Acting Director of Community and Economic Development Scudero presented the staff report
dated June 17, 2026, recommending the Planning Commission adopt the resolution approving
a two-year extension of the Final Development Plan, Use Permit and Design Review approvals
for the Acorn Business Park project.
Vincent Moita, Acorn III Self Storage LLC, gave a background of their company and a
PowerPoint presentation detailing the building permit timeline, permitting process with PG&E,
risk mitigation strategies, PG&E joint trench utility plan approval, easement location and
restrictions, PG&E easement solution, and architectural plans. He mentioned the goal was to
finalize and submit plans to commence construction, with prospects for additional projects for
approval in the future.
In response to Commissioner Riley, Mr. Moita stated that, in addition to the self-storage facility,
the team was actively marketing light industrial, hotel, and senior care facilities. He noted that
retail space had generated limited interest.
Commissioner Jones thanked the applicant for explaining the extension request and
emphasized that her request for additional information was to help the Commission understand
the delays. She requested that future extension requests include an explanation to facilitate
tracking of those issues. She expressed support for the project and looked forward to its
progress.
Commissioner Spijker stated he supported the extension.
Commissioner Perez also appreciated the explanation and spoke in support of the extension.
Chairperson Suman opened and closed the public comment period with no members of the
public requesting to speak.
On motion by Commissioner Riley, seconded by Commissioner Spijker, the Planning
Commission members present unanimously adopted the resolution approving a two-year
extension of the Final Development Plan, Use Permit and Design Review approvals for

General Plan Update – Staff will provide an update on the General Plan Update
process.

Acting Director of Community and Economic Development Scudero gave the Antioch General
Plan update. He announced workshops would be held on June 30, 2026, and July 7, 2026. The

Planning Commission was encouraged to engage residents to promote these events. He also
announced the next GPAC meeting would be held on the first Tuesday in August.
Planning Manager Merideth announced workshop flyers in Spanish and English were available
in the City Hall lobby.
In response to Commissioner Riley, Acting Director of Community and Economic Development
Scudero and Planning Manager Merideth explained the format for the community workshops.
Acting Director of Community and Economic Development Scudero also noted that two
additional community workshops would be held to gather feedback once the draft General Plan
was prepared.
Chairperson Suman opened and closed the public comment period with no members of the
public requesting to speak.
A speaker from the audience stated he wished to make general public comments.
Acting Director of Community and Economic Development Scudero informed the speaker that
comments could be made on agenda items; however, general public comments on unagendized
topics were accepted at the beginning of the meeting, and that time had already passed.
Commissioner Spijker added that if the speaker had an issue to bring to the Planning
Commission’s attention, he welcomed the speaker to attend the next meeting and provide his
comments. He announced Planning Commission meetings were typically the first and third
Wednesdays of the month dependent on the items before the Commission.

ORAL/WRITTEN COMMUNICATIONS

Acting Director of Community and Economic Development Scudero announced there were
several vacancies on the Sales Tax Citizens’ Oversight Committee and this was the only
committee that allowed for members sitting on other Boards and Commissions to participate.
Commissioner Jones added that she also served on the Sales Tax Citizens’ Oversight
Committee, provided an overview of its goals and objectives, and described it as a rewarding
experience. She encouraged fellow Commissioners to consider applying for the vacancies.

Commissioner Perez reported on her attendance at a previous TRANSPLAN committee meeting

REQUEST
The applicant, Gurmej Singh, requests approval of a Use Permit to operate a convenience
and liquor store in an existing commercial unit at the Deer Valley Square shopping center
at 3440 Deer Valley Road (APN: 052-460-028). The proposed store will sell alcohol, along
with other beverages, snacks, groceries, household items, and convenience goods. The
store will operate seven days a week from 7:00am to 11:00pm and will employ
approximately four people.
STAFF RECOMMENDATION
Staff recommend that the Planning Commission adopt a resolution approving the Use
Permit subject to Conditions of Approval.
ENVIRONMENTAL REVIEW
This project is Categorically Exempt from the provisions of the California Environmental
Quality Act (CEQA), pursuant to Section 15301 – Existing Facilities. This section of CEQA
exempts projects that:
• Consist of the operation of existing public or private structures.
• Involve negligible or no expansion of an existing use beyond that existing at the
time of the lead agency determination.
The subject site is an approximately 2,138 square foot unit in an existing, fully developed
retail commercial center. It involves negligible or no expansion of its existing use as a
retail commercial unit.

BACKGROUND
The proposed convenience and liquor store is located at 3440 Deer Valley Road (APN:
052-460-028). The site is a vacant commercial unit within the Deer Valley Square
shopping center. The subject parcel is 2.33 acres in size. Surrounding land uses include:



North: Former Pharmacy Building, PD – Planned Development District
South: Vacant Lot, PD – Planned Development District
East: Drive-Through Restaurant, PD – Planned Development District
West: Senior Residences, PD – Planned Development District

The site is zoned PD – Planned Development District and its General Plan designation is
Mixed Use. The Deer Valley Square Final Development Plan approval indicates that the
intended uses are commercial retail, to be clarified through approval of a Use Permit. A
Use Permit was approved by the Planning Commission in August 1998 for a pharmacy,
restaurant site and retail uses. The Use Permit did not discuss convenience or liquor store
uses. The City’s Zoning Ordinance requires approval of a Use Permit for convenience
store and liquor store uses, where permitted. The appropriate action therefore to permit

a convenience and liquor store is to adopt a Use Permit to specifically permit this type of
business at the requested location.
Food and beverage sales establishments are permitted within the Mixed Use General
Plan designation.
ANALYSIS
Project Overview
The applicant is seeking Use Permit approval for the operation of a new convenience and
liquor store with a Type 21 Off-Sale General license from the California Department of
Alcoholic Beverage Control (ABC). ABC Defines the Type 21 license as:
“Issued to retail stores. Authorizes the sale of beer, wine and distilled spirits for
consumption off the premises where sold. Minors are allowed on the Premises.”
In addition to alcohol, the proposed store will also sell other beverages, snacks, groceries,
household items, and convenience goods. The plans also show a sandwich counter within
the store. The store will operate seven days a week from 7:00am to 11:00pm and will
employ approximately four people.
Antioch Municipal Code (AMC) section 9-5.3831 “Liquor Establishments” regulates liquor
establishments throughout the city. Section 9-5.3831(A) states:
(A) “No on-sale or off-sale liquor establishments shall be operated within a radius of
500 feet from any other on-sale or off-sale liquor establishments or any school,
public park, playground, recreational center, day care center, or other similar use.”
The proposed location is not within 500 feet of any of these uses.
Parking
The AMC establishes a retail sales requirement of 5 parking spaces per 1,000 square
feet of gross floor area. Therefore, the business would require 11 parking spaces. The
convenience and liquor store is located within an existing shopping center with
approximately 170 parking spaces. Staff does not foresee the new store causing a
parking conflict given the ample available parking at the shopping center.
Conditions of Approval
Staff has prepared Conditions of Approval to ensure code compliance and minimize
compatibility concerns with surrounding uses. For example, the business hours of
operations will be conditioned to 7:00am – 11:00pm, seven days a week with any changes
to the hours requiring Zoning Administrator approval.

Another proposed Condition of Approval is that the business will be required to install and
maintain security cameras to provide 24-hour coverage at the store. If there is a violation
of the Conditions of Approval, the Planning Commission will hold a public hearing to
consider revocation of the Conditional Use Permit or imposition of a fine.
AMC section 9-5.3843 Tobacco and Paraphernalia Retailers prohibits the establishment
of new tobacco and drug paraphernalia retailers within the City, with minor exceptions.
Since this is a new establishment, tobacco and paraphernalia sales are prohibited, and a
Condition of Approval is included that reaffirms this.
The proposal was reviewed by the Contra Costa Fire Protection District and Contra Costa
Environmental Health who provided comment letters which have been shared with the
applicant (Attachment D). There are Conditions of Approval that the applicant meet all
requirements of both agencies.
CONCLUSION
Staff recommends that the Planning Commission approve a Use Permit to operate a
convenience and liquor store in an existing commercial unit at the Deer Valley Square
shopping center at 3440 Deer Valley Road (APN: 052-460-028) subject to Conditions of
Approval.

WHEREAS, the applicant, Gurmej Singh, requests approval of a Use Permit to
operate a convenience and liquor store in an existing commercial unit at the Deer Valley
Square shopping center at 3440 Deer Valley Road (APN: 052-460-028); and
WHEREAS, the project is Categorically Exempt from the provisions of CEQA,
pursuant to section 15301 – Existing Facilities because the subject site is an existing
unit in an existing, fully developed retail commercial center and involves negligible or no
expansion of the existing use; and
WHEREAS, the Planning Commission duly gave notice of a public hearing as
required by law; and
WHEREAS, on September 2, 2026, the Planning Commission duly held a public
hearing and received and considered evidence, both oral and documentary; and
WHEREAS, the Planning Commission considered all public comments received,
the presentation by City Staff, the staff report, and all other pertinent documents
regarding the proposed request.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Antioch as follows:
1.

The foregoing recitals are true and correct and are incorporated by this
reference.

2.

Based on its review of the entire record, the Planning Commission makes
the following findings pursuant to Section 9-5.2703 “Required Findings” (B)
(1) (a-e) of the Antioch Municipal Code:
a. The granting of such Use Permit will not be detrimental to the public
health or welfare or injurious to the property or improvements in such
zone or vicinity.
The project has been designed and conditioned to comply with the
City of Antioch Municipal Code requirements. Operational conditions
such as restrictions on hours, standards for maintenance of the site,
and requirements for security cameras, will minimize impacts. Based
upon the conditions imposed, the convenience and liquor store will not
be detrimental to the public health or welfare or injurious to the

property in the vicinity.
b. The use applied at the location indicated is properly one for which a
Use Permit is authorized.
The site is located within an existing unit in an existing commercial
center. The location’s Planned Development zoning allows for retail
and commercial uses with approval of a Use Permit. The location is
not within 500 feet of any of the sensitive uses identified in Antioch
Municipal Code section 9-5.3831 “Liquor Establishments.”
c. That the site for the proposed use is adequate in size and shape to
accommodate such use, and all parking, and other features required.
The project is located in an existing retail commercial center with
ample parking to serve customers.
d. That the site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
use.
The project site is currently developed as a commercial center and is
located on Deer Valley Road, an arterial with adequate width and
pavement type to carry any traffic generated by the proposed use.
e. The granting of such Use Permit will not adversely affect the
comprehensive General Plan.
The project is consistent with the location’s Mixed Use General Plan
designation, which permits food and beverage retailers.
3.

The project is Categorically Exempt from the provisions of CEQA,
pursuant to section 15301 – Existing Facilities because the subject site is
an existing unit in an existing, fully developed retail commercial center and
involves negligible or no expansion of the existing use.

Based on its review of the entire record herein, all supporting, referenced,
and incorporated documents, and all comments received, the Planning
Commission hereby approves the requested Use Permit to operate a

A.

GENERAL CONDITIONS
1. The project shall comply with the Antioch Municipal Code. All construction shall
conform to the requirements of the California Building Code and City of Antioch
standards.
2. The applicant (including any agent thereof) shall defend, with counsel of City's
choosing and at Applicant’s own cost, expense and risk, any and all claims,
suits, actions or other proceedings of every kind that may be brought or
instituted against City or its officials, officers, employees, volunteers and agents
to attack, set aside, void, or annul the City’s approval concerning this
application. The applicant shall pay and satisfy any judgment, award or decree
that may be rendered against the City or its officials, officers, employees,
volunteers, and agents as part of any such claim, suit, action or other
proceeding concerning the City’s approval of this application. Applicants shall
also reimburse the City for the cost of any settlement paid by the City or its
officials, officers, employees, agents, or volunteers as part of any such claim,
suit, action or other proceeding concerning the City’s approval of this
application. Such reimbursement shall include payment for the City’s attorneys’
fees and costs, including expert witness fees. Applicant shall reimburse the City
and its officials, officers, employees, agents, and/or volunteers, for any and all
legal expenses and costs incurred by each of them in connection therewith or
in enforcing the indemnity herein provided. Applicant’s obligation to indemnify
shall survive the expiration of this Approval.
3. The project shall be implemented as indicated on the application form and
accompanying materials provided to the City of Antioch and in compliance with
the Antioch Municipal Code, or as amended by the Planning Commission.
4. No building permit will be issued unless the plan conforms to the project
description and materials as approved by the Planning Commission and the
standards of the City.
5. This approval expires two years from the date of approval (expires September
2, 2028), unless operations have commenced, or an extension has been
approved by the Zoning Administrator. Requests for extensions must be
received in writing with the appropriate fees prior to the expiration of this
approval. No more than two one-year extensions may be granted.
6. No permits or approvals, whether discretionary or mandatory, shall be
considered if the applicant is not current on fees, reimbursement payments, and
any other payments that are due.

7. This approval supersedes previous approvals that have been granted for this

B.

AGENCY REQUIREMENTS
1. All requirements of the Contra Costa County Fire Protection District shall be
met.
2. All requirements of the Contra Costa Environmental Health Division (CCEHD)
shall be met.

FEES
1. The applicant shall pay all fees as required by the City Council.
2. The applicant shall pay all required fees at the time of building permit issuance.

D.

PROPERTY MAINTENANCE
1. No illegal signs, pennants, banners, balloons, flags, or streamers shall be used
on this site at any time.
2. The site shall be kept clean of all debris (boxes, junk, garbage, etc.) at all times.
3. No signs shall be installed on this site without prior City approval.

E.

PROJECT SPECIFIC REQUIREMENTS
1. This approval applies to a Use Permit to allow for operation of a convenience
and liquor store with a Type 21 Off-Sale General California Department of
Alcoholic Beverage Control license, as shown in the plans and materials
submitted to the City of Antioch on June 25, 2026.
2. In accordance with City of Antioch Municipal Code Section 9-5.2607 “Site Plan
and Design Review Required,” design review is required for any proposed
exterior remodeling of the project location.
3. Hours of operation shall be 7:00 AM – 11:00 PM, seven (7) days a week. Any
request to modify the hours of operation shall be subject to Zoning Administrator
approval.
4. Pursuant to Section 9-5.2707.1 “Violation, Revocation, Fine” of the Antioch
Municipal Code, if there is a violation of the Conditions of Approval, the Planning
Commission shall hold a public hearing to consider revocation of the Conditional
Use Permit. If the Planning Commission determines that the operation is not in
compliance with the Conditions of Approval, there is a public nuisance or

otherwise a threat to public health, safety, or welfare, this may result in
revocation of or modification to the Use Permit or imposition of a fine.
5. In accordance with the City of Antioch Municipal Code Section 9-5.3843,
tobacco products and drug paraphernalia are prohibited from being sold.
6. Temporary signs, banners, commercial flags, and similar devices are prohibited,
except as individually approved by the Community Development Department.
7. Windows signage (including open/closed signs and business hour signs) shall
occupy less than 10% of the windows. Windows shall remain un-tinted to allow
law enforcement personnel to have a clear and unobstructed view of the interior
of the store.
8. Security surveillance cameras shall be installed and maintained in good working
order to provide coverage on a twenty-four (24) hour real-time basis of the store.
Cameras shall remain active at all times and be capable of operating under any
lighting condition. Security video must use standard industry format to support
criminal investigations and shall be maintained for a minimum of sixty (60) days.

Project Name: Deer Valley Market

Project Overview
The plan is to create a neighborhood friendly retail convenience and liquor store. The business
will provide local residents and the nearby communities with convenient access to everyday
essentials like beverages, snacks, groceries, household items, and other convenience goods. The
store will help meet the needs of the community while reducing the need for longer trips to a
grocery store for basic convenience purchases.
Hours of Operation
The convenience store will operate seven days per week during Monday – Sunday: 7:00 AM to
11:00 PM. These operating hours are intended to accommodate the schedules of local residents,
commuters, workers, and customers who may require access to convenience goods outside of
traditional business hours.
Employees
The business will need approximately four employees. Staffing levels will vary depending on
customer demand; however, the store will typically operate with one to two employees during
regular business hours. Employees will be responsible for customer service, inventory
management, sales transactions, stocking merchandise, maintaining store cleanliness, and
ensuring compliance with all applicable laws and regulations.
Parking
The proposed business will utilize the existing on-site parking that's provided within the

spaces during peak hours. Customer visits are expected to be short, consisting primarily of quick
retail purchases and convenience transactions. Due to the high turnover nature of the business,
parking demand is expected to remain low and well within the capacity of the existing parking

Food facilities include restaurants, stores, bars,
cafeterias, snack bars, kiosks at transit sites, and any business or operation that sells or gives food away to
the public (including employees or students).

Plans must be submitted to CCEH and approved prior to the issuance of building permits for such facilities.
Prior to the submission of plans, CCEH staff is available to meet with prospective developers/operators to
discuss the requirements for these facilities and the plan review process.

Dumpster areas serving retail food facilities are required to have a drain to the sanitary sewer and
provided with a hot/cold water supply.
It is recommended that developers be informed of this
requirement, since it is usually easier to plan for the installation of sewer and water in dumpster areas
during initial construction rather than install these afterwards.

·

All retail food facilities must have approved restrooms. This includes kiosks located at transit sites.
It is
recommended that developers be informed of this requirement, since it is usually easier to plan for the

Some kitchens at church sites may be exempt from requirements to have plans approved by CCEH and
may not require a health permit if it is not used for any retail use. Please note that retail use includes any

If the future use of the kitchen includes any activity considered retail in nature, a health permit will be
required prior to commencing such an activity. In this case a plan review would be required as part of the
application process.
Any required upgrades to the kitchen and associated facilities (e.g., dumpster area,
restrooms, janitorial area) would need to be completed before the issuance of a health permit.
**Please note, a temporary event, open to the general public, where food will be sold or given away
requires a temporary event food permit whether or not they are held at the church site or somewhere else.

If the project utilizes a mobile food facility (MFF), in addition to a required heath permit, MFFs are also
subject to Contra County Ordinance Section 413-3.1612.
This ordinance contains subsections that limit
the amount of time a vehicle can remain in one location and the hours of operation, and also prohibits
alcohol sales.

·

Mobile food facilities that park in one location for more than one hour must have access to approved
restroom facilities.

·

Plans must be submitted to CCEH and approved prior to the issuance of building permits for such facilities.
Prior to the submission of plans, CCEH staff is available to meet with prospective developers/operators to
discuss the requirements for these facilities and the plan review process.

These comments do not limit an applicant’s obligation to comply with all applicable laws and regulations. If the

We have reviewed the preliminary Project Referral Request for Comments to operate a convenience and
liquor store in an existing commercial unit at the Deer Valley Square shopping center, at the subject
location. The following is required for Fire District approval in accordance with the 2025 edition of the
California Fire Code (CFC), Local Ordinances, and adopted standards.
This letter is NOT an approval or denial letter from the Fire District. The purpose of this letter is to provide
preliminary comments, prior to official review by the Fire District.
1.

Tenant Improvement Permit Required. The developer shall submit building construction plans and
specifications for the subject project to the Fire District for review and approval. Plan submittal
instructions are located at the end of this letter.
After the tenant improvement plans are approved, plans and specifications for all deferred
submittals shall be submitted, including, but not limited to the following.
• Fire sprinklers
• Fire alarm
• Carbon Dioxide Systems
All projects shall be submitted to the Fire District for review and approval prior to construction of the
building or installation of the systems to ensure compliance with minimum requirements related to
fire and life safety. Plan review and inspection fees shall be submitted at the time of plan review

Fire Safety and Site Maintenance during Construction

FCL Requirements. Flammable or combustible liquid storage tanks shall not be located on the site

Portable Generators. Portable generators used at construction sites shall comply with Section 1204.
(3309) CFC

Abatement Maintenance. The owner shall cut down and remove all weeds, grass, vines, or other
growth that is capable of being ignited and endangering property. (304.1.2) CFC

5.

Portable Fire Extinguishers Required. All homes under construction shall be provided with not less
than one approved portable fire extinguisher at each stairway on all floor levels, every storage shed,
and next to any portable generator or energy system on site.

6.

Fire Access during Construction. Fire apparatus access to the site shall be maintained at all times of
grading and construction.
• Vehicles shall not block fire apparatus access.
• Trash/Rubbish shall no accumulate within the homes and shall be removed from buildings
at the end of each shift of work. (3305.2.1-3305.2.2).
• Smoking shall be prohibited except in approved areas. Signs shall be posted in accordance
with Section 310. In approved areas where smoking is permitted, approved ashtrays shall
be provided in accordance with Section 310. (3305.1) CFC
• Failure to comply with Chapter 33 of the California Fire Code will result in violations and
possible fees.
Our preliminary review comments shall not be construed to encompass the complete project.
Additional plans and specifications may be required after further review.
