agenda for October 5, 2026, as presented. Commissioner Kueser seconded. All voted aye.

At 9:04 a.m., Julia Jensen, McPherson County Health Department Billing Clerk, joined the meeting to request
to write off uncollectible client debt for Q3 2026 in a total amount of $603.41. Eligible amounts include debt
from KDRS ($96.91), and VFC, 317, and State Vaccine ($506.50). Commissioner Kueser made a motion to
approve the request as presented. Commissioner O'Dell seconded. All voted aye.

Proclamation: Operation Green Light for Veterans 2026
WHEREAS, the residents of McPherson County have great respect, admiration and the utmost gratitude for all
the men and women who have selflessly served our country and this community in the Armed Forces; and
WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in
maintaining the freedoms and way of life enjoyed by our citizens; and
WHEREAS, McPherson County seeks to honor individuals who have made countless sacrifices for freedom by
placing themselves in harm's way for the good of all; and
WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars,
religious groups, civil service, and as County Veterans Service Officers in 29 states to help fellow former
service members access more than $52 billion in federal health, disability and compensation benefits each
year; and
WHEREAS, approximately 200,000 service members transition to civilian communities annually; and

WHEREAS, active military service members transitioning from military service are at a high risk for suicide
during their first year after military service; and

WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize
Operation Green Light for Veterans; and

WHEREAS, McPherson County appreciates the sacrifices of our United States military personnel and believes
specific recognition should be granted;
NOW, THEREFORE, BE IT RESOLVED, with designation as a Green Light for Veterans County, McPherson
County hereby declares November 4-11, 2026, as a time to salute and honor the service and sacrifices of those
transitioning from active service; and

I am requesting permission to sign a contract for Repath services for our agency. The cost
will be 7,500.00 per quarter. It includes the ability to cancel if we do not receive funding
from DOC.
Repath has many different components that will assist our officers supervise clients and
complete the required documentation and paperwork. The attached documents explain
the different aspects of Repath.
Repath is already in use in our Harvey County office by our 3 Drug Court ISO's through the
Drug Court grant. They have used it for several years and all 3 agree that it has made them
more efficient at their jobs. Additionally, 2 of the ISO's are Beta testers for Repath. Their
knowledge of the Repath program will be an asset as the rest of the team learns the
program.
Repath is used by several agencies throughout the state of Kansas. The Department of
Corrections pays for Repath to be used on all juvenile clients. I had hoped that they would
pay for use for all adult clients as well, but they have decided not to do that for the current
fiscal year.

AGREEMENT FOR CONTRACTUAL SERVICES BETWEEN
HARVEY/MCPHERSON COUNTIES COMMUNITY CORRECTIONS AND
eHAWK INC.
This Agreement is entered into this 28th day of September, 2026 between Harvey/McPherson
Counties Community Corrections (hereafter "Agency") and eHawk Inc, doing business at 4041
NE Lakewood Way, Suite 280, Lee's Summit, MO, ("eHawk") (collectively hereinafter Agency
and eHawk referred to as "Parties")
WHEREAS, Harvey/McPherson Counties Community Corrections wishes to engage eHawk to
provide technology for smartphone-based community supervision services;
WHEREAS, eHawk is willing to provide such services; and
WHEREAS, Sunny Milleson is authorized to execute a contract for such services;
In consideration of the mutual promises and covenants contained herein, and other good and
valuable consideration, the receipt and sufficiency of which is acknowledged by the Parties,
hereby agree as follows:
AGREEMENT
1. Term. This Agreement is effective on September 28, 2026 and shall continue for a period of
12 months unless earlier terminated as provided herein. This Agreement may be renewed
annually upon mutual written agreement of both parties prior to the renewal date. eHawk will
reach out to Agency ahead of each renewal to discuss continuing services. Written agreement
to renew may be provided by email.
2. Services Provided by eHawk and Cost. eHawk agrees to provide the RePath platform and
related services as described below. Pricing is based on the number of licensed officer seats,
as defined in Section 2(a).
a. Platform License and Pricing. Agency shall receive access to the RePath platform
for 8 licensed officer seats at a rate of $2,500 per officer seat per year. A licensed
officer seat is defined as any individual who will log into the RePath platform to
perform supervision duties, including but not limited to managing participant
caseloads, conducting virtual check-ins, scheduling visits, or monitoring compliance.
Supervisors or administrators who access read-only dashboards or reports but do not
manage participants directly are not counted as licensed officer seats. The annual
platform fee is $20,000.
Agency shall also receive the RePath GPS monitoring add-on for 8 officer seats at a rate of
$1,250 per officer seat per year. The GPS add-on annual fee is $10,000. The total annual cost
for platform and GPS is $30,000.

The above fees include:

RePath smartphone applications available for iOS on the Apple App Store and for
the Android operating system on Google Play Store
Access for up to 200 active participants concurrently enrolled in the program
Unlimited remote training on the platform for all Agency employees
Unlimited remote technical support for all participants added to the service

b. Mid-Contract Expansion. Agency may add licensed officer seats during the term of
this Agreement. Additional seats shall be priced at the same per-officer rate
established in Section 2(a), pro-rated for the number of full months remaining in the
then-current term. GPS add-on seats may be added on the same pro-rated basis.
Added seats shall renew at the full annual rate upon the next contract renewal date.
eHawk shall invoice any mid-contract additions separately upon activation.
3. Billing. eHawk will invoice the total annual amount as defined in Section 2(a) in four equal
quarterly installments of $7,500 each, billed in advance. The first quarterly invoice is due
upon contract execution, and each subsequent quarterly invoice will be issued on or before
the first day of each successive three-month period of the then-current term. Payment will be
due 30 days after the bill is received. In the case of multi-year agreements or renewals,
quarterly invoicing will continue on the same schedule, measured from the anniversary date
of the contract. Mid-contract expansion invoices as described in Section 2(b) shall be due 30
days after the bill is received. Late payments may be subject to a late fee of 1.5% per month
or the maximum amount allowed by law.
4. Limitations of Service and Liability. The service is a compliance service that monitors the
participant through their iOS or Android smartphone. The service tracks locations at several
intervals during the day and requires "check ins" which involve the application of
fingerprints, and/or facial recognition. The service is designed to be a more efficient and
comprehensive monitoring program than is commonly used. However, this service does not
continuously track location and does not require a physical attachment to the body. While the
system is designed to encourage full participation and identify participants who fail to
comply with the monitoring agreement, a participant may break their phone, allow the phone
to lose all battery power, fully power off their phone, give their phone to another individual,
attempt to spoof their actual location, attempt to deceive the fingerprint or facial recognition
technology, turn off location services, or simply leave their phone in another location.
Further, a participant's phone and service may, at times, not provide accurate location data
for technical reasons beyond eHawk's control. Agency agrees that it understands the scope
and limitations of the service. Further, Agency understands that the service depends upon
certain technology and third parties beyond eHawk's control. eHawk's liability to Agency
and/or any participant will be limited to activity entirely within its control and eHawk will
not be liable to Agency and/or any participant for any amount in excess of the amount paid
by said Agency and/or participant directly related to that participant.
5. Individual Participation Agreements. Agency agrees that it will require a participant
agreement for each individual participating in the monitoring service that, at a minimum, will
require that the participant 1) comply with the terms and conditions of the App; 2) will not
attempt to provide any false information to the App; and 3) will not attempt to circumvent the

intended use and functionality of the App. Agency agrees that it will require a written
guardian's approval for use of the App with any participant below the age of 13.
6. Use of Data.
a. Agency agrees that the data provided to the platform by eHawk will be used in a
manner consistent with and limited to the order and/or agreement for monitoring, the
data is not to be used for general law enforcement purposes or other purposes outside
of those specific to the monitoring order or agreement, and the data will only be
shared with approved individuals for a legitimate purpose consistent with the order
for monitoring. The Agency understands that its approved individuals will have the
ability to review data on the platform and also to make changes relating to the
supervision of participants. eHawk is not responsible for the use of the platform by
Agency's approved individuals. The Agency agrees that it will utilize the platform as
intended and will not attempt to save, maintain, database, index, transfer, or journal
the data outside of the platform unless by written agreement with eHawk. Agency
understands that all of the data relating to the service will be made available to
Agency for the length of the agreement and for 3 years beyond and eHawk will
provide a copy of all of the data relating to the service to the Agency at the Agency's
request.
b. eHawk may anonymize data relating to this agreement and provide analytics for
benefit of law enforcement, probation and parole, or academic purposes by separate
agreement. Agency understands that eHawk will provide non-anonymous data if
presented with valid warrant or subpoena and for service of legal process. Agency
agrees that eHawk may provide certain data across jurisdictions for certain purposes
including, but not limited to service of process, identification of prior arrests or
participation in the service, and confirmation of proper identity. Agency will have
access to such data from other jurisdictions at no additional cost.
7. Notice. Except as otherwise provided in this Agreement any notice of default or termination
from either party to the other party must be in writing and sent by certified mail, return
receipt requested, or by personal delivery with receipt. All notices shall be deemed delivered
two (2) business days after mailing, unless delivery is by personal delivery in which case
delivery shall be deemed to occur upon actual receipt by the other party. For purposes of all
notices, Contractor's and Agency representative are:

8. Default and Termination. The failure of the parties to comply with any provision of this
Agreement will place that party in default. Prior to terminating the Agreement, the nondefaulting party will notify the defaulting party in writing. This notification will make
specific reference to the provision which gave rise to the claimed default. If the default is not
cured within 30 days, then the non-defaulting party may terminate the agreement.
Termination for Lack of Funding. Agency's payment obligations under this Agreement
depend on continued funding from the Kansas Department of Corrections or other funds
appropriated for these services. If that funding is not appropriated, is withdrawn, or is
reduced so that Agency can no longer pay for the services, Agency may terminate this
Agreement by written notice to eHawk, which may be sent by email and must state the
funding reason. Termination will take effect at the end of the quarterly billing period in
which eHawk receives the notice, and eHawk will issue no further invoices after that date.
Agency will pay for all services provided through the effective date of termination, and
amounts already paid for a billing period that has begun are not refundable. No early
termination fee or penalty applies. Agency will not terminate under this section in order to
buy substantially similar services from another provider for the remainder of the then-current
term.
9. Non-Disclosure. All parties to this agreement understand that disclosure of confidential or
proprietary information may be necessary to fulfill the provisions of this agreement. The
receiving party agrees to take all reasonable precautions to protect any confidential or
proprietary information.
10. Intellectual Property. Any and all intellectual property owned by a party to this Agreement
prior to the date of this Agreement shall continue to be owned by such party.
11. Representation and Warranties of eHawk. eHawk represents and warrants to the Agency
that the execution, delivery and performance by eHawk of this contract has been duly
authorized by all necessary corporate action and no further corporate action is necessary to
authorize the execution of this agreement; there is no litigation known or threatened against
eHawk that would impact this agreement; and eHawk has not and will not enter into any
agreement that purports to grant a security interest to any person or entity relating to any
product or service included in this agreement.
12. Successors and Assigns. The Agency and eHawk each bind the other and their respective
successors and assigns in all respects to all of the terms, conditions, covenants, and
provisions of this Agreement.
13. Brokers. The parties to this Agreement (a) represent and warrant to the other party that it
has retained no finder or broker in connection with the transactions contemplated by this
Agreement.
14. Exclusivity. For the term of this Agreement, the Agency agrees that eHawk will be its
exclusive partner for any electronic monitoring of individuals that utilizes a smartphone as a
component to the monitoring service.

15. Entirety of Agreement. This Agreement hereto constitutes the entire agreement between
the parties with respect to the subject matter of this Agreement and specifically supersedes
any prior agreement, arrangement, or understanding between the parties regarding such
subject matter. All section and exhibit references herein, unless specifically indicated
otherwise, refer to sections of or exhibits to this Agreement.
16. Severability. If any provision of this Agreement or the application thereof to any person or
circumstance shall be invalid or unenforceable to any extent, the remainder of this
Agreement and the application of such provisions to other persons or circumstances shall not
be affected thereby and shall be enforced to the greatest extent permitted by law.
17. Headings; Exhibits and Schedules. The headings of the sections, subsections, and
paragraphs of this Agreement have been added for convenience only and shall not be deemed
to be a part of this Agreement. The schedules and exhibits attached hereto are incorporated
herein by reference in this Agreement.
18. Amendments and Waivers. This Agreement may be amended and the observance of any
provision hereof may be waived (either generally or in a particular instance and either
retroactively or prospectively) only with the written consent of each party to be bound
thereby. No provision of this Agreement shall be deemed to have been waived except if such
waiver is contained in a written notice given to the party claiming such waiver has occurred,
and no such waiver shall be deemed to be a waiver of any other or further obligation or
liability of the party or parties in whose favor the waiver was given.
19. Counterparts; Facsimile or Electronic Transmission. This Agreement may be executed in
one or more counterparts, all of which will constitute one and the same instrument. This
Agreement may be delivered by facsimile transmission or by scanned e-mail transmission.
This Agreement will be considered to have been executed by a person if there exists a
photocopy, facsimile copy, or a photocopy of a facsimile copy of an original hereof or of a
counterpart hereof which has been signed by such person. Any photocopy, facsimile copy, or
photocopy of facsimile copy of this Agreement or a counterpart hereof will be admissible
into evidence in any proceeding as though the same were an original.
Interpretation.
1. Directly or Indirectly. Any provision of this Agreement which refers to an action which
may be taken by a party hereto, or which a party hereto is prohibited from taking, shall
include any such action taken directly or indirectly by or on behalf of such party,
including by or on behalf of any affiliate or agent of such party.
2. No Presumption. In the event that any claim is made by any party hereto relating to any
conflict, omission, or ambiguity in this Agreement, no presumption or burden of proof or
persuasion shall be implied by virtue of the fact that this Agreement was prepared by or
at the request of a particular party or its counsel.
3. References to this Agreement. References to numbered or lettered articles, sections,
and subsections refer to articles, sections and subsections, respectively, of this Agreement
unless otherwise expressly stated.

4. Person. Except as otherwise expressly provided in this Agreement, all references to the
word "person" in this Agreement include individuals, partnerships, corporations, limited
liability companies, trusts, and any other legal entities or associations.
20. Governing Law; Venue; Arbitration. The construction and interpretation of this
Agreement shall at all times and in all respects be governed in accordance with the laws of
the State of Kansas. Venue shall be in McPherson County, Kansas.

We propose to work with you, along with the McPherson County Commissioners, to develop plans and budgets for renovations
within the McPherson County Courthouse as needed.
This proposal specifically includes:
1. Determine the next steps and coordinate repairs to the existing roof
2. Determine scope of work for interior repairs and remodels (i.e. painting, carpet, door repairs, etc.)
3. Attend all meetings as required.
4. Enlist the help of Architects and Engineers as needed.
5. Preliminary or Conceptual plans
a. Preliminary site plan
6. Feasibility sketches, and budgets to help make the decision regarding renovations on your current site.
7. Adjustment of the plan as ideas and needs are developed.
8. All drawings will be done using Revit or Auto Cad, so the plans can be shared with engineers and architects when that
time comes.
9. Budget for the project including final design and engineering.
10. The goal of this agreement is to:
a. Establish budget for this project.

This is a preliminary agreement; it includes only preliminary architectural and engineering work. Final working drawings
approved by licensed design professionals will be needed to do any construction projects.
We will perform the above at an hourly rate of $70.00 an hour with a maximum not to exceed $ 20,000.00.
Some items that may be needed at additional costs: Legal survey, hazardous materials study.
Some professionals may need to be reimbursed for their time. We will seek approval from the McPherson County
Commissioners prior to any commitments beyond the $ 20,000.00 limit.
It is understood that either party may sever this agreement at any time for any reason.
It is the intent of both parties that Fuqua Construction Inc. will be hired as Design-Builder doing all the design engineering
and construction of any significant remodeling or additions.
