Second Reading

AN ORDINANCE TO AMEND TITLE 3 CHAPTER 2 OF THE PORTLAND
MUNICIPAL CODE BY REPEALING AND REPLACING SECTION 3-202(1) OF
IMPOSITION OF FINES PENALTIES AND COST
WHEREAS, the Tennessee Code Annotated § 16-18-304 allows cities to set and collect
reasonable municipal court costs; and
WHEREAS, the City of Portland has determined that it is in the best interest of the City to
increase reasonable court costs to one hundred four dollars and fifty cents ($104.50) which is an
increase of five dollars ($5.00) to compensate for the Electronic Citation Sunset Provision in
Ordinance 21-47; and
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Aldermen of the City of
Portland that:
Title 3, Chapter 2, Section 3-202(1) of the Portland Municipal Code is hereby repealed and
replaced with the following:
3-202(1) In all cases heard and determined by the city, the city judge shall impose court costs in the
amount of one hundred four dollars and fifty cents ($104.50), excluding any municipal fine, local
litigation tax, or State litigation tax. A portion of the court costs (two dollars $2.00 effective July 1, 2025)
shall be forwarded by the court clerk to the state treasurer in accordance with Tennessee Code Annotated,
§ 16-18-304(a), to be used by the administrative office of the courts for training and continuing education
courses for municipal court judges and municipal court clerks. In addition, the court shall levy a local
litigation tax in the amount of thirteen dollars seventy-five cents ($13.75) in all cases in which the state
litigation tax is levied.

BE IT FURTHER ORDAINED that this Ordinance shall become effective upon its passage,
the public welfare requiring it.

AN ORDINANCE TO ACCEPT A QUALIFIED BID AND ENTER INTO CONTRACT
FOR THE RICHLAND GYM RESTROOM RENOVATIONS PROJECT
WHEREAS, the City of Portland deems it necessary to make improvements by renovating the
Richland Gym restrooms; and
WHEREAS, the City of Portland received two (2) qualifying bids and they were opened on
September 10, 2026, are as follows:
1. DUDE Construction, LLC - $473,400.00
2. Kerry G. Campbell, Inc - $570,997.00
WHEREAS, after careful consideration the bid from DUDE Construction, LLE has been
recommended as best bid for Richland Gym Restroom Renovations project; and
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Aldermen of the City of
Portland to enter into contract with DUDE Construction, LLC in the amount of $473,400.00 as
best bid for the Richland Gym Restroom Renovation project contingent upon contract review
and approval by the City attorney; and
BE IT FURTHER ORDAINED that this Ordinance shall become effective upon its passage,
the public welfare requiring it.

Alderman Cole thanked Kirby Systems, Blackburn Construction and the others that helped with the 9-11 Memorial.

9.

Mayor’s ReportMayor Callis spoke on the following:
• Since the unveiling of the 9-11 memorial, several people have stopped to look at and sit at the memorial.
• There will be early voting in Portland for the November 3rd, 2026 election. For locations and times of voting go to
votesumnertn.org.

• The Chamber will host a local candidate forum on October 1, 2026, at 5:00 pm in the Council Chambers at Portland
City Hall.

• The grant process for the water transmission line project is completed and scheduled to be finalized by the end of
September 2026.

A. Discussion - Meta Grant

RA

Director Sherry Ferguson discussed applying for a Meta grant to fund the same project proposed in the Park grant application
that was recently unsuccessful. She advised the Meta grant does not require a funding match or specify a set grant amount;
however, the application requires the City to disclose the amount of funding it is willing to commit.
Alderman Cole questioned whether the City had the $1.5 million previously committed for the prior grant application.
Director Slusser advised that the City does not have $1.5 mission in cash on hand for this project.
Discussion was held regarding the potential grant application and the amount the City could commit. The Board requested
that additional information be brought back to the October 12, 2026, meeting to assist them in determining the amount of
funding the City may be willing to commit.

12. Finance – Alderman Vince Ellis

A. Baker Donelson WHUD Presentation

Attorney Ryan Richards of Baker Donelson reviewed information regarding the water system transfer. Mr. Richards
reviewed the steps completed to date and the goals for the schedule through the end of the year. Mr. Richards advised a draft
of the purchase agreement to WHUD legal representatives on September 1, 2026, for WHUD Board approval. Mr. Richards
advised they have not received the information back from WHUD, but hope to get the information returned so the deadlines
requested by WHUD can be met.
Mr. Richards advised that the goal is to have the first reading of the final agreement at the October 12, 2026, City Council
Meeting, with the second and final reading at the October 19, 2026, City Council Meeting.
Mayor Callis asked if any City Council members had questions. Mr. Richards advised that he would not be able to attend
the October 12, 2026, City Council Meeting but would provide slides explaining the agreement and outlining any changes
between the final agreement and the Memorandum of Understanding.

B. Rate Study Presentation

Mr. Bob Adams of the Blankinship CPA Group explained how the rates are calculated and discussed the items they will be
researching. Mr. Adams advised if the WHUD transfer moved forward, additional work will be necessary because the water
and sewer fund has not been separated, either currently or historically. He explained that removing the water portion from
the debt service will affect the rate calculations.
Discussion was held regarding pausing the sewer rate study, and whether the gas rate study could move forward.
Mayor Callis suggested considering a flat-rate fee directly related to compliance issues. Discussion was held regarding the
flat fee, pausing the sewer rate study, and continuing with gas rate study.
It was determined to proceed with the gas rate study and develop possible examples of flat-fees related to compliance issues.

C. Discussion - Bond

Director Slusser reported that the city's municipal advisor, Juliann Graham, could not be present tonight, but would be at the
October 12, 2026, meeting to answer questions.
Director Slusser, reviewed the current bonds and the changes that would need to be made with the WHUD transfer.
Should the transfer be approved, at the October 19, 2026, meeting there will be two resolutions for Board approval, to refund
the bonds.

Director Slusser explained the steps that will take place for the bonds, and transfer. There will be a lot to happen in the next
2 1/2 months.
Because we don't have all the information from the transfer, we don't have final numbers in relation to the bond.

B. Presentation

Chief Arnold presented information about the Flock ALPR system currently being used by the Police Department.
Chief Arnold explained:

• How and what information the system captures.
• Tags captured are only run through the alert system, which includes stolen vehicles, missing persons, hit-&-run
accidents, and specific BOLOs.
• If the PD gets an alert, they must look at the captured information to confirm the tag matches the alert and run the
tag through the state system.
• The main area of concern is real-time alerts at the City Parks.
• It does not use facial recognition technology.
• It cannot identify the driver, passengers or determine the vehicle owner.
• It does not track by GPS.
• It does not determine speed.
• The information captured is not sold to a third party.
• The information is held for 30 days.
• There is a policy covering access and use of information that deals with misuse.
Chief Arnold explained the system has been used to assist in finding a missing elderly person, locating 15 stolen vehicles
and assisting with pursuits from other jurisdictions. He also presented stats from 2022 to 2026, showing an increase in case
closure rates.
After discussion, the Board requested this information be added to the City website.

A RESOLUTION FOR OCTOBER 2026 TO HONOR THE PRINCIPLES AND IDEALS
THAT MAKES AMERICA THE GREATEST NATION ON EARTH AS WE CELEBRATE
THE 250TH ANNIVERSARY OF THESE UNITED STATES
WHEREAS, Forged in the hope of freedom, opportunity, justice, self-reliance, and a better
tomorrow, 56 delegates from the Thirteen Colonies pledged their lives, fortunes, and sacred honor
in declaring their support for the dream that would soon become America; and
WHEREAS, Each month of 2026, the City of Portland will recognize one of the many American
principles and ideals that continue to strengthen our Union as we honor the 250th Anniversary of
these United States of America; and
WHEREAS, For October 2026, we recognize the value of Justice for All during this year of

celebration. Justice is not only an American ideal, it is rooted in biblical teachings as Deuteronomy
16:19 warns “do not pervert justice or show partiality”. Justice for All can be de�ined as impartial
application of the law for everyone regardless of background, identity, or status. Our pledge of
allegiance to the U.S. Flag states, “with Liberty and Justice for All”; and since our Founding Fathers
truly understood the dangers of a tyrannical government, they declared “that all men are created
equal” therefore desiring Justice for All equally; and

NOW THEREFORE BE IT RESOLVED, by the Mayor and Board of Aldermen of the City of Portland
that the American ideal of Justice for All continually be a reminder in the governing, planning, and
debate that shapes our community; and

BE IT FURTHER RESOLVED, That this Resolution shall become effective upon its passage, the
public welfare requiring it.

AN ORDINANCE TO AMEND THE CITY OF PORTLAND, TENNESSEE ZONING
MAP BY REZONING 0 FOUNTAIN HEAD ROAD (MAP 039 PARCELS 111.00 ) FROM
COUNTY RESIDENTIAL TO RS-20 (LOW DENSITY SINGLE FAMILY
RESIDENTIAL)
WHEREAS, the City of Portland desires to amend the official zoning atlas of the City; and
WHEREAS, the City of Portland believes that such amendment will promote, protect, and
facilitate the public health, safety, and welfare of the community through coordinated and
practical land use and land development for the betterment of Portland's population; and
WHEREAS, the Portland Municipal Planning Commission recommended approval of the
rezoning to GCS (General Commercial Services) by a vote of 8-0 at their September 8, 2026,
meeting.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Aldermen of the City of
Portland, Tennessee, as follows:
Section 1. That the property described herein be, and the same is hereby, rezoned from County
Residential to RS-20 (Low Density Single Family Residential) Approximately 4.6 +/- acres more
or less, located at 0 Fountain Head Road as shown on the attached map.
For reference, see Record Book 5368, Pages 214-217 in the Register’s Office of Sumner
County, Tennessee, and being shown as Map 039, Parcel 111.00 for Sumner County,
Tennessee.
BE IT FURTHER ORDAINED that all Ordinances in conflict herewith are repealed to the
extent of said conflict, and that this Ordinance shall become effect upon its passage on final
reading, the public welfare requiring it.

RESOLUTION

City of Portland, Tennessee
No. 26 - 81
A RESOLUTION AUTHORIZING THE CITY OF PORTLAND TO
PARTICIPATE IN THE “DRIVER SAFETY” MATCHING GRANT PROGRAM
WHEREAS, the safety and well-being of the employees of the City of Portland is of the
greatest importance; and
WHEREAS, all efforts shall be made to provide a safe and hazard-free workplace for
the City of Portland employees; and
WHEREAS, Public Entity Partners seeks to encourage the establishment of a safe
workplace by offering a “Driver Safety” Matching Grant Program; and
WHEREAS, the City of Portland now seeks to participate in this important program;
NOW THEREFORE BE IT RESOLVED by the Mayor and Board of Aldermen of the
City of Portland the following:
SECTION 1. That the City of Portland is hereby authorized to submit application for a
“Driver Safety” Matching Grant Program through Public Entity Partners.
SECTION 2. That the City of Portland is further authorized to provide a matching sum
up to $5,000 to serve as a match for any monies provided by this grant.
BE IT FURTHER RESOLVED that this Resolution shall become effective upon its
passage, the public welfare requiring it.

AN ORDINANCE TO ENTER AN AGREEMENT WITH McGHEE ENGINEERING,
INC. TO PROVIDE ENGINEERING SERVICES FOR THE CITY OF PORTLAND
NATURAL GAS PIPELINES ALONG W MT. VERNON ROAD, MORNINGSIDE DR
AND CONNECTION BETWEEN ROBERTSON COUNTY AND TGT STATIONS (RED
RIVER CROSSING).
WHEREAS, this project is deemed necessary to provide natural gas to the Buck Perry Rd
Booster Station, replacement of natural gas main on Morningside Dr to provide ample gas to
WWTP and the connection in Robertson County to improve system functions.
WHEREAS, McGhee Engineering Inc. fee shall not exceed $187,000.00 which provides the
following services: and
Task 1 Permitting and Easement Preparation
$42,000.00
Task 2 Design and Bidding Phase Engineering Services
$116,000.00
Task 3 Construction Phase Engineering Services
$16,000.00
Total Estimated Fee
$187,000.00
NOW, THEREFORE BE IT ORDAINED by the Mayor and Board of Aldermen of the City of
Portland to approve the McGhee Engineering Inc agreement in the amount not to exceed
$187,000.00 to provide engineering services for the W Mt. Vernon, Morningside Dr and
connection between Robertson County and TGT Stations: and
BE IT FURTHER ORDAINED that this Ordinance shall become effective upon its passage,
the public welfare requiring it.
