Agenda Item Summary
For the meeting of:

October 26, 2026

Agenda item title:

Presentation by TCD Interim Director, Anthony Gurrola, regarding the City of Gering
recertification as a Nebraska Economic Development Certified Community
Pat Heath, City Administrator

Submitted by:

Explanation of the agenda item:

The City of Gering is an Economic Development Certified Community (EDCC),
a statewide designation that affirms Gering’s readiness for business growth
and investment. Communities must recertify every five years to maintain this
status, which demonstrates commitment to economic development through
infrastructure investment, strategic planning, workforce initiatives, housing, and
business retention.
Twin Cities Development (TCD) staff prepared the recertification application on
behalf of the City. Previous TCD Director, Jordan Diedrich, received a letter in
July that the City of Gering was once again recertified (letter attached). Interim
TCD Director, Anthony Gurrola, will make a presentation to the Mayor and
Council at the October 26, 2026 regular City Council meeting.

RE: Economic Development Certified Community (EDCC) Recertification Application
Dear Jordan,
Congratulations! The Nebraska Diplomats are pleased to congratulate the City of Gering on
recertification in the Nebraska Economic Development Certified Community program.
The Department will be sending out a press release to announce that Gering has been
recertified in the Economic Development Certified Community program. Please submit a few
bullet points about Gering that you would like to include in the press release, such as recent
economic development accomplishments of the city and any information the community would
like to include as quotes. You can submit the information to me via email. The Department
requests that the City does not make a public announcement on the recertification until we
have issued the press release.
The Department would also like to recognize the City’s Recertification at a Gering EDC meeting,
or another special event organized locally when you are comfortable. Please think about how
you would like to do this, and we will work with you to be flexible. It can also just be a photo op
if you prefer.
Through the recertification designation, the city can continue to use the EDCC logo on the City’s
marketing material. Please continue to be diligent in keeping the City’s website and LOIS
information up to date.
The recertification will be good for five years, or until July 2031. You will receive a courtesy
notification prior to this date. If you have questions, please feel free to contact me at
[email protected] or 308-655-0919.
Again, congratulations!
Sincerely,
Ashley Rice-Gerlach, EDCC Program Manager

Agenda Item Summary
For the meeting of:
Agenda item title:
Submitted by:

October 26, 2026
Consider approving and authorizing the Mayor to sign an Interlocal Cooperative
Agreement for Landfill Operations and Solid Waste Disposal by and between the City
of Gering and the City of Kimball, Nebraska
Annie Folck, City Engineer
As the Gering landfill nears final closure, staff is exploring other options for
waste disposal. While a new landfill is still being studied and considered, a
new site will most likely not be permitted and built before the Gering landfill
sunsets. Staff have been exploring several options for an interim landfill, and
has obtained quotes from several other area landfills. One option that is a
unique opportunity is working with the City of Kimball.
Kimball currently owns and operates its own landfill, but the operational costs
are prohibitive for the small amount of waste they take in each year. Kimball
would not be able to handle additional waste from Gering on its own; however,
once Gering’s landfill closes, the City of Gering will have staff and equipment
available that will no longer be in use. The proposed agreement would allow
for the City of Gering to provide staff and equipment to manage the Kimball
landfill in return for a heavily discounted tipping fee.

Explanation of the agenda item:

This opportunity has numerous advantages for both communities. For Kimball,
it will provide some extra revenue while reducing their operating costs. For
Gering, in addition to the heavily discounted tipping fee, it will allow the City to
keep utilizing experienced employees and equipment, so that if/when a new
landfill is sited and built, the transition back to operating a landfill will be much
easier than if the City ceases all operations for a period of time. Additionally,
as Gering is considering whether or not to build a new landfill, costs for a new
facility will be compared to costs to expand capacity at the Kimball facility. If
expanding the Kimball facility turns out to be the most economical option, then
this proposed agreement has provisions for Gering to add a future landfill cell
at the existing Kimball facility. This will ensure predictable tipping fees for
Gering for the next several years.

Staff has compared the cost of this option against tipping fees at several other
facilities, taking into account transportation costs, as those can vary greatly
depending on distance. Even after accounting for additional staff time, fuel,
equipment, and other incidentals, the Kimball option remains the most
economical.
The Public Works Committee recommended approval of the
Board/Commission/Staff recommendation:
agreement at their meeting on October 14, 2026.

INTERLOCAL COOPERATION AGREEMENT FOR LANDFILL
OPERATIONS AND SOLID WASTE DISPOSAL
This Agreement is entered into as of the date of the last signature below (the “Effective Date”) by
and between the City of Gering, Nebraska, a municipal corporation and city of the first class
(“Gering”), and the City of Kimball, Nebraska, a municipal corporation and city of the second class
(“Kimball”). Each is a “Party”; together they are the “Parties.”

RECITALS
A. Gering owns and operates a municipal solid waste landfill near its west city limits in Scotts
Bluff County (the “Gering Landfill”). Remaining capacity is limited and cannot be stated with
certainty. Gering’s prior landfill arrangement with the City of Scottsbluff ended September 30, 2026
by a termination agreement dated July 27, 2026. Gering may keep the Gering Landfill open after that
date until it is actually full.
B. Kimball owns and operates a municipal solid waste landfill under a permit issued by the
Nebraska Department of Water, Energy and Environment, or any successor (the “Department”),
pursuant to the Integrated Solid Waste Management Act and Title 132 NAC (the “Kimball Landfill”
and the “Permit”). The site includes an older cell, a current active cell (the “Current Cell”), and an
area identified for a future cell (the “Future Cell”).
C. Once the Gering Landfill can no longer take municipal solid waste, the Parties want Gering
waste delivered to the Kimball Landfill, with Gering equipment and employees used in daily
operations there, Kimball remaining owner and permittee. Gering may later site its own landfill and
needs a defined way out. Kimball needs a discounted disposal outlet if this arrangement ends.
D. Each Party has waived any conflict arising from common legal counsel. This Agreement is
made under the Interlocal Cooperation Act, Neb. Rev. Stat. §§ 13-801 to 13-827, and Neb. Rev. Stat.
§ 13-2020. It does not create a joint public agency under the Joint Public Agency Act, and it does not
create a joint entity or other separate legal entity under § 13-804(6).
NOW, THEREFORE, the Parties agree as follows:

ARTICLE I. AUTHORITY AND ADMINISTRATION
Section 1.01. Authorization.
Each Party represents that its governing body has authorized this Agreement by resolution
adopted in open session, and that Kimball has obtained any Board of Public Works approval its
procedures require.
Section 1.02. No separate entity; no joint fund.
The Parties do not create a separate legal or administrative entity, joint entity, partnership, or joint
venture. Each remains a separate municipal corporation with its own governing body, budget,
employees, and property. There shall be no joint fund, joint bank account, or commingled reserve.
Neither Party may bind the other to indebtedness. No tax is authorized under Neb. Rev. Stat. §§ 13318 to 13-326 or §§ 13-2813 to 13-2816. Each Party shall report this Agreement to the Auditor of
Public Accounts as required by §§ 13-513 and 13-804(8). Consistent with § 13-804(5), neither Party
is relieved of any duty imposed by law except to the extent of actual and timely performance by the
other under this Agreement.

Section 1.03. Administration.
Consistent with § 13-804(4)(a), this Agreement shall be administered jointly by the City
Administrator of Gering and the City Administrator of Kimball (the “Administrators”). Either may
designate a deputy in writing. The Administrators shall confer as operations require and at least
quarterly during any Operations Period. Day-to-day direction at the Kimball Landfill during an
Operations Period shall be exercised jointly by the Gering and Kimball Environmental Services
Directors or other Gering official designated in writing, subject to the Permit, to Kimball’s rights as
landowner and permittee, and to this Agreement.

ARTICLE II. PURPOSE AND DEFINED TERMS
Section 2.01. Purpose.
The purpose is cooperative use of the Kimball Landfill as a disposal outlet for Gering municipal
solid waste after the Gering Landfill is no longer available for that purpose; assignment of daily
operational responsibility to Gering and Kimball jointly during the Operations Period while Kimball
remains owner and permittee; construction of the Future Cell at Gering’s cost if the Current Cell is
filled during the Operations Period; and a defined reciprocal disposal right for Kimball if this
arrangement ends.
Section 2.02. Defined terms.
“Acceptable Waste” means solid waste the Permit allows in the cell then being filled, excluding
Unacceptable Waste. “ADC” means alternative daily cover approved under the Permit. “C&D”
means construction and demolition debris. “Gate Rate” means a Party’s publicly posted or lawfully
approved ordinary per-ton fee to unaffiliated customers for municipal solid waste. “Gering Waste”
and “Kimball Waste” mean Acceptable Waste generated in that city’s solid waste jurisdiction area,
collected in the course of its municipal collection service, and/or waste collected or received by
Gering or Kimball through waste collection operations, interlocal agreements, citizens, or private
operators, or through other waste disposal agreements or arrangements including private hauler and
private citizen deliver to the Kimball Landfill, whether such waste originates inside or outside of the
jurisdictional area of either city. “Operations Period” runs from the Operations Commencement Date
to the Operations End Date. “Special Material” means a load or waste stream that is not ordinary
municipal solid waste, that federal and Nebraska law and the Permit would allow to be disposed at
the Kimball Landfill if required conditions are met, and that because of size, composition,
contamination short of regulated hazardous waste, or handling difficulty is customarily accepted only
at a premium rate. The term includes, by way of example and not limitation, derailed or wrecked
railcars and their non-hazardous contents, wind turbine blades and similar oversized composite
components, and asbestos-containing material, but only to the extent each such item is then lawful
for disposal at the Kimball Landfill. The term does not include waste prohibited from land disposal
by Neb. Rev. Stat. § 13-2039 or Title 132, Chapter 16, regulated hazardous waste, or Unacceptable
Waste. “Successor Facility” means a disposal facility Gering owns, controls, or has a contractual right
to use after Gering stops delivering Gering Waste to Kimball. “Ton” means 2,000 pounds as measured
by the certified scale at the Gering landfill, or by another method the Administrators approve in
writing if the scale is down. “Unacceptable Waste” means hazardous waste, unauthorized liquids,
regulated medical waste, radioactive waste, and any other waste the Permit or the Department
prohibits.

ARTICLE III. TERM AND COMMENCEMENT
Section 3.01. Duration.
This Agreement is effective on the Effective Date and continues until the later of the Operations
End Date or the end of any outstanding reciprocal obligation under Article IX, unless earlier terminated
under Article XI.
Section 3.02. Operations Commencement Date.
Gering shall give Kimball written notice when Gering determines that the Gering Landfill has
reached, or within not less than ninety (90) days will reach, the point at which Gering will stop
accepting municipal solid waste there. The notice shall state a proposed Operations Commencement
Date not earlier than ninety (90) days after the notice, unless the Administrators agree to a shorter
interval. The Administrators shall confirm the date in writing. Nothing in this Agreement requires
Gering to close the Gering Landfill on any particular calendar date. Until operations begin, Gering
shall, on request and at least once each calendar quarter, give Kimball a written estimate of remaining
Gering Landfill capacity.
Section 3.03. Conditions precedent.
Deliveries shall not begin until (a) the Department has issued any Permit modification required
for Gering Waste in the volumes reasonably expected, for Gering personnel as operators, and for
Gering equipment at the site; (b) the League Association of Risk Management (“LARM”), or the
successor pool then covering the Parties, has confirmed in writing that the arrangement can be
structured within existing or added coverage; (c) Gering equipment for initial mobilization is at the
site or scheduled to arrive by the commencement date; and (d) the Administrators have confirmed
that date in writing. Kimball, as permittee, shall be the applicant for any modification. Gering shall
supply the operational information Kimball needs. Gering shall be responsible for all Department
application fees and reasonable third-party engineering and related costs incurred solely for the
modification in subsection (a), unless the Administrators agree on a different split. If the Department
denies a modification essential to performance, either Party may terminate under Section 11.03.
Section 3.04. Phases.
The Operations Period, if it begins, consists of a Current Cell Phase and, if Article VIII proceeds,
a Future Cell Phase. There is no duty to build the Future Cell unless Article VIII is satisfied.

ARTICLE IV. OWNERSHIP, PERMIT, AND CLOSURE
Section 4.01. Kimball remains owner and permittee.
The Kimball Landfill, including land, cells, liners, leachate systems, wells, scales, buildings, and
fixtures, is and remains Kimball property. Kimball remains the named permittee. Kimball shall be
responsible for the cost of maintaining the existing Landfill site and improvements. Construction of
the Future Cell at Gering’s expense conveys no real-property interest to Gering. Gering’s
consideration for that cost is disposal capacity not ownership.
Section 4.02. Permit controls.
Every duty in this Agreement is subject to the Permit and to applicable law, including Title 132.
If this Agreement conflicts with the Permit, the Permit controls, and the Parties shall amend this
Agreement as needed. Gering shall operate during the Operations Period in conformity with the
Permit and the approved operations plan.

Section 4.03. Financial assurance; closure.
Kimball is solely responsible for closure and post-closure of the older cell, the Current Cell, and
the Future Cell if built, and for the financial assurance the Department requires. The Parties understand
that Gering Waste, and a Future Cell, will increase required assurance. Gering shall not be required
to post assurance or be named co-permittee unless both Parties and the Department later agree in a
written amendment. Closure of the Gering Landfill remains solely Gering’s responsibility. Gering’s
operational role at Kimball ends on the Operations End Date and does not include performing final
closure unless the Parties sign a separate paid contract for that work.
Section 4.04. Kimball’s residual control.
If Kimball’s Administrator determines in good faith that a Gering practice places the Permit in
material jeopardy or violates the Permit or law, Kimball may give written notice describing the
practice and the required correction. Gering shall correct it promptly, and in any event within any
period the Department or the Permit requires. Gering shall bear the cost of corrective work attributable
to Gering’s operations, employees, or equipment, except to the extent the condition existed before
commencement or was caused by Kimball.

ARTICLE V. WASTE AND OPERATIONS
Section 5.01. Delivery and acceptance.
From the Operations Commencement Date through the Operations End Date, Gering shall deliver
Gering Waste it collects or controls to the Kimball Landfill, except yard waste Gering takes to a
Scottsbluff-area or other yard-waste outlet, waste Gering lawfully recycles or diverts, Gering reserves
the right to deliver solid waste to other locations if it desires to do so. Unacceptable Waste, and
temporary diversions required by force majeure, scale outage, Permit restriction, or Department order.
Gering pays its own haul cost. Kimball shall accept Gering Waste that is Acceptable Waste, subject
to the Permit and to temporary closures required for safety, weather, or compliance. Title to
Acceptable Waste passes to Kimball when the load leaves the scale and is deposited. Title to
Unacceptable Waste does not pass; the delivering Party shall remove it at its expense on notice.
Section 5.02. Daily operations.
During the Operations Period Gering shall direct and supply daily municipal-solid-waste
operations: working face, compaction, daily cover and ADC, fill-area traffic control, and ordinary
recordkeeping for those tasks, performed in a workmanlike manner consistent with the Permit, at
Gering’s expense. Kimball and Gering agree to work together in good faith with respect to daily
operations. Either party may utilize the ADC machine as may be necessary and desirable for landfill
operations. (See also section 5.05 hours).
Section 5.03. Kimball retained functions; C&D; yard waste.
Kimball shall continue, with Kimball staff and equipment, those streams Kimball elects to keep,
including C&D, trees, and tires, and any scale-house staffing Kimball elects to provide. Gering is not
required to separate C&D at the source. If Kimball wants incoming Gering loads segregated, Kimball
shall do that work unless the Administrators agree otherwise in writing. Gering may deposit C&D,
trees, and tires at the site if Kimball is then accepting those materials, at the fees in Section 7.03.
Gering shall not deliver yard waste to the Kimball Landfill except as the Administrators agree in
writing.
Section 5.04. ADC and cover.

Gering shall purchase and provide ADC for waste placed under Gering’s direction. ADC may be
used six days in any seven-day period, with earthen cover on the seventh day, or on such other schedule
as the Permit then allows. Kimball shall allow Gering to obtain earthen cover required on the nonADC day, using Kimball’s on-site borrow. Gering shall be responsible for all work and expense to
obtain the earthen cover in compliance with applicable regulations.
Section 5.05. Hours.
Unless the Administrators agree otherwise in writing, and subject to the Permit: Gering-staffed
operations run Monday through Friday at commercially reasonable hours to be determined by Gering,
excluding Gering holidays, a calendar of which Gering shall give Kimball each December. Kimball
may staff Saturdays at Kimball’s cost. Gering shall make reasonable efforts to leave the site in a
condition that complies with all permit requirements. (See also section 5.02 Daily Operations)
Section 5.06. Scale.
Gering incoming waste shall be weighed on the Gering Landfill scale. Kimball shall keep
its scale certified and in ordinary working order in the event the Gering Landfill scale is inoperable.
If needed due to scale down time, the Administrators shall agree on a temporary weight estimating
method. Each loaded Gering truck and its weight shall be documented with per load scale ticket and
provided to Kimball on a daily basis. Kimball may inspect scale records relating to Gering Waste on
reasonable notice. Gering shall provide Kimball with a monthly summary of waste Gering has
delivered to the Kimball site.
Section 5.07. Shared staff or equipment.
Either Party may request short-term use of the other Party’s landfill staff or equipment. A request
is effective only if the other Administrator or designee approves it in writing, which may be by email
and may be conditioned on reimbursement of actual cost. An employee who assists the other Party
remains an employee solely of his or her own city.
Section 5.08. Records and Department contact.
Gering shall keep ordinary operating records for the work it directs, in the form the Permit
requires, and shall give copies to Kimball in time for Department reporting. Kimball shall keep
Permit, monitoring, financial-assurance, and scale records. Kimball is the point of contact with the
Department. Gering shall have a reasonable chance to review draft submittals that concern Gering
operations or the Future Cell, except where a deadline makes that impracticable. Each Party shall
promptly notify the other of any Department inspection, notice of violation, or order relating to the
Kimball Landfill during the Operations Period.
Section 5.09. Special Material.
Nothing in this Section requires either Party to accept Special Material. Acceptance is always
subject to the Permit, to Title 132 (including Chapter 13 special-waste classification and any required
Department written approval), to Title 129 and 178 NAC 22 and 40 C.F.R. Part 61, Subpart M, as to
asbestos-containing material, and to then-applicable federal and state law. If a change in law later
prohibits land disposal of a waste stream described in this Section (including any future prohibition
on wind turbine blades or similar components), that stream shall not be accepted.
(a) Current Cell. Kimball shall have sole discretion to decide whether Special Material may be
placed in the Current Cell. Kimball shall give Gering written notice of a proposed acceptance,
including the proposed special tipping fee and any handling conditions. If Kimball elects to
accept the load, Gering shall handle it in the ordinary course of operations under this Agreement,
at the special tipping fee Kimball has set, unless Gering notifies Kimball within five (5) business
Page 5 of 15

days that acceptance would place the Permit in material jeopardy or that Gering equipment then
on site cannot safely handle the load. Special-tipping-fee revenue for Special Material placed in
the Current Cell shall be divided fifteen percent (15%) to Kimball and eighty-five percent (85%)
to Gering, unless the Administrators agree otherwise in writing for a particular load.
(b) Future Cell. Special Material may be placed in the Future Cell only if both Administrators agree
in writing to accept the load or the class of loads, and agree on the special tipping fee, before the
load is received. Either Administrator may withhold agreement. For Special Material placed in
the Future Cell, the special tipping fee revenue shall be divided fifteen percent (15%) to Kimball
and eighty-five percent (85%) to Gering. That split applies to the tipping fee only. It does not
shift Permit responsibility, closure responsibility, or ownership of the Future Cell.
(c) Conditions of handling. The generator or delivering hauler shall obtain any Department specialwaste determination or asbestos waste-shipment record the law requires, and shall deliver the
load in the condition the Permit and applicable regulations require (including wet, bagged, labeled
asbestos waste). Extra costs of cutting, staging, cover, or other handling beyond ordinary
working-face work shall be charged to the generator or hauling customer in addition to the special
tipping fee, unless the Administrators agree to treat those costs as part of the fee. Gering shall
not be required to process a load that its then-available equipment cannot handle.
(d) Accounting. Special Material tons and the special tipping fee shall be separately identified on
the weigh ticket and on the monthly invoice under Section 7.04. The 15/85 split in subsection (c)
shall be settled on the same monthly cycle as ordinary tipping fees.
Section 5.10. Roll-Off Service
During the term of this Agreement Gering may offer roll-off container service to persons located
in the corporate limits of the City of Kimball. The service is not exclusive. Nothing in this Agreement
limits Kimball, or any private hauler, from offering competing roll-off service in Kimball.
(a) “Tonnage fees” generated by Gering roll-off loads that originate within the corporate limits of
the City of Kimball and that are disposed at the Kimball Landfill shall be divided fifteen percent
(15%) to Kimball and eighty-five percent (85%) to Gering. That split applies only to the tonnage
fee. Haul charges, container rental, delivery and pickup charges, and similar service charges
remain Gering’s. Loads originating outside Kimball corporate limits are not subject to this split.
(b) Gering shall identify Kimball-origin roll-off loads on the weigh ticket and shall report those tons
and tonnage fees on the monthly invoice under Section 7.04. The 15/85 split shall be settled on
the same monthly cycle as ordinary tipping fees. Gering’s roll-off customers in Kimball remain
Gering’s customers. This Section does not make Kimball the collector, and it does not make
Gering the exclusive franchisee of Kimball.

ARTICLE VI. EQUIPMENT AND PERSONNEL
Section 6.01. Gering equipment.
On or before the Operations Commencement Date Gering shall station at the Kimball Landfill,
and shall keep there during the Operations Period, to the extent Gering then owns or controls the unit
and it is operable: a landfill compactor; a dozer; a scraper tractor and bowl; an ADC machine and
tractor; and such other units as the Administrators agree in writing. Gering may store its ADC
machine inside of Kimball’s Landfill Building. Gering may also bring its shredder if, in Gering’s
judgment, it is working and useful. The Parties know the shredder is in poor condition and that Gering
is not obliged to rebuild it or replace it. If it is brought, Kimball may use it for C&D or similar
processing on a schedule that does not unreasonably interfere with Gering operations, Kimball
supplying its own operator unless otherwise agreed. Gering may utilize Kimball water or other
utilities necessary for operation of the Landfill. Before commencement the Administrators shall
initial a short exhibit listing units actually being moved, which exhibit shall be attached hereto as
Page 6 of 15

Exhibit “B” and incorporated fully herein by reference.
Section 6.02. Cost, risk, and return of equipment.
Gering bears fuel, maintenance, repair, and ordinary operating cost of Gering equipment, and risk
of loss. Kimball shall provide a reasonably secure staging area. If a unit is down for an extended
period, Gering shall supply a substitute or other arrangement sufficient to keep the working face in
Permit compliance. Kimball retains its own equipment for C&D, trees, tires, and other Kimball
functions, and bears cost and risk of that equipment. Stationing Gering equipment does not transfer
title. Within thirty (30) days after the Operations End Date, weather and access permitting, Gering
shall remove its equipment and leave the staging area reasonably clean. Kimball shall not assert a
landlord’s lien against Gering equipment.
Section 6.03. Property under § 13-804(4)(b).
Each Party acquires, holds, and disposes of its own real and personal property. Real property and
fixtures at the Kimball Landfill are Kimball’s. Gering equipment is Gering’s. Future Cell
improvements become Kimball fixtures when incorporated into the land, even though Gering paid for
them. There is no jointly owned property.
Section 6.04. Employees.
Gering shall provide, at Gering’s cost, the employees reasonably necessary to perform Gering’s
duties. They remain Gering employees only. Gering pays their wages, overtime, benefits, payroll
taxes, retirement, and workers’ compensation, and directs their work. Kimball employees assigned to
Kimball functions remain Kimball employees only. This Agreement does not create joint
employment. Each Party shall assign only employees reasonably qualified for the work and shall
cause them to complete Permit-required training. Gering employees shall comply with lawful written
site safety rules of general application that Kimball has provided. Travel between Gering and the
Kimball Landfill is a matter between Gering and its own employees.

ARTICLE VII. FEES AND BUDGET
Section 7.01. Current Cell Rate.
During the entirety of the phase of this Agreement in which the parties utilize the existing Current
Cell Gering shall pay Kimball [eighteen and 00/100 dollars ($18.00)] per Ton of Gering Waste
disposed in the Current Cell (the “Current Cell Rate”). The Current Cell Rate is inclusive of all
Landfill Disposal Fees mandated by Neb.Rev.Stat. 13-2042. From such Current Cell Rate revenue
Kimball shall be required to remit to the State of Nebraska the required fee of $2.34 per ton, or such
other amount as may be required in the future, for all tonnage disposed pursuant to this Agreement.
The Current Cell Rate is inclusive of Gering’s contribution toward Kimball’s Current Cell Closure
and Post Closure costs.
Section 7.02. Future Cell Rate.
During the entirety of the phase of this Agreement in which the parties utilize a newly constructed
Future Cell Gering shall pay Kimball an amount per Ton of Gering Waste disposed in the Future Cell
as shown on Exhibit A, attached hereto and incorporated fully herein by reference.(the “Future Cell
Rate”). Gering shall remit their Landfill Disposal Fees mandated by Neb.Rev.Stat. 13-2042 for Future
Cell Waste to Kimball at the required fee of $2.34 per ton, or such other amount as may be required
in the future, for all tonnage disposed pursuant to this Agreement, and Kimball shall remit such fees
to the State of Nebraska as required by law.

Section 7.03. Adjustment and other materials.
Beginning on the first anniversary of the Operations Commencement Date, and each anniversary
after that, each rate then in effect shall be adjusted by the twelve-month percentage change in the
Consumer Price Index for All Urban Consumers, Midwest Region, All Items Less Food and Energy,
not seasonally adjusted (or a successor index the Administrators select if that index is discontinued).
No adjustment shall reduce a rate below the rate in effect on the Operations Commencement Date.
C&D, tires, trees, and other segregated materials Gering deposits into a Kimball-managed area shall
be charged at Kimball’s then-posted rate for that material unless the Administrators agree otherwise.
Kimball Waste placed in a cell Gering is operating is not separately tipped to Gering.
Section 7.04. Invoices.
Kimball shall invoice Gering monthly, on or before the tenth day of the following month, with
tons by date and ticket number. Gering shall pay undisputed amounts within thirty (30) days.
Disputed amounts shall be identified in writing within that period and paid after resolution. Unpaid
undisputed amounts bear interest at the rate in Neb. Rev. Stat. § 45-104.02 from the due date. Gering
shall not withhold payment as a setoff against an unrelated claim except as a court allows.
Section 7.05. Financing and budget.
Consistent with § 13-804(3)(d): Gering shall finance its obligations (employees, equipment, fuel,
maintenance, ADC, haul, Future Cell construction if undertaken, and tipping fees) from Gering
revenues as its council appropriates. Kimball shall finance its obligations (Permit fees, monitoring,
financial assurance, closure and post-closure, Kimball staff and equipment, scale maintenance, and
site costs) from Kimball revenues as its council appropriates, supplemented by tipping-fee receipts.
Each Party shall include its estimated costs in its annual budget. There is no joint budget.

ARTICLE VIII. FUTURE CELL
Section 8.01. When construction is considered.
If during the Operations Period the Administrators determine the Current Cell has less than
eighteen (18) months of remaining capacity at then-prevailing incoming rates, they shall confer on
the Future Cell. Construction proceeds only if (a) Gering gives written notice that it elects to fund
the cell, (b) Kimball’s governing body confirms that Kimball will remain permittee and will accept the
added closure and post-closure obligation, (c) the Department approves the necessary Permit
modification, and (d) any local siting approval required by Neb. Rev. Stat. § 13-2035 or related statutes
has been obtained. Either Party may decline to proceed. A decision not to proceed is not a default.
Section 8.02. Gering pays; Kimball owns.
If construction proceeds, Gering shall pay the reasonable cost of design, Department fees,
construction, construction-quality assurance, and initial certification. Kimball shall make the land
available and shall be owner and permittee. Plans shall be prepared by a Nebraska-licensed engineer
selected by the Administrators and submitted in Kimball’s name. Bidding shall comply with the
public-letting statutes applicable to the contracting Party. Unless the Administrators agree that
Kimball will let the contract and Gering will reimburse Kimball, Gering may let the contract in
Gering’s name for work on Kimball land under a license Kimball grants for that purpose. All work
shall meet the Permit and Department standards. Upon substantial completion and Department
authorization to place waste, the Future Cell is Kimball property and the Future Cell Phase begins.
Section 8.03. No reimbursement on early exit; no later partnership committed.

If Gering has funded the Future Cell and later ends the Operations Period, Gering has no claim
for reimbursement of construction cost and no lien against the Kimball Landfill, except as provided
in a written amendment executed before construction contracts are signed. Gering’s remedy is the
Future Cell Rate for so long as it keeps delivering waste to that cell, and the reciprocal right in Article
IX. The Parties currently estimate an eight- to ten-year filling life for a Future Cell of the size under
discussion. That is an estimate only and is not a capacity warranty. Any later regional partnership
requires a separate agreement approved by both governing bodies.
Section 8.04. Future grant or contribution opportunities.
In the event that future grant or contribution opportunities arise which may assist in the siting and
construction of a Future Cell, including but not limited to funds related to military and workforce
housing hub needs, the Parties agree to work together in good faith towards securing such Future Cell
funding and share equally in the benefits therefrom.

ARTICLE IX. RECIPROCAL DISPOSAL AND SHORT STAY
Section 9.01. Gering’s right to leave for a Successor Facility.
Gering may end the Operations Period to begin using a Successor Facility by giving Kimball not
less than one hundred eighty (180) days’ prior written notice stating the expected opening date and
the Operations End Date. On that date Gering’s delivery obligation ends, Gering shall remove its
equipment under Section 6.02, and Gering employees shall cease daily operations. Gering shall
cooperate in an orderly hand-back of records and site condition.
Section 9.02. Kimball’s reciprocal right.
If the Operations Period ends for any reason other than Kimball’s uncured default, or if this
Agreement is cancelled before operations begin and Gering later opens a Successor Facility, Kimball
may deliver Kimball Waste to the Successor Facility, and Gering shall accept it, for five (5) years
from the later of the Operations End Date or the date the Successor Facility first accepts waste. The
tipping fee shall be negotiated in good faith at the time but shall not exceed Gering’s then-current
Gate Rate minus twenty five percent (25%). Kimball hauls at its cost, during Gering’s posted hours,
and delivers only Acceptable Waste under that facility’s permit. Gering may require reasonable notice
of expected weekly tonnage. The right is personal to Kimball. Kimball may use a contract hauler to
transport Kimball Waste but may not convert the right into a general third-party disposal contract. If
at the time the right would arise Gering has no Successor Facility and no contractual outlet that can
lawfully take Kimball Waste, the right is suspended until Gering has such a facility or outlet, and then
runs for the five-year period.
Section 9.03. Short Operations Period.
If the Operations Period ends less than eighteen (18) months after commencement, and if Kimball
determines it does not wish to resume sole operation of the Kimball Landfill, Kimball may, by notice
given within sixty (60) days after the Operations End Date, require Gering to accept Kimball Waste
at the Gering Transfer Station Outlet, or such other location as it may then be utilizing, for twentyfour (24) months, at a rate not exceeding that outlet’s Gate Rate minus twenty five percent (25%).
Gering may instead offer to continue operating the Kimball Landfill month-to-month during that
period. Kimball is not required to accept that alternative. Nothing in this Article requires Kimball to
keep the Kimball Landfill open after the Operations End Date, or requires Gering to site a Successor
Facility.

ARTICLE X. INSURANCE AND INDEMNITY
Section 10.01. LARM.
Each Party is and shall remain a LARM member or a member of a successor municipal pool, or
an insured of a private insurance carrier. Before commencement the Parties shall present this
Agreement to LARM and shall structure additional-insured endorsements, coverage territory,
automobile coverage for travel between the two cities, and equipment coverage in the form LARM
then requires. Each Party shall maintain throughout the term such LARM coverages as are reasonably
available and customary for a Nebraska city operating or hosting a municipal landfill, including
general liability, public-officials liability, automobile liability, workers’ compensation, and coverage
on that Party’s own equipment. A claim by a Gering employee arising from work at the Kimball
Landfill is Gering’s workers’ compensation claim. A claim by a Kimball employee is Kimball’s.
Section 10.02. Indemnity.
To the extent permitted by Nebraska law, and without waiving any defense or limitation under
the Political Subdivisions Tort Claims Act, Neb. Rev. Stat. §§ 13-901 to 13-928: Gering shall
indemnify Kimball and its officers and employees from claims, damages, and Department penalties
to the extent caused by the negligent or wrongful acts of Gering or Gering’s employees or by Gering’s
breach of this Agreement. Kimball shall indemnify Gering and its officers and employees on the
same basis for Kimball’s acts, employees, and breaches. Neither Party shall indemnify the other for
the other’s own negligence. Comparative fault applies. The indemnities survive as to claims arising
from facts that occurred during the Operations Period. Nothing in this Agreement waives sovereign
immunity or any cap or notice requirement of the Tort Claims Act except to the extent that Act already
waives it for the underlying claim. No third party is a beneficiary of this Article.

ARTICLE XI. TERMINATION AND DISPOSITION OF PROPERTY
Section 11.01. Extension.
The Parties may extend this Agreement by written amendment approved by both governing bodies.
Gering may request an extension on Gering’s side. A request shall be made at least one hundred
twenty (120) days before the date Gering proposes as a new Operations End Date. Kimball shall
consider a request in good faith but is not obliged to grant it.
Section 11.02. Termination for convenience; pre-commencement termination.
After the Operations Period has run eighteen (18) months, either Party may end the operational
provisions for convenience by twelve (12) months prior written notice. Article IX then applies.
Before the Operations Commencement Date, either Party may terminate by one hundred twenty (120)
days’ written notice if its governing body determines that commencement is no longer in that city’s
interest. Article IX applies if Gering thereafter opens a Successor Facility. Costs already incurred
under Section 3.03 are not refundable except as the Administrators have agreed in writing. Upon
Termination for convenience no other costs or reimbursements shall be due by or to either Party.
Section 11.03. Regulatory impossibility and default.
Either Party may terminate by written notice if the Department finally denies a Permit
modification essential to performance, or if a change in law makes performance illegal. The Parties
shall first confer for at least thirty (30) days on a lawful alternative. If a Party materially defaults and
the default continues for thirty (30) days after written notice, or for such longer period as is reasonably
required if the default cannot be cured in thirty days and a cure has begun and is pursued diligently,
the other Party may end the operational provisions on further written notice. Article IX survives for
Page 10 of 15

the non-defaulting Party. Remedies under Nebraska law are cumulative.
Section 11.04. Methods of termination; property.
Consistent with § 13-804(3)(e), the permissible methods of partial or complete termination are:
expiration under Section 3.01; Gering’s Successor Facility notice under Section 9.01; termination
under Section 11.02 or 11.03; and mutual written agreement of both governing bodies. Partial
termination may consist of ending the Operations Period while leaving Article IX in force. On any
termination or expiration: Gering personal property is removed under Section 6.02; Kimball property,
including Future Cell improvements, remains Kimball’s; Permit-required operating records are
delivered to Kimball; and unpaid tipping fees are invoiced and paid in the ordinary course. There is
no jointly owned property to partition.
In the event that Gering terminates this Agreement after construction of the Future Cell, Kimball
has no obligation to reimburse Gering for any of Gering’s costs or investment related to the Future Cell.
In the event that Kimball terminates this Agreement after construction of the Future Cell, Kimball shall
pay a termination penalty to Gering within 90 days of termination, in the amount of the value of the
remaining life of the Future Cell, pro-rated to Gering based on the percentage of Gering tonnage and
Kimball tonnage averaged over the preceding six month period of the Agreement. The parties agree
that in the event of Kimball termination after construction of the Future Cell, an independent third party
engineer shall be utilized to calculate the remaining life of the Future Cell, the average Gering and
Kimball tonnage of the preceding six month period, and the subsequent pro-rata termination penalty
due and owing from Kimball to Gering.
Section 11.05. Force majeure.
A Party is not in default for delay or failure to perform to the extent caused by fire, flood, tornado,
extended blizzard, war, terrorism, epidemic, a Department or court order not attributable to that
Party’s breach, or another event beyond that Party’s reasonable control. The affected Party shall give
notice promptly and shall resume when reasonably able. An event that increases incoming storm
debris, and thereby shortens remaining cell life, is not force majeure excusing payment of tipping fees
for waste actually delivered.
Section 11.06. Disputes.
Before filing suit, the Administrators shall confer in good faith within fifteen (15) days after either
requests a conference. This Section does not apply to a request for temporary injunctive relief to
prevent immediate Permit jeopardy or environmental harm, and it does not toll a limitations period
under the Tort Claims Act. The parties agree that pre-suit Mediation is required for all disputes
hereunder.

ARTICLE XII. GENERAL PROVISIONS
Section 12.01. Grants.
If either Party becomes eligible for a grant or similar external funding related to sanitation, cell
construction, equipment, or closure, the Parties shall confer in good faith on whether a coordinated
application would benefit both. Neither Party is obliged to join. A grant condition that would change
operations or Future Cell work is effective only if both Administrators approve it in writing and, if
material, both governing bodies approve an amendment. Unrestricted proceeds belong to the grantee
unless otherwise agreed in writing before the application is filed.
Section 12.02. Notices.
Notices shall be in writing and delivered by hand, certified mail return receipt requested, or email
Page 11 of 15

with confirmation of receipt, and are effective on receipt or on the third business day after certified
mailing.
To Gering: City Administrator Pat Heath, 1025 P Street, P.O. Box 687, Gering, NE
69341; [email protected].
To Kimball: City Administrator Annette Brower, 223 South Chestnut Street, Kimball, NE
69145; [email protected].
A Party may change its address by notice. Courtesy copies may be sent to each city clerk and to
counsel. Failure to send a courtesy copy does not invalidate a notice properly given to the
Administrator.
Section 12.03. Miscellaneous.
This Agreement is the entire agreement on its subject and supersedes the August 2026 discussion
notes and all prior negotiations. It may be amended only by a writing approved by both governing
bodies and signed by their authorized officers. Neither Party may assign this Agreement without the
prior written consent of the other. It binds each Party’s municipal successors. Nebraska law governs.
Venue lies in the district court of Kimball County or Scotts Bluff County, at the election of the Party
commencing the action. If a provision is held invalid, the remainder continues; the invalid provision
shall be modified to the minimum extent necessary to make it valid. A waiver must be in writing and
is not a waiver of a later default. Counterparts and electronic signatures have the effect Nebraska law
allows. There are no third-party beneficiaries. Meetings of either governing body to consider this
Agreement shall comply with the Open Meetings Act. A conference of the two Administrators is not
a meeting of a public body. Headings are for convenience. “Including” means “including without
limitation.” The Agreement has been negotiated by both Parties, each with counsel, and shall not be
construed against the drafter. Each Party shall execute further documents reasonably necessary to
carry this Agreement out, including Permit filings and LARM documentation.

IN WITNESS WHEREOF, the Parties have executed this Agreement as of the dates written below.

EXHIBIT “A”
FUTURE CELL RATE (Pursuant to Section 7.02)
The Future Cell Rate which Gering shall pay Kimball per ton of Gering Waste disposed in the Future Cell
shall be: Fifty percent (50%) of the Current Cell Rate (identified in Section 7.01 of the Agreement) as of
the date the Future Cell was opened. For example, if the Current Cell Rate at the time the future cell was
opened was $18.00 per ton, the Future Cell Rate shall be $9.00 per ton. For further example, if the Current
Cell Rate was adjusted by inflation (See Section 7.03 – automatic inflation adjustments) and therefore at the
time the Future Cell opened was $18.50 per ton, the Future Cell Rate shall be $9.25 per ton.
Kimball shall be responsible for all closure and post closure costs related to the Future Cell. Kimball shall
be responsible for remitting all Landfill Disposal Fees mandated by Neb.Rev.Stat. 13-2042 to the State of
Nebraska from the funds paid by Gering to Kimball as part of the Future Cell Rate.
The parties acknowledge that the current mandated Landfill Disposal Fee is $2.34 per ton. In the event that
the State of Nebraska or Nebraska Statute increases the mandated Landfill Disposal Fee, the Future Cell
Rate identified herein shall be automatically increased by the same dollar amount as the increase in dollar
amount of mandated Landfill Disposal Fees in Neb.Rev.Stat. 13-2042.

Administrator Heath explained that the City’s existing landfill is nearing capacity (information shown above was
provided to the committee on overhead screens). He went on to say that staff have been looking at options and
other landfills to haul waste to in the interim. The question is whether Gering continues to site a new landfill or
not; that could be one of the more affordable options. He added that Kimball is a good option and then reviewed
the data on the screens (shown above). The data showed Kimball at roughly $99 per trip for fuel. Total
transportation costs per ton is about $12.31 with Kimball. Pat then discussed cost comparisons with other landfill
locations such as Sidney, Chadron, Ogallala, and more. Engineer Folck added that that amount reflects combined
transportation costs and tipping fees. Some have lower tipping fees but higher transportation costs and more
staff time. Pat explained that Kimball is the best option short-term and long-term. Staff anticipate the City will
be in the 15,000 – 20,000 ton per year range.
Engineer Folck stated that the arrangement with Kimball is different, which is why the cost on the spreadsheet
appears so much lower for them. They’re too small for Gering to just haul to and they compact and do all of that;
they wouldn’t be able to handle that. Gering has four times the amount of waste they do. The idea is that when
Gering closes “We’ll have qualified, trained staff. We’re going to have good equipment and everything we need
to manage a landfill.” She explained that the thought in this agreement is Gering taking its staff and equipment
to Kimball and Gering would essentially be operating their landfill in return for a highly discounted tipping fee.
This allows Gering to leverage its existing investments and equipment; there’s a lot of value that would be lost if
the City doesn’t continue putting it to work. “It also allows us to stay in the activity as we’re deciding whether we
want to site a new landfill or not. If we stop for a year or two, it’s really hard to start again, so it allows us to stay
in the activity.” Annie added. She further discussed the long and short-term costs. Kimball has room for Gering
for about two to three years, but after that, they would need a new cell. She stated “We’ve made it clear to them
we are still exploring siting and building our own landfill, but one of the options that needs to be compared is
maybe we build another cell at Kimball because it’s already a permitted facility, and they have control of the land.”
Depending on how this process goes of trying to site a landfill, she feels really good about this being a viable option
for Gering should the City decide it’s not able to build a new landfill. If the City were to do that, it would pay for
the new cell, and pay an amount to Kimball for a tipping fee which is basically equal to the cost of the closure/postclosure which they have to send to the state every year. She explained that Gering pays $2.34 per ton that goes
to the state. If Gering paid for the cell and operated it, the City would be basically tipping there for free. Kimball
would be able to tip there as well; that’s the appeal for them.
Councilmember Shields asked how the process would work for City staff going to Kimball to run equipment. Pat
explained that most likely, Landfill staff would fill a truck during the day and drive to Kimball that afternoon.
Kimball would place Gering’s waste in their landfill and “We’ll compact it, we’ll cover it, or put ADC on it, and then
they’ll head back.” He and Annie noted that City staff won’t be driving their personal vehicles to Kimball, it would
be a fully loaded truck, and it would only be for a portion of the day that Gering staff would be down there.
Councilmember Shields asked about the free dump pass that’s available with the monthly Gering utility bill. Pat
explained that Gering customers can still take a load to Gering’s landfill and it will be loaded on a truck and hauled

to Kimball with everything else. Even if Gering sites a new landfill, customers would still be able to take things to
the new transfer station (on U Street), and it would be hauled to the new landfill.
Councilmember Gillen asked about restrictions on what the City can haul. Environmental Services Director, Steve
Mount, explained that it depends on what Kimball has in their state permit as far as what they can take or not,
but it’s pretty much the same as Gering’s. Pat noted that their cells are lined similar to Gering’s.
Councilmember Shields asked where the Kimball Landfill is located. Councilmember Kinsey replied that it’s off of
Highway 30 past the old drive-in movie theater; just west of Kimball.
Agreement
Pat stated that staff have been working with Jim and Annette at Kimball, and City legal, Matt Turman, drafted an
agreement that covers everything they could think of. He believes it’s a good agreement that protects Kimball
and Gering. Pat explained “If it does go long-term and Gering builds a cell, and if Gering walked away, we probably
wouldn’t get any money back on the cell, but if Kimball told us 20 years down the road they wanted to separate,
they would have to pay Gering what remaining air space would be in that cell to compensate the City for what we
didn’t use in that cell.”
Councilmember Gillen asked how many (future) cells they are permitted for. Annie replied they can do one more
with their existing footprint that’s permitted “which should get us another eight to ten years.” Then there would
have to be some site investigations for soil types on their existing site; there’s also a school section adjacent to it
that would have potential for long-term. Pat noted that HDR Engineers have advised that Gering not look 200
years down the road; too much is going to change in that time. He added that “50 years is about the max you
want to look at a landfill.”
Annie noted that even though Gering will still look into the possibility of a new landfill, there are a lot of benefits
of working together for both communities. For safety, there has to be two employees operating the landfill at all
times so in case something happens, there’s another person to call 911. Working with Kimball, they’ll already
have someone in the scale house, that’s already one employee on site that Gering wouldn’t have to pay for (when
Gering staff are out there covering) because that staff would already be there.
She added that staff didn’t provide a fixed cost per ton because Gering will still have to have an employee, and
someone still has to cover no matter how much is being taken in. Staff did provide a range, however.

Total Cost/ton@10,000 ton/yr.

Annie stated that staff believe Gering will be at the 12,000 to 15,000 ton per year range. Some of it depends on
what Scottsbluff does; they may be building a transfer station.
Councilmember Gillen asked if the adjusted customer rates accommodated the costs for hauling to Kimball. Pat
replied, yes. Annie added that the City will be doing a rate study and staff will be looking at that in greater detail
as well.
Regarding the final agreement, Kimball’s Board of Public Works met last night and didn’t have any other changes.
They approved the agreement last night, contingent on Gering approving it. It will probably go to their Council
next week (depending on the outcome of the Gering Public Works Committee meeting).

Councilmember Gillen inquired if Kimball has facilities to store the City’s equipment as they get a lot more storms.
Director of Environmental Services, Steve Mount, replied that the only equipment they’d be concerned about
storing is the ADC machine during cold weather. Other than that, everything at the landfill that they have right
now sits outside, such as the compactor. Councilmember Kinsey noted that heavy equipment is made of iron; hail
isn’t likely to damage it. Michael noted that hail can break windows, and rain can go into the cab.
Michael then asked about the renewal period. Engineer Folck replied that if Gering starts hauling to Kimball,
Gering would be locked in for 18 months. After that, either community can end it, but they have to give 12
months.
Jim Cederburg, Chairman for the Public Works Committee for Kimball, addressed the committee and expressed
his respect for Gering City staff and legal counsel as they’ve worked through this process. He stated that one of
the reasons Kimball is interested in this partnership is that they struggle to have enough tonnage to cover fixed
costs. He noted that tipping fees wouldn’t be used to reduce rates, but would be tucked away for the future.
He added that both Gering and Kimball looked out for each other’s best interests as they worked through
the agreement. Both were determined to make this a win-win for each community. He strongly encouraged
the committee to give a favorable recommendation to Council to approve the agreement.
Pat agreed with Mr. Cederburg and added that this is about as safe as Gering can get (to control costs) without
going to its own landfill. Other facilities can change their costs at any time. This is a safe way for the City of
Gering to go. He added that Gering will likely continue with a site survey with HDR Engineers, but will also have
them analyze these numbers to help Council and staff consider the best option. Councilmember Kinsey
commented that ultimately, the site location will play a big factor in future planning.
Councilmember Shields asked if this would be a daily procedure of having staff go to Kimball. Steve replied, yes.
Discussion followed on if there might be more than one load per day. Pat noted that with shingles coming in
like they are, it could be two trucks per day. He added that “We’ll know more when we get the transfer station
done. We’re going to test it.” Steve stated that weather will also be a factor. Discussion followed regarding
how many days of waste can be stored in the event of inclement weather and the highway potentially being
closed. Staff mentioned that material can actually be stored outside in covered roll-off boxes which helps
prevent the hazard of spontaneous combustion.
Pat stated there is something in the agreement that if Gering does build a new landfill, Kimball would be able
to use that landfill at a reduced rate.
Motion by Councilmember Kinsey to pass along the interlocal agreement as presented to the Public
Works Committee to the full Council. Second by Councilmember Shields. There was no discussion. The
vote was called. “AYES”: Gillen, O’Neal, Kinsey, Shields. “NAYS”: None. Abstaining: None. Absent:

Agenda item title:

Discuss participation in and expenditure of Economic Development Funds for a
Regional Housing Study

Submitted by:

Pat Heath, City Administrator

Explanation of the agenda item:

Panhandle
Area
Development
District
(PADD)
and
Western
Nebraska Economic Development (WNED) are preparing for a
regional housing study for the eleven counties in the Nebraska
Panhandle. The purpose of the study is to provide PADD, WNED, their
member communities, and regional partners with current, reliable,
and actionable information regarding housing conditions, needs,
barriers, and opportunities throughout the panhandle. To qualify for
most federal and state housing funding, applicants must provide a
current housing study. The current housing study expires in 2027.

The cost of the study is $106,795. PADD has applied for and received
$77,970.04 in grant funds. The remaining balance of $28,824.96 will be
paid by first class cities – amounts will be prorated based on population.
The amount Gering pays may be reduced if the smaller communities
contribute and if PADD can secure additional funds.
Staff recommends that Council approve the expenditure
of $5,772.14 in LB840 Economic Development Funds

Consider approval of Blind Alley Transformers Bid – Electric Department

Submitted by:

Annie Folck, City Engineer
The Electric Department continues to convert additional parts of the
City to 7200 voltage. As part of this process, they are going to be
moving some electric lines from overhead to underground in the vicinity
of S and T Streets between 15th and 20th Streets. This area only has
utility easements, not dedicated alleyways, and this will be the most
economical way to upgrade the transformers and wire for the upcoming
conversion.

Explanation of the agenda item:

The City will be bidding out the installation of this project, but because
of long lead times on transformers, the transformers are being ordered
separately. This allows the transformers to be ordered prior to the
design being completed and the rest of the project being bid.

The City received three bids. The low bid was from Border States, at
$87,665.50 (including sales tax). The bid met all specifications, and the
lead time is 13 weeks, which will be in time to keep the proposed
project on schedule.
Staff recommends awarding the bid to Border States in the
Board/Commission/Staff recommendation:
amount of $87,665.50.

Agenda item title:

Consider approval of the Monument Shadows Directional Drilling Project Bid –
Electric Department
Annie Folck, City Engineer

Submitted by:

The Electric Department continues to convert additional parts of the
City to 7200 voltage. As part of this process, they are going to be
replacing aging underground lines that were buried directly in the
ground with no conduit. This should help prevent some of the outages
and other issues that have been experienced during the conversion of
other parts of the City.
Explanation of the agenda item:

This bid is for the directional drilling (boring) of electrical conduit in the
Monument Shadows neighborhood. The City is providing the conduit.
After installation, the Electric Department will pull in new wires,
ensuring these underground lines can handle the higher voltages after
the conversion.

The project was publicly advertised, and the City received two bids (see
attached bid summary). The low bid was from Beveridge, Inc., in the
amount of $66,801.
Staff recommends awarding the bid to Beveridge, Inc., in
Board/Commission/Staff recommendation:
the amount of $66,801.
