The committee members discussed matters pertaining to the sheriff’s department,
particularly the extent of the department’s coverage in Georgetown Township and its use
of LPR cameras. There was a consensus between the members that they still have a lot of
questions and would like to gather more data about these topics. Township Superintendent,
Justin Stadt, stated that he can help with this and that someone from the sheriff’s
department will be attending the next Services Committee meeting.

Tim Doane, 3810 Bauer Rd., is requesting that the township grant a request for an Approved
Range for the purposes of target shooting with small caliber firearms, pursuant to Sec 38-215 of
the township ordinance on a parcel of land described as P.P. # 70-14-08-300-023, in an
Agricultural (AG) Zoning District, located at 3810 Bauer Rd., Georgetown Township, Ottawa
County, Michigan.

BACKGROUND
Tim Doane contacted the Zoning Department to inquire about the process for receiving approval
by the township for an Approved Range. He stated that he would like to cultivate a personal
target range on his property at 3810 Bauer Rd., near the intersection of 36th Ave. and Bauer Rd.
on his parcel in an Agricultural (AG) Zoning District.
Mr. Doane was notified that the township ordinance restricts the discharge of firearms within
300 ft of any building, structure, or edifice within any zoning district without the permission of
the occupant or owner unless on an approved range.
The applicant was informed that township standard operating procedure was to transmit the
request for the range to the Township Code Enforcement officer who will review the plan and
determine whether the request as proposed poses no public safety risk and complies with
township ordinance.

ARTICLE 38-XI FIREARMS DISCHARGE
Sec 38-210 Purpose
The purpose of the ordinance from which this article was derived is to secure and maintain
the public peace, health, safety, welfare and convenience of the residents and property
owners of the Georgetown Township, by the regulation of the use of firearms within said
township and the approval of firearm ranges. Further, the purpose of the ordinance from
which this article was derived is to regulate the discharge of firearms in residential districts
to protect adjacent people and property from the careless discharge of weapons which
creates an unsafe environment. The ordinance from which this article was derived is not

intended to conflict with state law with regard to hunting and it is not intended to regulate
the legal possession of firearms.
Sec 38-212 Definitions
B. Approved ranges. An "approved range," as used in the ordinance from which this article
was derived, shall mean a range for the shooting of firearms, constructed in such manner
as to prevent the projectile from any weapon so fired on said range from exceeding the
physical limits of said range.
C. Building. The words "building," "structure" or "edifice," as used in the ordinance from
which this article was derived, shall be construed to mean a space within its walls and
usually, but not necessarily, covered with a roof.
Sec 38-213 Regulation of Use Of Firearms
No person shall, from after the effective date of the ordinance from which this article was
derived, discharge any firearm within the township, except in compliance with the
ordinance from which this article was derived and except:
1. Authorized officers of the law are permitted to discharge their weapons in the
performance of their duties.
2. A person shall be permitted to discharge any weapon for the protection of his/her
life and his/her property.
3. A person may discharge a weapon for target practice purposes, in a safe
manner, upon a range which has been approved by the township board, for
the specified type of weapon so discharged.
Sec 38-214 Discharge Restrictions; Structures
It shall be unlawful, after the effective date of the ordinance from which this article was
derived:
1. To discharge any firearm within an area of three hundred (300) feet of any building,
structure or edifice, whether occupied or unoccupied, within any zoning district
without the permission of the occupant or owner unless in an approved range.
2. To discharge any firearm upon any platted land, or within three hundred (300) feet
of any public or private school real property within any district unless in an
approved range.
Sec 38-215 Approved Range
The township may approve firearms practice ranges provided that said range so approved
shall be so constructed as to prevent the discharge from the specified type of firearms
exceeding the limits of said approved range and provided further that said range complies
with all requirements of the township ordinances, including the Zoning Ordinance.
Approval of any practice range shall specify in said approval the type of firearm that may
be used on said practice range. Use of any firearms not approved for said practice range
shall be grounds for withdrawal of approval of said range.

FIREARM RANGE ADMINISTRATIVE STANDARD OPERATING PROCEDURE,
UTILIZED SINCE JANUARY 24, 2018
The following is the standard operating procedure when a request is submitted for the use
of a Firearm Range. The procedure is based on Sec. 38-210 through 38-216 in the
Georgetown Township Code of Ordinances. The purpose is to interpret the language in the
ordinance for the protection of adjacent people and property from the careless discharge of
weapons which creates an unsafe environment and presents a public safety risk. The
procedure is not intended to conflict with state law with regard to hunting and it is not
intended to regulate the legal possession of firearms.
A request for a firearm range shall include the following.
(a) The specific type of firearms that will be used at the range.
(b) The construction plan for the range that clearly shows that it will prevent the
discharge from exceeding the limits of the range.
Upon receipt of a request for a firearm range, the Code Enforcement Officer will review
the request and provide a finding as to whether or not the proposed range:
(a) Is constructed in such a way as to prevent the discharge from the specified
type of firearms from exceeding the limits of the proposed range;
(b) Poses no public safety risk; and
(c) Complies with all requirements of the township ordinances, including the
Zoning Ordinance.
After reviewing the Code Enforcement Officer’s findings, the Township Board may(a) Approve the proposed range for the specified type of firearm based on the
findings that the proposed range:
• Is constructed in such a way as to prevent the discharge from the
specified type of firearms from exceeding the limits of the proposed range.
• Poses no public safety risk; and
• Complies with all requirements of the township ordinances, including the
Zoning Ordinance.
(b) Deny the proposed range for the specified type of firearm based on the
findings that the proposed range:
• Is not constructed in such a way as to prevent the discharge from the
specified type of firearms from exceeding the limits of the proposed range;
or
• Poses a public safety risk; or
• Does not comply with all requirements of the township ordinances,
including the Zoning Ordinance.
Approval for the range may be revoked by the Township Board if it is found that:
(a) Any firearms not specifically approved for the range are being used; or
(b) The range is altered in such a way as to allow the discharge from the specified
type of firearms to exceeding the limits of the proposed range; or
(c) The site becomes noncompliant with any requirements of the township
ordinances, including the Zoning Ordinance.

DISCUSSION
This report has been constructed with information provided by the Code Enforcement Officer’s
inspection, the Zoning Administrator’s review of the ordinance in relation to the request and has
been reviewed by the Township’s attorney.
Staff have completed an evaluation of relevant legislation and ordinances regarding this request.
Township ordinance provides a mechanism for residents to seek approval for personal firearms
target ranges, as an Approved Range.
The Sport Shooting Range Act (SSRA) of 1989 regulates the operation of certain sport shooting
ranges and also regulates the application of state and local laws, rules and ordinances regarding
sport shooting ranges. As the Michigan Supreme Court recognized in its 2014 opinion in Addison
Township v Barnhart, the SSRA provides certain immunities to range owners and shooting ranges,
including immunity from nuisance lawsuits. The SSRA states:
MCL 691.1541 Definitions.
(a) "Generally accepted operation practices" means those practices adopted by the
commission of natural resources that are established by a nationally recognized
nonprofit membership organization that provides voluntary firearm safety
programs that include training individuals in the safe handling and use of firearms,
which practices are developed with consideration of all information reasonably
available regarding the operation of shooting ranges. The generally accepted
operation practices shall be reviewed at least every 5 years by the commission of
natural resources and revised as the commission considers necessary. The
commission shall adopt generally accepted operation practices within 90 days of
the effective date of section 2a.
(d) "Sport shooting range" or "range" means an area designed and operated for the
use of archery, rifles, shotguns, pistols, silhouettes, skeet, trap, black powder, or
any other similar sport shooting.
MCL 691.1542 Sport shooting ranges; civil liability or criminal prosecution; state
rules or regulations.
Sec. 2. (1) Notwithstanding any other provision of law, and in addition to other
protections provided in this act, a person who owns or operates or uses a sport
shooting range that conforms to generally accepted operation practices in this state
is not subject to civil liability or criminal prosecution in any matter relating to noise
or noise pollution resulting from the operation or use of the range if the range is in
compliance with any noise control laws or ordinances that applied to the range and
its operation at the time of construction or initial operation of the range.
2) In addition to other protections provided in this act, a person who owns, operates,
or uses a sport shooting range that conforms to generally accepted operation
practices is not subject to an action for nuisance, and a court of the state shall not
enjoin or restrain the use or operation of a range on the basis of noise or noise
pollution, if the range is in compliance with any noise control laws or ordinances

that applied to the range and its operation at the time of construction or initial
operation of the range.
MCL 691.1543 Local regulation.
Sec. 3. Except as otherwise provided in this act, this act does not prohibit a local
unit of government from regulating the location, use, operation, safety, and
construction of a sport shooting range.
MCL 691.1544 Acceptance of risk.
Sec. 4. Each person who participates in sport shooting at a sport shooting range
that conforms to generally accepted operation practices accepts the risks
associated with the sport to the extent the risks are obvious and inherent. Those
risks include, but are not limited to, injuries that may result from noise, discharge
of a projectile or shot, malfunction of sport shooting equipment not owned by the
shooting range, natural variations in terrain, surface or subsurface snow or ice
conditions, bare spots, rocks, trees, and other forms of natural growth or debris.
Staff has determined that SSRA provides some preemption from local regulation and that the
actions of the board should be made consistent with this relevant legislation. The SSRA provides
that an individual operating a sports shooting range must follow "Generally accepted operation
practices" (defined above), which staff has determined means the National Rifle Association’s
(NRA) guidance on range construction and etiquette must be applied to ensure that any public
risk is sufficiently mitigated. Staff informed the applicant that the provisions of the NRA
guidance and operating procedure must be met to recommend approval.
The NRA’s guidance states the following regarding dimensions of an outdoor range:

The applicant has proposed the following dimensions for his range:

12’ tall MET
45’ wide MET
Side walls will extend 15’ on each side and will be 8’ tall. MET
Base of berm will be 10’ wide MET
4’ wide at the height of 12’ MET
In response, the applicant has made the requested revisions (above) to his backstop construction
plan, including providing that the backstop will be a minimum of 12’ high and 4’ wide at the 12’
height. The backstop must be constructed to prevent projectiles from penetrating past the length
of the range. The applicant has indicated to the Zoning Administrator and Code Enforcement
Officer that he will use earth/dirt to construct the berm.
In adherence to our ordinance, the applicant has provided a list of the specific weapons and
caliber types that he proposes to use on his range:
Below is a list of the calibers and firearms that will be used on this range. There will be no large
caliber firearms used on this range. All shooting will take place within 35 yards of the berm.
Anyone on the range will be required to [wear] eye and ear protection at all times. The range
will be properly maintained and cleaned at all times [to] ensure a safe shooting environment. I
have been properly trained in both firearm safety and safe range practices during my time in the
Marine Corp and through various clubs and ranges throughout the years. I am proficient [with]
all firearms being used on the range.

The FIREARM RANGE ADMINISTRATIVE STANDARD OPERATING PROCEDURE,
UTILIZED SINCE JANUARY 24, 2018 states the following:
After reviewing the Code Enforcement Officer’s findings, the Township Board may(b) Deny the proposed range for the specified type of firearm based on the
findings that the proposed range:
• Is not constructed in such a way as to prevent the discharge from the
specified type of firearms from exceeding the limits of the proposed range;
or
• Poses a public safety risk; or
• Does not comply with all requirements of the township ordinances,
including the Zoning Ordinance.

It is important to note the applicant’s address is located about 327’ from undeveloped land
owned by Hudsonville Public Schools to the west and 498’ from the 5th and 6th Grade
school building to the south, also owned by Hudsonville Public Schools.
There is a possibility that a school will be constructed in the future on currently vacant land to
the west of the applicant’s property.
The Township Board must determine if the applicant’s location and proximity to
Hudsonville Public Schools poses any safety risks. Additional conditions of approval could
be added to address the issue.

DETERMINATION
The Township Board must determine whether the location of the proposed range poses a
safety risk given the proximity to property owned by Hudsonville Public Schools.
If the Township Board determined there is not a safety risk, staff has concluded that the proposed
Shooting Range Plan complies with township ordinance and the relevant provisions of the
SSRA, however, additional conditions of approval should be utilized to ensure that public safety
risks are properly mitigated if approved. The following conditions of approval are recommended:
1. The range and backstop shall be continuously maintained with a backstop and walls
measuring a minimum of 12’ in height by 45’ in length composed of impenetrable
materials, to repair any wear and degradation.
2. The maximum shooting distance on the range shall be no farther than 35 yards.
3. The township will immediately withdraw the approval of the range if the land to the
immediate east is ever further developed. Development consists of the construction of 1
or more new principal buildings located at PPN 70-14-08-300-024 within 300’ of the
range.

4. If PPN 70-14-08-300-031 is developed for school purposes, the Township may review
the range approval and may modify or withdraw the approval if necessary to protect
public safety.
5. The operation of the proposed range shall be only permitted within the timeframe of 8am
to dusk.
6. Use of the range for any caliber types or weapons not provided on the range plan shall
result in the immediate withdraw of the township approval.
7. The range shall comply with the generally accepted operation practices of the National
Rifle Association for shooting ranges.
8. If the range is used during school hours, the applicant must inform the Ottawa County
Sheriff’s Office and Hudsonville Public Schools of their intent to use the range prior to
starting.
OPTIONAL CONDITION
Replace condition 8 with the following:
8. The range is not permitted to be used during regular school hours or school events
outside of regular school hours.

If the township board determines that compliance with the township ordinance and the
provisions of the township operating procedure are met, the following motion to approve is
provided:

38-215, as provided in the attached range plan, and with the following conditions:

GEORGETOWN TOWNSHIP
ESCROW POLICY FOR APPLICATIONS AND DEVELOPMENT APPLICATIONS

DEFINITION
Application means applying for any of the following: 1) zoning approvals, including but not limited
to, Site Plans, Planned Unit Developments, Special Use Permits, Rezonings, Plats, Site
Condominiums, Variances or Interpretations, Land Divisions, Mobile Home Parks, Private Streets,
Zoning Compliance and any other zoning requests; 2) General Ordinance related approvals,
including but not limited to, mining, sidewalks, building, and utilities; and 3) approval for and
continuation of development of any sort.
STATEMENT OF POLICY.
The purpose of this policy is to formulate procedures for the establishment of an escrow account with the
Township by each developer at the time of submission of an application for each development within
the Township. The developer shall deposit funds into the escrow account for the particular application
proposed development. Those funds shall be used to offset costs incurred by the Township during the
course of that application process and during the time of the particular development, ensuring financial
responsibility by the developer for costs related to that application and/or development.
PROCEDURES.
1. Creation of the escrow account.
At the time of initial application, and in addition to the application fee, the developer/applicant shall
be responsible to deposit funds into an escrow account equal to an estimated amount calculated by the
Superintendent to include anticipated costs to be incurred by the Township related to that application
and/or development. The anticipated and continued costs shall include, but are not limited to, the
following: 1) engineering fees; 2) water and sewer charges; 3) lot inspection fees; 4) streetlights; 5)
review costs; 6) legal fees; and 7) publication and sending of legal notices; and 8) any fees related to
costs for professional services to assist in determining the appropriateness, completeness and
ordinance compliance of the application.
2. Complete application.
No application shall be considered to be completely submitted until the estimated funds are deposited
into the escrow account with the Township.
3. Additional funds to be deposited.
If costs incurred by the Township for the development exceed, or are expected to exceed, the initial
amount deposited into the escrow account, the developer shall be responsible to deposit additional
funds equal to the amount calculated by the Superintendent to cover the additional expenses incurred,
or are expected to be incurred, by the Township for that application and or continued development.
Further inspections or approvals or anticipated procedures may be withheld pending the deposit of the
additional funds.
If a development has multiple phases, at the time of application for each phase after the first one and
in addition to the application fee, the developer/applicant shall be responsible to deposit additional
funds into the escrow account previously established for the initial phase equal to an estimated amount
calculated by the Superintendent to include anticipated costs to be incurred by the Township related to
that phase of the development.
No building permit or final Township approval or permit shall be granted for an application or
project until all outstanding out-of-pocket costs and expenses incurred by the Township as
specified above have been reimbursed to the Township from the Escrow Account.
The Township Clerk shall maintain records regarding the Escrow Account and shall authorize
the disbursement of escrow funds in writing. Such escrow funds (from one or more applicants)
shall be kept in a separate Township bank account.
The Township shall collect and apply escrow funds in a reasonable fashion.
4. Refund of remaining balance.
After all the costs anticipated to be incurred by the Township related to all phases of the application
and/or development have been deducted from the developer’s escrow account, the remaining funds
shall be refunded to the developer who deposited the funds into the escrow account.
If the application for the development is withdrawn in writing after funds have been deposited into an
escrow account and prior to the Township granting any approvals and prior to the Township incurring
any costs related to the development, the funds in the escrow account shall be refunded, less an
administrative fee determined by the Superintendent. If the development is cancelled in writing after
any approvals are granted by the Township or after any costs have been incurred by the Township for
the development, the funds in the escrow account shall be refunded less the following as determined
by the Superintendent: 1) an administrative fee; 2) any costs incurred by the Township; and 3) any
future anticipated costs to be incurred by the Township for that application and/or development.
5. Appeals by aggrieved developer.
If any developer is aggrieved by the administration of this policy for any reason, including but not
limited to, the calculations of anticipated fees required to be deposited into the escrow account or the
amount of refunds, appeals may be submitted in writing to the Township Board.
IMPLEMENTATION.
The Georgetown Township Superintendent is responsible to implement the procedures detailed herein.
EFFECTIVE DATE.
This policy shall become effective upon adoption by the Township Board.
