Mayor Pro Tempore Philip Harris called the meeting to order at 4:00 p.m. at the Gulf Shores City Hall
Council Chambers.
The invocation was delivered by Councilman Stephen E. Jones.
Upon roll call, the following officials answered "present": Councilman Joe Garris, Jr., Councilwoman
Jennifer Guthrie, Councilman Jason Dyken, M.D., Councilman Stephen E. Jones and Mayor Pro
Tempore Philip Harris. Mayor Robert Craft was absent.
Councilman Joe Garris, Jr. moved to approve the minutes of the Rescheduled Regular Council
Meeting of June 8, 2026, as presented; seconded by Councilwoman Jennifer Guthrie; was discussed
and considered in full by the Council; and upon the question, the vote thereon was as follows:
Councilman Joe Garris, Jr. “aye”, Councilwoman Jennifer Guthrie, “aye”, Councilman Jason Dyken,
M.D., “aye”, Councilman Stephen E. Jones, “aye”, and Mayor Pro Tempore Philip Harris. Mayor

Furthermore, Councilman Jason Dyken, M.D. moved to approve the minutes of the Council Work
Session Meeting of June 15, 2026, as presented; seconded by Councilman Joe Garris, Jr.; was
discussed and considered in full by the Council; and upon the question, the vote thereon was as
follows: Councilman Joe Garris, Jr. “aye”, Councilwoman Jennifer Guthrie, “aye”, Councilman Jason
Dyken, M.D., “aye”, Councilman Stephen E. Jones, “abstain”, and Mayor Pro Tempore Philip Harris,
“aye”. Mayor Robert Craft was absent.
Councilman Stephen E. Jones moved to approve the expense vouchers in the amount of
$10,394,805.65 seconded by Councilman Jason Dyken, M.D.; and the vote of those officials present
was unanimously in favor of the motion.
The City Clerk noted that the complete list of vouchers to be paid, as reflected on a computer printout,
had been made a permanent record in the Clerk's office.
Jason Kudulis, of the Mobile Bay National Estuary Program introduced himself as the new director
and gave a brief summary of what the programs the organization offers.
Director of Recreation and Cultural Affairs Grant Brown announced July as Parks & Recreation
Month in the City. He proceeded to show a brief slide show detailing all the events planned for July,
read a proclamation declaring July as Parks & Rec Month and recognized numerous staff members
who were in attendance.
At this time, Councilman Stephen E. Jones moved for the adoption of the following Resolution:

Chilef Building Official / EMA Liaison Brandan Franklin reminded all of the Hurricane Expo
scheduled for Thursday, June 25th from 10:00 a.m. – 2:00 p.m. at the Civic Center inviting all to
attend.
HEARING OF PERSONS NOT LISTED ON FORMAL AGENDA:
Angela Chaffin gave a brief summary of the events surrounding the unveiling of the art installation at
Surf Style by Artist Wyland last week, afterwards she thanked the council and staff members who
attended.
Gulf Shores City Schools Superintendent Dr. Matt Akin announced they recently hosted 40-50
Alabama Superintendents in the new high school and all were impressed with it, they hope to have a
ribbon cutting sometime early August
There being no further business to come before the Council, Councilman Joe Garris, Jr. moved to
adjourn; seconded by Councilman Stephen E. Jones; and the vote of those officials present was
unanimously in favor of the motion.

JULY 6, 2026
The City Council of the City of Gulf Shores, Alabama met in a Council Work Session Meeting
on Monday, July 6, 2026, at 4:00 p.m. with Mayor Robert Craft presiding. The meeting was held
at City Hall.
Upon roll call, the following members answered present: Councilman Joe Garris, Jr.,
Councilman Jason Dyken, Councilman Stephen E. Jones and Mayor Robert Craft.
Councilwoman Jennifer Guthrie and Councilman Philip Harris were both absent.

Several residents had questions & opinions regarding the proposed Targeted Incentive Program,
these were addressed by Director of Economic Development & Public Affairs Director Blake
Phelps.
Timothy Pitman addressed the Mayor & Council to voice his concerns regarding the city’s
deployment of Flock cameras, further asking the council to completely terminate the contract
and remove or not renew the Flock Safety Contract. Mayor Craft requested he please email his
concerns to him as that would be easier for them to respond after reviewing his complete
summary.
Tom Clement addressed the Mayor & Council with concerns regarding his road and the need for
it to be repaired. City Administrator Jon Walker explained the roads were not accepted by the
county nor the city, that the original contractor had not built the roads to the county or city’s
standards. The city would not be able to take them over for any maintenance due to the
extensive cost of the work needed to bring them up to the city’s standards. Mayor Craft stated
he would get city staff to do an internal design to flesh out the approximate costs to build the
road to a standard acceptable to the city, further stating, he wasn’t saying they would do the
work, but would have it reviewed to be able to report back to Mr. Clement what it would take to
get it done.
Gulf Shores City Schools Superintendent Dr. Matt Akin announced that a recent graduate, Jack
Langston, had become the youngest lighting producer on the concert circuit, thanks to the tools
at the high school preparing him. Cam Flener, the lead singer of the Velcro Pygmies, recognized
his talents and was instrumental in getting him in front of the right people.

RESOLUTION NO.
A RESOLUTION
AUTHORIZING THE CREATION OF INVESTMENT PROGRAMS
WITHIN THE WATERWAY VILLAGE AREA AND
THE BEACH WALKING DISTRICT AREA
TO INCENTIVIZE HIGH-QUALITY COMMERCIAL
DEVELOPMENT FOR THE GOOD OF THE CITY
_____________________________________________________________________________
WHEREAS, the City Council of the City of Gulf Shores (the “City”) has determined that
it is necessary, desirable, and in the best public interest of the City to incentivize high-quality
commercial development within the Waterway Village Area and the Beach Walking District Area;
and
WHEREAS, in order to incentivize such development, it may be necessary for the City
consider certain post-development and post-construction tax rebate incentives for certain
qualifying projects approved by the City Council that produce additional tax revenue for the City
(the City Council is not considering providing any upfront capital, construction assistance, or
financing guarantees of any kind).
WHEREAS, the City believes that any tax rebate incentives will serve valid and sufficient
public purposes by increasing commercial activity in the City, expanding the City’s tax bases,
promoting employment opportunities for City residents, and improving the overall quality of life
in the City, notwithstanding any potential benefit to any potential developers from the City’s
expenditure of said public funds.
WHEREAS, the City Council has prepared the attached description of the Waterway
Village Area and Beach Walking District Area Investment Programs for release to the public.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GULF SHORES, ALABAMA, WHILE IN REGULAR SESSION ON JULY 13, 2026, as
follows:
Section 1. That the foregoing Whereas clauses, including the determinations by the Council
described in the third Whereas clause, are incorporated herein by reference.
Section 2. That the description of the Waterway Village Area Investment Program and the
Beach Walking District Area Investment Program, including the Application for use by potential
Applicants, is hereby adopted and approved and directed to be disseminated by the City to the
public.
Section 3. That any rebate incentives are subject to the successful approval of the Review
Committee, the negotiation and completion of a Development Agreement with the City, and the
approval by the City Council of such Development Agreement at a council meeting conducted in
compliance with Amendment No. 772 to the Alabama Constitution of 2022, as amended.

City of Gulf Shores
Waterway Area Investment Program
The Waterway Village Investment Program is designed to incentivize high-quality private investment
that strengthens the city’s walkability, expands year-round economic activity, and elevates the city’s
dining, retail, lodging, entertainment, and mixed-use offerings. Subject to the requirements described
below, the program provides the opportunity for approved applicants to receive a rebate from the
City of a portion of the additional tax revenues generated by a qualifying project, allowing
investors to recover a portion of their upfront costs and improve long-term project feasibility.
PROGRAM OUTLINE
Eligible Rebates
Projects may qualify for one or more rebates of approved portions of the additional:



City Sales Tax (City Rate 3%) generated by the business
Incremental Property Tax (City Rate 5 Mills) created by new construction developments
Lodging Tax (City Rate 10%) for boutique hotels or lodging components
Blended Rebate for mixed-use or major catalytic projects

Rebates are strictly performance-based: the City will issue the rebate only after the project is
completed, fully operational, and generates new tax revenue for the City. The City will not provide
any upfront or startup capital or construction assistance of any kind and will not guarantee any
construction indebtedness or other developer obligations.
Rebate Structure
 High-End or Destination Restaurants: up to 50% of new sales tax for up to 20 years
 Boutique/Specialty Retail: up to 50% of new sales tax for up to 20 years
 Mixed-Use Developments: up to 50% of new taxes for up to 20 years
 Boutique Hotels: up to 50% of new lodging tax for up to 20 years
 Entertainment-Focused Uses: up to 50% of new taxes for up to 20 years
Actual terms depend on project scale, public benefits, and alignment with City goals, which will be
determined by the City and the Review Committee in their sole discretion.
Projects Eligible for the Program
1. Mixed-Use Developments
Mixed‑ use projects combine multiple complementary uses within a single building or coordinated
site plan. These projects create all‑ day activity, support walkability, and increase the overall tax
base (property, sales and use, lodging).
Definition
A development that integrates at least two distinct uses—such as residential, retail, restaurant,
office, or lodging—within the same structure or master‑ planned site, with public‑ facing
restaurant or retail uses on the ground floor.

Upper‑ floor residential units, office space, or lodging
Shared parking or structured parking that supports multiple uses

 A boutique hotel with ground‑ floor retail and rooftop dining
 A multi‑ building project with retail, office, and residential components
Priority features: activated ground floors, walkability, high-quality architecture
2. High-End or Destination Restaurants
These restaurants serve as anchors for downtown activity, attract visitors, and elevate the city’s
culinary profile.
Definition
A full‑ service, sit‑ down restaurant with a significant capital investment, elevated design, and a
concept that enhances the city’s dining scene.
Qualifying characteristics
 Full commercial kitchen and high‑ quality interior finishes
 Chef‑ driven, specialty, or experiential dining concepts
 Outdoor dining, rooftop dining, or activation of public space
 Year‑ round operation
 Attractive to full and part-time residents as well as tourists and visitors
Examples
 A chef‑ owned seafood restaurant with a curated menu
 A high‑ end steakhouse or coastal fine‑ dining concept
 A destination brewery or craft cocktail bar with a full kitchen
Priority features: chef-driven concepts, outdoor dining, year-round operation
3. Boutique Retail & Specialty Shops
These businesses add character, uniqueness, and local flavor to Waterway Village.
Definition
Small‑ format retail businesses offering curated, specialty, or locally focused products that
contribute to a vibrant pedestrian environment.
Qualifying characteristics
 Locally owned or regionally distinctive brands
 High‑ quality storefront design and merchandising
 Experiential or specialty retail (artisan goods, curated apparel, gourmet foods)
 Year‑ round operation
 Attractive to full and part-time residents as well as tourists and visitors
Examples
 A boutique clothing store or home‑ goods shop
 A specialty food market or gourmet shop
 An artisan gallery or maker‑ focused retail space

 A 40‑ room boutique hotel with a rooftop bar
 A mixed‑ use building with a small lodging component above retail
 An existing building converted into an inn
Priority features: 25–75 rooms, ground-floor activation, architectural quality
5. Entertainment-Focused Uses
Vibrant, visitor-oriented entertainment concepts that enhance the coastal experience and support a
lively, walkable environment in Gulf Shores.
Definition
Entertainment venues and experiences—indoor or outdoor—that provide leisure, recreation, and
social activity for residents and visitors. These uses should complement the city’s coastal identity,
activate the streetscape, and contribute to a dynamic mixed-use environment.
Qualifying Characteristics
 Scaled appropriately for a walkable beach-town setting
 Strong indoor–outdoor integration (patios, terraces, open-air elements)
 Family-friendly or multigenerational appeal
 Architectural and experiential quality consistent with Gulf Shores’ coastal character
 Ability to activate the street edge (transparent façades, outdoor seating, music, lighting)
 Preference for concepts that are unique, experiential, or locally rooted
 Parking and circulation designed to support pedestrian activity
Examples
 A coastal-themed entertainment venue with live music and outdoor gathering space
 A small-format arcade, game hall, or family entertainment center integrated into a
mixed-use block
 A craft brewery or distillery with lawn games, food trucks, and event programming
 An immersive attraction (e.g., escape room, virtual reality experience, interactive art
space)
 A waterfront-inspired mini-golf or activity-based recreation concept
Priority Features: Strong indoor–outdoor activation, high-quality design consistent with Gulf Shores’

Project Evaluations
In order to be considered, interested applicants must first submit an Application (attached) to the
Review Committee. Potential projects will be evaluated using a transparent scoring system based on
the following factors and any other factors in the discretion of the Review Committee:
 Capital investment level
 Job creation (high wage, year-round positions)

Beach Walking District Area Investment Program
The Beach Walking District Area Investment Program is designed to incentivize high-quality private
investment that strengthens the city’s walkability, expands year-round economic activity, and elevates
the city’s dining, retail, lodging, entertainment, and mixed-use offerings. Subject to the requirements
described below, the program provides the opportunity for approved applicants to receive a rebate
from the City of a portion of the additional tax revenues generated by a qualifying project,
allowing investors to recover a portion of their upfront costs and improve long-term project feasibility.
PROGRAM OUTLINE
Eligible Rebates
Projects may qualify for rebates on:



City Sales Tax (City Rate 3%) generated by the business
Incremental Property Tax (City Rate 5 Mills) created by new construction developments
Lodging Tax (City Rate 10%) for boutique hotels or lodging components
Blended Rebate for mixed-use or major catalytic projects

Rebates are strictly performance-based: the City will issue the rebate only after the project is
completed, fully operational, and generates new tax revenue for the City. The City will not provide
any upfront or startup capital or construction assistance of any kind and will not guarantee any
construction indebtedness or other developer obligations.
Rebate Structure



High-End or Destination Restaurants: up to 50% of new sales tax for up to 20 years
Mixed-Use Developments: up to 50% of new taxes for up to 20 years
Boutique Hotels: up to 50% of new lodging tax for up to 20 years
Entertainment-Focused Uses: up to 50% of new taxes for up to 20 years

Actual terms depend on project scale, public benefits, and alignment with City goals, which will be
determined by the City and the Review Committee in their sole discretion.
Projects Eligible for the Program
1. Mixed-Use Developments
Mixed‑ use projects combine multiple complementary uses within a single building or coordinated
site plan. These projects create all‑ day activity, support walkability, and increase the overall tax
base (property, sales and use, lodging).
Definition
A development that integrates at least two distinct uses—such as residential, retail, restaurant,
office, or lodging—within the same structure or master‑ planned site, with public‑ facing
restaurant or retail uses on the ground floor.

A full‑ service, sit‑ down restaurant with a significant capital investment, elevated design, and a
concept that enhances the city’s dining scene.
Qualifying characteristics
 Full commercial kitchen and high‑ quality interior finishes
 Chef‑ driven, specialty, or experiential dining concepts
 Outdoor dining, rooftop dining, or activation of public space
 Year‑ round operation
 Attractive to full and part-time residents as well as tourists and visitors
Examples
 A chef‑ owned seafood restaurant with a curated menu
 A high‑ end steakhouse or coastal fine‑ dining concept

Definition
Entertainment venues and experiences—indoor or outdoor—that provide leisure, recreation, and
social activity for residents and visitors. These uses should complement the city’s coastal identity,
activate the streetscape, and contribute to a dynamic mixed-use environment.
Qualifying Characteristics
 Scaled appropriately for a walkable beach-town setting
 Strong indoor–outdoor integration (patios, terraces, open-air elements)
 Family-friendly or multigenerational appeal
 Architectural and experiential quality consistent with Gulf Shores’ coastal character
 Ability to activate the street edge (transparent façades, outdoor seating, music, lighting)
 Preference for concepts that are unique, experiential, or locally rooted
 Parking and circulation designed to support pedestrian activity
Examples
 A coastal-themed entertainment venue with live music and outdoor gathering space
 A small-format arcade, game hall, or family entertainment center integrated into a
mixed-use block
 A craft brewery or distillery with lawn games, food trucks, and event programming
 An immersive attraction (e.g., escape room, virtual reality experience, interactive art
space)
 A waterfront-inspired mini-golf or activity-based recreation concept
Priority Features: Strong indoor–outdoor activation, high-quality design consistent with Gulf
Shores’ coastal identity, family-friendly programming and multigenerational appeal, uses that
enhance walkability and support a lively downtown environment

In order to be considered, interested applicants must first submit an Application (attached) to the
Review Committee. Potential projects will be evaluated using a transparent scoring system based on
the following factors and any other factors in the discretion of the Review Committee:

execute and attest, respectively, a contract between the City of Gulf Shores and Eventbright to
provide point of sale ticketing for special events and to promote non-ticketed events. The term is for
one year with the option to renew for an additional year.
Section 2. That Eventbrite collects all fees directly from patrons. Net proceeds are remitted to
the City after the event concludes.

WHEREAS, over the last few years, the City has worked to exchange certain properties
with the Alabama Department of Conservation and Natural Resources (ADCNR) as part of its
long-term transportation planning efforts; and
WHEREAS, in 2023 the City conducted a corridor feasibility study that identified a future
east-west connection from Canal Rd. through Gulf State Park to HWY 59 necessary to improve
transportation infrastructure; and
WHEREAS, this exchange of property consists of the transfer of 30.35 acres of
undeveloped land from Gulf State Park to the City of Gulf Shores that would accommodate the
proposed future infrastructure improvements; and
WHEREAS, in exchange the City of Gulf Shores will transfer 53.26 acres of undeveloped
land to Gulf State Park; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GULF SHORES, ALABAMA, WHILE IN REGULAR SESSION ON JULY 13, 2026, as follows:

A RESOLUTION
ACCEPTING THE BID OF SILVER SHIPS, INC.
FOR PURCHASE OF 31 FOOT FREEDOM FIRE BOAT
IN THE AMOUNT OF $792,583.24; AND AUTHORIZING
MATCHING CITY FUNDS IN THE AMOUNT OF $199,927.24

WHEREAS, the FEMA Port Security Grant Program provides funding to port authorities,
facility operators, and state, local, and territorial agencies; and
WHEREAS, that on January 8, 2026, the Gulf Shores Fire Rescue Department was awarded
the FEMA Port Security Grant to purchase a fire boat to be utilized by their department; and
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GULF
SHORES, ALABAMA, WHILE IN REGULAR SESSION ON JULY 13, 2026, as follows:
Section 1. That the bid of Silver Ships, Inc. in an amount not to exceed $792,583,24 for
purchase of a 31-Foot Freedom Fire Boat is hereby accepted, being the lowest bid among sealed
bids opened on April 8, 2026.
Section 2. That the Mayor and City Clerk be and they are hereby authorized and directed to
execute and attest, respectively, a contract between the City of Gulf Shores and Silver Ships, Inc.
for purchase of a 31-Foot Freedom Fire Boat in substantially the form presented to Council this
date.

FOR FUNDING FROM THE DEPARTMENT OF HOMELAND SECURITY
FEMA PORT SECURITY GRANT PROGRAM
FOR PURCHASE OF A MOBILE COMMAND VEHICLE
IN THE AMOUNT OF $2,251,000.00; AND AUTHORIZING
MATCHING CITY FUNDS IN THE AMOUNT OF $567,750.00

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GULF SHORES, ALABAMA,
WHILE IN REGULAR SESSION ON JULY 13, 2026 as follows:
Section 1. That the Mayor and City Clerk are hereby authorized and directed to execute and
attest, respectively, a grant application to pursue Grant funding from the Department of Homeland
Security FEMA Port Security Grant Program to purchase a Mobile Command Vehicle to be utilized
by the Police Department in an amount of $2,251,000.00; and if awarded, authorize the Mayor and
City Clerk to execute said contract.
Section 2. That if awarded, the city would be responsible for a 25% match ($562,750.00),
which would be budgeted in the 2028 or 2029 Capital Budget.
Section 3. That in the event a grant is awarded, the City of Gulf Shores understands that it
will sign assurances to comply with all applicable Federal and State laws, rules and regulations.
Section 4. That this Resolution shall become effective upon its adoption.

AN ORDINANCE
ASSENTING TO THE ANNEXATION
OF CERTAIN PROPERTY DESCRIBED HEREIN TO
THE CITY OF GULF SHORES, ALABAMA AND
EXTENDING THE CORPORATE LIMITS OF THE CITY
TO INCLUDE SUCH PROPERTY

WHEREAS, on the 23rd day of May 2026, Mr. Edward Bonifay & Mrs. Terri L. Bonifay,
owners of property located at 21887 Cotton Creek Drive, the real property hereinafter described, did
file with the City Clerk a petition asking that the said tracts or parcels of land be annexed to and
become a part of the City of Gulf Shores; and
WHEREAS, said petition did contain the signature of the owner of the described territory and a
map of said property showing its relationship to the corporate limits of the City of Gulf Shores; and
WHEREAS, the governing body did determine that it is in the public interest that said property
be annexed to the City of Gulf Shores and it did further determine that all legal requirements for
annexing said real property have been met pursuant to Sections 11-42-20 through 11-42-24, Code of
Alabama, 1975; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GULF SHORES, ALABAMA, WHILE IN REGULAR SESSION ON JULY 13, 2026, as follows:
Section 1. That the Council of the City of Gulf Shores, Alabama, finds and declares that it is in
the best interest of the citizens of the city, and the citizens of the affected area, to bring the territory
described in Section 2 of this ordinance into the City of Gulf Shores.
Section 2. That the boundary lines of the City of Gulf Shores, Alabama, be and the same are
hereby altered or rearranged so as to include all of the territory hereto before encompassed by the
corporate limits of the City of Gulf Shores, Alabama, and in addition thereto the following described
territory, to-wit:
As situated in Baldwin County, Alabama, to-wit:
Commencing from the Southeast corner of Section 34, Township 8 South, Range 4 East, run West
332 feet to the point and place of beginning; thence run North 391.1 feet to a point; thence run West
166 feet to a point; thence run South 391.1 feet to a point; thence run East 166 feet to the point of
beginning, intending to describe the same property conveyed in that certain Warranty Deed dated
February 18, 2011, and recorded on February 22, 2011, as Instrument Number 1274439 in the Office
of the Judge of Probate of Baldwin County, Alabama.

Section 5. That the territory described in this ordinance shall become a part of the corporate
limits of the City of Gulf Shores, Alabama, upon publication of this ordinance as set forth in Section
4 above.
Section 6. That this Ordinance shall become effective upon its adoption and publication as
required by law.

GRANTING OF A NONEXCLUSIVE FRANCHISE
TO GRANBURY EXECUTIVE TRANSPORT
TO PROVIDE TRANSPORTATION SERVICE IN THE CITY OF GULF SHORES
AND AUTHORIZING THE EXECUTION OF A FRANCHISE AGREEMENT
BETWEEN THE CITY OF GULF SHORES AND THE COMPANY

WHEREAS, Adam Clark, owner of Granbury Executive Transport has requested
approval of its franchise to empower the Company to provide transportation services in the City
of Gulf Shores; and
WHEREAS, the city is desirous of granting a nonexclusive franchise to Adam Clark,
owner of Granbury Executive Transport, to provide transportation service in the city; and
WHEREAS, the residents of the city will benefit by the granting of such a franchise
renewal; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GULF SHORES, ALABAMA, WHILE IN REGULAR SESSION ON JULY 13, 2026, as
follows:
Section 1. That the approval of a nonexclusive franchise be and it is hereby granted to
Adam Clark, owner of Granbury Executive Transport, for operation of a taxi service within the
corporate limits of the city.
Section 2. That the Mayor and City Clerk are hereby directed and authorized to execute
and attest, respectively, a Franchise Agreement between the City of Gulf Shores and Adam
Clark, owner of Granbury Executive Transport which sets forth the requirements, covenants and
agreements of a franchise to the Company for operation of a taxi service within the City.
Section 3. That any future additional vehicles or drivers must be approved by the Revenue
Division.
Section 4. That the subject Franchise Agreement, the full text of which is available for
examination in the office of the City Clerk, is dated July 13, 2026.
Section 5. That this Ordinance shall become effective upon its adoption and publication
as required by law.
