PURPOSE:
The purpose of this agreement is to authorize the City of Neosho to participate in the electronic recording
(eRecording) system provided by iCounty Technologies, LLC, allowing the City to electronically submit documents
for recording through the EPICPortal system rather than utilizing traditional paper-based submissions. The
agreement establishes the terms, responsibilities, fees, security requirements, and operational procedures
associated with electronic recording services.

BACKGROUND:
iCounty Technologies, LLC has developed the EPICPortal electronic recording platform, which enables governmental
entities and other authorized users to submit documents electronically for recording by participating county
recording offices. Through this agreement, the City would gain the ability to electronically transmit documents,
receive recording confirmations, access recorded documents, and monitor submission status through a secure
online portal. The EPICPortal is designed to improve efficiency by reducing paper submissions, expediting the
recording process, and providing electronic access to recorded or rejected documents. The agreement further
includes software licensing provisions, ACH payment authorization procedures, and user requirements for accessing
and utilizing the electronic recording system.

RECOMMENDATION:
Staff recommends approval of the Memorandum of Understanding and Electronic Recording Agreement between
the City of Neosho and iCounty Technologies, LLC. Participation in the EPICPortal electronic recording system will
provide a more efficient and streamlined process for submitting and receiving recorded documents, reduce
administrative handling of paper documents, and enhance access to electronic records while maintaining
compliance with applicable recording requirements.

ORDINANCE NO. 745-2026

AN ORDINANCE of the City of Neosho, Missouri, authorizing the City of Neosho to enter
into an electronic recording agreement with iCounty Technologies LLC, a Missouri limited
liability company, for the purpose of electronic submission and recording of documents
through the epic portal; and authorizing the city clerk to execute the same by and on behalf
of the City of Neosho.
WHEREAS, the City of Neosho utilizes recording services for official documents and real
property records as required by law; and
WHEREAS, iCounty Technologies LLC has developed the EPIC Portal electronic recording
system which allows governmental entities to electronically submit documents for recording and
receive recorded documents electronically; and
WHEREAS, the City of Neosho finds that participation in the EPIC Portal electronic recording
program will improve efficiency, reduce processing time, and facilitate the electronic recording
and retrieval of documents;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NEOSHO,
MISSOURI, AS FOLLOWS:
Section 1.
That the Electronic Recording Agreement by and between the City of Neosho,
Missouri, and iCounty Technologies LLC, a Missouri limited liability company, for the purpose
of electronically submitting and recording documents through the EPIC Portal system, a true and
accurate copy of said Agreement being attached hereto and incorporated as Exhibit “A,” be and
the same is hereby approved.
Section 2.
That the City Clerk of the City of Neosho, Missouri, is hereby authorized and
directed to execute said Agreement and any associated enrollment, ACH authorization, contact
information, or ancillary documents necessary to implement the electronic recording services
contemplated therein on behalf of the City of Neosho, Missouri.
Section 3.
That this ordinance shall be in full force and effect from and after its passage.

ORIGINATOR DIRECT SUBMISSION
ELECTRONIC RECORDING AGREEMENT
This Agreement, made and entered into this ___ day of ____________, 20___, by and between
_____________________________________________________ (“Originator”), with offices located at
_________________________________________________________ and iCounty Technologies LLC
(“iCounty”), with offices at 1700 SW US Hwy 40 Eastbound, Suite 102, Blue Springs, Missouri 64015.
WHEREAS, iCounty has developed an electronic recording portal, iCounty EPICPortal (EPICPortal), to
electronically receive and process documents from eligible submitting organizations to enable
participating Counties to electronically record (eRecord) received documents directly within the
EPICPortal or via transmission from the EPICPortal to the county’s electronic recording system provider;
and,
WHEREAS, Originator desires to electronically submit real property and other specified documents for
Electronic Recordation in substitution for conventional paper based document; recording
NOW THEREFORE, in consideration of the mutual promises hereinafter contained, the parties hereby
agree as follows:

1. Glossary of Terms:
1.1 Electronic Recording. For purposes of this Agreement, “Electronic Recording” shall mean the
process of electronic submission and delivery of documents from Participating Originators to County,
via the EPICPortal, the electronic recordation of these documents, and the electronically based
receipt of confirmation of recording from County to, or within, the EPICPortal.
1.2 Participating County. For purposes of this Agreement, “Participating County” shall mean a
County government recording agency that has a contract whereby the iCounty’ EPICPortal is used
to allow the electronic delivery of documents for specified purposes.
1.3 User Agreement. For purposes of this Agreement, “User Agreement” shall mean the agreement
attached hereto as Exhibit 2, which iCounty may modify from time to time, that sets out the terms of
usage when accessing the icounty.com website for all electronic recording purposes.

2. iCounty Electronic Recordation.
2.1 iCounty will provide its Electronic Submission Client (“EPICSubmit” application to Originator,
which will enable Originator to:
a. Submit electronic documents to the EPICPortal for Electronic Recording by a participating
County.
b. Receive notification of the recordation status of submitted documents.
c. Print or download the successfully eRecorded documents.

3. Recording Fees
3.1 If required, Originator must have a completed agreement with each Participating County to
which they desire to electronically submit documents for Electronic Recording. Recording fees
will be paid via ACH transfers initiated by iCounty or a direct payment method, provided that
any payment method must be mutually agreed upon in writing between the Originator,
iCounty and Participating County.
3.2 Originator acknowledges that it remains solely responsible for payment of all such fees.
3.3 Originator shall execute Exhibit 1 to this Agreement authorizing iCounty to initiate debit entries
to Originator’s designated account, on a daily basis, for all successfully Electronically
Recorded documents in the amount of the actual recording fee(s) as established by law and
determined by the Participating County.

4. Retrieval of Electronically Recorded or Rejected Documents
Documents that have been successfully recorded by a Participating County, as well as rejected
documents, will be available for retrieval from the EPICPortal. It shall be solely the Originator’s
responsibility to query the EPICPortal to retrieve any documents.
4.1 Documents that have been successfully recorded by a Participating County will include the
document image and County recordation, as well as the Participating County’s recording fee
and the fee charged by iCounty under section 5 of this Agreement.
4.2

Documents rejected by the Participating County will include the Participating County’s
description of the reason(s) for rejection.

5. iCounty’ Fees and Payment
5.1 Portal Current Fee Structure
iCounty will charge Originator a “Portal Fee” (this fee is subject to change after a 60 day prior
notice from iCounty to Originator) for each document submitted and successfully Electronically
Recorded through the EPICPortal. Current Portal Fee is FOUR AND 00/100 DOLLARS
($4.00) per successfully recorded document.
5.2 Portal Fee Payment Procedure.
5.2.1 Originator shall pay all Portal Fees to iCounty via ACH transfer.
5.2.2 Originator shall execute Exhibit 1 to this Agreement authorizing iCounty to initiate debit
entries to Originator’s designated account, on a daily basis, for the Portal Fees.
5.2.3 Portal and Recording fees will be aggregated resulting in a single debit to Originators
account for each recording day.

6. Originator Responsibilities and Obligations
6.1 Originator shall ensure that it implements proper security measures and credentials to protect
against the unauthorized access and use of the EPICPortal by any of Originator’s agents or
representatives.
6.2 Originator assumes any and all responsibility for the form and content of documents submitted
for Electronic Recording and shall be diligent in ensuring that documents submitted for
Electronic Recording have been checked before submission for errors, omissions, scanning
defects, illegible areas, and other deformities that would impact the validity of the document.
6.3 Originator acknowledges that Electronic Recording permits it to prepare, sign and transmit in
electronic formats documents and business records and that the document or records shall be
considered as the “original” record of the transaction in substitution for, and with the same
intended effect as, paper documents and, in the case that such documents bear a digital or
electronic signature, Originator intends to be, and shall be to the extent of applicable law,
bound by those recorded documents for all purposes as fully as if paper versions of the
documents had been manually signed and submitted. A document cannot be cancelled once
it is submitted to the Participating County.
6.4 The Originator represents and warrants the accuracy and completeness of any and all
documents submitted for Electronic Recording and, where appropriate, that the electronic
documents presented for Electronic Recording were scanned form originals. . Originator shall
defend, indemnify and hold harmless iCounty and the Participating County from any loss,
costs or damages of any kind, should any dispute or legal action arise concerning an
Electronic Recording.
6.5 Originator is solely responsible for any and all costs associated with Electronic Recording.
6.6 Originator shall protect the integrity and accuracy of the Electronic Recording process through
ongoing monitoring of documents submitted and recorded through the EPICPortal.

6.7 Originator shall provide iCounty with following information for its Administrative and/or
Technical contact personnel: name, phone number, fax number, mailing address, and email
address.

7. iCounty Responsibilities
7.1 iCounty is responsible for providing, supporting, and maintaining the EPICPortal so as to
allow for the Electronic Recording provided for in this Agreement.
7.2 iCounty shall pass documents received from Originator to the Participating County without
content modification.
7.3 iCounty will maintain an audit trail of all electronic document activity. The audit trail will
contain, at a minimum, Originator identification, submitted content at point of receipt from the
Originator, submitted content at point of submission to the Participating County, dates and
times of key steps in the workflow, recording fees received from Originator and forwarded to
Participating County via ACH and any errors encountered in the ACH process. iCounty will
make the audit trail available to Originator and/or the Participating County, at their respective
reasonable requests.
7.4 iCounty recognizes that electronically recorded document images are the property of the
document originator and/or the recording county. Except as may be required by lawful court
order, iCounty will not sell or transfer any document images that pass through, or remain in,
our control to any third party. In addition, iCounty will treat customer banking information
provided to iCounty for ACH purposes on Exhibit 1 of this agreement as confidential
information.
7.5 iCounty will work in good faith with Originator and County to resolve any issues encountered
in the Electronic Recording process that are within the scope of iCounty’ systems and
software.

8. Miscellaneous.
8.1 Governing Laws
The laws of the State of Missouri shall govern this Agreement, without regard to its conflicts of
laws principles. Any suit or action brought by either party arising out of this Agreement shall be
resolved exclusively in a court of competent jurisdiction within the State of Missouri.
8.2 Disclaimer of Warranties; Limitation of Liability
To the maximum extent permitted by applicable law, iCounty services under this Agreement
are provided “AS IS” AND WITH ALL FAULTS. iCounty hereby disclaims any and all
warranties and conditions, either express, implied or statutory, including, but not limited to, any
implied warranties or conditions of merchantability, of fitness for a particular purpose, of lack of
viruses, of accuracy or completeness of responses, of results, and of lack of negligence or
lack of workmanlike effort. To the maximum extent permitted by applicable law, in no event
shall iCounty be liable for any special, incidental, indirect, or consequential damages
whatsoever arising out of or in any way related to its performance under or in connection with
this Agreement, even in the event of the fault, tort (including negligence), strict liability breach
of contract or breach of warranty. Originator agrees that iCounty’ liability for damages, if any,
shall not exceed the charges paid to iCounty by the Originator under this Agreement. It is
expressly understood that iCounty is providing a transmission service to enable the
recordation of “electronic original” documents and does not guarantee the legality of Electronic
Recording of documents.
8.3 Indemnification
Originator shall indemnify, defend, save, and hold harmless iCounty from and against all
damages, losses, costs, and expenses (including actual legal fees and disbursements), fines
and liabilities incurred by or awarded, asserted, or claimed against iCounty in connection with
Originator’s activities under this Agreement including claims brought by a person using or

relying upon any advice given or publication produced or distributed by Originator. iCounty
shall indemnify, hold harmless and defend Originator from and against any and all liability,
damages, costs, and expenses, including, but not limited to, defense costs and attorney's fees,
for or by reason of any actual or alleged infringement of any United State's patent, copyright,
or any actual or alleged trade secret disclosure, arising from or related to the operation and
utilization of iCounty' EPICPORTAL in connection with this Agreement.
8.4 Scope of Agreement
This Agreement sets forth the entire agreement and understanding of the parties hereto, and,
effective on the commencement date thereof, supersedes all prior agreements, arrangements,
and understandings. No representation, promise, or inducement has been made by either
party that is not embodied in this Agreement.
8.5 Severability
If any provision of this Agreement is invalid, illegal, or unenforceable under any applicable
statute or rule of law, it is to that extent to be deemed omitted. The remainder of the
Agreement shall be valid and enforceable to the maximum extent possible.
8.6 Amendments and Waivers
This Agreement may be amended, and any of its terms may be waived only by a written
instrument executed by both of the parties hereto, or in the case of a waiver, by the party
waiving compliance. The failure of either party at any time(s) to require performance of any
provision hereof or the waiver of such performance shall in no manner affect such party's right
at a later time to enforce the same or any other provision.
8.7 Force Majeure
Neither party shall be in default or otherwise liable for any delay in or failure of its
performance under this agreement if such delay or failure arises by any reason beyond its
reasonable control, including any act of god, any acts of the common enemy, the elements,
earthquakes, floods, fires, epidemics, riots, failures of delay in transportation of
communications, or any failure to act by the other party or such other party’s employees,
agents or contractor; provided, however that lack of funds shall not be deemed to be a reason
beyond a party’s reasonable control. The parties will promptly inform and consult with each
other as to any of the above causes, which in their judgment may or could be the cause of a
delay in the performance of this Agreement.
8.8 Termination
Either party may terminate this Agreement for any reason by providing 30 days written notice
of termination.
8.9 Evolution of Electronic Recording Technology
The parties acknowledge that the Electronic Recording process is an emerging technology and that
state and national standards will continue to evolve. The parties agree to meet to discuss changes
and additions to this Agreement as may be necessary from time to time.
Each party acknowledges it has read and understands this Agreement and agrees to be bound by its
terms.

SOFTWARE LICENSE AGREEMENT
1. GRANT OF LICENSE. iCounty grants to _________________________ (Originator) and Originator
accepts a non-exclusive, non-transferable license for any number of users to use the iCounty EpicSubmit
Electronic Recording System (“Software”) at Originator’s address according to the terms of this
Agreement. The purpose of this license is to permit the use of the Software to submit documents to the
EPICPortal, as further set forth in the Originator Direct Submission Electronic Recording Agreement
by and between iCounty and Originator (the “Electronic Recording Agreement”) Capitalized terms
not otherwise defined herein shall have the meanings ascribed to them in the Electronic Recording
Agreement.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
a. Rental. Originator may not sell, rent, or sublicense the Software to any third party.
b. Reverse Engineer. Originator shall not reverse engineer, decode, copy or replicate all or any
part of the Software.
c. Termination. iCounty may terminate this Software License Agreement at any time upon
written notice to Originator if Originator fails to comply with any of the terms and conditions of this
Agreement or the Electronic Recording Agreement. This Agreement shall terminate automatically
in the event that the Electronic Recording Agreement is terminated. In the event of termination of
this Agreement, Originator shall return to iCounty any and all copies of the Software and shall
certify in writing to iCounty within 30 days after termination that it has deleted any and all copies
of the Software from its computer systems.
3. COPYRIGHT. The Software is protected by copyright and other intellectual property laws and treaties.
iCounty (or its suppliers) own all rights, title, copyright, and other intellectual property rights in the
Software. The iCounty Electronic Recording System is licensed to Originator, not sold.
4. DISCLAIMER OF WARRANTIES. To the maximum extent permitted by applicable law, iCounty and
its suppliers provide the Software and any (if any) support services related to the Software (“Support
Services”) AS IS AND WITH ALL FAULTS, and hereby disclaim all warranties and conditions, either
express, implied or statutory, including, but not limited to, any (if any) implied warranties or conditions of
merchantability, of fitness for a particular purpose, of lack of viruses, of accuracy or completeness of
responses, of results, and of lack of negligence or lack of workmanlike effort, all with regard to the
Software, and the provision of or failure to provide Support Services.
ALSO, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET
POSSESSION, CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT, WITH REGARD
TO THE iCOUNTY SOFTWARE. THE ENTIRE RISK AS TO THE QUALITY OF OR ARISING OUT OF
USE OR PERFORMANCE OF THE iCOUNTY SOFTWARE AND SUPPORT SERVICES, IF ANY,
REMAINS WITH ORIGINATOR.
5. EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES. To the
maximum extent permitted by applicable law, in no event shall iCounty be liable for any special,
incidental, indirect, or consequential damages whatsoever arising out of or in any way related to
the use of or inability to use the iCounty Software, the provision of or failure to provide Support
Services, or otherwise under or in connection with any provision of Agreement, even in the event
of the fault, tort (including negligence), strict liability, breach of contract or breach of warranty of
iCounty or any supplier, and even if iCounty or any supplier has been advised of the possibility of
such damages.
Each party acknowledges it has read and understands this Software License Agreement and agrees to
be bound by its terms.

USER AGREEMENT
PLEASE READ THIS USER AGREEMENT AND THESE TERMS AND CONDITIONS CAREFULLY
BEFORE USING THIS SITE. Your use of this site is expressly conditioned on your acceptance of the
following terms and conditions. By using this site, you signify your assent to these terms and conditions.

profane material or any material that could constitute or encourage conduct that would be considered a
criminal offense, give rise to civil liability or otherwise violate any law. In addition, you are prohibited from
posting or transmitting any information which (a) infringes the rights of others or violates their privacy or
publicity rights, (b) is protected by a copyright, trademark or other proprietary right, unless with the
express written permission of the owner of such right, (c) contains a virus, bug or other harmful item, or
(d) is used to unlawfully collude against another person in restraint of trade or competition. You shall be
solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary
right, or any other harm resulting from your use of the Site.
3. AGE AND RESPONSIBILITY. If you use the Site, you are responsible for maintaining the
confidentiality of your account information and your password. You agree to accept responsibility for all
activities that occur under your account or password. You represent that you are of sufficient legal age to
use the Site and to create binding legal obligations for any liability you may incur as a result of the use of
the Site. You understand that you are financially responsible for all uses of the Site by you and those
using your login information.

4. REVIEW OF TRANSMISSIONS. iCounty may, from time to time monitor and review any information
transmitted or received through the Site and reserves the right to censor, edit, remove or prohibit the
transmission or receipt of any information that iCounty deems inappropriate or in violation of these terms
and conditions. During monitoring, the information may be examined recorded or copied, and your use of
the Site constitutes your consent to such monitoring and review. You agree that if you submit
suggestions, ideas, comments or questions or post any other information on the Site, you grant iCounty a
worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use,
reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such
content in any form, media or technology.
5. EXCLUSION OF WARRANTY. iCOUNTY MAKES NO WARRANTY OF ANY KIND REGARDING
THE SITE AND/OR ANY MATERIALS PROVIDED ON THE SITE, ALL OF WHICH ARE PROVIDED ON
AN “AS IS” BASIS. iCOUNTY DOES NOT WARRANT THE ACCURACY, COMPLETENESS,
CURRENCY OR RELIABILITY OF ANY OF THE CONTENT OR DATA FOUND ON THE SITE AND
SUCH PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING
IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW
OR FROM A COURSE OF DEALING OR USAGE OF TRADE. iCOUNTY DOES NOT WARRANT THAT
THE SITE, ITS SERVERS OR ANY E-MAIL SENT FROM iCOUNTY ARE FREE OF VIRUSES OR
OTHER HARMFUL COMPONENTS. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED
WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY
GIVES YOU SPECIFIC RIGHTS WHICH VARY FROM STATE TO STATE.
6. LIMITATION OF LIABLITY. iCOUNTY ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE
LIABLE FOR, ANY DAMAGES TO, OR VIRUSES THAT MAY INFECT YOUR COMPUTER
EQUIPMENTOR OTHER PROPERTY ON ACCOUNT OF YOUR ACCESS TO, USE OF, OR
BROWSING IN THE SITE OR YOUR DOWNLOADING OF ANY MATERIALS, DATA, TEXT, IMAGES,
VIDEO OR AUDIO FROM THE SITE. IN NO EVENT SHALL iCOUNTY BE LIABLE FOR ANY INJURY,
LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR
CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO LOST PROFITS OR
LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE ,
WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (I) ANY USE OF THE SITE OR
CONTENT FOUND HEREIN, (II) ANY FAILURE OR DELAY (INCLUDING, BUT NOT LIMITED TO THE
USE OF OR INABILITY TO USE ANY COMPONENT OF THE SITE FOR PROCESSING RECORDING
OF SUBMITTING DOCUMENTS), OR (III) THE PERFORMANCE OR NON PERFORMANCE BY
iCOUNTY, INCLUDING, BUT NOT LIMITED TO, NON PERFORMANCE RESULTING FROM
BANKRUPTCY, REORGANIZATION, INSOLVENCY, DISSOLUTION OR LIQUIDATION EVEN IF SUCH
PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY
OTHER PARTY.
If, notwithstanding the foregoing, iCounty should be found liable for any loss or damage which arises out
of or is in any way connection with any of the above described functions or uses of the Site or its content,
the liability of iCounty shall in no event exceed, in the aggregate, the greater of (a) the Recording fee and
service charge for accessing the Site, or (b) US$100.00. In its sole discretion, in addition to any other
rights or remedies available to iCounty and without any liability whatsoever, iCounty at any time and
without notice may terminate or restrict your access to any component of the Site. Some states do not
allow limitation of liability, so the foregoing limitation may not apply to you.
7. INDEMNIFICATION. You shall defend and indemnify iCounty and its officers, directors, employees
and agents from and against any claim, cause of action or demand, including without limitation
reasonable legal and accounting fees, brought by or on your behalf in excess of the liability described
herein or by third parties as a result of your use of the Site.
8. RELATIONSHIP. The relationship between iCounty and you will be that of independent contractors,
and neither of us nor any of our respective officers, agents or employees will be held or construed to be
partners, joint ventures, fiduciaries, employees or agents of the other.
9. GOVERNING LAW. This Agreement and its performance shall be governed by the laws of the state
of Missouri, United States of America, without regard to its conflict of laws provisions. You consent and

submit to the exclusive jurisdiction of the state and federal courts located in the state of Missouri, United
States of America, in all questions and controversies arising out of your use of the Site and this
Agreement. To the extent allowed by applicable law, any claim or cause of action arising from or relating
to your access or use of the Site must be brought within two (2) years from the date on which such claim
or action arose or accrued.
10. ATTORNEY’S FEES. If iCounty takes any action to enforce this User Agreement and these terms
and conditions, such parties will be entitled to recover from you, and you agree to pay, all reasonable and
necessary attorney’s fees and any cost of litigation, in addition to any other relief, at law or in equity, to
which such parties may be entitled.
11. INJUNCTIVE RELIEF. You acknowledge that a violation or attempted violation of any of this User
Agreement and these terms and conditions will cause such damage to iCounty as will be irreparable, the
exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at
law. Accordingly, you agree that iCounty shall be entitled as a matter of right to an injunction issued by
any court of competent jurisdiction, restraining such violation or attempted violation of these terms and
conditions by You, or Your affiliates, partners, or agents, as well as recover from You any and all costs
and expenses sustained or incurred by iCounty in obtaining such an injunction, including, without
limitation, reasonable attorney’s fees. You agree that no bond or other security shall be required in
connection with such injunction.
12. TERMINATION. iCounty may terminate this User Agreement and these terms and conditions and/or
the provision of any of the services at any time for any reason, including any improper use of the Site or
your failure to comply with these terms and conditions. Such termination shall not affect any right to relief
to which iCounty may be entitled, at law or in equity. Upon termination of this User Agreement and these
terms and conditions, all rights granted to you will terminate and revert to iCounty, as applicable.
13. ASSIGNMENT. You may not assign, convey, subcontract or delegate your rights, duties or
obligations hereunder.
14. MODIFICATION. iCounty may at any time modify these terms and conditions and your continued
use of the Site will be conditioned upon the terms and conditions in force at the time of your use.
15. ADDITIONAL TERMS. Additional terms and conditions may apply to submission, deliver, or
processing of these election documents, and other uses of portions of the Site, and you agree to abide by
such other terms and conditions.
16. SEVERABILITY. These terms and conditions shall be deemed severable. In the event that any
provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to
the fullest extent permitted by applicable law, and such determination shall not affect the validity and
enforceability of any other remaining provisions.
17. HEADINGS. The headings used in this User Agreement are included for convenience only and will
not limit or otherwise affect the terms and conditions herein.
18. ENTIRE AGREEMENT. This User Agreement, together with any terms and conditions of any
Electronic Recording Agreement entered into between you and iCounty or referred to herein constitute
the entire agreement between us relating to the subject matter hereof, and supersedes any prior
understandings or agreements (whether oral or written) regarding the subject matter, and may not be
amended or modified except in writing or by making such amendments or modifications available on the
Site.

documents will only by recorded on those days and hours established by the appropriate
County Recording Office. Documents will not be processed on County holidays, weekends,
etc., or in the event of network or equipment failure. This includes other closings ordered or
authorized by the appropriate County.

PURPOSE:
To approve the GPM for the Public Safety Center.
BACKGROUND:
The City of Neosho has contracted with Branco for the construction of the Public Safety Center.
In the CMAR agreement with Branco once bids have been obtained, the contractor is to submit to
the city a guaranteed maximum price for the project. This GMP is in the amount of
$14,580,032.00.
RECOMMENDATION:
Staff requests the GPM be accepted and authorize the Mayor to sign the contract document.

This GMP Amendment #1 total…………………………........................$ 14,680,032.00
Our Qualifications and Clarifications are as follows:
• All costs associated with abandoning, establishing or moving gas, water, fiber,
cable or electrical utilities are assumed to be by the Owner. Our scope of work
starts from the water meter, gas meter and transformer into the building.
• Design Fees are excluded.
• All costs associated with utility costs for temporary power, gas, water, etc. are
assumed to be by the Owner.
• All costs associated with the relocation of existing utilities, i.e. natural gas, fiber,
electric, cable, telephone, etc. are assumed to be by the Owner.
• All third-party testing is to be by the Owner.
• We have included a $200,000 allowance for Unsuitable Soils/Unforeseen
Conditions
• We have included a $65,000 allowance for Weather Protection/Temporary
Partitions as needed.
• We have included the use of Procore for document control.
• All furnishings such as: furniture, desks, tables, chairs, etc. are by the Owner.
These are referred to as F,F, & E.
• We have only included the raceway & low voltage cabling for the Fire Station
Alerting Systems. All equipment is to be purchased and installed by owner.
• All building permit costs are excluded and assumed to be by the owner or waived.
• Sales tax is excluded.
• We have included CMR provided Builders Risk, General Liability Insurance, & OCP.
• We acknowledge Addenda 1-4.
• The GMP includes Alternate #1 for the patio canopies.
• We have included an owner contingency in the amount of $400,000.
• We have included $400,000 (+/- 3.18% of the trade package’s value of
$12,553,082.00) as a CMR contingency. This contingency is for the CMR’s use for
such cost as:
• Market or schedule driven changes in the cost of work. These costs are known
as “buy-out differences from the budget”.

Adjustments to contractor’s scope of work not anticipated at the time the
subcontractor was contracted as required for a complete system installation
(i.e. “scope gaps”).

The above-mentioned contingency does not include changes in scope (i.e. changes in
building systems, kinds and quality of materials, finishes or equipment) which are the
basis for change orders. Examples would be adding a shower to a room or changing
plastic laminate casework to wood veneer casework. The contingency does not include
increases in the Cost of Work identified through the refinement and development of the
Construction Documents. In addition, unforeseen site conditions such as buried artifacts,
archaeological items, utilities and contaminated or unsuitable soil are not covered under
the contingency.
Fee is set at 1.95% and will be applied to all cost of work.
This GMP is based on a substantial completion date of 1/7/2028.

PURPOSE:
To authorize the acceptance and expenditure of Missouri Blue Shield Grant Program (MBSGP) funds for the
purchase of a Computer Voice Stress Analyzer (CVSA) truth verification system, training and certification for two
police department personnel, and a ForenScope Alternate Light Source (ALS) forensic evidence detection system.
These tools will enhance the Neosho Police Department's investigative capabilities, improve evidence identification
and collection, and strengthen both criminal and administrative investigations.

BACKGROUND:
The Neosho Police Department has been awarded $29,069.76 through the Missouri Department of Public Safety's
Missouri Blue Shield Grant Program. The purpose of the program is to support local law enforcement agencies and
strengthen public safety initiatives through the acquisition of equipment, training, and technology.
A significant component of this project is the acquisition of a Computer Voice Stress Analyzer (CVSA) system and
examiner certification training for two officers. The CVSA is a widely used law enforcement credibility assessment
and truth verification tool that analyzes vocal stress patterns during structured interviews. The technology is utilized
by thousands of law enforcement agencies nationwide as an investigative aid during criminal investigations,
applicant screening, cold case reviews, and administrative or internal affairs investigations. The system assists
investigators in identifying areas requiring additional inquiry and can help elicit admissions and disclosures during
properly conducted interviews. [police1.com], [nacvsa.org], [cvsa1.com]The project also includes the purchase of a
ForenScope Alternate Light Source (ALS) system. An alternate light source is a forensic evidence detection tool that
uses specialized wavelengths of light to reveal evidence that may not be visible under normal lighting conditions.
The technology assists investigators in locating latent fingerprints, biological fluids, hair, fibers, trace evidence,
footwear impressions, and other physical evidence at crime scenes and during laboratory examinations. The
ForenScope T-65 ALS is specifically designed to enhance crime scene investigations through multispectral
illumination and forensic evidence detection capabilities.
The acquisition of these tools will provide officers with advanced investigative resources that can improve case
development, evidence recovery, interview effectiveness, and overall investigative efficiency while reducing the need
to rely on outside agencies for specialized forensic and credibility assessment services.

RECOMMENDATION:
Staff recommends that the City Council approve acceptance of the Missouri Blue Shield Grant Program award and
authorize the purchase of the Computer Voice Stress Analyzer (CVSA) system, training and certification for two
examiners, and the ForenScope Alternate Light Source forensic evidence detection system. These purchases will
enhance the department's investigative capabilities, support more effective criminal and internal affairs
investigations, improve forensic evidence identification and collection, and provide long-term operational benefits
to the City of Neosho at no additional cost beyond the grant-funded amount.

1. Allowable Costs: The recipient understands that only allowable items in the approved budget will
be reimbursed under this award. These monies may not be utilized to pay debts incurred by other
activities. The recipient agrees to obligate funds no later than the last day of the project period.
(Funds are obligated when a legal liability to pay a determinable sum for services or goods is
incurred and will require payment during the same or future period.) The recipient also agrees to
expend funds no later than the date identified in the “MBSGP Notice of Funding Opportunity
(NOFO)”. (Funds are expended when payment is made.) Any funds not properly obligated and/or
expended will lapse. Any deviation from the approved award must have prior approval from the
DPS/OHS. The recipient shall fully coordinate all activities in the performance of the project with
those of the DPS/OHS. The recipient certifies that all expendable and non-expendable property
purchased funds under this award shall be used for approved project purposes only.
2. Award Adjustments: The recipient understands that any deviation from the approved award must
have prior approval from the DPS/OHS. No additional funding shall be awarded to a recipient
(unless specifically notified by the DPS/OHS of additional funding being awarded), but changes
from one budget line to another budget line may be possible if the request is allowable and within
the scope of the guidelines. Prior approval must be requested via the “Subaward Adjustment”
component of WebGrants.
3. Award Document Changes: In the event the DPS/OHS determines that changes are necessary to
the award document after an award has been made, including changes to period of performance or
Articles of Agreement, the recipient will be notified of the changes in writing. Once notification has
been made, any subsequent request for funds will indicate recipient acceptance of the changes to
the award.
4. Body Armor: The recipient understands, if monies are requested and awarded for the purchase of
body armor, that funds may be used to purchase body armor at any threat level designation, make, or
model from any distributor or manufacturer, as long as the body armor has been tested and found to
comply with the latest applicable National Institute of Justice ballistic or stab standards. Further, body
armor or armor vests must also be “uniquely fitted vests”. In addition, body armor purchased must be
made in the United States.
5. Body Armor Policy: The recipient understands, if monies are requested and awarded for the purchase
of body armor, that the law enforcement agency must have a written “mandatory wear” policy in effect.
The recipient will be required to forward a copy of such policy(s) to the DPS/OHS at the time of claim
submission.
6. Body-Worn Camera Policy: The recipient understands, if monies are requested and awarded for the
purchase of body-worn cameras, the law enforcement agency must have written policies and
procedures in place related to equipment usage, data storage and access, privacy considerations,
training, etc. The recipient will be required to forward a copy of such policy(s) to the DPS/OHS at the
time of claim submission.
7. Buy American: The recipient acknowledges Sections 34.350-34.359 RSMo regarding the Missouri
Domestic Products Procurement Act (or commonly referred to as the Buy American Act) and the
requirement to purchase or lease goods manufactured or produced in the United States, unless
exceptions to the Buy American Act mandate in Section 34.353 RSMo are met.

8. Buy Missouri: The recipient also acknowledges Sections 34.070 and 34.073 RSMo, regarding the
preference given to all commodities and tangible personal property manufactured, mined,
produced, or grown within the State of Missouri and to all firms, corporations, or individuals doing
business as Missouri firms, corporations, or individuals, or which maintain Missouri offices or places
of business, when quality is equal or better and delivered price is the same or less, quality of
performance promised is equal or better and the price quoted is the same or less, or when
competing bids are comparable.
9. Change in Personnel: The recipient agrees to notify, within a timely manner, the DPS/OHS if there
is a change in or temporary absence as it affects the “My Profile” module, “Contact Information”
component, and/or “Budget” component within WebGrants. The notification shall be sent as a
“Program Revision” through the “Subaward Adjustment” component of WebGrants.
10. Compliance Workshop: As a recipient of state funds, the recipient is required to participate in any
applicable Compliance Workshop hosted by the Missouri Department of Public Safety (DPS)/Office
of Homeland Security (OHS). The Compliance Workshop provides post-award information to
include, but not limited to, award acceptance, project implementation, reporting requirements,
award changes, civil rights compliance, monitoring responsibilities, record retention, internal
controls, and accounting responsibilities.
11. Contractual Services: For Contractual Services the following general requirements will be followed
when subcontracting for work or services contained in this grant award:
a. All consultant and contractual services shall be supported by written contracts stating
the services to be performed, rate of compensation and length of time over which the
services will be provided.
b. A copy of any contractual agreement made as a result of this award must be
forwarded to DPS/OHS for review or be readily available for review prior to execution
of the contract.
12. Criminal Activity: The recipient assures to formally report to the DPS/OHS within 48 hours of
notification if an individual funded, in whole or in part, under this award is arrested for or formally
charged with a misdemeanor or felony regardless of if the criminal offense is related to the
individual’s employment. The DPS/OHS reserves the right to suspend or terminate grant funding
pending the adjudication of the criminal offense.
13. Data Reporting Requirements: The recipient agrees to complete and submit any data or
statistical reports required for this program. Failure to submit reports by the deadline dates may
result in delay for reimbursement requests and/or cancellation of the award.
14. Discrimination in Public Accommodations: The recipient assures compliance with Section
213.065 RSMo, in regard to non-discrimination in public accommodations as it relates to
accommodations, advantages, facilities, services, or privileges made available in place of public
accommodations.
15. Duplication of Networks: The recipient assures that all equipment/software requested and
purchased under this award must be compatible with the statewide system. All software, if

applicable, must be compatible with the statewide criminal records system. All communication
devices, if applicable, must be capable of operating in accordance with the guidelines established
by the Missouri Interoperability Center.
16. Duplicative Funding: The recipient agrees that if it currently has an open award of federal and/or
state funds or if it receives an award of federal and/or state funds other than this award, and those
award funds have been, are being, or are to be used, in whole or in part, for one or more of the
identical cost items for which funds are being provided under this award, the recipient will promptly
notify, in writing, the DPS/OHS. If so requested and allowed by the DPS/OHS, the recipient shall
submit a “Subaward Adjustment” to eliminate any inappropriate duplication of funding.
17. Employment of Unauthorized Aliens: Pursuant to Section 285.530.1 RSMo, the recipient assures
that it does not knowingly employ, hire for employment, or continue to employ an unauthorized alien to
perform work within the State of Missouri, and shall affirm, by sworn affidavit and provision of
documentation, its enrollment and participation in a federal work authorization program with respect to
the employees working in connection with the contracted services. Further, the recipient shall sign an
affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in
connection with the contracted services.
In accordance with Sections 285.525 to 285.550, RSMo, a general contractor or subcontractor of any
tier shall not be liable when such general contractor or subcontractor contracts with its direct
subcontractor who violates subsection 1 of Section 285.530 RSMo, if the contract binding the
contractor and subcontractor affirmatively states that the direct subcontractor is not knowingly in
violation of subsection 1 of Section 285.530 RSMo, and shall not henceforth be in such violation and
the contractor or subcontractor receives a sworn affidavit under the penalty of perjury attesting to the
fact that the direct subcontractor’s employees are lawfully present in the United States.
18. Enforceability: If a recipient fails to comply with all applicable state requirements governing these
funds, the State of Missouri may withhold or suspend, in whole or in part, funds awarded under the
award or recover misspent funds following an audit. This provision is in addition to all other remedies
provided to the State of Missouri for recovery of misspent funds available under all applicable state and
federal laws.
19. Equipment: Equipment means tangible personal property (including information technology
systems) having a useful life of more than one year and a per-unit acquisition cost, which equals or
exceeds the lesser of the capitalization level established by the non-federal entity for financial
statement purposes, or $5,000. Expenditures for equipment shall be in accordance with the
approved budget. The recipient shall use and manage equipment in accordance with its procedures
if the equipment is used for its intended purposes. When original or replacement equipment
acquired under this award is no longer needed for the original project or program or for other
activities currently or previously supported by the DPS/OHS, you must request instructions from
DPS/OHS to make proper disposition of the equipment following the Missouri Office of Homeland
Security, Division of Grants, Administrative Guide for Homeland Security Grants.
20. Fair Labor Standard Act: All recipients of state funds will comply with the minimum wage and
maximum hour’s provisions of the Section 290.502 RSMo.

21. Federal Equitable Sharing Funds: The recipient assures its law enforcement agency is in
compliance with the state provisions of Section 513.653 RSMo, relating to participation in the
federal forfeiture system and the reporting of proceeds received therefrom to the Missouri State
Auditor.
22. Financial Reporting Requirements: The recipient agrees to complete and submit any financial
reports required for this program. Failure to submit reports by the deadline may result in delay for
reimbursement requests and/or cancellation of the award.
23. Fund Availability: The recipient understands all awards are subject to the availability of
appropriated funds and any modifications or additional requirements that may be imposed by law. It
is understood and agreed upon that, in the event funds from state sources are not appropriated, are
otherwise unavailable, or are not continued at an aggregate level sufficient to cover the costs under
this award, or in the event of a change in state law relevant to these costs, the obligations of each
party hereunder shall thereupon be terminated immediately upon receipt of written notice. The
recipient further understands and agrees that neither the DPS/OHS nor the State of Missouri shall
be liable for any costs, injuries, or other damages, liquidated or otherwise, caused by or related to a
lack of funds or withholdings.
24. Governing Directives: The recipient assures that it shall comply, and all its subcontractors as
applicable shall comply, with the applicable provisions of the “MBSGP Notice of Funding
Opportunity”, the “Missouri Office of Homeland Security, Division of Grants, Administrative Guide
for Homeland Security Grants, Information Bulletins released by the DPS/OHS, and other
applicable state laws or regulations.
25. Grant Reporting: Status reports are required to be submitted quarterly through the WebGrants
system.
26. Interoperability Equipment: To meet SAFECOM requirements all radios must comply with the Missouri
Department of Public Safety, Office of the Director DPS Grants Radio Interoperability Guidelines located
at https://dps.mo.gov/dir/programs/ohs/documents/radio-interoperability-guidelines.pdf. The Missouri
Interoperability Center will review all communications equipment applications to ensure they comply with
the Radio Interoperability Guidelines.
27. Law Enforcement Agency Requirements: Law enforcement agencies must be compliant with the
requirements listed below and must maintain compliance throughout the period of performance.
a. Section 43.505 RSMo - Uniform Crime Reporting: Pursuant to Section RSMo
43.505.3, each law enforcement agency in the state shall: (1) Submit crime
incident reports to the department of public safety on forms or in the format
prescribed by the department; and (2) Submit any other crime incident
information which may be required by the department of public safety. Law
enforcement agencies will be considered non-compliant if they have not
submitted MIBRS reports for three or more months in the previous twelve
months.
b. Section 590.650 RSMo - Vehicle Stops Report: Pursuant to Section 590.650.3
RSMo, each law enforcement agency shall compile the data described in

subsection 2 for the calendar year into a report to the attorney general and each
law enforcement agency shall submit the report to the attorney general no later
than March first of the following calendar year.
c. Section 590.1265 RSMo - Police Use of Force Transparency Act of 2021:
Pursuant to Section 590.1265 RSMo each law enforcement agency shall report
data submitted under subsection 3 of this section to the department of public
safety. Law enforcement agencies will be considered non-compliant if they have
not submitted Use of Force reports for three or more months in the previous
twelve months.
d. Section 43.544 RSMo - Written Policy on Forwarding Intoxication-Related Traffic
Offenses: Pursuant to Section 43.544.1 RSMo, each law enforcement agency
shall adopt a policy requiring arrest information for all intoxication-related traffic
offenses be forwarded to the central repository as required by Section 43.503
RSMo.
e. Section 590.030 RSMo - Rap Back Program Participation: Pursuant to Section
590.030 RSMo, all law enforcement agencies shall enroll in the state and federal
Rap Back programs on or before January 1, 2022, and continue to remain
enrolled. The law enforcement agency shall take all necessary steps to maintain
officer enrollment for all officers commissioned with that agency in the Rap Back
programs. An officer shall submit to being fingerprinted at any law enforcement
agency upon commissioning and for as long as the officer is commissioned with
that agency.
f.

Section 590.700 RSMo - Custodial Interrogations: Pursuant to Section 590.700.4
RSMo, each law enforcement agency shall adopt a written policy to record
custodial interrogations of persons suspected of committing or attempting to
commit felony crimes as outlined in subsection 2.

28. License Plate Readers (LPRs): Agencies purchasing license plate reader (LPR) equipment and
technology with grant funds administered by the Missouri Department of Public Safety, must adhere to
the following requirements:
a. LPR vendors chosen by an agency must have an MOU on file with the MSHP

information necessary to provide a NCIC and/or MULES hit when used in conjunction
with a License Plate Reader (LPR) device. An MOU must be on file with the Access
Integrity Unit (AIU) for the vendor and the law enforcement agency and a registration
process must be completed.

Agency shall have a license plate reader policy and operation guideline prior to the
implementation of LPRs. Reimbursements will not be made on the project until the
policy has been provided to the Missouri Department of Public Safety.

29. Lobbying: The recipient understands and agrees that state funds cannot be used, either directly or
indirectly, to support or oppose the enactment, repeal, modification or adoption of any law, regulation,
or policy, at any level of government.
30. Missouri Office of Homeland Security, Division of Grants Administrative Guide: To follow the
grant program guidelines as stated in the Missouri Office of Homeland Security, Division of Grants,
Administrative Guide for Homeland Security Grants, as well as Information Bulletins released by the
DPS/OHS to provide important updates, clarifications and policy statements related to DPS/OHS
Grant programs.
31. Monitoring: The recipient agrees to maintain the records necessary to evaluate the effectiveness
of the project. In addition, the recipient assures that all documentation or records relating to this
award shall be made available to monitoring representatives of the DPS/OHS, the Office of
Missouri State Auditor, or any of their authorized representatives immediately upon request. The
recipient assures that fund accounting, auditing, monitoring, and such evaluation procedures as
may be necessary to keep such records as the DPS/OHS shall prescribe, will be provided to assure
fiscal control, proper management, and efficient disbursement of funds received under this award.
32. Non-Disclosure Agreements: The recipient assures that it will not prohibit or otherwise restrict, or
purport to prohibit or restrict, the reporting (in accordance with law) of waste, fraud, or abuse to the
DPS/OHS or other agency authorized to receive such information.

b. Certifies that, if it learns or is notified that it is or has been requiring its employees or
contractors to exercise agreements or statements that prohibit or otherwise restrict
(or purport to prohibit or restrict), reporting of waste, fraud, or abuse as described
above, it will immediately stop any further obligations of award funds, will provide
prompt written notification to the DPS/OHS, and will resume (or permit resumption of)
such obligations only if expressly authorized to do so by the DPS/OHS.
33. Non-Supplanting: The recipient assures that state funds made available under this award will not
be used to supplant other federal, state, or local funds but will be used to increase the amount of
funds that would, in the absence of these funds, be made available for the activities of this project.
34. Procurement: The recipient assures that all procurement transactions whether negotiated or
competitively bid and without regard to dollar value shall be conducted in a manner to provide
maximum open and free competition. In addition, the recipient assures that all procurement
transactions will meet the minimum standards set forth in the “DPS Financial and Administrative
Guidelines” and identified here:
a. All quotations and the rationale behind the selection of a source of supply shall
be retained, attached to the purchase order copy, and placed in the accounting
files.
b. Purchases to a single vendor totaling less than $10,000 may be purchased with
prudence on the open market.
c. Purchases estimated to total between $10,000 but less than $100.000 to a single
vendor, must be competitively bid, but need not be solicited by mail or advertisement.
d. Purchases with an estimated total of $100,000 or over to a single vendor shall be
advertised for bids in at least two daily newspapers of general circulation in such
places as are most likely to reach prospective bidders at least five days before bids
for such purchases are to be opened.
e. Where only one bid or positive proposal is received, it is deemed to be sole source
procurement.
f.

Sole source procurement on purchases to a single vendor of $10,000 and over
requires prior approval from the DPS/OHS.

35. Reimbursement: Expenditures shall be in accordance with the approved budget and documentation in
the form of paid bills and vouchers shall support each expenditure. Care shall be given to assure that
all items purchased directly relate to the specific project objectives for which the award was approved.
36. Relationship: The recipient agrees that it will represent itself to be an independent recipient
offering such services to the public and shall not represent itself or its employees to be employees
of the DPS/OHS. (This provision is not applicable to the DPS/OHS or any of its divisions or
programs.) Therefore, the recipient shall assume all legal and financial responsibility for taxes,

37. Release of Funds: The recipient acknowledges no funds will be disbursed under this award until
such time as all required documents are signed by the recipient Authorized Official and returned to
the Missouri Department of Public Safety for final review and signature by the Director or his/her
designee.
38. Reporting Potential Fraud, Waste, and Abuse: The recipient shall not make false statements or
claims in connection with any funds awarded by the DPS/OHS. The result of such false statements
or claims includes fines, imprisonment, and debarment from participating in state and federal grants
or contracts, and/or other remedy by law. The recipient must promptly refer to the DPS/OHS any
credible evidence that a principal, employee, agent, recipient, contractor, subcontractor, or any
other person has, in connection with funds under this award, either:
(a) Submitted a claim that violates the False Claims Act; or
(b) Committed a criminal or civil violation of laws pertaining to fraud, conflict of interest,
bribery, gratuity, or similar misconduct.

giving written notice to the recipient of the effective date of suspension or termination. In the event of
termination pursuant to this paragraph, all documents, data, and reports prepared by the recipient
under the award shall, at the option of the DPS/OHS, become property of the State of Missouri.
In the event an award is suspended or permanently terminated, the DPS/OHS may take action as
deemed appropriate to recover any portion of the award funds, remaining or an amount equal to the
portion of the award funds wrongfully used.
42. Texting While Driving: The DPS/OHS encourages the recipient to adopt and enforce policies
banning employees from text messaging while driving any vehicle during the course of performing
work funded by this award, and to establish workplace safety policies and conduct education,
awareness, and other outreach to decrease crashes caused by distracted drivers.
43. Unlawful Employment Practices: The recipient assures compliance with Section 213.055 RSMo,
in regard to non-discrimination in employment practices as it relates to race, color, religion, national
origin, sex, ancestry, age, or disability.

Introduction:

The Missouri Department of Public Safety is pleased to announce the funding opportunity for the
SFY 2027 Missouri Blue Shield Grant Program (MBSGP). These state administered funds are
appropriated through Missouri House Bill No. 8 and are subject to request and approval each
fiscal year.
Program Description:

The Missouri Department of Public Safety (DPS) collaborates with local law enforcement
agencies to provide a proactive approach for the public safety of Missourians. The purpose of the
MBSGP is to provide funding to support the Missouri Blue Shield Program. This program is a
collaborative initiative in Missouri that brings communities together to support the law
enforcement agencies that serve and protect our cities and towns. This program acknowledges
local governments for their commitment to supporting local law enforcement efforts.
Period of Performance: 8.5 months

Projected Period of Performance Start Date: September 1, 2026
Projected Period of Performance End Date: May 15, 2027

Maximum Award: Each eligible Missouri Blue Shield Program applicant will receive
$28,985.50 for the purchase of equipment, training, and/or technology for their law enforcement
agency.

Allowable Costs:

The Missouri Department of Public Safety’s objective in awarding funding is to support local
efforts to enhance public safety, foster law enforcement support, and encourage community
partnerships. This opportunity will allow for the purchase of equipment, training, and/or
technology for law enforcement agencies. The Missouri Blue Shield Program is a
reimbursement grant. Recipients must incur an allowable expense, make payment and seek
reimbursement from the Missouri Department of Public Safety.

The Missouri Department of Public Safety understands in certain situations local cash flow
makes payment for equipment, supplies and training difficult. To help alleviate this situation,
DPS has agreed to accept requests for funds from recipients as soon as a vendor submits their
invoice, and the recipient has received goods or services. Consequently, the recipient does not
have to pay the vendor before submitting the claim for reimbursement.

Some items have additional requirements to be eligible for funding. Allowable items with
additional requirements are detailed below:

Mobile Data Terminals (MDT’s)/Mobile Data Computers (MDC’s)
Agencies seeking funding for mobile data terminals should research the type of computer
being requested. The Missouri Department of Public Safety is aware that non-ruggedized
laptops and tablets are typically not durable enough for road patrol purposes and
therefore not the best use of funds.

Interoperability Equipment (Portables/Handhelds, Mobiles, Repeaters, Base
Stations, etc.)

Investments in emergency communications systems and equipment must meet applicable
SAFECOM Guidance. All radios must meet the Missouri Department of Public Safety,
Office of the Director, DPS Grants Radio Interoperability Guidelines. The Missouri

Interoperability Center (MIC) will review all communications equipment applications to
ensure they comply with the Radio Interoperability Guidelines. Interoperability
equipment that does not meet these £uidelines will not be eligible for fundine.

NOTE: Agencies seeking any t\ pe of radio or radio-related accessory are
encouraged to contact the .Missouri Interoperability Center by phone at (855)
4-.MOSWIN or by email at moswin.svsadminrtf dps.mo.gov to ensure the
appropriate communication devices are purchased for the department’s
needs and location to the nearest MOSWIN tower and to ensure the

appropriate administrative requirements are met as it relates to the
MOSWIN. The Missouri Interoperability Center staff can also provide
helpful information regarding the department’s ability to access the
.MOSWIN and how to articulate such within the grant application.

Body-Worn Cameras

Agencies seeking funding for Body-Wom Cameras (BWCs) must have policies and
procedures in place related to equipment usage, data storage and access, privacy
considerations, and training. Recipients of funding for Body-Wom cameras must supply
the Missouri Department of Public Safety with a copy of such policy(s) and procedure(s)
at the time of claim submission.

Body Armor

Funds may be used to purchase body armor at any threat level designation, make, or
model from any distributor or manufacturer, as long as the body armor has been tested
and found to comply with the latest applicable National Institute of Justice (NIJ) ballistic
or stab standards, which can be found online at

Body armor or armor vests must also be “uniquely fitted vests” which means protective
(ballistic or stab-resistant) armor vests that conform to the individual wearer to provide
the best possible fit and coverage, through a combination of
(1) Correctly sized panels and carrier, determined through appropriate measurement and
(2) Properly adjusted straps, harnesses, fasteners, flaps, or other adjustable features.
The requirement that body armor be “uniquely fitted” does not require body armor that is
individually manufactured based on the measurements of an individual wearer.

In addition, body armor purchased must be made in the United States.

Agencies seeking funding for body armor are required to have a written “mandatory
wear” policy in effect. There are no requirements regarding the nature of the policy other
than it being a mandatory wear policy for all uniformed officers while on duty.
Recipients of funding for body armor must supply the Missouri Department of Public
Safety with a copy of such policy at the time of claim submission.
License Plate Readers (LPR)

Agencies purchasing license plate reader (LPR) equipment and technology with grant
funds administered by the Missouri Department of Public Safety, must adhere to the
following requirements:
a. LPR vendors chosen by an agency must have an MOU on file with the MSHP Central
Vendor File as developed and prescribed by the Missouri Department of Public Safety
pursuant to 11 CSR 30-17.

b. Prior to purchasing LPR services, the agency should verify the vendor’s MOU status

PURPOSE:
The purpose of this Agenda Item is to seek approval from the City Council to move forward with
the addition of 3 personnel to the Neosho Fire Department.
BACKGROUND:
During the budget discussions in July, three additional Fire Department personnel positions were included in the
budget with the understanding that they would be hired following the sale of the utilities.
I am requesting authorization to hire these three personnel with an effective start date of September 21.
The proposed hire date is necessary to ensure the new employees are adequately prepared to attend the Fire
Training Academy in Joplin, which begins on October 5. Hiring them on September 21 will provide sufficient time
to complete the following prerequisites before academy attendance:
• Two weeks of in-house department training
• Human Resources onboarding and training
• Required check rides
• Completion of employment paperwork and administrative requirements
• Introduction to department policies, procedures, and operational expectations
Providing this preparation period will help ensure the new hires are successful at the academy and fully prepared for
their assigned duties.
Additionally, upon successful completion of the academy and certification testing, these firefighters will be able to
transition directly onto shift assignments, allowing the department to realize the operational benefits of these
positions as quickly as possible.
