The Council for the City of Norwood met in a regular session on the above date with Mr. Joseph Geers
presiding. The meeting opened with a moment of reflection and the Pledge of Allegiance.

On roll call, the following members answered present: Ms. Franzen, Ms. Hoover, Ms. Bowling, Mr. Moore,
and Mr. Girton. Mr. Provins entered council chambers during the request to address council.
E) AMENDMENT OF AGENDA
There were several changes made to the agenda, including adding two new committee reports, Streets, Housing,
& Health; Finance, Budget, Audit, & Claims, an addition to a Section N, regarding flock cameras. There will be an
appointment of a new Ward 4 representative, Ann Leichty Appointment of Ward 4; and report sent by email
from the City Auditor.
On a motion made by Ms. Franzen, seconded by Ms. Hoover, it was moved to amend the agenda as stated. All
members present voted, “yes.” The motion passed.
F) MINUTES OF PREVIOUS MEETING

On a motion made by Mr. Girton, seconded by Ms. Franzen, it was moved to approve and accept both sets of
minutes as if read. All members present voted, “yes.” The motion passed.
President Geers appointed and swore in Ann Leichty, the appointed Representative for Ward 4.

RE: Flock Camera
Stephanie Downs, Floral Avenue, addressed council regarding favoring Flock cameras and wanting to
live in a safe town.

I) SPECIAL PRESENTATIONS
1) Michael Gabbard, Recreation Director
The Recreation Department has experienced significant growth and progress over the past year. The
Recreation Center, purchased in Spring 2021 and opened in 2022, continues to see increased
membership, including approximately $1,500 in additional revenue through Silver Sneakers.
Waterworks Pool was open 88 days, an increase of 15 days from last summer, resulting in increased
revenue. Norwood facility rentals also increased, while participation in programs and events
continued to grow. The Senior Center membership increased to 254 members, along with expanded
information sharing, programs, and additional opportunities for seniors. Several facility
improvements were completed, including new concrete on the Waterworks pool deck, restroom
flooring, and three new sun screens; new lockers at the Recreation Center; and at the Senior Center,
upgraded restrooms, a redesigned cafeteria layout with a new audio wall, and two additional
classrooms for rentals at the Community Center. For the future, the priorities include expanding
youth programming and continuing the planning and installation of an elevator at the Recreation
Center. The department also recognizes Clinton, Recreation Center Program Coordinator; April,
Senior Center Program Coordinator; all part-time staff; Darren Hackworth, Program Coordinator; and
the Information Technology, Public Works, Administration, and City Council teams for their continued
support and contributions to the community.
On a motion made by Ms. Hoover, seconded by Ms. Franzen, it was moved to allow more time for
the presentation. All members present voted, “yes.” The motion passed.

K) ADMINISTRATIVE REPORTS
Mayor Schneider, Mayor, welcomed Ms. Leichty to council. Mayor Schneider provided additional
information regarding the Wellness Fair, an opportunity provided by the Human Resources team to create
awareness and receive feedback from City employees regarding wellness. Mayor Schneider provided
information regarding the fund utilization with an emphasis on collaboration with City Council and City
Administrators. Mayor Schneider shared community events including his attendance of the International
Art Festival and the Norwood High School Marching Band competition.
James Bonsall, Treasurer, shared an update regarding the communications within the packet, including
increases in earning taxes. Mr. Bonsall shared additional updates including the attendance of a conference
his team will be attending for professional development.
Ken Miracle, City Auditor, shared an update regarding his administrative report that was sent to Council.
Mr. Miracle shared updates regarding the 2024 Audit, it has been completed, 2025 should be completed
by the end of October, and the bank reconciliation has been closed on various reconciliations.
Keith Moore, Law Director, provided an update on the Flock camera ordinance and reasoning as to why it
was a late add to the agenda.

Ms. Hoover shared updates regarding updates and changes for advertisements prior to the start of
Council Meetings through Norwood TV; sharing an update on composting with 18,000+ pounds being
diverted from the trash; the Fall Upcycle – October 24, 2026 with a host of collected items at Paycor, tire
and yard waste will occur at Public Works on October 24 and 25, and sharing the Skatepark updates on
October 21 at 6PM at the Norwood Recreation Center.
P) NEW BUSINESS
Ms. Hoover reminded residents about Voting and working the polls. Ms. Hoover also shared updates
about Emily’s Garden at Hunter Park with a cleanup day on Saturday, September 26, 2026. Mr. Moore
shared an update about the Norwood Bike Bus on Thursday mornings during the month of October
proceeding North of Wasson Way and arriving at the Montessori School. Mr. Moore shared his gratitude
to Mr. Powers rapid response to residents concerns regarding traffic and crosswalk signage.

AN ORDINANCE AUTHORIZING THE SAFETY-SERVICE DIRECTOR TO ENTER
INTO A REAL ESTATE OPTION AGREEMENT WITH LOVE CITY CHURCH
REGARDING THE PURCHASE OF REAL PROPERTY LOCATED AT 2100 ELM
AVENUE; AUTHORIZING THE EXPENDITURE OF NECESSARY FUNDS; AND
DECLARING AN EMERGENCY
WHEREAS, the City of Norwood has identified certain real property located at 2100
Elm Avenue, currently owned by Love City Church, as necessary for future improvements to the
City of Norwood’s public safety buildings; and
WHEREAS, Love City Church, current owner of 2100 Elm Avenue, has indicated to the
City that Love City Church’s congregation expects to be relocating to a different physical
location at some time in the next three years; and
WHEREAS, the current City of Norwood Police and Fire Stations are located on the
same block as 2100 Elm Avenue; and
WHEREAS, the City currently has the necessary appropriations available in the 2026
budget to make the initial option payment and sufficient funds are included in the Fiscal
Recovery Plans for the remainder of the purchase price and the end of the option period; and
WHEREAS, it is in the best interest of the City and its residents to secure this land now
to ensure the viability of future public safety projects.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
NORWOOD, STATE OF OHIO:
SECTION 1. That the Safety-Service Director is hereby authorized to enter into a Real
Estate Option Agreement with Love City Church regarding the purchase of real property located
at 2100 Elm Avenue, in substantially the same form as “Exhibit A,” attached hereto and
incorporated herein by reference.
SECTION 2. That the Safety-Service Director is further authorized to accept a deed for
said property at the end of the option period and to execute any and all documents necessary to
secure the option and finalize the transfer of title to the City.
SECTION 3. That the City Auditor is hereby authorized to draw, and the City Treasurer
is authorized to pay, and directed to expend the necessary funds to complete this transaction,
including the option price and any additional costs such as escrow fees, title insurance, recording
fees, and other closing costs, from the PUBLIC LANDS – CAPITAL FUND 1001-0911-57600
as previously appropriated.
SECTION 4. This Ordinance is declared to be an emergency measure necessary for the
immediate preservation of the public health, safety and welfare of the City of Norwood, and for
the further reason that this Ordinance is required to be immediately effective in order to execute
and record this Option agreement during the current appropriations year. Therefore, this
Ordinance shall be in full force and effect immediately upon its adoption and certification.

ORDINANCE AMENDING SECTIONS 919.16, 955.01, AND 955.02 OF THE
NORWOOD CODIFIED ORDINANCES TO ADDRESS CONSTRUCTION
DUMPSTERS AND STORAGE CONTAINERS ON PRIVATE PROPERTY
WHEREAS, Section 919.16, entitled “Minimizing the Impacts of Work in the Rights of
Way”, regulates the temporary placement of dumpsters and other equipment in the right of way,
but does not address placement on private property; and
WHEREAS, Chapter 955 of the Norwood Codified Ordinances, including Sections
955.01, entitled “Use and Approval”, and 955.02, entitled, “Compliance with Specifications”,
regulates the use of relatively permanent placement of dumpsters and trash receptacles on private
property, but not temporary use for construction purposes; and
WHEREAS, Council desires to address the placement of construction dumpsters and large
portable storage/shipping containers that remain on private property for extended and unnecessary
periods of time to the detriment of the health, safety and welfare of the residents of Norwood; and
WHEREAS, the Norwood Health Department has been replaced by a different body
named the Norwood Board of Health, necessitating the updating of Sections 955.001 and 955.02;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Norwood,
Hamilton County, Ohio, that Sections 919.16, 955.01 and 955.02 of the Norwood Codified
Ordinances are amended, as follows:
SECTION 1. Section 919.16 of the Norwood Codified Ordinances, entitled “919.16,
entitled “Minimizing the Impacts of Work in the Rights of Way”, is hereby amended to change
subsection (c)(3) and add new (c)(4) to read as follows:
919.16 MINIMIZING THE IMPACTS OF WORK IN THE RIGHTS OF WAY.
(a) Call Before Digging. Permittees shall be responsible to “call before you dig.” (Ohio
Utility Protection Service, 1-800-362-2764). The Ohio Revised Code §3781.28 states that
within forty eight (48) hours of receiving notice under §3781.28 of the Revised Code, each
utility shall locate and mark the approximate location of its underground utility facilities
at the excavation site. If a utility does not mark its underground utility facilities or contact
the excavator within forty eight (48) hours of receiving notice under §3781.28 of the
Revised Code, the utility is deemed to have given notice that it does not have any facilities
at the excavation site.
(b) Noise, Dust, Debris, Hours of Work. Each Permittee shall conduct Work in such
manner as to avoid unnecessary inconvenience and annoyance to the general public and
occupants of neighboring property. In the performance of the Work, the Permittee shall
take appropriate measures to reduce noise, dust, and unsightly debris as directed by
ordinance or as requested by the Service Director. No Work shall be done between the
hours of 8:00 p.m. and 7:00 a.m. nor at any time on Sunday or as directed by ordinance,
except with the written permission of the Service Director, or in case of an emergency.
(c) Trash and Construction Materials. Each Permittee shall maintain the Work site so
that:
(1) Trash and construction materials are contained so that they are not blown off of
the construction site.
(2) Trash is removed from a construction site often enough so that it does not become
a health, fire, or safety hazard.

(3) Trash dumpsters, portable storage or shipping containers eight (8) feet or more in
length, and storage or construction trailers are not placed in the street without specific
approval of the Service Director. Trash dumpsters, containers, and trailers shall not take
up more than two (2) parking spaces, shall not block any driveways, and must be removed
if any right-of-way work is scheduled.
(4) Trash dumpsters, portable storage or shipping containers eight (8) feet or more in
length, and storage or construction trailers are not placed on private property for more
than fourteen (14) days without written approval of the Building Commissioner.
(d) Deposit of Dirt and Material on Roadways. Each Permittee shall utilize their best
efforts to eliminate the tracking of mud or debris upon any street or sidewalk. Streets and
sidewalks shall be cleaned of mud and debris at the end of each day. All equipment and
trucks tracking mud and debris into the Right-of-Way shall be cleaned of mud and debris
at the end of each day or as directed by the Service Director.
(e) Protection of Trees and Landscaping. Each Permittee shall protect trees, landscape,
and landscape features as required by the City. All protective measures shall be provided
at the expense of the Permittee.
(f) Protection of Paved Surfaces From Equipment Damage. Backhoe equipment
outriggers shall be fitted with rubber pads whenever outriggers are placed on any paved
surface. Tracked vehicles that will damage pavement surfaces are not permitted on paved
surface unless specific precautions are taken to protect the surface. The Permittee will be
responsible for any damage caused to the pavement by the operation of such equipment
and, shall repair such surfaces. Failure to do so will result in the use of the applicant's
performance/warranty guarantee by the City to repair any damage, and, possibly, the
requirement of additional warrantee(s).
(g) Protection of Property. Each Permittee shall protect from injury any adjoining
property by providing adequate support and taking other necessary measures. The
Permittee shall, at its own expense, shore up and protect all buildings, walls, fences or
other property likely to be damaged during the Work, and shall be responsible for all
damage to public or private property resulting from failure to properly protect and carry
out Work in the public way.
(h) Clean-Up. As the Work progresses, all public rights of way and private property shall
be thoroughly cleaned of all rubbish, excess dirt, rock, and other debris. All clean-up
operations shall be done at the expense of the Permittee.
(i) Preservation of Monuments. A Permittee shall not disturb any surface monuments,
property marks or survey hubs and points found on the line of Work unless approval is
obtained from the Service Director. Any monuments, hubs, and points disturbed will be
replaced by a Ohio Registered Land Surveyor at the Permittee's expense.
(j) Parking. Each Permittee shall make provisions for employee and construction vehicle
parking so that neighborhood parking adjacent to a Work site is not impacted.
(k) Walkways. Each Permittee shall maintain an adequate and safe unobstructed
walkway around a construction site or blocked sidewalk.
(l) Snow/Ice Removal. Each Permittee shall clear all snow and ice hazards from public
sidewalks at the Work site by noon following a snowfall.
(m) Sanitary Facilities. Each Permittee shall provide necessary sanitary facilities for
workers. The location of such facilities shall be approved by the City in the Permit.
SECTION 2. Section 955.01 of the Norwood Codified Ordinances, entitled “Use and
Approval”, is hereby amended to read as follows:
955.01 USE AND APPROVAL.
(a) Dumpsters may be used as (1) collection receptacles for refuse and garbage within
the City limits or (2) temporary receptacles for trash and construction materials as
provided in Section 919.16.
(b) No person shall hereafter cause a dumpster to be put into use on his residence,
business premises, enterprise or establishment without first securing approval of the
proposed use and specifications from the Norwood Board of Health or, in the case of
temporary use, from the Norwood Building Department.

SECTION 3. Section 955.02 of the Norwood Codified Ordinances, entitled “Compliance
with Specifications”, is hereby amended to read as follows:
955.02 COMPLIANCE WITH SPECIFICATIONS.
Dumpsters or containers used for the storage of rubbish, garbage, grease and
recyclables shall meet all of the following specifications:
(a) Dumpsters shall be watertight.
(b) Dumpsters shall be made of a suitable material approved by the Norwood Board
of Health.
(c) Dumpsters being placed for the first time upon a given premises shall be new or
cleaned thoroughly and in good repair.
(d) Dumpsters serving residential dwelling units shall have, as minimum capacity, six
cubic feet of space per dwelling unit served thereby.
(e) Dumpsters being placed for the first time upon a given premises shall be placed
upon a concrete slab. Dumpsters that are currently located upon a blacktop, asphalt or
macadam surface are not required to be placed upon a concrete slab, provided that the
blacktop, asphalt or macadam surface supporting the dumpster is in good condition.
However, any dumpster that is located on a blacktop, asphalt or macadam surface shall
be relocated to a concrete slab at such time as the blacktop, asphalt or macadam surface
supporting the dumpster deteriorates to the point of requiring resurfacing. At such point,
the dumpster shall be placed upon a concrete slab. Such concrete slab shall be approved
by an official of the Building Department.
(f) Wooden fencing, concrete, block, chain link fence with the metal slats, or other
materials accepted by the Health Commissioner, which are of sufficient height and width
to shield the dumpster from the public view shall be maintained. Existing dumpsters shall
meet the provisions of this subsection within three years after the effective date of this
subsection.
(g) Dumpsters shall be constructed and maintained with lids and/or doors which are
capable of being completely closed and fastened shut.
(h) Except when rubbish and garbage is being loaded into or emptied out of the
dumpster, the lids and doors shall be kept closed and fastened shut with a latch or similar
mechanism.
(i) Dumpsters serving establishments other than residential dwelling units shall be kept
closed and/or secured, except when rubbish and garbage is being loaded into or emptied
out of the dumpster. Dumpsters serving residential dwelling units shall not be kept locked
unless each tenant is issued a key to the dumpster.
(j) Dumpsters being placed upon streets for the removal of demolition, building or
remodeling debris shall remain upon the street for no more than five days from date of
placement thereon, including Saturdays, Sundays and holidays. Such dumpsters shall be
exempt from the requirements set forth in subsections (a) through (i) hereof.
(k) Dumpsters shall be placed in a location accessible to the pick-up truck which
empties the dumpster, such that the pick-up truck shall not be forced to drive over any
street curb in order to service the dumpster.

“ORDINANCE AUTHORIZING THE MAYOR OR SAFETY-SERVICE DIRECTOR
TO ENTER INTO A LETTER AGREEMENT WITH THOMAS MCCABE TO SERVE

WHEREAS, Fire Chief Thomas “Tom” McCabe currently serves under the terms of employment
established by Ordinance No. 17-2020, which was approved during the COVID-19 pandemic under
conditions of significant financial strain; and
WHEREAS, the structure of Ordinance No. 17-2020 has rendered Chief McCabe ineligible for
merit-based compensation increases aligned with other department heads and market rates, resulting in his
compensation lagging behind other members of the Fire Department; and
WHEREAS, the City has subsequently developed a general salary ordinance applicable to
appointed employees (currently Ordinance No. 28-2026), and Fire Chief McCabe has requested the
cancellation of his current agreement under Ordinance No. 17-2020 so that he may instead be included
under the City's general salary ordinance; and

WHEREAS, the Mayor has accepted Chief McCabe's request for cancellation; now,
therefore,

BE IT ORDAINED by the Council of the City of Norwood, State of Ohio, that:
SECTION 1. That Ordinance No. 17-2020, entitled an “Ordinance Authorizing the
Mayor or Safety-Service Director to Enter into a Letter Agreement with Thomas McCabe to
serve as Fire Chief, consistent with the terms of the attached Exhibit A, and Declaring an
Emergency”, is hereby repealed in its entirety.
SECTION 2. This ordinance is hereby declared to be an emergency measure necessary
for the immediate preservation of the public peace, health, safety, and welfare of the City of
Norwood, and for the further reason that emergency action is required to allow simultaneous
effect of Fire Chief McCabe’s new compensation. It shall take effect and be in force
immediately upon its passage and approval by the Mayor.

now, therefore,
BE IT ORDAINED by the Council of the City of Norwood, State of Ohio, that
SECTION 1. The City hereby authorizes the early payment of amounts due to Fire Chief
Tom McCabe under Ordinance No. 17-2020 as detailed in Exhibit A, attached hereto and
incorporated herein by reference, to be paid in full during the 2026 and 2027 calendar years.
SECTION 2. Following the repeal of Ordinance No. 17-2020 and the execution of
payments, Fire Chief McCabe shall thereafter be included in the City’s general salary ordinance.
Pending adoption of this ordinance, Chief McCabe shall receive a retroactive increase in his
compensation rate, adjusted to January 1, 2026, reflecting an effective 10% increase. A similar
increase shall be structured for calendar year 2027 in accordance with the general salary ordinance
framework.
SECTION 3. This Council finds and determines that no additional appropriations are
required for calendar year 2026 to fund the provisions of this ordinance, as existing departmental
appropriations are sufficient to meet these requirements.
SECTION 4. This ordinance is hereby declared to be an emergency measure necessary
for the immediate preservation of the public peace, health, safety, and welfare of the City of
Norwood, and for the further reason that emergency action is required to allow all necessary
payments to be executed within the 2026 calendar year and to be included in Chief McCabe’s 2026
earnings and to allow simultaneous effect of the repeal of Ordinance No. 17-2020. It shall take
effect and be in force immediately upon its passage and approval by the Mayor.

WHEREAS, the City of Norwood and the Carl H. and Edyth B. Lindner Foundation
originally entered into a cooperative agreement in 2009 to support community development and
municipal projects; and
WHEREAS, this agreement was subsequently amended by the parties in 2014 to reflect
updated objectives and project scopes; and
WHEREAS, the Carl H. and Edyth B. Lindner Foundation has requested a further
amendment to the agreement in order to provide critical funding and support for numerous parks
capital improvement projects within the City; and
WHEREAS, the Administration and City Council find that amending the agreement as
requested by the Foundation serves a vital public purpose by enhancing municipal recreational
spaces and infrastructure for the health, safety, and welfare of the citizens of Norwood; now,
therefore,
BE IT ORDAINED by the Council of the City of Norwood, State of Ohio, that:
SECTION 1. The Council hereby amends the existing cooperative agreement between the
City of Norwood and the Carl H. and Edyth B. Lindner Foundation, originally established in 2009
and amended in 2014, as requested by the Foundation.
SECTION 2. The Safety-Service Director is hereby authorized and directed, on behalf of
the City of Norwood, to execute the amended agreement, attached as Exhibit A, with the
Foundation and to take all necessary actions to implement its provisions.
SECTION 3. This ordinance is hereby declared to be an emergency measure necessary for
the immediate preservation of the public peace, health, safety, and welfare of the City of Norwood,
and for its residents. The emergency is the immediate need to finalize the amended terms to ensure
improvement projects can begin as soon as possible. It shall take effect and be in force immediately
upon its passage and approval by the Mayor.

A RESOLUTION ACCEPTING A DONATION OF $3,500 FROM THE AMERICAN
LEGION POST 123, IN THE CITY OF NORWOOD, OHIO, FOR THE PURCHASE OF
SENIOR LUNCHES AT THE COMMUNITY/SENIOR CENTER,
AND DECLARING AN EMERGENCY
WHEREAS, the City of Norwood has received a generous donation from the American
Legion Post 123 to purchase lunches for seniors at the Community/Senior Center; and
WHEREAS, the American Legion Post 123 is sponsoring meals for seniors to promote
social welfare, community improvement, and outreach to support local seniors; and
WHEREAS, the American Legion Post 123 has requested that these funds be dedicated
exclusively to supporting and providing lunches for senior citizens at the Community/Senior
Center; now therefore,
BE IT RESOLVED by the Council of the City of Norwood, State of Ohio, that:
SECTION 1. The City of Norwood hereby accepts the donation of $3,500 from the
American Legion Post 123. The Council of the City of Norwood extends its sincere appreciation
to the American Legion Post 123 for its continued investment in the local senior community.
SECTION 2. This donation shall be deposited into the Community Center Donations
Fund # 1001-0000-48704.
SECTION 3. This resolution is hereby declared to be an emergency resolution and a
measure necessary for the immediate preservation of the public peace, health, safety, and general
welfare and shall go into effect forthwith. The reason for said emergency is the necessity to deposit
and allocate these funds immediately, and funds can be disbursed for the purpose stated in this
resolution.
