for on-site consumption. This
use shall not include automobile repair facilities or those uses allowed at an
automobile repair/body shop or automobile service station.
GROCERY, NEIGHBORHOOD – A retail establishment, which occupies less
than five thousand (5,000) square feet of gross floor area, which primarily sells
food and soft drinks, but also may sell other convenience and household goods,
including packaged liquor not for on-site consumption.
GROCERY, COMMUNITY – A retail establishment which occupies at least
five thousand (5,000) square feet but not more than twenty-five thousand
(25,000) square feet of gross floor area, which sells food, but also may sell other
convenience and household goods, including packaged liquor not for on-site
consumption.
GROCERY, SUPERMARKET – A retail establishment, which occupies more
than twenty-five thousand (25,000) square feet of gross floor area, which sells
food, but also may sell other convenience and household goods. Such
businesses may also sell site-prepared food items and packaged liquor not for
on-site consumption.
LIQUOR STORE – A retail establishment or place of business primarily or
exclusively engaged in retail sale for consumption off the premises of alcoholic
beverages.
Section 3.
That Chapter 400 Zoning Regulations of the Municipal Code of the
City of Overland is hereby amended by the addition of certain uses identified in Exhibit
“A”, which is attached hereto, to Appendix A, Tables of Primary Uses, and Table of
Planned Uses.
Section 4.
This Ordinance shall be in full force and effect from and after its
date of passage and being signed as provided by law.

AN ORDINANCE AMENDING CHAPTER 600, ALCOHOLIC BEVERAGES,
RELATING TO APPLICATION REQUIREMENTS, CLASSIFICATION OF
LICENSES, ADDITION OF NEW LIQUOR LICENSES, AND LIMITS ON
NUMBER OF CERTAIN LICENSES.
WHEREAS, the Liquor Control Act provides municipalities, including the City of
Overland (the “City”), certain authority in the regulation and trafficking of liquor; and
WHEREAS, one must be mindful that the traffic of liquor is not a lawful business
except as authorized by express state legislation; and
WHEREAS, the City desires to establish certain additional application
requirements, specifically bonding or surety requirements, to protect the City against
potential expenses related to liquor licensees’ failure to comply with state law or City
ordinance; and
WHEREAS, the City is using the authority derived from the state to classify certain
liquor licenses based on the nature of the business proposed; and
WHEREAS, the City also desires to establish certain appropriate business times for
liquor licensee’s operating package liquor sale operations; and
WHEREAS, the City also wishes to use the authority derived from the state to limit
the number of certain licenses that may be available for businesses within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF OVERLAND, ST. LOUIS COUNTY, MISSOURI, AS FOLLOWS:
Section 1.
Section 600.010 entitled “Definitions” is hereby amended by the
enactment of a new definition in to read as follows:
LIQUOR STORE
A retail establishment or place of business primarily or exclusively engaged in
retail sale of alcoholic beverages to be consumed off premises. For purposes of
this definition, “primarily or exclusively engaged in retail sale for consumption
off the premises of alcoholic beverages” shall mean that THIRTY-FIVE
PERCENT (35%) or more of the total sales floor of the establishment is
dedicated to the sale and merchandising of liquor or alcoholic beverages.

Section 2.
Section 600.180 entitled “License Application” is hereby
amended by the repeal of Section 600.180 § A. 3. which reads as follows, in its entirety;
Section 600.180 § A. 3.
3. In the event a license is sought for the sale at retail by the drink for consumption
on the premises where sold, of all kinds of intoxicating liquor, including the
sale of intoxicating liquor in the original package (Classes C to E), the
application forms shall provide for and contain spaces for information relating
to the applicant's compliance with any criteria and requirements concerning the
granting of such license, as the same are set forth and defined in this Code,
including, but not limited to, building and sanitary codes.
Section 3.
Section 600.180 entitled “License Application” is hereby
amended by the adoption of a new Section 600.180 § A. 3. which reads as follows;
Section 600.180 § A. 3.
3. In the event a license is sought for the sale at retail by the drink for
consumption on the premises where sold, of all kinds of intoxicating liquor,
including the sale of intoxicating liquor in the original package (Classes C
through E), the application forms shall provide for and contain spaces for
information relating to the applicant's compliance with any criteria and
requirements concerning the granting of such license, as the same are set
forth and defined in this Code, including, but not limited to, building and
sanitary codes. Applicant shall also include a bond or surety in the City’s
favor in an amount of five thousand dollars ($5,000.00), or in such other
amount as reasonably determined by the City Council. This bond or surety
shall be in place to guarantee compliance with the City’s Code, including
specifically Chapter 600. The bond or surety shall be drawn on by the City
if any enforcement action against the liquor licensee, including but not
limited to denial or revocation of a liquor license, selling liquor outside the
boundaries of the licensed premises, or sale operations outside of the
licensed classification of alcohol or intoxicating liquor business.
Section 4.
Section 600.180 entitled “License Application” is hereby
amended by the repeal of Section 600.180 § B. which reads as follows, in its entirety;

B. Licenses For Subsequent License Periods. Applications for issuance of licenses
for a premises that was granted a license during the previous license period must
be filed on or before the first day of June of each calendar year. Such application
shall be reviewed by the City Council at its next meeting or as soon thereafter

as is practical. Upon approval of the majority of the City Council and payment
of the license fee provided in this Chapter, the Clerk shall issue a new license.
Section 4.
Section 600.180 entitled “License Application” is hereby
amended by the adoption of a new Section 600.180 § B. which reads as follows;

B. Licenses For Subsequent License Periods. Applications for issuance of
licenses for a premises that was granted a license during the previous
license period must be filed on or before the first day of May of each
calendar year. Such application shall be reviewed by the City Council at
its next meeting or as soon thereafter as is practical. Upon approval of the
majority of the City Council and payment of the license fee provided in this
Chapter, the Clerk shall issue a new license.
Section 5.
All other provisions of Section 600.180 not amended herein shall
remain in full force and effect.
Section 6.
Section 600.260 entitled “Licenses—Schedule of Types of
Licenses, Fees, Limitations on Number per Type”, is hereby amended by the repeal of
Section 600.260 § A. which reads as follows, in its entirety;
Section 600.260 § A
A. Licenses for the sale of liquor, at retail in the original package, not for resale,
direct to the consumer, not to be consumed on the premises may be procured
by a licensee who meets all of the qualifications in this Chapter and upon
approval by the City Council according to the following two (2) types:
1. A group of licenses for the sale of intoxicating liquor and/or malt
liquor; this license is described as a full package liquor license or a
"Class A" license. The fee for all such licenses shall be one hundred
fifty dollars ($150.00). The "Class A" license group shall be further
broken down into the following subclasses:
a. "Class A-C": A license for the sale of intoxicating liquor
and/or malt liquor by a convenience store as defined by
Section 400.060, including stores that, either by inventory
and/or gross receipts, have fifty-one percent (51%) of its
sales in liquor and/or malt liquor; provided, however, that
to be eligible for a Class A-C license, such convenience
store does not offer gasoline at retail through pump
stations.
b. "Class A-F": A license for the sale of intoxicating liquor

and/or malt liquor by a convenience store as defined by
Section 400.060; provided, however, that to be eligible for
a Class A-F license, such convenience store must also offer
gasoline at retail through pump stations.
c. "Class A-S": A license for the sale of intoxicating liquor
and/or malt liquor by a supermarket as defined in Section
400.060 and any neighborhood market regardless of size.
For purposes of this Class A-S license, a supermarket shall
include retail establishments of eight thousand (8,000)
square feet or more that would otherwise qualify as a
supermarket but for the requirement of a gross floor area
of more than thirty-five thousand (35,000) square feet.
All "Class A" licenses may only be issued within a specific subset of
license to eligible retail establishments. No applicant for a "Class A"
license may qualify as multiple subclassifications of "Class A"
license.
2. A license for the sale of malt liquor and light wine. "Light wine" is
defined in this Article as wine containing not in excess of fourteen
percent (14%) of alcohol by weight, made exclusively from grapes,
berries and other fruits and vegetables. This license is described as
a package malt liquor and light wine license, or a "Class B" license.
The fee for such license shall be twenty-two dollars fifty cents
($22.50).
Section 7.
Section 600.260 entitled “Licenses—Schedule of Types of
Licenses, Fees, Limitations on Number per Type”, is hereby amended by the adoption
of a new Section 600.260 § A. to read as follows:
Section 600.260 § A.
A. Licenses for the sale of liquor, at retail in the original package, not for
resale, direct to the consumer, not to be consumed on the premises, may be

e. "Class A-LS": A license for the sale of intoxicating liquor
and/or malt liquor by a Liquor Store as defined by Sections
400.060 and 600.010.
All “CLASS A” licenses may only be issued within a specific subset
of license to eligible retail establishments. No applicant for a
“CLASS A” license may qualify as multiple subclassifications of
“CLASS A” license. If at any time a licensee in Class A-CS, A-GN,
A-GC, or A-GS is determined, in the sole authority of the City, to
require a Class A-LS license due to the percentage of total sales
floor of the establishment being dedicated to the sale and
merchandising of liquor or alcoholic beverages, such licensee shall
immediately decrease their sales floor percentage to become
compliant with the appropriate licensing classification, or shall be
required to procure a Class A-LS license.
2. A license for the sale of malt liquor and light wine. "Light wine" is
defined in this Article as wine containing not in excess of fourteen

Section 10. Section 600.270 entitled “Full Package Liquor License – Wine Tasting Permit”, is hereby amended by the repeal of Section 600.270 § B. which reads as
follows, in its entirety;

B. Full Package Liquor License Requirements. No full package liquor license for
the sale of intoxicating liquor in the original package not to be consumed upon
the premises where sold ("Class A," subclasses A-C, A-F and A-S) shall be
issued except to a person engaged in and to be used in connection with the
operation of one (1) or more of the following businesses: a convenience store
or a supermarket as defined herein, including neighborhood markets; nor shall
any person engaged in the above named occupations be given a license for
original package goods sales as herein defined who does not have and
continuously keep in his/her store a stock of goods having a value according to
invoices of at least one thousand dollars($1,000.00), exclusive of fixtures and
intoxicating liquors. Any other package liquor license other than a full package
liquor license obtained by a licensee is not subject to the requirements in this
Section.
Section 11. Section 600.270 entitled “Full Package Liquor License – Wine Tasting Permit”, is hereby amended by the adoption of a new Section 600.270 § B. which
reads as follows;
Section 600.270 § B.
B. Full Package Liquor License Requirements. No full package liquor license
for the sale of intoxicating liquor in the original package not to be
consumed upon the premises where sold (all “CLASS A” licenses) shall be
issued except to a person engaged in and to be used in connection with the
operation of one (1) or more of the following businesses: A Liquor Store as
defined in Sections 400.060 and 600.010, a Convenience Store,
Neighborhood Grocery store, Community Grocery store, or a
Supermarket Grocery store, all as defined by Section 400.060; nor shall
any person engaged in the above named occupations be given a license for
original package goods sales as herein defined who does not have and
continuously keep in his/her store a stock of goods having a value according
to invoices of at least one thousand dollars ($1,000.00), exclusive of fixtures
and intoxicating liquors. Any other package liquor license other than a full
package liquor license obtained by a licensee is not subject to the
requirements in this Section.
Section 12. The portions of this Ordinance shall be severable. In the event that
any portion of this Ordinance is found by a court of competent jurisdiction to be invalid,
the remaining portions of this Ordinance are valid, unless the court finds the valid portions
of this Ordinance are so essential and inseparably connected with and dependent upon the
void portion that it cannot be presumed that the City Council would have enacted the valid
portions without the invalid ones, or unless the court finds that the valid portions standing
alone are incomplete and are incapable of being executed in accordance with the legislative
intent.

This ordinance shall be in full force and effect from and after its
passage and approval according to law.
