Review Update to Police Department Automated License Plate Readers (ALPRs)
Policy #433
In June of 2022, Council reviewed and approved the implementation of
Automated License Plate Readers (ALPR) by Flock Safety, Inc.. The ALPR's
were installed in various phases throughout the Village. Police Chief Brian
O'Connell provides Council with a recap of the ALPR program, functionality, data

synopsis, operational overview, and built-in safeguards.
Since implementation, the Police Department has recommended updates to the
ALPR Policy #433. Police Department staff recommend proposing the reduction
of data storage from 30 days to 7 days, confirming limited data sharing with North
Regional Major Crimes Task Force, prohibiting Federal and out-of-state access
for immigration enforcement or health care investigations, requiring searches
conducted by a Winnetka Police Officer or a member of a partnering agency to
justify the use of the system by entering a valid department case number, and
confirm quarterly audits to be reported to both the Chief of Police and the Village
Manager.
Council discusses matters related to cybersecurity, partial license plate reads,
data storage, and communication related to NORTAF participation.
Trustee Myers suggests both the Police Chief and Fire Chief provide an annual
report to Council regarding a yearly recap as it relates to the use of the ALPR
system.

Resolution No. R-73-2026: Waiving Bidding and Awarding a Contract to
Microsystems, Inc. for Digitization Services for Community Development
(Adoption)
President Dearborn requested that Resolution No. R-73-2026 be removed from
the consent agenda for a separate discussion as the higher not to exceed
amount is largely based on the unpredictability in the total project scale given the
amount of documents within the file cabinets. While the quote is largely based on
digitizing property files, there is a significant number of additional files needed to
be digitized as well.
Community Development Director Scott Mangum states the need to digitize
paper files in order to improve records accessibility, reduce reliance on physical
file storage, protect the Village's records against loss or damage, and prepare for
the temporary closure of Village Hall for renovations. Council is advised that
given the volume, nature of the work, and time constraints, staff is limited with the
ability to issue a formal RFP for these services. With the Department previously

Chief Financial Officer Tim Sloth advises Council that in 2020, the Village was
notified by Representative Robyn Gabel's Office that two line item grants, totaling
$28,000,000, were awarded for stormwater management improvements. To date,
the Village has received $23,000,000 of the $28,000,000 in funding. In August of
2026, staff was notified that the final tranche of grant funds was to be released by
the Governor's Office of Management and Budget. On September 8, 2026 the

ITEM HISTORY:
December 2018 – Resolution No. R-77-2018, approving the Professional Services Agreement with
SAFEbuilt Illinois, LLC (Agreement dated December 31, 2018).
November 2020, November 2021, and November 2022 – First, Second, and Third Amendments, each
extending the term of the Agreement and setting prices for that extension term.
October 17, 2023 – Resolution No. R-94-2023, approving the Fourth Amendment, establishing a threeyear term with two additional one-year extensions.
EXECUTIVE SUMMARY:
At the November 5, 2026, Village Council meeting, the Council is scheduled to consider Resolution
No. R-72-2026, Approving a Fifth Amendment to the Agreement with SAFEbuilt Illinois, LLC for
Inspection and Plan Review Services. The amendment would extend the term of the Village’s
agreement with SAFEbuilt Illinois, LLC for permit administration, plan review, building inspections, and
code enforcement services through December 31, 2027, and establish an updated fee schedule for
2027 (the “Fifth Amendment”).
BACKGROUND
The Village first entered into a contract for building inspection and plan review services with SAFEbuilt
in June 2013. Prior to this date, these services were provided by Village employees. Winnetka, along
with four other neighboring municipalities – Glenview, Evanston, Wilmette, and Kenilworth – engaged
in an RFP process to identify a third-party vendor to provide these services. SAFEbuilt was the
successful vendor and was chosen over four others. The impetus behind this model was to address
the need for additional building plan review and inspection services due to the increase in building
activity at that time without adding permanent municipal employees, and to use a regional approach to
achieve economies of scale and process efficiencies.
In 2018, prior to the Village’s agreement with SAFEbuilt expiring, the Village joined the original four
Page 10 of 110
neighboring municipalities and six additional municipalities (Highland Park, Lincolnshire, Morton Grove,
Niles, Palatine, and Wheeling) in an RFP process for building plan review and inspection services. Six
proposals were received, with only three being responsive to the Village’s request for services. The
Village found SAFEbuilt to be the lowest responsible proposer, and the Village adopted Resolution No.
R-77-2018 entering into a contract with SAFEbuilt for building-related plan review and inspection
services.
The Agreement has since been amended four times. The First, Second, and Third Amendments (2020,
2021, and 2022) each extended the term for one year and set the prices for services during that period.
In October 2023, the Village Council adopted Resolution No. R-94-2023 approving the Fourth
Amendment, which established a three-year term through December 31, 2026, with two additional oneyear extensions. The Fourth Amendment also provided for a general 5% rate increase in 2024, with
subsequent annual increases limited to 3% or CPI, whichever is lower, and updated key personnel
designations and indemnification language.
Pursuant to these approvals, SAFEbuilt staff have been utilized to handle the Village’s plan reviews
and daily inspection of residential, multi-family, and commercial properties. When necessary,
SAFEbuilt staff have also assisted with code enforcement issues. SAFEbuilt services have been
primarily provided by one SAFEbuilt staff member, who has been assisted by other SAFEbuilt staff
during peak construction times in the summer or when there is a high volume of projects. Each service
has been assigned a rate, and each task has a performance expectation that is measured in units.
PROPOSAL
The current term of the Agreement expires on December 31, 2026. Consistent with the first of the two
one-year extensions contemplated under the Fourth Amendment, the Village Attorney has prepared
the attached Fifth Amendment, executed by SAFEbuilt on October 28, 2026. The Fifth Amendment
makes two substantive changes to the Agreement:
1. Term. Section 2.C, “Commencement; Term,” is replaced to provide that SAFEbuilt will
continue to provide services through December 31, 2027.
2. Fee Schedule. Exhibit E, Fee Schedule, is replaced with the 2027 rates summarized below.
All other terms and conditions of the original Agreement and the First through Fourth Amendments
remain in full force and effect.
The updated fee schedule itemizes electrical and plumbing inspections and plan review separately
from building services, renames after-hours inspections as emergency inspections, and adds rates for
health inspections, civil engineering, and some planning staff classifications that may be utilized in the
future at the Village’s discretion. The 2027 rates represent an increase of approximately 10% over
current 2026 rates. SAFEbuilt has noted an increase in labor costs and the experience and
certifications of the primary staff member as the primary reason.
The pricing for each service is summarized in the table below compared to the current contract with
the services typically used in bold font:

BUDGET
Annually, Village staff reviews the scope of services needed for the following year, which is based on
expected permit volume and anticipated services that can expand or be reduced based on actual yearly
projections. An amount of $206,000 was approved by the Village Council for SAFEbuilt plan review
and inspection services in FY2026, and actual spending for FY2026 is projected at approximately
$160,000. While the proposed hourly rates would increase, the amount budgeted has not changed, as
the primary staff member has reduced hours from five to four days per week since May 1, 2026 and
has thus far been able to maintain acceptable volume. Staff will continue to monitor the workload
through the remainder of 2026 and assess the scope of work for 2027. With $206,000 included in the
proposed FY2027 budget this allows for sufficient capacity for unexpected additional permit review and
inspection activity.
RECOMMENDATION:
Given SAFEbuilt’s continued positive performance and the established service rates for 2027, staff
requests that the Village Council consider adopting Resolution No. R-72-2026, Approving a Fifth
Amendment to the Agreement with SAFEbuilt Illinois, LLC for Inspection and Plan Review Services.

Resolution No. R-78-2026: Approving a Professional Services Agreement with
Strand Associates, INC. for Construction Engineering Services for the Green Bay
Trail Improvements Design (Adoption)
PRESENTER:
James Bernahl, Obaid Khalid
AGENDA DATE:
November 5, 2026
CONSENT:
No
ITEM TYPE:
Ordinances and Resolutions
ITEM HISTORY:
At the June 16, 2026 Regular Council meeting, staff presented an update on the Green Bay Trail. At
this meeting, the Village Council directed staff to seek a proposal for professional design services to
begin the design and permitting for Phase 1 of the proposed trail improvements.
EXECUTIVE SUMMARY:
Staff recommends approval of a professional services contract with Strand and Associates, Inc. for the
Green Bay Trail Improvements Design project in an amount not to exceed $225,200. The proposed
services include Phase I preliminary engineering, Phase II final design, and bidding assistance for trail
and amenity improvements.
The project includes the following improvements, subject to refinement during preliminary design and
Village review:
South Town Center. Improvements along approximately 300 feet of trail at the Indian Hill overpass on
Winnetka Avenue include a concrete sidewalk connecting the existing steps to the trail, seating, a picnic
table, a mile marker, a 40-foot by 20-foot activity platform, selective vegetation clearing, tree trimming,
and landscape restoration.
South Neighborhood. Improvements along approximately 150 feet of trail at the Wilson Street and
Willow Road access include seating, a 40-foot by 20-foot activity platform, selective vegetation clearing,
tree trimming, and landscape restoration. Historical signage, educational signage, and lighting are
excluded from this location.
Green Bay Trail. Improvements along approximately 3,300 feet include widening and resurfacing the
asphalt bike trail to a consistent 8-foot width, widening and resurfacing the existing gravel running path
along the east side to 3 feet, adding a new 3-foot gravel running path along the west side, and bike
trail striping.
Engineering services. The Village received grant funding, with assistance from Congressman Brad
Schneider’s Office, for construction improvements along the Green Bay Trail. The grant will be
administered by the Illinois Department of Transportation (IDOT); therefore, the Village is required to
follow IDOT’s project development and design procedures to ensure compliance with the grant
requirements. This process requires completion of both Phase I (Preliminary Engineering) and Phase
II (Final Design) prior to proceeding with construction.
Phase I includes topographic surveying, environmental review, geotechnical investigations, preliminary
design, utility coordination, a public information meeting, and preparation of a Project Development
Report and preliminary construction cost estimate. The scope includes coordination with the Illinois
Department of Transportation and Federal Highway Administration.
Phase II includes geotechnical reporting, utility coordination, engineering drawings, technical
specifications, erosion control and stormwater pollution prevention plans, and updated construction
cost estimates. Strand will coordinate with the Northwest Municipal Conference and submit final
documents to the Village and IDOT for IDOT letting. Bidding assistance includes responding to bidder
questions, preparing addenda, reviewing bids, and assisting with contract award and execution
documents.
Village responsibilities and project assumptions. The Village will select site amenities and provide
manufacturer information, available project records, access, legal services, and bidding and contracting
documents. The scope assumes all engineering design and construction will occur outside railroad
right-of-way and that railroad permits and flaggers will not be required.
Compensation. Services will be billed on a time and expense basis, with a total fee not to exceed
$225,200. The proposed contract budget is allocated as follows:
Service
Contract budget
Phase I Engineering
$136,100
Phase II Engineering
$84,200
Bidding-Related Assistance
$4,900
Total Not to Exceed Fee
$225,200
The fee covers the engineering and bidding services described above. Construction and construction
engineering services are not included in this scope.
Funding. As part of the approved FY2026 budget, the Village Council has approved $200,000 for these

FY2026, with the remaining work being substantially completed in 2027.

Agenda Item Executive Summary
TITLE:
Resolution No. R-82-2026: Waiving Bidding and Awarding a Contract to SB
Friedman Development Advisors, LLC for Developer Solicitation Services
(Adoption)
PRESENTER:
Scott Mangum
AGENDA DATE:
November 5, 2026
CONSENT:
No
ITEM TYPE:
Ordinances and Resolutions
ITEM HISTORY:
At the October 14, 2025, Village Council Study Session, the Village Council reviewed the background
of previous discussions about redevelopment of the former US Post Office site in the West Elm
Business District, provided direction for demolition of the existing building and site restoration, and
requested direct public engagement regarding the future use of the site. On December 16, 2025, the
Village Council approved Resolution No. R-103-2025, approving a contract with Teska Associates,
Inc., to perform public engagement and prepare concepts for the site based on community feedback.
SB Friedman Development Advisors, LLC (SB Friedman) was engaged in early 2026 to provide
development advisory services supporting Teska’s concept planning, including market feasibility,
funding strategy, and economic feasibility work. On August 18, 2026, the Village Council approved
Resolution No. R-60-2026, approving an agreement with SB Friedman to perform economic analysis
of site planning concepts for future development of the site.
At the October 13, 2026, Village Council Study Session, Teska and SB Friedman presented the results
of the Former Post Office Site visioning process, including community engagement findings, the
recommended site plan, and an economic and parking analysis. Following the presentation, the Village
Council provided direction to move forward with Concept 4 (a 1½-story commercial/restaurant building
with central open space) without underground parking, and directed that developer interviews be
conducted to pursue that concept.
EXECUTIVE SUMMARY:
On Thursday, November 5, 2026, the Village Council is scheduled to consider Resolution No. R-822026, Waiving Bidding and Awarding a Contract to SB Friedman Development Advisors, LLC for
Developer Solicitation Services (Attachment A). The Resolution would approve a contract with SB
Friedman, in substantially the form of its Proposal for Developer Solicitation Services dated October 9,
2026 (Attachment B), in an amount not to exceed $79,890. The services would support the Village in
marketing the site and soliciting development proposals for Concept 4, consistent with the Council’s
October 13 direction.
Pursuant to Section 4.12.010.C of the Village Code, Section IV.3.D of the Village’s Purchasing Manual,
and the Village’s home rule authority, the Resolution also waives competitive bidding. Village staff
recommends the waiver based on SB Friedman’s prior work on the project, which included review of
preliminary concepts, interviews with developers, market and financial analysis, and support of
engagement with elected officials and the public, and the Village’s satisfaction with that performance.
CONCEPT 4 AND DEVELOPER INTEREST
As presented on October 13, Concept 4 places a one-and-a-half story commercial/restaurant building
on the 27,700 square foot northern portion of the site, with central open space and a surface parking
lot retained to the south. SB Friedman estimated private investment of approximately $14.5 million for
the building and, with surface parking only, a net cost to the Village of approximately $7.8 million for
the public components. SB Friedman also noted that the building’s relatively small scale (under 20,000
square feet) and specific use requirements will limit the pool of developers, and that it is unlikely to be
built “on spec” and will require committed, experienced restaurant operator(s). The proposed services
are intended to test that interest and prepare the Village to attract qualified proposals.
PROPOSED SCOPE OF SERVICES
SB Friedman would provide development advisory services to support a two-stage developer
solicitation process: a request for qualifications (RFQ), followed by requests for proposals (RFP) from
a shortlist of qualified developers. Key components of the scope include:
• Pre-Marketing Support: Coordinating and participating in up to five virtual interviews with
restaurant operators, hospitality groups, and commercial developers to gauge interest in the site
and understand their requirements for developing and operating there.
• Site Readiness Support: Requesting, reviewing, and compiling due diligence documents (such
as title, ALTA survey, and NFR letter) and clarifying key development parameters, including
allowable uses, height and bulk, ground coverage, and on-site and off-site parking strategies
(including valet service).
• RFQ/P Preparation: Preparing the RFQ/P document, including the site and opportunity
description, development requirements and guidelines, submittal requirements, and selection
criteria, with up to two rounds of review with Village staff before publication.
• RFQ/P Distribution Support: Researching developers and restaurant groups well suited to the
site, supplementing that research with Village contacts, and distributing the RFQ/P and due
diligence materials by email and on the Village website. Because the project involves licensed
activity, Caren Kay, a Senior Vice President with SB Friedman and a licensed Illinois real estate
broker, would advise on the project.
• RFQ Response Review and Evaluation: Reviewing and summarizing developer submittals
(budgeted for up to five responses) to assist the Village in selecting a shortlist.
• RFP Response Review and Evaluation: Evaluating detailed proposals from up to three
shortlisted developers, compiling a comparative matrix covering offer of land, alignment with the
Village’s vision, type of commercial tenants, and certainty of tenant interest; participating in three
coordination meetings with Village staff and representative Trustees; and presenting the process
and recommended developer selection to the Village Council.
• Ongoing Communications: Up to six additional coordination calls and/or meetings with staff
and elected officials.
SB Friedman identified negotiation support as a potential additional service once a preferred developer
is selected, including analytical and negotiation support related to land disposition, the use and
structure of public assistance, and a term sheet and redevelopment agreement. Because the scope
and fee for those services cannot be predicted without knowing the details of a transaction, they are
Page 67 of 110
not included in the proposed contract and would be provided on an as-needed hourly basis only with
separate authorization.
FEE AND BUDGET CONSIDERATIONS
SB Friedman’s fees are based on time required at its 2026 hourly billing rates (Partner $460, Senior
Vice President $440, Project Manager $285, and Associate $225), which are in effect through
December 31, 2026. The proposed not-to-exceed amount of $79,890 consists of $79,290 in
professional fees (approximately 271 hours) and $600 in reimbursable expenses and travel. SB
Friedman may not exceed this amount without the Village’s prior authorization. Invoices are rendered
no more often than monthly and are payable within 30 days. Given that the amount is over $50,000,
Village Council authorization is required.

NEXT STEPS
If the Resolution is approved, staff and SB Friedman would define a detailed work plan. SB Friedman’s
proposed approach is as follows:
1. Conduct pre-marketing interviews to gauge developer and operator interest in Concept 4
and identify requirements for developing and operating at the site, consistent with the
Council’s October 13 direction;
2. Compile due diligence materials and clarify key development parameters so that there is
a clear path forward for the private sector; and
3. Prepare the RFQ/P for staff review and distribute it to the developers and restaurant
groups identified through the pre-marketing effort.
RECOMMENDATION:
Staff recommends that the Village Council adopt Resolution No. R-82-2026, Waiving Bidding and
Awarding a Contract to SB Friedman Development Advisors, LLC for Developer Solicitation Services,
in an amount not to exceed $79,890.

Proposal for Developer Solicitation Services
10.28.2026
The Post Office Site
ATTACHMENT 2
Ms. Kristin Kazenas
Village Manager
510 Green Bay Road
2nd Floor
Winnetka, IL 60093
Per our recent discussion, SB Friedman Development Advisors, LLC (“SB Friedman”) is
pleased to support the Village of Winnetka (the “Village”) on matters related to
developer solicitation and site redevelopment strategy for the former Post Office site
(the “Site”). SB Friedman requests fee authorization to provide development advisory
services (“DAS”) to the Village on an hourly basis related to the planned efforts to solicit
development proposals for the Site. We understand that Village has prepared requests
for qualifications and proposals (“RFQ/P”) documents in the past, and we propose to
support the Village on an as-needed basis in marketing the Site and reviewing
applications.
Key areas of work could include:
•
Pre-Marketing Support - Coordinating and participating in up to five (5) virtual
interviews with restaurant operators, hospitality groups and commercial
developers to gauge interest in the Site and determine specific requirements
they may have in developing and operating here.
•
Site Readiness Support - Assisting the Village in making the Site development
ready by requesting, reviewing and compiling due diligence documents (e.g.,
property title, ALTA survey, NFR letter, etc.) to share with the development
community. We want to ensure that when the Site is brought to market, there is
a clear path forward for the private sector to execute on development. Key
components such as allowable uses, maximum height/bulk, ground coverage,
on-site and offsite parking strategies (including valet service) for the
development and other key parameters should be clarified to minimize
uncertainty and articulate a clear vision for the Site.
•
RFQ/P Preparation - Preparing the RFQ/P document for a two -stage
developer solicitation process for the Site. Stage one would involve submittal of
developer qualifications and experience. Following the evaluation of developer
qualifications, a shortlist of developers would be invited to submit detailed
proposals including design concepts, tenant interest and provide an offer on
the land. Components of an RFQ/P typically include:
o Description of the site and development opportunity,
o D evelopment requirements and guidelines,
o Outline of submittal requirements, and
o Selection criteria.
We assume up to two (2) rounds of review with Village staff prior to publication.
•
RFQ/P Distribution Support - Building on the pre-marketing work, we will
research restaurant operators, hospitality groups and commercial developers
who may be well-suited to delivering Village goals for the Site. We will also
supplement our research with contacts that the Village has available to ensure
that the RFQ/P document is
1
Village of Winnetka | Developer Solicitation Services
seen by as many relevant parties as possible. We will work with the Village to distribute the RFQ/P document
and associated due diligence material via email and have it available on the Village website. Caren Kay is a
Senior Vice President with the firm and a licensed real estate broker in Illinois. Since this project involves
licensed activity, we will involve Caren as an advisor on the project.
•
RFQ Response Review and Evaluation - We can conduct a review of developer submittals and summarize
key aspects of each response to assist the Village in evaluating submittals and select a short list of qualified
developers to request proposals from. We assume up to five (5) responses to RFQ for budgeting purposes.
•
RFP Response Review and Evaluation - We anticipate that a short list of up to three (3) developers
deemed qualified by the Village will be offered the opportunity to make detailed development proposals for
the Site. We will evaluate the proposals from the developers and compile key points including offer of land,
alignment with Village vision, type of commercial tenants and certainty of tenant interest , into a comparative
matrix. We anticipate three (3) coordination meetings with Village staff and representative trustees to
evaluate development proposals. We will also be available for a presentation to Village Board outlining the
process and recommended developer selection.
•
Ongoing Communications - Throughout the process we anticipate engaging with staff and elected officials
in up to six (6) additional coordination calls and/or in-person meetings to those listed above.
•
(Potential Additional Service) Support Negotiation Process - Once a preferred developer has been
selected, for addition fee, we are available to assist the Village with analytical and negotiation support
regarding potential land disposition (including consideration for both fee simple sale and ground lease
options) and potential use and structure of public assistance. Services may include negotiating a business
transaction, term sheet and redevelopment agreement with the preferred developer. The precise scope and
fee related to these services are difficult to predict with accuracy without knowing the details of a potential
transaction. Depending on the developer proposal, additional analysis of public assistance terms and
discussions with private property owners may be needed. We suggest that this engagement would be on an
as needed hourly time and materials basis.
Professional Fees
We will work with the Village to define specific work plans in ways that are most useful to staff and elected officials.
Given the numerous potential paths this project may go down we must charge hourly for our time. Initially, our
professional fees for these services will be based on the time required at our current billing rates and will not exceed
$79,890 without your prior authorization.

Hubbard Woods Streetscape – Phase 1 Engineering Report
Update
Prepared By: James J. Bernahl, Director of Engineering/Village Engineer
Obaid Khalid, Assistant Village Engineer
Date:
November 5, 2026
INTRODUCTION
At the November 5, 2026, Village Council meeting, Village staff and representatives
from Gewalt Hamilton Associates, Inc. (GHA) will present an update on the Hubbard
Woods Streetscape Project, including the substantially completed Phase I Engineering
Report, preliminary construction cost estimate, and anticipated next steps for
advancing the project.
At the conclusion of the presentation, staff will seek direction from the Village Council
on these next steps to continue advancing the project's Phase II design.
BACKGROUND
The Hubbard Woods Streetscape Project was initially identified in the Winnetka
Downtown Master Plan and further advanced through the Downtown Streetscape &
Signage Master Plan. The project aims to improve pedestrian safety and accessibility,
traffic circulation, and the overall streetscape within the Hubbard Woods Business
District, consistent with improvements previously completed in the Elm Street Business
District.
The project area generally extends along Green Bay Road from Tower Road north to
Scott Avenue. Green Bay Road is currently under the jurisdiction of the Illinois
Department of Transportation (IDOT).
In September 2023, the Village Council approved an agreement with Teska Associates
to prepare a streetscape concept plan. Through community outreach, business
surveys, and public meetings, Teska developed alternative streetscape concepts
incorporating pedestrian bump-outs, enhanced crossings, landscaping, and traffic
circulation improvements.
At the June 11, 2024, Village Council Study Session, Council members expressed a
preference for the concept incorporating pedestrian bump-outs along Green Bay Road
and requested additional traffic and parking analyses before finalizing the preferred
concept.
1
In October 2024, the Village Council approved an agreement with GHA to complete
the Phase I Engineering Study. The initial phase focused on evaluating the proposed
streetscape concepts and their potential impacts on traffic circulation, parking, and
pedestrian movements, particularly around Hubbard Woods Park.
At the March 11, 2025, Village Council Study Session, GHA presented the findings of
the traffic and parking study. Based on Council feedback, the project advanced with
the preferred streetscape concept, including maintaining the existing counterclockwise
traffic circulation around Hubbard Woods Park, evaluating a four-way stop at Merrill
Street and Green Bay Road, and further studying safety improvements at the Tower
Road and Green Bay Road intersection.
PHASE I ENGINEERING STUDY – STATUS UPDATE
Since the March 2025 Council Study Session, GHA has continued advancing the
Phase I Engineering Study based on the preferred streetscape concept.
The second part of the Phase I study included the following major engineering tasks:
•
•
•
•
•
•
Topographic and right-of-way surveys
Traffic and crash analyses
Environmental study
Preliminary drainage analysis
Final Intersection Design Study
Preliminary roadway improvement exhibits and construction cost estimate
On June 15, 2026, Village staff and GHA held a public information meeting to present
the preliminary roadway improvement exhibits, including proposed roadway
configurations, traffic data, and crash analyses. Residents and business owners had
an opportunity to review the proposed design and provide comments. The public
meeting materials and comment response document are available on the Village's
website.
GHA has substantially completed the Phase I Engineering Study, and the report is
currently in the final IDOT review and acceptance process. The completed study
establishes the engineering framework for advancing the proposed improvements into
Phase II Design Engineering.
During the November 5 meeting, GHA will provide an overview of the study findings,
recommended improvements, and remaining steps for obtaining final IDOT
acceptance.
2
PRELIMINARY CONSTRUCTION COST ESTIMATE
As part of the Phase I Engineering Study, GHA prepared an updated preliminary
construction cost estimate of approximately $15 million (estimate based on 2026
construction costs), which includes the proposed streetscape improvements, roadway
reconstruction, and water main replacement.
The updated estimate provides a more comprehensive understanding of the
anticipated project construction costs and will serve as the basis for evaluating
potential funding sources and developing the project's implementation strategy.
The project is anticipated to require funding from multiple sources, which may include
potential IDOT financial contributions associated with the jurisdictional transfer, STP
funding (if granted), the Village Water Fund, and the Business District Revitalization
Fund.
The preliminary construction cost estimate will be further refined during Phase II
Design Engineering as detailed construction plans and specifications are developed.
NEXT STEPS
With the Phase I Engineering Study substantially complete, staff has identified the
following major steps to advance the Hubbard Woods Streetscape Project.
1. Proceed with Phase II Design Engineering
The next phase of the project is Phase II Design Engineering, which includes preparing
detailed construction plans and specifications, updating cost estimates, and obtaining
the necessary permits and agency approvals.
Advancing Phase II Design Engineering will allow the Village to further refine the
proposed streetscape and roadway improvements, address engineering requirements,
and prepare the construction plans and project specifications for construction.
With direction from the Village Council, staff will begin preparing and negotiating a
professional services agreement with GHA for Phase II Design Engineering and return
to the Council for consideration and approval of the agreement.
2. Initiate Negotiations with IDOT Regarding Jurisdictional Transfer
As previously discussed with the Village Council, the proposed streetscape
improvements include modifications to Green Bay Road, which is currently under IDOT
jurisdiction.
3
In August 2024, Village representatives met with IDOT to discuss the proposed
improvements, the potential jurisdictional transfer of Green Bay Road between Tower
Road and Scott Avenue, and associated engineering and funding requirements.
With the Phase I Engineering Study nearing final IDOT acceptance, staff recommends
moving forward with the process of initiating formal negotiations with IDOT regarding
the potential jurisdictional transfer.
These discussions will include roadway ownership, potential financial contributions
from IDOT, and other terms associated with transferring jurisdiction of the roadway to
the Village.
Staff anticipates coordinating these discussions with the advancement of Phase II
Design Engineering. Any proposed jurisdictional transfer agreement will be presented
to the Village Council for consideration and approval.
Recommendation
Staff requests comments and direction from the Village Council regarding the Phase I
Engineering Study findings, preliminary construction cost estimate, and proposed next
steps for the Hubbard Woods Streetscape Project.
Specifically, staff seeks Council direction to:
1. Proceed with preparing and negotiating a professional services agreement for
Phase II Design Engineering, and bring it back to the Village Council for
consideration and approval.
2. Initiate discussions and negotiations with IDOT regarding the potential
jurisdictional transfer of Green Bay Road between Tower Road and Scott
Avenue, including associated maintenance responsibilities and potential
financial contributions.
With direction from the Village Council, staff will continue advancing the project and
provide future updates regarding the Phase II Design Engineering agreement, IDOT
jurisdictional transfer negotiations, and project funding strategy.

TITLE:
Steep Slope Permit Appeal - 1207 White Bridge Lane
PRESENTER:
James Bernahl
AGENDA DATE:
November 5, 2026
CONSENT:
No
ITEM TYPE:
New Business
ITEM HISTORY:
None.
EXECUTIVE SUMMARY:
At the November 5, 2026 Village Council meeting, Mr. Rehan Aslam will present an appeal to the
Village Council after a determination from the Village Engineer and the Village Manager that
unpermitted work in the steep slope area at 1207 White Bridge is subject to the Village’s steep slope
requirements (see the Agenda Report in Attachment 1 for more detailed information and photographs.)
This will be the first appeal heard by the Village Council as outlined in the Village Code Section
17.82.090 (Attachment 2.) The Village Council will consider "whether the determination of the Director
in applying the steep slope regulations imposes an unreasonable and undue economic hardship that
materially limits the property owner from making reasonable use of such owner's property or otherwise
imposes requirements which are unreasonably burdensome to the property owner given the benefits
thereof to the Village."
Background
On June 3, 2026, Engineering and Forestry staff confirmed unpermitted work within the steep slope
area at 1207 White Bridge, including earth excavation, path clearing, vegetation removal, and a
switchback path toward Lake Michigan. Community Development subsequently issued a stop work
order. Staff met with Mr. Aslam on June 4 to explain the steep slope ordinance, permit requirements,
and tree protection requirements. Mr. Aslam stated that the work was intended to create access to
retrieve a fallen tree. On June 17, staff met with Mr. Aslam and consultant Dan Creaney to review
permit requirements and next steps. Staff also identified a large maple jeopardized by retaining wall
construction and discussed replacement planting and deposit requirements for tree removals.
On August 5, Mr. Aslam emailed the Village Manager, requesting an appeal to the Village Council. At
an August 10 meeting with Engineering Department staff, Mr. Aslam confirmed that he had retained
Greengard as his engineering consultant. Staff explained that the next step was a coordinated kickoff
meeting with Engineering, Community Development, Mr. Aslam, and his design engineer.
On August 12, Village Manager Kazenas emailed Mr. Aslam explaining that pursuant to Section
17.82.090 of the Village Code (Attachment 2), any determination of the Director of Engineering
regarding the Village's steep slope requirements may be appealed by the applicant to the Village
Manager by filing a request for review in writing within 35 days after the Director files his determination.
Although the 35 day appeal period had passed, Village Manager Kazenas extended the timeline for
the appeal to August 27.
On August 25, Village Manager Kazenas received Mr. Aslam's written request to waive steep slope
requirements for the unpermitted work. On September 4, Village Manager Kazenas denied the request
to waive the steep slope requirements. On September 11, Mr. Aslam acknowledged the Village's need
to apply the steep slope regulations consistently and requested that the Village provide cost sharing
for engaging with professional engineering firms to meet these requirements. On October 23, Mr.
Aslam spoke with Village Manager Kazenas and requested an appeal to the Village Council at the
November 5 Council meeting. Mr. Aslam's letter, and subsequent correspondence with Village
Manager Kazenas are included in Attachment 3.
Appeal
Mr. Rehan Aslam is appealing to the Village Council for a waiver of the steep slope permit requirements
associated with the work at his property. If a waiver cannot be granted, he further requests that the
Village share the cost of engaging the professional engineering firms needed to complete the
construction permit requirements.
RECOMMENDATION:
The Village Council will hear Mr. Aslam’s appeal and provide direction regarding the requested permit
waivers and alternative request for engineering cost sharing. The Village Council may reverse, affirm,
or modify the determination of the Director, or remand the determination back to the Director for
further consideration, with or without instructions.

slope area at 1207 White Bridge Lane and the property owner's subsequent request
for relief from the Village's steep slope requirements.
The report summarizes the history of the unpermitted work, staff's site inspections and
communications with the property owner, applicable permitting considerations, and the
current status of the matter.
BACKGROUND
On June 3, 2026, the Village Engineering Department was notified of potential
unpermitted construction activities within the steep slope area at 1207 White Bridge
Lane.
Engineering and Forestry staff conducted an initial site inspection and confirmed that
construction activities had occurred within the regulated steep slope area without the
required Village permits. The observed activities included earth excavation, clearing of
pathways, vegetation removal, and creation of a switchback pathway extending down
the slope toward Lake Michigan.
Following the initial inspection, the Community Development Department issued a
stop-work order to the property owner.
Since that time, Village staff from the Engineering, Forestry, and Community
Development Departments have conducted multiple meetings and communications
with the property owner to explain the applicable steep slope regulations, permitting
requirements, and necessary steps to address the unpermitted improvements.
On August 26, 2026, the Village received a written request from the property owner
seeking a waiver of the steep slope requirements associated with the previously
completed unpermitted work.

June 4, 2026 – Meeting with Property Owner
The Director of Engineering and a representative from the Forestry Division met with
the property owner at the site to discuss the observed construction activities and
explain the Village's steep slope regulations and permitting requirements.
3
During the meeting, the property owner indicated that the purpose of the work was to
establish a pathway to retrieve a large tree that had fallen on the property.
Staff explained that construction activities of this nature and extent within the regulated
steep slope area require appropriate engineering evaluation, plans, and Village
approvals before proceeding.
Staff also discussed the Village's tree protection requirements and encouraged the
property owner to engage qualified engineering and design professionals to assist with
preparing the necessary plans and permit application materials.
June 17, 2026 – Staff Meeting with Property Owner and Consultant
Representatives from the Engineering Department, Forestry Division, and Code
Enforcement met with the property owner and his consultant, Dan Creaney, to review
the applicable permit requirements and discuss the necessary steps for moving
forward.
During the site review, staff also observed that a large maple tree located near the rear
of the residence appeared to have been adversely affected by retaining wall
construction activities.
Forestry staff explained that any trees requiring removal would be subject to applicable
tree replacement requirements, including replacement plantings and associated
deposits.
The meeting provided an opportunity to further clarify the Village's requirements for
addressing the previously completed work and any proposed additional improvements.
July 1, 2026 – Additional Meeting Regarding Potential Driveway Improvements
At the property owner's request, the Assistant Village Engineer and Engineering staff
met with the homeowner to discuss potential future driveway improvements on the
property.
During the meeting, the property owner also raised concerns regarding observed
cracking in the foundation of his residence and questioned whether construction
activities at the neighboring property to the north may have contributed to the condition.
Staff did not offer an opinion regarding the cause of the reported foundation damage
and advised the property owner to consult a licensed structural engineer for an
independent evaluation.

August 10, 2026 – Follow-Up Meeting with Engineering Staff
At the property owner's request, the Director of Engineering and Engineering staff met
with the homeowner at the Village Yards facility to further discuss the history of the
project and the necessary steps to address the unpermitted work.
During the meeting, the property owner provided additional clarification regarding the
circumstances leading to the construction activities, reiterating that the work originated
from a large tree falling within the steep slope area.
The homeowner also confirmed that Greengard had been retained as the engineering
consultant for the project.
Staff reviewed the next steps and engineering design requirements necessary to
advance the permitting process. Staff explained that a coordinated project kickoff
meeting involving the Engineering Department, Community Development Department,
property owner, and the owner's design engineer would be required to review the
Steep Slope Ordinance, establish design expectations, and identify the necessary
permit submittals.
The meeting also included discussion of the property owner's Freedom of Information
Act (FOIA) request concerning construction activities at the neighboring property to the
north.
August 26, 2026 – Request for Waiver of Steep Slope Requirements
The Village received written correspondence from the property owner requesting a
waiver of the Village's steep slope requirements related to the previously completed
unpermitted construction activities.
The request was submitted following multiple meetings and discussions with Village
staff regarding the applicable regulatory requirements and procedures for addressing
the work.
CURRENT STATUS
Since the initial discovery of the unpermitted construction activities, staff from the
Engineering, Forestry, and Community Development Departments have continued
communicating and coordinating with the property owner regarding the steps
necessary to address the improvements within the regulated steep slope area.
To date, Village staff have explained the applicable ordinance requirements, identified
the need for professional engineering involvement, and outlined the process for
submitting the necessary plans and permit application materials.
5
The Engineering and Community Development Departments are currently awaiting
coordination from the property owner and his engineering design team to schedule a
joint kickoff meeting to review the project scope, applicable steep slope requirements,
and necessary engineering documentation.
Based on staff's observations, no additional construction activities have occurred within
the regulated steep slope area following issuance of the stop-work order.

Dear Ms. Kazenas,
Thank you for your thoughtful and thorough review of my letter, and for taking the time
to lay out the Village's reasoning in such detail. I also appreciate your kind words
regarding my recent travel.
While I am disappointed that the Village is unable to grant relief from the Steep Slope
and lakefront requirements at this time, I understand and respect the need to apply
these regulations consistently across all lakefront properties, and I do not take that
responsibility lightly given the historic character of my home and the sensitivity of the
bluff itself.
I want to reiterate that my primary goal throughout this process has been the protection
of my home and the long-term stability of the bluff. I remain fully committed to working
collaboratively with the Engineering Department to improve the bluff stabilization aligned
with the Village's requirements. Evidence of this is the completion of a topographical
survey as suggested by the Director of Engineering. In addition to the topographical
survey, a professional Bluff Improvement Plan will be completed. As advised, these
documents are perquisites for a construction permit application.
As I had mentioned in my appeal, if the extensive permit requirements can’t be waived,
can the village provide cost sharing for engaging the various professional engineering
firms needed for completing the construction permit requirements? Again, the basis for
this request will be the Stewardship of Historical Landmark Home and a Retired Senior
Page 97 of 110
Citizen with limited Income. If you believe this request is best addressed by the Village
Council, I will file a written request under Section 17.82.090 within the 35-day period. I
want to be clear that pursuing the appeal is not in place of continued cooperation with
staff — I see the two as running in parallel, and I remain hopeful that your office will be
able to approve the funding in principle.
Thank you again for your professionalism and for the Village's willingness to work with
me toward an approvable path forward.
Sincerely,
Rehan Aslam

Subject: RE: 1207 Whitebridge Hill Rd - Bluff Permit Appeal
Dear Mr. Aslam,
I hope your travel went well and that you have returned safely from your trip. Again, I am
sorry that the purpose of your travel was to visit a dying loved one and hope your visit
brought you and your loved one comfort.
Thank you for your August 25, 2026, letter requesting review and reconsideration of the
Village’s Steep Slope Ordinance requirements as they relate to work undertaken at your
property at 1207 Whitebridge Hill Road.
The Village appreciates the additional information you have provided regarding the
circumstances surrounding the work and your stated intent to stabilize the existing
retaining wall, protect your home, address erosion of the bluff, and provide access for
ongoing bluff maintenance. We also recognize and appreciate your willingness to work
with the Village and qualified professionals to address the engineering, drainage, and
safety considerations associated with the property.
In response to your request, the Village has carefully considered the information
presented in your letter and has reviewed the Director of Engineering’s determination
regarding the applicability of the Village’s Steep Slope Ordinance and associated
permitting requirements. We understand your position that the work was undertaken in
good faith for purposes of stabilization and preservation rather than as a traditional
development or expansion of the property. Nevertheless, following this additional
review, the Village is unable to approve your request for relief from the applicable
requirements at this time.
The Village Council adopted the Steep Slope and lakefront regulations in recognition of
the unique and sensitive conditions that exist along Winnetka’s lakefront bluffs. These
regulations are intended to help preserve and protect the bluffs, minimize erosion and
instability, manage drainage impacts, and ensure that work undertaken within these
environmentally and geotechnically sensitive areas is appropriately evaluated before
construction occurs. The permitting process, including the required professional
evaluations and supporting documentation, provides the Village with the information
necessary to understand how proposed work may affect not only an individual property,
but also the surrounding bluff system and neighboring properties.
The Village understands that the work at 1207 Whitebridge Hill Road was undertaken
with the good-faith intent of protecting the residence and addressing concerns regarding
bluff stability. However, the work performed falls within an area regulated by the
Village’s Steep Slope and lakefront ordinances and was undertaken without first
obtaining the required Village approvals. As a result, regardless of the intent behind the
improvements, the work does not presently comply with the applicable Village
requirements.
An important consideration in the Village’s review is the need to administer these
regulations consistently for all lakefront property owners. The Village recognizes that
individual circumstances can vary and that property owners may undertake work they
believe is necessary to protect their homes and property. At the same time, allowing
work subject to the ordinance to proceed or remain without the required technical review
and permitting could undermine the consistent application of the regulations and the
broader protections the Village Council intended when these requirements were
adopted.
This determination is not intended to minimize the concerns you have raised regarding
your home, the existing retaining system, bluff erosion, or the historic character of the
property. Rather, the Village believes that these circumstances reinforce the importance
of having the appropriate engineering, geotechnical, drainage, and other professional
information available so that the existing conditions and proposed improvements can be
properly evaluated and an appropriate restoration plan can be developed.
Moving forward, the Village strongly encourages you and your professional consultants
to continue working closely and collaboratively with the Village’s Engineering
Page 100 of 110
Department on the development of a final restoration plan for the property. The Village
believes this represents the most productive path toward addressing the existing
conditions while ensuring that the proposed restoration efforts are consistent with the
requirements established to protect the bluff.
The Engineering Department is prepared to assist you and your consultants throughout
this process by providing guidance regarding the information and documentation
necessary for review and by identifying and addressing potential issues as the
restoration plan is developed. Continued coordination during the preparation of the plan
should help minimize unnecessary delays and allow the Engineering Department to
expedite its review and approval to the extent reasonably possible once the necessary
information has been submitted.
The Village recognizes the importance of moving this process forward in a timely
manner. Our goal is not to unnecessarily delay restoration of the property, but rather to
ensure that the proposed work is appropriately designed and evaluated so that critical
restoration efforts can begin as quickly as reasonably possible while protecting the longterm stability and integrity of the bluff.
While the Village therefore cannot approve the requested relief from the applicable
Steep Slope and lakefront requirements at this time, staff remains committed to working
collaboratively with you toward an approvable restoration plan. We believe that
continued coordination between you, your professional consultants, and the
Engineering Department provides the best opportunity to efficiently resolve the
outstanding permitting issues and advance the restoration work necessary to protect
both your property and the bluff.
We appreciate your stewardship of your property and your willingness to continue
working with the Village. Our shared objective is to protect your property while also
preserving the stability and integrity of Winnetka’s lakefront bluffs and ensuring that the
regulations established for that purpose are applied fairly and consistently throughout
the community.
Pursuant to Section 17.82.090 of the Village Code, you may appeal this decision to the
Village Council by filing a request for review in writing within 35 days of today’s date.

Re: Request for Review and Appeal Pursuant to Section 17.82.090 — 1207
Whitebridge Hill Road
Dear Ms. Kazenas:
Thank you for your letter regarding my request for relief from the Village’s Steep
Slope Ordinance requirements concerning work undertaken at my property at
1207 Whitebridge Hill Road.
I am submitting this letter as my formal written request for review and appeal
pursuant to Section 17.82.090 of the Village Code, within the time period identified
in your letter. I request that you kindly review the determination of the Director of
Engineering and reconsider the requirement that the work be treated in the same
manner as ordinary development on the bluff.
My principal concern is that the purpose of the work undertaken was urgent and
twofold:
1. To immediately stabilize and strengthen the portion of the existing retaining
wall supporting soil adjacent to the foundation of the home. The purpose
was not to create a new structure, expand the property, or undertake
discretionary development. The objective was to protect the existing home
and prevent further loss or movement of supporting soil.
2. To build an access from the extended retaining wall to a walkable path to
transport soil to repair bluff erosion caused by a large uprooted tree and
bluff construction on adjacent property (1215 Whitebridge Hill Road) i.e.
Forty-foot-long steel H-piles were mechanically driven into the bluff,
causing intense vibration and soil movement in the surrounding area. In
the long term, the bench cut path is to further strengthen the bluff stability
and allow easier ongoing maintenance of bluff vegetation.
I recognize that the property is located within the bluff and steep-slope area and
that Chapter 17.82 establishes requirements for work in that area. I also recognize
the Village’s legitimate interest in ensuring that work on the bluff is properly
evaluated from an engineering, drainage, and safety standpoint.
However, I respectfully request that the Village distinguish between ordinary
development activity and emergency stabilization/preservation work necessary to
protect an existing home.
Request for Emergency Stabilization Consideration
Respectfully, I request that the Village reconsider the determination and allow the
necessary stabilization work to proceed under an emergency repair pursuant to
Section 17.82.070(D).
The existing retaining system serves an important structural and protective
function. Further deterioration or movement could result in additional loss of soil,
increased bluff erosion, and potentially greater risk to the foundation and
structural integrity of the home.
Delaying stabilization while requiring completion of every prerequisite normally
associated with a new development permit could potentially increase the very
risk that the regulations are intended to prevent.
I am not asking the Village to disregard engineering or safety requirements. To
the contrary, I am willing to have the work evaluated and documented by qualified
professionals and to comply with reasonable conditions imposed by the Village.
Alternative Relief if a Waiver Cannot Be Granted
I am a retired senior citizen with limited financial resources. My house is my life
savings. Costly professional studies to fulfill ordinary permit requirements will
cause a significant financial hardship. I would like to request that the professional
studies for the permit be limited to what is essential for addressing emergency
stabilization, rather than treating the work as new development.
If the professional studies and assessments required for the permit cannot be
waived, I would request that the Village consider whether it can provide permit fee
relief, financial assistance, reimbursement, or other available assistance with the
following technical work necessary to satisfy the permit requirements:
•
Topographical survey;
•
Soil/geotechnical analysis;
•
Structural engineering evaluation and design of the retaining wall;
•
Bluff drainage and water-management design; and
•
Any other professional studies determined by the Village to be necessary.
These requirements represent a substantial expense, potentially exceeding the
cost of the stabilization work itself, particularly when the purpose of the work is
preservation and protection of an existing residence rather than new
development.
Historic Landmark Consideration
I further respectfully request that the Village consider the property’s status as a
certified Historic Landmark home when evaluating the permit waiver and/or
alternative financial relief.
The preservation of the historic residence is directly related to the need to
stabilize the surrounding soil and strengthen bluff stability. Prompt stabilization
is therefore not simply a property improvement; it is a measure intended to
protect an existing historic structure.
I believe this circumstance warrants consideration of a practical solution that
allows the necessary stabilization to occur while still providing the Village with
appropriate engineering oversight and documentation.
Request for Audience with you and the Village Council
I respectfully request an opportunity to meet with you. Specifically, I ask that your
office consider the following:
1. Treating the necessary retaining-wall stabilization (extension) as
emergency repair work;
2. Waiving or modifying applicable steep-slope requirements to the extent
legally permissible;
3. Allowing necessary walkable path refinement while engineering and other
documentation is being completed, subject to appropriate Village
oversight; and
4. Providing or identifying available financial assistance, fee waivers,
reimbursement, or other funding mechanisms for the required survey, soil
analysis, structural engineering, and bluff-drainage work.
I fully appreciate the Village’s responsibility to protect the bluff, neighboring
properties, and public safety. The goal of my project is fully aligned with the same
objectives while protecting my home, a historic property, from further
deterioration.
I respectfully ask that the Village reconsider the Director of Engineering’s
determination in light of the emergency stabilization and preservation aim of the
Page 107 of 110
work, and provide a reasonable mechanism and time for addressing the
immediate structural and soil-stability concerns.
I would appreciate the opportunity to meet with you and the Village Council to
gain support for my stewardship of a Historic Landmark home recognized by the
Village of Winnetka and the State of Illinois.
Thank you for your consideration
Respectfully,

Dear Mr. Aslam,
I am in receipt of your letter requesting the Village Council to consider a waiver of the
Village’s Steep Slope Ordinance regulations related to the development work that you
have undertaken without a permit on your property located at 1207 Whitebridge Hill
Road.
The work on your property is within the bluff and the steep slope zone and is therefore
subject to the steep slope regulations set forth in Chapter 17.82 of the Village Code.
These regulations set forth reasonable development guidelines that require review and
approval by the Village in advance of any work to ensure that construction on the bluff
complies with the applicable regulations.
As you know, the Village’s Director of Engineering issued a stop work order on June 3,
2026, after he determined that you needed a permit to complete the work and that the
work did not comply with the Village’s steep slope regulations. Pursuant to Section
17.82.090 of the Village Code, any determination of the Director may be appealed by
the applicant to the Village Manager by filing a request for review in writing within 35
days after the Director issues his determination. Notwithstanding the 35-day timeline,
you may submit a written request for review to me on or before August 27, 2026, setting
forth the reasons for your appeal.
