PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM
What is the Housing Incentives Program?
•
The City of Siloam Springs Housing
Incentive Program (HIP) aims to
increase housing options for are
currently underrepresented in the
community.
•
City staff started working on this
program in early 2026, as an elective
program to address this issue and the
larger housing/affordability crisis that is
impacted the U.S.
•
The HIP is not a “by right” program, but
an elective reimbursement or Code
relief program based on eligibility
standards through a voluntary
application and case-by-case reviews.
•
The HIP only applies to certain
designated housing types.
PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM
The Housing Issue
•
The City of Siloam Springs has
experienced rapid growth in recent
years, growing at approximately a
three percent (3 percent) rate
annually in 2023-2024.
•
With the growth certain housing types
have not kept pace for the needed
demand.
•
In addition, seniors wanting to
downsize their home are having a
difficulties finding communities to
cater to their needs and, in some
cases, competing with first time home
buyers to purchase a new, smaller
home.
•
Staff has observed that long time
community residents have had to
leave Siloam Springs for the housing
they desire.

Needed Housing Type Gaps
• Senior housing for age 55+ remains a key need, the HIP intends to incentives this type of development.
• Another area identified is housing for executives when potential business headquarters or skilled industry desires
to locate to the community. The lack of this housing can harm existing and potential economic growth.
PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM
Needed Housing Type Gaps
• Infill housing fills in the undeveloped gaps in existing
neighborhoods.
• Conservation developments seek to preserve natural spaces by
clustering housing to one part of the project site to preserve
environmentally sensitive areas.
PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM
Needed Housing Type Gaps
•
•
Multifamily is a need when oriented towards age 55+ with an added density of 2 units beyond 16 units per acre & ADA accessible units.
Elderly assisted living, which is not the same as age 55+ housing, allows for greater assistance and services for the elderly, but is not skilled 24hour nursing care.
PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM
Needed Housing Type Gaps
• Missing middle references to housing types that are not single-family detached housing or multifamily, but the
transition space between these two extreme densities, e.g., fourplex, live-work, mixed uses, etc.
• Encourages a gradual transition from low to high density, with education of land use conflicts.
PLANNING COMMISSION
AGENDA ITEM F. HOUSING INCENTIVES PROGRAM

Finance Department Budget Review – Christina Petriches
Overview
Christina Petriches, Finance Director/Treasurer, announced the workshop would cover three main
items:
1. District Court Budget
2. Finance Department Budget
3. Electric Department Budget
She outlined the evening’s agenda before beginning her presentation.
District Court Budget Summary
Christina explained several recent state law changes affecting the District Court:
• The City is no longer required to contribute to the judge’s salary.
• The state now caps the percentage of court fees the City can retain at 50%.
• Installment plan fees are also capped.
• Intergovernmental revenue reimbursements have declined due to court clerk administration
changes.
2027 Projections:
•
•
•
•
Revenues remain constrained by state-mandated caps.
Personnel costs increase due to healthcare.
Operations costs decrease due to the City no longer contributing to judicial salaries.
No capital requests for 2027.
She emphasized that the City has very limited influence over District Court revenues or expenditures
due to statutory control.
Finance Department: 2026 Review & 2027 Goals
2026 Accomplishments & Challenges
Christina reviewed major challenges the Finance and IT staff navigated:
• A BS&A conversion failure.
• City Hall remediation and the associated IT complications.
• A state-mandated server platform migration.
• Significant infrastructure and financial initiatives such as the Headworks project and rate
study.
• Creation of a mobile workstation to support meetings held outside the boardroom.
2027 goals
•
•
•
•
•
•
Transition vendor payments to electronic funds transfers to increase efficiency and security.
Create a citywide Capital Improvement Plan for the 2028 budget cycle.
Evaluate AI solutions, including a secure, in-house large language model.
Establish a replacement schedule for mobile devices citywide.
Evaluate applying for GFOA recognition for financial reporting and potentially hiring a
financial advisor to support capital planning.
Centralize IT purchasing, access management, and major procurement functions.
Board Discussion – Questions & Concerns
A lengthy, substantive discussion followed. Key issues raised:
GFOA certification costs
Directors questioned:
•
•
•
Why the City should spend $20k the first year and $10–15k annually thereafter.
Whether additional audit pages (approx. 65) were necessary given the City's history of clean
audits.
Whether free audits offered by AML or the State should be considered instead.
Vehicle requests
•
•
•
•
•
IT currently shares a small fleet and has difficulty responding to multiple locations
simultaneously.
Directors questioned whether a second IT vehicle is justified or whether staff should claim
mileage instead.
Discussion included electric or hybrid vehicle alternatives.
The former City Administrator’s Tahoe was suggested as an interim option.
Kevin Yang (IT Engineer) provided details on vehicle needs and cost limitations for fully
electric options.
Inventory Warehouse Structure
•
•
•
Some Directors argued that electric and water inventory should sit under the Electric
Department, not Finance.
Christina noted that inventory was placed under Finance years ago by a previous
administrator and has remained there.
Directors expressed concern about efficiency, chain of command, and department autonomy.
Personnel Reassignments
•
A Planning Department administrative assistant was moved into Finance, prompting
concerns about internal recruitment policies and departmental disruption.
IT Infrastructure Costs
•
•
Increased hardware prices were attributed to global competition for servers driven by AI
industry demand.
One virtual machine host rose in cost by 43%, reducing the number the City could afford to
replace.
Capital Requests & Operational Costs
Christina highlighted:
• 10% increases in software renewals ($72,000).
• A $32,000 increase in postage due to stamp cost increases and residents opting out of
e-billing.
• Additional professional service costs tied to financial reporting certification and financial
advisory services.
• Two vehicle capital requests: one for IT and one replacement truck for the inventory
warehouse.
• Slight decreases in capital overall due to previous year’s migration expenses.
Electric Department Budget Review
Phil Stokes, Electric Department Director
Service Territory & Boundary Updates
Phil explained that:
• The City's electric territory, originally established in 1939, had long-standing encroachments
from Carroll Electric.
• After years of negotiation, the Corporation Commission approved a boundary settlement
involving a swap of ten customers each.
• This new mapping provides accurate, enforceable service boundaries and prevents future
disputes.
Key staff involved included Christina Petriches; Jason Carter, City Attorney; and Electric Department
personnel.
System Capacity & Reliability
Phil outlined the City's electrical capacity:
• The city has 280 MW of available supply from GRDA.
• Current peak demand is 75 MW.
• Projected growth of 3% annually would place demand at ~100 MW in ten years, still far
below available capacity.
Despite this, Phil noted growing nationwide grid instability due to:
• Retirement of coal and nuclear plants (loss of system “spinning mass”).
• Variability of solar and hydro resources.
Directors expressed relief at learning the City is not at risk of brownouts and praised Electric Staff for
high reliability and rapid response.
Future Power Generation Options
Directors asked about:
• Possible solar installations (e.g., on the wastewater pond).
• Battery storage: Phil noted costs of $8–10 million per battery bank.
• Gasification as a long-term option.
• Small scale nuclear (“modular”) generation, GRDA is evaluating it with Nebraska partners.
Substation Overview
Phil reviewed each of the four substations:
Lincoln Substation
•
•
Heavily loaded; limited expansion due to surrounding development.
Supports Simmons Foods and nearby areas.
Southwest Substation
•
•
Supports John Brown University.
Similar space constraints.
Country Club Substation
•
•
•
Large area with room to expand.
Contains a spare transformer previously purchased for growth and backup.
$500,000 requested for steel and plumbing work to place the transformer into service.
Moss Substation
•
•
Two transformers replaced following a lightning strike.
Land is needed to build additional feeders to meet east-side growth.
•
A concrete pad has already been poured for a future transformer.
Phil noted that transformers now cost $1.67 million and have 14-month delivery times.
Economic Development Load Opportunities
Phil described interest from two major customers:
Customer A (near Country Club Substation)
•
•
•
Would require significant power but use no water or sewer.
Would pay for their own transformer and infrastructure.
Estimated $400,000+ net monthly revenue to the City.
Customer B (Syroco building area)
•
•
•
Requested 40 MW load.
Expected $1 million in net monthly electric revenue.
Would fund all infrastructure needed.
Directors were surprised at the scale of possible revenue and discussed long-term implications for
tax and fee reductions.
Future Capital & System Needs
Phil listed several future needs:
• Additional circuit switchers, currently no spares.
• Upgrading transmission lines between GRDA substations to unlock “stranded capacity”
limited by wire size.
• A new substation near the airport area to support long-term growth.
• Replacement of approximately 500 failing poles identified during a recent inspection.
• Modernization of traffic signals and addition of intersection battery backups.
• Continued undergrounding of key lines despite high costs.
Additional Board Discussion
Other topics included:
• Whether electric inventory should return to the Electric Department. Phil expressed flexibility
and confidence regardless of structure.
• Clarification that streetlights and traffic signals fall under Electric’s responsibility.
• Lifespan of poles (typically 30–40 years depending on treatment).
• Directors emphasized that if “it isn’t broken,” reorganization should be minimal.
Adjournment
The workshop adjourned at approximately 6:30 PM, with the regular Board meeting scheduled to
begin immediately afterward.

Grant Acceptance / Grand River Dam Authority / Parks & Recreation / $23,140.71
Recommendation: Grant Acceptance from Grand River Dam Authority for Parks and Recreation in the
amount of $23,140.71.
Background: The Grand River Dam Authority (GRDA) offers a sponsorship program to support
economic and community development initiatives in the cities it serves. The City participates in this
program annually and has been awarded $23,140.71 in sponsorship funds for the current year.
Staff has determined that the most beneficial use of these funds is to upgrade the lighting fixtures at the
Aquatic Center and the outdoor basketball courts at Bob Henry Park. The estimated cost of the lighting
upgrades is $13,784.35 for the Aquatic Center and $9,356.36 for the basketball courts, for a total project
cost of $23,140.71.
Fiscal Impact: The City will use the $23,140.71 in GRDA sponsorship funds to cover the costs of the
proposed lighting upgrades. These expenditures will be incorporated into the 2026 budget amendment
for the Electric Department.
Reviews:
Finance: Finance has reviewed the fiscal impact statement provided and concurs with its assessment as of
10/27/2026.

Ordinance 26-21 / Amending Section 35-185 of the City Municipal Code / Rezoning from PDL to R-5 / 700 Block of AR HWY. 16
Staff Findings: The proposed rezoning aligns with the guidance of the future land use map and City
Code. Potential Motion. Place Ordinance No. 26-21 on its _____ (1st) reading,
suspending the rules and reading by title only.
Background: The applicant, Calara Land, LLC., desires to rezone property at the 700 block of AR
HWY. 16, consisting of approximately 13.34 acres, from the P-DL District (Planned development
legacy) to the R-5 District (Townhomes). The Planning Commission reviewed the rezoning application
at the September 8, 2026, regular meeting.
At the Planning Commission meeting there was a question regarding the area of the original Planned
Development and another question regarding density from the public. The Commission and Staff
addressed both questions.
The Commission forwarded the request for the rezoning permit to the Board of Directors with a
recommendation for approval with a 6-0 vote (Olson was not present).
According to Title 3 of Code Chapter 35, a rezoning development permit shall only be authorized when
the applicant has convincingly demonstrated that the proposed zoning:
(a) Will not substantially interfere with other owners’ reasonable peace and enjoyment of
their neighboring properties;
(b) Will not substantially damage any property value in the neighborhood;
(c) Will be compatible with and respect the context of its location and the character of the
surrounding existing neighborhoods;
(d) Will not, whether by the nature of the allowed uses in the proposed zone, or by the
allowed siting, height, or design of structures or landscaping in the proposed zone, tend to
burden the present or future use of neighboring properties in accordance with current
zoning standards;
(e) Is adequately supported by infrastructure, including without limitation, streets, and
parking; and
(f) Compared to present zoning of the property, is equally or more consistent with public
health, safety, and convenience within the neighborhood.
Please consult the staff report to the Planning Commission for the analysis and findings on these criteria.
Fiscal Impact: No fiscal impact is anticipated.
Reviews:
Legal: Legal counsel has reviewed and approved this document as of 9/11/2026.
Finance: Finance has reviewed the fiscal impact and is in support of the agreement and funding
commitments as of 9/11/2026.

Section B: Site Analysis
B-1) PROJECT ANALYSIS AND APPROVAL CRITERIA
I.
The following criteria are shown to indicate if this proposal meets the minimum
criteria for approval. Criteria I-II is a subsection of Sec. 35-194 of the Municipal
Code; Criteria III is Sec. 35-50 in the same Code.
II.
ZONING USE UNIT CONSISTENCY: R-5 (Townhomes)
(a) Purpose
The district is established to protect the enjoyment, privacy, and value of residential
townhomes.
(b) Planned uses
Use Unit 6 (Townhome dwelling), with the exception of a single accessory dwelling
unit (ADU) if applicable.
(c) Special uses
The proposed use is a planned use, the following are the special uses: Units 5
(Multifamily dwelling), 9 (Small office), and 14 (Small institution).
III.
LOT STANDARDS CONSISTENCY
The minimum R-5 zone standards are compared with the subject property below.
1
MINIMUM (R-5) ZONING
REQUIREMENTS
Lot Area: 2,500 sq. ft.
Lot Width: 20 ft.
Maximum Lot Coverage: 80%
Maximum Density 16 Units per acre (208
Units)
SUBJECT PROPERTY PROPOSAL
581,117.00 sq. ft. or 13.34 acres
Approx. 586 ft.
Approx. 0.00%
N/A1
Due to Development requirements such as adequate infrastructure, additional zoning requirements
that are triggered after 4 units per acre, and factors unique to the site, the final unit count will likely be
less than is shown in the table above.
9/8/26 P.N. 03-07538-000; RZ26-08

IV.
PLANNING PERMIT CODE REQUIREMENTS
According to Title 3 of Chapter 35 of the City’s Code, a rezoning development permit
shall only be authorized when the applicant has convincingly demonstrated that the
proposed zoning:
(a) Will not substantially interfere with other owners’ reasonable peace and
enjoyment of their neighboring properties:
City staff is aware of no evidence that the proposed rezoning for single-family
townhome use will cause a consistent disturbance to the peace and enjoyment
of the neighboring properties. Additionally, the density cannot exceed 16
dwelling units per acre by Code. Further, if four or more dwelling units exist
on this lot or lots created by any development at this location, they will be
subject to landscape buffer requirements. This would ideally offer adequate
buffering and protection to the existing and potential future neighboring
properties that are residential in nature to the south as well as the existing
multifamily to the north. Enforcement of the City Code’s nuisance chapter will
ensure that excessive noise, or unsightly debris, etc. is mitigated. These rules
ensure that the proposal will not inherently decrease the quality-of-life
standards already in place across the City.
(b) Will not substantially damage any property value in the neighborhood:
There is no evidence to suggest whether this request, if approved, would
damage property value in the neighborhood.
(c) Will be compatible with and respect the context of its location and the character
of the surrounding existing neighborhoods:
The proposed zoning is of similar use classes and is compatible with the vast
majority of the existing residential uses in the neighborhood as well as the
higher intensity commercial uses abutting and near the subject location.
(d) Will not, whether by the nature of the allowed uses in the proposed zone, or by
the allowed siting, height, or design of structures or landscaping in the proposed
zone, tend to burden the present or future use of neighboring properties in
accordance with current zoning standards:
Townhome uses in this area are not anticipated to burden the present or future
uses of neighboring properties due to the proposed use having requirements
built into the Zoning Code that account for additional setbacks once height is
beyond 30 feet (no building can exceed 35 feet) and open space requirements
tied to density should a development proposal occur at such a level that 16 or
more dwelling units per acre will trigger open space and landscape buffer
requirements designed to mitigate adverse impact. Additionally, besides the
south portion of this parcel, all other sides are abutted by existing uses of equal
or greater intensity than what this zoning would allow.
9/8/26 P.N. 03-07538-000; RZ26-08
5
(e) Is adequately supported by infrastructure, including without limitation, streets and
parking:
Water System
There is an existing 8” water main that runs on the south side of the property,
that extends east of the subject property. There is a second 6” water main that
runs on the east side of AR 16 Hwy to the north. Staff finds this existing
infrastructure to be adequate for fire and projected water needs. Extensions of
public water system to serve the development shall be the responsibility of the
owner/developer.
Sewer System
There is an existing 8” sewer main that stubs into the southwest corner of the
property. Staff finds this existing infrastructure to be adequate for wastewater
needs. Extensions of public sewer system to serve the development shall be the
responsibility of the owner/developer.
Storm Drian System
An existing detention basin is shown on the west side of the development.
Staff will evaluate the pond and extensions of the drainage collection system
for the anticipated stormwater discharged associated with development of the
subject property to its full zoning potential. Extensions of public storm drain to
serve the development shall be the responsibility of the owner/developer.
(f) Compared to present zoning of the property, is equally or more consistent with
public health, safety, and convenience within the neighborhood:
Nothing in the proposed rezoning appears to inhibit or harm the general public
health, safety, and convenience within the neighborhood.
9/8/26 P.N. 03-07538-000; RZ26-08
6
B-2)
COMPREHENSIVE PLAN CONSISTENCY
The 2040 future land use map describes the subject property as Neighborhoods 2. The
proposed R-5 zone is consistent with the designation as townhomes are considered
“very appropriate” for said designation.
Figure B-2 (1) Future Land Use Map

STAFF ANALYSIS
General Summary
The applicant is requesting to rezone a parcel at
Key Points:
the 700 block of S. AR HWY. 16, a currently

vacant site. The rezoning was prompted by the
• Consistent with the land
applicant’s request to develop single family
use plan
townhomes as opposed to multifamily, which
• Assists with housing needs
the existing Planned development legacy calls
for.
The rezoning meets the minimum lot requirements (see above). The future land use map
calls for multiple residential uses in this area and considers townhomes “very
appropriate”.
9/8/26 P.N. 03-07538-000; RZ26-08
7
The request is a downzone from the original approved Planned Development, which
called for approximately 228 multifamily units on this lot in terms of intensity related to
allowed density, which the applicant states in their letter intent would cause the unit
count to drop by approximately 200 units.
Existing and Future Land Uses
Currently the site is vacant.
The letter of intent states that the applicant wishes to develop single family townhomes.
Neighborhood Context and Compatibility
This proposal is consistent with the context and compatibility with the neighborhood as it
is abutted to the north by equal or greater commercial and residential land uses, existing
multifamily to the east, existing commercial to the west, and small-lot single-family to
the south. With proper buffering and landscaping, which would be required if the
proposal were approved and subsequent development were to occur as well as taking into
account the original entitlements that would have allowed them to propose constructing
multifamily at a greater level of intensity than what they can achieve under the R-5
zoning district, this meets the context and compatibility of the neighborhood.
Conditions and Staff Conclusions
This proposal is consistent with the Future Land Use Map.
There is an existing residential multifamily development of equal or greater intensity near
or abutting the subject property to the north.
All Code requirements must be followed – which decreases the total available area of
development in relation to the overall size of the site as it currently sits while vacant.
Additionally, some interior space will likely have to feature drainage mitigation
measures, infrastructure, etc. which are important to factor in as opposed to merely using
acreage vs. lots as a calculation of available housing density.
The City Engineer has reviewed this proposal including the potential density and does not
have a traffic concern at this time.
Fiscal Impact:
Staff is not aware of any fiscal impact at this time.

Ordinance 26-21 / Amending Section 35-185 of the City Municipal Code /
Rezoning from P-DL / 700 Block of AR HWY. 16
Staff Review
•
The applicant desires to rezone a lot consisting of approximately 13.34
acres, from P-DL (Planned development legacy) to R-5 (Townhomes).
•
No Future Land Use Map amendment is necessary as this is already
designated as “Neighborhoods 2”.
•
The R-5 zoning district use of “Townhome” is considered “very
appropriate” under the current Future Land Use Map designation.
•
Based on the letter of intent, the applicant is proposing townhomes at this
location.
•
The neighborhood primarily functions as an existing residential area that
features a mix of single-family surrounding the property to the west, south,
and east, and a mixed zoned site of G-I and R-2 to the north.
This is a summary only and does not replace any requirements listed within the full
staff report.

•
The applicant has expressed their desire to develop single-family
townhomes at this site as opposed to the 285 apartment units that the P-DL
originally called for based on their Letter of Intent. Further, they have
stated that, if approved, the zoning would decrease the density by
approximately 200 units.
•
The site is currently vacant, the aerial photo to the left shows units that no
longer exist.
•
The neighborhood primarily functions as an emerging residential area that
features mostly single-family dwellings surrounding the property to the
north and east, a place of worship to the west, and unincorporated Benton
County to the south with a mix of vacant property and an existing auto
salvage yard.
This is a summary only and does not replace any requirements listed within the full

Staff Findings: The proposed rezoning aligns with the guidance of the future land use map and City
Code. Potential Motion. Place Ordinance No. 26-22 on its _____ (1st) reading,
suspending the rules and reading by title only.
Background: The applicant, Springs Church of Christ, LLC., desires to rezone property at 2703 E.
Kenwood St., consisting of approximately 1.32 acres, from the G-I District (General Institutional) to the
R-5 District (Townhomes). The Planning Commission reviewed the rezoning application at the
September 8, 2026, regular meeting.
At the Planning Commission two members of Springs Church of Christ spoke in favor of the request.
Since the meeting, staff have received four calls inquiring about the request.
(a) Will not substantially interfere with other owners’ reasonable peace and enjoyment of
their neighboring properties;
(b) Will not substantially damage any property value in the neighborhood;
(c) Will be compatible with and respect the context of its location and the character of the
surrounding existing neighborhoods;
(d) Will not, whether by the nature of the allowed uses in the proposed zone, or by the
allowed siting, height, or design of structures or landscaping in the proposed zone, tend to
burden the present or future use of neighboring properties in accordance with current
zoning standards;

MINIMUM (R-5) ZONING
REQUIREMENTS
Lot Area: 2,500 sq. ft.
Lot Width: 20 ft.
Maximum Lot Coverage: 80%
Maximum Density 16 Units per acre (16
units)1

SUBJECT PROPERTY PROPOSAL
57499.20 sq. ft. or 1.32 acres
Approx. 230.00 ft.

Due to Development requirements such as adequate infrastructure, additional zoning requirements
that are triggered after 4 units per acre, and factors unique to the site, the final unit count would
likely be less than is shown in the calculation above.

City staff has concerns that the proposed zoning designation at the subject
location may not be conducive with other owners’ reasonable peace and
enjoyment based on a previous Special Use Development Permit to allow
multifamily as a use at the same site that was denied by the Board of Directors
but there is no conclusive evidence at this time based on the proposal at hand to
determine whether or not this could or would come to fruition if the request
were to be approved as it is a rezoning request. If approved, would still be
subject to enforcement of the City Code’s nuisance chapter, which would likely
ensure that excessive noise, unsightly debris, etc. would be mitigated. In sum, it
is impossible at this time to make a determination as to whether or not this
proposal would interfere with other owners’ reasonable peace and enjoyment
of their neighboring properties, but it should be carefully considered based on
the existing surrounding character and context, as well as the entitlements that
(b) Will not substantially damage any property value in the neighborhood:
There is no evidence to suggest whether this request, if approved, would
damage property value in the neighborhood.
(c) Will be compatible with and respect the context of its location and the character
of the surrounding existing neighborhoods:
The subject property is surrounded on two sides by residential single-family
zoned districts and dwelling units that are already built and in existence to the
north and east, a place of worship to the west, and mostly unincorporated,
undeveloped land to the south with a small portion of the south being an autosalvage yard that has existed for years (also, not within the City limits). The
Letter of Intent provided by the applicant states that, if possible, they intend to
place as many as 10-12 dwelling units at this location were the rezoning
request and any subsequent permitting requirements approved and this should
be carefully considered given the small size of the parcel in relation to the
proximity to the adjacent single-family dwellings that are already in existence.
This should be considered when evaluating the proposal. Finally, a Special
Use Permit requesting multi-family housing was heard by the Board of
Directors at the December 17, 2024, Board of Directors meeting under
proposed Resolution Number 57-24, and failed with a 5-1 vote on its first
reading (minutes are attached with this staff report).
5
9/8/26 P.N. 03-07890-000; RZ26-06
(d) Will not, whether by the nature of the allowed uses in the proposed zone, or by
the allowed siting, height, or design of structures or landscaping in the proposed
zone, tend to burden the present or future use of neighboring properties in
accordance with current zoning standards:
The proposed zoning of R-5 at the subject location would actually lower the
maximum allowable height (which under G-I, after meeting additional setback
requirements once the 50-foot mark is reached) from potentially 72 feet in the
G-I district, to a maximum allowable height of 35-feet under R-5 (which has
additional setback requirements after the 30-foot height mark is reached).
Additionally, the current G-I zoning potentially allows for additional nonresidential uses by-right if Code requirements can be met that would either not
be allowed under R-5 or would require an approved Special Use Development
Permit. Additionally, the R-5 zoning would require landscape buffering,
opaque screening, and minimum open space requirements to be met that would
be triggered on this lot were four or more dwelling units to be developed that
might lessen any potential burden on the present or future use of the
neighboring properties in relation to the current G-I zoning.
(e) Is adequately supported by infrastructure, including without limitation, streets and
parking:
Water System
There is an existing 8” water main that runs along the west side of Arkansas 16
Hwy. Also, there is a second 8” water main that runs along the east side of
Arkansas 16 Hwy and terminates at the southwest corner of the subject parcel
(03-00003-000). Staff finds this existing infrastructure to be adequate for fire
and projected water needs pending the exact layout and additional connections
that may be required to provide redundant connections to the water system.
Any extensions of the existing water system shall be at the cost of the
owner/developer.
Public Sewer System
There is an existing 10” sewer main that runs parallel to the east side of the
subject parcel (03-04344-012), and an 8” sewer main that runs along the north
side of the parcels. Staff finds this existing infrastructure to be adequate for
wastewater needs. Any extensions of the existing sewer system shall be at the
cost of the owner/developer.
Storm Drain System
The property generally drains from southwest to northeast. Exact layouts for
drainage and detention systems are preliminary at this point. Final designs for
drainage conveyance and detention shall comply with the City of Siloam
Springs Drainage Criteria Manual.
(f) Compared to present zoning of the property, is equally or more consistent with
public health, safety, and convenience within the neighborhood:
Nothing in the proposed rezoning appears to inhibit or harm the general public
health, safety, and convenience within the neighborhood.

B-2)
COMPREHENSIVE PLAN CONSISTENCY
The 2040 future land use map describes the subject property as Neighborhoods 2. The
proposed R-5 zone is consistent with the designation as townhomes are considered
“very appropriate” for said designation.

STAFF ANALYSIS
General Summary
The applicant is requesting to rezone one lot at
2703 E. Kenwood St., a currently vacant site.
The rezoning was prompted by the applicant’s
request to acquire the necessary zoning to
develop single-family attached townhomes
based on their letter of intent.
The rezoning meets the minimum lot
requirements (see above). The future land use
map calls for multiple residential uses in this
area and considers townhomes “very
appropriate”.
Key Points:
• Lots comply with zoning
• Consistent with the land
use plan
• May lower potential for
intensity of allowed uses
due to lot size
• Compatibility, past site
history, and context are
major focal points related
to this request
Existing and Future Land Uses
Currently the site is vacant.
The letter of intent states that the applicant wishes to develop attached townhomes on a
single lot without any subsequent subdivision of land.
Neighborhood Context and Compatibility
This proposal may not be consistent with the context and compatibility with the
neighborhood as it is abutted to the north by equal or lesser residential land uses, smalllot single family residential development immediately to the east, mostly vacant county
land to the south, and a and an existing place of worship on the parcel to the immediate
west.
Conditions and Staff Conclusions
This proposal is consistent with the Future Land Use Map.
There are no residential areas abutting the property that are of equal or greater intensity –
they are all of lower intensity or General Institutional for limited use for a place of
worship, or unincorporated land to the south across E. Kenwood St. currently located in
Benton County that is all designated as “Neighborhoods 1” on the Future Land Use Map,
which lends to it being planned for lower-intensity residential development in the future.
A similar Special Use Development Permit requesting multi-family housing was heard by
the Board of Directors at the December 17, 2024, Board of Directors meeting under
proposed Resolution Number 57-24, and failed with a 5-1 vote on its first reading
(minutes are attached with this staff report).
All Code requirements must be followed – which might result in a net decrease of the
total amount of units.
Fiscal Impact:
Staff is not aware of any fiscal impact currently.

RE:
Rezoning Application
2703 East Kenwood Street
Mr. Belt,
On behalf of our client we have prepared application materials to rezone Benton County
Parcel 03-07889-000.
The property is designated as Lot 2 of the East Kenwood Place Subdivision as shown on
a lot split plat recorded as file number L202551081 in the Benton County records. The
property includes 1.32 acres along the north side of East Kenwood Street located
approximately 350 feet east of Arkansas State Highway 16 and approximately 150 feet
west of Lewis Circle.
The property is currently in the G-1 (General Institutional) zoning district, and is owned by
Springs Church of Christ, LLC, which also owns the adjacent property to the west of the
subject property. We request the property be rezoned to the R-5 (Townhomes) district.
The intent of the rezoning is to allow for future residential development of the property by
Summer Properties, LLC, which has the property under contract to purchase following the
rezoning. The buyer/developer had a pre-application meeting with Siloam Springs
planning staff on May 4 to discuss their plans and options for the proposed project.
Applicant is requesting to rezone to the R-5 district because it will accommodate the
proposed development they intend to build with respect to both the type of structure
proposed as well as the proposed density the developer anticipates, each of which is
described below.
Proposed Structures:
The proposed buildings will be attached townhome dwellings, with each building including
three to four units. Each unit will have two stories, and each will run from the front of the
building to the rear of the building. To be clear, these will not be apartment buildings with
“front” and “rear” units or with “upstairs” and “downstairs” units. Indeed, such structures
are prohibited in the proposed district without a Special Use permit, which would require
separate approval by the City as well as notification of surrounding property owners and
the general public that such a request had been made. An image is included at the end of
this letter to illustrate the general type and style of homes the developer is proposing.
Rezoning Application

Page 2
Proposed Density:
The R-5 district allows for a maximum density of sixteen units per acre (21 total units for
this parcel). However, with the proposed townhome structure developer intends to use, it
is not feasible to achieve a density that high. We have developed several potential
configurations for the project, and it is anticipated the project will include three to four
buildings (of three to four dwelling units each) with approximately thirteen to sixteen total
dwelling units across all buildings. This would put the development at an actual density of
10-12 units per acre. The final layout and density will depend in large part on the location
and amount of land required for on-site stormwater detention, which will be determined
during drainage design as part of the construction plan development process. The
construction plans will be developed for submission to the City for review and approval as
a Significant Development following rezoning if this application is approved.
Developer does not intend or propose to split the property into lots. Instead, all units will
remain on a single tract of land. Any proposed split of the property would be required to
come back to the City for separate approval.
It appears the proposed zoning district and project would be compatible with surrounding
zoning and uses as well as with the future land use plans included in the City of Siloam
Springs’ Comprehensive Plan 2040.
Compatibility with Surrounding Zoning/Uses:
Much of the land north and east of the subject property is single family residential.
However, there is also significant commercial and institutional use and zoning in the area
to the south and west. The proposed development is ideally suited to serve as a transition
or buffer area between these commercial and institutional uses and the single family uses,
avoiding a situation where these incompatible uses would be situated directly next to each
other. The existing institutional use mentioned above is clearly the church directly west of
the subject property. The existing commercial use is the tow company located across E
Kenwood Street from the subject property, the presence of which would tend to preclude
zoning or use of the subject property as single family. In addition, the properties at the
southeast and northwest corners of E Kenwood Street and AR Hwy 16 are both zoned for
commercial use. Parcel 03-07024-000, located just southwest of the subject property, is
zoned C-1A (Light Commercial District), while parcel 03-00108-000 is zoned C-2
(Roadway Commercial).
Compatibility with Future Land Use Plan:
Siloam Springs is experiencing rapid growth, and understandably desires to ensure the
growth occurs in a thoughtful manner that is respectful of the City’s history, culture, and
surrounding residents. Accordingly, the City spent significant time and resources
developing the 2040 Comprehensive Plan and also enacting the Unified Development
Code (Chapter 35). The requested zoning corresponds well with the stated land use goals
and the future land use map from the 2040 Comprehensive Plan. The future land use plan
designates this portion of the City in the “Neighborhoods 2” category. This category
“provides for “missing middle” housing densities and supports workforce housing options”,
which is precisely what the developer is proposing. In addition, triplex, and fourplex
residential developments are indicated to be “highly appropriate” uses in this future land
use category. Accordingly, no amendment to the Future Land Use Map is anticipated to
be needed for the requested rezoning. The proposed zoning and development provides
an opportunity for Siloam Springs to add high quality, attractive housing in a manner
consistent with the stated goals and desired housing provided in the Comprehensive Plan.

The existing structures that have been constructed on the site are not intended to be
retained as part of the proposed development. Developer plans to remove the existing
buildings and replace them with new construction.
Please let me know if you have any questions or need any additional information regarding
this application.
Sincerely,
Daniel Lazenby

Item N: Resolution 63- 24/ Significant Development Permit/ 3868 Hwy. 412 East( Olive

Maegan Thomas briefed the item. There was lengthy discussion regarding the waiving
of fees that were requested by the builders. Don Clark, 2135 Montclair Avenue, he is vicepresident of administration for the project. He is excited to bring it and appreciates the
consideration. He discussed that Siloam Springs is a secondary market, and it takes a lot of
convincing to bring a development like this to the area. Arthur Hulbert, 20705 Hwy 16, wants to
find a way to help local businesses but also states that this development would be beneficial to
our City. He advised that other developments are watching prior to making a decision to come to
the area. He stated his vote would be yes. William Hall, 1203 Latisha Lane, Callahan' s has been
in business in this city for 31 years. He does not agree with waiving the fees for a large
corporation such as this since local businesses do not get these waivers. It was discussed that
local businesses who have new development could also request fee waivers. It was decided by
the board that they would like staff to investigate ways the City could help our local businesses.
A motion to approve was made by Hunt and seconded by Allen. Motion passed unanimously.
Item 0: Administrator' s Report is attached. Gilbert, ask we remember Director Rissler and her
family due to the loss of her sister.
Mayor Nation requested the board to agree to pull the executive session from the agenda. A motion
was made by Hunt and seconded by Carroll to remove executive session. Motion passed 5- 1.
Blair voiced her opposition to the removal of the executive session was because they had not
decided on the raise for the City Administrator and if one were not voted on prior to December
31' he would receive the same raise all city employees will get. Gilbert stated he was willing to
forgo his raise for 2025 so long as the City staff received their raises. A motion was made by Blair
and seconded by Long, removing the raise of the City Administrator for 2025. Motion passed 4- 2.

Carroll— Merry Christmas. He went and enjoyed BBQ at the Fire Department awards banquet and
had a wonderful time. They have an ardent desire for community and the surrounding area. It is
said that when something is going on they run toward it instead of away from it. He feels the Fire

Ordinance 26-22 / Amending Section 35-185 of the City Municipal Code /
Rezoning from G-I to R-5 / 2703 E. Kenwood St.
Staff Review
•
The applicant desires to rezone a lot consisting of approximately 1.32 acres,
from G-I (General institutional) to R-5 (Townhomes).

Agenda Item H. Code Amendment
Ordinance 26-22 / Amending Section 35-185 of the City Municipal
Code / Rezoning from G-I to R-5 / 2703 E. Kenwood St.
Staff Findings
•
Staff finds that the rezoning meets the minimum lot requirements
of R-5 zoning.
•
This proposal may not be consistent with the context and
compatibility with the neighborhood as it is abutted to the north
by equal or lesser residential land uses, small lot single family
residential development immediately to the east, mostly vacant
county land to the south, and a and an existing place of worship
on the parcel to the immediate west.
•
A similar Special Use Development Permit requesting multifamily housing (for the shown units in the aerial photo to the left)
was heard by the Board of Directors at the December 17, 2024,
Board of Directors meeting under proposed Resolution Number
57-24, and failed with a 5-1 vote on its first reading (minutes are

ORDINANCE NO. 26-25
CITY OF SILOAM SPRINGS, BENTON COUNTY, ARKANSAS
AN ORDINANCE ESTABLISHING A TEMPORARY MORATORIUM ON
THE DEVELOPMENT, CONSTRUCTION, PERMITTING, APPROVAL,
AND OPENING OF DATA CENTERS WITHIN THE CITY OF SILOAM
SPRINGS, ARKANSAS; PROVIDING FOR THE REVIEW AND
DEVELOPMENT OF APPROPRIATE REGULATORY STANDARDS;
DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES
WHEREAS, the City of Siloam Springs is authorized under Arkansas law to regulate the
development and use of land within its corporate limits for the purpose of promoting the health,
safety, order, convenience, prosperity, and general welfare of the City; and
WHEREAS, data centers are an expanding land use associated with artificial intelligence,
cloud computing, data storage and processing, streaming services, and other computing operations;
and
WHEREAS, depending upon their size, design, and operation, data centers may require
substantial amounts of electricity and water and may require significant utility and other
infrastructure to support their construction and operation; and
WHEREAS, data center development may present land use and infrastructure
considerations involving electrical capacity, water and wastewater capacity, noise, lighting, traffic,
emergency services, environmental impacts, compatibility with surrounding properties, and other
matters affecting the public health, safety, and welfare; and
WHEREAS, the City’s Unified Development Code does not presently contain
development standards specifically designed to address the characteristics and potential impacts
associated with modern large-scale data centers; and
WHEREAS, Interim Resolution 2025-008 has been introduced before the Arkansas
Legislative Council and requests that the Legislative Council encourage a moratorium on the
development and opening of data centers in Arkansas while the State develops standards for data
center development to support cities, counties, and other localities; and
WHEREAS, Interim Resolution 2025-008 identifies concerns associated with large-scale
data center development, including substantial electrical and water demands, infrastructure
requirements, potential risks associated with utility infrastructure investments, and potential
impacts upon environmental quality, public health and safety, economic prosperity, and social
well-being; and
WHEREAS, the Board of Directors finds that the City’s existing development and utility
standards were not developed specifically to evaluate the unique combination of land use,
1
electrical demand, water use, utility infrastructure, noise, backup generation, and other operational
characteristics that may be associated with large-scale Data Centers, and that compliance with
existing standards may therefore not adequately address all impacts associated with such
development; and
WHEREAS, the Board of Directors finds that additional time is necessary to study and
evaluate data centers as a land use and to determine whether amendments to the City’s Unified
Development Code or other City regulations are appropriate before additional development of such
facilities occurs within the City; and
WHEREAS, the Board of Directors finds that a temporary moratorium will preserve the
status quo for a reasonable period while allowing the City to evaluate appropriate regulations
without determining at this time whether data centers should ultimately be permitted, conditionally
permitted, restricted, or otherwise regulated within the City.
NOW, THEREFORE, BE IT ENACTED, by the Board of Directors of the City of Siloam
Springs, Arkansas:
Section 1. Definition. For purposes of this Ordinance, “Data Center” means a building,
facility, or group of buildings or facilities whose principal use is to house computer servers, data
storage systems, networking equipment, or related computing equipment for the centralized
storage, management, processing, transmission, or dissemination of digital data. The term does
not include an office, commercial, governmental, educational, institutional, or other use in which
computer servers, networking equipment, or data storage equipment are incidental or accessory to
the principal use of the property.
Section 2. Temporary Moratorium. A temporary moratorium is hereby imposed upon
the development, construction, establishment, permitting, approval, and opening of any new Data
Center within the corporate limits of the City of Siloam Springs.
During the moratorium, the City shall not accept, process, approve, or issue any application
or request for rezoning, conditional use approval, site plan or development approval, building
permit, certificate of occupancy, or other City permit or approval when the purpose of the
application or request is the development, construction, establishment, or operation of a new Data
Center. No new Data Center shall commence construction or operation within the City during the
moratorium.
Additionally, during the moratorium, the City shall not enter into, approve, or authorize
any agreement, special rate arrangement, commitment to extend, construct, expand, or upgrade of
utility infrastructure, reservation or allocation of electrical, water, wastewater, or other utility
capacity, or other commitment of City resources or utility service specifically for the development,
construction, establishment, or operation of a new Data Center. Nothing herein shall prohibit
ordinary utility operations, maintenance, system planning, or the provision of generally applicable
utility services unrelated to a specific proposed Data Center.
2
Section 3. Existing Uses and Approvals. This Ordinance shall not prohibit the continued
lawful operation of a Data Center lawfully operating within the City before the effective date of
this Ordinance. The moratorium shall not apply to a Data Center for which all final City land use
and development approvals and all required City building permits were issued before the effective
date of this Ordinance.
Nothing in this Section shall create or recognize any vested right beyond that provided by
applicable law.
Section 4. Review and Recommendation. During the moratorium, the City
Administrator shall coordinate a review of the City’s existing ordinances, Unified Development
Code, utility capacity, infrastructure, and other matters relevant to Data Center development and
shall present appropriate recommendations to the Board of Directors.
In conducting the review, the City Administrator may obtain input and assistance from the
Planning Department, the Planning Commission, City utilities, the Fire Department, the Police
Department, the Public Works Department, the City Attorney, other City departments and officials,
utility providers, consultants, and other persons or entities possessing relevant expertise. The City
Administrator shall also provide reasonable opportunities for public input regarding Data Center
development and potential regulatory standards during the review period. The review should
consider, as appropriate:
a. Appropriate zoning districts and locations for Data Centers;
b. Compatibility with surrounding land uses;
c. Setbacks, buffering, screening, and landscaping;
d. Electrical demand, capacity, and infrastructure;
e. Water consumption and water system capacity;
f. Wastewater demand and capacity;
g. Noise and vibration;
h. Lighting;
i. Traffic and roadway impacts;
j. Stormwater and drainage;
k. Fire protection, emergency response; and public safety;
l. Environmental impacts;
m. Backup generators, fuel storage, and other accessory equipment;
n. Utility infrastructure, extensions, upgrades, and allocation of associated costs;
o. Operational reporting, monitoring, and enforcement;
p. Decommissioning and restoration requirements;
q. Potential economic and fiscal effects of data centers, including utility revenues,
infrastructure investment, employment, and other economic development benefits
or costs; and
3
r. Such other matters as may reasonably affect the public health, safety, welfare,
infrastructure, or orderly development of the City.
Any proposed amendment to the City’s Unified Development Code shall be submitted to
and considered by the Planning Commission and Board of Directors in accordance with applicable
Arkansas law and City ordinances.
Section 5. Duration. The moratorium established by this Ordinance shall remain in effect
for six (6) months from the effective date of this Ordinance unless earlier terminated by ordinance
of the Board of Directors. Nothing herein shall prevent the Board of Directors from terminating
the moratorium before its expiration upon determining that the City’s review has been completed
and that appropriate regulations have been adopted or that no additional regulation is necessary.
Any extension of the moratorium beyond the six-month period shall require further action
by the Board of Directors.
Section 6. Nature and Purpose of Moratorium. This Ordinance constitutes a temporary
measure intended to provide the City a reasonable opportunity to study an emerging land use and
determine whether additional regulation is appropriate. Nothing herein shall be construed as a
determination that Data Centers are inherently incompatible with development within the City or
should be permanently prohibited.
Section 7. Compliance with State and Federal Law. This Ordinance shall be interpreted
and applied consistently with applicable state and federal law. Nothing herein is intended to
prohibit or regulate any activity that the City is preempted or otherwise prohibited from regulating.
Section 8. Repealer and Severability. Prior ordinances in conflict with the provisions
enacted herein are repealed to the extent of the conflict as of the effective date of this Ordinance.
If any provision of this Ordinance or the application thereof to any person or circumstance is held
invalid, the invalidity shall not affect other provisions or applications which can be given effect
without the invalid provision or application, and to this end the provisions of this Ordinance are
declared severable.
Section 9. EMERGENCY CLAUSE. It is hereby found and determined by the Board of
Directors that data centers constitute an emerging land use with potentially significant demands
upon electrical, water, wastewater, transportation, emergency services, and other public
infrastructure; that the City’s existing development regulations were not specifically designed to
address the characteristics and potential impacts of modern large-scale data centers; that additional
time is reasonably necessary for the City to study those impacts and determine whether appropriate
local regulations should be adopted; and that acceptance, processing, or approval of applications
or the making of utility or infrastructure commitments for Data Center development during the
review could impair the City’s ability to protect the public health, safety, and welfare. Therefore,
an emergency is declared to exist, and this Ordinance, being necessary for the preservation of the
4
public peace, health, safety, and welfare, shall be in full force and effect immediately upon its
passage and approval as provided by law.

STAFF DISCUSSION
The City of Siloam Springs has received a petition from the Lynch Butler Revocable Trust for the review
of the vacation of utility easements on what are currently Lots 1 and 3 of the Butler Addition in conjunction
with a Minor Subdivision Development Permit Application, a Property Line Adjustment Permit
Application, and a Rezone Development Permit Application. The easements to be vacated were filed for
record in the office of the Benton County Circuit Clerk and Ex-Officio Recorder under instrument number
L202614507. The easements are not needed by the City or private utility operators and are requested to
be permanently closed as shown on the vacation exhibit.
All relevant utilities and City departments have signed off on the easement vacation, as indicated in the
attached memorandum. Finally, it should be noted that these requests are forwarded directly to the Board
and bypass the Planning Commission; this is because easements and rights-of-way are typically vacated
by the Board. Finally, staff has received no evidence that the proposal interferes with the reasonable peace
or enjoyment of the neighboring properties. Staff does not anticipate that any property values will be
substantially damaged, and the proposal appears to be adequately supported by infrastructure.
Fiscal Impact:
Staff does not anticipate any fiscal impacts as a result of this request.

IV.
LAND USE CODE REQUIREMENTS
According to the Land Use Code, a rezoning development permit shall only be
authorized when the applicant has convincingly demonstrated that the proposed zoning:
(a) Will not substantially interfere with other owners’ reasonable peace and enjoyment
of their neighboring properties;
City staff is aware of no evidence that the proposed rezoning for commercial use
will cause a consistent disturbance to the peace and enjoyment of the neighboring
properties. The neighboring properties are generally either unoccupied or are
commercial in nature and are generally considered equal or greater intensity of
land use from the proposal. Enforcement of the City Code’s nuisance chapter will
ensure that excessive noise, or unsightly debris, etc. is mitigated. These rules
ensure that the proposal will not inherently decrease the City’s quality-of-life
standards.
(b) Will not substantially damage any property value in the neighborhood;
Commercial uses in this area are not expected to negatively impact property
values, given the existing commercial developments in the neighborhood and
the adjacent commercial zoning districts surrounding the subject property.
(c) Will be compatible with and respect the context of its location and the character
of the surrounding existing neighborhoods;
The proposed zoning is of similar use classes and is compatible with the
commercial uses in the neighborhood.
(d) Will not, whether by the nature of the allowed uses in the proposed zone, or by
the allowed siting, height, or design of structures or landscaping in the proposed
zone, tend to burden the present or future use of neighboring properties in
accordance with current zoning standards;
Commercial uses in this area are not anticipated to burden the present or future
uses of neighboring properties due to the proposed use being equal or lesser
intensity than the land uses abutting the subject property, or the abutting land
uses are presently unoccupied.
10/27/26 P.N. 03-07902-000; RZ26-09
5
(e) Is adequately supported by infrastructure, including without limitation, streets and
parking;
Water System
There is an existing 8” water main that runs south of the property, within the rightof-way of East US 412 Highway. This waterline falls within the paving of the
highway and is deemed not accessible until well east of the subject property. The
current development underway west of the subject property has extended a new
waterline to their east property line within easements and is accessible to the
subject property. Any costs for extension or connection to the public water system
is the responsibility of the owner/developer. Staff finds this existing infrastructure
to be adequate for fire and projected water needs.
Sewer System
There is an existing 12” sewer main that runs along the east boundary of the future
proposed eastern lot. Any costs for extension or connection to the public
wastewater system is the responsibility of the owner/developer. Staff finds this
existing infrastructure to be adequate for wastewater needs.
Storm Drain System
The existing site is unimproved and has a natural swale/stream along the east
property line flowing to the north. If developed, all stormwater mitigation
requirements must be met per code, including but not limited to: drainage
easements, detention facilities, other improvements, and drainage structures. Any
costs for extension or connection to an acceptable drainage outfall of public or
private drainage systems, is the responsibility of the owner/developer.
(f) Compared to the present zoning of the property, is equally or more consistent with
public health, safety, and convenience within the neighborhood.
The proposed zoning does not markedly inhibit sound planning of the City’s
growth. Nothing in the proposal will consistently inhibit or harm the public
health, safety, and convenience within the neighborhood.

approved.
The Minor Subdivision/Property Line
Adjustment for MS26-03 has been approved at the staff level, thus meaning that this
request meets all requirements for the C-2 zoning district.
Existing and Future Land Uses
The existing site is presently undeveloped and vacant and is not presently used for
agricultural purposes.
All properties abutting the site are currently vacant except for Chick-Fil-A to the west, and
the adjacent C-2 zoned lots to the south and west, which also have existing commercial
uses.
The future land use map calls for Regional Commercial in this area.
Neighborhood Context and Compatibility
The surrounding area is characterized by emerging commercial development that is
regional in scale with Commercial uses immediately to the west, south, and slightly further
to the east.
As previously mentioned in this report, staff finds that the undeveloped lots in this
neighborhood are well-suited for future commercial development, especially from a longrange perspective.
Conditions and Staff Conclusions
The lot meets the minimum zoning requirements and approval criteria.
Please note that a site plan was not included with the rezoning application.
Staff finds that this rezoning request is consistent with the Future Land Use Map, meets all
other zoning requirements, and meets the surrounding Regional Commercial context at this
site.
Fiscal Impact:
Staff is not aware of any fiscal impact at this time.

To: Planning Department / Planning Commission / Board of Directors
City of Siloam Springs
RE: Rezoning Request – 3900 Block of Hwy. 412 East
To Whom It May Concern:
The property owner is requesting to rezone approximately 0.534 acres located at the 3900
Block of Hwy. 412 East from A-1 (Agriculture) to C-2 (Roadway Commercial).
The request is being submitted in conjunction with an associated Minor Subdivision/Property
Line Adjustment. As a result of the proposed adjustment to the eastern property boundary of
Lot 6, a small portion of A-1-zoned property will be incorporated into a lot that is otherwise
zoned C-2 (Roadway Commercial).
The proposed rezoning is intended to maintain consistent zoning throughout Lot 6 and align the
zoning boundary with the proposed property boundary.
We respectfully request consideration and approval of the proposed rezoning.
Thank you,
Maegan Thomas

Ordinance 26-26 / Amending Section 35-185 of the City Municipal Code / Rezoning from A1 to C-2 / 3900 Block of US HWY. 412 E.
Staff Review
•
The applicant desires to rezone a lot consisting of approximately 0.53 acres, from A-1 (Agricultural) to
C-2 (Roadway Commercial).
•
No Future Land Use Map amendment is necessary as this is already designated as “Regional
Commercial”.
•
Based on the letter of intent, The proposed rezoning is intended to maintain consistent zoning
throughout Lot 6 and align the zoning boundary with the proposed property boundary. This was
submitted in conjunction with a Minor Subdivision/Property Line Adjustment and Easement Vacate
Request, the first two being approved and easements accepted unanimously at the October 13, 2026,
Planning Commission meeting with the Easement Vacate request portion passing unanimously during
its first reading before the Board of Directors on October 20, 2026.
Staff Findings
•
Due to the Minor Subdivision and Property Line Adjustment applications being approved, this request
meets the requirements for C-2 zoning.
•
Staff has not received any calls or correspondence regarding this request.
•
This request is consistent with the zoning pattern called for by the Future Land Use Map and
encourages commercial growth on a regional scale, which is appropriate at this location.
•
Based on these findings, staff recommends Approval.
This is a summary only and does not replace any requirements listed within the full staff report.

Section B: Site Analysis
B-1) PROJECT ANALYSIS AND APPROVAL CRITERIA
The following criteria are shown to indicate if this proposal meets the minimum criteria for
approval. Criteria I-II is a subsection of Sec. 35-204 (land use) and subsection 35-204 (lot
standards limited) of the Municipal Code; Criterion III is Sec. 35-49.
I.
ZONING USE UNIT CONSISTENCY
Planned Uses
The subject proposal is consistent with an age restricted business use which is best
associated with Use Unit 26 and is not permitted use within the C-2 Zoning District by
right, see special uses below.
Special uses
As previously stated, the subject proposal best falls under Use Unit 26 (Age restricted
business), which is permitted through a special use permit approval within the C-2
Zoning District.
II.
LOT STANDARDS CONSISTENCY
The minimum C-2 zone standards are compared with the subject property’s lot below:
MINIMUM (C-2) ZONING
SUBJECT PROPERTY PROPOSAL

This development occurred in approx. 1985 at which time the maximum lot coverage permitted within
a C-2 zoning district was greater than in the current zoning code, therefore, the existing lot coverage
is considered legal non-conforming.

III.
PLANNING PERMIT CODE REQUIREMENTS
According to Sec. 35-49 of the City Code, a special use permit shall only be authorized
when the applicant has convincingly demonstrated that the proposed project:
a. Will not interfere with other owners’ reasonable peace and enjoyment of their
neighboring properties:
The applicant is requesting to allow for a stand-alone tattooing business within a
C-2 zoning district, along a heavily trafficked commercial corridor. Staff is aware
of no evidence that the proposed use will cause a consistent disturbance to the
peace and enjoyment of the neighboring properties. The neighboring properties
are primarily described as commercial or manufactured home residential in nature
and are generally considered equal or greater intensity than the proposed use. This
is due to the use being contained within an existing shopping center, called
Chandler Plaza, and will not produce any exterior manifestation, other than
signage, that would impact or interfere with other owners’ peace and enjoyment
of their properties. Chandler Plaza real estate records date back to 1985, which is
assumed to be around the time it was constructed. Enforcement of the City Code’s
nuisance chapter will ensure that excessive noise, or unsightly debris, etc. is
mitigated. These rules ensure that the proposal will not inherently decrease the
City’s quality-of-life standards.
b. Will not substantially damage any property value in the neighborhood:
It does not appear that the request would substantially damage any neighboring
property values. The proposal would operate in the same manner as any other
commercial retail use and is considered consistent with the surrounding existing
commercial uses within the neighborhood.
c. Will be compatible with and respect the context of its location and the character
of the surrounding existing neighborhoods:
The proposed use is considered consistent with the established surrounding
commercial uses within the neighborhood. As previously stated, the commercial
retail center has existed at this site for over forty years. There was an established
barber shop within the same shopping center that once offers tattooing services,
however it has since been relocated. The services provided were under 50 percent
of the total sales volume, therefore it would not appear that a similar service, as a
stand-alone business, would impact the neighborhood character in a measurable
way compared to the historic use. The business, on its face, will operate no
differently than any other standard commercial retail use. Therefore, the proposal
appears to be considered compatible with the existing commercial neighborhood
context.
10/8/26 P.N. 03-01913-000, SU26-02
5
d. Will not, whether by the nature of the use, or by the siting, height, or design of
structures or landscaping, tend to burden the present or future use of neighboring
properties in accordance with current zoning standards:
There is no evidence that the proposal will cause any substantial burden to the
present uses around the area. Traffic is not anticipated to remarkably increase, as
the proposal is to replace an existing commercial use with a new commercial
business.
e. Is adequately supported by infrastructure, including without limitation, water and
sewage systems, streets, parking, and drainage:
Water System
A 12” water main exists on the south side of the subject property. Staff finds this
to be adequate for fire flow requirements and to serve the proposed needs of the
development.
Sanitary Sewer System
A 6” sewer line runs along the south side of this subject property. Staff finds this
to be adequate to serve the sanitary sewer needs of the proposed business.
Storm Sewer System
The majority of the site drains off site to a drainage channel located to the west
side of S. Dogwood St. No changes to the drainage patterns are proposed with
this special use permit request.
Parking
As previously stated, this is the site of an existing commercial retail center—all
parking is existing on site.
f. Does no harm to the health, safety, and convenience within the neighborhood and
any affected vicinity:
There is nothing in the proposal indicative of harm, based criteria as shown. A
commercial retail business with greater than 50 percent age restricted sales is
considered generally consistent, based on the nature of the retail use, with the
surrounding commercial neighborhood context.
g. Promotes favorable economic conditions or public welfare within the city.
The proposal to allow for greater than 50 percent age restricted sales would allow
for a new commercial retail business within the city and, as a result, creates new
jobs and offers a wider variety of options to consumers, thus promoting favorable
economic conditions by increasing the services and jobs within the community.

B-2)
COMPREHENSIVE PLAN CONSISTENCY
The 2040 Land Use Map describes this area as Regional Commercial. Therefore, the
proposed use is consistent with the land use designation for the property.

context.
The city currently has a barbershop business that
offers tattooing as a service; however, this service is
not considered the primary activity of the business and therefore is not considered as an
“age restricted business” needing a special use permit.
Existing commercial retail shopping center, Chandler Plaza, was built in approximately
1985 and one of the tenant spaces once served as the former location of the aforementioned
barbershop business. As such, tattooing services are not novel to the location, what is
different from the previous use is that the proposal will be a stand-alone business that
exclusively offers tattooing rather than a sub-service offered within a barbershop business.
The applicant is not associated with the relocated barbershop business.
Proposed use is consistent with the surrounding existing commercial uses within the
neighborhood, especially within close proximity of a major commercial thoroughfare, US
HWY 412 W.
Staff has found no evidence that the proposed use will not operate in the same manner as a
standard commercial retail use within a commercial strip center.
Residential Impacts
Staff is unaware of any impacts to the residential uses located within this neighborhood as
a result of granting this special use approval.
As previously stated, the site has been used for a variety of commercial uses for over 40
years; therefore, the addition of a tattooing business at this location is not anticipated to
have any additional impact on the neighboring manufactured home residential properties.
The business will front onto S. Dogwood St., a commercial use street, with the rear abutting
the rear side of a manufactured home park located off of W. Tulsa St.
A greater impact may be considered if the proposal was from new construction, rather than
occupying one of the vacant suites of an existing commercial shopping center.
Conditions and Staff Conclusions
As shown on page 1 of this report, staff finds that the applicant meets the minimum
requirements for approval, with the condition that the allowed use be limited to tattooing
and no other age restricted business falling under Use Unit 26.
Section C: Fiscal Impact
Street fees are not assessed with special use permits. Staff is not aware of any fiscal impact at this
time.
