The Johnson County Board of Commissioners met in regular session on Tuesday August 25, 2026, County
Commissioners present were, David Borrenpohl District 1, Tim Weber District 2, Les Agena District 3.
Kathleen M Nieveen County Clerk is recording the minutes.
Notice of the Johnson County Commissioner’s meeting was sent to each post office in Johnson County; it was
posted on the Johnson County Website at johnsoncounty.ne.gov and was sent to the Nemaha Valley Observer on
August 21, 2026.
The meeting was called to order by Chairman Borrenpohl at 9:00 A.M.
The Pledge of Allegiance was recited by all in the room.
Chairman Borrenpohl acknowledged that the open meetings act was posted by the entrance of the Johnson
County Board Room.
A motion was made by Agena and was seconded by Weber, to approve the agenda. Yeas: Agena, Weber,
Borrenpohl. Nays: none motion carried.
A motion was made by Agena and was seconded by Borrenpohl to approve the minutes of August 11, 2026, board
meeting. Yeas: Agena, Weber, Borrenpohl, Nays; none motion carried.
A motion was made by Weber and was seconded by Agena, to approve the claims as submitted. Yeas: Agena,

Megan Buckley EMA was present to discuss the paging system.
Kevin Kramer was in to discuss Flock Camera’s
Highway Supt. Matt Schaardt was present to discuss the NioCorp Road and that at the present time they are on
schedule, but if the rain continues it could be pushed back a week or two.
A motion was made by Weber and was seconded by Agena to approve the 2026 Cat 140 All Wheel Drive Motor
Grader through Sourcewell pricing, for $295,250.00 with trade in. Yeas: Agena, Weber, Borrenpohl, Nays; none
motion carried.
Matt received a bid for a trailer, and the board will consider this during budget discussions.
CDL License were also discussed, and the road Infront of the school in Cook he will be looking into options on
fixing the road
At 9:30 A.M. the fuel bids were opened and placed on file in the County Clerk’s Office. Only one bid was
received. A motion was made by Weber and was seconded by Agena to approve the bid from Gottula Propane
Service as follows:

A motion was made by Agena and was seconded by Borrenpohl to go into closed session at 9:45 A.M. to hold a
Strategy session with respect to pending litigation to or by the public body. Yeas: Agena, Weber, Borrenpohl,
Nays; none motion carried.
A motion was made by Agena and was seconded by Weber to come out of closed session at 9:55 A.M. Yeas:
Agena, Weber, Borrenpohl, Nays; none motion carried.
A motion was made by Weber and was seconded by Agena to hire Justin Eichmann with Houghton Bradford
Whitted P.C. for legal representation in the case Mike Pietzyk et. al vs County Board of Commissioners Johnson
County, Nebraska. Yeas: Agena, Weber, Borrenpohl, Nays; none motion carried.
The appointment for the Johnson County Surveyors position was discussed. A motion was made by Borrenpohl
and was seconded by Weber to appoint Jeff Boden to the Position of Johnson County Surveyor to fill out the rest
of the vacant term of office. Term to end January 6, 2027. Yeas: Agenda, Weber, Borrenpohl, Nays; none motion
carried.
A motion was made by Borrenpohl and was seconded by Weber to approve the .020000 for the Johnson County
MFO Tax Rate for 2026-27. Yeas: Borrenpohl, Agena, Weber, Nays; none motion carried.
A motion was made by Weber and was seconded by Agena to approve the Johnson County Ag Society Tax Rate
for 2026-27 at General fund .006086, Sinking Fund .000761. Yeas: Agena, Weber, Borrenpohl, Nays; none motion
carried.
With no discussion from the public the board adjourned the meeting at 10:56 A.M.
The board will meet again in regular session on Tuesday September 8, 2026, at 9:00 A.M. All board meetings are
open to the public; the agenda is kept current and available at the County Clerk’s Office.
