Note: As each taxing district calculates their annual tax rate, the process in place to ensure a taxing district does
not realize a windfall in tax revenue because of an increase in property value is to lower the tax rate so tax
revenues do not increase greater than the cost of living. Likewise, when there is a decrease in property values,
the tax rate is increased so the taxing district does not experience a loss in tax revenues

Planning and Zoning Case No. SUP-26-005– Special Use Permit

On October 26, 2026 the Planning and Zoning Commission held a public hearing to renew a
Special Use Permit to operate a camping facility on Lot 1A of Hunleth Addition. City staff
presented a report on the proposal and fielded questions from the Commission. The
applicant was present and able to provide additional information regarding proposed land
use and answer additional questions from the Commission. Following the applicant’s
comments, the public hearing for the application was opened and closed with no
comments from the public. The Commissioners felt that no additional discussion was
warranted. Then the Commission voted 6-0 in favor of recommending approval of the
Special Use Permit for the subject property, with certain conditions as required by Chapter
409 of the Municipal Code of Ordinances.
An ordinance has been prepared and is attached, along with supporting documents, for
your consideration. Please contact me if you have any questions, concerns, or comments
regarding the proposal.

Re:

Staff Report for Case No. SUP-26-005 – Special Use Permit for Camping Facilities

Proposal Summary:
An application by Harmony Brown to renew the Special Use Permit for a campsite

General Information:

Legal Description:
Current Zoning:
Current Land Use:

Harmony Brown
Harmony Brown
Lot 1A Hunleth Addition

Vacant/Undeveloped

Surrounding Zoning & Land Use:

R-2 – Single-Family Residential

Background:
In October of 2024, the City Council approved a Special Use Permit for the
applicant to use the subject property for a “glamping” (glamour camping) facility.
The applicant’s intention was to build a home on the property and then develop the
site for “glamping” where guests would stay overnight. For a variety of reasons, the
applicant has not begun construction on the originally proposed house or campsite.
The Special Use Permit was approved for a period of two years, after which the
applicant would need to apply for a renewal to continue the use of the property.
While the site has not been developed, the applicant still intends to use the
property in accordance with her original vision: a home on the property with an
adjacent “glamping” facility. While the development of the “glamping” site is
unlikely to occur soon, the applicant has expressed to staff an interest in

maintaining an active Special Use Permit for the site. Ensuring that the proposed
business is permitted is an important part of the funding process of the project.
The applicant has also expressed to staff the initial focus will now be to first build a
home on the subject property and then work on the development of the camping
site as a next phase.
Staff Analysis:
The conditions of the property and the basis of approval remains the same as when
the original Special Use Permit was approved. As such, staff feels there is no
justifiable reason to object to the renewal of the application. The approval of the
application permits the use of the property for “glamping” but when the property is
ready to be developed, a site plan must be reviewed and approved in accordance
with City Code prior to construction.
Staff Recommendation:
City staff recommends approval of the Special Use Permit with the following
conditions:
1. The Special Use Permit, originally approved by Ordinance # 24-10-05, shall be
renewed for a period of two (2) years. Prior to the expiration of the Special Use
Permit, the applicant may apply for an renewal of the permit.
2. The applicant must comply with all regulations outlined in the Code of
Ordinances. If the regulations and requirements are not adhered to by the
applicant, the City may revoke the Special Use Permit with approval from the
City Council.

Renewal of Municipal Judge Service Agreement

The Municipal Judge for the City of Excelsior Springs is up for contract renewal. Judge Blair has
been the City’s judge for nine years. His contract is considered for renewal every two years. The
proposed agreement would renew Judge Blair’s contract for a two-year term beginning January
1, 2027 and ending December 31, 2029. Compensation would represent a five-percent increase
from the current agreement. Funding is included in the City’s adopted budget.
Based on my observations of Judge Blair during his court sessions, he is respectful and efficient
in managing his court proceedings. His tenure with the City has been without complaints.,
An ordinance is required for the extension of Judge Blair’s contract which is available for your
consideration. The contract renewal agreement is also attached.

his duties as described herein or as otherwise directed by the CITY and will at all times maintain
the highest of professional standards in representing the interests of the CITY.

RE:

Amending City Code to Establish Random Drawing for First-Day Candidate Ballot Order

Requests have been made for consideration of changing the process in determining the
order of city council candidates’ names on the election ballot. A new policy and procedure
for all future elections is recommended. The intent of the change is to ensure that each
eligible participant has an equal chance at being the first name on the ballot, to have a
transparent and fair procedure, and an administratively efficient system.
The City Code currently contains a provision requiring the names of the candidates to
appear in the order that their statements of candidacy were filed with the City Clerk. In order
to implement the new lottery system, Section 120.040 of the Code of Ordinances needs
amended.
The proposed changes primarily effect the candidates filing order prior to 5:00 P.M. on the
first day of filing, and the order will be determined by random drawing. The lottery system
process is defined in the attached Ordinance Section 1. (2), (a), (b), and (c).
This year there are two (2) positions that will become vacant on the City Council. The first
day to file for the April 6, 2027 General Municipal Election will be Tuesday, December 15,
2026 at 8:00 a.m. Filing will close at 5:00 p.m. on Tuesday, January 5, 2027.
Respectfully submitted,
Shannon Stroud
City Clerk

Re: 2027 Regional Household Hazardous Waste (HHW) Program
Since 1997 the Regional Household Hazardous Waste Collection Program
has offered residents the opportunity to safely dispose of household
hazardous products that shouldn’t be thrown away in the trash.
Membership in the program provides residents with year-round access to
collection facilities in Kansas City and Lee’s Summit, and to multiple
collection events throughout the region.
Materials accepted for safe disposal include paint and paint-related
products, automotive fluids, batteries, lawn and garden chemicals,
housecleaners, fluorescent bulbs, and other items such as nail polish, bug
spray and oven cleaners.
The 2027 program fee will remain at $1.14 per capita and is applied to
2025 population estimates. The MARC Solid Waste Management District
supports the program with Plan Implementation funds. The district
collaborates with the cities of Kansas City, Mo and Lee’s Summit to make
this program possible.
If you are interested in providing this service to your residents in 2027, please
sign and return the agreement by Tuesday, December 15, 2026. After both
parties have signed the agreement, you will receive a copy with the invoice.
District staff are available to answer any questions and can meet with you
personally and/or attend a meeting to provide more information. Please

this definition shall be made by Kansas City.
II

for the upcoming year, the participating member is responsible for any costs incurred by Kansas City
and/or Lee’s Summit to serve residents after December 31. Kansas City and SWMD reserve the right to
invoice the member city or county for any waste disposal costs incurred as a result of late notification.

Water rate adjustment
City staff reviews the budgets for water, sewer, and trash annually to determine if the existing
fees being charged is enough to cover expense and maintain proper reserve balances in each
fund. The water rate schedule was approved at the October 12th, 2026 council meeting but the
monthly consumption for inside and outside city limits and over 30,000 gallons a month, did not
get the 3% drop for volume sales as the past schedule of fees has had.
The revised “Table A-9 Water Utility Rates”, is attached that shows the 3% drop for the greater
than 30,000-gallon sales for inside and outside city limits. This is the only modification.
The modified rates are to go into effect as of November 3rd, 2026.
An ordinance is included for your consideration and approval of this rate adjustment.
Please call me if you have and questions or concerns regarding this.
