NEW BUSINESS:
AN ORDINANCE OF THE CITY OF SODDY-DAISY, TENNESSEE,
REZONING A TRACT OF LAND LOCATED AT 8769 DAYTON PIKE
FROM M-2 WHOLESALE AND LIGHT INDUSTRY DISTRICT TO R-1
SINGLE FAMILY RESIDENTIAL DISTRICT FOR THE DEVELOPMENT
OF A CHURCH. PUBLIC HEARING AND FIRST READING.
Mayor Coleman noted that the Planning Commission had recommended denial of the
request. Liz Crowe, 9827 Shoreline Heights and representative of C4 Church which is trying to
purchase the existing building, requested this item to be deferred until the next meeting as they
have heard the concerns from the City and Planning Commission. She said they are working to
find a solution that works out for everybody. She said they want to honor the City, honor the
community, honor the property owners and honor the church at the same time. She said they need
more time to do this. Mayor Coleman said the item is on the agenda and unless the Commission
agrees to roll it to the next meeting, it will be heard tonight. He asked for the consensus of the
Board relative to deferring action until the next meeting.

Mrs. Crowe distributed a handout to the Board showing the economic impact the church
would have on the City and what they would contribute to Soddy-Daisy if located here. She said
they have approximately 650 people/members who attend their church. She gave an
approximation of the money they would spend in the City in a year, if each family spent $75.00
per week. She said this gives an approximate impact of the sales tax if a church is developed
versus a warehouse. She thanked the Board for their time.
Bob Privett, 9103 Springfield Road, said he had an ordinance in front of him that prohibits
any religious, charitable, scientific, non-profit, educational institution which includes churches in
certain zones, but does not include R-1 (Single Family Residential District). He stated that he has
served the City as a Commissioner as well as Mayor in years past. He said years ago the City
rezoned R-1 to C-2 (Local Business District) as the City saw the properties on Dayton Pike as
Commercial. He said there is no R-1 on Dayton Pike. He said the ordinance clearly says that they
want to preserve prime commercial property in the city for our tax base. He said he is in no way
opposed to churches, but feels the City needs to preserve its tax base. He said the Commission at
that time made this change to conserve property for the betterment of the community. He said
residential should not take up the business district. He said it was the intent of the Commission
and the Planning Commission to restrict R-1 on Dayton Pike at that time. He said the current
zoning of the parcel is M-2 (Wholesale and Light Industry District) and this is the best zoning it
can be. He said granting the request to rezone to R-1 would cut the bones out of the Ordinance.
He said it would destroy that properties value. He said rezoning to R-1 would create a residential
property right in the middle of our commercial district. He said that if the parcel is removed from
the tax roll, not only does Soddy-Daisy lose taxes, but Hamilton County loses more money than
Soddy-Daisy. He said if revenues are lost, then property taxes have to be increased. He asked the
Board to follow the recommendations of their Planning Commission. Diane Walker, 9986 Lovell
Road, said just to put some context out there for the Commissioners, the City is approximately 23
square miles in size. She asked City Manager Johnson how many square miles are currently taken
up by churches? City Manager Johnson said he does not know how many square miles, but there
are currently 34 churches. City Manager Johnson said the City is approximately 23-24 square
miles with 150 tax exempt parcels of which 34 are churches. Shane Harmon, 11998 Old Dayton
Pike, said he owns multiple parcels in the City and pays $12,000 per year for taxes. He said
tonight on the news they stated that the United States is currently 40 trillion dollars in debt.
He said the City cannot afford to get behind. He said that he has seen the City crunch and stretch
numbers to make them work. He said when he was a Commissioner he voted to make Dayton Pike
commercial not R-1 and M-2 zoning is hard to get. He said if this property is downgraded or
changed, it will probably not go back to M-2. He said he is not against churches. He said this is
not an easy decision and he would support the Board either way. Vice-Mayor Penney asked for
other examples of exempt properties. City Manager Johnson said these would include State of
Tennessee schools, Hamilton County and City properties. Mayor Coleman asked for a motion, he
said the recommendation from the Planning Commission is to deny. Vice-Mayor Penney said he
is on the Planning Commission as well and good discussion were held during that meeting. He
said we have an ordinance on the books and he does not feel good voting against our own
ordinance.

Commissioner Keith noted the following explanation with his vote: it is not that
we do not want your church in our City, we would love to have your church in
our City, I think you could find another location where the church could go, we
cannot put a burden on our taxed people by taking away taxes on our tax roll. He
said we have raised taxes twice in two years and if we take another tax base off
the roll, we will have to raise taxes again to keep this City running. He said we
cannot afford to do that. He said this is not personal against the church. He said
he thinks there are other properties in the City that would allow the church. He
suggested they speak with the City Manager to see if he may know of other
parcels.
Mr. Privett said he felt some residential zones were overlooked and should have been included in
the ordinance. He said he felt the ordinance should be amended to include R-2A (Rural
Residential District) and R-1 and suggested the Board consider this.
AWARD SIGNALIZATION BID
City Manager Johnson said this is for our signalization project through Federal Highway
Administration. He said we had to re-bid the project due to technicality. He said Nabco was still
the low bidder, with their bid coming down approximately $15,000.00. He said their bid was for
$661,789.57. He recommended awarding the bid to Nabco. Commissioner Everett asked if this
was budgeted? City Manager Johnson said it is.

reviewed the contract. He asked for approval for the Mayor to sign it.

said the truck being requested is for the Fire Department. City Manager Johnson stated that
$60,000.00 was budgeted for the purchase and the State Contract price is $50,578.27. He said
there will be some lighting added, but the total cost should not exceed $60,000.00. Public Works
Director Grant said that this truck will replace Squad 1 which has the most mileage and they plan
to get rid of the “old” Dodge.

City Manager Johnson said that at the next meeting life saver awards would be presented
to the Police Department.
Vice-Mayor Penney thanked those in attendance for coming and participating. He said that
flock cameras have made the national news and asked Police Chief Petty to briefly explain these.
Police Chief Petty said the City does not have flock cameras. He said we have LPR (License Plate
Reader) cameras and they are used as a preventative measure. He said the police department is
only looking for bad guys. He LPRs can be beneficial to work with other counties and cities. He
said the City’s first LPR cameras were through BlueLine in the school zones. He said as
technology grows citizens should be more concerned with cell phones than the cameras. He said
for example the LPRs recently tracked homicide suspects as they left our City and were
instrumental in tracking them to Washington State. He said the suspects are now in custody and
their case will be heard downtown soon. He said his department only looks at them if a crime is
committed and we have a policy and procedure that most of the time the only officers reviewing
the cameras are on the investigative team. He said after 60-90 days the cameras are wiped clean.
Police Chief Petty said that TACP (Tennessee Association of Chiefs of Police) will have a big talk
in the next meeting. He said they only have Metadata and you must have the ability to see the
data. Vice-Mayor Penney said the cameras are an added resource. Police Chief Petty said if an
officer violates the statute he/she may be terminated and/or may be prosecuted. He said the City
previously had 700-900 victims of crime per year. He further stated that the City is on pace to
keep that number at 247 victims.
Commissioner Beene said at the last meeting he had noted that an individual had requested
a yield sign at Montlake Road and Dayton Pike. He said after visiting the site, he could see the
need for one there if heading southbound on Dayton Pike. Commissioner Beene noted that three
candidates have qualified to run for the City Commission. He thanked them for their willingness
to commit their time to the community. He expressed his appreciation for the Public Works
Department having cleaned the ditch at the north end. He said football at Soddy-Daisy High
School still needs sponsorships. He said when he was first elected into office, the first order of
business was a tax increase. He said as a commissioner after numerous meetings with City
Manager Johnson, he saw the need for an increase and that is why he voted the way he did. He
said we must protect the tax base of the City.
Commissioner Everett announced an upcoming workshop scheduled for September 8th at
9 a.m. He said Scramble Alley will be discussed. Commissioner Everett expressed his
appreciation for the members of C4 Church and the data they provided. He said he and his wife
both own businesses in the City. He said that business owners pay a lot of money to do business.
He stated that he appreciates anyone that wins souls for the Lord. He said the Commission has to
vote for what is best for the City as a whole. He said the Commission is trying to carry on what
previous Commissions have done for the town. He said we try to keep the taxes low. He said he
respects all previous commissioners and the current Board. He asked everyone to stay engaged in
the community.
Commissioner Keith asked everyone to support high school football and to shop local.
Mayor Coleman said that some of the parents at Soddy-Daisy High School had expressed
concern with the edges of Hyatte Road crumbling. Public Works Director Grant asked if Mayor
Coleman had an address for where this is occurring? City Manager Johnson said we will look into
it. Mayor Coleman said that the stop sign at the railroad crossing on Harrison Lane is missing. He
said that the railroad owns that sign. He announced that the crossing at Harrison Lane will be
closed until 10 p.m. tonight. He said the high school wrestling team rings will be presented
tomorrow night.
Mr. Privett expressed concern with the amount of traffic on Dayton Pike in front of the
Post Office at 2:15 p.m. due to school traffic. He said cars are parking in the middle of Dayton
Pike and blocking Dayton Pike which could pose issues in an emergency. City Manager Johnson
said that changes are coming with the new construction at the middle school and this problem
should be eliminated once that is complete.
Sean Sims, 11318 Dayton Pike, commended the Commission for a job well done.
