Roll Call called by Clerk Krug. Council Members Isbell, Honchell, Harp, Hughes,
Newport, and Wilms present. Mayor Flynn was present.

Citizen Input Mayor Flynn explained the 3-minute per-person rule for Citizen
Input. He proceeded to call each person on the list, in turn.
Ginny Vance, 5 Glencoe Ln. Ginny came to speak about the "Grow Native"
initiative to grow a Monarch-Friendly Bella Vista by starting a Pollinator Pocket
Program. They are asking for a City liaison to help them identify the first locations
throughout Bella Vista for their pollinator pocket planters.
Patti Foss, Carroll Drive. Patti came to speak about the need she sees for more
comprehensive city planning. She believes we need to ask the larger questions
of "What are the goals for Bella Vista and what kind of community are we trying
to become?" before we can answer the question of lowering the A&P tax,
which was a proposed ordinance on the Agenda. She was disappointed that
the Agenda Packet didn't provide a fiscal impact or explain the larger policy
objective behind the reduction. She proposed a forum bringing together
residents, City staff, POA, A&P, developers and other relevant stakeholders to
participate in providing input on major decisions. She thinks the question is how
to create engagement before an issue reaches the point of controversy.

Reports
Monthly Financial Report through June 30, 2026: Mayor Flynn stated the
total operating revenues were up 5.9% from last year, and they were
$833,000 more than budget. City sales tax was up 8.8% over last year to
date. County sales tax was up 3.3% over last year. On the expense side,
total operating expenses were well controlled, in fact $611,000 under
budget. After half a year, we were $1.4 million dollars ahead of budget
between the revenues and the expenses.
Childhood Cancer Awareness Month Proclamation: Mayor Flynn read the

proclamation designated for the month of September 2026, and called up
Bella Vista residents Dory and MacKenzie Maddry and Heather and Dustin
High for the presentation and picture. Both families have been impacted by
childhood cancer. MacKenzie is a survivor and Elijah High lost his battle with
cancer last year at age 15.
Septic Smart Week Proclamation: Mayor Flynn read the proclamation,
proclaiming September 14–18 as Septic Smart Week in the City of Bella
Vista.

IN DEVELOPMENT IMPACT FEE REVENUE FOR LIBRARY GROWTH-RELATED
QUALIFYING EXPENDITURES

ORDINANCE: REQUIRING ORIENTATION AND CONTINUING EDUCATION FOR
ELECTED OFFICIALS OF THE CITY OF BELLA VISTA, ARKANSAS; ESTABLISHING
MINIMUM TRAINING REQUIREMENTS; PROVIDING FOR REPORTING OF
COMPLIANCE; AND FOR OTHER PURPOSES. Third Reading Mayor Flynn read
the ordinance for the third reading. Council Members Hughes, Harp, and
Isbell discussed the firefighters' training, budget, and how it may or may not
affect this ordinance. Council Member Harp stated he cannot support this
ordinance. Mayor Flynn reflected more on the firefighter comments, adding
that firefighters have been added regularly, the fire budget has increased,
and another fire training staff member has been added. Council Member
Wilms said the city needs to work under the same restraints as the private
sector concerning continuing education and training. Council Member
Hughes made a motion to amend the ordinance, seconded by Council
Member Wilms. Roll Call Vote: (Ayes: 6/Nays: 0) Passed: 6-0. Motion to

ORDINANCE: AMENDING ORDINANCE NO. 2017-15 TO REDUCE THE
PREPARED FOOD AND BEVERAGE TAX RATE FROM ONE PERCENT (1%) TO
ONE-HALF OF ONE PERCENT (0.5%), AND FOR OTHER PURPOSES Mayor Flynn
read the ordinance for the first time. Council Member Harp said he thinks
residents are ready to reduce the amount spent on advertising. He wants to
save money by reducing taxes and limiting government. Council Member
Hughes asked if he would be agreeable to increasing the lodging tax by 3%
and reducing the food & beverage tax by 1/2%, plus taking away some city
expenses for tourism and putting them onto the A&P Commission. Then take
this to the residents to vote on. Council Member Harp said he thinks it is
good to allow residents to vote on issues, but he is not ready to change this
ordinance. Council Member Newport mentioned that this measure would
mean a 25% reduction in the operating budget of the A&P Commission,
which is hefty and should be considered carefully. Mayor Flynn said he
researched NWA and couldn't find any city under 1% for food and
beverage tax. He also said the state created A & P Commissions for very
specific purposes, and it would be important for us to understand what we
would be giving up in this ordinance. Mayor Flynn suggested this is a good
opportunity to understand more about A&P Commissions and moved this to
the second reading next month. Council Member Wilms stated that he
could not support this ordinance, because he believes that Bella Vista
benefits greatly from the efforts of the A&P Commission.
ORDINANCE: ESTABLISHING AN ADVISORY GREEN COMMITTEE, PROVIDING
FOR MEMBERSHIP, PROVIDING FOR ITS ORGANIZATION AND DUTIES, AND FOR
OTHER PURPOSES Mayor Flynn read the ordinance for the first reading.
Council Member Hughes explained her reasons for proposing this
ordinance. It would be another way for community people to get involved
in sustainability and environmental issues. The Committee would consist of
seven members. Council Member Harp asked about the desired outcome,
and Council Member Hughes said it was mainly educational. Council
Member Newport made a motion to suspend the rules and waive three
readings, seconded by Council Member Isbell. Roll Call Vote: (Ayes:
5/Nays:1, Wilms) Passed: 5-1. Council Member Wilms voiced concern over
rushing to pass this, and preferred to wait for at least a second
reading. Council Member Hughes made a motion to approve, seconded
by Council Member Newport. Roll Call Vote: (Ayes: 4/Nays: 3, Honchell,
Harp, Wilms) Passed: 4-3. Mayor Flynn voted to break the tie.
RESOLUTION: EXPRESSING THE WILLINGNESS OF THE CITY OF BELLA VISTA TO
UTILIZE FEDERAL-AID MONIES FOR REPLACEMENT OF THE BROWNING CREEK

BRIDGE ON CULLEN HILLS DRIVE Mayor Flynn read the resolution and called
Street Superintendent Karen Hunt forward to speak. She gave a brief history
of the Browning Creek Bridge, stating that it was built in 1984 and it is the
city's responsibility to maintain. In 2017, when it was inspected by ARDOT
(Arkansas Department of Transportation), it was rated "Routine D." In 2023,
after inspection, it was moved up one level to a rating of "Important C."
Also, in April 2023, Supt. Hunt became street superintendent along with
Assistant Dan Downing. At that time, they felt it was important to begin a
bridge maintenance plan, so they started seeking funding opportunities to
address the aging infrastructure. They discovered the ARDOT local bridge
program, covering 90% federal funding and 10% city funding for bridge
maintenance. The city applied for funding and found out their project met
the eligibility requirements. None-the-less, the city was not selected as a
project in 2024. Later in 2025, City Council decided to create a fund with a
$500,000 "start" toward bridge maintenance and street repairs. In 2026,
ARDOT inspected the bridge and the rating changed to a pressing "B rating"
or needing a plan for repair. The Street Department reapplied to be
accepted as a project, and this time in 2026, the project was accepted.
This resolution is a commitment to spend $5,000 on a feasibility study, which
is required by ARDOT. When that study is completed, Streets will return to the
Council with the estimate for repair or replacement, and then the 90%-10%
funding will apply. Council Member Honchell thanked Supt. Hunt for her

REVENUE RELATED TO PUBLIC SAFETY BUILDING ADDITIONS Mayor Flynn read
the resolution and called Chief Graves forward to explain it. He said the
Council approved $120,000 in Resolution 2026-45 on June 22, 2026, to build
a sidewalk outside the Public Safety Building running along the property.
That sidewalk was required by ordinance and was not built at the proper
time when the building was constructed. In order to come into compliance,
the sidewalk is now being addressed. In June, Chief Graves was working off
an estimate from their engineering firm. Shortly after the resolution passed,
he received another updated estimate from the engineering firm
suggesting it would require closer to between $150,000 and $160,000. Two
bids then came in, which both exceeded the approved amount of
$120,000, and they chose the lowest bid of just over $150,000. Therefore, he
is asking for Resolution 2026-45 to be amended to $155,000, to ensure he

does not need to return for more. Council Member Wilms asked for the
timeline, and Chief Graves said the contractors are ready to begin, and the
project should be completed by the end of the year. Council Member
Newport made a motion to approve, seconded by Council Member Wilms.

BACKGROUND
The City performs seasonal street right-of-way mowing from approximately April
through October across the East, Central, and West sections of the community. Each
section is equipped with two mowing tractors, a brush hog and a batwing tractor to
maintain roadside vegetation. Due to the city's varied terrain, slopes, and roadside
conditions, mowing crews are intentionally staffed in pairs to enhance employee
safety, provide immediate assistance in the event of equipment failure or emergency,
and maintain safe work practices.
When a mower requires routine maintenance or experiences a mechanical
breakdown, mowing operations within that section must be paused — impacting
efficiency. The purchase of a new mowing tractor, will replace an aging unit currently
in service in the field. Retaining the older unit to use as a backup will reduce
downtime, allow continuous paired operations, and support timely and safe
maintenance of the city's street rights-of-way throughout the mowing season.

WHEREAS, the City Council of the City of Bella Vista previously adopted Ordinance
No. 2017-15, creating the Bella Vista Advertising and Promotion Commission and levying a tax
in the amount of one percent (1%) upon the gross receipts or gross proceeds from prepared food
and beverages; and
WHEREAS, the City Council desires to amend the tax rate levied in Section 3 of
Ordinance No. 2017-15 to reduce the rate by one-half of one percent (0.5%);
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BELLA VISTA, ARKANSAS:
SECTION 1:

Section 3 of Ordinance No. 2017-15 is hereby amended to read as

"SECTION 3: LEVY OF PREPARED FOOD AND BEVERAGE TAX. Pursuant
to Arkansas Code Annotated § 26-75-602(c)(2), there is hereby levied a tax in the
amount of one-half of one percent (0.5%) on the portion of the gross receipts or
gross proceeds received by restaurants, cafes, cafeterias, delicatessens, drive-in
restaurants, carry-out restaurants, concession stands, convenience stores, grocery
store-restaurants, or similar businesses from the sale of prepared food and
beverages for on-premises or off-premises consumption, but such tax shall not
apply to such gross receipts or gross proceeds of organizations qualified under 26
U.S.C. § 501(c)(3)."

SECTION 3: Severability. If any section, clause, sentence, or part of this Ordinance is
held to be invalid or unconstitutional, such invalidity shall not affect the validity of the remaining
portions hereof.
SECTION 4: Effective Date. The tax rate reduction set forth herein shall become
effective on the first day of the first monthly reporting period beginning after the effective date
of this Ordinance.

WHEREAS, the City Council of the City of Bella Vista has the management and control
of the finances and property of the City pursuant to Arkansas Code § 14-43-502; and
WHEREAS, the City Council desires to require its prior approval before the City acquires
an automatic license plate reader system or facial recognition and identification system;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF BELLA VISTA, ARKANSAS:
SECTION 1: PROHIBITION ON ACQUISITION OR ACTIVATION WITHOUT
COUNCIL APPROVAL
(a) The City of Bella Vista shall not acquire or activate an “automatic license plate reader
system,” as that term is defined in Arkansas Code § 12-12-1802, without the prior approval
of the City Council.
(b) The City of Bella Vista shall not acquire or activate a “facial recognition and identification
system,” as defined in this Ordinance, without the prior approval of the City Council.
(c) For purposes of this Ordinance, “acquire” or “acquisition” includes, but is not limited to,
purchasing, leasing, renting, accepting as a gift, donation, or grant, or otherwise obtaining
an automatic license plate reader system or facial recognition and identification system.
(d) For purposes of this Ordinance, a “facial recognition and identification system” means one
(1) or more mobile or fixed automated cameras used in combination with computer
algorithms to convert images of human faces into computer-readable biometric data for the
purpose of identifying or attempting to identify an individual.
SECTION 2: EXISTING CAMERA EQUIPMENT
(a) Nothing in this Ordinance shall prohibit the City from continuing to use or operate camera
equipment lawfully possessed by the City before the effective date of this Ordinance,
including camera equipment that is technically capable of being used with an automatic
license plate reader system or facial recognition and identification system, provided that
the City shall not activate or enable such capability without the prior approval of the City
Council as required by this Ordinance.
(b) The ordinary use of such camera equipment to capture, record, or transmit images shall
not, by itself, constitute the activation or use of an automatic license plate reader system or
facial recognition and identification system.
