Public Participation at Meetings. Members of the public shall speak only when recognized by the presiding
officer. Members of the public shall be limited to speaking only during the “Public Comment – General” for issues
not on the meeting agenda (limited to three (3) minutes) and following Council discussion on each agenda item
prior to a vote by the City Council on that item (limited to three (3) minutes). Each speaker shall observe the
specified time limitation unless the rules are waived by a majority vote of the City Council. Due to an issue that
may involve a large amount of public comment, by a majority vote of the City Council, the public comment time
limit may be reduced to one (1) minute per member of the public. The presiding officer may also encourage
groups to designate one or more individuals to speak on their behalf to avoid cumulative comments. Individuals
may only speak one time per topic, including one time during public comment. Individuals may only comment
during public comment and/or when a vote is being taken by the Council. Prior to addressing the City Council,
members of the public shall register with the City Clerk on a form provided by the Clerk and shall identify
themselves by name, street name, and city of residence at the podium prior to speaking. The City Clerk shall
record in the meeting minutes the name, street name, city of residence, and/or organizational affiliation of
persons addressing the City Council and the topic to which they speak. A person shall not be excluded from a
meeting that is otherwise open to the public except for a breach of the peace actually committed at the meeting.
Disorderly Conduct at Meetings Prohibited. The presiding officer may call to order any person who is breaching
the peace or being disorderly by speaking without recognition, engaging in booing or catcalls, applauding, failing
to be germane to the topic or issue being considered, speaking longer than the allotted time, threatening intent
to commit an act of unlawful violence to a particular individual or group of individuals, excessive body odor, or
engaging in other conduct which is determined by the presiding officer to be disruptive to the meeting. Any
person so disrupting a lawful public meeting of the City Council may be removed or excluded from a meeting
that is otherwise open to the public in accordance with the Michigan Open Meetings Act and shall be guilty of a
misdemeanor pursuant to state statute, being MCL 750.170 et seq, and §131.03(B) of the City Code Of
Ordinances. The Chief of Police or his designate shall serve as the sergeant-at-arms at council meetings for
purposes of enforcement of the rules under this section.

construction and Flock camera concerns.
William Grove, spoke regarding issues with police (non)response to individuals doing
burnouts near his home.
Adam Minster, spoke regarding issues with residents using Google Images to report houses
for Administrative Hearing Bureau and issues with trash collection.
Lauren Anthony, spoke regarding concerns with the amount of data being collected by Flock
cameras and city officials say in allowing them.
Mike Hagadone, requested additional police support around schools and safety issues around
pickup time as well as sidewalk installation issues and need for better reclamation after
installation.

DISCUSSION: CDD Miller gave an overview of review letter dated August 18, 2026. Prior to
board discussion, Miller addressed the variance standards for approval. The board began
discussions of the information provided.
The applicant (Brian Lee, Metro Home Improvements) gave an overview of the proposed project,
variance request and explain the plans for the addition for elderly care of the homeowner.

Proposed rezoning of 29317, 29299 and 29217 Ford Road and vacant Pardo Ave lot to CBD Central
business district

The owner of four properties at the southeast corner of Ford and Middlebelt Road has requested these lots to be
rezoned to CBD, Central Business district. The site is comprised of three lots at 29317, 29299 and 29217 Ford Road and
the vacant Pardo Ave lot Parcel ID# 35-013-01 0022-001 which are all zoned currently as Planned Development. The
proposed rezoning is evaluated in the attached September 3, 2026 review letter.
The applicant previously applied for and received approval for a Planned Development (PD) in order to redevelop the
site into a 4-story mixed-use building. The applicant has not taken action on this proposed development and no longer
plans to move forward with this project. With the previously approved PD designation, the property owner is currently
only allowed to construct the approved 4-story building and are not able to receive permits for any other projects. To
remedy this, the City requires that the applicant apply to rezone the property from the PD zoning back to CBD to allow
for the site to be redeveloped for a permitted use.
Section 154.006(C)(3) of the Zoning Ordinance specifies the standards of approval that the Planning Commission and
City Council shall consider before taking action on any proposed zoning map amendment (rezoning). These approval
criteria include compliance with the basic intent and purpose of the Zoning Ordinance, being in compliance with the
City’s Master Plan and ensuring the rezoning is compatible with the zoning classification of surrounding land.
On September 10, 2026, the Planning Commission held a public hearing. There were no written comments provided and
no in-person comments or questions were made at the public hearing. After considering all the issues the Planning
Commission has recommended City Council approve the proposed rezoning for 29317, 29299 and 29217 Ford Road and
the Pardo Ave lot.
RECOMMENDATION
The Planning Commission recommends the City Council approve the rezoning of 29317, 29299 and 29217 Ford Road and
Pardo Ave lot from PD Planned Development to CBD Central Business District based on compliance with the Master
Plan, the Future Land Use Map, the findings of fact summarized in the attached review letter and compliance with the
amendment standards of Zoning Ordinance Sec. 154.006(C)(3).

action on this proposed development and no longer plans to move forward with this project. This has resulted in
the property remaining under PD designation, which leaves the property unable to be developed for any project
besides the approved Planned Development. To remedy this, the City requires that the applicant apply to rezone
the property from the PD zoning back to CBD to align with the other properties in this corridor and to allow for the
site to be redeveloped for a permitted use.

Section 154.006(C)(3) of the Zoning Ordinance outlines standards which are to be considered when reviewing a
rezoning request. The following are our comments on each review standard:
A. Will the proposed amendment be in accordance with the basic intent and purpose of the Zoning
Ordinance?
Yes, the proposed zoning district would bring the site into accordance with the intent and purpose of the
Zoning Ordinance. The Future Land Use Map designates the subject site and the adjacent properties as
CBD, Central Business District, which is the intended zoning district with its own preferred type of
development.
B. Will the proposed amendment further the comprehensive planning goals of the city?
As stated above, the proposed rezoning would allow the site to adhere to the original zoning and intent of
the district. The site, which was previously zoned CBD and was rezoned to PD, should be rezoned back
to CBD to allow the goals and objectives of the master plan to move forward. Rezoning back to CBD will
allow investment in a vacant structure and allow new businesses to be established.
C. Have conditions changed since the Zoning Ordinance was adopted, or was there a mistake in the
Zoning Ordinance, that justify the amendment?
The applicant has decided not to move forward with the original plans for the site, which was a mixed-use
project with PD zoning. Rezoning the property back to CBD zoning will allow the site to be developed for
a use besides the approved Planned Development. There has been no mistake in the Zoning Ordinance
made.

D. Will the amendment correct an inequitable situation created by the Zoning Ordinance, rather than
merely grant special privileges?
The zoning ordinance has not created an inequitable situation, and this rezoning is not attempting to
address such an issue. The rezoning would not grant special privileges for the applicant/property owner.
E. Will the amendment result in unlawful exclusionary zoning?
No, this rezoning would not result in unlawful exclusionary zoning, but it would bring the subject property
into conformity with the rest of the corridor.
F. Will the amendment set an inappropriate precedent, resulting in the need to correct future
planning mistakes?
No, this will not set an inappropriate precedent. The purpose of this rezoning can be viewed as a
necessary step to allow the elimination of a vacant structure and the establishment of new uses. The PD
rezoning of the site was an attempt to allow a development long envisioned by the master plan but was
not permitted by right in the CBD zoning district. While the utilization of the planned development process
is a viable option, it can be a more involved process. In order to encourage multi-story mixed use
buildings in the future and create a less arduous process for owners to invest, the city could establish
regulations that allow mixed uses by right.
G. If a rezoning is requested, is the proposed zoning consistent with the zoning classification of
surrounding land?
Yes, as stated previously, the proposed zoning is consistent with the surrounding land.
H. If a rezoning is requested, could all requirements in the proposed zoning classification be
complied with on the subject parcel?
The Schedule of Regulations in the Zoning Ordinance identifies the dimensional requirements of each
zoning district. If the subject site were to be rezoned to CBD, the existing structures will adhere to all
necessary requirements. Any new development will have to adhere to the regulations of the CBD district.
There may be additional landscaping, screening, or parking requirements to be met, but the site appears
to be sufficient in size to accommodate them.
R ECO MMENDAT ION
The proposed rezoning will make the subject site cohesive with the Ford Road corridor. We advise the Planning
Commission to recommend to City Council the approval of the proposed rezoning of the 2.61-acre site from PD to
CBD based upon consistency with the City’s Master Plan, compatibility with adjacent uses and it being in
accordance with the intent and regulations of the zoning ordinance.

The property owner of two parcels located on the south side of Ford Road between Dillon and Shotka Streets has
proposed to construct a four-story mixed-use building at 30759 Ford Road and 30810 Pardo Ave. The applicant has
chosen to utilize the Planned Development (PD) process for this project.
The application has undergone a review by the Planning Commission, and they have made a recommendation to City
Council. Per Zoning Ordinance Sec. 154.432.J, the next step requires the City Council to hold a public hearing to consider
the proposed project. We are requesting that City Council schedule a public hearing on October 26, 2026, for the
proposed Planned Development project at 30759 Ford Road and 30810 Pardo Ave.

Re: Public hearing on proposed kratom ordinance
I recommend that Council call a public hearing on the attached ordinance concerning
kratom and products containing 7-hydroxymitragynine, commonly called 7-OH.
Kratom is a plant sold in forms such as powders, capsules, drinks, and extracts. Regular
use can lead to dependence and withdrawal. Reported health effects include nausea, dizziness,
seizures, and liver problems. Products may also vary in strength or contain contaminants.
Concentrated 7-OH products raise particular concern because they can have stronger opioid-like
effects than traditional kratom leaf. Michigan health officials have reported more severe overdose
and withdrawal concerns with these enhanced products.
The proposed ordinance would prohibit the sale and distribution of kratom and synthetic
variants in Garden City, along with other activities such as growing, giving, and advertising them.
It also provides possible business license action for businesses who sell kratom in violation of the
ordinance.

AN ORDINANCE TO AMEND THE CITY OF GARDEN CITY, MICHIGAN CODIFIED
ORDINANCES BY ADDING CHAPTER 125-SALE AND DISTRIBUTION OF KRATOM
PRODUCTS; PROVIDING FOR SAVINGS CLAUSE; PROVIDING FOR SEVERABILITY;
PROVIDING FOR THE REPEAL OF INCONSISTENT ORDINANCES; PROVIDING FOR
PUBLICATION; AND PROVIDING FOR THE EFFECTIVE DATE OF THE ORDINANCE.
THE CITY OF GARDEN CITY HEREBY ORDAINS: THE FOLLOWING CHAPTER 125 SHALL
BE ADDED AS FOLLOWS:
SECTION 1.

ADDING CHAPTER 125-SALE AND DISTRIBUTION OF KRATOM PRODUCTS.

(A) No person, cooperative, organization, or legal entity shall grow, synthesize, sell, offer to sell,
give, import, distribute, advertise for sale or distribution, or permit to be sold kratom or a synthetic
variant of kratom.
(B) As used in this section, “kratom” means a product containing any part of the plant Mitragyna
speciosa, whether growing or not; the leaves of that plant; any extract or resin from any part of that
plant; and every compound, salt, derivative, mixture, or preparation of that plant or its leaves,
seeds, or extracts.
(C) As used in this section, “synthetic variant of kratom” means any synthetic form of kratom,
including, but not limited to, 7-hydroxymitragynine (7-OH).
(D) This section does not apply to kratom that has been approved by the United States Food and
Drug Administration as a drug product, a dietary supplement, or a food additive in conventional
food. This exception, however, does not apply to a synthetic variant of kratom.
(E) Any business or its operators found guilty of violating this section may have the business
license for that business revoked or denied pursuant to the business licensing provisions of the City
Code.
(F) All others found guilty of violating this section shall be guilty of a municipal misdemeanor and
subject to the penalties found in Chapter 130.99 of the City Code.
SECTION 2.

SAVINGS CLAUSE

The rights and duties which have matured, penalties which have been incurred, proceedings
which have begun and prosecution for violations of law occurring before the effective date of this
Ordinance are not affected or abated by this Ordinance.

SECTION 3.

SEVERABILITY

If any section, subsection, clause, phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portion hereof.
SECTION 4.

REPEAL OF INCONSISTENT ORDINANCES

All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the
extent necessary to give this ordinance full force and effect.
SECTION 5.

PENALTY

Any violation this Ordinance shall be punishable as a municipal civil infraction and fined as
set forth in Chapter 41.
SECTION 6.

PUBLICATION

The Clerk of the City of Garden City shall cause this Ordinance to be published in the manner
required by law. The publication shall contain a notice stating that a complete copy of the Code is made
available to the public at the office of the City Clerk in compliance with state law requiring that records
of public bodies be made available to the general public.
SECTION 6.

EFFECTIVE DATE

This ordinance shall take full force and effect upon publication thereof.
CERTIFICATION
This Ordinance was duly adopted by the City Council of the City of Garden City at its regular meeting
