RECOMMENDATION:
That the Planning Commission adopt Planning Commission Resolution approving Conditional Use Permit
26-0448 with Conditions of Approval found in the Resolution, along with the corresponding Notice of
Exemption.
BACKGROUND:
The applicant requests approval of Conditional Use Permit No. 26-0448 to establish Flames Restaurant
Bar and Grill within a vacant commercial space formerly occupied by a hardware store at 404/408 West
Robertson Boulevard. The project site is located at the intersection of West Robertson Boulevard and
North Fourth Street and comprises Assessor’s Parcel Numbers 001-126-005 and 001-126-006. The
proposed restaurant would occupy approximately 6,875 square feet of existing interior space and provide
dining and bar service with alcohol sales under an ABC Type 47 license.
The proposed tenant improvements include a full commercial kitchen with a Type I exhaust hood, an
indoor dining and lounge area, a bar with countertop seating, new men’s, and women’s restrooms, and
associated electrical and plumbing improvements. A dedicated arcade and billiards area would
accommodate video arcade machines, pool tables, and air hockey tables. The project also proposes
converting an existing 1,280-square-foot covered patio into outdoor dining space. The existing 4,161square-foot metal storage area shown on the plans would remain.
The site is designated and zoned Downtown Mixed Use (MX-D). The proposed restaurant with alcohol
sales and bar service is subject to approval of a Conditional Use Permit.
Proposed operational conditions require compliance with ABC licensing requirements and the posting of
consistent restaurant and bar hours. Staff is also recommending a condition that a security guard be
present for events involving live amplified music entertainment.
The existing parking area would continue to serve the property. The Zoning Ordinance does not require
additional on-site parking in the downtown area when an existing building is reused. Proposed Conditions
of Approval recommend Americans with Disabilities (ADA) upgrades to provide accessible parking and
pedestrian access. This includes refreshed parking lot striping, ADA upgrades to the existing entrance,
installation of an ADA accessible corner curb return ramp at the street intersection, and removal or
modification of obstructions within the pedestrian path of travel. Additional conditions recommend
conversion of the driveway adjacent to the covered dining area to a sidewalk with curb and gutter, which
will increase the number of on-site parking spaces. Also, to convert the site to a restaurant use, there are
conditions to require trash enclosure improvements, installation of a grease interceptor and backflow
prevention assemblies, and utility meter upgrades where necessary. The specific wording of these
recommended conditions can be found in the draft approval resolution.
Requested Entitlements
The Applicants have submitted the following applications for processing:
• Conditional Use Permit;
ENVIRONMENTAL REVIEW

applications for consistency with the approved project and verify compliance with applicable conditions

PROJECT DESCRIPTION AND LOCATION
The proposed project, Conditional Use Permit No. 26-0448 (Flames Restaurant Bar and Grill), is located
at 404 and 408 Robertson Boulevard, Chowchilla, CA 93610, an approximately 20,900 square-foot parcel
Assessor’s Parcel Number [APN] 001-126-005 and 001-126-006 at the northwest corner of Robertson
Boulevard and North 4th Street. The site is zoned Downtown Mixed Use (MX-D) an contains an existing
6,385-square-foot, two-story building, formerly used as a hardware store.
The project proposes to reuse the existing building as a family-friendly restaurant, full-service bar, and
indoor amusement arcade. The project will utilize the existing building, parking, and utilities, with all
entertainment and arcade activities contained indoors.
EXEMPTION
•
•
Class 1 Section 15301- Existing Facilities, Class 1 applies to the operation, permitting, leasing,
licensing, or minor alteration of existing public or private structures and facilities involving
negligible or no expansion of the existing facility. Section 15301 also includes interior or exterior
alterations to existing structures, including modifications to interior partitions, plumbing,
electrical systems, and similar improvements.
The proposed project consists of the reuse of an existing approximately 6,385-square-foot, twostory commercial building, formerly operated as a hardware store, for Flames Restaurant Bar and
Grill, consisting of a restaurant, full-service bar, and indoor amusement arcade. The project will
utilize the existing commercial building and developed site, including existing parking and utility
services. No new principal building or substantial expansion of the existing building is proposed
as part of Conditional Use Permit No. 26-0448.
REASONS WHY PROJECT IS EXEMPT
Class 1, Section 15301:
The project qualifies for a Class 1 Categorical Exemption under CEQA Guidelines Section 15301 because
the project involves the permitting and reuse of an existing commercial structure within an established
developed area.
The proposed restaurant, bar, and indoor amusement arcade will operate within the existing building.
Improvements necessary to accommodate the proposed use are primarily associated with the
conversion and operation of the existing commercial space and may include interior modifications and
upgrades necessary to comply with applicable building, fire, accessibility, health, and safety
requirements.
The project does not involve construction of a new principal structure or a substantial expansion of the
existing building. The existing parking area and utility services will continue to serve the property.
Entertainment, arcade activities, and amplified sound will be contained within the building, with no
outdoor speakers or live amplification proposed.
Accordingly, the project represents the permitting and reuse of an existing commercial facility involving
negligible or no expansion of the existing facility and is consistent with the types of activities
