PURPOSE:
Consider and act on appointing a member to The Aransas Pass Municipal Development
District Board of Directors for an unexpired term ending September 30, 2027.
BACKGROUND AND FINDINGS:
The Aransas Pass Municipal Development District is comprised of seven (7) directors
appointed by the City Council. Each of the directors shall be a resident of San Patricio
County and the City of Aransas Pass and shall serve without compensation. Each
member shall serve two terms.
The City Council vacated a board member position on July 20, 2026, and now seeks to
fill the unexpired term.

Sarah T. Hamid, Director of Strategic Campaigns for the Electronic Frontier Foundation,
presented information regarding automated license plate reader systems, including data
collection and retention, third-party access, privacy and civil-liberties concerns, cybersecurity,
legal exposure, effectiveness, and cost. Kaitlin Webb also provided an in-person presentation
addressing Flock Safety's public claims, data-security practices, and reported uses of ALPR
data.

Mayor Knight opened the public hearing at 6:45 p.m. Joseph Garza, Director of Development
Services, explained that the prior conditional use permit had expired; therefore, the request
was processed as a new application. He stated that the Planning and Zoning Commission
recommended approval through December 20, 2026.
Carol Salinas, Will Garner, Myron Schroeder, Jason Followell, and applicant Richard Titus
addressed Council. Comments concerned the existing ordinance prohibiting occupancy of a
recreational vehicle, property rights, the applicant's construction progress, the temporary
nature of the permit, and whether the ordinance should be reviewed.

Council Member Goyer made a motion to approve the ordinance granting a conditional use
permit through December 20, 2026, to allow a recreational vehicle to be placed at 624 S. Rife
Street and used as a temporary dwelling during construction of a single-family dwelling.
Seconded by Mayor Pro Tem Chacon. Council Members Chacon and Goyer voted Aye;
Council Members Camarillo-Smith and Martin voted Nay. Mayor Knight voted Aye to break
the tie, and the motion carried, 3-2.
Council requested that a future discussion item be placed on an agenda to review the City's
regulations concerning occupancy of recreational vehicles and utility connections. Following
the vote, Mr. Titus thanked Council and expressed concerns regarding comments made during
prior Planning and Zoning proceedings.
7. CITIZEN COMMENTS

Maria Halloran asked about the status of the Council-approved letter to Lowe's regarding the
Trap-Neuter-Return program.
Will Garner addressed Council regarding leadership, accountability, and community
involvement.
Jason Followell raised concerns regarding the status of an alleged assault report and the City's
recreational-vehicle occupancy regulations.

Sandra Garcia presented a preliminary preview of the Fiscal Year 2026-2027 budget by
videoconference. She reviewed anticipated revenues and expenditures, projected fund
balances, debt capacity, and potential future borrowing.
Ms. Garcia emphasized that the figures were preliminary and would be updated after certified
values and the Municipal Development District and Crime Control budgets were received.

8.III. REGULATIONS FOR GRAY WATER AND USED OIL DISPOSAL FOR

MOBILE FOOD TRUCKS.
Council Member Martin advised that gray-water and used-oil disposal requirements for mobile
food trucks are governed by state regulations and that additional research was ongoing.

the system's safeguards, audit controls, and the company's response to privacy and misuse
concerns. Will Garner, Leroy Theriot, Brandon Chin, and Jacob Miller spoke in favor of
terminating the agreement and removing the cameras.
City Attorney Ysassi reviewed the agreement's termination-for-convenience provision in
Section 6.2 and explained the City's potential camera-removal costs and written-notice
requirements.

Interim City Manager Hernandez and City Attorney Ysassi summarized the final contract
negotiations, including resolution of previously discussed additional costs, removal of interest
provisions, and acceptance of a 30-day payment term. Will Garner asked Council to ensure it
had reviewed the final contract before voting.
Council Member Goyer made a motion to approve the contract with Victory Building Team
for the Fire and Police Station Renovation and Additions Project. Seconded by Mayor Pro
Tem Chacon and the motion carried with the following vote: Council Members CamarilloSmith, Chacon, Martin and Goyer voting Aye.

PURPOSE:
This Memorandum of Understanding will establish a framework between the City of
Ingleside and the City of Aransas Pass to evaluate and discuss a potential future potable
water supply arrangement.
BACKGROUND AND FINDINGS:
The City of Ingleside is pursuing an additional potable water source, and Aransas Pass
has expressed interest in purchasing water if it becomes available.
The MOU is non-binding and allows both cities to exchange information, evaluate
feasibility, and negotiate possible future terms. Any final agreement would require
approval by both governing bodies.

MEMORANDUM OF UNDERSTANDING
REGARDING THE EVALUATION AND POTENTIAL DEVELOPMENT OF
A FUTURE POTABLE WATER SUPPLY ARRANGEMENT
This Memorandum of Understanding (“MOU”) is entered into by and between the City of
Ingleside, Texas, a home-rule municipality organized and existing under the laws of the State of
Texas (“Ingleside”), and the City of Aransas Pass, Texas, a home-rule municipality organized and
existing under the laws of the State of Texas (“Aransas Pass”), each referred to individually as a
“Party” and collectively as the “Parties.”
RECITALS
WHEREAS, Ingleside is pursuing the development of an additional potable water supply source,
currently contemplated through a proposed water supply project (the “Proposed Water Supply
Project”), to meet its current and future municipal water needs;
WHEREAS, if successfully completed, the Proposed Water Supply Project is anticipated to
provide Ingleside with an additional source of potable water that may be available to support a
future potable water supply arrangement with Aransas Pass, subject to Ingleside first meeting the
current and anticipated needs of its own utility customers;;
WHEREAS, Aransas Pass has expressed an interest in obtaining potable water from Ingleside
should additional potable water become available through the Proposed Water Supply Project;
WHEREAS, the Parties recognize that any future wholesale water supply or other potable water
supply arrangement with Aransas Pass will require additional engineering, financial, operational,
regulatory, and legal evaluation, and may require the construction of transmission facilities and the
negotiation of mutually acceptable contractual terms;
WHEREAS, the Parties desire to establish a framework for exchanging information and
negotiating in good faith regarding a potential future wholesale water supply agreement or other
potable water supply arrangement to facilitate the provision of potable water to Aransas Pass while
recognizing that any such agreement remains subject to further evaluation and approval; and
WHEREAS, the Parties acknowledge that Ingleside must first ensure that any future water supply
adequately serves the current and anticipated needs of its own utility customers before committing
water for wholesale delivery.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties
agree as follows:
ARTICLE 1
1.1 Purpose. The purpose of this MOU is to establish a framework for cooperation and goodfaith negotiations regarding potential development of a future potable water supply arrangement
between Ingleside and Aransas Pass if additional potable water becomes available through
Ingleside’s Proposed Water Supply Project.

1.2 No Commitment. This MOU is intended solely to facilitate future discussions and planning.
Except as expressly provided herein, nothing contained in this MOU shall obligate either Party to
enter into a wholesale water supply agreement or other potable water supply arrangement to
facilitate the provision of potable water to Aransas Pass.
ARTICLE 2
2.1 Conditions Precedent. The Parties acknowledge that any future wholesale water supply
agreement shall be contingent upon, among other things:
a) Ingleside successfully securing an additional potable water supply through the Proposed
Water Supply Project;
b) Ingleside determining, in its sole discretion, that sufficient potable water is available to
satisfy the current and anticipated needs of its own utility customers while making water
available for wholesale sale;
c) Aransas Pass determining that it has the legal and contractual authority to purchase potable
water from Ingleside, including identifying and, where appropriate, addressing any existing
contractual obligations, regulatory requirements, or other legal restrictions that may affect
such purchase;
d) completion of any engineering, operational, and feasibility evaluations necessary to
determine the viability of delivering potable water to Aransas Pass;
e) identification of mutually acceptable delivery infrastructure and allocation of responsibility
for the design, permitting, construction, ownership, operation, and maintenance of such
infrastructure;
f) receipt of all governmental, regulatory, and third-party approvals, permits, consents, or
authorizations required to implement the proposed wholesale water supply arrangement;
g) agreement upon mutually acceptable commercial, operational, and legal terms;
h) approval of the wholesale water supply agreement or other potable water supply
arrangement by the governing bodies of both municipalities; and
i) the Parties determining that the proposed wholesale water supply arrangement is in their
respective best interests.
ARTICLE 3
3.1 Negotiations. Following the Parties' evaluation of the matters identified in Article 2, and if the
Parties determine that the proposed wholesale water supply arrangement is feasible and in their
respective best interests, the Parties intend to negotiate in good faith the terms and conditions of a
mutually acceptable wholesale water supply agreement or other potable water supply arrangement
to facilitate the provision of potable water to Aransas Pass.
ARTICLE 4
4.1 Exchange of Information and Evaluation. The Parties agree to cooperate in exchanging
reasonably requested engineering, operational, financial, legal, contractual, regulatory, and
planning information necessary to evaluate the feasibility of the proposed wholesale water supply
arrangement. Such cooperation may include evaluating existing water supply agreements,
contractual obligations, available water supplies, projected water demands, regulatory

requirements, infrastructure needs, financing considerations, and any approvals, waivers,
amendments, consents, or other actions that may be necessary to facilitate a potential wholesale
water supply agreement or other potable water supply arrangement.
Nothing in this Article shall require either Party to disclose information that is confidential,
proprietary, privileged, or exempt from disclosure under applicable law.
ARTICLE 5
5.1 No Commitment. Nothing contained in this MOU shall:
a) reserve, dedicate, or allocate any quantity of water to Aransas Pass;
b) grant Aransas Pass any priority right to purchase water;
c) obligate Ingleside to construct facilities;
d) obligate Ingleside to reserve capacity for Aransas Pass;
e) obligate Ingleside to sell water; or
f) obligate Aransas Pass to purchase water.
The Parties acknowledge that any commitment regarding the sale or purchase of water shall be set
forth only in a wholesale water supply agreement or other potable water supply arrangement
approved by the governing bodies of both Parties. Nothing in this MOU shall be construed as
requiring Ingleside to dedicate, reserve, or make available water that Ingleside determines is
necessary to meet the current or anticipated needs of its own utility customers.
5.2 Existing Water Supply Obligations. The Parties acknowledge that Aransas Pass’ ability to
purchase wholesale potable water from Ingleside and Ingleside’s ability to supply potable water to
Aransas Pass may be subject to existing contractual obligations, regulatory requirements, bond
covenants, permits, or other legal restrictions, including existing agreements governing the
purchase or supply of water. Each Party agrees to evaluate whether any such obligations or
restrictions would affect its ability to enter into a wholesale water supply agreement or other
potable water supply arrangement with the other Party and, if appropriate, to pursue any approvals,
consents, waivers, amendments, or other actions reasonably necessary to facilitate the Parties'
consideration of a wholesale water supply agreement or other potable water supply arrangement.
5.3 No Representation. Nothing in this MOU shall be construed as a representation or warranty
by either Party that it presently possesses all legal, contractual, or regulatory authority necessary
to enter into or perform a future agreement or other potable water supply arrangement
contemplated by this MOU. Nothing herein shall require either Party to breach any existing
contractual or legal obligation.
ARTICLE 6
6.1 Term. This MOU shall remain in effect for three (3) years following the Effective Date unless
earlier terminated in accordance with this Article. The Parties may extend this MOU by mutual
written agreement approved by the governing bodies of both Parties.
6.2 Termination. Either Party may terminate this MOU upon thirty (30) days' prior written notice
to the other Party. This MOU shall also automatically terminate, without further action by either

Party, if Ingleside determines that the Proposed Water Supply Project will not proceed or is
otherwise abandoned.
ARTICLE 7
7.1 Incorporation of Recitals. The foregoing recitals are incorporated into this MOU and made a
part hereof for all purposes.
7.2 Cooperation. The Parties agree to cooperate in good faith throughout the evaluation of the
proposed project.
7.3 Municipal Authority. Nothing in this MOU shall be construed to limit or impair either Party's
authority to exercise its governmental, legislative, regulatory, or proprietary powers or to make
decisions regarding the operation, management, or expansion of its municipal water utility system
in accordance with applicable law.
7.4 Governing Body Approval. Any agreement shall remain subject to further negotiations,
approval by the governing body of each municipality, and execution by duly authorized
representatives.
7.5 Non-Binding. Except as otherwise expressly provided herein, this MOU is intended solely to
establish a framework for evaluating and discussing a potential wholesale water supply
arrangement between the Parties and does not create any binding obligation to enter into a
wholesale water supply agreement or other potable water supply arrangement.
7.6 No Obligation to Proceed. Each Party reserves the right, in its sole discretion, to discontinue
discussions or negotiations regarding the proposed wholesale water supply arrangement at any
time. No Party shall have any liability to the other arising from its determination not to proceed
with the proposed wholesale water supply arrangement or from the Parties' inability to negotiate
or reach agreement on the terms and conditions of a wholesale water supply agreement or other
potable water supply arrangement.
7.7 Costs. Each Party shall bear its own costs and expenses incurred in connection with this MOU
and the negotiation of any agreement.
7.8 Assignment. Neither Party may assign this MOU without the prior written consent of the other
Party.
7.9 Governmental Immunity. Nothing in this MOU is intended to, nor shall it be construed to,
waive or limit either Party’s governmental immunity, sovereign immunity, official immunity,
statutory limitations on liability, or any other rights, remedies, defenses, or protections available
under the Constitution and laws of the State of Texas.
7.10 Governing Law and Venue. This MOU shall be governed by and construed in accordance
with the laws of the State of Texas. The Parties agree that exclusive venue for any action arising
out of or relating to this MOU shall be in the state courts of competent jurisdiction located in San
Patricio County, Texas.

7.11 Entire Agreement. This MOU constitutes the entire understanding between the Parties with
respect to the subject matter hereof and supersedes all prior and contemporaneous negotiations,
discussions, understandings, and communications, whether oral or written, relating to such subject
matter.
7.12 Amendments. This MOU may be amended only by written instrument approved by the
governing bodies of both Parties and executed by their duly authorized representatives.
7.13 Counterparts; Electronic Signatures. This MOU may be executed in counterparts, each of
which shall constitute an original and all of which together shall constitute one instrument.
Electronic signatures shall be deemed original signatures.
7.14 No Reliance. Each Party acknowledges that it is entering into this MOU solely for the purpose
of facilitating discussions regarding a potential wholesale water supply arrangement. Neither Party
shall be entitled to rely upon this MOU as creating any right to receive or purchase water or as
guaranteeing that a wholesale water supply agreement or other potable water supply arrangement
will be negotiated or executed.
7.15 Notices. Any notice, request, demand, consent, approval, or other communication required or
permitted under this MOU shall be in writing and shall be deemed given when delivered
personally, when sent by nationally recognized overnight courier, when deposited in the United
States mail by certified mail, return receipt requested, postage prepaid, or when transmitted by
electronic mail, provided that no notice of failed transmission is received. Notices shall be sent to
the following representatives, or to such other representative or address as a Party may designate
by written notice:

Del Mar College has proposed an agreement with the City of Aransas Pass that would
allow the Del Mar College Small Business Development Center to utilize designated
office and meeting space at the Aransas Pass Civic Center. The purpose of the
arrangement is to provide local entrepreneurs, prospective business owners, and
existing businesses with access to counseling, educational resources, technical
assistance, and other small-business development services.

This Memorandum of Understanding ("Agreement") is entered into by and between the
City of Aransas Pass, Texas ("City") and the Del Mar College District, acting by and
through its Small Business Development Center ("SBDC"), collectively referred to as the
"Parties."
RECITALS
The Parties desire to promote economic development by providing confidential small
business counseling and related services to the public through SBDC at the City's Civic
Center. The Parties therefore agree as follows.
1. Purpose
The City agrees to make office space available for SBDC to provide business counseling,
educational programs, seminars, webinars, and related economic development services.
2. Office Space
The City shall designate office space within the Civic Center. The City may relocate
SBDC to comparable space upon reasonable notice whenever operational needs require.
3. Permitted Use
The office may be used for confidential client appointments, virtual meetings,
administrative work, training preparation, temporary storage of business materials, and
related SBDC activities. No unrelated commercial activity is permitted.
4. Scheduling
The Parties shall establish mutually agreed annual or quarterly schedules for office use.
Either Party may request reasonable modifications to accommodate operational needs.
5. Equipment
Unless otherwise agreed, SBDC shall provide its own furniture, computers, printers,
telecommunications equipment, files, and supplies. SBDC is responsible for securing,
maintaining, and insuring its personal property.

6. City Property
SBDC shall exercise reasonable care and shall reimburse the City for damage to Cityowned furniture, fixtures, equipment, or improvements caused by the negligence or
intentional misconduct of SBDC employees, agents, contractors, or invitees, excluding
ordinary wear and tear.
7. Signage
Temporary brochures and informational materials may be displayed inside the assigned
office. Permanent signage, banners, wall displays, or exterior signs require prior written
approval of the City.
8. Access and Security
The City shall provide reasonable access during scheduled occupancy. Each Party is
responsible for safeguarding its confidential information and property.
9. Liability
Each Party shall be responsible only for claims, damages, losses, and liabilities arising
from its own negligent acts, omissions, or wrongful conduct. Nothing in this Agreement
constitutes an indemnity beyond that permitted by Texas law or waives governmental
immunity, official immunity, or any other defense.
10. Insurance
Each Party shall maintain insurance or self-insurance as required by applicable law or
internal policy.
11. Independent Entities
Nothing in this Agreement creates a partnership, joint venture, agency relationship, or
employment relationship between the Parties.
12. Records and Confidentiality
Each Party shall comply with applicable federal and Texas law regarding confidential
information and public records, including the Texas Public Information Act where
applicable.
13. Term and Termination
This Agreement begins on the Effective Date and continues for one (1) year. It may be
renewed annually by written agreement. Either Party may terminate this Agreement
without cause upon thirty (30) days' written notice. Immediate termination is permitted
for material breach or unsafe conditions if not timely cured.

14. Amendment
This Agreement may be amended only by a written instrument executed by both Parties.
15. Notices
Official notices shall be delivered to the representatives designated by each Party.
16. Force Majeure
Neither Party shall be liable for delays caused by events beyond its reasonable control.
17. Governing Law and Venue
Texas law governs this Agreement. Exclusive venue lies in San Patricio County, Texas.
18. Entire Agreement
This Agreement constitutes the entire understanding between the Parties concerning the
subject matter and supersedes prior oral or written understandings.

PURPOSE:
CONSIDER AND ACT ON AMENDING AN APPROVAL GRANTED TO THE FIRE
CHIEF TO PURCHASE LIFE SAFETY EQUIPMENT.
BACKGROUND AND FINDINGS:
On July 6, 2026, the Fire Chief presented budget requests to City Council for Fiscal
Year 2026-2027. Among those budget requests were thermal imagers.
In the course of the presentation to City Council, a specific brand was named for the
thermal imagers during the presentation and in the Agenda Item, and approval was
granted by Council in the amount not to exceed $ 21,248 for two thermal imagers.
However, since that Council Meeting, the Fire Chief has been presented with the
opportunity to purchase another brand of thermal imagers with greater capabilities and
more affordability from another vendor at a reduced expense from the originally quoted
vendor.
Because the Agenda Item and presentation specifically named a brand of thermal
imagers to be purchased, an amendment must be requested to authorize the Fire Chief
to select the brand and vendor for thermal imagers.

RECOMMENDATION
City Staff recommends City Council amend the July 6th agenda item for the approved
purchase of thermal imagers and authorize the Fire Chief to consider, select, and
purchase thermal imagers in an amount not to exceed the previously approved amount
of $21, 248.

$21,248 expended from the 2024 Fire Station Certificate of Obligation Bond.

BACKGROUND AND FINDINGS: On May 4, 2026, the City Council approved the issuance

of a Request for Qualifications (RFQ) for Engineering and Design Services for the Public
Works Office Additions Project.
The deadline for receiving proposals was June 18, 2026, and a total of eleven (11)
proposals were received from the following:

All proposals were submitted timely. An evaluation committee reviewed and scored the
qualifications on July 16, 2026. International Consulting Engineers (ICE) received the
highest total score of 570 points. Staff recommends awarding the RFQ to ICE and
authorizing City staff to negotiate a contract for engineering and design services.

for Head Start at Kieberger Elementary.
This modification would keep the Alley, located between Saunders Street and Eighth
Street immediately southeast of Kieberger School, running parallel with Saunders Street
as a one-way street, but would allow north-bound traffic rather than south-bound traffic
during the school year from 7:00 a.m. to 4:30 p.m.
These plans have been reviewed and approved by Aransas Pass Public Works.

WHEREAS, the City Council of the City of Aransas Pass finds that regulating the
direction of traffic on public streets and alleys is necessary to protect the public health,
safety, and welfare;
WHEREAS, the Aransas Pass Independent School District has modified its student dropoff and pick-up traffic circulation at Kieberger School and has requested that the City
revise the designated direction of travel for the adjacent alley in order to improve traffic
flow and enhance student safety;
WHEREAS, the City Council finds that amending Section 28-24(b)(1) of the Code of
Ordinances to reverse the one-way direction of travel for the specified alley during
designated school hours is in the best interest of the public health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ARANSAS PASS, TEXAS:
SECTION 1. Amendment.
Section 28-24(b)(1), Article II, Chapter 28 is amended to read:
(1) Alley, located between Saunders Street and Eighth Street immediately southeast of
Kieberger School running parallel with Saunders Street during the school year from 7:00
a.m. to 4:30 p.m., only ..... North bound traffic flow permitted.
SECTION 2. Unchanged Provisions.
Except as expressly amended herein, all other provisions of Section 28-24 and Chapter 28
remain in full force and effect.
SECTION 3. Traffic Control Devices.

The appropriate City officials are authorized and directed to install, remove, replace, or
modify all traffic control signs and devices necessary to implement this ordinance. The
amended one-way designation shall not become effective until the required signs have
been installed.
SECTION 4. Penalty.
Any person who violates any provision of this ordinance or the section of the Code of
Ordinances amended hereby shall be deemed guilty of a misdemeanor and, upon
conviction, shall be punished by a fine in accordance with the general penalty provisions
of the Code of Ordinances of the City of Aransas Pass, Texas. Each day that a violation
continues shall constitute a separate offense. Nothing herein precludes the City from
seeking any other remedy available at law or in equity.
SECTION 5. Repealer.
All ordinances or parts of ordinances in conflict are repealed to the extent of the conflict.
SECTION 6. Severability.
If any provision is held invalid, the remaining provisions remain in full force and effect.
SECTION 7. Codification.
It is the intent of the City Council that this ordinance be codified within the City's Code
of Ordinances.
SECTION 8. Publication.
This ordinance shall be published as required by law.
SECTION 9. Effective Date.
This ordinance shall become effective upon its passage and publication as required by
law; however, the one-way traffic regulation established herein shall not become
enforceable until the appropriate traffic control signs have been installed and are being
maintained in accordance with Section 28-24(a) of the Code of Ordinances.

The Aransas Pass Police Department oversees the wrecker services that are permitted
through the city, which operate on a rotational basis for all tows requested by the City of

The amendments are intended to update and clarify permitting, operational, equipment,
vehicle storage facility, rotation, and enforcement requirements using the language
contained in the proposed amendments provided to the City Council.
If approved, it is requested that the ordinance take effect on October 1st 2026.

WHEREAS
The City Council finds that adoption of the 2024 International Codes promotes the public
health, safety, and welfare by providing updated minimum standards for construction,
maintenance, and occupancy of buildings;
The City previously adopted the 2018 International Codes by Ordinance No. 2019-4251
together with various local amendments;
The City Council desires to replace the references to the 2018 International Codes with
the corresponding 2024 International Codes while preserving all local amendments
contained in Ordinance No. 2019-4251 unless expressly modified by this Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ARANSAS PASS, TEXAS:
Section 1. Repeal and Replacement
All references in Ordinance No. 2019-4251 to the 2018 editions of the International
Codes are repealed and replaced with the corresponding 2024 editions listed herein.
Section 2. Adoption of 2024 ICC Codes
The following codes are adopted by reference as though fully set forth herein:

• International Residential Code, 2024 Edition
• International Existing Building Code, 2024 Edition
• International Plumbing Code, 2024 Edition
• International Mechanical Code, 2024 Edition

Section 3. Electrical Code
The 2017 Edition of the National Electrical Code (NFPA 70), as previously adopted by
the City and as locally amended, shall remain in full force and effect until amended or
replaced by separate ordinance.
Section 4. Local Amendments Preserved
Except where expressly modified by this Ordinance, every local amendment,
administrative provision, permit exemption, fee provision, windstorm requirement,
accessibility requirement, Board of Standards and Appeals provision, and other local
amendment adopted by Ordinance No. 2019-4251 shall remain in full force and shall
apply to the corresponding 2024 International Code.
Section 5. References
References in the Code of Ordinances to the 2018 ICC Codes shall be construed to refer
to the corresponding 2024 ICC Codes whenever applicable. Any local amendment
referencing a renumbered section shall be construed to refer to the corresponding section
in the 2024 edition whenever possible.
Section 6. Conflicts
All ordinances or parts of ordinances in conflict with this Ordinance are repealed only to
the extent of the conflict.
Section 7. Savings
No permit, enforcement action, prosecution, right, obligation, or liability existing before
the effective date is affected by this Ordinance.
Section 8. Severability
If any provision of this Ordinance is held invalid, the remaining provisions shall remain
in effect.
Section 9. Publication
The City Secretary shall publish this Ordinance as required by law.
Section 10. Effective Date
This Ordinance shall become effective upon the date established by the City Council
and after publication as required by law.
Section 11. Transition of Pending Applications
Permit applications submitted before the effective date of this Ordinance may be
reviewed under the code in effect at the time of application, unless the applicant elects to
comply with the newly adopted code or unless otherwise required by law.
