Mrs. Saingilus stated the Infrastructure Surtax Oversight Committee is requested to
approve the completed sales tax funded projects to ensure that each proposed project
meets the requirements of the Village's Resolution, PBC's Sales Tax Ordinance and
State law. The completed projects have been funded utilizing Infrastructure Surtax
Funding that have been received by the Village of Palm Springs. Below you will find a
list of projects completed during the FY 2019.

Surtax Projects Annual Report. Committee Member James Mandigo seconded the
motion for approval. Motion carried 3-0.

Proposed New Infrastructure Surtax Project List - FY 2020

Mrs. Saingilus stated in May 2016, the Village Council entered into an Interlocal
Agreement with Palm Beach County and the School District of Palm Beach County to
support a one-cent infrastructure surtax for Capital Improvement Projects (CIP).
In September 2019, the Village Council approved the Village's Capital Improvement
Plan (CIP) that included a number of projects (in addition to the previously approved
FY 2019 & FY 2018 sales tax projects) to be funded utilizing infrastructure surtax
dollars. Approval of these projects by the Village Council was completed during the FY
2020 budget process. The Village is expected to receive approximately$1,709,896 in
FY 2020 (and has approved bringing forward $3,244,211 from Fund Balance Assigned) to support these projects.

The approved list of sales tax funded projects is being presented to the Infrastructure
Surtax Citizen Oversight Committee to ensure that each proposed project meets the
requirements of the Village's Resolution, PBC's Sales Tax Ordinance and State law.
Committee Member Diana Sardina asked if the projects were just for Parks and
Recreation. Mrs. Saingilus informed the Members that at this time it was Parks and
Recreation that was bringing forward project’s FY 2020.
The Committee did ask about the Police Department projects. Chief of Police Tom
Ceccarelli said since the last meeting, the Police Department went out for Request for
Quote (RFQ) and set up a committee. There were six (6) proposals submitted, and the
Committee chose Song and Associates. There will be a meeting on March 11, 2020
with the Architect. They will have to go back out for the construction project. He said it
was slow, but they were getting there.
Chairman Susan Chapman also asked for an update on the projects that were started
to date. Parks and Recreation Director Justin Lucas stated the surveillance cameras
have been added to every park. There were two (2) fishing docks in Sago Park and
Frost Park, they were made of a composite that lasts much longer.
Some new projects underway:







A new Community Center, property must be obtainable for the Village.
Sable Palm Park – new restroom facilities. There is a restroom in place, the project
is not complete, sod and sidewalks are needed and then it will be open to the
public.
Sago Palm Park - new pavilions, a large and small one. They are picked out and
it will take 60-90 days to install for use. New playgrounds, shade structures and
park improvements are also listed.
Pathway park, the design was started last fiscal year and within 60 days, there will
be an enhanced sidewalk, a new concrete called lumino glow, paver bricks, which
is the first stage of the nine (9) park connectors.

Director Lucas also mentioned the year before the two (2) Blue Bird school buses were
bought. There was also a smaller passenger bus that is ADA compliant with a lift. They
are also in the process of getting the buses wrapped, to spruce them up.
Program Manager Walter Sanchez stated FY 2019 two (2) sidewalk projects were
completed, August 19, 2019 which was on Reo Lane. The other one was on Lakewood
Road, both the south and north sides. The project was completed July 19, 2019,
between Davis Road and Kirk Road.
Chairman Susan Chapman asked for a motion to approve Item 3.3. Committee
Member James Mandio made a motion to approve the proposed new Infrastructure

Surtax Projects - FY 2020. Seconded by Committee Member Diana Sardina. Motion
carried 3-0.

5. OTHER BUSINESS
Director of Public Works Ronald Eyma wanted to introduce himself to the Committee as
Public Works would also have projects and help in a lot of the projects. He also thanked
the Committee Members for their time that they are volunteering.

SUMMARY:
The Infrastructure Surtax Citizen Oversight Committee is requested to review and recommend
the required FY 2020 Infrastructure Projects Annual Report (Resolution 2017-06 - Section 3.)
to the Village Council for final approval. This report provides an update on the status of each
project that was previously submitted to the Citizen Committee for review and approved to
ensure compliance with all state, County and Village surtax funding requirement.

The proposed Annual Report was prepared by the Senior Administrative Manager with the
assistance of the Parks and Recreation Director, Police Chief, Project Manager and Assistant
Public Service Director and reviewed by the Finance Director.

There is no fiscal impact to the Village.

Public Service - Public Works:
New Bike Lanes – Congress Avenue (2nd Avenue South to 6th Avenue)
 This project is included in the Villages Capital Improvement Projects for FY 2022.
Discussions with the Florida Department of Transportation and Palm Beach
County Roadway are planned for the near future to discuss the project and the
permitting agencies requirements.

Police Department:
Police Department Building Expansion (Design and Engineering)
 Architect representatives conducted a site visit of the police department and took
numerous photos of the interior and exterior of the building. A brief meeting to
review the space needs and finalize some of the numbers. The meeting allowed
the architect to verify the Needs Assessment / Programming for the facility. After
the meeting, the architect analyzed the program data and developed several “big
picture” options for the project approach.
A meeting was held to review the approach options to eliminate any direction that
should not be further pursued.
After receiving all three design options the proposed costs did not meet the initial
budget projected. A revised presentation document was received reducing the
overall project cost and proposed square footage to better align with the available
budget. Revisions included site approach, budget adjustments, and program
changes.

Staff is currently reviewing the latest revisions to discuss the next steps going
forward.
Parks & Recreation:
The below park projects are ongoing and in the planning stage. A landscape
architect will be retained to perform a complete redesign of the Sago Park. This
would include establishing standards for the pavilions. Once Sago Park is
complete the remaining park projects will be conducted.
Sago Palm Park Improvements (renovation) – (This project was originally approved
by Council with separate line items, it now has been combined as one large project to
include the below:
 Kayak Launch
 Renovate/Replace Restroom
 Replace Metal Pavilions (1) one large group pavilion
 Replace Metal Pavilions (1) one small group pavilion
 Install New Playground Equipment
 Install Playground Shade Structure
 Surfacing/landscaping
 ADA Sidewalk
 Renovate the entry way into Sago Palm Park
 Parking Improvements
Sabal Palm Park - Install New Bathroom Facilities

This project was completed July 2020

Royal Palm Park ‐ New Fishing Dock
 Engineering for this fishing dock has been completed- bid prices were higher
than budget; will work to find grants that can be used to supplement this cost
Lakewood Garden Park ‐ Install Playground Shade Structure
We received a grant from Land Water Conservation Fund (LWCF), and Sales Tax
Dollars will be used to fund this project to include the below:
 Amenities include:
 Replacement of playground
 Playground Surfacing
 Adding shade to the playground
 New picnic tables
 Renovation of basketball court






Renovation of sand volleyball court
New landscaping
Trash/recycling
New combo pet/bottle filler/water fountain

Village Center ‐ Install Playground Shade Structure
 Playground has been selected and includes equipment that provides shade
Ballfield Turf Grass Renovations – Village Complex
 This project includes removal of old sod, laser grading, new soil, irrigation and
sodding has been completed. Grow in period with completion in November 2020

Property Purchase Community Center – 250,000 Sales Tax Portion
 Staff is currently researching and looking for sites

Consistency with the Village's Resolution, PBC's Sales Tax Ordinance and State Law
SUMMARY:
In May 2016, the Village Council entered into an Interlocal Agreement with Palm Beach
County and the School District of Palm Beach County to support a one-cent infrastructure
surtax for Capital Improvement Projects (CIP) and equipment that were not funded due to the
recent recession and dramatic decrease in assessed property values over the past decade. In
November 2016, the one-cent sales tax was approved by 56.63% of the voters of Palm Beach
County. The Village will receive approximately $12,567,545 million dollars over a 10-year
period to complete various Capital Improvement Projects (CIP).
In September 2020, the Village Council approved the Village's Capital Improvement Plan
(CIP) that included a number of projects (in addition to the previously approved FY 2019 & FY
2020 sales tax projects) to be funded utilizing infrastructure surtax dollars. Approval of these
projects by the Village Council was completed during the FY 2021 budget process. The
Village is expected to receive approximately $1,479,402 in FY 2021 (and has approved
bringing forward $2,097,250 from Fund Balance - Assigned) to support these projects.

ARTICLE XVI. - LOCAL GOVERNMENT INFRASTRUCTURE TAX[10]

Sec. 17-491. - Imposition.
There is hereby imposed a one (1) percent local government infrastructure surtax ("Surtax") upon all
authorized taxable transactions occurring within the County.

Sec. 17-492. - Administration, collection, and distribution of proceeds.
The Surtax shall be administered, collected, and enforced in accordance with the provisions of
Section 212.054, Florida Statutes (2015), and the rules promulgated by the Florida Department of
Revenue. The proceeds of the Surtax shall be distributed by the Department of Revenue directly to the
County, the Municipalities, and the School Board, in accordance with an interlocal agreement.

Sec. 17-493. - Expiration date; survival of certain restricted uses.
(a) Sunset. In all events, this article shall be in effect only through December 31, 2026. It shall "sunset"
and expire thereafter, without further action by the Board, at which time it shall be deemed repealed
and of no further force and effect, and the Surtax levied hereunder shall terminate. Alternatively, this
article shall "sunset" in the event that the total aggregate distributions of Surtax proceeds equal or
exceed the amount of $2,700,000,000.00 on or before September 1 of any year during the term of
this article, in which event the Board shall take all necessary action to repeal this article and notify
the Florida Department of Revenue prior to the applicable deadline so that the Surtax will not
continue for the following calendar year.
(b) Survival of restrictions on use of Surtax proceeds. Notwithstanding the provisions of subsection (a)
for the expiration and repeal of this article, so long as any Surtax proceeds shall remain unspent, the
restrictions hereby imposed concerning the distribution and use of such Surtax proceeds as well as
the proceeds of any borrowings payable from Surtax proceeds, and all interest and other investment
earnings on either of them shall survive such expiration and repeal and shall be fully enforceable in a
court of competent jurisdiction.

Sec. 17-494. - Citizen oversight.
(a) The County, the Municipalities, and the School Board shall each separately provide for the creation
of citizen oversight committees ("Committee" or collectively "Committees") to provide for citizen

review of their respective expenditure of Surtax Proceeds, as soon as possible after the Surtax
becomes effective, but not later than the date on which Surtax funds are first expended. A
Municipality may either participate in an oversight committee created by the Palm Beach League of
Cities or create its own committee.
(b) The Committees shall serve as advisory and reporting bodies to the creating entities. Each creating
entity shall establish specific duties and membership requirements governing Committee operations
and participation.
(c)

Each Committee shall have the responsibility to review the expenditure of Surtax proceeds by the
entity which created it.

(d) The Committees shall meet monthly, or as otherwise needed to fulfill their duties and responsibilities.
Each Committee shall provide an annual report to the governing board of the entity which created it.
(e) Committee members shall receive no compensation for the performance of their duties.
(f)

The Committees, their members, and all their proceedings shall be governed by and comply with the
provisions of the Florida Sunshine Law, F.S. Ch. 286, Florida Statutes, the Florida Public Records
Law, F.S. Ch. 119, and the Florida Ethics Code, F.S. Ch. 112, and all other applicable local or state
statutes, ordinances, or rules.
