The East Brandywine Township Board of Supervisors meeting of Thursday, April 16, 2026 was called to order
at 6:30 PM at the East Brandywine Township Municipal Complex with a Pledge of Allegiance.
Opening of Meeting
Chairman Taraschi opened the meeting by announcing that this meeting is being recorded.
Public Comment on Agenda Items
Chairman Taraschi requested holding comments regarding agenda number 6. A. until we get to that section of

Approval of Minutes
Vice-Chairman Scribner made a motion to approve the meeting minutes from the April 2, 2026, AM session.
Supervisor Keller seconded the motion. With all members voting Aye, motion passed 3-0.

The Chester County Planning Commission provided a review letter dated November 21, 2025.
Chapter 399 of the Code of East Brandywine Township is organized by zoning district, with each district
containing its own statement of intent, use regulations, and area and bulk standards. Within each district’s use
regulations, uses are further categorized as permitted by right, conditional use, or special exception. While this
structure clearly identifies what uses are permitted within a given district, it has historically made it more
difficult to answer the inverse question—in which districts is a particular use permitted? Additionally, the code
had allowed certain uses to be defined differently across districts, even though the Township maintains a
standard definitions section in §300-17.
Public Notice Text: The Ordinance amends Chapter 300, titled Land Use, Section 300-17, titled Definitions, by
adding, deleting, and amending certain definitions primarily applicable to uses permitted in the Township. The
Ordinance also amends Chapter 399, titled “Zoning”, to conform Chapter 399 to the Definitions as amended by
the proposed Ordinance, to remove certain uses from and add certain uses to the various Zoning Districts in the
Township, and to amend supplemental regulations. The provisions of the Ordinance are severable, conflicting
ordinances or parts of ordinances are repealed, and the Ordinance will be effective immediately upon enactment.
At this time, I respectfully request the Board adopt Ordinance 2 of 2026.
Ordinance 3 of 2026: Cable Franchise -- Read at Agenda Item IX(B)
Included in your packet this evening is a proposed Ordinance 3 of 2026 authorizing execution of a new cable
franchise agreement with Verizon. The ordinance was advertised in the Daily Local News on Thursday, April 9.
The agreement is the result of negotiations conducted by the Cohen Law Group on behalf of the Chester County
Manager’s Consortium. Twenty-seven municipalities shared the expense of this project, representing a
considerable savings to East Brandywine.
The agreement maintains the standard 5% franchise fee, strengthens audit and accountability provisions, and
updates customer service and enforcement standards. The term of the agreement is five (5) years. An Executive
Summary of the agreement prepared by the Cohen Law Group is also included in your packet.
For reference, the Township’s only other franchise agreement (with Comcast) was approved in 2012 with a 15year term and includes an automatic 5-year renewal, extending it through 2032.
At this time, I respectfully request the Board adopt Ordinance 3 of 2026.

America 250 Student Art Competition
The East Brandywine Township Historical Commission has launched the America 250 Student Art Competition
in recognition of the upcoming 250th anniversary of the United States. This initiative invites students to create
original artwork centered on the theme: “What Does America Mean to You?”
The competition is open to students in the Downingtown Area School District as well as students who reside
within East Brandywine Township.
Students may submit their artwork by dropping it off at the Township Building, submitting through the Google
Form available on the flyer and Township website, or by emailing their submission to
[email protected]
2026 “Fore the Parks” Golf Outing
East Brandywine Parks & Recreation is having their annual “Fore the Parks” golf outing fundraiser on May 20 th
at the Honey Brook Golf Club. 8:00AM is the shotgun start and 12:00PM will be lunch. Registration is $150 per
person and includes greens fee, driving range, lunch, goodie bag, snacks/beverages, and prizes. All donations
will continue to support East Brandywine Parks.

Earth Day at Bondsville Mill Park
On April 22nd, from 10:00AM to 12:30PM, come celebrate Earth Day at Bondsville Mill Park by discovering the
power of mindful engagement with nature through Forest Bathing, which is a guided, sensory-based
experience that encourages participants to slow down, connect with the natural environment, and promote
overall well-being.
Chairman Taraschi presented the building inspectors report to the Board.
Roadmaster Claas stated he did not have a report for this meeting.
Deputy Chief Yankanich presented his report to the Board. A copy verbatim et literatim is included in these

1. Officers continued to participate in several community engagement events throughout March and
early April, including the Township Easter Egg Hunt, the EBYA Opening Day ceremonies, The Learning
Experience Easter event, and other local activities. We are grateful to the community organizations and
residents who invited us to be part of these gatherings and appreciate the opportunity to engage with
families in such positive and enjoyable settings.
2. Sgt. James Ferraro will be retiring on Sunday, April 19th, after more than 25 years of dedicated service
to the East Brandywine Township Police Department. Sgt. Ferraro has been a steady, dependable
presence within the department, known for his professionalism, strong work ethic, and unwavering
commitment to the community. He has served as a mentor to younger officers, a reliable leader on
every shift, and a model of consistency throughout his career. His retirement marks the conclusion of a
distinguished tenure, and we extend our sincere appreciation for his service and contributions to the
department. We wish him the very best as he begins this next chapter.

3. All phases of the hiring process for candidate Joseph Spina have been successfully completed, including
background investigation, psychological evaluation, and medical/physical testing. We anticipate
formally swearing him in during the Board of Supervisors’ morning work session in May, which will
allow him to begin the onboarding and field training process shortly thereafter.
4. Officer Cameron Whiteman continues to progress through the Field Training Program with positive
development noted across each phase. He is demonstrating strong foundational skills, sound
decision-making, and steady improvement as he transitions toward more independent patrol
responsibilities. His performance remains on track with the projected training timeline.
5. The Township experienced several periods of heavy rain and high winds during March and early April.
Officers responded to roadway hazards, downed trees, and traffic disruptions. We appreciate the Road
Crew’s quick response in clearing debris and restoring safe travel conditions.

Training Completed:
During March and early April, the department continued its strong commitment to professional development
and advanced training. Sergeants Lemus and Harnish successfully completed the New Jersey State Police
Association of Chiefs of Police Leadership and Command Academy, an intensive 13-week program recognized
for its demanding curriculum and long-term value to both the participant and their agency. Their completion
of this course reflects exceptional dedication and leadership growth.
Officer Kelso completed Standardized Field Sobriety Test Instructor certification and also attended a DUI case
law course to further strengthen his instructional and enforcement capabilities.
Officer Hayes participated in a Chester County Leadership Development program, supporting his continued
growth within the department.
Chief Yankanich attended the annual accreditation conference and associated training sessions to ensure
continued compliance with statewide standards and best practices.

Sergeant Harnish and Detective Flood continued their participation in the County Investigation School, a
year-long program that meets monthly and enhances investigative proficiency across a broad range of
disciplines.
Old Business
Brandywine Walk: Rear Deck & Steps on Detached Homes Follow up Discussion
Supervisor Keller initiated discussion pertaining to detached homes in the Brandywine Walk Community. Any
questions regarding attached homes can be addressed at a later date.
Supervisor Keller explained to the audience that in the Townships zoning code there are different districts with
different setbacks per district. In the AQRC (Brandywine Walk Community) there is a 25-foot rear yard setback.
Ms. Keller also explained that decks and steps must be setback at least 15 feet from any side or rear lot line.
Supervisor Keller pointed out 2 plan notes specific to Brandywine Walk. The first being, #31, no construction of
buildings and decks shall be permitted outside of the above referenced building and deck envelope. The second
being, #32, per resolution 21 of 2022, application for variance or other relief to the township zoning hearing
board to exceed the allotted impervious coverage limitation permit construction outside the building and deck
envelope shall be prohibited.
Supervisor Keller believes there is a compromise proposal for this issue. She suggested placing plan note #31
into section 399-75 of the Townships zoning code and striking plan notes #31 & #32 from the plan document.
Residents could then seek individual relief from the zoning hearing board. The intent behind this proposal is to
preserve the density requirements of the development while allowing the residents to seek individual relief
from the zoning hearing board.
Chairman Taraschi provided the attending residents of Brandywine Walk with a summary of this project. He
began with the sale of this property in 2016-17 by DASD to the Developer. The by-right building would yield
248 units after all the land development requirements are laid out. The DASD and the developer requested an
ARQC overlay zoning. The developer and the developer’s attorney presented drafts of their zoning proposal to
the Townships Planning Commission (PC) stating that zoning allowed for a higher number of housing units.
Chairman Taraschi added within their rights, the 295-unit plan was designed. At the July 2022 Planning
Commission meeting, representatives of the developer appeared before the PC to review their plan. The
Township Engineer and Solicitor voiced concerns regarding the density. The developer’s engineer and attorney
confirmed that nothing would be built outside of the building envelope if it was all inclusive. Mr. Taraschi stated
the developer was not asked to design it that way. It was confirmed to the PC there would be no construction
outside the building envelope. He also added this ensured the support of the PC. The Township Engineer and
Solicitor requested that this be memorialized on the plans to ensure awareness during the construction and
sales process. Mr. Taraschi reported this occurred 4 months prior to the plan receiving final approval. The
developer agreed to these notes. He added the developer was the benefactor of these notes. Also stating, this
resulted in final plan approval without going back to the drawing board.

Chairman Taraschi stated it appears that through the sales process with NVR, some buyers may not have been
given the proper information. Resulting in choosing the larger home that fills most of the building envelope
which did not allow for a larger deck or stairs. As buyers question the builder, that builder and attorney then
ask the Township to remove the notes without offering a solution to the concerns that made them necessary in
the first place. Requesting removal of these notes essentially nullifies the approvals of the plan. He also stated
the plan would not have been approved by the PC otherwise for these notes.
Chairman Taraschi stated Resolution 21 of 2022 is law under this project. This request presents an unfavorable
position to the builder. Do we stop work until this is resolved from a planning standpoint? Does the plan change
to less units to address the initial concern of the two items in question? It was decided to take no action at this
time. In May of 2025, the Supervisors were contacted by Lou Girolami to discuss this situation. Mr. Taraschi
met with Lou and another gentleman to discuss. He recalls informing them about the complexity of this lengthy
process. Mr. Taraschi considered possible solutions over time but ran into roadblocks.
Chairman Taraschi stated at the 2025 November PM meeting the Board was presented with a petition however,
there was enough opposition considered to not make any changes to this plan. He wants to listen to all opinions,
adding, some of what he heard was that there should be a fair process to allow for special circumstances to get
steps off the back of their house into the area outside of the building envelope. Mr. Taraschi stated there was
a resident that spoke at the November meeting who was against removing the notes from the plan, however,
he felt that there should be some type of special circumstance if needed. Mr. Taraschi added this lends itself to
the zoning hearing process.
Chairman Taraschi stated the proposal that has been presented this evening is to allow zoning relief. He added
this is going to take time, and the developer is going to have to agree to the removal of these notes and the
modification of the plan. He also added there are 31 items on this resolution, so it may need to go back to the
Planning Commission.
Chairman Taraschi also addressed the grills under the porch issue. He had spoken to Jeff Cantlin, the Township
Building/Codes inspector, who explained that there are no laws governing grills in the international building
code. However, common sense should prevail. He added, the National Firefighters Association does not lobby
for regulations to date. Mr. Taraschi stated Mr. Cantlin is our Codes Inspector and is at the Township daily, so
if anyone has a question, please reach out to him.
Vice- Chairman Scribner pointed out there will be a cost associated with this change and wondered who is
responsible to pay. Do the Homeowners of Brandywine Walk pay, or do the taxpayers of the Township pay? Mr.
Scribner voiced concern as this was a battle that the Township had with Applecross years ago.
Chairman Taraschi opened the floor for questions from the audience.
Mr. Rick Gantz, 1139 Daffodil Place, inquired if a hardship is the basis for getting relief from the zoning hearing
board. He asked for clarity on what a hardship is. Vice-Chairman Scribner stated hardship is up to you and your
attorney to decide. Adding, there will be fees involved on the resident’s end. Mr. Scribner stated this is nothing

personal, but there are certain guidelines the Township needs to follow and administer. Mr. Scribner deferred
to Mr. Oeste on costs associated with the zoning hearing board.
Mr. Oeste briefly explained the variance process stating the zoning hearing board is a Township hearing board,
adding it’s an independent body from the Board of Supervisors, a quasi-Judicial body. He added they have their
own attorney. Mr. Oeste stated a variance has legal requirements that come from the Pennsylvania Municipal
Planning Code (MPC). One of those requirements is that the applicant must prove a hardship, which is not easy.
He stated, it can be a heavy burden to be entitled to a variance with that determination falling under the zoning
hearing board and not the Board of Supervisors. Mr. Oeste also stated the property must suffer from a hardship;
adding the Township does not get reimbursed by the applicant for the cost of a zoning hearing. These cost the
Township approximately $3,000.00 per hearing. Mr. Oeste stated he was not sure what the application fee is
for a zoning hearing. He explained there are 5 standards that have to be complied with to be entitled to a
variance. Supervisor Keller added it’s a case-by-case basis, adding zoning hearings are open to the public. Ms.
Keller suggested attending a zoning hearing for the experience. Chairman Taraschi reiterated this process could
take several months.
Mr. Oeste informed the audience this Board cannot just delete the notes. Adding it has to go through an
application process; someone will have to file an application to amend the final plan for Brandywine Walk while
complying with the Township requirements. Mr. Oeste is concerned that some people bought their properties
in reliance of the plan. The Township did everything it could to make sure future buyers were aware of these
restrictions. Mr. Oeste stated his point is a plan amendment has to be filed and it will be up to the Board
whether to approve it or not.
Mr. Gantz stated some of the residents were told of the notes, some were not, and some were misled. He
added this has caused a rift within the community. He added there are 9 residents that don’t want this change,
however, there are over 60 residents that do. He stated the supervisors were elected by a majority of voters,
and now the majority are looking to the supervisors to provide relief. Chairman Taraschi stated at this time he
doesn’t think it’s built out, adding there will be more neighbors that may have a say one way or the other. Mr.
Gantz stated they will be a large voting population. Mr. Taraschi stated you all have to live together in this
community. He added he would like the community to work together and come back to the Board with a
solution in the future, adding it can certainly be considered. However, for now it’s a tough scenario.
Mr. Oeste stated that the Board is in favor of this proposed change. He added he did not want the residents to
think this is going to happen necessarily. He reiterated his concerns that the Board may not have the legal
authority to change this plan. Supervisor Keller added if the plan can be changed it is not the Board that can
change it, but the Developer.
Mr. Reven provided the audience with the website that they can use to learn about how the zoning hearing bard
works in Pennsylvania. That website is dced.pa.gov/library.
Mr. Lou Girolami, 1213 Gilray, asked for clarification that this is now in the hands of the developer and who
from the Township should speak with the developer. Chairman Taraschi stated that it would be the developer’s
attorney that would need to speak with the Township attorney, Mr. Oeste. There was some additional discussion

regarding the cost per hearing for the Township. Mr. Girolami stated he was concerned that this would not be
addressed in a timely manner. He also stated he did meet with Mr. Taraschi in May; however, he has not heard
anything back from him on this matter. Mr. Taraschi stated he understands that there was no solid solution
based on their conversation. Mr. Scribner added for clarification; the Board cannot discuss their opinions
outside of a public meeting due to sunshine law violations. Mr. Taraschi stated the developer’s attorney will
need to start communicating with the Township solicitor as soon as possible. There was additional discussion
on how to communicate with the Board.
Mr. Mike Snyder, 1116 Kidron Court, had a question about egress through the backyard of the house in case of
a fire. Most of the egress is in the front yard of the house. He expressed concern regarding a 20-foot drop and
escaping his home in case of a fire. Mr. Taraschi stated that would be something to discuss with the zoning
hearing Board.
Mr. Don Lowery, 1228 Renzi Court, stated a safety concern with grills on the deck. He added a lot of us are over
55 and are handicap. There is no way to get out of the back of the house. He asked the Board if this could be
considered a hardship. Mr. Scribner reiterated that the Board cannot define your hardship. Based on Mr.
Scribner’s opinion, he doesn’t see why he can’t add steps and stay within the building envelope if the intent is
safety.
Mr. John Tallman, 1232 Renzi Court, inquired if residents can present a designed plan to the Board. Mr. Taraschi
stated the Board does not make that decision, and the application and plan need to be reviewed by the building
department and codes officer.
Ms. Sherri Kourahanis, 1040 Marengo Way, stated she has a physical handicap and is concerned that she cannot
get out of the back of her home. She would like steps on the back of her deck and does not want to cut half her
deck off to add those steps due to the current restrictions. There was some additional discussion regarding being
told by NVR sales that they would be allowed to have stairs.
Mr. Robert Mayo, 1026 Gilray Drive, thanked the Board for allowing the community to speak. Stating the
developer is currently the HOA president and they have never had a public meeting within their community. He
added he and his wife are not opposed to people building their decks out or adding stairs if it remains within
the building envelope. He added they are concerned if encroachment is on the property lines. He read and
understood the legal weight of the documents. He inquired if they don’t want to live in a community that’s over
extended, how do they get their investment money back. Mr. Taraschi did not have a solution to Mr. Mayo’s
question. Mr. Mayo proposed the developer should buy them out. There was some discussion regarding taking
legal action. Mr. Oeste again repeated the process of amending the plan. The Board also reiterated that the
only thing that is changing is the ability to go before the zoning hearing board.
Mr. Lou Girolami stated he feels the developer will be disengaged by the October/November time frame. He
voiced concern that they would not be through the process by then. The Board stated there have been
developers in the township for 20 years and did not think this developer would decline working with Brandywine
Walk residents to finish this change.

New Business
Appointment of Planning Commission Member for a Term Expiring December 2028 & Appointment if Planning
Commission Non-Voting Member
Mr. Reven presented the Board with the two vacancies. One is for a voting member and one for a non-voting
member. Mr. Croft would be appointed to the voting seat and Mr. Wilson to the non-voting seat. Mr. Croft’s
term would expire on 12/31/2028. Mr. Willson would be appointed annually until he moves into a voting seat.
Supervisor Keller acknowledged these are two very qualified candidates. Adding, Carl has already been serving
the community while Mr. Wilson is a new volunteer. Supervisor Keller thanked the volunteers and added her
vote this evening is based on the intentions that were discussed at the Planning Commission meeting. She
believes both volunteers will use their knowledge and background as an asset to this community. Adding Ms.
Keller feels new volunteers should be encourage in the Township.
Mr. Reven respectfully asked the Board to appoint Mr. Carl Croft to the Planning Commission for a term expiring
in 2028. Vice-Chairman Scribner stated so moved. Supervisor Keller seconded the motion. With all members
voting Aye, motion passed 3-0.

seat. Vice-Chairman Scribner stated so moved. Supervisor Keller seconded the motion. With all members voting
Aye, motion passed 3-0.
Financial Security Release #2 East Brandywine Center: Carlino/Giant
Mr. Reven presented Release # 2 to the Board. He added this release has been reviewed and approved by the
Township Engineer. Mr. Reven respectfully asked the Board for permission for Staff to process Escrow Release
#2 for East Brandywine Center.
Vice-Chairman Scribner made a motion to approve Release # 2 in the amount of $155,437.70 for East
Brandywine Center Carlino/Giant. Supervisor Keller seconded the motion. With all members voting Aye,
motion passed 3-0

Ordinance 2 of 2026: Zoning Code Update
Mr. Reven presented Ordinance 2 of 2026 to the Board. He stated Chapter 399 of the Code of East Brandywine
Township is organized by zoning district, with each district containing its own statement of intent, use
regulations, and area and bulk standards. He added, within each district’s use regulations, uses are further

categorized as permitted by right, conditional use, or special exception. Also stating while this structure clearly
identifies what uses are permitted within a given district, it has historically made it more difficult to answer the
inverse question: in which districts are a particular use permitted. Mr. Reven added, the code had allowed
certain uses to be defined differently across districts, even though the Township maintains a standard
definitions section in §300-17. Mr. Reven respectfully asked the Board to adopt Ordinance 2 of 2026. Mr. Oeste
stated per the MPC this was advertised on April 3rd and April 9th.
Chairman Taraschi asked if there were any questions from the audience or Board. There were none.
Vice-Chairman Scribner made a motion to adopt Ordinance 3 of 2026. Supervisor Keller seconded the motion.
With all members voting Aye, motion passed 3-0.
Ordinance 3 of 2026: Authorizing Execution of a Cable Franchise Agreement Between the Township and
Verizon
Mr. Reven presented Ordinance 3 of 2026 to the Board. He explained this is to authorize the execution of a
cable franchise agreement between the Township and Verizon. Mr. Oeste stated per the MPC this was
advertised on time.
Chairman Taraschi asked if there were any questions from the audience or Board. There were none.
Vice-Chairman Scribner made a motion to adopt Ordinance 3 of 2026. Supervisor Keller seconded the motion.
With all members voting Aye, motion passed 3-0.
Resolution 4 of 2026: C2P2 Application: All Abilities Inclusive Playground
Mr. Stribrny presented Resolution 4 of 2026 to the Board. Adding this is a grant application to benefit the allinclusive playground in the Community Park. Mr. Stribrny respectfully asked the Board to adopt Resolution 4 of
2026.
Vice-Chairman Scribner made a motion to adopt Resolution 4 of 2026. Supervisor Keller seconded the motion.
With all members voting Aye, motion passed 3-0.

RESOLUTION NO. 6 of 2026
A RESOLUTION OF THE BOARD OF SUPERVISORS OF EAST
BRANDYWINE TOWNSHIP AUTHORIZING THE ACQUISITION OF
REAL PROPERTY INTERESTS LOCATED IN THE TOWNSHIP OF
EAST BRANDYWINE, CHESTER COUNTY, PENNSYLVANIA BY
PURCHASE OR CONDEMNATION FOR THE PURPOSE OF PUBLIC
ROAD, TRAFFIC SIGNAL, UTILITY, AND STORMWATER
MANAGEMENT IMPROVEMENTS

WHEREAS, the Board of Supervisors (the “Board”) of East Brandywine Township (the
“Township”) is authorized and empowered pursuant to applicable law including, without
limitation, Section 2201 of the Pennsylvania Second Class Township Code, 53 P.S. § 67201, to
acquire real property interests for public purposes, including real property necessary for, and in
furtherance of completion of public road, traffic signal, utility, and stormwater management
improvements; and
WHEREAS, Pulte Homes of Pennsylvania, pursuant to a Condition Statement imposed
by the Pennsylvania Department of Transportation to Highway Occupancy Permit Application #
082827, is required to design, obtain permits, and construct certain highway, traffic signal,
utility, and stormwater management improvements along State Route 0322 (Horseshoe Pike),
State Route 4013 (Hopewell Road) and State Route 4015 (Bondsville Road) as depicted on a
plan titled Highway Occupancy Permit Plans Pulte Homes of PA, LP, prepared by Bowman
Consulting Group, Ltd. and McMahon, a Bowman company, dated 05-11-23, last revised 12-1224, 44 plan sheets, which is incorporated herein by reference (the “Improvements” or “Public
Project”); and
WHEREAS, in order to construct the Improvements, the acquisition of parts of certain
properties is required, including permanent acquisitions of additional road right-of-way in fee,
permanent traffic signal easements, and temporary construction easements. A list of the owners
and locations of the properties where acquisitions are required, the type of acquisition, and the
square footage of each area to be acquired is attached hereto as Exhibit “A” and incorporated
herein by reference (the “Necessary Real Property Interests”).
NOW, THEREFORE, BE IT RESOLVED by the Board, and it is hereby resolved by
authority of the same, that the acquisition of the Necessary Real Property Interests by purchase
or condemnation according to law is in the public interest and is necessary to construct the
Improvements and the Public Project; and

BE IT FURTHER RESOLVED by the Board, and it is hereby resolved by authority of
the same, that the Necessary Real Property Interests for the completion of the Project shall be
acquired by the Township by agreement, purchase, or condemnation under the provisions of the
Acts of Assembly as more fully set forth in this Resolution and as otherwise; and
BE IT FURTHER RESOLVED by the Board, and it is hereby resolved by authority of
the same, that the Township Manager, Township Secretary, Township Treasurer, Township
Engineer, Township Solicitor and other necessary consultants are authorized and directed to take
any and all steps which they, in their discretion, deem necessary and proper and in the best
interests of the Township to effectuate this Resolution including, without limitation, the filing of
one or more Declarations of Taking under and pursuant to the Pennsylvania Eminent Domain
Code, 26 Pa.C.S.A. § 101 et seq. and/or the negotiation, execution and recording of deeds of
conveyance and easement agreements in lieu of the filing of Declarations of Taking.
ADOPTED by the Board of Supervisors of East Brandywine Township this 7th day of
May, 2026.
