The meeting schedule for the next month is as follows: Regular Town Commission
Meeting Monday, November 2nd at 6:00 PM; Code Enforcement Hearing Tuesday,
October 6th at 10:00 AM; Planning & Zoning Board Meeting Tuesday, October 20th
at 9 AM. All meetings are held in the Commission Chambers at Town Hall.

Town Hall will be closed Monday, October 12, 2026, in observance of the Columbus
Day holiday.

The Annual Municipal Election will be held on March 9, 2027. There will be two
Town Commission seats open for a three-year term and one Commission seat open for
a two-year term. Candidate filing dates run from November 2, 2026, at Noon through
November 13, 2026, at Noon in the Town Clerk’s Office. / Las elecciones municipals
anuales se celebrarán el 9 de marzo de 2027. Se elegirán dos miembros de la Comisión

The Town is hosting a blood drive event with One Blood on Saturday, October 10th

PROCLAMATION DECLARING OCTOBER 19-25, 2026, FLORIDA CITY WEEK
WHEREAS, city government is the government closest to most citizens and the one
with the most direct daily impact upon its residents; and
WHEREAS, municipal government provides services and programs that enhance the
quality of life for residents, making their city their home; and
WHEREAS, city government is administered for and by its citizens and is dependent
upon public commitment to and understanding of its many responsibilities; and
WHEREAS, city government officials and employees share the responsibility to pass
along the understanding of public services and their benefits; and
WHEREAS, Florida City Week offers an important opportunity for elected officials and
city staff to spread the word to all citizens of Florida that they can shape and influence
this branch of government; and
WHEREAS, the Florida League of Cities and its member cities have joined together to
teach citizens about municipal government through a variety of activities.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN OF OCEAN RIDGE AS
FOLLOWS:
Section 1. That the Town of Ocean Ridge encourages all citizens, city government
officials and employees to participate in events that recognize and celebrate Florida City
Week.
Section 2. That the Town of Ocean Ridge encourages educational partnerships
between city government and schools, as well as civic groups and other organizations.

Resolution 2026-09: Adoption of Tentative Millage Rate for Fiscal Year 2026/2027
a. Presentation of Proposed Millage Rate for FY 2026/2027

Town Manager Heiser proceeded to provide an overview of the Town's proposed operating millage rate,
offering both historical context and a current assessment of the Town's fiscal standing.
b. Announce the Town of Ocean Ridge Computed Millage Rate of 5.4 mils,
which is higher than the Rolled Back Rate of 5.0881 by 6.1%. The millage to be levied
is 5.4000.
Town Manager Heiser announced that the Town of Ocean Ridge is proposing an operating millage rate
of 5.4 mills for fiscal year 2026-2027. She noted that the rate has remained unchanged for four
consecutive years. She stated that the proposed rate of 5.4 mills exceeds the rollback rate of 5.0881 mills.
c. Public Comment & Comments from Commissioners
Vice Mayor Coz opened the floor for public comment.
Resident Betty Bingham inquired about using existing alleyways for sewer installation to minimize
roadway disruption. Vice Mayor Coz noted that state funding would be expected if sewer installation is
mandated and closed public comment.

cost would be sufficiently low and that it would not require Commission approval.

PRESENTATIONS & PROCLAMATIONS
1. Swearing-in of Commissioner Lanette Gustafson
Town Clerk Kelly Avery administered the Oath of Office to Commissioner Lanette Gustafson, who was
duly sworn into office. Members of the Commission offered their congratulations.
2. State of Education Report – PBC School Board Member Erica Whitfield
Palm Beach County School Board Member Whitfield delivered her State of Education report. She noted
that this would likely be her final such presentation to Ocean Ridge, as she is transitioning to the Palm
Beach County Commission following her November election to represent District 2.
Commissioners asked questions regarding the overall decline in student numbers, the district's comparative
standing statewide, and absenteeism. Member Whitfield confirmed the district is among the bestperforming urban districts in Florida and that chronic absenteeism remains a focus area being addressed
through parental notification systems and the truancy court.
3. Proclamation for Feeding South Florida
Town Clerk Avery read the proclamation into the record.
Vice Mayor Coz presented the proclamation to the organization's representative in attendance.

4. Audit Presentation
Ronald Bennett of Bennett & Associates presented the Town's fiscal year 2025 financial statements, noting
this was his 20th consecutive year making the presentation and most likely his last in that capacity, as the
Town has engaged a new auditing firm.
Commissioner Aijala thanked Mr. Bennett for his long service to the Town. The Commission expressed
appreciation for his 20 years of auditing and looked forward to his continued affiliation with the Town in a
different capacity.

Approval of Agreement for Auditing Services with Grau & Associates

Town Manager Heiser provided background on the procurement process.
Commissioner Aijala noted that both firms were highly qualified, and that Grau's geographic proximity,
being located on the east side of the state, would be an added convenience. He confirmed that cost, while
favorable, was not the sole basis for the selection.
Commissioner Aijala moved to approve the hiring of Grau & Associates for auditing services;
seconded by Commissioner Cassidy. Motion carried. 4-0 (1:11)

Approval of Ordinance on Second Reading: Ordinance 2026-02: An Ordinance Of The
Town Commission Of The Town Of Ocean Ridge, Florida, Amending Chapter 66,
“Environmental Regulations”, Article IV, “Landscaping”, Division 2, “Water Efficient
Landscape”, Section 66-142, “Artificial Turf/Synthetic Grass”, To Conform To The
Requirements Of Section 125.572, Florida Statutes, And The Florida Department Of
Environmental Protection’s Minimum Standards For Single Family Residential
Properties Of One (1) Acre Or Less In Size; And Providing For Repeal Of Conflicting

Direction on Enforcement of Political Signs in the Town’s Right of Ways.

Town Manager Heiser introduced the item.
Town Clerk Avery clarified that while signs may be placed beginning 60 days before an election, current
code prohibits placement in the Town's right-of-way entirely.
Vice Mayor Coz noted that historically, strict enforcement has resulted in neighbor-against-neighbor
conflicts and suggested that a reasonable approach would be to allow signs in the Town right-of-way for
the thirty (30) days prior to the election without active enforcement, provided the signs do not pose safety
concerns.
Commissioner Aijala agreed, noting that aggressively removing signs that are marginally out of position
could appear petty or suggest favoritism.
Town Manager Heiser clarified that, regarding sign placement on private property, staff would first contact
the property owner or candidate before taking any enforcement action. She further stated that the Town
would not enter private property to enforce sign regulations.
Town Attorney Goddeau noted that safety-related concerns, such as signs obstructing sight lines, would
warrant more immediate action notwithstanding the thirty (30) day period.
The Commission gave consensus to permit political signs in the Town right-of-way during the 30 days prior
to an election, with enforcement reserved for situations involving safety hazards or repeated noncompliance
26.

Appointment of Alternate Member to the Planning & Zoning Board

Town Manager Heiser presented the application of Lori Herkert, a Coconut Lane resident, for appointment
as an alternate member to the Planning and Zoning Board. She noted that Ms. Herkert holds an MBA, has
extensive volunteer experience, and also has a background as a respiratory therapist. Ms. Herkert was
unable to attend the meeting as she was returning from travel abroad but communicated her readiness to
serve.
Commissioner Cassidy asked about how frequently alternates are called upon.
Town Clerk Avery indicated that alternates have been needed more often in recent years, both due to
absences and due to conflict-of-interest recusals that reduce an otherwise quorate board below voting
capacity.
Commissioner Cassidy moved to appoint Lori Herkert as an alternate member to the Planning and
Zoning Board; seconded by Commissioner Aijala. Motion carried 4-0. (1:24)
STAFF & COMMITTEE REPORTS

Town Manager
Town Manager Heiser directed the Commissioners to the written report included in the meeting packet
and highlighted the generator installation on Tropical as a notable item. She reported that the longrunning project remains on schedule for installation in mid-October, pending coordination with the crane
operator.

Police Chief

Chief of Police Scott McClure stated his report was in the packet and provided an update on the Town’s
License Plate Reader (LPR) system, noting its effectiveness in assisting with criminal investigations and
vehicle recoveries. He reported that an internal audit found no misuse or policy violations and cited an 81%
reduction in crime over the past three years. He also noted efforts to relocate cameras from state rights-ofway and maintain coverage through agreements with private property owners.

FY 27 BUDGET HEARING ITEMS
1. a. Presentation of the Final Millage Rate for FY 2026/2027

Town Manager Michelle Heiser opened the final budget hearing by welcoming attendees and
noting that the budget process began in May. She expressed appreciation for the Commission’s
collaboration in establishing priorities and assisting staff throughout the process.
b. Announce the Town of Ocean Ridge Computed Millage Rate is higher than the
Rolled Back Rate of 5.0881 by 6.13%. The millage to be levied is 5.4000.
Town Manager Heiser announced that the Town of Ocean Ridge's computed millage rate is
higher than the rollback rate of 5.0881 by 6.13 percent, and we are asking the millage rate to be
levied at 5.4000 mills. She noted that Ocean Ridge’s proposed millage rate was comparable to
neighboring municipalities, falling in the middle of the range. She also mentioned that the rate
has remained consistent and supports a balanced budget, the Commission’s priorities, fiscal
sustainability, and adequate reserves.

Commissioner Carolyn Cassidy raised a question regarding the neighboring City of Boynton
Beach, noting that their figure appeared to reflect a rollback rate. Town Manager Heiser
confirmed that Boynton Beach had been asking for the rollback rate, though she noted she was
not entirely certain of the specifics of their situation.

comment.
d. Resolution No. 2026-11: Adoption of final Millage Rate for Fiscal Year 2026/2027
Town Clerk Avery read the resolution into the record by title only.
Town Manager Heiser reiterated the formal announcement for the record, noting the slide was
now visible to confirm the figures: the final millage rate being brought forward for a vote is
5.4000 mills, representing 6.13 percent over the rollback rate of 5.0881 mills.
Vice Mayor Coz noted that, if a nearby $59 million residential property sells at its listed price,
the Town could receive approximately $1.06 million in additional annual tax revenue. The
comment prompted brief discussion regarding the transaction’s potential impact on the local tax
base.
Vice Mayor Coz moved to adopt Resolution 2026-11; seconded by Commissioner Aijala.

Town Manager Heiser presented the final budget. She characterized the budget as needs-based
and noted the elimination of recurring line items that had not been utilized. She stated that the
primary increases resulted from salary adjustments and higher operating costs. She advised that
any unanticipated needs arising during the fiscal year would be presented to the Commission
for consideration.
Commissioner Gustafson asked whether an outline of the eliminated items was available for
the public to review.
Town Manager Heiser responded affirmatively and provided several specific examples. She
noted that the updated procurement policy permits the Town Manager to make emergency
purchases without awaiting Commission approval, subject to subsequent ratification by the
Commission. The Commission expressed support for the change.
Mayor Pugh commented favorably on the elimination of the pre-allocated line items, observing
that such items had historically been funded through contingency in any case. Town Manager

As you may know, the Municipal Election will be held on March 9, 2027.
As done each year, a Resolution designates the members of the Election Canvassing Board for
the Town of Ocean Ridge. This year, we would like to again appoint the Palm Beach County
Canvassing Board for the March 9, 2027, Municipal Election for purpose of canvassing the
returns and certifying the results of the election including all absentee ballots and/or to attend the
testing of the automatic tabulation equipment. This is to meet the guidelines as outlined in state
law, town code, and the election agreement between the County and Town.

RESOLUTION NO. 2026-13
RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF OCEAN RIDGE,
FLORIDA, APPOINTING THE PALM BEACH COUNTY CANVASSING BOARD AS
THE TOWN OF OCEAN RIDGE CANVASSING BOARD FOR THE 2027 MUNICIPAL
ELECTION; AND PROVIDING FOR REPEAL OF CONFLICTING RESOLUTIONS,
SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, pursuant to sections 2-196 and 2-198 of the Town of Ocean Ridge Code of Ordinances,
the Town’s canvassing board for the upcoming 2027 municipal election may be composed of members of the
Town Commission or its designee for purpose of canvassing the returns and certifying the results of the election
including all absentee ballots and/or to attend the testing of the automatic tabulation equipment; and,
WHEREAS, the Palm Beach County Supervisor of Elections has made the Palm Beach County
Canvassing Board (as defined by section 102.141, Florida Statutes) available to municipalities to serve as a
municipality’s canvassing board for the municipality’s 2027 election; and
WHEREAS, the Palm Beach County Canvassing Board is composed of the Palm Beach County
Supervisor of Elections, a county court judge, and the chair of the Board of County Commissioners for Palm
Beach County, which Canvassing Board must be utilized by the Town in the event of a county-wide election or an
election which encompasses more than one municipality; and
WHEREAS, the Town of Ocean Ridge finds that the designation of the Palm Beach County
Canvassing Board as the Town’s canvassing board for the 2027 municipal election is in the best interests of the
Town and serves a valid public purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COMMISSION OF THE TOWN
OF OCEAN RIDGE, FLORIDA, THAT:
Section 1.
The Town Commission hereby designates all canvassing duties as defined by
Florida Statutes, the Florida Administrative Code, and the Town’s Code of Ordinances to the Palm Beach County
Canvassing Board for the 2025 Municipal Election.
Section 2.

Subject: Request for Legislative Lobbying Efforts
Staff asks the Commission to authorize the Town's lobbyists to pursue legislative relief during
the 2027 Legislative Session for small municipalities facing heavy public records workloads.
The attached information sheet would serve as the Town's supporting material.
Public records requests to the Town have grown, especially police records involving bodycamera and other video. The departmental sum of requests rose from 503 in 2024 to 596 in
2025, an increase of 18.5%. Police requests nearly doubled over the same period, from 112 to
222 (98.2%). The 2026 partial-year count of 188 already equals 84.7% of the 2025 total. Clerk's
Office volume has stayed fairly steady.
Request counts understate the workload. A single video request may involve several recordings,
exemption review under F.S. 119.071(2)(l), audio and image redaction, quality checks and
secure delivery. Staff handle this work on top of their regular duties.
Current Law
Chapter 119 requires prompt acknowledgment and a good-faith response but sets no completion
deadline. Requesters may remain anonymous and need not state a purpose. F.S. 119.07(4)(d)
already allows a special service charge when a request requires extensive IT or staff assistance,
but applying it to video redaction is inconsistent in practice.
Relief Options the Lobbyists May Pursue
The Town's position would preserve public access and anonymity while seeking these four types
of relief:
1. Funding: state grants and shared regional services for records staffing, video redaction
and secure delivery.
2. Workflow clarity: statutory guidance on production schedules, rolling releases and
duplicate requests.
3. Cost recovery: clear authority to recover the actual cost of extensive video review and
redaction, with transparent estimates and safeguards against excessive fees.

4. Statewide study: data on request volume, video hours, staff time, unrecovered costs and
automated submissions, to support targeted reform.

automated bulk requests; local counts do not establish how many requests are automated or commercially motivated.

Current Florida law
Chapter 119 requires prompt acknowledgment and good-faith response; §119.07 sets no universal completion deadline.
Anonymous access is longstanding, and a requester generally need not explain a purpose. Residency, connection to an
incident or commercial use generally does not determine access. Reasonable special service charges are already
permitted for extensive IT or staff assistance. Body-camera privacy exemptions and other applicable exemptions still

Options for legislative discussion
Fund capacity. Provide small-town grants and shared regional services for records staffing, video redaction and secure
delivery.
Clarify high-volume workflows. Develop guidance on documented production schedules, rolling releases and duplicate

Make cost recovery workable. Clarify reasonable actual-cost recovery for extensive video review and redaction, with
transparent estimates and safeguards against excessive fees.
Measure the statewide burden. Study request volume, video hours, staff time, unrecovered costs and evidence of
automated submissions before designing targeted reforms.
Public access remains essential. Small towns need practical tools and resources to provide it reliably.

Town Commission Agenda Memorandum
Subject: Town Manager
The FY2027 budget process did more than produce an annual spending plan. It established a
more disciplined management framework for how the Town defines its cost to operate, evaluates
discretionary expenditures, maintains reserves, and measures whether fiscal discipline is
affecting resident services.
Since the last update, the Town Manager and Staff:
• Completed the FY2027 budget process and final adoption, including the August 31 final
workshop, September 14 tentative hearing, and September 21 final hearing. The adopted
framework totals approximately $20.69 million, including $11.395 million in recurring
operations, $382,370 in debt service, and $4.3 million in capital investment, while
maintaining the 5.4000 millage rate.
• Introduced a clearer “Cost to Operate” framework, separating recurring operating costs
from debt, capital projects, reserves, and other nonrecurring expenditures. This gives the
Commission a much better baseline for evaluating future budget growth.
• Developed the Need-Based Expenditure Review methodology rather than automatically
carrying forward discretionary projects simply because they appeared in prior budgets.
The approach is essentially: Need Identified → Condition Assessed → Priority
Established → Funding Authorized → Expenditure Made. This was part of how you
constrained expenditure growth while preserving existing service levels.
• Established proposed long-term financial guidance around a 58% General Fund reserve
benchmark and 4% annual contingency target, creating a more disciplined framework for
future budget development instead of treating fund balance as an arbitrary number.
• Maintained substantial financial capacity, with approximately $6.5 million in projected
unassigned General Fund balance, while also identifying roughly $1.18 million in
expenditures that could be reduced or deferred if conditions warranted.
• Advanced the regional water authority evaluation following Commission direction on
August 31, including incorporating $200,000 for due diligence into FY2027 so the Town
can independently evaluate governance, infrastructure valuation, rates, liabilities, capital
obligations, service standards, and the financial implications before making any
commitment.
• Continued restructuring the Town's financial management model, advancing the
contracted operational accounting approach at $4,000 per month, completing the

competitive auditor-selection process, and continuing corrective measures around
segregation of duties, invoice review, training, and financial controls.
• Developed the public-records workload/legislative issue brief documenting the
increasing administrative burden on small municipalities, including the growth in Clerk
and Police records requests, anonymous requests, automated/non-human requests, and
third-party use of body-camera footage. The material was prepared as a tool for the
Town's legislative advocacy.
• Began connecting fiscal discipline to resident service satisfaction. Rather than measuring
success solely by whether expenditures decline, the developing management model pairs
financial performance with whether residents believe the Town is maintaining the level
and quality of service they expect.
