This item is before the City Council for a first reading and a public hearing.
First Reading. Deputy City Clerk to read Bill #3066, by title only. This will
conclude the first reading, no motion will be conducted.
Public Hearing. The City Council will hold a Public Hearing in accordance
with §400.1910. The conduct for the public hearing should be as follows:

DESCRIPTION:
Request. To allow for "outdoor display and storage" associated with the new
Rick's Ace Hardware, located at the tenant space addressed 9612 Olive
Boulevard.
What is a special permit? A special permit is a land use that is recognized
by the underlying zoning district but is not called out as a permitted use by
right. The purpose of a Special Permit is to carefully review uses which need
extra deliberation to ensure the surrounding area is not adversely impacted.
A defined procedure for review and approval is established for these uses
that considers specific safety, design, and community-compatibility reviews
conducted by the City's Planning and Community Design Commission and
approved by the City Council.
Under Article XII Special Permit, the special permit procedure defined
provides a basis for the City to determine the suitability of certain specified
uses under prescribed conditions. These uses are not permitted uses (by
right), except through the special permit use procedure provide a process to
determine if a use would be suitable and compatible through the
interpretation by both the Commission and City Council.
In simple terms, the use is not permitted by right but "may be" compatible
with the district under certain conditions. These uses tend to have a unique
operation or requirement that some oversight, or manage conditions, would
minimize any negative effects on the site or surroundings. The Code, in
some cases, will also impose additional regulations that normally would not
be placed on a permitted use by right, such as hours of operations,
limitations on occupancy, landscape/buffer mitigation, etc.
Zoning. The property grounds are zoned "COR" Commercial/Office/Retail
District. The "COR" District is a designated zoning district under Chapter 400
Zoning Regulations, of Title IV Land Use of the Olivette Municipal Code. The
district is intended to exhibit a mix of businesses, services and residential
options developed collaboratively to meet the specific needs of the community.
As a special permit, outdoor display and storage (§400.740 Exhibit Table A:
Authorized Uses) may be authorized following review and recommendation
from the Planning and Community Design Commission, holding of a public
hearing, and approval by the City Council.
Why is this before the City Council? All special permit requests, including
major amendments, are reviewed and acted upon by the City Council through
an ordinance-following a review and recommendation from the Commission
and a public hearing.
PUBLIC HEARING. As previously noted, a public hearing is required prior to
consideration by the Council. As per §400.1090, the City is required to post
notice of the hearing 15 days prior to the scheduled date. A public notice was
published on July 27, 2026, in The Countian -St. Louis County, the newspaper
of designation and general circulation for the City of Olivette.
COMMISSION REVIEW AND RECOMMENDATION:
On July 2, 2026, the Commission reviewed the Petition for the subject special
Permit request for outdoor display and storage, including approval of the
proposed site improvement plans. The Commission found the request would
comply with the purpose and intent of the COR District, would be suitable and
compatible with the surrounding site and operations, and would further the
vision and objectives of the 2026 Comprehensive Plan Update.
The
Commission approved a recommendation for the City Council to authorize
issuance of a Special Permit request subject to the following conditions:
1. Amended the site improvement plans to relocated the covered outdoor display area
from the current proposed location west to the drive aisle nearest to the main
building structure to minimize the distance a pedestrian would access the area from
the main entrance.
2. Limit the placement of the covered outdoor display area to four (4) months out of
the calendar year.
A revised site improvement plan reflecting the placement requested by the
Commission has been provided, and included in the Exhibit, for this bill.

9600 AND 9606 OLIVE BOULEVARD, TO PERMIT RICK'S ACE HARDWARE TO
OPERATE AN OUTDOOR DISPLAY AND STORAGE AREA ON THE EAST PARKING
LOT PORTION ASSOCIATED WITH THEIR TENANT SPACE ADDRESSED AS 9612
OLIVE BOULEVARD
WHEREAS, on May 21, 2026, Vickie Busatto, Executive Vice President and Chief Operating Officer
Director for Rick's Ace Hardware ("Petitioner"), submitted a petition for outdoor display and storage of
merchandise on part of the property grounds of Olivette Center, the multi-tenant shopping center addressed
as 9600 and 9606 Olive Boulevard (“Property”), specifically on the east side of the tenant space addressed
as 9612 Olive Boulevard; and
WHEREAS, the Property is owned by OL3BP Associates, LLC ("Owner"), and is managed by
Bianco Properties and consist of an improved 4.7-acre parcel containing an 80,118 square foot multi-tenant
commercial building, developed originally in 1957; and
WHEREAS, the Property grounds are zoned “COR” Commercial/Office/Retail District (“COR
District”) and the purpose and intent of the COR District is to exhibit a mix of businesses, services and
residential options developed collaboratively to meet the specific needs of the community and "outdoor
display and storage" of merchandise associated with a permitted use on the lot grounds is authorized only
through a special permit use; and
WHEREAS, the special permit procedure, as outlined under Article XII Special Permits (“Article
XII”), being part of Chapter 400 Zoning Regulations of Title IV Land Use of the Olivette Municipal Code,
provides the basis for the City to determine the suitability of certain specified uses under prescribed
conditions, these uses are not permitted uses except as otherwise determined to be suitable and compatible
by the Commission and City Council, and the City reserves the full discretion to deny any such application
or to revoke any such approval based upon a finding that an established special permit usage has become
unsuitable and incompatible with its surroundings or that the conditions of approval are not being observed;
and
WHEREAS, the request by the Petitioner is for the placement of

Outdoor merchandise to be displayed under the existing covered sidewalk facing Olive
Boulevard along the north face of the tenant space; and
Outdoor merchandise to be displayed along and adjacent to the east face of the tenant
space facing the parking lot between the main entrance and the dock doors located on the
far south end of the east building face; and
Outdoor merchandise to be displayed under an erected 48-foot by 30-foot wide opened
framed covered canopy located on the drive aisle closest to the east face of the tenant
space, and
WHEREAS, under Article XII, additional prescribed conditions are noted for location, enclosure,
and operations (§400.1223.G.11) and said petition is found to be compliant; and
WHEREAS, on July 2, 2026, the petition for the Special Permit Use request was introduced to the
Olivette Planning and Community Design Commission (“Commission”), including a presentation by staff,
an overview of operations and proposed improvements from the Petitioner, and the receipt of public
comments; and
WHEREAS, on June 2, 2026, the Commission found the petition request complied with the
purpose and intent of the COR District, would be suitable and compatible with the surrounding site and
operations, and would further the vision and objectives of the 2026 Comprehensive Plan Update; and
WHEREAS, the Commission motioned to approve the Petition for a special Permit request,
including the site improvement plans as authorized under Site Plan Review, and recommend to the City

WHEREAS, in accordance with the procedures outlined under Article XI Site Plan Review, Section
400.1090 Site Plan Review Procedures for Special Permit or Rezoning under Chapter 400 Zoning
Regulations due and lawful notice of a public hearing on the special permit request, to be held by the City
Council on August 11, 2026, at 7:00 PM in the City Council Chambers at the Olivette City Center, 1140
Dielman Road, Olivette, Missouri, was published in The Countian - St. Louis County, a newspaper of
general circulation in the City of Olivette, on Monday, July 27, 2026; and
WHEREAS, a public hearing was duly and properly held by the City Council at the time and place
provided for in the notice and all comments, statements, objections, and suggestions concerning the special
permit request were duly heard and considered by the City Council; and
WHEREAS, the City Council, after careful and due deliberation, has determined that the proposed
special permit request is in the interest of the public health, safety, welfare, and morals of the City of Olivette.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OLIVETTE, ST. LOUIS COUNTY,
MISSOURI, AS FOLLOWS
Section One.
The Olivette City Council (“Council”) hereby approves and authorizes a Special Permit request for
Rick's Ace Hardware ("Petitioner") for the placement of

Outdoor merchandise to be displayed under the existing covered sidewalk facing Olive
Boulevard along the north face of the tenant space; and
Outdoor merchandise to be displayed along and adjacent to the east face of the tenant space
facing the parking lot between the main entrance and the dock doors located on the far south
end of the east building face; and
Outdoor merchandise to be displayed under an erected 48-foot by 30-foot wide opened framed
covered canopy located on the drive aisle closest to the east face of the tenant space, and
at the property grounds addressed as 9600 and 9606 Olive Boulevard (“Property”) in accordance with the
approved petition filed by the Petitioner, including the site improvement plans, hereto all attached as Exhibit
A, and with the following conditions:
• Full compliance with the standards and conditions for special permit uses for location, enclosure,
and operations noted under Section 400.1223.G.11 outdoor storage and outdoor display; and
• That the proposed48-foot by 30-foot wide opened framed covered canopy located on the drive aisle
closest to the east face of the tenant space be placed seasonally no more than four (4) months of
the calendar year.
• Use, placement, and operation, be maintained as presented in the Memorandum from the
Department of Planning and Community Development dated July 2, 2026.

Section Two.
A. The City Council may revoke this Special Permit Use if, after providing written notice and a hearing
to the Petitioner or its assigns, or to the occupant, the Council finds that
(a) the conditions and requirements of this Ordinance have not been fulfilled or otherwise have
been violated, or
(b) that the Petitioner, or its assigns, or the occupant of the property, has failed to comply with or
has otherwise violated a law or laws, whether state, local, or federal, applicable to the property
or its use.
The City may, but shall not be required to, provide an opportunity to cure if reasonably justified by
the circumstances then existing. The burden of proof to revoke the Special Permit Use shall be on
the City.
B. In addition, the City may cause a summons to be issued to the Petitioner, its assigns, or any
occupant of the property for any violation of the conditions of this Ordinance or any other ordinance
of the City, and upon conviction thereof, the Petitioner, its assigns, and/or occupant shall be subject
to punishment as provided in Section 100.180 of the Olivette Municipal Code.
Section Three.
Within ninety (90) days of the enactment of this Ordinance by the Olivette City Council, the
Developer shall record this Ordinance, including attachments, with the St. Louis Recorder of Deeds.
Section Four.
It is hereby declared to be the intention of the City Council that each and every part, section and
subsection of this Ordinance shall be separated and severable from each and every other part, section and
subsection hereof and that the City Council intends to adopt each said part, section and subsection
separately and independently of any other part, section and subsection. In the event that any part of this
Ordinance shall be determined to be or to have been unlawful or unconstitutional, the remaining parts,
sections and subsections shall be and remain in full force and effect.
Section Five.
This Ordinance shall be in full force and effect from and after its passage and approval as provided
by law.

DESCRIPTION:
Request. To allow for an automotive maintenance facility within the 5,015
square foot tenant space addressed as 10401 Baur Boulevard, Ste. B.
What is a special permit? A special permit is a land use that is recognized
by the underlying zoning district but is not called out as a permitted use by
right. The purpose of a Special Permit is to carefully review uses which need
extra deliberation to ensure the surrounding area is not adversely impacted.
A defined procedure for review and approval is established for these uses
that considers specific safety, design, and community-compatibility.
Under Article XII Special Permit, the special permit procedure defined
provides a basis for the City to determine the suitability of certain specified
uses under prescribed conditions. These uses are not permitted uses (by
right), except through the special permit use procedure provide a process to
determine if a use would be suitable and compatible through the
interpretation by both the Commission and City Council.
In simple terms, the use is not permitted by right but "may be" compatible
with the district under certain conditions. These uses tend to have a unique
operation or requirement that some oversight, or manage conditions, would
minimize any negative effects on the site or surroundings. The Code, in
some cases, will also impose additional regulations that normally would not
be placed on a permitted use by right, such as hours of operations,
limitations on occupancy, landscape/buffer mitigation, etc.
Zoning. The property grounds are zoned "LID" Light Industrial District. The
"LID" District is a designated zoning district under Chapter 400 Zoning
Regulations, of Title IV Land Use of the Olivette Municipal Code. The district
is intended to accommodate light industrial manufacturing and warehousing
activities at a scale and intensity of use that is compatible with the
development in the City of Olivette.
As a special permit,

indoor automobile detailing services,
automotive body, paint, and interior repair and maintenance (NAICS
811121),
automotive repair maintenance (NAICS 8111), and
any use which, in the judgment of the Commission, is identical or similar
to any of the above-listed uses and which conforms to the intent and
purpose and the lot size, height and yard regulations of the Zoning Code
may be authorized following review and recommendation from the Planning
and Community Design Commission, holding of a public hearing, and approval
by the City Council.
Why is this before the City Council? All special permit requests, including
major amendments, are reviewed and acted upon by the City Council through
an ordinance-following a review and recommendation from the Commission
and a public hearing.
PUBLIC HEARING. As previously noted, a public hearing is required prior to
consideration by the Council. As per §400.1090, the City is required to post
notice of the hearing 15 days prior to the scheduled date. A public notice was
published on July 27, 2026, in The Countian -St. Louis County, the newspaper
of designation and general circulation for the City of Olivette.
COMMISSION REVIEW AND RECOMMENDATION:
On July 2, 2026, the Commission reviewed the Petition for the subject special
Permit request for indoor automotive repair facility, including approval of the
proposed site improvement plans. The Commission found the request would
comply with the purpose and intent of the LID District, would be suitable and
compatible with the surrounding site and operations, and would further the
vision and objectives of the 2026 Comprehensive Plan Update.
The
Commission approved a recommendation for the City Council to authorize
issuance of a Special Permit request subject to the following conditions:

Only indoor automotive body, paint, and interior repair and maintenance (NAICS
811121), is authorized, and
• There shall be no outdoor storage, and
• Operations restricted to the hours of 8:00 AM to 5:00 PM, and
•
All exterior wall lighting along the south building elevation facing the creek and
Indian Meadows Park and Subdivision to be converted to wall pack light fixtures
that are cut-off and directed downward,
as illustrated in the petition application dated June 5, 2026, and as
amended by the Commission on July 2, 2026, as presented in the
Memorandum from the Department of Planning and Community
Development dated July 2, 2026, subject to any staff conditions noted
therein.

SPACE ADDRESSED AS 10401 BAUR BLVD, STE B
WHEREAS, on June 5, 2026, Corbin Holtzman and Alexandria Travers with PPM/Baur, LLC
("Petitioner" and "Property Owner"), submitted a petition to operate an indoor automotive repair facility
within the tenant space addressed as 10401 Baur Boulevard, Suite B ("Tenant Space"); and
WHEREAS, the Tenant Space is part of a multi-building and tenant office/warehouse complex
known as the Baur Business Park ("Property") owned and managed by PPM/Baur, LLC, and consist of a
6.6 acre parcel with four, multi-tenant flex buildings totaling 122,904 square feet built in 1988; and
WHEREAS, the Property grounds are zoned “LID” Light Industrial District (“LID District”) and the
intent and purpose of the "LID" District is to accommodate light industrial manufacturing and warehousing
activities at a scale and intensity of use that is compatible with the development in the City of Olivette and
an indoor automotive repair facility is authorized only through a special permit use; and
WHEREAS, the special permit procedure, as outlined under Article XII Special Permits (“Article
XII”), being part of Chapter 400 Zoning Regulations of Title IV Land Use of the Olivette Municipal Code,
provides the basis for the City to determine the suitability of certain specified uses under prescribed
conditions, these uses are not permitted uses except as otherwise determined to be suitable and compatible
by the Commission and City Council, and the City reserves the full discretion to deny any such application
or to revoke any such approval based upon a finding that an established special permit usage has become
unsuitable and incompatible with its surroundings or that the conditions of approval are not being observed;
and
WHEREAS, the request by the Petitioner is to lease a 5,015 square foot tenant space addressed
as 10401 Baur Boulevard, Suite B for operations of an Advanced Driver Assistance Systems (ADAS) sensor
calibration facility, including related light assembly, equipment testing, training, office, and ancillary
warehouse/storage use, and any other lawful use ancillary thereto; and
WHEREAS, under the "LID" District, said operations are similar to indoor automobile detailing
service and automotive body, paint, and interior repair and maintenance (NAICS 811121) and both uses
are permitted as special permit uses in the "LID" District; and
WHEREAS, under Article XII, automotive repair maintenance (NAICS 8111) use require additional
prescribed conditions, including a minimum land area of 80,000 square feet, and conditions for operations
and building and site design outlined as outlined in Section 400.1223.G.9, and the petition submitted
proposes operations to be consistent with the noted operations and the site improvement found to be
compliant with the noted building and site design; and
WHEREAS, on July 2, 2026, the petition for the Special Permit Use request was introduced to the
Olivette Planning and Community Design Commission (“Commission”), including a presentation by staff,
an overview of operations and proposed improvements from the Petitioner, and the receipt of public
comments; and
WHEREAS, on June 2, 2026, the Commission 2026, the Commission found the petition request
complied with the purpose and intent of the LID District, would be suitable and compatible with the
surrounding site and operations, and would further the vision and objectives of the 2026 Comprehensive
Plan Update; and
WHEREAS, the Commission motioned to approve the Petition for a Special Permit Use request,

WHEREAS, a public hearing was duly and properly held by the City Council at the time and place
provided for in the notice and all comments, statements, objections, and suggestions concerning the special
permit request were duly heard and considered by the City Council; and
WHEREAS, the City Council, after careful and due deliberation, has determined that the proposed
special permit request is in the interest of the public health, safety, welfare, and morals of the City of Olivette.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OLIVETTE, ST. LOUIS COUNTY,
MISSOURI, AS FOLLOWS
Section One.
The Olivette City Council (“Council”) hereby approves and authorizes a Special Permit request for the
Petitioner to lease a 5,015 square foot tenant space addressed as 10401 Baur Boulevard, Suite B for
operations of an Advanced Driver Assistance Systems (ADAS) sensor calibration facility, including related
light assembly, equipment testing, training, office, and ancillary warehouse/storage use, and any other
lawful use ancillary thereto, in accordance with the approved petition filed by the Petitioner, including the
site improvement plans, hereto all attached as Exhibit A, and the following conditions:

Section Two.
A. The City Council may revoke this Special Permit Use if, after providing written notice and a hearing
to the Petitioner or its assigns, or to the occupant, the Council finds that
(a) the conditions and requirements of this Ordinance have not been fulfilled or otherwise have
been violated, or

(b) that the Petitioner, or its assigns, or the occupant of the property, has failed to comply with or
has otherwise violated a law or laws, whether state, local, or federal, applicable to the property
or its use.
The City may, but shall not be required to, provide an opportunity to cure if reasonably justified by
the circumstances then existing. The burden of proof to revoke the Special Permit Use shall be on
the City.
B. In addition, the City may cause a summons to be issued to the Petitioner, its assigns, or any
occupant of the property for any violation of the conditions of this Ordinance or any other ordinance
of the City, and upon conviction thereof, the Petitioner, its assigns, and/or occupant shall be subject
to punishment as provided in Section 100.180 of the Olivette Municipal Code.
Section Three.
Within ninety (90) days of the enactment of this Ordinance by the Olivette City Council, the
Developer shall record this Ordinance, including attachments, with the St. Louis Recorder of Deeds.
Section Four.
It is hereby declared to be the intention of the City Council that each and every part, section and
subsection of this Ordinance shall be separated and severable from each and every other part, section and
subsection hereof and that the City Council intends to adopt each said part, section and subsection
separately and independently of any other part, section and subsection. In the event that any part of this
Ordinance shall be determined to be or to have been unlawful or unconstitutional, the remaining parts,
sections and subsections shall be and remain in full force and effect.
Section Five.
This Ordinance shall be in full force and effect from and after its passage and approval as provided
by law.

Description:

employees. The City of Olivette last adopted such ordinance on September 10,
2024.
A certified copy of the ordinance, once approved, must be forwarded to the MEC
within ten days of adoption, and the deadline for submitting the ordinance is September 15. Failure to adopt such an ordinance will require all elected and certain
appointed officials to file the Personal Financial Disclosure Statement – long form.

OFFICIALS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OLIVETTE, MISSOURI AS
FOLLOWS:
Article 1 - Ordinances
Section 115.080 Declaration of Policy.
The proper operation of municipal government requires that public officials and employees be
independent, impartial and responsible to the people; that government decisions and policy be made in the
proper channels of the governmental structure; that public office not be used for personal gain; and that
the public have confidence in the integrity of its government. In recognition of these goals, there is hereby
established a procedure for disclosure by certain officials and employees of private financial or other
interests in matters affecting the City.
Section 115.090 Conflicts of Interest.
A. All elected and appointed officials as well as employees of the City must comply with conflict of
interest Statutes under Chapter 105, RSMo., as well as any other State law governing official
conduct.
B.
Any Council Member who has a substantial personal or private interest in any measure, bill, order,
or ordinance proposed or pending before the Council must disclose that interest to the City Council
and that interest shall be recorded in the City Council meeting minutes.
C.
Substantial personal or private interest is defined in Section 105.450 et seq., RSMo. While Council
Members should review Section 105.450 et seq., RSMo., examples may include ownership by the
individual, spouse, or dependent children, whether singularly or collectively, directly or indirectly of

Ten percent (10%) or more of the business entity; or
2.
An interest having a value of ten thousand dollars ($10,000.00) or more, or
3.
The receipt of a salary, gratuity, or other compensation or remuneration of five thousand
dollars ($5,000.00) or more, per year from any individual, partnership, organization or association
within any calendar year.
Section 115.100 Disclosure Reports.
A. Each elected official, City Council candidate, the City Manager and the Finance Director shall
disclose the following information by May 1, or the appropriate deadline as referenced in Section
105.487, RSMo., if any such transactions were engaged in during the previous calendar year:
1.
For such person, and all persons within the first degree of consanguinity or affinity of such
person, the date and the identities of the parties to each transaction with a total value in excess of
five hundred dollars ($500.00), if any, that such person had with the City, other than compensation
received as an employee or payment of any tax, fee or penalty due to the City, and other than
transfers for no consideration to the City; and
2.
The date and the identities of the parties to each transaction known to the person with a total
value in excess of five hundred dollars ($500.00), if any, that any business entity in which such
person had a substantial interest, had with the City, other than payment of any tax, fee or penalty due
to the City or transactions involving payment for providing utility service to the City, and other than
transfers for no consideration to the City.
3.
The City Manager and the Finance Director also shall disclose by May 1 for the previous
calendar year the following information:
a.
The name and address of each of the employers of such person from whom income of one
thousand dollars ($1,000.00) or more was received during the year covered by the statement;
b.
The name and address of each sole proprietorship that he/she owned; the name, address and
the general nature of the business conducted of each general partnership and joint venture in which
he/she was a partner or participant; the name and address of each partner or co-participant for each
partnership or joint venture unless such names and addresses are filed by the partnership or joint
venture with the Secretary of State; the name, address and general nature of the business conducted
of any closely held corporation or limited partnership in which the person owned ten percent (10%)
or more of any class of the outstanding stock or limited partnership units; and the name of any
publicly traded corporation or limited partnership that is listed on a regulated stock exchange or
automated quotation system in which the person owned two percent (2%) or more of any class of
outstanding stock, limited partnership units or other equity interests;
c.
The name and address of each corporation for which such person served in the capacity of a
director, officer or receiver.
Section 115.110 Filing of Reports.
The reports, in the attached format, shall be filed with the City Clerk and with the Missouri Ethics
Commission. The reports shall be available for public inspection and copying during normal business
hours.
Section 115.120 When Filed.
A. The financial interest statements shall be filed at the following times, but no person is required to file
more than one (1) financial interest statement in any calendar year:
1.
Each City Council candidate shall file the statement no later than fourteen (14) days after the
close of filing for election candidacy;
2.
Each person, subject to this Article, employed by the City or appointed to office, shall file the
statement within thirty (30) days of such appointment or employment; and
3.
Every other person required to file a financial interest statement shall file the statement
annually not later than May 1 and the statement shall cover the calendar year ending the immediately
preceding December 31; provided that any member of the City Council may supplement the
financial interest statement to report additional interests acquired after December 31 of the covered
year until the date of filing of the financial interest statement.
Section 115.130 Officers and Employees Barred From Interest in City Contracts and Work.
No officer or employee elected or appointed in the City of Olivette shall be interested, directly or
indirectly, in any contract or job for work or materials or the profits in any contract or job or services to
be furnished or performed for the City; no such officer or employee shall be interested, directly or
indirectly, in any contract or job for work or material or the profits thereof or services to be furnished or
performed for any person, firm or corporation operating an interurban railway, street railway, gas works,
electric light or power plant, heating plant, telegraph line, telephone exchange or any other public utility
within the territorial limits of said City. No such officer or employee shall accept or receive, directly or
indirectly, from any person, firm or corporation operating within the territorial limits of said City any
interurban railway, street railway, gas works, water works, electric light or power plant, heating plant,
telegraph line or telephone exchange or other business using or operating under any public franchise any
frank, free ticket or free service, accept or receive, directly or indirectly, from any such person, firm or
corporation any other service upon terms more favorable than are granted to the public generally. Any
violation of the provisions of this Section shall be a misdemeanor and every such contract or agreement
shall be void. Such prohibition of free transportation shall not apply to Policemen or Firemen in uniform
provided such free transportation is given by virtue of a written contract or agreement between said City
and transportation company to that effect. Nor shall any free service to City Officials heretofore provided
by any franchise or ordinance be affected by this provision.
Article 2. Filing of Ordinance.
The City Clerk shall send a certified copy of this ordinance to the Missouri Ethics Commission within
ten days of its adoption.
Article 3. Effective Date.
This Ordinance shall be in full force and effect from and after the date of its passage and approval and
shall remain in effect until amended or repealed by the City Council.

Bill 3069 – An Ordinance Granting an Easement to Spire for the installation of an underground gas main
Description:
The Olive Intersections Cost-Share Project includes construction of a new storm sewer grated inlet and the
conversion of an existing inlet into a storm sewer manhole. During excavation, several unforeseen utility conflicts
were encountered, including fiber optic lines, a gas main, and a water distribution main. The existing 12-inch
ductile iron water main is too shallow to maintain the required vertical separation from the proposed storm sewer
structure. As a result, the new storm sewer inlet will likely need to be relocated behind the curb and redesigned
as a double curb inlet to provide adequate stormwater capacity. This revised design is currently under review
and will be constructed per MoDOT requirements.
Spire has determined that there is insufficient space to safely relocate its high-pressure gas main within the
originally proposed alignment. As a result, Spire has requested a permanent easement to relocate the gas main
around the proposed storm sewer structure. Granting this easement will allow the utility relocation to proceed
while maintaining the important safety separation.
The proposed easement area and relocated gas main do not adversely impact City use of 9201 Olive Blvd

Whereas, Spire will need a new easement from the City for the related facilities.

Section 1. The City hereby grants to Spire an easement in the locations described in

Easement Deed shall be in substantially the same in form and content as the Deed
attached as Exhibit A.
Section 2. The City Manager is hereby authorized to execute the Easement Deed on
behalf of the City and is further authorized to execute any other necessary documents to
effectuate the purpose of this Ordinance.

maintain a gas distribution system consisting of mains, piping, valves, service connections, appurtenances
and above ground structures along with the right to construct, maintain, alter, inspect, repair, replace,
protect, relocate, change the size of, operate and remove a cathodic protection rectifier or rectifiers,
anodes and cables thereto, and appurtenances for the production of cathodic protection currents therein,
in, under and across the following part of the aforesaid land, namely:
A ten-foot (10’) wide strip of land (“Easement”) in the above parcel as shown on “Easement
Exhibit”, together with the rights to use additional space adjacent to the above-described easement as
may be required during construction and the right of ingress to and egress from the above-described
land and contiguous land owned by Grantor. In exercising its rights of access, Grantee shall whenever
practical, use existing roads or lanes.
Grantee, its successors and assigns, will have the right to use and control a line or lines of
natural gas pipe for the circulation and distribution of natural gas for public or private use through the
above-described property for all proper purposes connected with the installation, use, maintenance, and
replacement of the line(s) of natural gas pipe, and with the attachment thereto of the service lines of its
customers. Furthermore, Grantee, its successors and assigns, will have the right to use and control a
cathodic protection rectifier or rectifiers, anodes and cables thereto, and appurtenances for the
production of cathodic protection currents therein through the above-described property for all proper
purposes connected with the installation, use, maintenance, and replacement of the cathodic protection
rectifier or rectifiers, anodes and cables thereto, and appurtenances for the production of cathodic
protection currents therein. Grantee has the right and privilege of removing at any time, any or all the
cathodic protection rectifier or rectifiers, anodes and cables thereto, and appurtenances to produce
cathodic protection currents therein without surrendering its easement rights stated herein.
Grantee has the right and privilege of removing at any time, any or all the line of natural gas
improvements without surrendering its easement rights stated herein. If the natural gas pipe to which
the service line connection(s) of the undersigned is abandoned, the service line (s) and the connection(s)
may be relocated to another natural gas pipe as directed by Grantee.
Grantors shall have the right to use and enjoy the above-described lands, except as to the
rights herein conveyed. Grantor agrees not to obstruct or interfere with the normal use or maintenance
of such pipeline or lines and any connections to the same along with cathodic protection rectifier or
rectifiers, anodes and cables thereto, and appurtenances to produce cathodic protection currents therein.
The undersigned also agrees not to erect or cause to be erected any building or structure on said
easement and not place fill in excess of five (5) feet on pipeline(s) or cathodic protection rectifier or
rectifiers, anodes and cables thereto, and appurtenances for the production of cathodic protection
currents therein, or remove overburden (cover) such that pipeline or cathodic protection rectifier or
rectifiers, anodes and cables thereto, and appurtenances for the production of cathodic protection
currents therein, does not have at least three (3) feet of remaining cover. Grantee shall also have the
right to clear and keep clear brush, trees, shrubbery, roots and other obstructions which, in Grantee’s
judgment, may interfere with the safe, proper and expeditious laying, construction, maintenance,
alteration, inspection, repair, replacement, protection, relocation, operation and removal of said pipe
line(s), lines and facilities, cathodic protection rectifier or rectifiers, anodes and cables thereto, and
appurtenances for the production of cathodic protection currents therein or any part thereof, within or
upon the above described land.
Grantor further reserves the right to make other improvements it desires on, over, in or near
the Easement Area and should Grantor’s improvements plan so require, Grantee will remove its gas
distribution system components, cathodic protection rectifier or rectifiers, anodes and cables thereto, and
appurtenances for the production of cathodic protection currents therein, from the referenced Easement
Area; provided however, that Grantor agrees to provide to Grantee written notice no less than 120
days before commencing work in connection with any such improvements. In connection with any such
improvement, Grantor agrees to provide detailed information regarding such improvements to Grantee
and to cooperate with Grantee to identify an alternate Easement Area owned or controlled by Grantor
and agreeable to both parties with respect to which Grantee would be accorded rights substantially
similar to those contemplated herein. In any such instance, the cost of removing and relocating the gas
distribution system components, cathodic protection rectifier or rectifiers, anodes and cables thereto, and
appurtenances to produce cathodic protection currents therein shall be paid by the Grantor if the
removal and relocation is made necessary by the actions of Grantor.
Grantor warrants and will defend the title to said easement during its existence with the
Grantee for its use and benefit against all parties whatsoever.
Grantee accepts this easement with the understanding and on the condition that whenever it
shall make any excavations in the above-described property the Grantee will properly backfill all
excavations and shall restore the ground as nearly as practicable to its former condition.

The fire department has a fleet of 17 portable Motorola radios. These radios were originally
purchased in 2016 with 911 tax funds by the Saint Louis County Emergency
Communications Commission. After this initial purchase, the responsibility for replacement
and maintenance falls to the city of Olivette.
In December 2023 the department received a notice from Motorola and Wireless USA that
parts will no longer be available and service support will be discontinued. As a result, the
department has set up a replacement cycle beginning with the FY25 Capital Improvement
Budget. The cycle will replace two radios each year moving forward. The department
purchased two radios in August 2025. This request is a continuation of this yearly cycle at
a cost FY27 for $17,529.50.
Should another grant opportunity become available the department will submit an
application to replace additional radios.

Description: The City of Olivette Fire Department has identified the need to replace its
frontline pumper with a new Rosenbauer Commander fire engine to ensure the
department continues to provide safe, reliable, and effective emergency response to the
community. The Rosenbauer Commander fire truck is a durable and versatile emergency
response vehicle designed to perform reliably in demanding firefighting situations. As
the department's primary fire suppression apparatus, the pumper responds to
approximately 1,700 emergency incidents each year, including structure fires, vehicle
fires, hazardous conditions, rescue incidents, and mutual aid responses throughout the
region.
Recommended Action: Motion to authorize the City Manager to execute the purchase of
one (1) Rosenbauer Commander Fire Engine through Sentinel Emergency Solutions an
agent of HGAC (Houston Galveston Area Council) Purchasing Program in an amount

The Fire Department is requesting authorization to purchase a Rosenbauer Commander pumper
through Sentinel Emergency Solutions using the Sourcewell cooperative purchasing contract.
Cooperative purchasing organizations such as Sourcewell and HGACBuy provide a streamlined,
compliant, and cost-effective method for procuring fire apparatus. These organizations competitively
solicit and award contracts on behalf of participating governmental entities, allowing fire
departments to satisfy public procurement requirements without conducting a separate, timeintensive bidding process.
The department has successfully utilized cooperative purchasing agreements to procure a variety of
essential equipment; including structural firefighting gear, a powered stair chair and a Lucas
mechanical chest compression device. The city's purchasing policy allows the use of cooperative
purchasing agreements.
The Rosenbauer Commander is the same apparatus platform currently utilized by the department,
providing significant operational and maintenance advantages because the current pumper will
become the City’s backup pumper. Maintaining a standardized fleet ensures that equipment,
components, and replacement parts remain interchangeable between the main line pumper and the
backup pumper, reducing inventory requirements while simplifying maintenance, repairs, and longterm fleet management.
Fleet standardization also enhances operator familiarity and technician proficiency, improving
overall operational efficiency.
In addition, the department currently utilizes Sentinel Emergency Solutions as its primary provider
for apparatus maintenance and repair services. Continuing with the same manufacturer and service
provider allows the department to maintain its existing service relationship while streamlining fleet
support through a single vendor, eliminating the need to coordinate maintenance among multiple
providers. Sentinel Emergency Solutions operates a full-service apparatus maintenance and repair
facility in Lemay, Missouri, offering comprehensive mechanical service, body repair, warranty
support, preventive maintenance, and emergency repair capabilities. The proximity and capabilities
of this facility provide the department with reliable access to technical support, helping maximize
apparatus availability and operational readiness.
By comparison, other manufacturers, including Pierce and E-ONE, do not maintain a local service
facility capable of performing major apparatus repairs. Consequently, apparatus requires significant

service may need to be transported out of state, resulting in longer repair times, increased
transportation costs, and extended periods of apparatus downtime.
For these reasons, the purchase of a Rosenbauer Commander pumper through Sentinel Emergency
Solutions using the Sourcewell cooperative purchasing contract represents the most efficient, costeffective, and operationally advantageous procurement option for the City of Olivette Fire

Chief Andreski stated that this spring, Olivette was designated a Blue Shield city, and as such
we are now able to apply for funding. This is a reimbursement grant and the department would
be able to make purchases after September 1, 2026. The available funding for the Olivette Police
Department in FY 2027 is $28,985.50.

The company used last year did not submit a bid.
Council Member Solomonov asked if there were any three-year bids. Ms. Tucker Knight stated
that there were not but we could ask next year. There is a lot of volatility in the market.
A motion was made by Council Member Jurgiel to authorize purchasing the 2026 youth soccer
uniforms from Challenger Sportswear, not to exceed $15,078. The motion was seconded by
Council Member Solomonov.

Minutes
The Olivette City Council met on August 4, 2026 at 7:35 p.m. via videoconferencing,
livestreaming, and in-person. Mayor Lewis called the meeting to order.
On roll call, the following persons were present: Mayor Bryan Lewis, Chairman Pro-tem Kate
Pichon-Hellmann, and Council Member Rob Jurgiel (via Zoom).
Council Member Sidney Clark and Mike Solomonov were absent with an excuse.
Also in attendance were City Manager Jennifer Yackley, Director of Parks and Recreation Beverly
Tucker Knight, and Police Chief Beth Andreski
Discussion of Flock Cameras
Police Chief Beth Andreski and Detective Sergeant Tim Loethen presented information on
community concerns and department response regarding Flock Safety Cameras.
Indian Meadows Pavilion Discussion
Director of Parks and Recreation Beverly Tucker Knight and Chief Andreski presented information
on the history and current state of the pavilion at Indian Meadows Park. Council is considering
following staff recommendations to remove the pavilion as well as the concrete pad. The matter
has been referred to the Parks and Recreation Commission for their review.
At approximately 9:52 p.m. the meeting was adjourned.
