Attending the meeting Mayor Travers and Commissioner Abey. Commissioner Fluharty was not
present.
Public Hearing: 206 Market St- Thomas & Kelli Short right of way removal:
Public hearing opened at 7:00 PM by Mayor Travers. Stating the property of 206 Market St
Vienna, MD 21869, owned by Thomas and Kelli Short are requesting to have the right of way
removed. This right of way starts at Market St and continues back to the tennis courts on Middle
St. Its previous use was for the old Vienna school, which is no longer existent. Public hearing
notice has been published in the Star Democrat twice and posted at the post office and Hebron
Savings Bank. There was also a sign posted on the property for the public hearing. Mayor
Travers opened the floor for public comments. One resident asked if this is the same right of way
the church on Church St was requesting to use. Mayor Travers answered no; this right of way
runs adjacent to what the church was requesting. Next public question, why was there a right of
way in the first place? Mayor Travers responded that it was placed there when the old Vienna
school was there for access. Now that there is no school, the property owners would like to have
it removed. No other public questions or concerns currently. Commissioner Abey made a motion
to close the public hearing, second by Mayor Travers. Public hearing closed at 7:02 PM.

C. Code Enforcement: Clerk stated letters have been mailed for property clean-up to town
residents. Mayor Travers said this is the second attempt for multiple residents. Commissioner
Abey stated we have reached out to Dorchester County to see if they can assist with code
enforcement until the town is able to get our own code enforcement officer. We are pending a
response. A follow up email was sent on 9/14/26,
D. Public Works: Did not attend the meeting, no update.
E. Water & Sewer: W/S COLLECTED SINCE 8/10/26 MEETING presented by Clerk:
$13,140.72. No other updates currently.
V: Old Business
A. ENR Upgrade- Land Acquisition: Still working on getting the survey done. Contract and
bid with surveyor has been approved. Don Baumgartner has agreed to do the surveying for the
WTP and WWTP. No dates have been set for when the survey on WWTP will be completed.
B. Lead Service Lines: Mayor Travers stated it's still in progress. There will be another survey
sent out to residents to identify the type of lines that are on the property.
C. Grants: As presented by Candace D- The following is an update on our current grants.
1. We are still awaiting the grant agreement for the Waterway Improvement grant for bulk
adding and docking on the river.
2. The playground grant, I understand, is in the hands of the citizen committee. Ann from
the committee spoke and said the committee is still working; they are pending a meeting
with vendors for bids on work that needs to be completed. We need vendors that will
agree to wait for direct funding from the grants rather than having to pay up front.
3. I have not been involved in the enhanced nutrient removal project at the sewer treatment
plant. I believe that Commissioner Fluharty and GMB are taking care of that.
4. The Community Legacy funding we received to paint three historic buildings in town
must be completed by June 2027. Mrs. Cindy is working with a vendor.

Pending Grants:
1. The Congressionally Directed Spending request for the new well has been selected by
Sen. Van Hollen to be advanced to the Appropriations Committee. Congress is still in
disagreement about what total amount to allocate for Congressionally Directed Spending
projects for the entire country, so no action has been taken yet. However, I believe that
we should be hearing something soon
2. Delaware Nature Society – we are awaiting a decision on our application for funding to
create a rain garden.
3. Community Legacy – we are awaiting a decision on our application to fund
improvements at the John Smith discovery center.
4. Byrne Justice Assistance Grant – we are awaiting a decision on this application to
provide additional surveillance cameras and to hire Sheriff’s deputies on overtime to
provide extra security to the town.
5. Waterway Improvement Fund – I have applied for an additional $400,000
D. Impact Fees: Still pending information from MML. A follow-up email was sent on
9/14/2026. Candace asked if there was a direct contact that the clerk reached out to? Clerk stated
it was just the general MML email. Candace said she will reach out to MML and let the clerk
know an update.
E. WTP/WWTP: Mayor Travers stated Katherine, with GMB and Ernest from Hebron, have
been working together on pay forward funding to see if the current unused line of credit terms
can be changed to fit what is needed now for the WTP/ WWTP project. Somerset Well Drilling
has been awarded the project and extended the bid contract for test wells. USDA still requires
additional funds to be set aside to move forward with their funding for the WTP. Land
acquisition is being worked on for the WWTP; surveys are being completed. Town attorney Pete,
still working on getting the Right of Way signed over for the new WTP location by landowner.
The owner is requesting plat showing right of way before anything is signed over. A survey of
new WTP at town hall was completed on 9/14/2026 by Don B.
F. FY 2026/2027 Budget- Mayor Travers said the next budget meeting still needs to be
determined. Donna is still working with Clerk to get QuickBooks cleaned up and more accurate
numbers to go by.
G. 206 Market St- Thomas and Kelli Short Right of Way Removal: Public hearing was held
9/14/2026 at 7:00 PM. There were no opposers. Mayor Travers stated a voting needs to take
place for approval to be granted. Commissioner Abey made a motion to grant the right of way of

removal. Mayor Travers approved and seconded the motion. 2 votes approved, 0 voted denied.
Commissioner Fluharty is not present to vote. Mr. Short is now able to have his surveyor remove
the right of way from 206 Market St and redo his paperwork. The Clerk did request a copy of the
new plat to be given to the town hall for records once completed.
H. WWTP Clean-Up: Mayor Travers said there is a bay liner boat back there and a couple of
things that need to be claimed. Commissioner Abey would like a post to be made on the website
and Facebook page for property owners to claim. Some items back there have been claimed and
approved, but there are also items that have been back there for several years that need to go.
I. In Town Residents Delinquent Water/ Sewer Bills: Mayor Travers stated door hangers have
been hung on doors of residents that were past due on water sewer bills. Shut off date was
provided. Most bills have been paid. Outstanding water/ sewer balance for town residents went
from around $22,000 to $4,800 since the last meeting on 8/10/2026.
J. Heritage Society- Battle of Vienna: Pat Johnson, head of Heritage Society spoke and
said they had a great turn out for the Battle of Vienna. At one point there were over 300 people
that had attended. There were over 750 people between the town site and the Handsel House
Site. There were 20-24 volunteers from the community that came and helped. The shipwreck
display at the John Smith Museum was open to the public. The heritage society is working on
getting the museum open on a more regular basis for visitors to come and see it and it will also
be open the weekend of the Nause Wae Wash Indian Festival for Chief Donna. The society has
also started working on Luminaries. Pat requested to have the luminaries added to the town talk.
They will be held December 19th, 2026.
K. No Parking Signs at Waterfront: Mayor Travers has contacted the sheriff's department for
proper procedures. The mayor and commissioners reached out to both tow companies within
town Bunky's Service Center and J&S Recovery, to see if they would like to be rewarded the job.
Both have agreed. If one company is not available, the other will tow the illegally park vehicle.
Signs will be purchased and placed at the waterfront. Vehicles will be towed at the owner's
expense. Mayor Travers stated it is forecasted to be a bad winter, it may be a good idea to place
new no parking signs along Market St. To keep the roads cleared during state of emergencies for
plows and emergency vehicles. Market St is the main snow route for the town, it's safer to have
the road cleared.

I. New Business
A. Pie Shop Rental: There is a new tenant renting the pie shop. The company is Sweets
by Kins. She will be utilizing the facility as a bakery and selling sweets and desserts. Mayor
Travers stated it is her understanding that the building was not in great condition, and the new
tenant is willing to repair the building. Commissioner Abey asked if there would be a grand
opening. Tenant stated yes, but they are waiting until renovations are complete before they post
the date. They will let the town hall know so it can be posted. Clerk will get 1 year contract
together for the tenant, Mayor and Commissioners to sign.
B. MML Clerk Training: Candance and Commissioner Fluharty have suggested the
clerk do a training offered by MML. It would be beneficial for her to learn new things. Candace
had suggested to Commissioner Fluharty and the community that she is willing to help get the
clerk signed up and pay for the course. It is $60.00. Candace is going to forward the information
to the Mayor, Commissioners, and Clerk.
C. Heritage Museum: It has been brought to the Heritage Societies attention that the
roof on the heritage museum is damaged and causing a leak in the building and needs to be
repaired. The leak is on the back side of the building about halfway down from the top. It is
lifted and pulling apart. Mayor Travers asked if the Heritage Society has any fundings to help
pay towards getting the roof repair. Heritage society stated no, they are tenants, it is the towns'
responsibility. The Heritage Society has made repairs in the John Smith Museum by painting the
doors and making them presentable and adding smoke alarms and repairing the ceiling in the
bathroom. Commissioner Abey asked if there is any way the two museums could combine and
make one since the town doesn't have the funds to repair the roof. Pat stated ideally that they
would like to combine both into the Captain John Smith Museum once the building is renovated.
Candace said we are waiting on the grant for $245,000 that won't have a decision made until
Spring 2027. Then the idea is to combine both museums. It doesn't make sense to do the move
before the renovations. Candace said it doesn't make sense to invest a ton of money into the
Heritage Museum if the museum is going to be moved. Pat J stated the building can be
repurposed; it would be used for the new mid shore Meals Until Monday. Theres's parking and
trucks can gain access. It could be a place of their own in the future. Pat offered to reach out to
Holly with tourism to see if there are any emergency funds available to at least get an evaluation
and the roof secured for the winter, until we can get the funds to repair the roof. Pat asked if the
town had a roofing company that they would use or hold an agreement with that could help.
Public comment: Mr. Larmore asked what are the 3 most valuable assets properties that the town
owns within the town limits. Mayor Travers stated that the Waterfront, town hall, and a third
property can't be thought of. He feels the town needs revenue and the museums don't generate
revenue for the town. There isn't anything offered by the town for people to stop to generate
revenue. He feels the Heritage Museum should be torn down and space used for revenue. He
thinks the house on the waterfront should be an outfitter. A small apartment over top and have a

kayak launch below. The town needs revenue change, an economic center, or a revenue source.
The town cannot survive without revenue. Make an inventory list of what the town has and what
it brings to the town. The town needs revenue, not expenses.
D. Christmas Parade: Christmas parade date was set for 11/28/2026 at 6:00 PM. Bob
Murphy had asked if he is still able and allowed to help set up and head that line up. Mayor
Travers said the middle school band is able to attend but on 11/28/2026. Commissioner Abey
said we don't need to cancel it; nobody had said that he wasn't allowed to. If he's offering, let him
help. Time has been set for 6:00 PM. Mayor Travers agreed.
Public Comments:
Will there be a fall clean up dumpster this year? Mayor Travers said yes. Commissioner
Abey and Mayor agreed to have the dumpster scheduled for October 17, 2026, and it will be
located at the Wastewater Treatment Plant.
Another public comment was stated about the frustration and concern for a thorough way
to manage the town. Budgets have been due and are not complete. Barriers are being used as
ways to not move forward, planning processes, etc. We need a path to drive forward. We can
start fresh and get a plan. All of this is tied together by clear and transparent communication to
the community. There are discrepancies within the audit that have been brought up for years that
have not been discussed. Plans for corrections, some have been made but others have not been
made. There is a large concern that the town is on the brink of disaster, unless we ask for the help
of the community, county, MML. Vienna is not going to see a future; we need to grow
economically. We need to evaluate properties and develop into commodities for people to come
and ways to support the community. We have talented people within the town we need
committees to be formed to help. We aren't moving forward, and the mayor and commissioners
are ultimately responsible, and the community is trying to help. Offload buildings that the town
can't afford to maintain. Look for ways to offload properties. Commissioner Abey spoke upon
the audit and budget topic and said to make numbers meet the accountant had to shuffle around
$63,000 to make the numbers in QuickBooks match the numbers on the audit. To get an accurate
budget, we have to have accurate numbers for reference. This is an issue that the audit company
did not pick up on. There will be a meeting this Friday, 9/18/2026 at the town hall at 10:00AM
with the accountant and UHY audit company to go over and review and discuss these issues and
concerns and why the audit was passed. To start next year's budget for 2026, the town must pay
$27,000 for last year's audit. The public stated there needs to be a bookkeeper. It's not the clerk's
problem she inherited it; this problem goes back years. Commissioner Abey stated the museums
are part of the properties that the town pays all expenses for and doesn't receive anything; it's not
large amounts but over the years it adds up. The Heritage Society has paid rent for the last two
years. To move forward, we have to let go of some of the past. The Heritage Society and the
Mayor and commissioners need to have a meeting and go over the rent, and expenses the town
pays for. If the Heritage Society are tenants, they should help pay towards some of the costs. Pat
stated that would be the first meeting that will be held to discuss these issues. There was never an

agreement until the Heritage Society brought one to the town. Another resident asked if it's
possible to offload some of the buildings, or would it be held up because of using grants to
purchase? Commissioner Abey said there's a fine line because some were purchased on grant
funds, and others were not. Candace stated the longer-term plan for the Heritage Society is to
hopefully get the grant to renovate and combine so eventually the town could but the Heritage
Museum on the market. Mayor Travers said that has been a discussion for years. UHY audit
findings have been discussed at meetings. We have to fix everything before we can get an
official answer. The public said, but you can set a preliminary budget. How do you know what
your income is or what you're spending if you have no budget. We need to get a current budget
for the community; we want to see where our tax money is going. Another resident suggested
seeing what it costs to run everything for one month and start there to make a new budget. The
clerk stated that has been given to the mayor and commissioners for budget meetings, but there
were other questions as to what miscellaneous chargers were for, and we have no answer for that
with how QuickBooks stands at this time. The town needs to hear the transparency. We can start
with this current calendar year and capture the year-end monthly charges. For the towns' benefit
we can start fresh and move forward. We didn't know about the budget meeting. The meetings
were posted at the post office and town hall and online. The meeting on Friday will be posted on
Wednesday. The required 48 hours of notice. The public asked if the accountant charges are
included in the audit price. Mayor answered, no. Her bill is separate. Another resident said the
transparency is coming along and put in categories that make sense to the town. We're asking for
actual expenses that the town pays to see where our money is going. A synopsis of the audit
meeting needs to go out in the town talk. It's our responsibility to inform the town. We don't
want to end up on WBOC. A resident asks who signs the agreement contract with UHY or is it
an auto renew? We could use a local group of community members to do an audit on contracts
and when they are renewed, what percentages, and what they cost. The members could provide a
report to the mayor and commissioners. There are members in the town that are knowledgeable
and willing to help. A resident asked if there has been any update on the development Mr.
Larmore presented. There hasn't been any new information or ideas brought to the town. The
town had to wait for the new critical area to be approved, and then Mr. Larmore would be able to
go to Dorchester County to start the growth allocation process. Ann stated another revenue idea
would be a larger farmers' market. We just have to advertise and put the word out that the town
has a farmers' market on Friday and find a way for the town to make some money.
Advertisement is an issue with the town because advertising must be on private or commercial
property and there isn't much of that around here. It will always be a problem no matter the
vendor is because we can't get signage on the highway. Could the town charge for using the
billboard that the town has out on rt now? It could be a revenue producer. It's not supported by
the county. The town doesn't need to own multiple properties but certainly holds onto the
waterfront. A resident then asked what the town's long-term plan for the farms outside of town?
The previous commissioner said the original plan was to be used for housing. A resident then
asked what the next step for the town is. Where are we going to go from here? The mayor and

commissioner stated they would like to start the meeting Friday with the audit company. We
need a copy of the contract with UHY to review. Residents agreed and said get the finances set
straight and then move forward. Get help from the town and set up different committees.
Katherine C. added a comment that there will be a meeting for the Vienna Radio Station on
Wednesday, 9/16/26 at the Captain John Smith Museum at 6:30 PM. Anyone is welcome to
come. Clerk stated Wicomico County Choices Academy called and said their fishing field trip is
scheduled for 10/7/26 and a Rain date of 10/8/26. Resident asked if they pay for that? To the
clerk's knowledge, she is not sure. There is also going to be another poker run on the last
Saturday of September on the Nanticoke. Mayor Travers asked if there are any other public
comments. No response from the residents.
Next meeting will be September 28,2026 at 7:00PM. Commissioner Abey made the motion to
adjourn the meeting. Seconded by Mayor Travers. Meeting adjourned at 8:17 PM
