August 10, 2026, Quorum Court Minutes

Judge Day called the meeting to order at 5:30 PM.
Invocation was led by Pastor Mike Book from Prospect Baptist Church
Assembly and Pledge of Allegiance was led by Justice Rick Myers
11 Justice of the Peace were present. Justice Linda Allison and Justice Josh Longmire were absent.
First order of business was the approval of Quorum Court minutes from July 27, 2026. A motion to
accept was made by Justice Pasmore and seconded by Justice Tennison. Judge Day took a vote to accept
the minutes, and it passed unanimously.
There was no old business.
New business.
Judge Day explained to the court that in their packet was information regarding the Craighead
Conservation Annual Report. Judge Day explained that the county gives them a small amount of money
but that they were mostly funded through the state and grants.
Announcements:
Judge Day reminded the court of the groundbreaking for InnovAsian on August 11th at 9:30 AM on Post
Road.
Judge Day announced that the Extension office has invited the court on September 14th to have a meal
with the Quorum court meeting.
Judge Day stated that audit was completed today. He reported that there was a supplemental finding
regarding public notice not having the who paid or the cost statements that are required. Judge day said
he would speak with the company Iron Planet that was responsible for the publication.
Sheriff Marty Boyd spoke to the court regarding the Sheriff’s office audit. Sheriff Boyd stated that the
Sheriff’s office had two supplementals. One was not having two factor authenticators on all the
terminals. The second supplemental was about timely settlements that are to be done by the 10th of
each month. Sheriff Boyd stated that in November and December of 2025 the settlements were not
completed by the 10th.
Circuit Clerk David Vaughn stated that his office had two supplementals. The first was a receipt issue and
the second was deposits in transit that were not broken down the way audit wanted.
Tax Collector Wes Eddington reported to the court that his office had a clean audit with no findings.
Terry McNatt Treasurer reposted that his office had a clean audit with no findings.
County Clerk Mary Dawn Marshall also reported to the court that the Clerk’s office had a clean audit
with no findings.

Public comment.
Matt Redmon, 4109 Stephanie Lane, spoke to the court regarding flock cameras.
Martin Lilly 2300 Pleasant Grove Road, attorney representing Kee Construction spoke to the court about
the ordinance Establishing Weight limits and Permitting on County Road 780. Mr. Lilly also spoke to the
court about an application for a plat for Kee Construction, he stated that they had not received
approval on the plat. Judge Day explained that they had not sent a complete application and that he had
responded by email making them aware of that.

A motion to adjourn was made by Justice Rogers and seconded by Justice Tennison. Meeting adjourned
at 5:45 PM.

Public Services Committee Minutes
Date: 8-10-2026
Attendance: Justice Richard Rogers, Justice Kevin Williams, and Justice Brad Noel
Call to Order: Justice Richard Rogers called the Public Services Committee meeting to
order at 5:46 PM.

Resolution Appointing Jessie Montgomery to the Philadelphia Fire Protection District
Board:

A motion to send to the full Quorum Court was made by Justice Kevin Willaims and
seconded by Justice Brad Noel. All in favor. Motion passed. Resolution will go before the
full Quorum Court.
Adjournment:
A motion to adjourn was made by Justice Brad Noel and seconded by Justice Kevin
Williams. All in favor. Meeting adjourned at 5:48 PM.

Transportation Committee Meeting Minutes
Date: 8/10/2026
Call to Order:
Justice Cline called the meeting to order.
Attendance:
Justice Steve Cline, Justice Terry Couch, Justice David Tennison, Justice Garrett Barnes,
Road Department Superintendent John James, and County Judge Marvin Day were present.
Road Report:
John James provided an update on road work and current projects, stating CR 862 was
back open after completion of projects.
Plat Review:
The committee reviewed two plats: K.White – CR 791 and Chevel Creek Estates – Hwy 141.
Justice Garrett Barnes made a motion to approve the K.White plat. Justice David Tennison
seconded. All in favor. Motion carried. Justice David Tennison made a motion to approve
Chevel Creek Estates. Justice Terry Couch seconded. All in favor. Motion carried.

Tabled Item – An Ordinance to Establish Weight Limits and Permitting on County Road
780:
Justice Terry Couch made a motion to untable the Ordinance to Establish Weight Limits and
Permitting on County Road 780. Justice David Tennison seconded. All in favor. Motion
carried. County Judge Marvin Day spoke to the committee regarding the ordinance. Public
comments were made by Martin Lily and Linda Vinson. Justice Terry Couch made a motion
to send the ordinance to full court. Justice David Tennison seconded. Justice Garrett Barnes
abstained. Motion carried.

With no further business, a motion was made by Justice Terry Couch to adjourn, seconded
by Justice David Tennison. All in favor. Meeting adjourned.

Finance Committee Minutes
Date: 8-10-2026
Attendance: Justice Dan Pasmore, Justice Darrel Cook, Justice Barry Forrest, Justice Rick
Myers, Tax Collector Wes Eddington, and Treasurer Terry McNatt.
Call to Order: Justice Barry Forrest called the meeting to order.
Tax Collection Report:
Tax Collection report was given by Collector Wes Eddington, noting an increase of 8.1% in
current tax collections.
Treasurer’s Report:
Treasurer Terry McNatt presented the June 2026 financial report. McNatt noting
expenditures are down 3.8 million from 2025.

Appropriation Ordinance to Add Funds to Computer Services, Dept 114, for Upgrading
Phone System:
The committee asked Austin Vance, IT Director, to come in and explain the need and plan
for a new phone system. Justice Darrel Cook made a motion to send the ordinance to the
full Quorum Court and a second from Justice Dan Passmore. All in favor. Motion carries.
Adjournment:
With no further business, Justice Darrel Cook made a motion to adjourn, and Justice Rick
Myers seconded. All in favor. Motion passed. Meeting adjourned.

ORDINANCE NO. 2026-

AN ORDINANCE TO AUTHORIZE THE COUNTY OF CRAIGHEAD, ARKANSAS, TO
ESTABLISH WEIGHT LIMITS AND PERMITTING ON COUNTY ROAD 780, SETTING FORTH
PROVISIONS, PROCEDURES, AND PENALTIES THERIN, AND FOR OTHER PURPOSES.

WHEREAS, The County of Craighead has reviewed the needs of roads and their maintenance
within Craighead County, State of Arkansas, and
WHEREAS, Craighead County and private partnerships have created a significant investment
in County Road 780 and it is incumbent upon the County to protect that investment against
waste, deterioration, and destruction, and
WHEREAS, it has been determined that the County may select and classify County Road 780
for imposing weight limits to accomplish a legitimate and reasonable classification and to
accomplish legitimate state objective due to costs of patching incurred in the repaving of
County Road 780, and
WHEREAS, the County of Craighead has determined that County Road 780, being an asphalt,
paved road is ever increasing receiving heavy loads due to an adjacent gravel pit; and
WHEREAS, carriers do have other avenues of ingress and egress for the particular gravel pit;
and
WHEREAS, this ordinance services a legitimate public interest because other gravel pits
located in Craighead County are not accessible and adjacent to paved county roads as are
County Road 780, and
WHEREAS, the County of Craighead has reviewed pertinent sections of County Road 780 and
determined that certain sections would be applicable to regulations under Arkansas Code
Annotated Section 27-66-501 governing the protection of road surfaces, and allowing for
criminal and civil penalties for violations of load limits, Ark. Op. Att. Gen. Op. No. 94-066, and
WHEREAS, the County Judge by and through his jurisdiction over county roads shall not be
limited as to the maintenance and construction of public roadways and bridges throughout the
unincorporated areas of the county pursuant to wide discretion of A.C.A. 14-14-1101, and
WHEREAS, Craighead County has determined that imposing a weight limit restriction is the
least restrictive means of providing safety and financial resources for the citizens of Craighead
County and to further its objective of not unduly burdening its taxpayers and committing
waste with regards to the taxpayer’s investment in the County Road system, and

WHEREAS, Craighead County has authority to set policy regarding County roads and to
enforce all laws associated with the unlawful operations of motor vehicles as they relate to the
Craighead County road system, which shall include but not be limited to the authority to
weigh vehicles and require removal of excess roads pursuant to Arkansas Code Annotated
Section 27-35-101, Sections 27-66-501, et. seq., Amendment 55, Section 3 of the Arkansas Const.,
and for all other lawful purposes not inconsistent with Arkansas Law, and
WHEREAS, the County Judge shall impose a restriction on any usage, without posting a bond,
of the entirety of County Road 780 for any travel with a weight limit of fifteen (15) tons, noting
most all unloaded trucks would weigh less than 15 tons, and shall post such by appropriate
signage in the designated area beginning at State Highway 351 and extending the distance of
County Road 780, ending at State Highway 141, and
WHEREAS, any usage otherwise shall have posted a bond and permit, and
WHEREAS, the local law enforcement will provide and have the capabilities and education
and training to allow for the assessment of proper weights and shall provide citations for
violations herein; and

THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF CRAIGHEAD COUNTY,
ARKANSAS, AS FOLLOWS:
SECTION 1. It is determined by the Quorum Court of Craighead County, in accordance with
Arkansas Code Annotated Section 27-35-103, the County Judge shall erect signage on County
Road 780, beginning at State Highway 351 and extending the distance of County Road 780,
ending at State Highway 141, and have signs designated NO THRU TRUCKS with a weight
limit in excess of fifteen (15) tons.
SECTION 2. Any trucks being utilized that are in excess of the weight limits set forth shall
have the ability to post a bond with the County in an amount set forth based upon the
weighted average unit price as established by the Arkansas Highway Department cost
criterial, as updated from time to time. The county shall utilize field inspection criteria
consistent Arkansas Highway Department field inspection criteria.
SECTION 3. Penalties: Any person, business, manufacturer, refiner, retailer, wholesaler, or
transporter in the private sector who is found guilty or pleads guilty or nolo contendere to or is
found guilty of violating and provision(s) of this ordinance shall be guilty of a misdemeanor
and be fined not less that $100.00 and $100.00 court costs for the first violation per day of
violation. Each subsequent conviction or please shall be increased by $100.00 for each offense.
SECTION 4. Civil Liability for Damaging Roads: Any person, business, manufacturer,
refiner, retailer, wholesaler, or transporter in the private sector driving any vehicle, object, or

contrivance upon any County road, highway, or structure therein shall be civilly liable to the
County for all damage which the highway or structure may sustain as a result of any careless,
negligent, or illegal operation, driving, or moving of that vehicle, object, or contrivance, or as a
result of operation, driving, or moving of any vehicle, object, or contrivance of excessive
weight as set forth in this Ordinance. The cost criteria shall be based upon the Arkansas
Highway Department cost criteria.
SECTION 5. All funds collected under the authority of this Ordinance whether from fines
or payment of damages, or any one source funds created hereunder, are hereby
appropriated to the Craighead County Road Funds for use in repairing and maintaining
County roads and bridges.
SECTION 6. Severability: If any provisions of this ordinance are held invalid, such invalidity
shall not affect the remaining provisions of the ordinance which remains effective, absent the
invalid provision, and to this end, the provisions of this ordinance are declared to be severable.

RESOLUTION NO.

A RESOLUTION RECOMMENDING THE APPOINTMENT OF JESSIE MONTGOMERY TO
THE BOARD OF DIRECTORS OF THE PHILADELPHIA FIRE PROTECTION DISTRICT.
WHEREAS ACT 742 of the General Assembly of the State of Arkansas states that the
County Judge of each county is the appropriate person to appoint and reappoint board
members to the Philadelphia Fire Protection District Board of Directors.
WHEREAS Derek Patsey, appointed March 1, 2024, has resigned from the board and the
remainder of his term needs to be filled.
WHEREAS the said County Judge does hereby make the following appointment to the
Board of Directors of the Philadelphia Fire Protection:
Mr. Jessie Montgomery shall be appointed to the Philadelphia Fire Protection Board to
serve the remainder of Derek Patsey’s term, set to expire March 1, 2029.
BE IT HEREBY RESOLVED BY THE QUORUM COURT OF CRAIGHEAD COUNTY,
ARKANSAS; that the above-described appointments will become effective upon passage
by the court and filing of this document in the County Clerk's Office.

APPROPRIATION ORDINANCE NO. ________________
BE IT ENACTED BY THE QUORUM COURT OF CRAIGHEAD COUNTY,
ARKANSAS; AN ORDINANCE TO BE ENTITLED:
An Ordinance amending the 2026 Annual Operating Budget to add funds to Fund 1000, County General Department 114
Computer Services, to upgrade Craighead County phone systems.
Section 1. The current phone system, including hardware and software, has been in use since 2019 and is need of
an upgrade. Historically the phone systems are normally reviewed and upgraded every five to six years to ensure
effective means of communication.
Section 2. That Fund 1000, County General, Department 114, Computer Services have monies added to lines items 2002
3009, and 3021 for the purchase of 310 new County phones, programming, software and other associated fees.

for upgrading the Craighead County phone system. These funds shall be established in the chart of accounts
