WHEREAS, the Town of Hyde Park Zoning Secretary Barbara Keenen has submitted her letter of
retirement effective October 2, 2026.
NOW, THEREFORE, BE IT RESOLVED, that the Town of Hyde Park Town Board does hereby
acknowledge the retirement of the Town of Hyde Park Zoning Secretary Barbara Keenen; and
BE IT FURTHER RESOLVED, that the Town Supervisor and the Town Board extend their

RESOLUTION AUTHORIZING THE TOWN OF HYDE PARK TOWN BOARD TO CREATE THE
POSITION OF FULL-TIME MUNICIPAL SECRETARY IN THE NY HIRING FOR EMERGENCY
LIMITED PLACEMENT STATEWIDE PROGRAM AND APPOINT RICKIE SORCI FOR THE TOWN OF
HYDE PARK ZONING DEPARTMENT
WHEREAS, there exists a vacancy for the position of full-time Municipal Secretary in the Town of Hyde
Park Zoning Department; and
WHEREAS, the Town was notified by Dutchess County Department of Human Resources that this
position is now a Non-Competitive Class position through the NY Hiring for Emergency Limited
Placement Statewide Program (“HELP”).
NOW, THEREFORE, BE IT RESOLVED, that the Town of Hyde Park Town Board does hereby create
and appoint Rickie Sorci to the position of full-time Municipal Secretary (HELP) for the Town of Hyde
Park Zoning Department effective Tuesday, September 15, 2026, at an hourly rate of $22.91 as
established by the CSEA Town Hall Unit Collective Bargaining Agreement; and
BE IT FURTHER RESOLVED, that said position is a Grade 4 in the aforementioned Collective
Bargaining Agreement; and
BE IT FURTHER RESOLVED, that Ms. Sorci’s benefits and all other terms and conditions of
employment shall be subject to the terms of the aforementioned collective bargaining agreement; and
BE IT FURTHER RESOLVED, that said appointment is subject to a probationary period as set forth in
the Civil Service Law of the State of New York and shall be subject to all of the Civil Service Law Rules
and Regulations; and
BE IT FURTHER RESOLVED, that the Town of Hyde Park Town Board does also hereby authorize the
Town Supervisor to execute all documents required by the Dutchess County Department of Human
Resources to create and appoint Rickie Sorci to said appointment.

WHEREAS, there exists a vacancy for the position of full-time Groundskeeper/Cleaner in the Town of
Hyde Park Recreation Department; and
WHEREAS, the Town of Hyde Park Recreation Director would like to appoint Shane Baxter to the
position of full-time Groundskeeper/Cleaner.
NOW THEREFORE BE IT RESOLVED, that the Town of Hyde Park Town Board does hereby appoint
Shane Baxter to the position of full-time Groundskeeper/Cleaner at an hourly rate of $22.91 as
established by the CSEA Town Hall Unit Collective Bargaining Agreement with his start date to begin
the later of September 15, 2026, or the workday immediately following the Town’s receipt and approval
of his pending background investigation; and
BE IT FURTHER RESOLVED, that said position is a Grade 4 in the aforementioned Collective
Bargaining Agreement; and
BE IT FURTHER RESOLVED, that Shane Baxter’s benefits and all other terms and conditions of
employment, shall be subject to the terms of the aforementioned collective bargaining agreement; and

WHEREAS, the Town of Hyde Park Board of Assessment Review consists of five (5) members with five
(5) year terms; and
WHEREAS, there currently exists a vacancy for a Board of Assessment Review member due to Jack
Dworak’s term ending on September 30, 2026; and
WHEREAS, the Town of Hyde Park Town Board would like to appoint Duane Pearson to the Board of
Assessment Review effective October 1, 2026, for a term set to expire September 30, 2031.
NOW, THEREFORE, BE IT RESOLVED, that the Town of Hyde Park Town Board does hereby appoint
Duane Pearson to the Town of Hyde Park Board of Assessment Review effective October 1, 2026, for a

RESOLUTION AUTHORIZING THE TOWN OF HYDE PARK TOWN BOARD TO APPROVE
AMENDING THE TOWN OF HYDE PARK FEE SCHEDULE TO ADJUST THE CHARGES FOR THE
TOWN CEMETERY
WHEREAS, the Town of Hyde Park owns and is charged with the care, control and management of the
Union Cemetery, and the Town Board is authorized by Section 291 of the Town Law to adopt
regulations for the proper care of such cemetery and for the burial of the dead therein; and
WHEREAS, Chapter 12 of the Code of the Town of Hyde Park empowers the Town Board to impose
and set all fees charged by the Town for its services and programs through a Fee Schedule established
and amended by resolution, without the necessity of enacting a local law or ordinance, and further
provides that a fee so adopted supersedes any fee specified elsewhere in the Town Code (Town Code §§
12-1, 12-2); and
WHEREAS, the charges presently in effect for the Town cemetery are $1,200.00 for an adult grave,
$550.00 for an infant grave, and $650.00 for a cremation space; and
WHEREAS, by Resolution Request Form submitted for the September 14, 2026, meeting, Andrea Ortiz
has advised the Town Board that the Town's costs of grounds maintenance, equipment,
administration, record keeping and the general upkeep of burial spaces have increased, and has
requested that the Town Board adjust the foregoing charges so that they more nearly reflect the
Town's cost of providing and maintaining cemetery services; and
WHEREAS, the Town Board has reviewed the request, together with the supporting materials
accompanying it, and has considered the Town's cost of operating and maintaining the cemetery, the
charges imposed by comparable cemeteries serving this area, and the Town's interest in having
cemetery operations supported by the charges paid by those who use them rather than by general
Town revenues; and
WHEREAS, the Town Board finds the adjustments set forth below to be reasonable, to be necessary to
keep the cemetery financially self-sustaining, and to be consistent with the Town's continuing
obligation to provide well-maintained and properly administered burial spaces to residents of the Town
and their families.
NOW, THEREFORE, BE IT RESOLVED, that the Town of Hyde Park Fee Schedule is hereby amended,
pursuant to §§ 12-1 and 12-2 of the Town Code, to establish the following charges for the Town
cemetery; and

BE IT FURTHER RESOLVED, that the charges established by this resolution shall take effect on
October 1, 2026, and shall apply to every purchase of interment rights made on or after that date,
provided that any purchase for which a written agreement was executed and payment or deposit
received by the Town before that date shall be completed at the charge in effect on the date the
agreement was executed; and

BE IT FURTHER RESOLVED, that all other fees and charges relating to the Town cemetery, including
without limitation charges for the opening and closing of graves, foundations, markers, disinterment’s,
and interments performed on Saturdays and holidays, shall remain as presently in effect until
amended by further resolution of the Town Board; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to cause the Town Fee Schedule
on file in the Town offices to be updated to reflect the charges established by this resolution, to post
the amended cemetery charges in the office of the Town Clerk and on the Town's website, and to
furnish a copy of this resolution to the Town Comptroller, to the officer or employee charged with the
administration of the Town cemetery, and to any funeral director or other person who has requested
notice of the Town's cemetery charges.

MUNICIPAL INVESTMENT GRANT (MIG) FROM DUTCHESS COUNTY FOR REPLACEMENT OF THE
SECURITY ENTRANCE DOORS AT THE TOWN OF HYDE PARK POLICE DEPARTMENT
WHEREAS, the Town of Hyde Park has received a Municipal Investment Grant (MIG) from Dutchess
County in the amount of $22,398.00 for replacement of the Town of Hyde Park Police Department’s
security entrance doors; and
WHEREAS, the updated project budget requires a Town contribution of an additional $28,898.00 for
the project.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby accepts the grant award, and
acknowledges the Town contribution of $28,898.00 is available either through the current Town
budget or Town general fund balance; and
BE IT FURTHER RESOLVED, the Town Supervisor is authorized to execute the grant agreement after
review by the Town Attorney, and the signature of the Town Supervisor constitutes acceptance of the
terms and conditions of the grant agreement.

RESOLUTION AUTHORIZING THE TOWN OF HYDE PARK TOWN BOARD TO APPROVE THE
SUBMISSION OF THE LAW ENFORCEMENT TECHNOLOGY GRANT PROGRAM APPLICATION
WHEREAS, the Town of Hyde Park is committed to seeking funding opportunities that support and
enhance community development, infrastructure, and municipal services; and
WHEREAS, the Law Enforcement Technology (LETECH) Program is available through the New York
State Division of Criminal Justice Services (NYS DCJS) to provide financial assistance to municipal law
enforcement agencies for the implementation of law enforcement technologies and related software and
equipment to support law enforcement partners in their efforts to maintain safe and thriving
communities; and
WHEREAS, the Hyde Park Town Board has opted to submit an application to the NYS DCJS LETECH
Program to procure an unmanned aerial vehicle (UAV, also known as a “drone”), Flock Safety cameras,
handheld Lidar devices, dash-mounted speed radar units for patrol vehicles, AED replacement pads,
throwable flotation aids, water guides, rescue tubes, poles, throw bags, and general office-related
equipment, including Dell Tower Plus Desktop, Dell Pro 5 Micro Desktop, Dell monitors, CyberPower
surge protectors, Canon printers, and toner cartridges; and
WHEREAS, the NYS DCJS will fund up to 100% of the total project cost, up to $125,000.00 and the
Town of Hyde Park will not be required to provide a match under this solicitation.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Hyde Park has
authorized the submission of this application for the purpose of implementing this critical project to
enhance the safety and security of residents throughout the community; and
BE IT FURTHER RESOLVED, that the Town Supervisor is authorized to execute any and all
necessary documents related to the submission of the grant application and to take all necessary
actions to effectuate the intent of this resolution.

RESOLUTION AUTHORIZING THE TOWN OF HYDE PARK TOWN BOARD TO APPROVE AN INTERMUNICIPAL AGREEMENT WITH THE HYDE PARK CENTRAL SCHOOL DISTRICT FOR THE
PROVISION OF POLICE OFFICERS FOR EVENT SECURITY DURING THE 2026-2027 SCHOOL
YEAR
WHEREAS, the Town of Hyde Park (the “Town”) maintains a police department pursuant to Article 10
of the Town Law, and all powers of the Town relative to police matters, including the general authority
and direction of its police officers, are vested in the Town Board pursuant to Town Law §§ 39, 150 and
154; and
WHEREAS, the Hyde Park Central School District (the “School District”) is responsible for the safety
and security of its students, employees and visitors, including pursuant to Education Law § 2801-a,
and has requested that the Town furnish uniformed police officers to provide safety and security at
School District events during the 2026-2027 school year; and
WHEREAS, the Town and the School District are each a “municipal corporation” within the meaning
of General Municipal Law § 119-n(a), and each has the power to provide, perform or exercise the
functions that are the subject of the agreement hereinafter described; and
WHEREAS, Article 5-G of the General Municipal Law, and in particular § 119-o thereof, authorizes
municipal corporations to enter into agreements for the performance among themselves or one for the
other of their respective functions, powers and duties on a cooperative or contract basis, and for
compensation to defray the cost of such services; and
WHEREAS, the services to be rendered by the Town under the agreement hereinafter described are to
be furnished at a rate intended to recover the Town’s actual cost of providing such services, including
salary, fringe benefits, employer contributions and reasonable administrative overhead, and the Town
Board has been advised by the Chief of Police and the Town Comptroller as to the sufficiency of such
rate; and
WHEREAS, the agreement hereinafter described is not a purchase contract or contract for public work
subject to the competitive bidding requirements of General Municipal Law § 103, and Chapter 24 of
the Code of the Town of Hyde Park is therefore inapplicable, the Town being the provider rather than
the purchaser of the services thereunder; and
WHEREAS, the Town Board has determined that the approval of the agreement hereinafter described
constitutes a Type II action pursuant to 6 NYCRR § 617.5(c)(26), being routine or continuing agency
administration and management, and Chapter 54 of the Code of the Town of Hyde Park, and
accordingly requires no further review under the State Environmental Quality Review Act; and
WHEREAS, a copy of the proposed Inter-Municipal Agreement between the Town of Hyde Park and the
Hyde Park Central School District for the provision of police officers for event security has been
presented to and reviewed by the members of the Town Board, and the Town Board has been advised
by the Town Attorney with respect thereto; and
WHEREAS, the Town Board has determined that the approval of said agreement is in the best
interests of the Town and its residents.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Hyde Park hereby
approves the Inter-Municipal Agreement between the Town of Hyde Park and the Hyde Park Central
School District for the provision of uniformed police officers for safety and security at School District
events during the 2026-2027 school year, in substantially the form presented to and reviewed by the
Town Board at this meeting, a copy of which shall be filed with the Town Clerk; and
BE IT FURTHER RESOLVED, that the Town Supervisor is hereby authorized and directed to execute
said agreement on behalf of the Town of Hyde Park, and to execute such other documents and take
such other actions as may be reasonably necessary to effectuate the same, subject in each case to the
approval of the Town Attorney as to form and to such non-material changes as the Town Attorney may
approve; and
BE IT FURTHER RESOLVED, that said agreement shall not be executed by the Town Supervisor, and
shall not take effect, unless and until it has likewise been approved by a majority vote of the voting
strength of the Board of Education of the Hyde Park Central School District as required by General
Municipal Law § 119-o(1); and
BE IT FURTHER RESOLVED, that no obligation of the Town under said agreement shall extend
beyond the funds appropriated therefore by the Town Board, and the obligations of the Town
thereunder are subject to annual appropriation; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to transmit a certified copy of
this resolution to the Superintendent of Schools of the Hyde Park Central School District, the Chief of
Police, the Town Comptroller and the Town Attorney.

ALCOHOLIC BEVERAGES TO BE CONSUMED AT THE TOWN OF HYDE PARK LIBRARY EVENT
TO BE HELD ON SATURDAY, DECEMBER 5, 2026
WHEREAS, the Town of Hyde Park Library has requested that the Town Board waive the provisions of
Chapter 35, Article I, entitled “Public Consumption”, of the Code of the Town of Hyde Park for the
Hyde Park Library’s event to be held on Saturday, December 5, 2026, from 2:00 pm to 4:00 pm at the
Hyde Park Library, 2 Main Street, Hyde Park, NY 12538; and
WHEREAS, Section 35-4 of the Code of the Town of Hyde Park provides that the provisions of Chapter
35, Article I shall not apply in the event of a fair, picnic or other community gathering for which
special permission has been granted by the Town Board; and
WHEREAS, such special permission shall be contingent upon the Town of Hyde Park Library, naming
the Town as an additional insured for Liability Insurance purposes and the submission of sufficient
documentation indicating the same.
NOW, THEREFORE, BE IT RESOLVED, that the Town of Hyde Park Town Board does hereby waive
the provisions of Chapter 35, Article I of the Code of the Town of Hyde Park and grants special
permission to the Hyde Park Library for the use of alcohol at their event, subject to the provisions of
the Alcoholic Beverage Control Law of the State of New York; and
BE IT FURTHER RESOLVED, that the Town of Hyde Park Town Supervisor hereby authorized to
execute any and all documentation to effectuate this approval.

RESOLUTION AUTHORIZING THE TOWN OF HYDE PARK TOWN SUPERVISOR TO EXECUTE A
CHANGE ORDER EXTENDING THE TERM FOR SHARED SEVICES AGREEMENT (IMA) BETWEEN
THE TOWN OF HYDE PARK AND THE COUNTY OF DUTCHESS FOR SNOW REMOVAL SEASON
WHEREAS, the County of Dutchess owns, operates, and maintains a system of County highways
located within the Town of Hyde Park; and
WHEREAS, Section 135-a of the Highway Law authorizes a county or its superintendent of highways
to contract with any city, town, or village for the removal of snow from County roads and for sanding
or otherwise treating such roads for the purpose of removing the danger of ice and snow, upon such
terms and conditions as may be agreed upon and subject to the approval by resolution of the
legislative body of each municipality; and
WHEREAS, Article 5-G of the General Municipal Law, and Section 119-o thereof, further authorizes
municipal corporations to enter into agreements for the performance among themselves, or one for the
other, of their respective functions, powers, and duties on a cooperative or contract basis, such
agreements to be approved by a majority vote of the voting strength of the governing body of each
participating municipal corporation; and
WHEREAS, the Dutchess County Legislature adopted Resolution No. 2026065 on May 19, 2026,
authorizing the County Executive or her designee to execute intermunicipal agreements for snow and
ice control services with municipalities within the County in substantially the form annexed thereto;
and
WHEREAS, the County has presented to the Town a proposed Intermunicipal Agreement for Snow
Removal and Ice Control Services for a term commencing October 1, 2026 and expiring September 30,
2027, which may be extended for two additional periods of one year each upon such terms and
conditions as the parties may thereafter agree; and
WHEREAS, Exhibit C to the proposed Agreement designates eight County Road segments within the
Town, Cream Street, Creek Road, Crum Elbow Road, Dutchess Hill Road, East Dorsey Lane, East
Market Street, North Cross Road, and St. Andrews Road comprising 13.71 centerline miles; and
WHEREAS, the proposed Agreement provides for compensation to the Town at the rate of $6,150.00
per centerline mile for the period October 1, 2026, through April 30, 2027, yielding $84,316.50 based
upon the mileage set forth in Exhibit C, payable fifty percent on December 1, 2026, and the balance
on or before April 30, 2027; and
WHEREAS, the Town possesses appropriate snow and ice removal equipment, sufficient snow and ice
control personnel, and sufficient materials on hand to perform the services contemplated by the
proposed Agreement, and the Superintendent of Highways has reviewed Exhibit C and has advised
that the Town is able to perform the work described therein; and
WHEREAS, the Town Board has reviewed the proposed Agreement together with the advice of the
Town Attorney and has determined that entering into the Agreement is in the best interests of the
Town and its residents and promotes the safety of the traveling public; and
WHEREAS, the Town Board has determined that the approval of the proposed Agreement constitutes
a Type II action under 6 NYCRR § 617.5(c), for which no further review is required under the State
Environmental Quality Review Act.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Hyde Park hereby
approves the Intermunicipal Agreement for Snow Removal and Ice Control Services between the
County of Dutchess and the Town of Hyde Park in substantially the form presented to the Board,
subject to such non-material modifications as the Town Attorney shall approve as to form; and
BE IT FURTHER RESOLVED, that the Town Supervisor is hereby authorized and directed to execute
and deliver the said Agreement on behalf of the Town, together with such other documents as may be
necessary to carry the same into effect, including the electronic payment authorization form required
by the Dutchess County Comptroller; and
BE IT FURTHER RESOLVED, that prior to execution the Town Supervisor and the Town Attorney are
directed to request that the County (a) revise Section VIII of the Agreement so that the Town’s
obligation to defend and indemnify is limited, to the fullest extent permitted by law, to claims to the
extent caused by the negligence or willful misconduct of the Town, its officers, employees, and agents,
is reciprocal as to the County, and is conditioned upon prompt written notice and tender of the
defense by the County; and (b) correct the reference in Section VII of the Agreement so that the
assigned County road mileage is identified as appearing in Exhibit C rather than Exhibit A; and
BE IT FURTHER RESOLVED, that execution of the Agreement is further conditioned upon
confirmation by the Town’s insurance carrier or broker that the coverages, endorsements, waivers of
subrogation, and additional insured status required by Section IX of the Agreement can be provided,
and upon delivery to the County of a conforming certificate of insurance approved by the County’s
Director of Risk Management prior to the commencement of work; and
BE IT FURTHER RESOLVED, that in the event the County declines to make the revisions described
above, the Town Attorney shall report that fact to the Town Board before the Agreement is executed, so
that the Board may determine whether to proceed; and
BE IT FURTHER RESOLVED, that the Superintendent of Highways is directed to verify the centerline
mileage set forth in Exhibit C prior to execution, and, during the term of the Agreement, to maintain
records of labor hours, equipment hours, and materials applied that are attributable to the County
roads covered by the Agreement, so that any request for an adjustment to the payment terms arising
from unusual weather conditions may be supported by documentation; and

RESOLUTION CLARIFYING RETAIL CANNABIS SPECIAL USE PERMIT GRANTED TO COOL
SUNNY LLC, DESIGNATING ISSUING OFFICER, AND CORRECTING RECITAL
WHEREAS, by Resolution 6:8 – 8 of 2026, adopted June 8, 2026, the Town Board of the Town of Hyde
Park granted a Retail Cannabis Special Use Permit to Cool Sunny LLC (the “Applicant”) for the
operation of a retail cannabis dispensary at 701 Violet Avenue, Hyde Park, New York, Tax Parcel No.
6164-04-595147 (the “Property”), in the Neighborhood Business District (the “Permit”); and
WHEREAS, the Permit was granted subject to conditions numbered 1 through 11 of Resolution 6:8 – 8
of 2026, which by the terms of that Resolution are to be satisfied prior to the issuance of the Retail
Cannabis Special Use Permit certificate and prior to the issuance of any building permit or certificate
of occupancy, and subject to the performance standards numbered 12 through 19, which apply
throughout the term of the Permit; and
WHEREAS, by Resolution No. 2025-65A, adopted May 6, 2026, the Planning Board granted
conditional site plan approval and authorized its Chairperson or her authorized designee to sign the
approved site plan set upon compliance with four conditions, the third of which is the issuance of a
special use permit for retail cannabis from the Town Board; and
WHEREAS, condition 11 of Resolution 6:8 – 8 of 2026 requires that all conditions of Planning Board
Resolution No. 2025-65A be satisfied and that the approved site plan set be signed prior to the
issuance of the permit certificate, and questions have arisen as to the order in which the conditions of
the two resolutions are to be satisfied; and
WHEREAS, §108-8.6D(1)(a) of the Town Code provides that a retail cannabis special use permit is a
type of special use permit as contemplated by Chapter 108 and not an additional permit, §108-8.6G
provides that the decision of the Town Board shall be in writing, and §108-8.6G(1) provides that such
decision shall state that the retail cannabis special use permit is granted, granted with conditions, or
denied; and
WHEREAS, the operative provision of Resolution 6:8 – 8 of 2026 states that the Town Board “hereby
grants” the Permit, from which it follows that the Permit was granted on June 8, 2026, and that the
conditions set forth in that Resolution are conditions upon the issuance of the permit certificate and
upon the issuance of any building permit or certificate of occupancy rather than conditions upon the
grant itself; and
WHEREAS, Chapter 108 does not designate an officer of the Town to issue the permit certificate
provided for in Resolution 6:8 – 8 of 2026, and §108-8.6H provides that upon the granting of a special
use permit any conditions must be met in connection with the issuance of permits by applicable
enforcement agents or officers of the Town; and
WHEREAS, §108-30.2B charges the Zoning Administrator with receiving and processing all
applications under Chapter 108 for special use permits, §108-30.1A prohibits any board, agency,
officer, or employee of the Town from issuing, granting, or approving any permit, license, certificate, or
other authorization for any use of land or structures that is not in full compliance with Chapter 108,
and §108-30.4C requires the Zoning Administrator to certify compliance with the requirements of
Chapter 108 other than the Building Code as a condition of the validity of any certificate of occupancy,
such that the Zoning Administrator is the officer appropriately charged with issuance of the permit
certificate; and

WHEREAS, §108-32.1 establishes the certificate of occupancy as the authorizing document for the use
of land and structures in the Town, and § 108-32.1C(2)(a) requires that a certificate of occupancy
identify by reference or attachment any special use permit applicable to the use authorized thereby;
and
WHEREAS, the second recital of Resolution 6:8 – 8 of 2026 states that the Property has frontage on
Albany Post Road, whereas the Property in fact has frontage on Violet Avenue, also known as New
York State Route 9G, which is likewise a State highway, so that the requirement of § 108-8.6D(1)(c)
that the Property have frontage on a state road or highway is satisfied notwithstanding the
misidentification; and
WHEREAS, §108-8.6B of the Town Code excludes state or federally owned land, and uses operated by
the state or federal government, from the definition of limitation uses, and the Town Board’s finding
that the Property is not located within 500 feet of any limitation use was and is made with reference to
that exclusion; and
WHEREAS, the Town Board wishes to clarify the foregoing matters of sequence and administration,
and to correct the recital identified above, without altering the substance of Resolution 6:8 – 8 of 2026,
the conditions imposed thereby, or the determinations made therein.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Hyde Park hereby
resolves as follows:
1. Permit previously granted; Planning Board condition satisfied. The Town Board
confirms that the Retail Cannabis Special Use Permit was granted to Cool Sunny LLC on
June 8, 2026, upon the adoption of Resolution 6:8 – 8 of 2026, and that condition 3 of
Planning Board Resolution No. 2025-65A is thereby satisfied. No further action of the Town
Board is required in order for the Chairperson of the Planning Board or her authorized
designee to sign the approved site plan set upon satisfaction of the remaining conditions of
Resolution No. 2025-65A.
2. Designation of issuing officer. The Zoning Administrator is hereby designated as the
officer of the Town charged with issuing the Retail Cannabis Special Use Permit certificate
referenced in Resolution 6:8 – 8 of 2026. Issuance shall be ministerial and shall occur upon
the Zoning Administrator’s confirmation that conditions 1 through 11 of that Resolution
have been satisfied, provided that satisfaction of conditions 7 and 8 shall be confirmed by
the Chief of Police and satisfaction of condition 11 shall be confirmed by the signature of
the Chairperson of the Planning Board or her authorized designee upon the approved site
plan set. The Applicant need not return to the Town Board for any further resolution in
connection with the issuance of the certificate.
3. Date of certificate; term and expiration dates. The Zoning Administrator shall date the
certificate upon issuance and shall transmit a copy to the Town Clerk. Consistent with
Resolution 6:8 – 8 of 2026, the three-year term of the Permit shall run from the date of
issuance of the certificate. The Zoning Administrator shall calendar the expiration of that
term and shall notify the Applicant in writing not less than 180 days prior to expiration of
the requirement under §108-8.6K(2) that any application for renewal be subject to the same
requirements and review standards as an initial application. The Zoning Administrator
shall further calendar June 8, 2028, being two years from the date of approval of the
Permit, as the date upon which the Permit expires under §108-8.6I(1) if a certificate of
occupancy has not been issued. Upon issuance of a certificate of occupancy for the
Property, the Zoning Administrator shall ensure that the certificate identifies the Permit by
reference or attachment as required by §108-32.1C(2)(a).
4. Correction of recital. The second recital of Resolution 6:8 – 8 of 2026 is corrected to read
that the Property is located in the Neighborhood Business District and has frontage on
Violet Avenue, also known as New York State Route 9G, a State highway. The Town Board
reaffirms its determination that the requirement of §108-8.6D(1)(c) is satisfied.

5. Limitation uses. The Town Board clarifies that its finding that the Property is not located
within 500 feet of any limitation use as defined in §108-8.6B was made with reference to
the exclusion set forth in that definition for state or federally owned land and for uses
operated by the state or federal government.
6. No amendment; no new determination. Nothing in this Resolution shall be construed as
a new or amended determination upon the application of Cool Sunny LLC, as an
amendment to or waiver of any condition or performance standard imposed by Resolution
6:8 – 8 of 2026, or as a reopening of any proceeding upon that application. Resolution 6:8 –
8 of 2026 remains in full force and effect according to its terms, and the Permit continues
to be subject to suspension and revocation as provided in §108-8.6J and §108-8.6L. This
Resolution is administrative and clarifying in nature, effects no change in the use of land,
and accordingly requires no public hearing, no referral under §239-m of the General
Municipal Law, and no further determination under the State Environmental Quality
Review Act.
7. Filing and distribution. Within five business days of the adoption of this Resolution, the
Town Clerk shall cause a copy of this Resolution to be filed in the office of the Town Clerk,
with additional copies delivered to the Zoning Administrator, the Building Inspector, the
Chief of Police, and the Planning Board. The Town Clerk shall confirm in writing to the
Zoning Administrator that Resolution 6:8 – 8 of 2026 was filed and delivered as required by
§108-8.6H.

WHEREAS, the Town of Hyde Park permits licensed adult-use retail cannabis dispensaries, having
repealed its retail dispensary opt-out by Local Law No. 2-2022; and
WHEREAS, the Town Board has reviewed § 108-8.6 of the Town Code (“Retail cannabis
establishments,” added by Local Law No. 3-2024) and has determined that certain conditions of the
retail cannabis special use permit are inconsistent with, or preempted by, New York State law and
cannot lawfully be carried out specifically, the requirement of a criminal “background investigation” by
the Chief of Police (§ 108-8.6(E)(2)), provisions vesting the Chief of Police with control over the
applicant’s security plan, surveillance system, and product storage (§ 108-8.6(E)(1)(h)), and a
conviction-based ground for denial or revocation that does not conform to Article 23-A of the
Correction Law (§ 108-8.6(J)(5)) (HYDE PARK CODE at 501); and
WHEREAS, the New York State Cannabis Law (including § 131) and the regulations of the Office of
Cannabis Management at 9 NYCRR Part 119 preempt local laws pertaining to the operation or
licensure of adult-use cannabis licenses and reserve to municipalities only limited time, place, and
manner authority, and the Cannabis Control Board and the Office of Cannabis Management determine
applicant and licensee fitness through the State licensing process; and
WHEREAS, the Town Board wishes to introduce and consider proposed Local Law No. B of 2026 to
amend § 108-8.6 to conform the Town Code to State law; and
WHEREAS, a copy of the proposed Local Law is annexed hereto and has been placed before each
member of the Town Board.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1.

Introduction: Proposed Local Law No. B of 2026, entitled “A Local Law to amend Chapter 108
(Zoning) of the Code of the Town of Hyde Park, § 108-8.6 (Retail cannabis establishments), to
conform the Town’s retail cannabis special use permit requirements to New York State law,” in
the form annexed hereto, is hereby introduced before the Town Board of the Town of Hyde
Park.

SEQRA Determination: The Town Board hereby determines that the adoption of the proposed
Local Law is a Type II action pursuant to the State Environmental Quality Review Act and 6
NYCRR 617.5(c)(33) and 6 NYCRR 617.5(c)(26), that it will not result in any significant adverse
environmental impact, and that no further review under SEQRA is required. The Town Board
directs that a Part 1 Environmental Assessment Form documenting this determination be
completed and placed in the record.

Referral: The proposed Local Law shall be referred to the Town Planning Board for review and
recommendation, and, to the extent required by General Municipal Law §§ 239-m and 239-n,
to the Dutchess County Department of Planning and Development, prior to the public hearing
or Town Board action.

4.

Public Hearing: The Town Board shall hold a public hearing on the proposed Local Law on
October 13, 2026, at 6:05pm, at Town Hall 4383 Albany Post Road Hyde Park, NY 12538, at

Intent of Proposed Action. The proposed action is the adoption of a local law amending the Town's zoning text at Section 108-8.6. The amendment
(a) repeals the requirement that cannabis operators undergo a criminal background investigation by the Chief of Police; (b) revises the security-plan

WHEREAS, an action entitled Andre-Nigel Barnett v. Letitia Ann James, et al., Case No. 26-cv-03048
(JGLC), is pending in the United States District Court for the Southern District of New York, in which
the plaintiff, appearing pro se, has named the Town of Hyde Park as a defendant and has asserted
allegations against Town police officers, the Justices of the Town Justice Court, and other officers and
employees of the Town, arising out of vehicle and traffic enforcement, prosecution and adjudication
commencing on or about January 16, 2023; and
WHEREAS, a summons and amended complaint in that action have been delivered to the Town,
directed to the attention of the Supervisor, and the matter has been reported to the Town’s liability
carrier, the Town neither admitting nor conceding by this resolution the sufficiency of process or of
service of process upon the Town or upon any individual defendant; and
WHEREAS, the acts and omissions alleged in the amended complaint are alleged to have occurred in
the course of the performance by Town officers and employees of their official duties and
responsibilities; and
WHEREAS, the Town maintains liability coverage through the New York Municipal Insurance
Reciprocal (“NYMIR”), and NYMIR has assigned the firm of Drake Loeb PLLC, 555 Hudson Valley

election, appointment or employment in the service of the Town, whether or not compensated — in any
civil action or proceeding arising out of an alleged act or omission occurring while the employee was
acting within the scope of public employment or duties (Town Code §§ 18-3, 18-5(A)), and further
provides for the defense and indemnification of duly appointed police officers of the Town consistent
with General Municipal Law § 50-j (Town Code § 18-5(H)).
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby approves and accepts the
assignment by NYMIR of Drake Loeb PLLC as counsel for the Town of Hyde Park and for the Town’s
elected and appointed officers, employees, volunteers, police officers, Town Justices and court
personnel who are named, or who may hereafter be named, as defendants in the above-referenced
action, in their official capacities and in their individual capacities, and authorizes that firm to appear
in the action, to answer or move with respect to the amended complaint and any further amended or
supplemental pleading, to conduct and respond to discovery, to make and oppose motions, to appear
at all conferences and proceedings, to prosecute or defend any appeal, and to take all other steps
counsel deems necessary or appropriate in the defense of the Town and of the individual defendants;
and
BE IT FURTHER RESOLVED, that, pursuant to Town Law § 65(1), no officer or employee of the Town
shall retain or employ other legal counsel in connection with this action except as directed by the
Town Board, and the Town Attorney is authorized and directed to coordinate with assigned counsel

and with NYMIR, to furnish such records, information and assistance as assigned counsel may
require, and to report to the Board on the progress of the action; and
BE IT FURTHER RESOLVED, that each officer and employee of the Town who has been served with
process in this action, and who has not already done so, is directed to deliver copies of all papers so
served to the Town Attorney forthwith, and that, to the extent strict compliance with the five-day
period prescribed by § 18-7 of the Town Code has not occurred, the Town Board, finding no resulting
prejudice to the Town or to its carrier, waives such strict compliance as a condition of the defense
authorized by this resolution, without waiving the continuing obligation of cooperation imposed by
that section; and
BE IT FURTHER RESOLVED, that nothing in this resolution shall be construed as an admission of
any allegation of the amended complaint, or as a waiver of any defense, immunity, privilege or right
available to the Town or to any officer, employee or justice of the Town, including but not limited to
absolute judicial immunity, qualified immunity, governmental function immunity, sovereign and
statutory immunities, insufficient process and insufficient service of process, and all other defenses
available under the Federal Rules of Civil Procedure and applicable limitations periods; and
BE IT FURTHER RESOLVED, that in the event a conflict of interest is determined to exist between the
Town and any officer or employee, or among officers or employees, with respect to the defense of this
action, the matter shall be addressed in accordance with § 18-5(D) of the Town Code, and the Town
Board will consider the retention of separate counsel upon the recommendation of the Town Attorney
and in consultation with NYMIR and assigned counsel; and
BE IT FURTHER RESOLVED, that all Town departments, officers and employees are directed to
preserve and maintain, pending further direction from assigned counsel, all records, materials and
evidence in the Town’s possession or control pertaining to the subject matter of this action, including
correspondence, electronic mail, audio recordings, video recordings, photographs, dispatch and
incident records, and other electronically stored or computer-generated data, and to suspend any
routine disposition or destruction of such materials notwithstanding any otherwise applicable records
retention schedule; and, with respect to records of the Town Justice Court, this direction shall be
carried out in a manner consistent with the administration of that Court and the requirements of the
Unified Court System; and
BE IT FURTHER RESOLVED, that all Town officers and employees are directed to cooperate fully with
assigned counsel, with NYMIR and with investigators retained by NYMIR in the defense of this action,
and, except as otherwise required by law or by the proper discharge of their official duties, to refer
inquiries concerning the action to assigned counsel; and
BE IT FURTHER RESOLVED, that the Supervisor is authorized to execute, on behalf of the Town,
such acknowledgments, authorizations and other documents as may be necessary to effectuate the
representation authorized by this resolution, and that all actions heretofore taken by the Supervisor,
the Town Attorney, NYMIR and assigned counsel in connection with the tender and defense of this
action are hereby ratified, confirmed and approved; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to deliver a certified copy of this
resolution to Michael J. Barfield, Esq., Drake Loeb PLLC; to NYMIR; to the Town Attorney; to the Chief
of Police; to the Justices of the Town Justice Court; and to the Court Clerk.

RESOLUTION INTRODUCING A LOCAL LAW TO AMEND THE TOWN ZONING MAP TO REZONE
THE PARCEL LOCATED AT 532 SALT POINT TURNPIKE, HYDE PARK (TAX PARCEL ID: 1332006263-03-421439), FROM THE GREENBELT DISTRICT TO THE NEIGHBORHOOD BUSINESS
DISTRICT, REFERRING THE LOCAL LAW TO THE TOWN AND COUNTY PLANNING BOARDS AND
SETTING A PUBLIC HEARING
WHEREAS, the Town Board of the Town of Hyde Park has received a petition requesting an
amendment to the Town Zoning Map to rezone the parcel located at 532 Salt Point Turnpike, Town of
Hyde Park, Dutchess County, New York, designated as Tax Parcel No. 133200-6263-03-421439, from
the Greenbelt (GB) Zoning District to the Neighborhood Business (NB) Zoning District; and
WHEREAS, the purpose of the rezoning is to allow for neighborhood-scaled commercial uses in an
area currently designated for more limited rural and agricultural development, in accordance with
evolving community needs and economic development goals; and
WHEREAS, the proposed rezoning is consistent with the Town of Hyde Park’s Comprehensive Plan,
which emphasizes fostering organic growth and expanding the economic base by encouraging mixeduse development in community centers while preserving open space in outlying areas; and
WHEREAS, the Comprehensive Plan’s Concept Map identifies the area surrounding 532 Salt Point
Turnpike as a preferred growth center, supporting the transition to a Neighborhood Business District
to align with existing commercial uses and neighborhood cores; and
WHEREAS, the proposed rezoning aligns with the strategic directions outlined in the Comprehensive
Plan, including channeling higher-density development to infrastructure-ready locations and
preserving natural/open space in outlying areas; and
WHEREAS, pursuant to Section 108-34.1 of the Town Code and New York State Town Law §265, the
Town Board must introduce a local law in order to effectuate such a zoning map amendment; and
WHEREAS, pursuant to the State Environmental Quality Review Act (SEQRA), the proposed action is
a Type I action and is subject to environmental review, for which the Town Board hereby declares its
intent to serve as Lead Agency; and
WHEREAS, pursuant to Section 239-m of the New York State General Municipal Law, the proposed
amendment must be referred to the Dutchess County Department of Planning and Development for
review; and
WHEREAS, the Town Board also wishes to refer to the proposed zoning amendment to the Hyde Park
Planning Board for its advisory opinion as required by Town Code §108-34.1; and
WHEREAS, a public hearing must be held by the Town Board before adoption of any local law
amending the zoning map.
NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Hyde Park that:
1. A proposed local law entitled “Local Law No. C of 2026 – A Local Law Amending the Town
Zoning Map to Rezone the Parcel Located at 532 Salt Point Turnpike, Hyde Park, New York, Tax
Parcel No. 133200-6263-03-421439, from the Greenbelt District to the Neighborhood Business
District” is hereby introduced.

2. The Town Board hereby declares its intent to act as Lead Agency for the SEQRA review of this
Type I action and authorizes the circulation of a Notice of Intent to all involved agencies.
3. The proposed local law and supporting materials are hereby referred to:
o

The Hyde Park Planning Board for an advisory opinion pursuant to Town Code §10834.1.

o

The Dutchess County Department of Planning and Development pursuant to GML
§239-m.

4. A public hearing on the proposed local law is hereby scheduled for October 13, 2026, at
6:05pm, at the Hyde Park Town Hall, 4383 Albany Post Road, Hyde Park, NY 12538.
5. The Town Clerk is hereby directed to publish and post notice of said public hearing in
accordance with the Town Code and applicable New York State law.
6. The applicant shall notify all owners of property located within 300 feet of the boundaries of the
subject parcel of the proposed zoning amendment and the scheduled public hearing, no later
than ten (10) calendar days prior to the date of the public hearing in accordance with the
procedures set forth herein, and shall file proof of such notification with the Town Clerk prior
to the hearing.

A LOCAL LAW AMENDING THE TOWN OF HYDE PARK ZONING MAP TO REZONE THE
PARCEL LOCATED AT 532 SALT POINT TURNPIKE, HYDE PARK, NEW YORK, TAX PARCEL
NO. 133200-6263-03-421439, FROM THE GREENBELT DISTRICT TO THE NEIGHBORHOOD
BUSINESS DISTRICT
BE IT ENACTED, by the Town Board of the Town of Hyde Park as follows:
SECTION 1. TITLE
This Local Law shall be known as “Local Law No. C of 2026 Amending the Town of Hyde Park Zoning
Map for the Rezone of 532 Salt Point Turnpike.”
SECTION 2. LEGISLATIVE INTENT
The purpose of this Local Law is to rezone the parcel located at 532 Salt Point Turnpike, Town of Hyde
Park, Tax Parcel No. 133200-6263-03-421439, from the Greenbelt (GB) District to the Neighborhood
Business (NB) District in order to better align permitted uses on the site with surrounding development
patterns, economic goals, and community needs.
The Town Board finds that this rezoning is consistent with the purposes and intent of the Town Zoning
Law and the Town’s Comprehensive Plan.
SECTION 3. ZONING MAP AMENDMENT
The Zoning Map of the Town of Hyde Park, adopted as part of Chapter 108 of the Town Code entitled
“Zoning,” is hereby amended by changing the zoning district designation of the parcel located at 532
Salt Point Turnpike, Hyde Park, New York, and identified as Tax Parcel No. 133200-6263-03-421439,
from the Greenbelt (GB) District to the Neighborhood Business (NB) District.
SECTION 4. SEVERABILITY
If any provision of this Local Law is found to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the remainder of this Local Law.
SECTION 5. EFFECTIVE DATE
This Local Law shall take effect immediately upon: Filing with the Secretary of State of the State of
New York.
