PRESENT:
Present on Roll Call was Chairman Juran, C. McDonough and C. Scott. Also, present
was Atty. Garrett Beaulieu (1st. Ass. City Solicitor) and C. Mercier.
MEETING CALLED TO ORDER:
Chairman Juran called the meeting to order noting the attendance and topics for
discussion regarding further review and discussion of City Council Rules.
ORDER OF BUSINESS:
C. Juran began review of the new drafted rules and commented on the following:
Rule 5 – C. Juran commented on start time changes.
Rule 6 – C. Juran noted rules governing subcommittees.
Rule 12 – C. Juran commented on submitting a vote to reconsider and the timing when
Council agenda finalization is changed due to holidays. Clerk Geary noted that a 12
Noon time deadline would work for every meeting.
Rule 15 – C. Juran noted any changes regarding this consent agenda should have an
explanation and instruction sheet for the Councilors. Atty. Beaulieu noted new concepts
will have growing pains.
Rule 16 – Atty. Beaulieu noted use of resolutions by the Council. C. McDonough noted
letters sent should have resolutions attached to them as it shows more professional
approach.
Rule 17 – C. Juran commented on rules to relinquish chair during meeting and what
order to follow. Atty. Beaulieu noted some procedures used to relinquish the chair.

Rule 21 – C. Scott commented on the use of privilege during meeting and that
instructions should be provided to members. Atty. Beaulieu noted language was lifted
from Roberts Rules.
Rule 22 – C. McDonough discussed rule of inquiry and compliance with that rule. Atty.
Beaulieu noted rights of appeal regarding ruling from the Chair. C. Juran noted chair
runs the meeting and makes those determinations.
Rule 25 – C. Juran noted sufficiency of the vote when members are absent or have
resigned and if there is a difference between an elected official versus an appointed
official. Atty. Beaulieu noted that distinction is covered by Massachusetts law.
Rule 30 – C. Juran question number of voted needed to allow someone to participate in
the meeting. Atty. Beaulieu noted members can set that number.
Rule 34 – C. McDonough questioned how ordinances can be introduced. Atty. Beaulieu
noted usually generated from Manager’s office but may be other methods.
Rule 37 – C. Juran commented on the relationship with Rule 5 suspensions. C.
McDonough noted only can suspend Council rules and not statutes.
C. Juran commented on next steps. Motion by C. Scott, seconded by C. McDonough
to bring matter before full Council. So voted. C. McDonough noted further discussions
regarding subcommittees.

5. CITY COUNCIL - MOTIONS
5.1. C. Nuon - Req. City Mgr. contact Lowell's state delegation to
advocate for legislation to no longer make a voter inactive if they miss
the annual municipal census form.
In City Council, seconded by C. McDonough, failed per Roll Call vote 4
yeas (M. Gitschier, C. Liang, C. McDonough, C. Nuon), 5 nays (C.
Descoteaux, C. Juran, C. Mercier, C. Robinson, C. Scott), 1 absent (C.
Chau). So voted. C. Nuon noted legislation gave election directors a
different means to move voters to the active list through a post office data
base. C. Nuon suggested sending a letter of support to delegation
supporting proposed legislation. C. Juran noted she had not seen the bills
and that there could be some issues and concerns regarding the use of the
post office. C. Scott noted concern on how it would work and a lot is not
known about the process. C. Mercier noted her reservations and that the
focus should be prevention of fraud. C. Nuon stated that the failure to fill
out census form should not be a reason to remove voters from the roll. C.
Robinson recognized the spirit of the motion but noted the other means to
be placed back on the voter rolls. C. McDonough noted the need for a
better process but was not sure how this would work.

5.2. C. Nuon - Req. City Mgr. provide a report about the
implementation of state law relative to making voters inactive which
will include recommendation for better educating voters about their
voting status approaching an election.
In City Council, seconded by C. Liang, referred to City Manager. So voted.
C. Nuon noted the need to find ways to make it easier for voters to be
engaged. C. Scott agreed with educating the voters.
5.3. C. Nuon / C. Liang - Req. City Mgr. work with appropriate
department to update City Council regarding installation of
Cambodian Town's banners along Middlesex Street.
In City Council, no second needed, referred to City Manager. So voted. C.
Nun noted the banners are ready to be replaced. C. Liang noted upgrades
in the area and that banners should be added.
5.4. C. Liang - Req. City Mgr. / City Clerk offer language support and
interpretation services to registered speakers, available upon request,
during City Council, Board, Commission and community meetings,
whether held virtually or in person.
In City Council, seconded by C. Nuon, referred to City Manager. So voted.
C. Liang noted the need of the community members.
5.5. C. McDonough - Request the city manager work with the
appropriate departments to explore all available options for
increasing compliance with the city's noise ordinance as it relates to
dumpster services.
In City Council, seconded by C. Robinson, referred to City Manager. So
voted. C. McDonough noted the issue was consistent and that there are a
lot of vendors violating the ordinance. C. Robinson noted the persistent
issue and that raising fines could be a solution. City Solicitor Williams
responded that raising fines would involve special legislation.

5.6. C. Robinson - Req. City Mgr. have the proper department explore
and provide a potential path towards the addition of a skatepark in
Centralville including possible locations.
In City Council, seconded by C. Scott, referred to City Manager. So voted.
C. Robinson noted this type of area could get many of them off the street
and commented on possible funding sources.
5.7. C. Robinson - Req City Mgr. have the proper department work
with the Housing SC to explore a land co-op model for the opportunity
to increase affordable homeownership.
In City Council, seconded by C. Nuon, referred to City Manager. So voted.
C. Robinson noted that new opportunity could be present by use of this new
housing model, though it may be non-traditional. Yovani Baez-Rose (DPD)
requested time to explore model and present findings to the Housing SC.
C. Descoteaux noted such a report would provide information regarding the
model.
5.8. C. Robinson / M. Gitschier - Req. City Mgr. reach out to all tax
exempt, community partners such as ULowell, MCC, LHA, etc. to
explain the current fire staffing situation and ask for voluntary
assistance with preventing brownouts.
In City Council, no second needed, referred to City Manager. So voted.
Registered speakers, Pat McCabe (comment – speaking as a resident and
noted the number of calls by the department for those entities; noted
overtime was not related to sick time abuse) and Bill Harland (comment –
supported the motion and welcomed money from an outside source),
addressed the Council. C. Robinson noted request is based on a need for
money and that staffing effects overtime budget of department. C.
McDonough noted the fire expenses in school spending and that all entities
should pay for those same expenses. C. Descoteaux commented on the
staffing and overtime and questioned the number of new hires pending.
Manager Golden, Jr. indicated that there would be 6-9 new hires. C. Nuon

noted the overtime in the department cannot be sustained and that is an
ongoing problem. C. Nuon noted the need to better understand staffing
and overtime relationship. C. Scott questioned current taxing of these
entities and how does it stand today. Conor Baldwin (CFO) commented on
requests made to these entities and that they are tax exempt per state law.
C. Scott noted retirements will affect the level of staffing in the department.
C. Liang supports additional funding sources but realized the overtime must
be put in order. C. Mercier noted public safety is the number one priority.
Chair relinquished to Vice Chair Nuon at 7:16 PM. C. Juran noted the need
to understand interplay of resources with other entities. M. Gitschier
commented on prior budgets and noted that there is no abuse with the
overtime as they are following applicable law. M. Gitschier noted
administration made a mistake in funding overtime as opposed to putting
resources to hiring and that staffing correlates with overtime. M. Gitschier
noted government created this problem. Chair returned at 7:30 PM.
5.9. M. Gitschier / C. Robinson - Req. City Mgr. have the proper
department start the process to fill the vacant District 1 City Council
seat.

Robinson noted the different opportunity to increase housing.
B) Motion Response - Fire Chief Hiring Process - In City Council,
Motion “To accept and place on file” by C. Scott, seconded by C.
Descoteaux. So voted. Chair relinquished to Vice Chair Nuon at 8:45 PM.
M. Gitschier noted the response and commented that it was important for
public to see the process unfolding regarding the hiring. M. Gitschier noted

outlined the hiring process; noting use of committee to assist. Chair

C) Motion Response - Hiring Practices and Background Check - In City
Council, Motion “To accept and place on file” by C. Robinson, seconded by
C. Nuon. So voted. C. Nuon commented on the need to provide thorough
checks with all individuals associated with City. Mr. Baldwin commented on
the process for checking and noted upgrades to procedures. Chair
relinquished to Vice Chair Nuon at 8:55 PM. M. Gitschier commented on
the absence of the HR Director noting he is in charge of policies and
procedures regarding checks and further noted that current hiring practices
are a disaster. Chair returned at 9:00 PM. Mr. Baldwin provided
background for his involvement to the response.
D) Motion Response - MIS Tech Improvements - In City Council, Motion
“To accept and place on file” by C. Liang, seconded by C. McDonough. So
voted. C. Juran noted that the Council should be aware of the technology
upgrades in the City.
E) Motion Response - Support Letter Senate 3064 - In City Council,
Motion “To accept and place on file” by C. Mercier, seconded by C. Liang.
So voted.
F) Motion Response - 24-hour Shelter Winter Protocol - In City Council,
Motion “To accept and place on file” by C. Scott, seconded by C. Juran. So
voted. C. Scott noted the invitation to the delegation regarding discussion
of this issue. C. Juran commented on available facilities in the City which
would assist with the housing crunch. Manager Golden, Jr. noted his
discussions with various partners emphasizes housing over shelters.
G) Motion Response - Former City Councilor - In City Council, Motion
“To accept and place on file” by C. McDonough, seconded by C. Liang. So
voted. C. McDonough commented on the request and noted that ethics
rules should be tight.
H) Motion Response - Hot Pot - In City Council, Motion “To accept and

voted. C. Liang commented on the report and noted a purchasing line item.
Mr. Baldwin noted that item involved charges to the Purchasing
Department.

Manager Golden, Jr. commented on the development and purpose of the
report.
6.3. Communication - Resignations of Members from Various Boards
and Commissions.
In City Council, Motion “To accept and place on file” by C. Robinson,
seconded by C. McDonough. So voted. Antonia Bryant resigned from the
Lowell Youth Commission. Brad Buitenhuys resigned from the
Conservation Commission. Manager Golden, Jr. noted Mr. Buitenhuys was
resigning from Community Preservation Committee and that was accepted
as well.
6.4. Communication - Appointments to Lowell Youth Commission.
In City Council, Motion “To accept and place on file” by C. Scott, seconded
by C. Mercier. So voted. The following were appointed to the Lowell Youth
Commission: Dylan Quinones; Avry McKiernan; and Ariana Martinez. Ms.
McKiernan addressed and thanked the Council.

Gitschier questioned the timing and noted it was not good as it was a short
window. William Rosenberry (Election Director) outlined the proposal,

city's vacancy ordinance at 50 Warren St.
The City of Lowell’s Commercial Vacancy Registration Program has been a good tool in the city’s
efforts to open communication with property owners of vacant commercial spaces in the city. The
program has seen sites transition to new ownership, start active rental listings, and pull permits to
transition to new uses. There have also been some sites that have not engaged with the staff, requested
waivers, or acknowledged the city’s outreach efforts; those sites are generating fines.
The adoption of the program and the subsequent enforcement across the city have been beneficial. The
purpose of this program was to ensure that negligent property owners are forced to engage with the city
to try to fill their vacancies. The economic development staff have used the opportunity to engage with
property owners to educate them on the various programs the city has available to support them as
property owners, and programs we can utilize to support small businesses.
Given the number of existing long-term vacancies scattered across the city, the staff have taken a
“worst first” approach. The economic development staff work closely with the Building Commissioner
and inspectional service staff to identify priority target locations across the city for enforcement. This
approach is consistent with the initial motivation of the program to force property owners to activate
their property. While the ordinance language does require vacancies longer than 90 days to register
their sites, the city is targeting long-term problem properties for strict enforcement.
While the ICC site owned by the UMass Building Authority (UMBA) is currently vacant, the site has
been professionally maintained and has not been reported to Inspectional Services as the source of
minimum maintenance, health or safety violations. The site is secured and UML facilities staff are
working to maintain the site in accordance with city standards. UMBA has not registered the site
through the program, but as a division of the Commonwealth of Massachusetts the City does not have
the authority to enforce this ordinance for this site. UML and the City are in regular communication
about the ICC and planning for the site’s future use. Through the City Manager’s office, the Council
will remain updated on plans for any future uses planned for ICC.

proper department provide a written report on the City’s enforcement of short-term rental
regulations, including responsible departments, estimated number of active short-term
rental violations and enforcement actions over the past 24 months.
MOTION RESPONSE #13719: 6/16/26 - Councilor Juran – Request City Manager provide
a summary of any city regulations regarding short-term rentals (including Airbnb or similar
programs) and rooming houses.
Short-term rentals (STR), defined as a residential dwelling where rooms are rented for less than twenty-eight (28)
days, are prohibited in the City of Lowell. The city’s Board Enforcement Agent is responsible for enforcement of
STR violations in the city. Reports of STR units come into the city through a variety of channels, including 311
reports, direct calls, and emails. Interdepartmental collaboration between DDS, LPD, and LFD has provided
necessary access to units for health and safety inspections that have also helped identify STR units and rooming
houses. The Board Enforcement Agent also does monthly checks online for listings in Lowell on popular sites
such as Airbnb, VRBO, and others.
Attached to this response is a report with STR listings that have received warnings or fines since 2025. The Board
Enforcement Agent will issue warnings or escalating fines depending on the site condition and prior
communication with the property owner. Multiple infractions and inaction will result in fines being issued. Some
property owners try to avoid following the city’s existing ordinance related to STR units which requires follow
up and multiple points of contact, while others are unaware this ordinance exists and are often looking for
supplemental income, and once informed have removed listings.
With the prevalence of online sites offering STR listings, it can be difficult to track all postings, but staff try to
keep abreast of the situation and work to get these listings offline as soon as we are aware of their existence. Staff
are currently investigating a few postings actively online. It can be difficult to confirm locations because listing
addresses are not available until final booking. Staff will continue to track listings and communicate with property
owners about our existing ordinances.

forward to beautify areas of the reservoir utilizing the planting of pollinators.
In the spring, the City of Lowell secured a Community Biodiversity Grant from the Massachusetts
Department of Fish and Game. This grant helped create the Centerville Habitat Interconnected
Restoration Project (CHIRP): https://www.lowellma.gov/2214/CHIRP.
DPD staff have created a Pollinator Garden Initiative and have information and resources for
residents interested in starting a pollinator garden at home available online:
https://www.lowellma.gov/1932/Pollinator-Garden-Initiative.
Most pollinator gardens require two growing seasons to become fully established. DPD would like to
give the existing garden at the Robinson School (planted in the spring) time to establish itself before
expanding too quickly with other pollinator garden sites. These locations should eventually require
limited maintenance from DPW, but initially, the increased watering demands and strategic weeding
and maintenance may add more of a burden to DPW in the short term. Earlier this year, DPD and DPW
attended a joint training focused on care and maintenance of green infrastructure held at the South
Common rain gardens. This training was an opportunity for joint learning between DPD staff, who
often work on the design and project implementation of green design features, and DPW staff, who are
charged with the ongoing maintenance of these facilities. This training was very successful, and DPD
and DPW intend to schedule additional opportunities for this type of cross-training in the future. As
we work to enhance more environmental sustainability into sites, we must also recognize that the care
and maintenance needs also need to shift and staff need to be equipped to manage the work.
The Community Biodiversity Grants are anticipated to be available annually. DPD will look into that
source and others for future pollinator gardens at the reservoir and other locations once we are able to
determine the success of the Robinson School site after another full growing season is completed.

The Lowell Historic Board discussed the process to enlarge the existing portrait of former Mayor
Charles D. Palmer at the September meeting. The Board supports the idea of pursuing this effort and
asked the administrative staff to research ways the portrait can be enlarged and report back the full
costs and scope to the board at a future meeting.
Staff are currently working to identify options for the portrait enlargement and will bring a vote before
the Historic Board at a future meeting to fully fund the project.

and DPD look into establishing social districts for Downtown Lowell.
The Commonwealth of Massachusetts does not allow social districts by right. Recently, the Governor
issued an act allowing cities and towns to designate public consumption (social districts) through July 31,
2026, to coincide with the state hosting FIFA World Cup games. This designation was temporary and has
now expired. If Lowell pursued a seasonal or pilot Social District Program, it would require special
legislation. The License Commission is the only entity in the City of Lowell that can make or change
alcohol laws/regulations in the municipality. This group voted not to accept the "open carry" option for
FIFA.
If Lowell wants to pursue this idea, DPD recommends an initial discussion with stakeholders, including
members of the License Commission, LPD, the City Manager’s office, Economic Development staff, the
Greater Lowell Chamber of Commerce, local business owners, and the Lowell Downtown Neighborhood
Association. If the decision to seek special legislation is supported, it would be critical to have an engaged
stakeholder group to identify appropriate locations for these districts and plan for program
implementation.

RE: Vote to Authorize Manager to execute Release Deed
Dear Mayor Gitschier and Members of the City Council:
The Lowell Housing Authority (“LHA”) has requested that the City Release certain restrictions
and liens on properties now owned by the LHA. Some of these liens have been previously
released and in those instances the Release would function as a formality to satisfy lenders and
title insurance. A summary of the releases sought is contained below:
1. 722-724 Merrimack Street Lowell: LHA acquired this parcel in 1995 by a deed recorded
in Book 7717, Page 261. There is a 1992 Demo Order recorded in Book 6118, Page 247
and an associated Lien recorded in Book 6316, Page 255. The Lien was previously
released in Book 7624, Page 158. The Release would capture the Demolition Order.
2. 22 Decatur Street: The City deeded this parcel to LHA in March of 1998 by deed
recorded in Bool 9142, Page 166. Said deed includes a 30-year open space restriction.
This release would eliminate the final 1.5 years of the restriction to allow LHA to
commence construction.
3. 730 Merrimack Street: The City deeded this parcel to LHA in the same deed as 22
Decatur and includes the same 30-year open space restriction. This release would
eliminate the final 1.5 years of the restriction to allow LHA to commence construction.
4. 32 Decatur Street: the 1995 Deed to LHA from the City contains reverter language that
the parcels would conveyed would revert to the City if not used by LHA within 5 years
for the construction of the LHA’s “Multi-Service Community Center.” The Center was
built and 32 Decatur has served as attached open space/parking for the Center.
5. 691-701 Merrimack Street: This parcel is registered land. The 1971 Deed requires that
the parcel be dedicated to the purposes of an Urban Renewal plan which has since
expired and a Release will allow LHA to proceed with its planned construction
6. 53-63 Salem Street – Old Tax Takings from 1986. These parcels do not appear on our
current list of tax title accounts.

Enclosed is a copy of the proposed vote, for approval by the City Council, authorizing the City
Manager to execute the Release, which will allow the LHA to proceed with its plans to construct
additional housing units on under-utilized land.
