Description:
This Bill is to amend the Master Development Plan for the Olive Crossing
development.
What is a Master Development Plan (MDP)? The MDP is a procedure
outlined in Article XXII "M-U" Gateway I-170/Olive Boulevard Mixed-Use
Gateway District.
Defined under §400.2170.D, the MDP is a plan, or series of plans, depicting
the boundaries of the development, identifying existing improvements and
natural features within the development area, and illustrating the location of
anticipated structures, including buildings, parking fields, streets and major
drive aisles, land use categories, and public spaces and improvements in
geographic relation to one another.
An explanation of Article XXII "M-U" Gateway District. The intent and
purpose of the "M-U" Gateway District is to ensure the coordinated
redevelopment of the land area adjacent to the I-170/Olive Boulevard
interchange to develop a mixed-use gateway to the City of Olivette in
substantial compliance with the Olivette Comprehensive Plan, all regulations
and standards in this Article, and all other applicable or informative land use
regulations of the Olivette Municipal Code. Furthermore, the "M-U" Gateway
District is intended to provide the flexibility necessary to effect the intent and
purpose of this Article, the method by which such redevelopment shall take
place is by application for rezoning to a Planned Development District (PDD).
The objectives of the "M-U" Gateway District are to:
1. Guide development surrounding the I-170/Olive Boulevard interchange to
create a mixed-land use destination, with emphasis on promoting:
a. Medium density development consisting of two (2) or more stories,
b. Development of corporate offices, educational campuses, and medical
services, and
c. Development of housing and lodging services.
2. Limit retail land uses to prevent such uses from dominating or fully anchoring
redevelopment.
3. Maximize development by encouraging higher development density.
4. Assure that the street system is coordinated and managed with regard to the
Olive Boulevard corridor.
5. Provide redevelopment flexibility while coordinating redevelopment efforts
with surrounding properties.
6. Enable redevelopment that is consistent with the Comprehensive Plan.
7. Develope a safe and attractive pedestrian environment along the Olive
Boulevard corridor and within the district.
8. Provide minimum standards and regulations to protect and preserve the value
of properties along the Olive Boulevard corridor.

Brief timeline of Olive Crossing. In December 2015, the City Council of
Olivette published a request for proposals soliciting development proposals
from qualified real estate development organizations for an area identified as
the I-170 Interchange Gateway District. The I-170 Interchange Gateway
District consisted of nearly 14 acres of land located in the southwest corner of

the I-170/Olive Boulevard interchange. A primary goal of redevelopment for
the Project Area was to create an eastern “gateway” into the City to “lead
progress along the Olive Boulevard corridor and act as a catalyst for future
development in Olivette.” In addition, development within the Project Area
was to encourage inviting common areas and public space that establish a
focal point of activity in the City. At the same time, the development to include
amenities that serve the daily needs of Olivette residents and optimize the
fiscal and economic benefits to the City through employment opportunities and
sales tax revenue generation.
In April 2017, through Ordinance #2605, the City Council selected a proposal
submitted by Keat Olivette Gateway, LLC, and approved a Redevelopment
Plan.
What is a Redevelopment Plan. A redevelopment plan in a Missouri TIF (Tax
Increment Financing) district is a formal, legally adopted municipal strategy that
outlines how a blighted, conservation, or economic development area will be
upgraded and funded.

The Redevelopment Plan proposed "to replace the existing vacant land and
outmoded uses with a grocer anchored retail and dining development
containing approximately 85,000 square feet of space. An important role of
the development was to provide an enhanced entry image to the City of
Olivette via a signature gateway feature at the I-170 interchange, additional
streetscape amenities along Olive Boulevard, and an improved public space at
the corner of Olive Boulevard and Price Road".
In February 2019, through Ordinance #2654, the City Council approved an
amended Redevelopment Plan which revised the scope of the Original
Redevelopment Project to include added vertical density for office and other
commercial uses.
The adoption of a Master Development Plan.
In September 2019, through Ordinance #2675, the City Council approved the
first Planned Development District under the M-U Gateway District
procedures, entitled Olivette Gateway Plaza Planned Development District,
including the first Master Development Plan. The MDP included six lots,
consisting of a mixture of retail, office, and hotel.
In April 2021, through Ordinance #2720, the City Council approved an
additional amendment to the Redevelopment Plan which converted a proposed
office structure on a lot known as Lot 4 to a multifamily apartment use.
With the Council adopting Ordinance #2720, in July 2021, through Ordinance
#2725, the City Council approved the first amendment to the 2019 Master
Development Plan. Said amendment included converting an office structure
to residential apartments (The Clover) and the potential consolidation of two
lots to accommodate a grocer (Aldi).
The Second Amendment, to the Master Development Plan.
In June 2025, through Ordinance #2815, the City Council approved an
amendment to the Redevelopment Plan under Ordinance #2720. A portion
of said amendment would provide the option for the Developer to consider
replacing a proposed office structure and garage on the lot known as Lot 5
with at least one retail/restaurant building of at least 5,000 square feet.

With the option provided under Ordinance #2815, the Developer is requesting
to amend the Master Development Plan to replace the office structure and
parking garage proposed for Lot 5. Lot 5 would be subdivided, and in lieu of
the office structure and garage, the Developer proposes a restaurant or
combination of a restaurant, office, or retail.
Commission recommendation. On October 15, 2026, the City’s Planning
and Community Design Commission (“Commission”) approved a motion to
recommend approval.
A public hearing is scheduled for Tuesday, November 15, 2026.
Recommended Action:
This item is before the Council for a first reading, by title only.

CITY COUNCIL AGENDA SUBMISSION
November 10, 2026

Agenda Item: Approval to increase the Emergency Medical Services (EMS)
transport charges and establish a policy for Estate Billing
Description: The Fire Department has received notification from our billing
company, EMS/MC, that the Centers for Medicare & Medicaid Services (CMS)
has approved increases to EMS transport reimbursement rates for 2026. CMS
annually reviews and updates the Medicare ambulance fee schedule and notifies
fire and EMS agencies of applicable changes.
The average response cost per trip for services has increased from $3,786.52 in
2024 to $4,058.09 in 2025. The fire department responds to an average of 61
billable trips per month. In accordance with the 2025 cost report submitted by
GEMT. The average gross charges per trip for EMSMCs are $1,026.67, with an
average net charge of $625.44 after the mandated Medicare and Medicaid
contractual deductions from the gross charges.
Attached is a Fee Schedule outlining the proposed changes from the current
rates to the 2026 rates. After reviewing the CMS-approved adjustments and
comparing them to our current fee structure, the Fire Department recommends
adopting the proposed increases. These adjustments align with federal
reimbursement guidelines, help maintain consistency with industry standards,
and support the continued delivery of high-quality emergency medical services
while ensuring the Department recovers an appropriate portion of the costs
associated with providing EMS transport.
Establish Estate Billing Policy
The City of Olivette recommends adopting a formal estate billing policy for
ambulance services. Estate billing is the process of seeking payment for
outstanding medical or ambulance service charges from the estate of a
deceased individual. In these situations, any unpaid balance is submitted as a
claim against the deceased person's estate and is handled through the normal
probate or estate administration process.
Currently, Olivette Fire Department is the only regional ambulance provider that
does not pursue estate billing claims, with the exception of the City of Frontenac,

which does not bill the estates of its residents. Most neighboring ambulance and
fire service providers routinely submit claims to estates for unpaid ambulance
service charges as part of their standard billing practices.
To align with regional practices and ensure consistent recovery of costs
associated with ambulance service delivery, it is recommended that the
department pursue estate billing for all patients who have unpaid ambulance
balances at the time of death, regardless of residency status.
Under the proposed policy, EMSMC, the department’s billing agency, would
continue its normal collection and correspondence process when notified that a
patient is deceased. If an unpaid balance remains, EMSMC will pursue payment
through the estate administration process for a period of up to three years from
the date of service. During this period, standard billing notices, collection
correspondence, and estate claim procedures will be utilized consistently with
existing billing practices.
If payment is not received within three years of the date of service, and
documentation confirming the patient's death has been provided, the remaining
balance will be adjusted and written off. The write-off may occur sooner if it is
determined that the estate has been closed, lacks sufficient assets, or no further
collection opportunities exist. This approach ensures that reasonable efforts are
made to recover costs while also establishing a clear endpoint to collection
activity.
These procedures are recommended by EMSMC and are generally consistent
with the practices utilized by other emergency medical service providers in the
region.
Recommended Action: Motion to authorize the increase in EMS transport
fees and establish a process for Estate Billing as authorized by the Centers
for Medicare and Medicaid services for 2026.

Olivette Fire Department
Inter Office Memo From
Chief Steven J. Carman

MEMORANDUM
TO:
MAYOR, CITY COUNCIL, AND MS. YACKLEY
FROM:
CHIEF STEVE CARMAN
SUBJECT: EMS TRANSPORT AND ESTATE FEE
DATE:
NOVEMBER 10, 2026
CC:

On June 10, 2025, the City Council approved an increase in the ambulance transport fee schedule
from 150% to 175% of the Medicare allowable rate. That increase was implemented immediately
and was not phased in overtime.
Since that approval, the Centers for Medicare & Medicaid Services (CMS) has updated its
ambulance reimbursement schedule for 2026. After reviewing the Department's current fee
structure, billing trends, and reimbursement levels, staff is recommending a phased increase from
175% to 350% of the Medicare allowable rate.
Unlike the 2025 adjustment, the proposed increase represents a significantly larger change to the
fee schedule. Therefore, the fire department believes it is prudent to implement the increase in four
stages between November 2026 and August 2027. A phased implementation allows patients,
insurance carriers, and the City's billing processes to adjust gradually while also reducing the
impact of a single substantial fee increase. This approach provides a more measured transition to
the proposed reimbursement level while ensuring the Department recovers a greater portion of the
costs associated with providing emergency medical services.
The Department does not currently anticipate requesting an additional multiplier increase during
2027 beyond the phased adjustments outlined in this proposal. Future fee schedule reviews will
continue to occur whenever CMS updates its reimbursement rates, and any recommended changes
beyond those contained in this proposal will be brought before the City Council for consideration.
The intent of this proposal is to establish a fee structure that remains sustainable for the
foreseeable future while maintaining alignment with federal reimbursement methodologies and the
increasing costs of providing EMS services.

CITY COUNCIL AGENDA SUBMISSION
Date: November 10, 2026

Agenda Item:
Authorization for the City of Olivette to enter into a three-year Agreement
with Flock Safety for Automated License Plate Recognition (ALPR) Cameras
Description:
The Olivette Police Department is requesting authorization to enter into a
three-year agreement with Flock Safety for the continued operation of the
City's Automated License Plate Recognition (ALPR) camera system, including
the renewal of six existing camera leases and the addition of two new camera
locations, bringing the City's total to eight (8) cameras.
Consolidating all eight cameras under a single three-year agreement will
align their renewal dates, simplify contract administration, and provide
continuity in the City's ALPR program.
In response to recent concerns regarding the use, access, and sharing of
ALPR data, the Olivette Police Department has implemented additional
policies, procedures, and administrative safeguards to strengthen oversight
and ensure the technology is used responsibly and consistently with the
Department's public safety mission. These measures include:
Federal Agency Access Restrictions: Filtering out all federal agency requests
for access to Olivette's ALPR data.
Restricted Search Parameters: Filtering out requests and searches associated
with immigration enforcement and reproductive healthcare.
Limited Data Sharing: Restricting open sharing of ALPR data to agencies
within the Major Case Squad's geographic boundaries.
Monthly User Audits: Command staff will conduct monthly audits of all
system users to review access and ensure compliance with Department
policy.

Probationary Officer Restrictions: Officers within their first year of
employment will have limited access to the system, allowing them to receive
and review vehicle alerts and associated information but not independently
conduct searches or create hot lists. Any searches or hot list entries must be
initiated through a supervisor or Field Training Officer.
Mandatory User Training: All new and existing users will be required to
complete mandatory online training addressing appropriate system use,
access restrictions, and auditing requirements.
Public Transparency Portal: The Olivette Police Department is also
implementing a Flock Transparency Portal to provide an additional layer of
public transparency regarding the City's use of Automated License Plate
Recognition (ALPR) technology. The portal is expected to be live during the
week of November 9–13, 2026, and will be accessible through a direct link on
the City's website. The Department's ALPR Use Policy will also be made
available through the City's website alongside the Transparency Portal,
allowing members of the public to easily review the policies and procedures
governing the use of this technology.
These changes are intended to provide additional accountability, establish
clear limitations on system access and use, and reinforce the Department's
commitment to responsible deployment of ALPR technology.
Recommended Action:
Authorization for the City to enter into a three-year agreement with
Flock Safety for the renewal of six existing ALPR cameras for a total
amount not to exceed $54,000.00.
Authorization for the City to enter into a three-year agreement with
Flock Safety for the addition of two new cameras for a total amount
not to exceed $20,000.00.
