Commissioner Schroeder thanked everyone who came out to the groundbreaking for Drill Tech Drilling and
Shoring's new Regional Office in Elbert County.

Commissioner Schroeder presented a plaque to the Elbert County Public Trustee/Treasurer, Sherry Hewlett,
congratulating her on 30 years working with Elbert County and recognizing all her hard work and dedication.

A Presentation regarding Traffic Assessment Cameras - Andrew Nichols, National Data & Surveying
Services
Public Works director Monty Hankins clarified that cameras, located in the northwest corner of Elbert County,
are for traffic assessment cameras. Any new P.U.D. being built is required to provide traffic studies.

Chris McGranihan, a civil engineer with LSE Transportation Consultants, introduced Andrew Nichols of
National Data & Surveying Services, who gave a presentation as to what the traffic assessment cameras
collect and how they work. Mr. Nichols emphasized that these are not flock cameras and do not pick up any
facial recognition. They are strictly for traffic assessments as developments are being built. Signs will be
posted to inform the public of the use of traffic study cameras.
The Commissioners and Mr. Nichols discussed data collected and how the information is used.
H. LIQUOR LICENSING BOARD

Commissioner Buck called for a brief recess at 5:10 PM.
Chris Stacy with BayWa Resources replied to the public comment concerns and questions.
The Commissioners and representatives from BayWa discussed the project and concerns.
Commissioner McDaniel presented his concerns, including water, wildlife impact and light pollution with the
applicant. The applicant addressed each concern.
The applicant responded to Commissioner Schroeder’s inquiries concerning heat domes and agriculture use
on the site. The applicant responded that the goal is to have sheep grazing under the solar panels.
Commissioner Buck presented his concerns about traffic studies, emergency response plans and timelines for
construction. The applicant addressed these concerns. The applicant must receive approval for the SUR and
1041 prior to construction and traffic studies will be conducted upon approval. Commissioner Buck
requested additional information on water usage, road use, decommissioning, housing for workers and
property values for surrounding properties. The applicant addressed the concerns.
Commissioner Schroeder outlined the conditions of approval and asked if the applicant was agreeable to the
conditions. The applicant responded that they agreed to the conditions.
Commissioner Buck requested that the applicant increase the setbacks for the project. The applicant agreed
to add larger setbacks as an additional condition to the SUR.
Commissioner McDaniel asked CDS Director Jen Jones if all criteria had been met for the 1041 application.
Ms. Jones confirmed that everything was in order.
Commissioner Schroeder found that everything was in order and all criteria had been met with the
application for the Shepherd Solar SUR.

discussed.

Whereas, this year’s National 4-H Week theme, “Beyond Ready,” reminds us that
4-H is building a ready generation in a world of change and equips young people
with skills for the future while meeting them where they are today;
Whereas, 4-H is America’s largest youth development organization, supporting six
million youth across the country; and
Whereas, 4-H programs are delivered by the Cooperative Extension System – a
community of more than 100 public land-grant colleges and universities across
the Nation – that provides experiences for young people to learn by doing;
Whereas, 4-H is in every city and county in the United States and helps 6 million
youth become engaged, successful and independent; and
Whereas, 4-H connects young people and adults to their communities, preparing
them for work and life through experiential and inquiry-based learning while
providing emerging research for positive youth development; and
Whereas, expanding from its strong agricultural roots, 4-H helps young people
explore the world around them and grow into productive adults; and
Whereas, supporting future leaders in science, agriculture and community
leadership is an important imperative for U.S. Department of Agriculture National
Institute of Food and Agriculture 4-H program; and
NOW, THEREFORE, be it proclaimed by the Board of Elbert County
Commissioners that we: do hereby officially recognize and designate October 4,
through October 10, 2026 as NATIONAL 4-H WEEK and encourage our citizens to

SHEPHERD SOLAR (SUR-2026-0002)
WHEREAS, Elbert County, Colorado (the “County”) is a duly and regularly created, organized
and existing political subdivision and public body corporate and politic, existing as such under
and by virtue of the Constitution and laws of the State of Colorado; and
WHEREAS, the members of the Board of County Commissioners of the County have been duly
elected and qualified; and
WHEREAS, the applicants requested an SUR permit to construct and operate a solar energy
facility across approximately 1,990 acres with a battery energy storage system (BESS) and
operations & maintenance building (O&M), in southeastern Elbert County; and
WHEREAS, at a duly noticed public hearing on September 1, 2026, the Planning Commission
held a public hearing on the proposed Shepherd Solar SUR. At the hearing there were
presentations by Staff and the applicant, public comment was solicited, and the Planning
Commission voted for and forwarded a recommendation of denial to the Board of County
Commissioners for consideration; and
WHEREAS, the Board of County Commissioners, having found that the original hearing was
properly noticed, and having reviewed the recommendation of the Planning Commission and
having reviewed the documentation of the applicant, and having listened to all public comment,
moved to deny the SUR permit for failing to meet one or more of the approval criteria; and
WHEREAS, after a motion and a second, the Board voted 2 in favor and 1 opposed to deny the
SUR permit and then directed the County Attorney to prepare a written resolution of denial to be

presented to the Board at their next regularly scheduled business meeting for final determination;
and
WHEREAS, this resolution was prepared and presented to the Board as the proposed form of
denial of the SUR permit as further set forth herein.
NOW THEREFORE, BE IT RESOLVED, the proposed Shepherd Solar Special Use by
Review fails to satisfy the Board that it meets all review criteria found in the Elbert County
Zoning Regulations Article III.E.5, thus the Board of County Commissioners of the County of
Elbert, State of Colorado does hereby deny the Shepherd Solar Special Use by Review (SUR),
Case No. SUR-2026-0002 based upon the following findings:
1. Subsection A, the proposed use is not in harmony and compatible with the surrounding
area and neighborhood; and
2. Subsection C, the use will likely unduly increase traffic congestion or burden the
existing road system; and
3. Subsection F, the proposed use will not be adequately landscaped, buffered, and
screened.

2. Paragraph 1, Criteria (c), the proposed project has not satisfactorily satisfied the Board that it
is not subject to significant risk from natural hazards; and
3. Paragraph 1, Criteria (g), the Board is not satisfied that the proposed activity will not
significantly degrade the environment, specifically, Appendix “A,” 1(c)4 “changes in short or
long term housing availability, location, cost or condition;” and
4. Paragraph 2, Criteria (f), the Board is not persuaded that the benefits accruing to the County
and its residents from the proposed activity do not outweigh the losses of any resources
within the County or the losses of opportunities to develop such resources.

Solar & Battery Energy Storage Systems Regulations
CDS and Legal staff have had several work sessions with the Board of County Commissioners (BOCC)
regarding potential solar and battery energy storage systems (BESS) regulations. Following work session
discussions, staff prepared draft regulations for consideration by the Planning Commission (PC). The draft
regulations were heard by the PC on August 18, 2026. The draft regulations presented to the PC are
included as Attachment A. The PC recommended 7-0 to forward the draft regulations to the BOCC for
approval with several revisions. Staff has incorporated the recommended revisions from the PC into the
draft regulations, which is included as Attachment B.
Kara Gerczynski, a local fire protection expert, has provided comments on the draft regulations. These
comments are included as Attachment C-1. Staff has incorporated revisions to address the comments in
Attachment C.
These regulation updates were noticed in the Elbert County News on September 10, 2026, as required per
ECZR Art. II E. The affidavit of publication is included as Attachment D.

(b) Battery Energy Storage System units shall be located internal to the site and should not
be located at the perimeter of the site.
(c) Battery Energy Storage System units shall be spaced a minimum of ten-feet apart or as
otherwise required per manufacturer specifications and approved by the local fire
district.
(d) A defensible space buffer of least 50-ft in width shall be maintained around the outer
boundary of the site to main a safety zone. The buffer may be located within the
required setback.
(e) In the event an applicant believes there is a safer manner to consturct facilities in
accordance with specific technology and manufacturer performance standards, the
Board may consider alternatives not withstanding any setbacks or spacing
requirements herein.

Draft Definitions:
Battery Energy Storage Systems (BESS): A rechargable energy storage system consisting of
batteries, battery chargers, controls, power conditioning systems and assocaited electrical
equipment designed to provide electrical power to a building or to provide electrical gridrelated servcies. Battery energy storage systems designed and operated for a single residential
household shall not be included in the definition.
Defensible Space Buffer: A managed zone of cleared or thinned vegetation and combustible
materials established around a site or structure.
Solar Farm: An electricity generating facility consisting of one or more solar panels under
common ownership or operating control, and includes substations, cables/wire and other
buldings accessory to the facility, whose main purpose is to supply electricity to the utility grid
and/or off-site customers.

Hi Jennifer,
Thanks for sending this over. I do have some concerns with the draft resolution, which I have
outlined below. I would be happy to discuss these further with you.
· Technology-Specific Requirements
The current separation requirements appear to be primarily based on the hazards associated with
lithium-ion battery energy storage systems (BESS). However, other energy storage technologies may
be deployed within the county that pose significantly di erent fire and thermal-runaway risks. NFPA
855 recognizes that hazard characteristics can vary by technology; therefore, it may be appropriate
to tailor separation requirements to the specific energy storage technology and its demonstrated
performance, rather than applying a single standard to all systems.
· Internal vs. External Site Exposures
The code should distinguish between structures and infrastructure that are internal to the energy
storage facility and those that are external exposures. Certain buildings, access roads, and
operational facilities located within the site are necessary for maintenance, monitoring, security,
and overall facility operations. Applying the same setback requirements to both internal and
external site features may create unintended operational challenges without providing a
corresponding increase in life safety or property protection.
· Separation Distances Between BESS Enclosures
Separation distances between BESS units should be based on manufacturer-specific testing and
system design. NFPA 855 relies on large-scale fire testing, typically conducted in accordance with
UL 9540A, to evaluate thermal runaway propagation, fire spread, and the adequacy of separation
distances between energy storage units. As a result, the required spacing can vary considerably by
manufacturer and technology. I recommend revising this requirement to either establish a
minimum separation distance of 10 feet or that the required spacing shall be determined by
approved large-scale fire testing and the manufacturer's installation requirements in accordance
with locally recognized standards.
