Citizen Agenda & Public Comment
An opportunity for citizens to address the Mayor and City Council on matters which are not
scheduled for consideration by the City Council on this agenda. In order to address the
Council, a Public Meeting Appearance Card must be completed and presented to the City
Secretary prior to the start of the Council meeting. The Texas Open Meeting Act prohibits
deliberation by the City Council of any subject which is not on the posted agenda, therefore
the Council will not be able to discuss or take any action on items brought up during the
citizen presentations. Citizen presentations will be limited to 5 minutes per person. Persons
wishing to provide comments on an item appearing on this agenda must complete a Public
Meeting Appearance Card and present it to the City Secretary prior to the item being called
on the agenda and wait until recognized by the Mayor or other presiding officer before
speaking on the item when that item is called for discussion.

Description:
Consider and Act on an Ordinance approving and adopting the budget for the Fiscal Year beginning October 1,
2026 and ending September 30, 2027.
Background Information:
City staff initiated the Fiscal Year (FY) 2026-2027 Budget process in April and had budget discussions with the City
Council throughout April, May, June, July, and August, including a special Council Retreat on April 15, 2026. The
discussions included the General Fund Budget, Special Revenue Funds, Community Development Corporation, and
Debt Service. The required public hearings on the Proposed 2026 Tax Rate and the Proposed FY 2026-2027 Budget
were held on September 3, 2026. The proposed budget has been available for review by residents on the City
website and at the City Secretary’s Office since August 5, 2026.

This budget is based on the property tax rate of $0.621953 per $100 of assessed valuation. The overall property tax
dollars generated by the proposed tax rate will increase by $432,239 or 8.54%, and of that amount, $40,953 is tax

revenue to be raised from the new property added to the tax roll this year.
The FY 2026-2027 Budget is presented for Council approval. The presented budget mirrors the expressed
consensus of Council from the budget discussions.

Financial Consideration:
The Annual Budget totals $23,201,169 for FY2026-2027.
Recommended Motions:
I move to approve Ordinance 2026-XX adopting the Fiscal Year 2026-2027 Annual Budget of the City of Lake Dallas
for the fiscal year beginning October 1, 2026 and ending September 30, 2027.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE DALLAS,
TEXAS, APPROVING AND ADOPTING THE BUDGET FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 2026, AND ENDING SEPTEMBER 30, 2027, AND
CATEGORY APPROPRIATIONS FOR EACH FUND AND DEPARTMENT,
PROJECT AND ACCOUNT; REPEALING CONFLICTING ORDINANCES;
PROVIDING
FOR
INTER-FUND
TRANSFERS;
PROVIDING
FOR
INVESTMENT OF CERTAIN FUNDS; PROVIDING FOR FISCAL AND
BUDGETARY POLICY GUIDELINES; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, as required by Section 7.02 of the City Charter, the City Manager has prepared and submitted
to the City Council a Budget Estimate of expenditures and revenues of all city departments, activities and
offices for the fiscal year beginning October 1, 2026, and ending September 30, 2027 (“the FY 2026-2027
Budget”), and
WHEREAS, the proposed FY 2026-2027 Budget has been filed with the City Secretary of the City of Lake
Dallas as required by law; and
WHEREAS, notice of a public hearing upon the proposed FY 2026-2027 Budget has been duly and legally
posted or published as required by law; and
WHEREAS, said public hearing was held on September 03, 2026, and whereon full and final consideration
was given the proposed FY 2026-2027 Budget; and
WHEREAS, the City Council of the City of Lake Dallas, Texas, has determined that the proposed FY
2026-2027 Budget will be sufficient to provide the needed services to Lake Dallas residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAKE
DALLAS, TEXAS, THAT:
SECTION 1. For the purpose of providing the funds necessary and proposed to be expended in the Budget
of the City of Lake Dallas for the fiscal year beginning October 1, 2026, and ending September 30, 2027,
the FY 2026-2027 Budget heretofore prepared by the City Manager and submitted to the City Council for
its consideration and approval, said Budget for the different funds of the City of Lake Dallas are hereby

The above said budget is hereby approved for a total of $23,2211,169 and the available resources and
revenues of the City of Lake Dallas for said fiscal year be and the same are hereby appropriated and set
aside for the maintenance and operation of the various funds of the Government of the City of Lake Dallas,
together with the various activities and improvements as set forth in said FY 2026-2027 Budget, and
expenditures under these appropriations shall not exceed the approved fund budget unless and until the
budget shall be amended by a Council-approved budget amendment, and further the expenditures shall be
in accordance with the uses and purposes of the respective funds, as provided for in said FY 2026-2027
Budget. The City Manager is hereby authorized to make expenditures under this FY 2026-2027 Budget,
without budget amendment, which exceed specific line items within each fund.
SECTION 2. The Budget for the fiscal year beginning October 1, 2026, and ending September 30, 2027,
approved herein, is on file in the City Secretary Office.
SECTION 3. The expenditures during the fiscal year beginning October 1, 2026, and ending September
30, 2027, shall be made in accordance with the FY 2026-2027 Budget approved by this ordinance unless
otherwise authorized by duly enacted ordinance of the City of Lake Dallas.
SECTION 4. The City Manager be and is hereby authorized in accordance with the provisions of Section
6.17 of the City Charter to approve expenditures up to the amount set forth in the financial policies adopted
by the City Council, with any expenditure over such amount requiring the approval of the City Council.

SECTION 5. The City Manager be and is hereby authorized to make interfund transfers in accordance
with budgeted appropriations during the fiscal year.
SECTION 6. The City Manager and/or the designated Investment Officer is authorized to invest idle funds,
whether operating funds or bond funds in accordance with the City’s Investment Policy as prescribed by
the Public Funds Investment Act.
SECTION 7. The administration and execution of said budget for fiscal year beginning October 1, 2026,
and ending September 30, 2027, shall be subject to certain fiscal and budgetary policies as adopted by the
City Council.
SECTION 8. This Ordinance shall take effect immediately from and after approval.

Background Information:
The proposed tax rate of $0.621953 per $100 of assessed valuation is used to fund the FY 2026-2027 Budget. This
proposed tax rate is an increase from the prior year by $0.062242 per $100 or 11.12%. Of the proposed tax rate,
$0.522219 will be applied to fund maintenance and operations in the General Fund and $0.099734 will be applied
to fund tax-supported debt (Interest and Sinking).
Financial Consideration:
The FY 2026 Proposed Tax Rate will generate approximately $432,239 or 8.54% more in property tax revenue than
FY 2025.

Recommended Motions:
Because the tax rate will be above the No-New Revenue Rate, state law requires the motion adopting the
ordinance read as follows:

AN ORDINANCE OF THE CITY OF LAKE DALLAS LEVYING THE AD
VALOREM TAXES FOR THE YEAR 2026 (FISCAL YEAR 2026-2027) AT
A RATE OF $0.621953 PER ONE HUNDRED DOLLARS ($100) ASSESSED
VALUATION ON ALL TAXABLE PROPERTY WITHIN THE
CORPORATE LIMITS OF THE CITY OF LAKE DALLAS AS OF
JANUARY 1, 2026, TO PROVIDE REVENUE FOR THE PAYMENT OF
CURRENT EXPENSES; PROVIDING FOR AN INTEREST AND SINKING
FUND FOR ALL OUTSTANDING DEBT OF THE CITY OF LAKE
DALLAS; APPROVING THE 2026 CITY APPRAISAL ROLLS;
PROVIDING FOR DUE AND DELINQUENT DATES TOGETHER WITH
PENALTIES AND INTEREST; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, assessments and renditions of all taxable property in the City of Lake Dallas have
been made for the year 2026 by the Denton Central Appraisal District; and
WHEREAS, the City Council has approved Ordinance No. 2026-__ adopting the City’s annual
budget for fiscal year 2026-2027; and
WHEREAS, the City Council has determined that a total tax rate of $0.621953 per $100.00
assessed valuation should be adopted in order to provide funds necessary for the operations and
maintenance obligations of the City and to fund required debt payments; and
WHEREAS, the City Council of the City of Lake Dallas, Texas, upon full consideration of the
matter, is of the opinion that the tax rate and ad valorem tax appraisal roll should be approved and
adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LAKE DALLAS, TEXAS, THAT:
SECTION 1. There be and is hereby levied for the tax year 2026 on all taxable property, real,
personal and mixed, situated within the corporate limits of the City of Lake Dallas, Texas, and not
exempt by the Constitution of the State and valid State laws, a tax of $0.621953 on each one
hundred dollars ($100) assessed valuation of taxable property, which shall be apportioned and
distributed as follows:
(a)

For the purpose of defraying the current expenditures of the municipal government
of the City of Lake Dallas, a tax of $0.522219 on each one hundred dollars ($100)
assessed value on all taxable property within the City.

(b)

For the purpose of creating a sinking fund to pay the interest and principal
maturities of all outstanding debt of the City of Lake Dallas, not otherwise provided

for, a tax of $0.099734 on each one hundred dollars ($100) assessed value of
taxable property within the City of Lake Dallas and shall be applied to the payment
of interest and maturities of all such outstanding debt.
SECTION 2. THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND
OPERATIONS THAN LAST YEAR’S TAX RATE. THE TAX RATE WILL
EFFECTIVELY BE RAISED BY 11.12% PERCENT AND WILL INCREASE TAXES
FOR MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY
APPROXIMATELY
$62.00.
SECTION 3. Assessments and renditions for the year 2026 on all taxable property and the Tax
Roll certified by the Chief Appraiser of the Denton Central Appraisal District are hereby approved
and incorporated herein by reference.
SECTION 4. All ad valorem taxes shall become due and payable on October 1, 2026, and all ad
valorem taxes for the year shall become delinquent if not paid prior to February 1, 2027. There
shall be no discount for payment of taxes prior to February 1, 2026. A delinquent tax shall incur
all penalty and interest authorized by law, to wit:
(a)

A penalty of six percent on the amount of the tax for the first calendar month it is
delinquent, plus one percent for each additional month or portion of a month the
tax remains unpaid prior to July 1 of the year in which it becomes delinquent.

(b)

Provided, however, a tax delinquent on July 1, 2027, incurs a total penalty of twelve
percent of the amount of delinquent tax without regard to the number of months the
tax has been delinquent. A delinquent tax shall also accrue interest at the rate of
one percent for each month or portion of a month the tax remains unpaid. Taxes for
the year 2026 and taxes for all future years that become delinquent on or after
February 1 but not later than May 1, that remain delinquent on July 1 of the year in
which they become delinquent, incur an additional penalty in the amount of twenty
percent (20%) of taxes, penalty, and interest due, pursuant to Texas Property Tax
Code Section 6.30 and 33.07, as amended. Taxes assessed against tangible personal
property for the year 2026 and for all future years that become delinquent on or
after February 1 of a year incur an additional penalty on the later of the date the
personal property taxes become subject to the delinquent tax attorney’s contract, or
60 days after the date the taxes become delinquent, such penalty to be in the amount
of twenty percent (20%) of taxes, penalty, and interest due, pursuant to Texas
Property Tax Code Section 33.11. Taxes for the year 2026 and taxes for all future
years that remain delinquent on or after June 1 under Texas Property Tax Code
Sections 26.07(f), 26.15(e), 31.03, 31.031, 31.032 or 31.04 incur an additional
penalty in the amount of twenty percent (20%) of taxes, penalty, and interest due,
pursuant to Texas Property Tax Code Section 6.30 and Section 33.08, as amended.

SECTION 5. The City shall have available all the rights and remedies provided by law for the
enforcement of the collection of taxes levied under this ordinance.

SECTION 6. All Ordinances of the City of Lake Dallas in conflict with the provisions of this
Ordinance be, and the same are hereby, repealed and all other provisions of the Ordinances of the
City of Lake Dallas not in conflict with the provisions of this Ordinance shall remain in full force
and effect.
SECTION 7. Should any sentence, paragraph, subdivision, clause, phrase, or section of this
Ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect
the validity of this Ordinance as a whole or any part or provision thereof other than the part thereof
decided to be unconstitutional, illegal, or invalid.
SECTION 8. This Ordinance shall take effect immediately from and after its passage, as the law
and City Charter in such cases provide.

Consider and Act on a Resolution Ratifying the Property Tax Increase Reflected in the Fiscal Year 2026-2027
Budget.
Background Information:
Chapter 102 of the Local Government Code (LGC) requires certain actions be taken when the adoption of a budget
will require raising more revenue from property taxes than in the previous year, even if that amount is only $1.00.
Specifically, Texas Local Government Code Sec. 102.007(c) states:
“Adoption of a budget that will require raising more revenue from property taxes than in the previous year
requires a separate vote of the governing body to ratify the property tax increase reflected in the budget. A vote
under this subsection is in addition to and separate from the vote to adopt the budget or a vote to set the tax rate
required by Chapter 26, Tax Code, or other law.”
The FY 2026-2027 Budget will require raising more revenue from the property taxes than in the previous year.
Because of this, the City Council is required to take a separate action to vote to ratify the adopted budget. The tax
rate of 0.621953 per $100 of valuation is an increase of 11.12%.
Financial Consideration:
The FY 2026 Proposed Tax Rate will generate approximately $432,239 or 8.54% more in property tax revenue than
FY 2025.
Recommended Motions:
I move that the property tax rate be increased by the adoption of a tax rate of 0.621953, as reflected in the
FY2026-2027 Budget as required by Local Government Code 102.007(c), which is effectively a 9.0 percent increase
by which the proposed tax rate exceeds the no-new-revenue tax rate.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
DALLAS, TEXAS, RATIFYING THE PROPERTY TAX INCREASE
REFLECTED IN THE 2026-2027 FISCAL YEAR BUDGET; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, Texas Local Government Code §102.007(c) requires that adoption of a budget that
raises more property tax revenue than was generated the previous year requires a record vote of
the City Council to ratify the property tax increase reflected in the budget in addition to and
separate from the record votes to approve the ordinance adopting the annual budget and the
ordinance adopting the tax rate for the current tax year; and
WHEREAS, the City Council has approved Ordinance No. 2026-__, adopting the 2026-2027
fiscal year budget, which will require raising more revenue from property taxes than last year’s
budget; and
WHEREAS, the City Council of the City of Lake Dallas, Texas, desires to ratify the property tax
increase reflected in Ordinance No. 2026-__ approving the 2026-2027 Fiscal Year Budget.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LAKE DALLAS, TEXAS, THAT:
SECTION 1. The property tax increase reflected in the 2026-2027 Fiscal Year Budget and
approved pursuant to Ordinance 2026-__ is hereby ratified.
SECTION 2. This Resolution shall take effect immediately from and after its passage.

Mayor Pro-Tem Vrba called the meeting to order at 6:00 p.m.
2. Invocation and Pledges of Allegiance
Pastor Josue Maldonado led the invocation and the pledges.
3. Presentation: None
4. Citizen Agenda & Public Comments:
Tessa Rife, of 748 Cedar Leaf Cir., thanked Codi for bringing in Erin as Library Director. Ms.
Rife stated that she was “blown away” at the amount of community events and programs that
have been hosted under Erin’s leadership that weren’t there prior to her appointment. She called
Erin’s hiring a “brilliant decision.”
Denise Andresen, of 614 Myers Dr., requested that item 1 of the Consent Agenda be pulled for
separate consideration. Ms. Andresen stated that under the city’s contract with Axon, the Police
Department now has nine Automated License Plate Readers (ALPRs) operating without a written
policy governing the use of the data that they collect. She stated that Chief Robb confirmed the
absence of such policy. Ms. Andresen stated that at the October 23 City Council meeting, whose
minutes were on tonight’s agenda for correction, an item concerning speed limits was pulled
from the Consent Agenda, but an agreement to apply for Flock camera grant funding was not.
She went on to say that “mass surveillance” means “liability” for the City, and that contract with

Flock would put the City “deeper” in the hole with an “already strapped” budget. Ms. Andresen
requested that an audit log be made available for citizens to access data gathered from Flock
cameras. She stated that even if the cameras are located in Hickory Creek, they still track Lake
Dallas residents, arguing that residents have a “right” to access that data.
Scott Griffin, of 312 Plantation Oak Ave, stated that while he normally attends City Council
meetings to hold City leadership accountable, he would like to also hold himself accountable. He
said that he has asked for Luke’s resignation “many times,” arguing that the town “looks like
crap.” Mr. Griffin said that he is going to run for City Council and find a City Manager who will
“decrease” the city budget and “wear more hats.” He also echoed the concerns expressed by Ms.
Andresen, claiming that Flock cameras violate both the protection against search and seizure,
and the right of a citizen to face their accuser. He stated that Flock cameras are “run by AI” and
should not be installed “anywhere near here.”
Lucy Phillips, of 2209 Wagon Wheel Trail (Corinth, TX), came to report on the Library’s
“spectacular” summer reading program. Ms. Phillips said that, over the course of the summer,
2,083 items were circulated, and 169 programs were held: 83 were for children, and 61 were for
teens and tweens, and they even had 25 adult activities taking place. Ms. Phillips stated that the
Library had a total of 3,789 participants in its summer program, and the kickoff event alone had
around 300 attendees. She also expressed gratitude for the “amazing” teen volunteers who
assisted with the programs this year, and for the “hours, hours, hours” of time and effort that
were put into these programs by the Library staff.

Council received a presentation from Finance Director Sarah Cochran regarding the City’s
estimated current financial standings, End-Of-Year projections, and an overview of the Budget
for the 2027 Fiscal Year.
Council reviewed and discussed the proposed Budget for FY 2026-27 and directed Staff to
make any necessary revisions. No action was taken.

Review and hold a discussion regarding Code of Ordinances Section 42-74 “Trash and
Rubbish.”
Council discussed current regulations concerning trash cart placement and storage under Sec.
42-74 of the Code of Ordinances. Council directed Staff to prepare an ordinance revising Sec.
42-74 to allow for storage of trash carts behind the property build line.

approving a negotiated settlement between the Atmos Cities Steering Committee (“ACSC”)
and Atmos Energy Corp., Mid-Tex Division regarding the company’s 2026 Rate Review
Mechanism filing; declaring existing rates to be unreasonable; adopting tariffs that reflect
rate adjustments consistent with the negotiated settlement; finding the rates to be set by the
attached settlement tariffs to be just and reasonable and in the public interest; approving
an attachment establishing a benchmark for pensions and retiree medical benefits;
requiring the company to reimburse ACSC’s reasonable ratemaking expenses; determining
that this ordinance was passed in accordance with the requirements of the Texas Open
Meetings Act; adopting a savings clause; declaring an effective date; and requiring delivery
of this ordinance to the company and the ACSC’s legal counsel.
Motion: to approve an Ordinance of the City Council of the City of Lake Dallas, Texas, approving

c. Consider and act on an ordinance ordering a special election to be held on
November 3, 2026 for the purpose of placing before the voters of the City of Lake
Dallas a proposition to vote for or against reauthorizing a local sales and use tax
to provide revenue for maintenance and repair of municipal streets; authorizing
a joint election with other Denton County political subdivisions; contracting for
election services with Denton County; and providing an effective date.
